POLICE FIND DNA MATCH IN HALLOWEEN MURDER ARMSTRONG (Canadian Press)
Police say they believe the man who killed an 18-year-old woman in Armstrong on Halloween is the same person who sexually assaulted a woman inside a Kelowna escort agency in 2005. Police made the revelation during a news conference yesterday into the ongoing investigation of Taylor Van Diest’s death. RCMP Cpl. Dan Moskaluk says police have obtained the DNA profile of the person who killed Van Diest. Moskaluk said while police don’t yet know the suspect’s identity, they do know the DNA collected matches evidence from an April 2005 sexual assault inside Kelowna’s Garden of Eden escort agency. “The suspect DNA sample is not contained within the known-offender DNA data bank,” said Moskaluk. “So what this means is investigators can confirm the match, however, they do not have the outright identity of the person at this time.” Police believe he is a Caucasian male with dark skin tones, is 25 or 26 years old, has dark eyes and short dark hair and is between fivefeet, eight-inches and five-feet, 10-inches tall. Armstrong Mayor Chris Pieper said he doesn’t like to use the word “fear,” but noted locals are cautious and nervous and a “cloud of uncertainty” is hovering over the town. “You won’t get over it. You just have to learn to deal with it,” he said. Locals are more aware of their environment than before the killing, he added, and
the community has changed. Pieper urged people who may have information on the suspect’s identity to call police tip lines or Crime Stoppers. “Nobody will ever know who you are.” Moskaluk said police believe the suspect is a resident of the Okanagan Valley but may have lived outside the area for a period of time between 2005 and 2011. He said the young man may have suffered scratches to his face, neck or arms after the homicide and may have changed his regular routine. The suspect may have also made an unplanned, sudden or unexplained departure after the Halloween murder and may be collecting social assistance or be financially dependent on others, he said. A B.C. Supreme Court judge has upheld Canada’s law against polygamy, finding that the potential harm to women and children in multiple marriages outweighs the infringement of religious freedom. The ruling clears the way for the B.C. Attorney General’s ministry to try again to prosecute leaders of Bountiful, a polygamous community in southeastern B.C. near the Idaho border. Charges against Winston Blackmore and James Oler, rival leaders of the community, were dismissed on a legal technicality by another B.C. judge in 2009. Blackmore was charged with having 19 wives and Oler three wives. Attorney General Shirley Bond said yesterday the ministry will take time to study the complex ruling before deciding what to do next. After the prosecution was turned away, the government proceeded with a reference case, to see if the rarely used law conforms with the Charter of Rights and Freedoms. “Our case was in essence quite simple – that there are profound harms to children and women related to polygamy, and today I think that Justice Bauman clearly
embraced government’s argument,” Bond said. “My job now is to go back and assess what implications this might have for a future potential prosecution.” Bond added that with many intervenors in the case, the judgment is likely to be appealed. Chief Justice Robert Bauman issued a 300-page ruling yesterday after hearing testimony from
expert witnesses as well as people who have lived in Bountiful, an isolated community of about 1,000 people belonging to the Fundamentalist Church of Jesus Christ of Latter Day Saints. Bauman surveyed the history of marriage around the world and found that preserving monogamous marriage “represents a pressing and substantial objective for all of the reasons that have seen the ascendance of monogamous marriage as a norm in the West.” He rejected arguments that there is such a thing as “good polygamy.”

A bag full of hamburgers was the weapon of choice for a Saanich McDonald’s customer Friday night who became agitated when his meal wasn’t hot enough. Saanich police were called to the McDonald’s restaurant at Shelbourne Street and Cedar Hill X Road after the man began causing a scene inside the fast food restaurant. He had ordered six hamburgers via the drive-thru, but entered the restaurant when he found his food wasn’t to his satisfaction. The restaurant’s staff cooked up six more burgers for the unhappy customer, but the man spat out his first bite of the freshly cooked food and hurled the bag of burgers at the manager. “This dispute over the temperature of some hamburgers resulted in charges of assault, for throwing the bag, and also causing a disturbance,” said Sgt. Dean Jantzen. A 45-year-old Saanich resident was arrested and released with a future court date. The McDonald’s manager did not suffer any physical injuries from being struck by the bag of burgers.

