A right-to-die organization can’t challenge Canada’s law barring assisted suicide because its plaintiffs are anonymous, a B.C. judge ruled yesterday, but the group still hopes to intervene in a competing case scheduled to be heard in the fall. The Farewell Foundation launched a lawsuit on behalf of four anonymous people who want help ending their lives, arguing the Criminal Code section dealing with assisted suicide violates the Charter of Rights and Freedoms. B.C. Supreme Court Judge Lynn Smith ruled the group doesn’t have standing because the plaintiffs were anonymous, but she recommended the Farewell Foundation apply to intervene in a separate case about to head to trial, said foundation spokesman Russel Ogden. “We felt that it was important that people who are in states of serious suffering be able to attend to their personal health circumstances rather than become the standard bearers for the right-to-die movement,” Ogden said in an interview. “We will be applying to intervene (in the other case), and we will be applying to lead evidence in that.” Sheila Tucker, one of the lawyers in the case that will be heard in November, said it’s too early to say whether her clients will support the Farewell Foundation’s application for intervener status. “We’ll really have to wait and see what the nature of their actual application is. All we know is that they intend to apply, but not on what terms.”

Vancouver Police Chief Jim Chu says charges against Stanley Cup rioters can’t be rushed into court without risk of weakening the ensuing prosecutions. He spoke out yesterday, defending the more than two-month wait so far for charges to be laid in the June 15 crime spree that saw mobs torch cars and loot dozens of stores downtown. “If we rush cases to court, we risk losing them by being ineffective and inefficient,” Chu told reporters. “If you are in favour of speed, you are in favour of more acquittals and lighter sentences.” The chief sought to calm public demands for faster action – especially after hundreds of rioters in Britain were quickly rounded up and charged within days of much more severe civil unrest. “It will take months before all the evidence is processed and we are ready to make arrests,” he said, adding he shares the public’s

Lower Mainland berry pickers and other harvesters are being promised a provincial review of minimum wages for farm work won’t leave them earning less than they do now. More than 10,000 pickers are paid piece-work rates based on how much they harvest. Charan Gill, spokesman for Progressive Intercultural Community Services Society, said it appears the province ordered the review in response to complaints of farmers and contractors after indications the minimum piece rates would rise in lockstep with a series of planned increases in B.C.’s minimum wage. “I have no faith they will be fair to the workers,” Gill said, adding the consultant Victoria has hired speaks no Punjabi and therefore won’t get a fair sense of most harvesters’ concerns. A labour ministry spokesman said the review may guide any further increases in the piece rates but reducing them is “not under consideration.” Minimum pay rates for pickers range from 16 cents per pound for Brussels sprouts to 40 cents for blueberries, while tree fruit
fetches $17 to $20 per large bin. Those rates climbed 9.4 per cent in May at the same time B.C.’s minimum wage rose to $8.75 an hour. Gill said the rates typically work out to the equivalent of $4 or $5 an hour. “We are saying there should be a living wage for the farm workers,” he said. Gill argues the province should eliminate piece rates entirely in favour of hourly wages. That would also help reform the
current system, which critics say is rife with abuse of workers and corrupt accounting practices. Farm contractors routinely pay pickers at piece rates but then convert the amounts to hourly pay on the books as if minimum wages had been paid. That lets companies record an artificially low number of hours and avoid violating employment standards when pickers work long hours during harvest season.

An 18-year-old Mission male was killed Tuesday after he was hit by a boat while tubing at night on Osoyoos Lake. Three males, all 18, were being pulled on a tube behind a 20-foot Bay Karavan Bowrider when they were struck by the bow of a 15-foot Stingray. The owner/operator of the Stingray, a 27-year-old Alberta man, is in custody and under investigation for dangerous operation of a vessel causing death. Alcohol is being investigated as a possible factor in the incident.

A 46-year-old Union Bay man is in custody on numerous counts. Comox Valley RCMP responded Tuesday to a call of two men fighting along Highway 19A in Union Bay. It was later discovered that a 72-year-old man had stopped to help a younger man who was parked by the side of the road with his hazard lights activated. The 72-year-old was attacked and his vehicle stolen. A hitchhiker subsequently assaulted Nanaimo RCMP members. Kenneth Karl Slezak is scheduled to appear in court today.

