The case of six children awarded almost $1 million by a court because of the failure of child protection workers to rescue them from appalling squalor should be a clanging wake-up call for change in the system, says B.C.’s children’s representative. The children, only identified by their initials, claimed in a B.C. Supreme Court lawsuit they were subjected to inadequate housing and medical attention, lack of food and violence by their parents. The government admitted liability in the case. The main question for the judge was the assessment of damages against the Crown. Five of the six children involved in the court action have some form of fetal alcohol disorder and one child testified at the trial that her mother was “always drunk.” The children’s school principal testified about making numerous calls to family services to report injuries – including a cigarette burn –and about seeing the children going through the garbage because they were hungry. Court heard that while the family came to the government’s attention in 1988, the Ministry of Children and Families didn’t permanently seize the children until 1999. B.C. Children’s Representative Mary Ellen Turpel-Lafond said yesterday, the decision sends a loud and clear message that reform and improvement in the child welfare system in B.C. must be done. “This type of decision should be a catalyst for that as well. Because we can have a million-dollar settlement, how many other cases will we have?”

The best way to protect yourself from falling objects in an earthquake is ducking under a desk or sturdy table, or crouching and protecting your head from impact until one minute after the shaking stops. Public Safety Minister Shirley Bond, Speaker Bill Barisoff, MLAs and staff interrupted the legislature session Thursday morning to demonstrate the latest strategy for responding to an earthquake. Schools, government offices and families around the province also participated. The “Great British Columbia Shakeout” is Canada’s largest earthquake exercise, with more than 500,000 people registered to take part. The drill was also held in Oregon, California and other U.S. states in the Pacific region where faults could produce a major earthquake at any time. “When an earthquake does occur, the ground will shake and jerk sideways, which creates sudden back-and-forth motions,”

said Kelli Kryzanowski, manager of catastrophic planning for Emergency Management BC. “This intense shaking can cause every unsecured object in a room to topple, to fall or even become airborne, and this is when people are most often injured or killed in earthquakes.” Every year in B.C. there are more than 1,200 earthquakes,

The Vancouver Police Department’s decades-long campaign to move sex workers into the darkest, dirtiest streets of the city’s Downtown Eastside was only in response to a law that intended to keep prostitutes out of sight, the force’s lawyer told a public inquiry yesterday. The hearing into the Robert Pickton case has heard from several witnesses who have complained about police tactics that have displaced sex workers and contained them in dangerously isolated areas of the city, where they are easy prey for predators. But Vancouver police lawyer Tim Dickson suggested the force was only doing the best it could under the law that prohibits communication for the purposes of prostitution, which came into effect in

The city of Vancouver says the Occupy Vancouver camp in the downtown core has cost the city more than $500,000 since it began last Saturday. Most of the money has gone to policing, which was beefed up for the event in light of the Stanley Cup riot. An $8 billion federal contract for Coast Guard and navy support ships could mean the end of ferries built in foreign shipyards, B.C. government officials say. Jobs, Tourism and Innovation Minister Pat Bell said yesterday the upgrades to Seaspan facilities in North Vancouver and Victoria to construct seven new vessels will make the company more competitive, particularly for specialty ships like the icebreaker that is part of the contract.

The law replaced previous provisions that made solicitation a crime. “The police have a mandate to enforce a law that has as its purpose removing prostitution from streets and from view ... but when the police do enforce the law, the street prostitution doesn’t go away, it just goes somewhere else,” Dickson said when cross-examining Simon Fraser University criminologist John Lowman. “That’s the general pattern,” replied Lowman. Dickson argued the law was never intended to eradicate prostitution, but rather address the public nuisances associated with sex work. Canada’s top court has closed the door on compensation for business lost during construction of the Canada Line. The Supreme Court of Canada refused to hear an appeal by Vancouver businesswoman Susan Heyes. Cambie Street merchants said they were badly damaged by the decision to use traffic-disrupting cut-and-cover construction rather than a more costly bored tunnel. She initially won a $600,000 judgment against the rapid transit line builders but then was stripped of the award in the B.C. Court of Appeal.

