Garrett “Rocky” Burnett was best known as an NHL enforcer during his brief hockey league stint, but his reputation didn’t protect him during a bar room brawl that put him on life support. Now, the B.C. government is suing more than 30 people, including Delta’s police chief, to recover what it spent on Burnett’s lengthy hospitalization and recovery. The B.C. Supreme Court lawsuit, filed Aug. 9, said Burnett was smashed over the head with a bar stool, injuring his brain, putting him in a coma and on life support. Delta Police Chief Jim Cessford was named as the person responsible for the two investigating officers, Paul Uppal and Lorne Pike, who the lawsuit said failed to safeguard evidence like video surveillance. “He subsequently failed to conduct a full and thorough investigation of the assault and failed to keep any adequate record of such investigation,” the lawsuit said of Uppal. The fight happened on Boxing Day, 2006 at the Cheers Nightclub inside the North Delta Inn. The lawsuit lists the owner of the inn, a dozen of its employees and 10 unknown patrons as additional defendants. The suit alleges the bar owner and its employees failed to make sure Burnett would be safe, didn’t properly alert emergency responders after the assault and didn’t have a proper system for monitoring alcohol consumption. The allegations have not been proven in court. Burnett played 39 games for the Anaheim Ducks in the 2003-2004 season. The lawsuit doesn’t specify a dollar figure for the health costs.

The B.C. government’s plan to appoint a municipal auditorgeneral has raised concerns in local government circles, but the minister responsible says it won’t mean the province is going to start telling local councils how to tax and spend money. Community, Sport and Cultural Development Minister Ida Chong met with the executive of the Union of B.C. Municipalities in late July to discuss the plan. According to a summary sent by the UBCM to its member councils, the UBCM executive complained about the lack of consultation and asked Chong if local councils’ policy decisions would be exempt from a municipal auditor’s authority, as they are in other jurisdictions. Chong said in an interview yesterday that B.C.’s municipal auditor won’t overrule local governments, but “performance audits” would highlight areas where communities can save money. The service will beneﬁt the 160 local governments in B.C., especially the smaller ones, she said. “More than half of our municipalities have populations under 5,000,” Chong said. “They don’t have the capacity to do value-for-

money audits or performance audits.” Smaller communities also receive unconditional grants from the province, and a municipal auditor-general would check whether they are spent effectively. All municipalities get federal and provincial cost-sharing grants for major projects, and an auditorgeneral could compare a group of communities to see which ones are more efﬁcient.

Premier Christy Clark promised a municipal auditor general while running for the B.C. Liberal leadership. Her platform promised to expand the provincial auditor-general’s ofﬁce to include a municipal auditor, and to “review the municipal taxation formula.” Chong said municipal tax rates wouldn’t be the ﬁrst priority, but a municipal auditor general may choose to compare rates and their effect on industrial development.

Mission police are hunting for two males who invaded a Silverdale home Sunday, mistakenly believing it contained a grow-op. The pair of masked suspects, one of whom was armed, entered the Silverdale Avenue home at 2 p.m. Aug. 7 and demanded to be shown the pot. When they couldn’t ﬁnd any, the men told the victims not to call police and left. The residents were not hurt. Police are asking anyone who saw any suspicious people or vehicles in the area to call them at 604-826-7161, or anonymously at 1-800-222-8477.

DOG RESCUED AFTER ENDURING BROILING VEHICLE KAMLOOPS (Canadian Press)

A dog is recovering in Kamloops, and the B.C. SPCA is investigating after ﬁnding the pet inside a vehicle parked in 31 degree heat. Special Const. Kent Kakoska says by the time rescuers had managed to release the dog Tuesday afternoon, the temperature in the direct sun inside the vehicle had topped 54 degrees Celsius. Kakoska describes the car as a blast furnace. He says the dog was in obvious distress, panting heavily and appearing to need immediate attention.

Negotiations are continuing in an attempt to avert a strike among B.C.’s 15,000 community social service workers. Workers are in a position to strike at any time, but Oliver Rohlfs of the B.C. Government and Service Employees Union says the two sides resumed negotiations on Tuesday. The union is looking for improved working conditions and job security after the workers’ contract expired in March 2010.

PICKTON INQUIRY ADDS INDEPENDENT LAWYERS VANCOUVER (Canadian Press)

The public inquiry into the Robert Pickton case has appointed two independent lawyers to represent the interests of aboriginal women and residents of Vancouver’s Downtown Eastside, an attempt to pacify a number of community groups that plan to boycott the hearings. The appointments come as a growing list of advocacy groups that were granted participant status at the inquiry vow to skip the hearings because they were denied provincial government funding. The pair of lawyers appointed yesterday won’t represent any speciﬁc client, but a news release said they will take guidance from the groups that have been granted participant status.