When it comes to robbery, size matters. In a scene reminiscent of the movie Crocodile Dundee, a would-be robber with a knife met his match Monday night when he tried to rob a West Kelowna pizza shop. In the movie, a mugger produces a knife only to learn his victim carries a bigger one. According to police, the same thing happened during a robbery attempt at a pizza restaurant in the 1,700-block of Ross Road. The robbery was foiled after the suspect brandished a knife and the store employee
brandished a bigger one. RCMP Const. Steve Holmes said the incident happened at just after 10:30 p.m. when a man, wearing a black jacket and with his face disguised, produced a knife and pointed it at the cash register indicating a demand for cash. The employee stood away from the cash register and picked up a large pizza knife and told the suspect no. The suspect then asked for a small amount of money instead but left when the employee again refused. A police dog team was called in and followed a track from the restaurant south to a nearby RV park where the track ended. Police are still searching for the suspect. Holmes said while police do not advocate anyone putting themselves at risk in this way, fortunately, no one was injured.

An Abbotsford woman is lucky to have suffered only minor scrapes and bruises after she awakened in a trash compactor that had been activated. The woman had fallen asleep in the compactor behind a Value Village thrift store. She was jolted awake at about 10 a.m. yesterday by the movement of garbage as it was pushed to the back of the compactor. Abbotsford Fire Rescue Service members were called to the scene and pulled her out. The trash had apparently been compacted twice before the machine was turned off.

A ten month investigation has cleared three Prince George Mounties of various assault allegations. An internal review by members of the Kelowna RCMP’s independent professional standards unit has found no basis to a woman’s claims that she was assaulted and sexually assaulted during an arrest in Prince George. An investigation began after the woman claimed she was beaten, drugged and sexually assaulted following her arrest at a house party.

Environmentalists say a deal to renew Alberta-Pacific Forest Industries’s tenure over a vast tract of Alberta wilderness was reached quietly, without measures to protect endangered caribou herds. And the Alberta Wilderness Association says the deal, dated last month, gives the company more control over the provincially owned forests than the provincial government. They say the deal doesn’t appear to have any new protected areas, despite advice from biologists that caribou will die out in the region without better habitat conservation.

Statistics Canada says Canada’s labour force continues to grow but retiring baby boomers will slow the rate of growth to a crawl over the next 20 years. By 2031, the agency estimates there could be as many as 22.5 million people working, compared to 18.5 million last year. But while in 1981 there were six people working for each retiree, by 2031 the ratio will be three to one. By that year, the agency also projects that the participation rate in the labour force could be less than 63 per cent of Canadians over the age of 15.

A Winnipeg man who volunteered with Scouts Canada for 14 years has been accused of sexually exploiting a teenage boy. Scouts Canada has conformed that Stuart Garrett Young, who is 39, was suspended from the organization following a police investigation. Young is charged in the sexual exploitation and sexual assault of a teenager between May 2009 and May of this year. Scouts Canada said Young, like all volunteers, underwent security checks every three years, most recently in 2009.

Statistics Canada research suggests rates of childhood obesity in the country are inaccurate as they most often rely on data from parents. A determination of obesity is based on a height/weight ratio, so when one of the data sets is wrong, it can skew the results. The study found that on average, parents underestimated their child’s height by 3.3 cm and weight by 2.4 pounds. It also found that many kids whose weight was under-reported were in fact obese, while those whose height was under-reported were wrongly classified as obese.

A river in Idaho has finally run out of toilet paper. State officials say crews finished removing massive rolls of unprocessed toilet paper that fell off a truck and were lodged for weeks in the upper Lochsa River. Earlier attempts to pull out the paper was called off when it began disintegrating, creating an even bigger mess. Teams yanked out the remnants last weekend when lower river flows made the work more manageable. The rolls landed in the water after the truck hauling the load along U.S. Highway 12 slid into the river. The driver was cited for inattentive driving.
Former Soviet leader Mikhail Gorbachev has criticized the government for taking Russia backward and said the nation needs free elections and a fresh leadership. Gorbachev was speaking yesterday ahead of the 20th anniversary of the Aug. 19, 1991, coup that briefly ousted him and precipitated the collapse of the Soviet Union. Gorbachev criticized the United Russia party led by Prime Minister Vladimir Putin, which he described as a bad copy of the Soviet Communist Party. A U.S. tourist detained in Aruba over the presumed death of his travel companion had an insurance policy that covered the missing woman, a prosecutor said yesterday. Gary Giordano mentioned the insurance during questioning, but authorities haven’t determined whether it is relevant to their investigation into Robyn Gardner’s death, Solicitor General Taco Stein said. The policy included both travellers, but it wasn’t clear whether it covered Gardner’s accidental death, Stein said. Nor was it clear who was the beneficiary. “If you travel, you take out insurance. That’s not an uncommon thing, to say the least,” Stein said. “It all depends on what’s in the policy.” Giordano, a businessman from Gaithersburg, Maryland, travelled to Aruba with Gardner on July 31 and reported her missing two days later, saying she disappeared while the two were snorkeling. He assisted the search but was detained as he tried to leave the country because of questions about his account of what happened. A judge ruled Monday that there is enough evidence to hold him for at least 16 more days on suspicion of involvement in Gardner’s presumed death.

