The self-described fundamentalist Mormons in Bountiful, B.C., have shaped the debate over Canada’s anti-polygamy law, but an imminent court ruling could have implications extending far beyond the boundaries of the isolated community. Observers say if a B.C. Supreme Court judge strikes down all or part of the Criminal Code section banning polygamy in a ruling today, it will have a major impact on Canada’s immigration system, certain minority communities, and could make this country a haven for polygamists. At the same time, a group of so-called polyamorists, who describe themselves as consenting adults in relationships that happen to involve more than two people, worry they could be targeted if the law is upheld. The B.C. government asked the court to examine the constitutionality of the polygamy law following the failed prosecution of two leaders from Bountiful. There are believed to be hundreds of polygamous marriages in Canada involving Muslims. Nick Bala, a law professor at Queen’s University, said striking down the polygamy law could bring those polygamous marriages, however rare, out of the shadows while leaving immigration officials with few options to prevent polygamists from entering the country. “If the law is struck down, I think Canada could become a real centre for polygamists, both from the United States and Muslim countries,” said Bala, who provided an affidavit at the B.C. court case but wasn’t called to testify. A new survey says B.C.’s inmate-to-prison-guard ratio has grown to 40 to one since 2002. At North Fraser Pretrial in Port Coquitlam, where prisoners await trial, the ratio is 60 inmates per guard. Boyd said so far this year there have been 29 reports of assaults on North Fraser guards. According to the survey of 200 guards at B.C. facilities, in the past year two thirds received a credible threat of harm from an inmate. Almost 40 per cent had been hit by feces, urine, vomit or spit, and more than one in four had been physically assaulted by an inmate. Public Safety Minister Shirley Bond said her ministry is close to announcing a new site for a 360-cell facility in the Okanagan, which it has been trying to build for several years. The ministry has $185 million in expansions coming, including another 200 corrections officers, she said.

Occupy Vancouver activists were ousted for a second time yesterday in a court ruling that left them considering where to move their roving protest next. The band of demonstrators were ordered to pack up and leave by 5 p.m., less than 24 hours after they relocated to a partially-covered plaza outside the provincial law courts from their five-week encampment at the city art gallery. B.C. Supreme Court Judge Anne MacKenzie, who also made the previous ruling against the group, found the new setup to be a public nuisance and in contempt of court for interfering with access to justice by virtue of its location. But MacKenzie stopped short of issuing a blanket injunction that would prevent protesters from setting up camps on any other public lands, as requested by the Crown lawyer who argued on the province’s behalf. “To use the courts’ jurisdiction ... to control something that may not happen in the future on public lands is speculative,” she said in her ruling, issued about an hour after the application was presented.
“After all, there already exists a remedy for trespass.” There was no legal representation for the protesters. The group was ordered evicted from city-managed land outside the Vancouver Art Galley last week, with a deadline to clear off by 2 p.m. Monday. Protesters lived in a mini-village for five weeks as part of the global movement decrying corporate
greed and the world’s concentration of wealth held in the hands of very few. Vancouver Police also told the group officers would enforce the order if they didn’t vacate. “Police are asking the protesters not to resist in any way that could jeopardize their safety,” said a release, noting the force had made careful decisions since the demonstration began on Oct. 15.

Criminal charges will not be pursued against a School District 20 bus driver who allegedly canvassed Castlegar students to play a “be quiet game” and then preceded to apply duct tape to the mouths and wrists of volunteers. What the driver thought to be a fun game for the journey home Oct. 26, was not seen in the same light by police, the school district, nor the parents who found their child returning home from school bound with duct tape. “Even if it was meant to be a joke, it was unacceptable,” said Greg Luterbach, superintendent of schools. “We don’t think it’s appropriate and therefore that’s why we’ve dealt with it.” Luterbach couldn’t provide details on the specific action taken in this “confidential personnel matter.” But complainants were satisfied enough by the district’s response and the investigation conducted by the police, that no criminal charges were pressed, according to Cpl. Deb Postnikoff of the Castlegar RCMP. An investigation revealed that there was no harm done to the elementary kids who participated. The police conducted interviews with parents and several children. The school district constantly does professional training sessions for its staff, holding the most recent for bus drivers this fall.