The lawyers are former B.C. Civil Liberties Association president Jason Gratl, and Robyn Gervais, who has previously represented the Carrier Sekani Tribal Council. Gervais will also have the help of two additional lawyers working pro bono. Commissioner Wally Oppal recommended 13 participants receive public funding to pay for lawyers at the inquiry, but the provincial government only approved funding for relatives of Pickton’s victims. Some of the groups that were denied funding have already said they won’t use the independent lawyers because they feel the lawyers won’t be able to properly represent their interests. So far, more than half of the community groups that were granted status have either formally withdrawn or announced plans to do so.

Public health officers will take a hard look at any health risks posed if Metro Vancouver builds a new garbage incinerator. B.C. chief medical health officer Dr. Perry Kendall supports the planned public health impact assessment even though he doubts a modern waste-to-energy plant would pose a significant threat to the public. “Concerns have been expressed,” he said, adding it’s “useful, necessary and good practice” to study the issue. A health risk review could be 18 months away, after an expected call for bids in 2012.

A 24-year-old man has been charged with second degree murder in connection with the stabbing death of his mother in Burnaby on Monday evening. RCMP responded to several emergency calls to the 6700 block of Elwell Street about 6:30 p.m., said police spokesman Sgt. Peter Thiessen in a press release. Ofﬁcers found a 45-year-old woman with many cuts and stab wounds lying on the street. Jose Tomajin was taken to hospital but died several hours later.

PUBLIC INQUIRY URGED INTO LEAKED CSIS DOCS MONTREAL (Canadian Press)

Adil Charkaoui and his supporters are calling for a public inquiry into leaked documents that accuse him of plotting to blow up an airliner. A Montreal newspaper said last week it had obtained a CSIS report that alleges Charkaoui discussed the plot with Abousﬁan Abdelrazik. Abdelrazik is another Montrealer suspected of being a terrorist. Charkaoui says the allegations are false and represent a threat to his security.

Police have arrested two teenage girls in the death of a Manitoba woman who was found decapitated along a road. The girls, who are 15 and 17, are charged with manslaughter in the death of Roberta McIvor on the Sandy Bay reserve. RCMP will only say McIvor was sleeping in her vehicle July 30 when thieves broke in and removed her. The Mounties say McIvor, who was 32, was fatally injured as the vehicle drove away.

Winnipeg is dealing with a sharp rise in the number of deliberately set ﬁres this summer. Police say there were 78 cases of arson in July – double the number in the same month last year. Const. The latest ﬁres, set early yesterday, included one in a garage that caused $100,000 in damage and a smaller blaze at a community centre.

Pakistan handed a key suspect in the 2002 Bali bombings over to Indonesian authorities yesterday, more than six months after he was captured in the country’s northwest, Pakistani ofﬁcials said. Umar Patek allegedly built the bombs used in the suicide attacks on Bali nightclubs that killed 202 people, many of them Australian tourists. The top UN envoy in Somalia is warning that warlords will fill the vacuum created by the departure of al-Shabab Islamist fighters from the capital unless the government takes immediate action to promote law and order. Augustine Mahiga told the UN Security Council in a briefing from Mogadishu yesterday that al-Shabab’s unexpected withdrawal from the city presents the first opportunity in years for the transitional government to exercise authority over the capital. A UN food agency says that cereal prices in famine-stricken East Africa reached new peaks in several countries last month, adding to an already dramatic situation for millions of hungry people. The United Nations estimates that tens of thousands of people have died from malnutrition in Somalia in recent months. Over 11 million people across East Africa need food aid because of a long-running drought. The high prices are the result of a combination of factors, including poor harvests because of the drought and sharp increases in fuel and transport costs, the agency said.

Afghanistan’s president issued a decree yesterday stating that the country’s courts do not have the power to alter election results, appearing to bow to pressure to resolve an impasse over the parliament’s legitimacy that threatened to create a constitutional crisis. The Afghan parliament has been in limbo after a special court in June called for the removal of 62 sitting lawmakers, saying they won their seats through fraud. The dispute hamstrung the country’s already tumultuous Hamid Karzai political system, with the courts, the president and legislature all claiming the right to make the final ruling about last year’s messy elections. Afghanistan’s September 2010 ballot was plagued by irregularities and voter intimidation. Norwegian investigators increasingly believe the man who confessed to killing 77 people in last month’s attacks planned and committed them on his own, a prosecutor said yesterday. Anders Behring Breivik detonated a bomb in Oslo on July 22, killing eight people, followed by a massacre at a youth camp where he shot dead 69 others. There was initial speculation that others were involved in the attack, but prosecutor Christian Hatlo said that after 40 hours of questioning, police are fairly certain Breivik acted alone and that he appears to be telling the truth. Hatlo said police have been able to verify much of what Breivik told them about the attacks, and that they had not discovered “any direct lie, yet.” “That is also why we, with a certain conﬁdence, can say that he was alone, but I have to emphasize that we have not concluded yet,” Hatlo said. Investigators searched his computer and cellphone records for any signs of contact with other extremists who may have helped or inﬂuenced him. Law enforcement agencies in other countries have assisted Norway, including in the U.S., where authorities interviewed Breivik’s sister.