Assault charges have been dropped against the ex-boyfriend of murdered teen Maple Batalia, who was shot to death late last month in Surrey. Gurjinder “Gary” Dhaliwal was charged with assaulting 19-year-old Batalia and another person at a Tim Horton’s on Sept. 24, four days before Batalia was gunned down in a parkade outside SFU Surrey on Sept. 28. No arrests have been made in connection with Batalia’s death.

A lawyer for the only Canadian on death row in the United States expects to file an application for clemency by the end of the year. Ronald Smith, who is originally from Red Deer, Alta., has faced the death penalty in Montana for nearly 30 years. He was convicted in 1983 for shooting two cousins while he was high on drugs and alcohol near East Glacier, Mont. His lawyer says an actual hearing would probably be in the spring.

The parliamentary ethics watchdog is rejecting a Conservative complaint about union advertising and sponsorship at the NDP convention in June. A four-year, $9.5-million project to spruce up the backyard of Parliament Hill has been cancelled as too expensive. Public Works last week asked for bids to clear “invasive vegetation” and to plant trees on the escarpment that drops from behind the Parliament Buildings to the Ottawa River. But Public Works Minister Rona Ambrose has abruptly ordered officials to cancel their plans as too expensive. Her spokeswoman says Public Works will continue to examine cost-effective ways to prevent erosion on the slopes.

The Supreme Court of Canada has ordered a new trial for a man who claimed he collected hundreds of child porn images for artistic purposes. But in its decision, the top court says an appeals court was right to overturn a trial judge’s acquittal of Robert Katigbak. He has admitted the more than 600 images and 30 video clips of “real children and real abuse” constituted child pornography. He testified at his trial that he collected the material over a seven-year period and wanted to create an exhibition on child exploitation.

A Chinese court has rejected an activist’s appeal of her nine-month jail term for staging a noisy protest. The Beijing No. 2 Intermediate People’s Court yesterday upheld the conviction of Wang Lihong for creating a disturbance when she helped lead a protest on behalf of three bloggers accused of slander. Her supporters and rights groups say the charges against her were fabricated to punish her for her wider activism, noting that she alone was charged for a protest many others attended. Her prosecution underscores the government’s worries about Internetempowered social activists.

Irish Travellers yesterday began leaving a site in southeast England where they have lived illegally for a decade, ending days of fierce resistance and a lengthy legal battle against authorities who forced their eviction. Authorities earlier began removing homes and dismantling protesters’ scaffolding from Dale Farm to force out the Travellers, a traditionally nomadic group similar to, but ethnically distinct from, Gypsy or Roma people. Local authorities argued that the 86 families lack permission to pitch homes on the land, but the Travellers call it ethnic cleansing.

Palestinian diplomats are trying to muster support for a UN Security Council vote in New York on Nov. 11 on their bid for membership in the global body, a senior Palestinian official said yesterday. Any member of the Security Council can request a vote on the Palestinian request, but a resolution recommending membership requires a minimum of nine “yes” votes and no veto by one of the council’s five permanent members – Britain, China, France, Russia and the U.S. Once the 15-member Security Council recommends a country’s Ibrahim Khraishi membership its application must be approved by a two-thirds vote in the 193-member General Assembly. Washington, Israel’s closest ally, has already pledged to use its veto if Palestinian membership gets the support of nine or more council members. Palestinian Foreign Minister Riad Malki told reporters in late September that the membership bid has support so far from eight Security Council members: Russia, China, India, South Africa, Brazil, Lebanon, Nigeria and Gabon. A former U.S. university student accused of using a webcam to spy on his roommate’s intimate encounter with another man turned down a plea deal yesterday that could have kept him out of prison. The teenage subject of the alleged spying, Tyler Clementi, killed himself in September 2010. Dharun Ravi, 19, yesterday affirmed his decision to go to trial. A conviction could mean 10 years or more in prison. A judge set a trial date of Feb. 21. Ravi faces 15 criminal counts, including invasion of privacy and bias intimidation, a hate crime. He remained silent during the hearing, other than to say “yes” when New Jersey Superior Court Judge Glenn Berman asked him whether he understood the risks he faces by appearing in court. Berman ruled that Ravi’s lawyer should not have access to his writings, including documents found on his computer. Berman reiterated his earlier ruling that Ravi, his lawyer and his lawyer’s investigator should be given the name and birth date of the man who had the encounter with Clementi, with the caveat that they not give that information to anyone else.

