Politicians and business owners are nervously awaiting the outcome of B.C.’s harmonized sales tax referendum, to be revealed shortly before noon today. Premier Christy Clark is braced for rejection of the HST, when Elections BC releases the official count of more than 1.6 million ballots mailed in from around the province this summer. Clark’s government has been working long hours to prepare what she calls “plan B” for returning the province to its former provincial sales tax if a majority of people vote to end the HST. If that happens, one of the first tasks that would fall to the B.C. government would be opening negotiations with the federal government on repaying a $1.6 billion transition fund paid to the province since the adoption of the HST in 2010. A provincial sales tax administration and audit centre would also have to be re-established, and businesses across the province would have to change their cash registers and accounting systems for the second time in two years. If the HST survives the referendum, B.C. will send out transition payments of $175 for each child under 18 and lower-income senior in the province. In an effort to persuade voters to keep the HST, Clark and Finance Minister Kevin Falcon have also committed to reduce the rate from 12 per cent to 11 per cent next year and 10 per cent in 2014. If the HST is rejected, Falcon has kept his options open to change some of the exemptions to the former PST. But Clark said this week that her government will carry out the will of the people as expressed in the referendum.

The father accused of pimping out his daughter in Penticton is facing additional charges, while three other men face charges for allegedly receiving sexual services from her. “The three men have been arrested in relation to an ongoing investigation involving the procurement of a youth for sexual purpose,” said Cpl. Annie Linteau. “Numerous charges have now been laid against the father who was allegedly making his daughter available to these men for sexual purposes.” RCMP did not release the names of the three men – aged 34, 63 and 67 – pending charge approval. In May, RCMP received information that a young girl was being sexually victimized. Her 46-year-old father was arrested on July 22 and Crown counsel has since added charges for a total of three counts of assault, two counts of sexual interference, two counts of living on the avails of prostitution, one count of sexual exploitation and one count of a parent or guardian procuring sexual activity. The man remains in custody and will

The 67-year-old man said he was a client of the juvenile for about eight weeks but argues that he was told she was of legal age. Wolfe said he expected some backlash since he came forward publicly about the potential charge that carries a minimum sentence of six months and up to five years of jail time. In fact, the mutterings of passersby strolling in front of City Hall this week did not go ignored by Wolfe, who was there to pick up nomination papers for the November election. “I have had three threats against my life and I have had to report to the police on three different occasions,” said Wolfe, standing on the steps of City Hall. “I also had a lady at the Farmers’ Market basically challenge me, and I said look at the paper, read the news but don’t judge me unless you have the full facts. Let the courts hear the evidence, then after all the evidence has been heard and the judge has ruled, then you can criticize me, if there is any at all.”

It might have looked funny, but Richmond Mounties said it was no joke when a local man tried to squeeze a full-sized fridge into the trunk of his family sedan. It was a hazardous situation call, one that no doubt prompted raised eyebrows, if not dropped jaws and fits of laughter. Richmond RCMP Cpl. Sherrdean Turley said that on Aug. 8, around noon, an RCMP constable was dispatched to Liquidation World on the 3000 block of Sexsmith Road. The report was that someone had loaded a full-sized refrigerator into the trunk of his car. “The fridge was one third in the trunk while the remainder teetered over the edge of the car’s bumper. The fridge was secured to the vehicle using rope and the seatbelts from the back seat,” RCMP Const. Justin Stewart said. When Stewart approached the driver and asked him if what he was doing was a good idea, the driver replied that he thought it was okay. Stewart then explained that the load was unsafe for transport and how dangerous his actions were. The driver apologized, removed the fridge and arranged proper transportation.

A fisheries scientist says she believes senior officials close to the prime minister prevented her from talking to the media about her research into the 2009 sockeye salmon collapse in B.C. Kristi Miller told a federal inquiry yesterday that she learned about the gag order only through the inquiry and believes officials with the Department of Firsheries and Oceans were OK with her giving interviews about the publication of her article in the journal Science. “I learned only through the inquiry process that the decision of not allowing me to speak to the press after the Science paper came out of the Privy Council Office and not from DFO,” she said. Miller testified she believes it would have been useful to speak to the media after the article’s publica-

tion to let them know what scientists knew and didn’t know and she found it frustrating to see the direction some news stories went. The federal government did not dispute Miller’s suggestion that it was the Privy Council Office, which serves the prime minister, that refused to allow Miller to talk to media. “Dr. Miller’s testimony was thorough, extensive and speaks for itself,” said Dimitri Soudas, communications director at the Prime Minister’s Office in an email. “Her study and transcripts of her testimony is publicly available.” The inquiry heard Tuesday that Miller is working on trying to figure out whether the parvovirus is linked to the Fraser River sockeye collapse. The virus has never before been found in fish and her work is considered groundbreaking.