Concert movies typically offer a peek into the private moments of a pop star’s life. Michael Jackson: This Is It revealed the entertainer’s perfectionist tendencies, and sly sense of humour. Justin Bieber: Never Say Never showed the teen singer’s drive for success. But Glee: The 3D Concert Movie, opening tomorrow, is an 83-minute romp with the fictional characters who populate the Fox TV series. It’s multi-purposing at its finest: stars Lea Michele, Cory Monteith, Kevin McHale, Chris Colfer, Amber Riley, Heather Morris and the rest maintain their Glee personae while performing hits from the show during the concert tour that traversed the U.S. earlier this summer. And that’s what sets it up for success, says director Kevin Tancharoen. “It would have been completely disconnected from what made (the show) extremely popular if it had turned into, ‘Oh, look at Lea Michele and Cory Monteith and Harry Shum Jr. be superstars and rehearse and do press and record and go on tour,’” Tancharoen said. “That’s why I think it’s different from those other concert films,” he continued. “Those are all rock stars and musicians, and these are characters who mean something different to everybody else. They are extremely talented and they all sing very well and perform very well, and that’s another big part of the

show that was very popular, so we kind of wanted to mix all that stuff together to make this 3D concert experience.” In addition to on-stage performances of songs such as Teenage Dream and I’m a Slave 4 U, the ﬁlm also shows its stars giving backstage interviews in character. “I feel like I did a nice blend of Rachel and of Lea while I was onstage performing,” Michele said Saturday. “We are our characters, but at the same time when we walk on stage, we are ourselves.”

They’re cancelling or forgoing cable and satellite TV subscriptions in record numbers, according to an analysis by The Associated Press of the companies’ quarterly earnings reports. In a tally by the AP, eight of the nine largest subscription-TV providers in the U.S. lost 195,700 subscribers in the April-to-June quarter. That’s the ﬁrst quarterly loss for the group, which serves about 70 per cent of households. The loss amounts to 0.2 per cent of their 83.2 million video subscribers. The chief cause appears to be persistently high unemployment and a housing market that has many people living with their parents, reducing the need for a separate cable bill.

A French luxury shoemaker has lost a round in its New York court battle against a rival it claims unfairly copied its line of women’s shoes with red soles. A federal judge has denied Louboutin’s request for a preliminary injunction. The parties have been ordered back to court next week. Brett Lawrie of Langley hit a grand slam in Toronto’s five-run sixth inning to vault the Blue Jays into the lead as they defeated the Oakland Athletics 8-4 last night. It was the second homer of his five-game majorleague career. The 21-year-old third baseman played his first game for Toronto (59-57) last Friday in Baltimore. Lawrie now has six RBIs since being called up from triple-A Las Vegas. In Lawrie’s next at-bat he lined a double off the left-field fence for a double with one out in the eighth. As he slid in to second the crowd chanted “Lawrie, Lawrie.” The Canadian then scored on a single by Rajai Davis. Lawrie was 2-for-4 on the night, and is hitting .389 (7-for-18) over his five-game career. After Lawrie scored, Yunel Escobar was hit by a pitch from left-hander Jordan Norberto and the benches cleared briefly. Order was restored quickly. Oakland (52-64) picked up a run in the ninth when Josh Willingham hit his 19th homer of the season against reliever Jesse Litsch. Reliever Casey Janssen (4-0) picked up the win, while Listch picked up his first career save.

Henderson Alvarez , called up from double-A New Hampshire, lasted 5 and 2/3 innings in his major-league debut. The 21-year-old pitcher allowed three runs and eight hits. Left-hander Gio Gonzalez (9-10) took a 3-1 lead into the sixth but left with the bases loaded with none out for left-handed reliever Craig Breslow. Gonzalez had filled the bases after Adam Lind’s double and walks to Edwin Encarnacion and Colby Rasmus. Before Rasmus walked, he missed a bunt and Lind was caught off second, but catcher Kurt Suzuki’s throw went into centre field for an error to put runners at second and third. Aaron Hill singled in a run with the bases still loaded. That set the stage for Lawrie’s grand slam. The rookie smashed a 2-0 90-m.p.h. fastball over the left-field fence to put the Blue Jays into a 6-3 lead. Lawrie had to wave from the dugout when the crowd chanted his name after the grand slam. Earlier in the day, the Blue Jays were defending themselves to the media after an ESPN story suggested Toronto was stealing signs. The article was based off complaints from four players on an opposing team and suggested Toronto used someone in the stands to send signs to Jays hitters about pitches in April of 2010. “I’ve been in the organization for a long time, this is my second year as a GM,” general manager Alex Anthopoulos said before the game. “I’ve never gotten a phone call, e-mail, or a text, nothing relating to this. It’s never come up, ever.”

