The failed investigations that allowed serial killer Robert Pickton to spend years murdering sex workers before his arrest shouldn’t be viewed through the prism of hindsight, lawyers for the Vancouver police and the RCMP told a public inquiry into the case yesterday.

In their opening statements, lawyers for the police agencies urged commissioner Wally Oppal to judge them based on what officers on the ground knew when they investigated reports of missing women and allegations involving Pickton, rather than measuring them against all the gruesome facts that have emerged since the serial killer’s arrest.

“It is all too easy with the benefit of hindsight to take issue with the past work done and decisions made by individuals in circumstances where they did not have all of the information that is known today,” said Cheryl Tobias, who represents the RCMP. The inquiry has already been told about a series of alleged missteps involving both police agencies.

Those errors include failing to take reports of missing women seriously; ignoring a Vancouver officer who warned there was likely a serial killer at work; failing to tell the public that a serial murderer could be at large; brushing aside tips implicating Pickton; and botching police interviews with Pickton himself.

The union that represents Air Canada’s 6,800 flight attendants accuses Labour Minister Lisa Raitt of misusing the federal labour board to block a planned strike just hours before it was set to begin.

“Minister Raitt’s attempt to use the Canadian Industrial Relations Board to circumvent the rights of our members is outrageous,” Paul Moist, president of the Canadian Union of Public Employees, said yesterday.

He issued the statement shortly before Raitt submitted two referrals to the quasi-judicial board,

ending the possibility of a legal strike until the board completes its review.

The flight attendants had planned to strike just after midnight early this morning, a move that would have disrupted travel at Canada’s biggest air carrier and affected thousands of travellers across the country and abroad. Raitt has asked the board to consider whether the Air Canada flight attendants should be considered essential workers and prevented from striking.

“Making the referral to the board suspends the right to strike,” CIRB executive director Ginette Brazeau said.

Brazeau couldn’t say how long it would take the labour board to deal with Raitt’s referral but most observers believe it won’t happen before the House of Commons resumes sitting on Monday, when back-towork legislation could be used by the government to prevent a service disruption at Canada’s largest airline.

The head of the B.C. Treaty Commission wants her mandate extended one more year to see if the federal-provincial effort to settle aboriginal land claims has a future after two decades.

Chief Commissioner Sophie Pierre’s three-year appointment is set to end next March. The former chief and administrator of the Ktunaxa-Kinbasket Tribal Council in southeastern B.C. has tried to speed up progress since her appointment in 2009, a period that saw two treaties implemented and another signed.

As the commission tabled its 19th annual report yesterday in Victoria, Pierre turned up the heat. She said treaty talks have become “just another program of government” where Ottawa in particular is holding up progress.

“We believe as a commission that with political will, with strong political direction, we could have seven treaties instead of two, right now, and we could have nine comprehensive agreements instead of the one that we have,” Pierre said.

After implementation of the Tsawwassen First Nation treaty in Metro Vancouver and the

Maa-Nulth treaty on southwestern Vancouver Island, the Yale treaty in the Fraser Canyon was ratified as the federal government launched an inquiry into the state of Fraser River salmon stocks.

That put fish negotiations on hold for all remaining treaties until the inquiry determines what fish there are to divide up.

Jerry Lampert, the federal appointee to the treaty commis-

sion, agreed with Pierre that federal negotiators have too narrow a mandate, and have to go back to Ottawa for approval of each area of agreement.

Pierre said Ottawa needs to turn its experienced negotiators loose to do their work, and take things off the table that are not going to be negotiated. If that doesn’t produce results, she said they should shut treaty negotiations down.

BC HYDRO CUTTING 300 JOBS THIS WEEK VANCOUVER (Canadian Press)

British Columbia’s power utility says it’s cutting its workforce by 300 people this week.

BC Hydro says it’s part of a workforce reduction that will see staff reduced by about 700 positions over the next three years. The utility has already cut 250 positions.

President and CEO Dave Cobb says the utility needs to keep power rates low for families and businesses.

He says BC Hydro is making changes to become a leaner and more efficient organization, too.

FRIGID WINTER FORECAST MAY MEAN MORE SNOW JEFF NAGEL (Black Press)

A moderate La Nina weather pattern is expected to bring colder-than-normal temperatures to most of B.C. Environment Canada meteorologist David Jones said that may translate into more snow in the Lower Mainland.

“I’d say it’s a good year to get snow tires,” Jones said. “But remember other outcomes are possible.”

The projection is for the 90-day temperature average over the winter to run one to two degrees colder than normal.