Bravo isn’t saying what might happen to the second season of The Real Housewives of Beverly Hills following the unexpected death of Russell Armstrong, estranged husband of cast member Taylor Armstrong. The couple’s marital troubles were part of the drama on the first season of the reality show, which follows the lavish lifestyles of six women living in the posh neighbourhood. Their problems were to remain part of the plot of season two, set to premiere Sept. 5. Russell Armstrong, 47, an investment banker and venture capitalist, was found dead Monday night. Los Angeles County officials said no suicide note was found. Armstrong appeared on several episodes during the show’s first season, accompanying wife Taylor to various events. Taylor Armstrong often discussed the couple’s relationship on the show, and fellow housewife Kyle Richards said that would continue in season two. Richards said in an interview last week that viewers could expect to see “Taylor’s situation, just seeing that unravel, and it’s a very emotional subject; a very difficult subject.”

When you get right down to it, Jeff Bridges’ new self-titled album got its start more than 30 years ago on the set of Heaven’s Gate. The now legendary six-month shoot threw the actor, whose hobby was guitar-slinging, together with a bunch of musicians, including Kris Kristofferson and one of Kristofferson’s players – a young T Bone Burnett. “That was it, that was when we became friends,” Bridges said of Burnett. “We stayed friends over the years. We haven’t spent that much time together. We’re both busy guys. But you know how it is with people that you click with. You just pick up where you left off.” And when the two got back together on the 2009 film Crazy Heart, the click was audible. The collaboration led to Academy Awards for each and some of the best work of their respective careers. “Jeffrey’s exactly the same as he was then, only more so,” Burnett said. “His spirit has not wavered in all these years. He’s remained very true to whichever muse he’s following. Maybe all of them.
Maybe he follows all the muses. Maybe that’s one of the keys to Jeffrey.” For the new album, Burnett brought in his old standbys, players like guitarist Marc Ribot, and guests like Rosanne Cash, Sam Phillips and Ryan Bingham, who