Police may have a break in the murder of an 18-year-old woman in Armstrong. The RCMP say there have been what they call “significant developments” in the investigation into the killing of Taylor Van Diest, but they won’t release any details until a news conference later today. ONE ARRESTED AFTER SCHOOL LOCKDOWN NATASHA JONES (Langley Times)
A dramatic afternoon at Langley Secondary School ended yesterday with police tape removed and all students confirmed safe. The incident drew 40 officers from Serious Crime, General Duty, Youth Unit and Dog Services, as well as Air One. The incident unfolded when police received several calls that a person armed with a weapon had entered the school between 11 a.m. and noon, said Cpl. Holly Marks, who speaks for Langley RCMP. She said that the Lower Mainland Emergency Response Team completed a thorough and methodical search of the school and recovered a replica handgun. A 17-year-old man is in custody, and no one was
injured, Marks said. Earlier, there had been reports that more than one gunman had entered the school. Both LSS and Christian Life Assembly next door were locked down, and Transport Canada closed the airspace above Langley Regional Airport which is across the street from the school. During the tense situation, anxious parents reported that their children were sending them text messages. Later, police were said to have confiscated all cellphones. One mother said that her son had texted her from the gym that no one was allowed to leave. He said that the students were “relaxed and bored.” No one had heard gun shots, she added.

A Surrey man was shot in the face early Sunday morning outside of a Holiday Inn in Richmond. Richmond RCMP Cpl. Sherrdean Turley said two groups of males became engaged in a conversation in a parking lot near the hotel. “As the conversation concluded, and one of the two groups was departing, a gun was produced and at least one shot was fired resulting in a 23-year-old Indo-Canadian male suffering a shot to the face,” Turley said. The victim was taken to hospital and was listed in stable condition.

Quebec’s justice minister is leaving Ottawa upset, empty-handed, and accusing the Harper government of acting more like right-wing ideologues than the Government of Canada. Jean-Marc Fournier says he can’t understand why his federal counterpart wouldn’t consider three suggestions for modest amendments to the omnibus crime legislation C-10. The sweeping bill would toughen a multitude of penalties for juvenile and adult offenders. But Quebec’s position is that the changes are ill-researched and based more on ideology than sound logic. Fournier, who criticized the feds during a recent parliamentary committee appearance, positively unloaded on them yesterday. “I don’t recognize the Canada that I know in this kind of decision,” Fournier told reporters before leaving town. “This is not the Government of Canada. This is the government of the Reform party.” Quebec and some other provinces are saying they
don’t want to pay the extra prison costs that will be caused by C-10. Fournier says that Quebec – with its lower-thanaverage crime rates – has a position based on studies conducted over several decades, and on close consultation with numerous people involved in the justice system. Meanwhile, he says the federal position is supported by nothing other than a Justice Department study that backs the Quebec approach. He says that when Rob Nicholson agreed to meet him in Ottawa yesterday, he had hoped there might be some openness to amendments. But Fournier says that what he got instead was a diversionary tactic. “What I got was a manoeuvre,” said Fournier, who once worked for ex-Liberal leader Michael Ignatieff. “A diversionary manoeuvre where they tell me, ‘Yes, come and see me – I agree with rehabilitation.’ “Then they tell me in the end, ‘No, no, I absolutely have to pass this law here.”’ Quebec had asked for three amendments to the bill that would have granted provinces more flexibility in its application. For example, Fournier had been hoping the province could opt out of one provision that could allow the identity of young offenders to be divulged. Quebec’s position is that protecting young offenders’ anonymity is key to their rehabilitation, and to providing them with a fresh start once they’ve been punished for a crime.

The Conservative government has reintroduced a bill that would define self-defence and citizen’s arrest. Current legislation heavily restricts citizen’s arrest, allowing it only if perpetrators are caught in the midst of a criminal offence on or involving the arrester’s property. The proposed legislation would authorize an owner or authorized person, like a store employee, to arrest a suspected criminal within a “reasonable amount of time” after committing an offence.