PARAGLIDER IN HOSPITAL AFTER 40-FOOT FALL KAMLOOPS (Kamloops This Week)

A paraglider was airlifted to hospital over the weekend after an apparent mishap near Kamloops Lake.

Emergency crews were called to an area near Savona at about 1 p.m. on Saturday for a report of a paraglider who had fallen 40 feet out of the sky.

It’s believed a wing in the man’s glider had collapsed.

He was conscious and responsive, police said, but was airlifted to hospital as a precaution.

There has been no update on his condition, age or name.

BABY’S BODY FOUND ALONG FRASER RIVER VANCOUVER (Canadian Press)

A homicide investigation has begun after a tugboat crew found a dead baby boy inside a log boom on the Fraser River in Burnaby.

John Bowles, manager of Harken Towing, said two people aboard the 11-metre Harken No. 9 discovered the boy while delivering a load of logs to a storage area on the north arm of the Fraser River about 9:30 p.m. Tuesday.

“He was floating inside a log boom, not one of the ones they were towing but one that was in the logstorage already,” said Bowles.

Sgt. Jennifer Pound of the Integrated Homicide Investigation Team said the crew wasn’t sure at first what they had found.

“They initially had thought the baby was a toy or doll of some sort,” said Pound. “And then upon a closer look they realized that it was a baby and at that point the police were called in.”

Pound said while the boy appears to be a newborn, she couldn’t give any details until an autopsy is done.

Meanwhile, she said police need to find the mother.

“I think our main message at this point is to reach out to the mother of the baby,” she said. “We know that this must have been very traumatizing for her. She needs to be medically assessed. We don’t know if she’s by herself or if she’s got support or any of those details.”

Pound asked anybody who knows anything about the boy or feels there is something suspicious about someone who has recently given birth to call the IHIT tip line.

THIEVES TAKE WAR MEMORIAL FROM MAPLE RIDGE PARK MAPLE RIDGE NEWS (Black Press)

A plaque honouring soldiers was stolen from a Maple Ridge park last week. Glued on a granite boulder near the cenotaph in Memorial Peace Park, the 12-by-22-inch bronze plate was discovered missing on Oct. 5 by a parks worker.

It listed the names of soldiers from Maple Ridge and Pitt Meadows who won awards during the First, Second and Korean wars. The parks department is now scrambling to get the plaque replaced before Remembrance Day.

RECORD LOW FOR FIRES THIS YEAR IN B.C. KAMLOOPS (Kamloops This Week)

For those who thought the summer was a bit of a downer in the weather department, it will be no surprise to learn the forest-fire season was the slowest on record for B.C. According to numbers from the province’s wildfire co-ordination centre and the Kamloops Fire Centre, there were just 623 forest fires in 2011, burning 12,210 hectares across the province. Barring any late surge in blazes, the season will prove quieter than the previous record-low in 1954, when 711 forest fires were recorded.

Canada Post workers are taking the Harper government to court in a case that could test the Conservatives’ aggressive stance on the rights of unionized labour.

The Canadian Union of Postal Workers is challenging the constitutionality of the law which forced its members back to work in June.

Britain’s government is pushing its plan to change the rules on royal succession to provide equal treatment for princes and princesses. The government says it is trying to convince every Commonwealth nation where Queen Elizabeth II is head of state to modernize succession. Under the proposed plan, the first child of Prince William and the Duchess of Cambridge would eventually become monarch – regardless of gender.

The changes would scrap a rule that puts boys ahead of their sisters in the line to the British throne and lift a ban on British monarchs marrying Catholics.

The UN Security Council has authorized the 130,000-strong NATO-led force to remain in Afghanistan for another year.

The resolution was adopted unanimously yesterday by the UN’s most powerful body.

The council expressed serious concern at ongoing terrorist and criminal activities in the country and the increase in civilian casualties.

The council called on all countries to contribute personnel, equipment and training resources to an Afghan force slated to take over security in the country at the end of 2014.

Myanmar freed an outspoken critic and a major ethnic rebel as it began releasing 6,300 convicts yesterday in its latest liberalizing move, but kept some political detainees behind bars, dampening hopes for a broader amnesty.

It was not clear how many of the country’s estimated 2,000 political detainees were included in the amnesty – one estimate said only 206 of them were freed. But the released included ailing Shan Army commander Hso Hten and comedian Zarganar, who was imprisoned after criticizing the government’s response to Cyclone Nargis in 2008.