Another big name has fallen at the Rogers Cup. World No. 2 Rafael Nadal was ousted in three sets after a long and spectacular match against Croatia’s Ivan Dodig yesterday. After the ﬁrst set, Nadal looked to be coasting to a convincing win, but Dodig came back to eliminate the Spanish star 1-6, 7-6 (5), 7-6 (5), in a match that lasted three hours eight minutes. “This is the greatest moment of my life,” said Dodig following the surprising victory. Dodig also thanked the Montreal fans, who cheered him for much of the match. The upset comes one day Rafael Nadal after fourth seed and two-time defending champion Andy Murray was sent packing after a 6-3, 6-1 loss to South Africa’s Kevin Anderson. Also yesterday, defending champ Caroline Wozniacki crashed out of the Rogers Cup women’s draw in Toronto. The top-ranked Dane was shocked by Roberta Vinci 6-4, 7-5. Wozniacki, who has won a WTA-leading ﬁve titles this year, was up 5-1 in the second set and looking to rally from a set down. However, the No. 22-ranked Italian stormed back with three break points to complete the upset.

MONTREAL COPS FINISH CHARA PROBE MONTREAL (Canadian Press)

A police investigation into Boston Bruins captain Zdeno Chara has been completed and the file has been transferred, as per standard procedure, to criminal prosecutors. Now that the investigation is over Crown lawyers must decide whether to lay charges over Chara’s devastating hit against Montreal Canadiens forward Max Pacioretty. Montreal police had held off interviewing Chara during the spring, while his Bruins were on their Stanley Cup-winning run. Investigators finally questioned him last month. Authorities in Quebec got involved in the file last March, amid a public outcry after the NHL announced it would not suspend Chara for smashing his opponent into a stanchion. Pacioretty has recovered from a cracked vertebra and concussion, and is expected to return to action next season. Before the hit, the Habs forward had been involved in a series of skirmishes with Chara in an increasingly bitter rivalry. Pacioretty later said he was disgusted by the league’s failure to suspend him, but also added that he disagreed with the decision for law-enforcement to get involved.

Swiss watchmaker Tag Heuer has ended its 10-year commercial relationship with Tiger Woods, and expressed hopes the former topranked golfer can “overcome his difﬁculties.” Tag Heuer had stopped promoting Woods’s image in the United States in 2009, weeks after revelations about his marital problems emerged.

Libyan state television broadcast images yesterday of a man it said was Moammar Gadhafi’s youngest son in an attempt to refute rebel claims that he had been killed in a NATO air strike. Rebels claimed on Friday that 27-year-old Khamis Gadhafi, who commands one of the best trained and equipped units in the Libyan military, was killed in the western front-line town of Zlitan. The regime dismissed the claim and said the rebels were only trying to deflect attention from the killing last week of the opposition’s military commander, possibly by other rebels. The images on television showed the son at a Tripoli hospital visiting people wounded in a NATO air strike and said it was on Tuesday. If genuine, it would be the first time he has been seen in public since the reports of his death. The Libyan revolt that began in February has sunk into a deep stalemate in the past few months, with the rebels holding on to most of the eastern half of the country that they captured early on and Gadhafi’s regime controlling most of the west. Neither side has been able to tip the balance into an outright victory.

The streets of Hama were deserted yesterday and the city in central Syria that has come to symbolize defiance against the regime appeared to be under full government control after last week’s brutal crackdown on protesters. To the east, troops seized control of another flashpoint city, Deir el-Zour, after four days of intense shelling and gunfire. The government took journalists on a tour to see a rare glimpse of Hama, a city of 800,000 which has seen some of the largest anti-government protests of the 5-month-old uprising. About 50 armoured personnel carriers were placed on flatbed trucks heading out of the city after a week-long military assault that the government said was aimed at rooting out “terrorists.” The government blames the unrest in Syria on foreign extremists, a claim dismissed by most observers. Turkish Prime Minister Recep Tayyip Erdogan also said his ambassador reported that tanks and security forces had begun to withdraw from Hama. “Let’s hope that this develop-
