RIGHT-TO-DIE CASE OPENS IN B.C. COURT

The B.C. government has introduced sweeping changes to family law, to reflect modern trends from test-tube babies to the rising number of common-law relationships. B.C. now has three times the number of couples moving in together as are getting married, and those common-law relationships are more likely to break up. The legislation treats those similar to a marriage, in caring for children and division of assets. The new Family Law Act is designed to encourage out-of-court settlements in family breakups, which account for about one fourth of all cases in B.C. courts. It does away with the terms “custody” and “access” and emphasizes parental responsibility and guardianship instead, with new penalties for parents who refuse to provide parenting time or fail to spend time with children as agreed or ordered by a judge. The act also creates a new protection order for cases involving family violence, with any breach of the order treated as a criminal offence. Tracy Porteous, executive director

A B.C. Supreme Court judge has begun hearing arguments over whether Canada’s laws against assisted suicide should be struck down, while outside the courthouse, a group protesting against euthanasia hung effigies in trees. Joe Arvay, lawyer for the B.C. Civil Liberties Association, told the court there is a wealth of new evidence supporting the right to die since the high court rejected Sue Rodriguez in her efforts to get help to end her life 18 years ago. Arvay told the court he’s confident that once all the evidence is completed, the judge will find Canada’s ban on assisted suicide unconstitutional. Arvay is representing Gloria Taylor, 63, and four others in their argument against laws that make it a criminal offence to help seriously ill people end their lives. Taylor suffers from ALS, or Lou Gehrig’s disease, an incurable illness that gradually weakens and degenerates muscles to the point of paralysis. The case was fast-tracked because of her deteriorating condition. But outside the court, the effigies were hung to represent victims and two dozen people held protest signs urging against relaxing assisted suicide laws. Federal government lawyer Donnaree Nygard told the court in her opening statement that the potential harm of striking down the law is irreversible and would put the elderly, the depressed and the disabled at risk.

Eugene Raponi, family lawyer and mediator of the Ending Violence Association of B.C., said civil protection orders under the Family Relations Act are not taken seriously by police or coordinated with criminal investigations. Domestic violence cases are the second largest category of criminal charges in B.C. behind impaired driving. “Hopefully, under this legislation, (judges) are not going to arrange to have someone who’s threatening to kill the mother to have custody of the child,” Porteous said. Eugene Raponi, a family lawyer and mediator in Victoria, said common-law spouses currently

have a difficult process to divide assets if they split up. The new legislation exempts inherited assets from settlements, and whether the couple is married or not, it calls for even division of assets accumulated while they are together. It also protects voluntary agreements from being overturned by a judge, and provides for mediation and arbitration to reach agreements. “I like to say that if it costs as much to get divorced as it did to get married, you’re doing well, and I think a mediation can accomplish that goal,” Raponi said.

PATTULLO BRIDGE REBUILD DOGGED BY DELAYS JEFF NAGEL (Black Press)

A new and likely tolled Pattullo Bridge won’t open before 2018 at the earliest, according to internal TransLink estimates. That timeline calling for procurement in 2013 and a construction start in 2015 is contained in reports obtained by Black Press under Freedom of Information and amounts to a three-year delay for the project. But even those dates are starting to look doubtful because TransLink is now more than a year behind schedule in launching a promised round of public consultations on the new bridge’s design. The delay is largely due to months of wrangling between TransLink officials, who insist a new bridge is needed, and the province’s transportation ministry, which argued as recently as last spring to instead refurbish the existing 74-year-old bridge to save money and avoid the need for tolls. TransLink spokesperson Erin Dermer said outreach sessions are being planned by the end of this year to update the public on the status of the project in advance of formal consultations. “Our plan is to undertake public consultations in the early spring of 2012,” she said.

Those consultations had been originally set for September of 2010 until the province asked they be postponed while ministry staff reviewed the plans. No decision has been made on whether TransLink will propose building a four- or six-lane new bridge and Dermer could not say whether that will happen in time for the spring consultations. TransLink officials had vowed in 2010 to fast-track the bridge and said

then it could open as soon as 2015. It’s been nearly 10 years since an ICBC report flagging safety concerns with speeders on the Pattullo Bridge first spurred politicians to look for ways to make it safer or rebuild it. Many people have died in crashes on the bridge or its approaches over the years. The bridge’s centre lanes are closed each night to reduce the risk of head-on crashes.