Britain’s High Court has rejected an appeal from a community of Irish Travellers to prevent their eviction from an illegal site where they have lived for a decade.

The decision by Justice Duncan Ouseley clears the way for bailiffs to clear the contested Dale Farm site, 50 kilometres east of London.

Ouseley said yesterday that the Travelers had waited too long to challenge the eviction. Officials say the dispute stems from a planning issue – the 86 families own the land, but lack permission to pitch homes on it.

EGYPT’S ARMY DENIES SHOOTING CHRISTIAN PROTESTERS CAIRO, Egypt (Associated Press)

A military official yesterday blamed a group of Christian protesters for starting violent clashes with armed troops, saying some attacked soldiers with swords and firebombs during a Christian rally earlier this week that turned into Egypt’s worst violence since Hosni Mubarak was ousted.

Gen. Adel Emara denied the troops opened fire with live ammunition on the protesters or intentionally ran them over with armoured vehicles. The violence late Sunday left at least 26 people dead, most of whom where Christians and many of whom were crushed by vehicles or shot to death with gunfire, according to forensic reports. State media said at least three soldiers were also killed.

Emara spoke at a press conference yesterday that was clearly aimed at defending Egypt’s military rulers from the heavy criticism they have faced in the wake of the violence. He gave a detailed account of the military’s version of the events, using video footage of the events culled from state TV and independent stations. One of the images showed a protester hurling a heavy stone at soldiers inside an armoured vehicle.

Witnesses and Christian protesters have denied the demonstrators started the fighting outside Egypt’s state television building in Cairo. At the press conference, Emara did not show other videos aired on TV or posted on YouTube – one of which seems to show soldiers storming protesters who were peacefully holding speeches outside the building.

The U.S. Congress approved three free trade agreements yesterday that advocates say will boost exports, give the economy a needed lift and help put Americans back to work.

The deals with South Korea, Colombia and Panama are hailed as economic victories by President Barack Obama and most Republicans in Congress. For a brief moment, it appeared that the bickering sides would put aside their political differences in the interest of action that could help the struggling jobs market.

Still, many Democrats, traditionally wary of free trade, opposed the Colombia deal because of that country’s alleged poor labour record. Republicans also criticized Obama for waiting several years to send the pacts to Congress. They were signed during George W. Bush’s presidency.

The House also scheduled a vote on a Senate-passed bill to extend benefits under a program that helps workers whose jobs are adversely affected by foreign trade.

The deal with South Korea alone is the largest since the North American Free Trade Agreement with Mexico and Canada in 1995. The White House says together the three agreements will increase U.S. exports by $13 billion US and create tens of thousands of jobs.

RIGHTS GROUP SLAMS CELEBS FOR CHECHEN CONCERT MOSCOW (Associated Press)

An international human rights watchdog lambasted an Oscar-winning actress and other Western celebrities on Wednesday for attending a concert held on the birthday of Chechnya’s Kremlin-backed leader, who has been accused of grave rights abuses and spending taxpayers’ money on his eccentric hobbies.

The Human Rights Watch said that actress Hilary Swank, actor Jean Claude Van Damme and British violinist Vanessa Mae attended the concert in the Chechen capital, Grozny. The Oct. 5 show was held at a police-cordoned stage on Chechen leader Ramzan Kadyrov’s 35th birthday.

Human Rights Watch urged the artists to “avoid legitimizing people like” Kadyrov, who has been accused by rights groups of having orchestrated abductions, extrajudicial killings and the enforcement of sharia law in Chechnya, a Russian republic.

“Ramzan Kadyrov is linked to a grim record of abuse,” the group’s Europe and Central Asia director Huge Williamson said. “When stars get paid to turn up to party with (Kadyrov), it trivializes the suffering of countless victims of human rights abuses.”

Nicolas Cage may be happy he got to work with Nicole Kidman and reunite with director Joel Schumacher on his new thriller Trespass. Yet Cage isn’t thrilled that viewers will be able to watch the movie at home the same day it opens in a handful of theatres.

The story of a family terrorized by home intruders, Trespass debuts tomorrow for a limited theatrical run in New York City, Los Angeles, Chicago and seven other major markets. It will be available at the same time for home viewing through video on demand.

The DVD and Blu-ray release follow barely two weeks later on Nov. 1, compared with a typical window of about four months between the time most Hollywood films open in theatres and debut on home video.

It’s a business decision that will help Trespass distributor Millennium Entertainment, an independent outfit that does not have the big marketing bucks of a Hollywood studio, make the most of its

advertising dollars.