Michael Buble has a new book out, one that’s billed as an all-access portrait of the Canadian crooner, but he wants his fans to understand something. Onstage Offstage, hitting stores Tuesday, is not the no-holds-barred memoir that fans might have expected from the refreshingly outspoken singer. That book is coming, Buble said, but the three-time Grammy winner felt he needed to accumulate more miles before he looked back. He envisions that more in-depth book will come out a decade or more down the line, while Onstage Offstage is meant to serve a different purpose. “The truth is, I want people to really understand, (Onstage Offstage) is very light,� said the singer. “I’m proud of it, it’s great, but it’s a picture book.� “When they sold the idea to me, I was completely against it – I felt it was too early in my career to have any kind of memoir. But they said it’s not a memoir, it’s a coffee-table book ... I just don’t want people to get mixed up and think this was like, the memoir. “Because really, they’ll be disappointed if they think that. I hope it’s nice reading, it’s light reading, it’s fun, it’s quick, but, you know, there’s a lot more pictures than there are words.� That sort of honesty is typical of Buble. Michael Douglas’ imprisoned son pleaded guilty to a new drug charge yesterday, admitting that he managed to get drugs in prison even while he was co-operating with the government in a drug investigation. Cameron Douglas, 32, pleaded guilty to a narcotics possession charge, saying: “God knows I’m sorry about this situation.” Although the charge carries the potential for a 20-year prison term, a plea deal with prosecutors recommended Douglas serve between a year and 1 1/2 years in prison. His sentencing was set for Dec. 21. Michael Douglas, who was not in court, said in a statement that his son’s offence involved a small user-quantity of drugs. “Cameron accepts full responsibility for his conduct,” the father said. “While he has made much progress, he is still not cured. Most people and their families are able to address this illness privately and outside the spotlight. Unfortunately this has not been possible here – for reasons completely outside of his control. He thanks those that have rooted for his recovery and looks forward to the day when he will not disappoint.”

However, the fall report from the Ottawa-based think tank came with two big caveats – both European and U.S. policy-makers must implement policies necessary to stave off disaster. “All bets are off if we have another financial crisis. It’s very scary right now,” said economist Pedro Antunes, who authored the paper. The outlook represents a somewhat rosy outlook from what earlier this year was among the most pessimistic of Canada’s major forecasters. The Conference Board said Canada’s economy, which is slowing down to 2.1 per cent growth this year, will pick up some steam next year and advance by 2.4, before accelerating to 3.3 per cent in 2013.

Shaw Communications saw its overall fourth-quarter profit fall by 32 per cent, as losses from an abandoned wireless strategy offset gains elsewhere, according to the Calgarybased company’s financial report yesterday. The cable, Internet and satellite TV provider had $82.5 million in net income, or 18 cents per share, down from $121.6 million or 28 cents per share last year. The decline for the three months ended Aug. 31 was due to an $83.7-million loss or 19 cents per share at Shaw’s discontinued operations. Three days and 30 hours’ worth of talks ended on a nasty note yesterday in NBA labour negotiations. And only one thing seemed fairly certain: more games were likely to be cut. Possibly even the season. Players insist that’s the outcome owners wanted all along – “preordained,” as union executive director Billy Hunter said. “We’ve always felt there was still a place where they would just not go and they would lock us out as long as it would take in order to get us beyond that place. There was never really a willingness to negotiate beyond certain points,” union president Derek Fisher of the Lakers said. “There was just a line drawn, and regardless of what’s going on, how many times we meet, ‘we’re not going past that.”’ After 30 hours of negotiations before a federal mediator, the sides remained divided over two main issues – the division of revenues and the structure of the salary cap system. The season was supposed to begin Nov. 1, but all games through Nov. 14 – 100 in total – already have been scrapped, costing players about $170 million in salaries. The union said owners essentially gave it an ultimatum to accept a 50-50 split of revenues. Lawyer Jeffrey Kessler said the meeting was “hijacked.” “We were shocked,” he said. “We went in there trying to negotiate and they came in and they said you either accept 50-50 or we’re done and we won’t discuss anything else.”