B.C. TO ADD THREE MORE VACCINES FOR CHILDREN VICTORIA (Canadian Press)

The B.C. government is adding three more vaccines to its free childhood immunization program starting in January. One vaccine will target the rotavirus to help protect babies from diarrhea and vomiting, and infants born on or after Nov.1, 2011, will be eligible. A chicken pox booster shot will also be added to the program for children four to six years of age. The government will also offer the hepatitis A vaccine to all aboriginal infants and children to try to reduce the incidence of the disease among B.C. First Nations.

MISSING SNOWMOBILER FOUND DEAD PRINCE GEORGE (Canadian Press)

A missing snowmobiler who was swept away by an avalanche has been found dead. Cpl. Craig Douglass of the Prince George RCMP said in a media statement that the body of the 40-year-old man was located yesterday at the Torpy Mountain recreation area about 100 kilometres northeast of Prince George. Douglass said the coroner is now investigating. The avalanche occurred Sunday afternoon while the victim and a friend were sledding.

BUS DRIVER ALLEGEDLY ASSAULTED BY TEENS NORTH SHORE OUTLOOK (Black Press)

A West Vancouver Blue Bus driver is recovering from facial injuries after allegedly being assaulted in the early hours of Saturday morning by two male youths attempting to board a bus. According to West Vancouver Police, the 16 and 17-year-old West Vancouver residents were denied entry to the bus by the operator because of suspected intoxication. The driver was then allegedly assaulted by the teens, suffering injuries that included a broken nose. The suspects fled the scene but were arrested a short time later.

REPORT SPANKS CITIES FOR OVERSPENDING JEFF NAGEL (Black Press)

No Lower Mainland cities have come even close to limiting their spending to a growth rate deemed sustainable by a small business lobby group. The Canadian Federation of Independent Business released an analysis yesterday that found overall municipal operating spending in the province has soared at nearly four times the combined rate of population and inflation over the past decade. Mission – which the CFIB credits with one of the best cost-control records – still saw its spending grow at double that rate from 2000 to 2009 and almost every other city in the region increased its spending at least three times as fast. “Municipalities are spending more than ever and

faster than ever,” said CFIB B.C. director Shachi Kurl. “Taxpayers can only bear so much. Things are on track to become unsustainable.” The Union of B.C. Municipalities has previously argued cities are struggling to pay more costs that are being downloaded onto them by senior government, and have little control over some escalating costs, such as policing. But the CFIB discounts that argument, noting cities are also receiving much more in grants and transfers from Ottawa and Victoria, while also raising much more revenue directly in local fees and charges. According to the BC Municipal Spending Watch 2011 report, the biggest cities in the province spent on average $1,290 per person on operating costs in 2009.

Staff and volunteers at the Greater Vancouver Zoo are shocked and saddened by the loss of “Amryn,” the young male Rothschild giraffe. Amryn was found yesterday on the ground inside his barn and was treated aggressively, but he died shortly thereafter. A full post mortem was performed, but at this time the cause of the death is unknown. Amryn was born on December 20, 2007 at the zoo. His mother Eleah and father Jafari both still live at the zoo.

The victim of a Saturday night (Nov. 12) car crash in Langley has been identified as Dylan Reichelt, the 18-year-old son of BC Lions head trainer Bill Reichelt. “The B.C. Lions Football Club is mourning the loss of Dylan Reichelt, son of team athletic therapist Bill Reichelt, who passed away from injuries sustained in an automobile accident Saturday evening,” said spokesperson Jamie Cartmell. Dylan is survived by his parents, Bill and Cathy, his sister Keira and twin brother Jesse.

Newfoundland’s provincial police service announced yesterday that it had located a stolen car. The 1970 Opel had been reporting missing nearly three decades ago. The vehicle was stolen from a garage and was reported missing by its owner in 1984. Now, 27 years later, it was found in another garage. Patrol officers, acting on information, checked the garage on Torbay Rd. in St. John’s and confirmed the vehicle was in fact the long-missing Opel. No arrests have been made.

Parliament’s budget watchdog says an aging population and a larger debt are cramping the federal government’s ability to reduce spending. A new report from the parliamentary budget officer shows that government spending is edging down, but is still far more than it was before the massive stimulus program was put in place for the 2008-2009 recession. The report based on departmental numbers says the biggest cost-drivers are health transfers, servicing the public debt, adjustments to collective agreements and old-age security.