Abbotsford Police have reported that the body found on Wednesday morning is that of a 15-year-old male who fell to his death. He was discovered by a cyclist at 5:30 a.m. in the parking lot of the Sevenoaks Shopping Centre. A medical examination has determined that the cause of death was the result of a fall. When first discovered, Cost. Ian MacDonald said police administered chest compressions and first aid, but “it was apparent that the person was deceased.”

The casket of NDP leader Jack Layton arrives at Toronto’s City Hall last night. The journey to Toronto took place along a stretch of highway now famous for the solemn vigils that would spring up every time a member of the Canadian Forces was killed in Afghanistan. This time, however, they were on hand to salute a political soldier. “It’s becoming a thing, this highway,” said 58-year-old Don Rayment of Kingston, Ont., one of about 60 people gathered on an overpass to watch Layton’s hearse pass by. “I think it’s a good thing that we do this. It shows our humanity and it helps us experience our humanity, to sort of exercise it, to see the best in other people and to join them.” Layton’s flag-draped coffin spent nearly two days in the Commons foyer – a familiar haunt for the NDP leader, who would habitually bound out of the Commons after question period to speak to journalists at the very same spot. Layton will lie in repose at Toronto’s City Hall before a state funeral tomorrow at Roy Thomson Hall.

A Canadian-born man was killed in Libya this week as he fought to free his ancestral home from the regime of Moammar Gadhafi. A friend says Nader Ben Raween was shot by a sniper as he stormed Gadhafi’s compound on Tuesday. He was 24. Haitham Alabadleh says Ben Raween was born in Edmonton but had family living in Tripoli, the Libyan capital. He says Ben Raween had lived and worked in Ottawa for three years before deciding to return to Libya to offer support to rebel forces.

VERMONT SAYS ‘BIENVENUE’ TO CANADIAN TOURISTS MONTREAL (Canadian Press)

Vermont, long known for its small-town charm and friendly people, is sending a message to its neighbours to the north: Canadians are “bienvenue.” Burlington city council has unanimously passed a non-binding resolution encouraging local businesses to put up more French signs and to get their employees to learn the language. A strong Canadian dollar has meant more tourists than ever are flocking south of the border. Canadians already make up nearly 20 per cent of visitors to the state.

The Supreme Court of Canada says it won’t review the sentences of two men who pleaded guilty to manslaughter in the shooting deaths of four Alberta RCMP officers. Dennis Cheeseman and Shawn Hennessey admitted they gave gunman James Roszko a rifle and a ride back to his farm the night before he ambushed four Mounties near Mayerthorpe in 2005. Hennessey was sentenced to 15 years in prison, while Cheeseman got 12 years.

DARE LEADS TO BREAK-IN AT QUEBEC HELLS ANGEL BUNKER SHERBROOKE, Que. (Canadian Press)

Just because the Hells Angels aren’t home doesn’t mean no one is minding the bunker. Two Quebec men, acting on a dare, found that out the hard way when they triggered an alarm at a fortified bunker in Sherbrooke on Wednesday night. Provincial police monitoring the bunker’s video surveillance system contacted their Sherbrooke counterparts who found the men inside. Sherbrooke police said the men, aged 18 and 22, were apparently coaxed by friends into entering the vacant complex, southeast of Montreal.

CLOUD, FOG AND RAIN GREETED RESOLUTE PLANE RESOLUTE, Nunavut (Canadian Press)

An initial report by the Transportation Safety Board says there was cloud, fog and light rain when a chartered jet crashed into a hill while on approach to land at the Resolute airport. Twelve people died in the crash, three survived. The report is the first confirmation of what the weather was like Saturday when First Air flight 6560 crashed 1.6 kilometres from the airport’s runway. No cause of the crash has been determined, but investigators have recovered the plane’s black boxes from the wreckage.

