A dying woman is asking the B.C. Supreme Court to fast track her lawsuit so she can have a doctorassisted suicide, reopening a debate that was last famously battled in the courts almost 20 years ago. Lawyer Joe Arvay told the court the lawsuit must be heard quickly so Gloria Taylor can exercise her “constitutional right” to a doctor-assisted suicide. Taylor’s request is one of two cases that has resurrected the right-to-die argument that was thought settled by Canada’s highest court in the 1993 Sue Rodriguez case. Arvay, who is also acting on behalf of the B.C. Civil Liberties Association, wants a trial date this year because Taylor – who suffers from ALS or Lou Gehrig’s disease – is getting worse. “We have a dying woman who wants to exercise her constitutional right to die with dignity,” Arvay told reporters outside the court. “The only way that’s going to happen is if the trial is heard in November, because her situation is urgent.” Donaree Nygard, the lawyer for the Attorney General of Canada, called Arvay’s tight schedule “unworkable” and said it wasn’t possible to rush a case that is this complex. They are challenging a law that protects a large number of people, Nygard told the court. “Protection from the ultimate threat that they be euthanized against their true wishes,” she said. “The rights of those people is incredibly important. This trial should not be rushed.”
This week marks the one-year anniversary of the shooting death of Langley resident Alvin Wright, who died after he was shot by an RCMP officer during an Aug. 6, 2010 confrontation inside his bedroom. It was marked by Vancouver lawyer Donald Sorochan yesterday with the announcement the family has just filed a lawsuit against six unnamed RCMP officers. Sorochan provided reporters with copies of the B.C. Supreme Court statement of claim that had been filed a few minutes earlier in the Vancouver court registry across the street from his Howe Street office. The lawsuit seeks unspecified compensation from six unnamed RCMP officers, four men and two women and their superiors, for the alleged wrongful death of Wright, the false imprisonment of his spouse Heather Hannon and the infliction of mental distress on her following the shooting. Lawyer Donald Sorochan has launched a wrongful death lawsuit against the RCMP officers involved in the 2010 death of 22-year-old Alvin Wright of Langley. the 22-year-old Wright lived with his common-law wife and their infant daughter. According to the lawyer, police were called after Wright and his spouse got into a heated argument and he ordered her out of the house. She wanted help getting some of her possessions from the baby’s room. “There were no threats or acts of violence,” Sorochan said. “At no point did Heather express any concern for her safety.” When Hannon managed to get
in the house ahead of police while Wright was sleeping, she phoned the RCMP again and was told to leave the house. Despite that, several officers went inside and entered the bedroom where Wright was sleeping. Witnesses heard a single gunshot. Wright was wounded in the stomach and was taken to hospital where he was declared dead the next day. Police arrested Hannon at the scene and refused to let her contact a lawyer. Claims made in the civil lawsuit have yet to be proven in court.

B.C.’s total population continues to grow, reaching more than 4.5 million as of April 1. But for the first quarterly period since 2003, the number of people moving to other provinces exceeded those moving from other provinces into B.C. The net loss was only 98 people, with 12,598 people moving to B.C. and 12,696 moving out in the first three months of the year. B.C. experienced consistent net loss through interprovincial migration from 1997 to 2003, an often-cited statistic in B.C. political debates about the effect of NDP government policies in the province during the 1990s. B.C. saw its largest net loss of 893 people to Alberta, with 6,704 people going east and 5,811 moving west in the first three months of 2011. A Tamil asylum seeker who arrived in Canada aboard the MV Sun Sea last year has been ordered deported on allegations he committed a war crime in Sri Lanka. The Centre for Addictions Research B.C. is launching Canada’s first study into the risk of smoking pot and driving. For the next five years, blood samples will be taken from anyone in a vehicle accident, so long as a blood sample is required for treatment. The driver’s identification will be wiped from the record before the blood samples are tested for THC – the active ingredient in cannabis. The probe could have the same effect on pot and driving that previous studies of alcohol’s role in car crashes had on drunk driving laws, the group says.