Civil liberties groups are outraged by an English city’s plan to install audio recorders in licensed taxi cabs as a security measure. Officials in Oxford say that from next year cabs will carry audio-equipped cameras that run whenever the vehicle is in use. The city says the recordings will be available only to police or other authorities in connection with specific investigations. Nick Pickles of Big Brother Watch said yesterday the plan is “a staggering invasion of privacy.” Britain has hundreds of thousands of surveillance cameras in public places, including trains, subways and buses.

German prosecutors formally arrested a woman suspected of co-founding a farright terror organization that authorities say murdered 10 people. The woman, identified only as Beate Z., has refused to co-operate with police since turning herself in last week. The 36-year-old is suspected of having set fire to a house used by two other alleged members of the National Socialist Underground group. Prosecutors believe the group murdered eight Turks and one Greek from 2000 to 2006 and fatally shot a policewoman in 2007.

A Russian spacecraft carrying an American and two Russians has blasted off successfully from the Kazakh steppes on a mission to the International Space Station. The Soyuz TMA-22 lifted off as scheduled at 8:14 a.m. local time yesterday from the Russian-leased Baikonur cosmodrome in Kazakhstan. It is carrying NASA astronaut Dan Burbank and Russians Anton Shkaplerov and Anatoly Ivanishin and is set to dock at the station tomorrow. The launch was postponed for two months following the crash of a Progress cargo ship in August.

Efforts to free former Ukrainian Prime Minister Yulia Tymoshenko from prison through the domestic legal system are almost certainly doomed and she is likely to remain in prison for many months, her lawyer said yesterday. Serhiy Vlasenko charged that President Viktor Yanukovych is intent on keeping the top opposition leader in prison to bar her from elections. Tymoshenko, 50, was convicted last month of abusing her powers while negotiating a natural gas import contract in Russia in 2009 and sentenced her to seven years in jail.

Thailand’s prime minister is urging people in flooded areas to be patient, saying the government is working as hard as it can to drain the water. Prime Minister Yingluck Shinawatra said Monday that the flooding situation that has plagued the country since late July is improving as waters recede. She urged people to “tolerate the flooding situation and turn unity into power to struggle through the crisis.” The national death toll from Thailand’s worst floods in more than half a century has reached 562. The floods are still affecting 22 of 77 Thai provinces.

He said the 27 EU nations should increase their contacts with the Syrian opposition. The names of those Syrians newly sanctioned will not be known until they are published in the EU’s official journal in a day or two.

Italy’s premier-designate Mario Monti began talks yesterday to create a new government of non-political experts tasked with overhauling an ailing economy and keeping market fears over the country from threatening the existence of the euro. Investors initially cheered Monti’s appointment, following quickly on Silvio Berlusconi’s weekend resignation, though concern lingered about the sheer amount of work his new government will have to do to restore faith in the country’s battered economy and finances. President Giorgio Mario Monti Napolitano tapped Monti on Sunday to create a government capable of implementing economic reforms aimed at reviving stagnant growth to bring down public debt, stuck near 120 per cent of GDP. Napolitano encouraged all sides to join forces to rescue Italy from its financial woes. Improving market confidence in Italy is crucial to the future of the eurozone as the country would be too expensive to rescue. A default on its 1.9 trillion euro ($2.6 trillion) debt would cause massive chaos in financial markets and shake the global economy.

The justices announced they will hear more than five hours of arguments from lawyers on the constitutionality of a provision at the heart of the law and other related questions about the act. The central provision in question is the requirement that individuals buy health insurance starting in 2014 or pay a penalty. Canada’s new plastic, see-through currency feels a lot like the celluloid film you used to load into your old-fashioned camera. The smooth, stretchy, polymer bills may prove popular with the beach crowd because you can easily tuck the waterproof money into your bathing suit and take it out for a swim. The Bank of Canada officially put the first of the new generation of bills into circulation yesterday – the $100 one. The $50 bill is coming next March, and the rest of the bills will be in circulation by 2013. Officials are singing polymer’s praises, saying the new bill has a lot of security features that will make it a challenge to counterfeit. At a Toronto event, Bank of Canada governor Mark Carney said the new bills are better than the traditional paper notes on a number of counts. They’ll save taxpayers money not only because they’re

sturdier, but also because they’ll cut down on fraud, he said. “They’re more secure, they’re more economical and they’re better for the environment than any note we’ve previously issued,” Carney said. While the new money might look ultra-modern to Canadians, some other countries – Australia and New Zealand – have had polymer currency for well over a decade. Canadian officials, however, say these new bills will have the most high-tech features. Carney boasted that the polymer bank notes were developed by physicists, chemists, engineers and bank note experts from Canada and around the world. Bank of Canada director Daniel Johnson says the new bill will last two-and-a-half times longer than the current bank note: “A $100 bill circulates for about seven years before new ones have to be issued. This one will last maybe 20 years.”