The UN human rights envoy to Myanmar says at the end of his visit to the country its new government should release all political prisoners. Myanmar installed a nominally civilian government in March but still holds more than 2,000 political prisoners. Envoy Tomas Ojea Quintana thanked the government for allowing his visit and access to government ministers and opposition leaders. He spoke in Yangon yesterday after meeting with democracy icon Aung San Suu Kyi a day earlier. He said the government has taken some positive steps but concerns such as torture and ethnic tensions remain.

Russian helicopters searched yesterday for the wreckage of the unmanned spaceship that crashed and exploded in a forested area in Siberia. The supply ship was launched from the Baikonur cosmodrome in Kazakhstan about 1,500 kilometres southwest of the crash site. It fell after the third stage of its booster rocket failed a few minutes into Wednesday’s launch, in the Choisky district in Russia’s Altai province. It was the 44th launch of a Progress supply ship to the space station – and the first failure in the nearly 13-year life of the complex.

African leaders have pledged nearly $380 million to help famine-hit families in the Horn of Africa. During a donor conference held yesterday at the African Union headquarters in Ethiopia’s capital, the African Development Bank in a statement announced a donation of $300 million for long-term development in the Horn of Africa, to be spent by 2013. Nations also pledged $28.8 million in food donations. African leaders promised to donate $51 million, the most generous donors being Algeria with $10 million, Egypt with $6 million, and Angola with $5 million.

North Korean leader Kim Jong Il left Russia aboard his armoured train yesterday, crossing into Manchuria in China’s northeast a day after pushing for a return to discussions on his country’s nuclear program. Kim Jong Il’s train – a present to his father from Soviet dictator Josef Stalin – has been remodeled and refurbished with luxurious interior and satellite communications since Soviet times. Kim has a fear of flying, and uses the train extensively. North Korea is pushing to restart the sixsided talks that involve both Koreas, the United States, China, Russia and Japan.

China is replacing Tibet’s hard-line Communist Party boss under whom bloody rioting broke out in the Himalayan region three years ago. The official Xinhua News Agency says Zhang Qingli, the region’s highest-ranking official, is being moved to another position which it did not identify. It says he will be replaced by Chen Quanguo, a longtime party official in the eastern province of Henan who last served as governor of Hebei province surrounding Beijing. Like all of Tibet’s party chiefs, Chen is not Tibetan but a member of China’s majority Han ethnic group.

One thousand rebels bombarded buildings filled with regime fighters hiding amid civilians in a ferocious battle yestserday for Moammar Gadhafi’s last major stronghold in Tripoli. The Libyan leader, still in hiding, sent a new message calling on his supporters to kill the rebels. The bullet-ridden bodies of three Gadhafi soldiers in military uniforms lay on the ground outside a fire station in the battle-scarred Abu-Salim neighbourhood and a few bodies of rebel soldiers were wrapped in blankets nearby. The battles raged for at least four hours, then stopped at sundown. Abu Salim, which is adjacent to Gadhafi’s Bab al-Aziziya compound seized by rebels on Tuesday, is thought to be the last major hotbed of regime brigades in Tripoli. After hours of fierce fighting, Associated Press reporters at the scene said rebels were making progress pushing them out. Many of the

fighters are believed to have moved to Abu Salim from Bab al-Aziziya after the compound was captured and ransacked. “Don’t leave Tripoli for the rats. Fight them, fight them, and kill them,” Gadhafi said in audio message broadcast on Al-Rai television. “It is the time for martyrdom or victory,” he said, calling tribes outside the capital “to continue their march to Tripoli.” He said imams in mosques should call for youths to rise up “for jihad.” A regime spokesman said Gadhafi is safely in hiding and leading the battle against the rebels.

Sri Lanka’s president announced plans yesterday to lift wartime emergency laws that have curbed civil and political liberties for most of the past 30 years. More than two years have passed since the government’s victory in its bitter civil war against separatist Tamil Tiger rebels. The emergency laws, which Parliament had extended every month, had allowed the government to detain suspects without trial, displace residents from their land and set up ubiquitious military checkpoints. President Mahinda Rajapaksa told the Mahinda Rajapaksa legislature the laws were no longer needed, signalling that they would be allowed to expire by the end of next Wednesday. “Today I propose to this assembly the withdrawal of the emergency laws to enable the country to conduct its affairs through its normal laws and in a democratic manner,” Rajapaksa said. Authorities still can exercise similar powers under another law, the Prevention of Terrorism Act. But legal experts say unlike the emergency laws, PTA is inferior to fundamental rights clauses of the constitution.