Chilliwack motorists are being asked to watch for toads crossing in the Ryder Lake area. The annual migration of the Western toad has begun, say members of the Fraser Valley Conservancy. Periodic road closures on Ryder Lake Road and Elk View Road can be expected, as volunteers gingerly scoop mostly juveniles into buckets and shuttle them across the road between now and mid-August. It’s the fourth year the blue-listed toads have received a helping hand in this co-operative and conservation-minded way. Council adopted the conservancy group’s request for the road closures in June, and has helped coordinate the event and minimize residents’ inconvenience
during the closures. Now that summer is underway many juvenile toadlets will be killed on the roads as they are impossible to see from behind the wheel by motorists. Other populations affected by vehicle traffic include redlegged frogs, Pacific tree frog, rough skinned newts, and Northwestern salamanders. The timing of the migratory event is determined by climactic and biological factors. Fraser Valley Conservancy has received support for this project from the Goverment of Canada’s Habitat Stewardship Program for Species at Risk, Fraser Salmon and Watershed Program, TD Friends of the Environment, Kids for Ryder Lake, Ryder Lake Farmer’s Institute and the City of Chilliwack.

The remains of 13 Inuit removed from northern Labrador as part of a research project in the 1970s will be returned to an island in Saglek Bay later this month. Premier Kathy Dunderdale plans to be on hand for the special reburial ceremony Aug. 16 on Rose Island. The remains of 113 Inuit were removed from two islands as part of research conducted by Memorial University in St. John’s more than 30 years ago. Most of the remains were returned to Rose Island in 1995, but some of remains were left behind by mistake.

The United Nations says the southern African country of Zimbabwe needs more than $480 million this year in food, health and humanitarian aid. Alain Noudehou, the UN humanitarian co-ordinator in the capital, Harare, said yesterday that an estimated 1.4 million people still need food handouts because of crop failures, erratic rain and other economic pressures affecting daily incomes. In a mid-year aid review, Noudehou said international donor funding was also needed to help tens of thousands of Zimbabweans facing expulsion from neighbouring South Africa.
An Italian parliamentary commission approved a draft law yesterday banning women from wearing veils that cover their faces in public. The draft passed by the constitutional affairs commission would prohibit women from wearing a burka, niqab or any other garb that covers the face in such circumstances. Third parties who force women to cover their faces in public would be fined 30,000 euros or about $41,000 Cdn, and face up to 12 months in jail. The draft will be forwarded to parliament after the summer recess.
French authorities have agreed to extradite former Panamanian strongman Manuel Noriega to his native Panama, his lawyer said yesterday. Yves Leberquier said French Prime Minister Francois Fillon signed the extradition on July 6 and that Noriega was notified last week. It was not immediately clear when Noriega would be sent home. Noriega was imprisoned in the United States for two decades after being deposed in a 1989 U.S. invasion. He was sent from Florida to France last year to face money laundering charges, where he was sentenced to 7 years in prison.
A North Korean defector and 25 advocacy groups are urging nations to protest Pyongyang’s chairmanship of the world’s only multilateral forum for nuclear arms diplomacy. Former North Korean army captain Kim Joo-il, a defector now living in Britain, says the regime is using the 65-nation Conference on Disarmament to fuel its anti-Western domestic propaganda and sway even skeptical North Koreans. The attorney for a Somali man accused of being the highest ranking pirate the U.S. has ever prosecuted wants the piracy charge against him dismissed because he didn’t commit robbery at sea. Mohammad Saaili Shibin is charged with piracy, kidnapping and weapons charges for his role in the hijacking of a yacht off the coast of Africa that left all four Americans onboard dead. Prosecutors say Shibin never boarded the yacht Quest, but operated from land in Somalia to determine how much money the hostages could be ransomed for once they were brought to Somalia. Shibin attorney James Broccoletti wrote in a court filing Monday that merely communicating with those who boarded the Quest doesn’t constitute piracy. “This count should be dismissed because under no set of facts was the offence of ‘piracy’ committed,” he wrote. The government hasn’t filed a response yet and the U.S. Attorney’s Office declined to comment yesterday. This is the third case in which the definition of piracy has come under scrutiny. What constitutes piracy is being contested in two other cases involving attacks on the USS Nicholas and the USS Ashland.

For years, Harry Potter author J.K. Rowling and her family had honoured a French ancestor who they believed was a hero. But the author has now discovered that her family had been mistaken about the true identity of her great-grandfather. Rowling has recorded a television program with the BBC that shows her coming to terms with the revelation that her family had confused Louis Volant, a war hero awarded with the Legion d’honneur for his bravery during the Battle of Verdun, with her real great-grandfather, who had the same name and also fought for France. Rowling told the Radio Times that the experience was an upsetting and emotional one. She said taking part in her genealogy research made her so emotional that she cried several times. “There were a lot of big surprises, some wonderful, and one ... upsetting,” she said. “However, I went into the program wanting the truth, no matter what it was, because I knew so little about my French ancestry, and I don’t regret a moment of it. I loved the whole experience,” she added. The BBC show, called Who Do You Think You Are? will be broadcast this month.