The global economy – including Canada – is on track to slow in the coming months, according to a report from the Organization for Economic Co-Operation and Development. The OECD said yesterday its monthly index for composite leading indicators pointed “more strongly to slowdowns in all major economies” with Canada among those set to see growth drop below the long term trend. Canada dropped 0.4 points in September, taking its composite leading index number to 99.4, down from 101.2 in May. The country’s leading indicator has been falling for several months and dropped below 100 in August. For the OECD member countries as a whole, September’s reading was 100.4 down 0.4 percentage points from August and down from 102.3 in May.

U.S. LOOKING INTO GM GEAR SHIFT PROBLEMS WASHINGTON (Associated Press)

A U.S. safety agency is investigating problems with the automatic shift levers on several General Motors cars that have caused at least seven crashes. The U.S. National Highway Traffic Safety Administration said on its website yesterday that the probe began with complaints about the Saturn Aura midsize car from the 2007 and 2008 model years, affecting nearly 89,000 vehicles. But the agency said it is now checking to see if the problems extend to other GM vehicles. NHTSA said the protective jacket around cables connecting the floor shift lever to the transmission can deteriorate, exposing the cables to the elements. Brendan Shanahan has no plans to preside over a league where goalies have to worry about getting hit. And he thinks it’s “irresponsible” for the Buffalo Sabres to suggest otherwise. The NHL’s new sheriff reacted strongly to complaints from the Sabres yesterday after he elected not to suspend Bruins forward Milan Lucic for his collision with Buffalo’s Ryan Miller. “I think Buffalo’s comments are irresponsible to suggest that it’s open season,” Shanahan said at the Hockey Hall of Fame induction ceremony. “I will have this warning for players: ‘It’s not. If you run a goalie you’re going to find yourself in the same situation that Lucic was today, you’re going to have to explain yourself and you don’t explain it sufficiently, and if I don’t buy it, you’re going to be suspended.”’ On Saturday, Miller was knocked to the ice by Lucic when the goalie strayed from his net to play the puck in the first period of Buffalo’s 6-2 loss. Shanahan held a hearing with Lucic yesterday and was satisfied with his

assertion that he didn’t have time to avoid the collision. “I judged this case for what this case was,” said Shanahan. Miller suffered a concussion on the play and called Lucic “gutless” afterwards. The Sabres were perplexed that the rugged Bruins forward wasn’t suspended and suggested it sent a message across the NHL that goalies won’t be protected. “It just means that teams will be to able do exactly what Lucic did,” Sabres coach Lindy Ruff told reporters in Montreal. “Your goaltender can play the puck, we can run him over, we can hurt him and all you get is a two-minute minor penalty. “That is essentially what that means – You can concuss the other team’s goalkeeper ... it means it’s fair game on goaltenders again.” Shanahan has been a busy man since replacing Colin Campbell over the summer. He’s already handed out 14 suspensions this season and drawn some criticism for fulfilling a mandate to make them harsher than in the past.

NBA SEASON IN JEOPARDY: STERN NEW YORK (Associated Press)

NBA commissioner David Stern says it looks like the 2011-12 season really is in jeopardy after the players rejected the league’s latest proposal. Stern had urged players to take the deal on the table, saying it’s the best the NBA can offer and warned that decertification is not a winning strategy. In an interview with ESPN, Stern says the union’s decision to disband is a “big charade.” He says he believes the union is trying to see “if they can scare the NBA owners or something. That’s not happening.” Union executive director Billy Hunter says they’re prepared to file an antitrust lawsuit against the league in the next few days. He says players were not prepared to accept Stern’s ultimatum, saying they thought it was “extremely unfair.” Hunter said the NBPA was in the process of converting to a trade association and that all players will be represented in a class-action suit against the NBA. Players and owners have been talking for two years but couldn’t reach a deal, with players feeling the league’s desires to improve competitive balance would hurt their free agency options. And beyond that, the owners’ desire for a 50-50 split of basketball-related income, after players were guaranteed 57 per cent under the old deal, meant players were shifting at least $280 million per year to the owners.