The federal information watchdog says a government move to destroy gun-registry records sets a bad precedent. Suzanne Legault says a federal bill to scrap the long-gun registry – and delete millions of records – violates the letter and spirit of the Library and Archives Act. She told a House of Commons committee the national archivist is best placed to oversee the maintenance of federal records. The government bill introduced last month would permanently delete more than seven million files on gun ownership.

Italy new PM, a former European commissioner, returned to Brussels yesterday with a promise to keep the EU at the heart of his government’s work. Prime Minister Mario Monti also said that growth and fiscal discipline could coexist. “I don’t see any contradiction between rigour in public finance and growth via structural reform,” he said, following a meeting with European Commission President Jose Manuel Barroso. It was clear that the mood between Rome and Brussels had greatly improved now that Monti had taken over from Silvio Berlusconi as prime minister.
Silvio Berlusconi is reviving his musical career, just a week out of office. The billionaire media mogul and threetime Italian premier released a new CD with his longtime musical collaborator Mariano Apicella on Tuesday. Berlusconi – a one-time cruise ship crooner – doesn’t sing on the new collection, titled True Love, but co-wrote all 11 songs. The album features love songs and jazz arrangements. It is the fourth CD that Berlusconi and Apicella, a Neapolitan guitarist and singer, have recorded together.
A key UN committee has voted overwhelmingly to condemn Syria’s human rights violations and call for an immediate end to all violence in the country. The General Assembly’s human rights committee adopted a nonbinding resolution sponsored by Britain, France and Germany yesterday. The vote was 122-13 with 41 abstentions. The resolution was a victory for the three European powers. Their effort last month to win approval for a legally binding Security Council resolution threatening sanctions against Syria over its crackdown against civilians was blocked by Russian and Chinese vetoes.
New details are emerging about a band of neo-Nazis suspected in 10 killings, including indications they knew a policewoman they are thought to have slain. The dapd news agency reported yesterday that federal police president Joerg Ziercke said the family of the policewoman killed in 2007 wanted to rent a pub in a small eastern German town, but a man connected to the neo-Nazi group instead got the lease. Bild newspaper cites Interior Minister Hans-Peter Friedrich as saying the circumstances are unclear but it appears the policewoman “was not killed coincidentally.”

Pakistan’s envoy to the United States resigned yesterday, losing a battle with the country’s generals to keep his job over allegations he wrote a memo to Washington asking for its help in reining them in. Hussein Haqqani said he stands by his denials, insisting he had nothing to do with the memo that was sent to then-U.S. military chief Adm. Mike Mullen in May. He said he was “happy to face an inquiry” into the affair. The affair underlined the tense relations between the U.S. and Pakistan, a key ally in its struggle against Islamic militants, and the internal struggle between civilian politicians and the military in Pakistan. Haqqani is a key ally of President Asif Ali Zardari. He was well regarded in Washington, where he had a difficult job representing Pakistan during several crises, including the aftermath of the U.S. raid that killed Osama bin Laden in May. The memo accuses Pakistan army chief Gen. Ashfaq Pervez Kayani of plotting to bring down the government in the aftermath of the raid on Osama bin Laden on May 2. It asks Mullen for his “direct intervention” with Kayani to stop this. It was not immediately known who would replace Haqqani.

Bare-chested singing is a regular affair for the rocker, and when Gill was asked if he’d go shirtless for the pair’s CMT Crossroads special, Sting chimed in: “He will tonight. You know I haven’t eaten in six weeks preparing for this gig because of this yardstick over here,” said Gill, looking at Sting before laughing: “Going to look like Laurel and Hardy up there.” “I’ve never been described as a yardstick. For the grand opening of Gaga’s Workshop, it seemed as if Lady Gaga chartered a sleigh, picked up Santa Claus and Willy Wonka along the way and landed Monday night at Barneys New York flagship on Madison Avenue. The Workshop is the retailer’s instore holiday shop, conceived, designed and christened by Lady Gaga – 510 square metres of bright colours, crazy shapes and a gigantic cartoon statue of the superstar herself in a pinup pose surrounded by jagged mirrors and sitting atop thousands of black plastic discs. From the street, passers-by get a hint of what’s taken over the fifth floor of the store since Gaga and stylist Nicola Formichetti also created the window displays. “It’s a Charlie and the Chocolate Factory moment,” Gaga said. “We wanted it all to be whimsical and fun, with a sense of art and fashion.” She doesn’t have time to do much holiday shopping anymore, she explained, but Christmas was a special time in her “traditional Italian house,” where the smell of food cooking all day is one of her fondest childhood memories. Gaga’s Workshop is open through Jan. 2.