co-wrote the Oscar-winning The Weary Kind (Theme from Crazy Heart) with Burnett. Bridges and Burnett sorted through more than 60 songs and recorded 17 over 12 days. Some of the 10 tracks that made the album were leftovers from Crazy Heart. Bridges wrote two of the songs on the album and co-wrote a third with Burnett and Crazy Heart author Thomas Cobb. Burnett, one of today’s most influential producers with a distinctive sound, says he was careful to keep the focus on how Bridges wanted the music. And while Bridges says recording music is a lot like playing a part, a picture of the actor emerges through the songs he chose. It’s an introspective album, subtly psychedelic with shades of rock and country. It is not an album of acid-tinged lounge music by The Dude, Bridges’ iconic character from The Big Lebowski – though Bridges says, “I think the Dude would dig this album.” And it’s not a slab of outlaw country a la his Crazy Heart alter ego Bad Blake. Cleo Lemon has a tough act to follow – his own. Although the Toronto Argonauts are riding a six-game losing streak, Lemon comes into tonight’s contest at Rogers Centre against the Saskatchewan Roughriders having registered consecutive 300-yard passing performances for the first time in his 1 1/2year CFL tenure. What’s more, Lemon was a stellar 26-of-36 passing for a career-high 368 yards and three TDs in Toronto’s 37-32 road loss to Hamilton on Saturday with no interceptions. “I feel a lot more comfortable with the system, all my teammates and everyone doing their job and getting into their roles,” Lemon said. “But I’m a confident player, I approach every game feeling I’m going to go out and do my job. “I’ve never lacked that. Sometimes, though, you just don’t get the results you want.” Lemon, 32, has been a lightning rod for criticism throughout his CFL tenure. Last season, Lemon sported a solid 61.7 per cent completion average but had more interceptions (19) than touchdowns (15) while Toronto had the league’s worst passing attack (221.1 yards per game).
But solid defence and opportunistic special teams helped lead Toronto to the East Division final before succumbing to the eventual Grey Cup-champion Montreal Alouettes. When head coach/GM Jim Barker held his season-ending meeting with Lemon, he told the veteran he’d again be competing for the No. 1 job in training camp. Lemon reclaimed the starting position. Barker has a simple explanation for Lemon’s turnaround: a heart-to-heart talk the two had before facing Winnipeg when Barker issued Lemon an ultimatum. “I don’t know, when I told him that if his play didn’t pick up he was done,” Barker said, drawing chuckles from the gathered media. “It kind of clicked in a hurry and he had the best quarter of football he’d ever had.” Lemon is second among CFL starters in passing completion, his 65.1 per cent mark behind only Edmonton’s Ricky Ray (66 per cent). Lemon has thrown for 1,410 yards and has seven TDs against just three interceptions. “Cleo has taken a lot of heat for his numbers ... but he is managing the game very well,” Barker said. “He has had back-to-back 300-yard games, can he do that on a continual basis? There are 27 potential changes being looked at during the NHL’s research and development camp and it’s possible that not a single one will ever make its way into the league. The same can’t be said of the players who are serving as guinea pigs this week. Even NHL executive Brendan Shanahan, who is in charge of the camp, harbours no illusions about why roughly half of the league’s 30 general managers interrupted their summer vacation to attend. “The truth is that we coax a lot of them here with the 36 best 17-year-olds in North America,” Shanahan said yesterday. “It’s sort of once we get them under the roof, as they’re scouting these kids, they get trapped into a conversation about hockey and the future of the game. “It’s funny – I think there are some guys that are passionate about the rules and the game, but I think most are here to see the players.” The stands were packed at the Toronto Maple Leafs practice facility for the camp’s first two sessions yesterday. The attendees included a number of scouts with next to no interest in the modified icing and faceoff rules, among many other things, on display. NHL commissioner Gary Bettman expects the league to review its substance abuse and behavioural health program following the death of two players over the summer. Winnipeg Jets forward Rick Rypien and New York Rangers tough guy Derek Boogaard both spent time in the program, which is run in conjunction with the NHL Players’ Association. “My guess is we’ll talk at the appropriate time with the players’ association, making sure that we’re comfortable with all of the mechanisms and programs we have in place, which are extensive,” Bettman said yesterday at the league’s research and development camp. “I don’t think any sports league does more than we do but maybe there’s more, as we focus on it, that we need to focus on. I know it’s always hard for people to accept, but sports is a microcosm of society in general. “And life isn’t always easy.”

A young chemistry student working as a volunteer to prepare a visit by the pope to Madrid has been arrested on suspicion of planning a gas attack targeting protesters opposed to the pontiff’s stay, officials said yesterday. Pope Benedict XVI is due to arrive today for a nearly four-day visit to celebrate World Youth Day, and a protest march was scheduled for last night in Madrid. A police official said the suspect arrested in the capital on Tuesday is a 24-year-old Mexican student specializing in organic chemistry. She would not say whether investigators believe the man was actually capable of carrying out a gas attack, and did not know if the man actually had chemicals for one. He was arrested at a Madrid convention centre where the hundreds of thousands of pilgrims coming to town for the papal visit are supposed to pick up their accreditation, the police official said on condition of anonymity in line with the department’s rules. An official with the visit’s organizing committee said the Mexican was a volunteer working to help deal with the massive flow of people coming to Madrid.
The indictment reveals details of the investigation into a case that has consumed Lebanon for six years, sparked political turmoil in the country and led to fears of renewed violence. Prosecutors analyzed a vast network of telephone records to link four Hezbollah members to the assassination of former Lebanese Prime Minister Rafik Hariri, but there is no clear smoking gun in the case, according to an indictment unsealed yesterday. The UN-backed special court investigating Hariri’s murder published the 47-page indictment against four members of the Iranian-backed Shiite militia Hezbollah for alleged involvement in the deadly truck bombing that killed Hariri in 2005. The publication comes after the Special Tribunal for Lebanon said last week that Lebanese authorities had been unable to arrest the four suspects or serve them with their indictments. Hezbollah, Lebanon’s most powerful political and military force, has denied involvement and said it will never turn over the suspects. Still, the suspects could be tried in absentia. Former Prime Minister Saad Hariri, the son of the late leader, urged Hezbollah’s leader to hand over the suspects and co-operate with the tribunal.