B.C.’s tough new impaired driving penalties have helped reduce deaths by 40 per cent in the first year since they came into effect, according to preliminary figures released by the provincial government yesterday. There were 68 alcohol-related deaths across B.C. in the 12 months that ended Sept. 30, compared with 113 deaths in the previous 12 months. Premier Christy Clark said the statistics validate a decision by B.C. to implement Canada’s toughest penalties for blood alcohol readings as low as 0.05 per cent. A blood alcohol reading in the “warn” range between 0.05 and 0.08 per cent can result in a threeday driving ban, a $200 “administrative penalty” and another $250 fee to have a driver’s licence reinstated.
For roadside readings of 0.08 per cent or higher, police have the option of imposing a 90-day driving ban, a $500 fine and impounding the vehicle for 30 days. That suspension can cost a driver $3,750, including $700 for towing and storage and $1,420 to take a mandatory “responsible driver” course. “For the first time in a decade, we’ve seen a real drop in the deaths associated with impaired driving, and 45 more people made it home safe in the past year as a result,” Public Safety Minister Shirley Bond said. “Together with public education, prevention programs and criminal sanctions, the roadside penalties will continue to play a role in helping to ensure the success seen over the past year becomes a life-saving trend over the longer term.”

The Canadian Council on Social Development wants the short-form census to include questions about ethnicity and cultural heritage, aboriginal status and disability. Research suggests the current decline in Arctic sea ice is the longest and steepest in more than 1,400 years. The study co-written by scientists at the Geologic Survey of Canada uses 69 different information sources to give the most detailed history ever of the northern oceans. It concludes Arctic waters have lost more ice over the last 50 years than any time since 561 AD. The report’s authors say the most probable explanation is warmer air and sea temperatures caused by greenhouse-gas-induced climate change.

The Federal Court of Appeal ruled against the public broadcaster yesterday, saying the CBC is legally required to turn over material for review by the information commissioner of Canada. A coalition of anti-poverty groups says Canada has made little progress in the past two decades when it comes to poverty reduction. The latest report card by Campaign 2000 says the number of children living in poverty has dropped 20 per cent in 20 years. Meanwhile, the organization says Canada’s economy has more than doubled in size in that same time frame. The report finds one in 10 children lives in poverty, and the proportion jumps to one in four for children living in First Nations communities.

U.S. authorities have arrested seven men on federal hate crime charges in haircutting attacks against the Amish religious group. Authorities arrested the men yesterday at their compound in Ohio. Authorities say members of a breakaway Amish group forcefully cut the beards and hair of several Amish men and women in recent months. Among those arrested are the breakaway group’s leader and three of his sons. Cutting the hair is a highly offensive act to the Amish, who believe the Bible instructs women to let their hair grow long and men to grow beards and stop shaving once they marry.
France’s foreign minister says he will seek EU backing for humanitarian corridors or other help for Syria, amid a deadly government crackdown on opposition protesters. Foreign Minister Alain Juppe gave strong backing to the opposition Syrian National Council at a meeting in Paris yesterday with its leader, Burhan Ghalioun. Officials say the European Space Agency has received the first signal from an unmanned spacecraft bound for moon of Mars since it got stuck in Earth’s orbit. Occupy Wall Street has a benefit album planned with Jackson Browne, Third Eye Blind, Crosby & Nash, Devo, Lucinda Williams and even some of those drummers who kept an incessant beat at Manhattan’s Zuccotti Park. Participants in the protest movement said yesterday that Occupy This Album, which will be available sometime this winter, will also feature DJ Logic, Ladytron, Warren Haynes, Toots and the Maytals, Mike Limbaud, Aeroplane Pageant, Yo La Tengo and others. INCOME Activist filmmaker Michael Moore is also planning to sing. DISPARITY Jason Samel, a musician who is putting together the disc, said the goal is to raise between $1 million and $2 million US to help fuel the movement that is protesting income disparity. “It’s really going to be an amazing help for years to come,” Samel said. Money raised will go through the non-profit Alliance for Global Justice. The initial plan is that half of the proceeds will go to the New York movement that was based in Zuccotti Park until being kicked out last week, and the other half to offshoots across the world who apply for specific projects, he said. GOP presidential candidate Michele Bachmann lashed out yesterday at NBC for not apologizing or taking immediate disciplinary action for an off-colour song played during her appearance on Jimmy Fallon’s Late Night. In her first comments on the flap, Bachmann said on the Fox News Channel that the Fallon show band displayed sexism and bias by playing a snippet of a 1985 Fishbone song as she walked onstage for Tuesday’s show. The title of the song is Lyin’ Ass B----. “This is clearly a form of bias on the part of the Hollywood entertainment elite,” Bachmann said. She added, “This wouldn’t be tolerated if this was Michelle Obama. It shouldn’t be tolerated if it’s a conservative woman either.” Fallon has tweeted an apology to Bachmann, saying he was “so sorry about the intro mess.” Bachmann said she hoped to speak with Fallon and wouldn’t mind going on his show again. But Bachmann expressed surprise that she’s heard nothing from the TV network. She suggested that discipline for the show’s band, The Roots, was in order.