Elle Macpherson fired her business adviser for leaking secrets when journalists were actually getting juicy details about the supermodel by hacking into her phone, the former aide told a British inquiry into media ethics yesterday. In testimony which illuminated the human costs of the illegal practice, Mary-Ellen Field described how she lost both her job for Macpherson and one at an advisory firm because of the unfounded suspicions – a double-blow that was all the more serious because she was in poor health. “It had a very serious effect,” she told the inquiry. “I had become ill and was falling down all the time.” Field said her relationship with Macpherson was once close, but it fell apart after the model’s intimate secrets began appearing in the press in 2005. Macpherson became convinced that Field was an alcoholic and ordered her to go to a rehabilitation clinic. Field said she was shocked by
the allegations she was a drunk who’d been blabbing about her employer, but went along with Macpherson’s recommendation because she needed her job.

She told the inquiry there was no doubt the sacking was the result of what happened with Macpherson. Although it has since emerged that the leaks were the result of phone hacking by the News of the World tabloid, not any indiscretions, Field said she has not heard from Macpherson in years. Field was one of several victims of press intrusion testifying yesterday at Britain’s Royal Courts of Justice. The federal auditor general says he’s been given no way to measure the employment impact of a billion-dollar fund designed to maintain or create jobs during the last recession. The heavily promoted plan was a two-year, $47-billion stimulus spending exercise launched in January 2009 in the midst of a global recession. Despite the Harper government’s massive promotion of the plan, interim auditor John Wiersema found a common theme among the three speciďŹ c programs and $7 billion in spending he examined. Wiersema says all are hobbled by a failure to coherently say whether results met expectations for the dollars that were spent. The auditor general’s criticism was particularly pointed for the $1-billion Community Adjustment Fund, which was created with the singular purpose of creating and maintaining jobs in smaller communities hard-hit by the recession. “The lack of reliable performance information on job creation will make it difďŹ cult for the government to assess the Community Adjustment Fund program’s effectiveness in meeting one of its key objectives,â€? says the report.

A change in play-calling philosophy coupled with an improved offensive line has put the B.C. Lions in a position to play for the Grey Cup on their home field. All-star centre Angus Reid said the Lions made changes after starting the CFL season as a predictable drop-back passing team with the odd run sprinkled in. “We weren’t winning games, the quarterback’s getting hit too much and we were running a completely unbalanced offence,” Reid said yesterday at the Lions’ practice facility. “You’re not going to survive throughout the course of the season.” Changes were made after a 30-27 loss on Aug. 13 to the Winnipeg Blue Bombers – Sunday’s title game opponent – that dropped the Lions to 1-6 on the season. Now there’s more motion with multiple backs running the football. Or slotback Kierrie Johnson taking a handoff and scampering around the end. Or halfback Andrew Harris hauling in a Travis Lulay touchdown pass like he did in Sunday’s 40-23 West semifinal win over Edmonton. The play-selection changes helped the Lions’ offensive line allow only 29 sacks – the fewest in the CFL – but the Bombers accounted for 10 of them in two victories.
Lulay was sacked six times in a 25-20 loss in Winnipeg on July 28. “Right now we’re a way better team than we were in the two times we played them,” said right tackle Jovan Olafioye. “(We’re) much better in pass protection and run blocking. We were at the breaking point when we lost to Winnipeg the last time.” So the Lions went into Edmonton the next week and beat the Eskimos 36-1.