A U.S. consumer group has filed complaints against two of the largest American automakers over advertising claims that their vehicles are made in the U.S., even though they’re assembled in Canada and Mexico.

The Made in the USA Foundation says it has filed two complaints with the U.S. Federal Trade Commission against Ford and Chrysler for misleading advertising.

It targets a commercial for the Chrysler 300, assembled in Brampton, Ont. The ad contains the tag line “Imported from Detroit.”

The complaint against Ford involves an ad claiming its Fusion model is American, even though its assembled in Mexico.

The consumer advocacy group is asking the FTC to force the automakers to stop making those claims.

Long Tan’s first Major League Soccer goal gave the Vancouver Whitecaps a 2-1 victory over D.C. United yesterday.

The expansion Whitecaps, long since eliminated from the playoffs, posted their second straight victory. They improved to 6-16-10 with two games remaining in their first MLS season.

D.C. (9-11-11) suffered its third straight loss and saw its wild card playoff chances reduced with three games remaining.

Tan, the first and only Chinese-born player to play in MLS, put the Whitecaps ahead 2-0 in the 47th minute as he headed in Alain Rochat’s cross.

Camilo scored in the first minute for the Whitecaps while Brandon McDonald replied in the 58th for United.

Vancouver coach Tommy Soehn elected to go with strikers Camilo and Tan again after they were effective in a 3-0 win over an undermanned Salt Lake squad a week earlier.

Consequently, star striker Eric Hassli started the game on the bench before replacing Tan in the second half.

Hassli returned following a one-game suspension for receiving eight yellow cards on the season.

The tandem of Camilo and Tan paid off right away. After the Whitecaps brought the ball up the pitch following the opening kick-off, Tan fed Camilo in the box and the Brazilian striker beat D.C. goalkeeper Bill Hamid with a low shot just inside the post from about six yards out.

The Whitecaps will play their final road game at Dallas on Saturday and then wrap up their first season at home against Colorado on Oct. 22.

The Texas tag team of Nelson Cruz and Mike Napoli was too much for the Detroit Tigers.

Cruz made a rocket throw to keep the score tied, then hit a crushing three-run homer in the 11th inning off Jose Valverde that helped send the Rangers over the Tigers 7-3 last night for a 3-1 lead in the AL championship series. Napoli had put Texas ahead with an RBI single earlier in the 11th.

Cruz, whose grand slam in the 11th inning won Game 2, once again starred for the Rangers in a game delayed at the start for more than two hours by rain.

With Detroit runners at the corners in the eighth and the score three-all, Cruz caught Delmon Young’s fly ball to right field and made a strong peg to Napoli, the catcher, to nail Miguel Cabrera.

Napoli blooped a go-ahead single in the 11th and Cruz soon added his fourth home run of the ALCS. Cruz became the first player in major league history to hit a pair of extrainning homers in the same post-season series. Texas tries for its second consecutive AL pennant tonight, sending C.J. Wilson to the mound to face Detroit ace Justin Verlander.

Canadian Milos Raonic lost to David Ferrer for the third time this season, going down 7-5, 7-6 (7) to the third seed from Spain in the second round of the Shanghai Masters yesterday.

Raonic was beaten by Ferrer at the Australian Open and in Monte Carlo three months later. The Spaniard is ranked fifth in the world, compared

to No. 31 for the Canadian.

“I had my opportunities and came up short in both of the sets,” Raonic said. “I didn’t take care of my serve. David makes you play all the points, I wasn’t able to close it out today.”

The 20-year-old from Thornhill, Ont., is returning from July hip surgery after a fall at Wimbledon.

Tens of thousands of Syrians thronged a main square of the Syrian capital and nearby streets yesterday in a show of support for embattled President Bashar Assad, as he struggles to quell a 7-month-old uprising. Opponents charge such rallies are staged by the regime.

International pressure is building on Assad to step down over his regime’s bloody crackdown on anti-government protests. The UN says nearly 3,000 people have been killed.

Wednesday’s demonstration was intended to show that Assad still enjoys the support of many Syrians. The gathering was huge in comparison with frequent, almost daily anti-regime protests across the country since March that are often met by tear gas and gunfire from police and security forces. The uprising has yet to bring out the middle- and upper-middle classes in Damascus and Aleppo, the two economic powerhouses.

Organizers said the Damascus rally was also meant to thank Russia and China for blocking a UN Security Council resolution condemning Syria for its brutal crackdown.

Their vetoes last week drew heavy criticism from the U.S.