Cory Schneider stopped 24 shots for his second career shutout and the Vancouver Canucks extended a run of dominance against the Colorado Avalanche with a 3-0 win last night. Manny Malhotra and Alexandre Burrows had early goals while Ryan Kesler added an empty-net goal at 19:30 of the third to round out the scoring. The victory was Vancouver’s 10th in the past 12 meetings with Colorado, which fell to 1-2 in an eight-game run at the Pepsi Center that stands out as the longest continuous homestand in franchise history. Colorado came in as the third-most prolific shooting team in the league, averaging 33.5 shots per game. But the Avalanche were outshot as they struggled to find openings in Vancouver’s defence as well as break through against Schneider. Schneider, the backup to Roberto Luongo, preserved the shutout with consecutive saves near the end of a third-period power play. He stuffed a shot on the left side of the net by Ryan O’Reilly and then wheeled to his right to block O’Reilly’s attempt to shove in the rebound.
The loss also extended the Avalanche’s difficulties at home, where they have won only three times in 11 games. Leading 1-0, the Canucks added to their advantage when Burrows knocked in his sixth goal of the season midway through the second period. With defencemen Shane O’Brien sliding across the crease and goalie Semyon Varlamov dropping to his knees in an attempt to block the shot, Burrows went high, lifting the puck over them both and into the upper corner of the net. Malhotra scored the game’s first goal at 17:03 of the opening period. Buono, chasing a fifth Grey Cup title as a head coach, said a player’s performance Sunday is what counts. “My thing is what you do, you do,” he said. “What’s the big deal? “Some players, God bless them, enjoy sex. Turkey’s prime minister apologized Wednesday for the first time for the killings of nearly 14,000 people in a bombing and strafing campaign to crush a Kurdish rebellion in the 1930s. The apology by Prime Minister Recep Tayyip Erdogan was no big change of heart but a political tactic to tarnish the reputation of the opposition party, which was in power at that time. Still, this comes at a tense time for relations between Turkey and its minority Kurds, and it sparked calls for Turkey to face another dark chapter of its history, the mass killings of Armenians in 1915. Erdogan’s government is currently fighting against autonomy-seeking Kurdish rebels and despite efforts to seek peace, says it is determined to crush the rebels if they don’t lay down their arms. The fighting has killed tens of thousands since it began in 1984, but it is only the latest of several uprisings by Kurds in Turkey’s largely Kurdish southeast. Erdogan on Wednesday offered his apology for the killings of 13,806 people in the southeastern town of Dersim – now known as Tunceli – between 1936 and 1939.

A French court ruled yesterday that former dictator Manuel Noriega can be extradited to Panama to serve time for past crimes, more than 20 years after being ousted and arrested in a U.S. invasion. The elderly former Panamanian strongman hasn’t seen his homeland in more than two decades, years he spent behind bars in Florida, on drug charges, and France, for money laundering. His lawyer said he could be in Panama as soon as today. Panama wants Noriega returned to serve prison terms handed down after he was convicted in absentia for embezzlement, corruption and murder. There’s a chance that because of his age – he’s in his 70s – he may get to serve out his time under house arrest. “God Bless you,” Noriega told the French appeals court that announced the extradition approval yesterday. “God bless my family, God bless my enemies, God bless France.” “I want to return to Panama and prove my innocence,” he said,
through an interpreter. The decision comes after months of legal procedures focused on a man whose complicated past has kept judicial officials in three countries busy for years. France’s prime minister, Francois Fillon, now needs to sign an administrative decree allowing for Noriega to be transferred. “If Panama wants to do this very quickly, it will send a mili-
tary plane, and as of tomorrow night, he could be in Panama City,” Olivier Metzner, a lawyer for Noriega, told reporters in Paris yesterday. Panama’s Foreign Secretary Roberto Henriquez told a news conference in Panama later that five Panamanian officials – guards, foreign ministry employees and a doctor – will travel to France to bring back Noriega. He said Panama expects Noriega will return in tourist class on a commercial flight. Henriquez said appropriate security measures would be taken.