Andy Serkis has emerged as a master of the art of creating characters in the digital realm of performance capture. He’s been the backbone of the great ape in King Kong and Gollum in The Lord of the Rings, creatures that are completed by visual-effects artists layering computer animation over his performance. Serkis has become best-known for his performance-capture characters, which now include a chimpanzee in the Apes prequel, opening Friday, along with a key part in this December’s The Adventures of Tintin, from Steven Spielberg and Kong and Lord of the Rings creator Peter Jackson. Vancouver Canuck centre Ryan Kesler has undergone hip surgery, the NHL team said in a release yesterday. The Selke Trophy winner is expected to make a full recovery in 10-to-12 weeks. Kesler needed the operation to repair his labrum,
which is a type of cartilage that surrounds the socket of ball-and-socket joints. It helps to provide stability to the joint while allowing flexibility and motion. “After consultation with our team physicians following the playoffs, it was deemed that Ryan would require a procedure on his hip,” GM Mike Gillis said in a release. “We expect a full recovery and determined this procedure would best serve both Ryan and the team’s long-term goals.” Kesler had a career-high 41 goals and added 32 assists in 82 games with the Canucks last year. In 25 playoff games he added seven goals and 12 assists.

When he steps onto the Rogers Centre turf Thursday night, Anthony Calvillo’s top priority will be getting the Montreal Alouettes back on track. After starting the season with three straight wins, the defending Grey Cup champions have lost two straight heading into their road game against Toronto. The Argonauts (1-4), though, are struggling as well. Barring injury, Calvillo will take down another of Damon Allen’s CFL records. He needs just nine completions to break Allen’s all-time mark of 5,158. Earlier this season, Calvillo broke Allen’s CFL record of 394 career TD passes and is on pace this year to eclipse Allen’s all-time passing yards mark of Anthony Calvillo 72,381 and become the most prolific passer in pro football history. Toronto, at least, will counter with its starter in the lineup as Cleo Lemon returns. He missed the Argos’ heart-breaking 26-25 road loss in Edmonton on Friday night due to an exposed nerve in a tooth that was cracked the previous week against Winnipeg. Dalton Bell got the start against Edmonton and finished 17-of-29 passing for 156 yards and two interceptions. Lemon was injured after being hit by Winnipeg’s Joe Lobendahn following a 14-yard run. He opened that contest impressively, leading Toronto on an opening touchdown march and completing all five passes he attempted.

A day after voters soundly defeated a $400-million US referendum for a new hockey arena, a New York official is asking for new ideas to develop the 31-hectare parcel. County executive Edward Mangano backed the referendum as a way to keep the New York Islanders from moving out of the Nassau Veterans Memorial Coliseum. The team’s lease expires in 2015. Mangano said yesterday that he welcomes Islanders owner Charles Wang – or anyone else – to submit a proposal for the property. Wang failed in an earlier attempt to privately develop the land. According to unofficial election results, the referendum failed by a 57 to 43 per cent margin. An Islanders spokeswoman says Wang has no comment. He has said the team will honour its lease.

Organizers want to go beyond Earth to celebrate the 50th anniversary of Seattle’s iconic Space Needle. On Monday, they announced a multi-tiered contest to send a member of the public on a short ride into space using a company from the burgeoning space travel industry. “The private business of taking people to space is right in front of us,â€? said Ron Sevart, president and CEO of the PaciďŹ c Northwest landmark. “It felt so natural for us to build a contest around that.â€? The trip to space offered through the contest by private Virginia-based ďŹ rm Space Adventures would be a suborbital shot, with about six minutes of zero gravity. The total ight, from takeoff to landing, would last about 30 minutes, with the pilot-less rocket taking two passengers to a height of 100 km. People interested can sign up to enter at the Space Needle’s website through the end of December. After the entry period, a computer will randomly choose 1,000 people who will be asked to submit a one-minute video. Following the video, the public, via a vote, will whittle down the number of contestants. A ďŹ tness challenge will be set up for the top vote-getters before a panel makes a ďŹ nal selection. The winner will be announced in April 2012.