Research in Motion is hoping its millions of BlackBerry Messenger-obsessed users will get just as hooked on its new service, BBM Music, and pay $5 a month to swap song recommendations and share music with friends. The program, announced yesterday, allows BlackBerry users to select 50 songs from a catalogue of millions of tracks for their own personal playlist. Those songs can also be listened to offline without an Internet connection. But the key to the program is not only in listening to the songs on your own playlist but sharing them with other BBM users – which RIM says now total more than 45 million. Research In Motion will continue to struggle in the consumer market and the resignation of Apple CEO Steve Jobs won’t give the BlackBerry maker an opportunity to recapture lost ground, analysts said yesterday. “I think that train has left the station as far as RIM having a problem because of a competitor,” said William Blair & Co. analyst Anil Doradla. Doradla noted that co-CEOs Jim Balsillie and Mike Lazaridis have “mastered the science part of it” in creating an efficient, well functioning smartphone phone for business users. “But there is a certain artistic side of it where it has to appeal to consumers, it has to awe the consumer. I think that’s one thing that they lack,” Doradla said from Chicago. Apple announced Wednesday that Jobs, 56, resigned from the CEO post, in a move that seems motivated by his ongoing, yet still unspecified

health problems. RIM has had a bumpy transition to the consumer market, losing ground to both Apple and Google’s Android operating system in the important North American market. The next generation of BlackBerry smartphones are considered critical to the Waterloo, Ont., company’s success. The phones will have the same operating system as the BlackBerry PlayBook tablet and will be more like mobile computers. Technology analyst Bill Kreher of Edward Jones said RIM will continue to struggle and its prospects will get worse before they get better, but he does hold out some hope for the new generation of BlackBerrys. “At the end of the day, the success of these companies is predicated on their ability to create compelling devices and that doesn’t change with Steve (Jobs) stepping down,” Kreher said from St.Louis, Mo.

Warren Buffett is coming to the rescue of another fallen U.S. banking giant. Buffett’s Berkshire Hathaway announced yesterday that it would invest $5 billion US in Bank of America Corp., giving a much-needed vote of confidence in the struggling bank. The bank’s stock had plunged 52 per cent in the past 12 months on concerns over the bank’s mortgage problems. Investors have also been worried that Bank of America will need to raise large amounts of capital to shore up its balance sheet. The bank had to pay $12.7 billion US earlier this year to settle lawsuits over failed mortgages. Most of the toxic mortgages came from its 2008 purchase of Countrywide Financial Corp. CEO Brian Moynihan has insisted the bank doesn’t need to raise money.

NATIONAL BANK EARNS $312M IN Q3 MONTREAL (Canadian Press)

National Bank of Canada’s profit increased 15 per cent to $312 million in its latest quarter despite a challenging environment for financial markets and margin pressure. The Montreal-based bank earned $1.84 per diluted share for the quarter ended July 31, up from $1.56 per share or $271 million a year ago. Excluding special items related to taxes and credit losses, the bank earned $293 million, up seven per cent, resulting in $1.72 per share of profit. “In this period of global economic uncertainties, the bank should benefit from its strong capital position and sound credit portfolio,” CEO Louis Vachon said in a statement yesterday. NEW SHERIFF IN NHL TOWN: SHANAHAN TORONTO (Canadian Press)

Brendan Shanahan knows exactly what he’s getting in to. Without ever overseeing a discipline hearing or handing out a suspension, the NHL’s new sheriff is already familiar with the ins and outs of hockey justice. “I played this sport, I understand the passion that’s involved,” Shanahan said during the NHL’s recent research and development camp. Shanahan assumed the sport’s most thankless position when he inherited the disciplinary duties from Colin Campbell on the eve of the Stanley Cup final. They’ll take full effect in the next few weeks with the start of the 2011-12 season. The new job is as demanding as they come. Campbell was worn out after serving 13 years in the highly scrutinized position, eventually suggesting to commissioner Gary Bettman in March that it might be time for a change. Shanahan was a natural fit to replace him. “He’s smart, he’s thoughtful, he’s passionate about the game, he was a great player and he gives us a (new) dimension,” said Bettman. “He’s played the modern game.” Not only does Shanahan plan to introduce some new elements to the job – he told Yahoo Sports recently that a video will be released following each discipline hearing to explain the decision – it will be done in a different way than his predecessor. Shanahan will continue to be based out of New York, rather than Toronto, and is expected to dole out harsher penalties.
