FORMER TORY MP SUES HARPER OTTAWA (Canadian Press) A host of officials including Prime Minister Stephen Harper were involved in a “conspiracy” to remove Helena Guergis from cabinet and the Conservative caucus, a defamation suit filed yesterday by the former Ontario MP alleges. The allegations – that Guergis was removed based on unproven allegations, damaging her reputation and political career – are contained in a statement of claim filed with the Ontario Superior Court. “The conspiracy engaged in by the defendants was effected to serve the defendants’ political, personal and/or financial goals and not for any legitimate or lawful purpose,” reads the statement of claim. Harper fired Guergis from cabinet and kicked her out of the Conservative caucus in April 2010. He cited information he had received involving allegations of criminal conduct and referred the matter to the RCMP. Harper did not provide any details of the allegations to Guergis, according to the documents. “Harper’s advice to the plaintiff that he had become aware of allegations that the plaintiff had been involved in criminal conduct constituted flagrant and outrageous conduct,” the documents allege. A police investigation cleared Guergis of any wrongdoing and no charges were ever laid. Guergis sat as an Independent MP until the May election, when she lost her riding of Simcoe Grey to Tory Kellie Leitch. The claims contained in the documents have not been proven in court and no statement of defence has been filed, but the prime minister’s office calls the allegations groundless.

Police have released a video of potential witnesses that may have information leading to the arrest of those responsible for the murder of Maple Batalia three months ago. Batalia was 19 years old when she was shot and killed on Sept. 28 in a parkade near the Surrey campus of Simon Fraser University. She had been studying late and left for the parkade just before 1 a.m. when she was shot multiple times
in what police believe was a targeted attack. Batalia was an aspiring actress, model, who was planning to go to medical school. Those dreams were cut short three months ago. The Integrated Homicide Investigation Team (IHIT) has released a video of persons of interest, who are not suspects, but may have information important to the case. “These persons are not suspects in this crime, but may have information from before, during or after the crime that could possibly assist IHIT investigators.” said Sgt. A 36-year-old Burnaby woman and her two young daughters, aged six and four, are dead after a twovehicle crash on the Trans-Canada Highway Wednesday afternoon. RCMP and the B.C Coroners Service continue to investigate the collision, which happened at about 5:10 p.m. Dec. 21, on Highway 1 about six kilometres west of the Rogers Pass Summit. A 2003 Suzuki SUV was westbound on a straight stretch of roadway when for an unknown reason it crossed into the eastbound lane where it was struck by an eastbound commercial tractor trailer unit. “The impact of the collision was so severe that all three female occupants of the (SUV) were deceased immediately,” said Sgt. Mike Pears of the RCMP’s Trans Canada East Traffic Services in a press release. RCMP will not be releasing the names of those killed in the incident at the request of the family. The mother and her daughters were travelling from Calgary to their home in Burnaby. The driver of the truck is from the Lower Mainland and was not injured. The trucking company is based in Langley. Pears said in an interview from Golden that road conditions don’t appear to have been a factor.
“The surface wasn’t bare and dry but it sure wasn’t ice covered either, or snow covered,” he said. “They were pretty good conditions for this time of year in this area.” Pears said police are trying to determine why the woman’s vehicle veered into oncoming traffic. “Was this person tired? Were they distracted by something? ... We may never know that.” So far the only witnesses to
speak to police are the truck driver and one other person, he said. “It is the holiday season and we’re going to see a spike in traffic here in the next day and a half,” said Pears. “I’m kind of hoping that everyone will just take their time and relax, get from point A to point B safely so whoever they’re spending the holiday season with can be joyous and not have to deal with an incident like this for family members.”

Guilty | A B.C. man who performed a botched circumcision on his four-year-old son on the kitchen floor of his home has lost an appeal of his negligence conviction and been found guilty of a more serious charge: aggravated assault.

Mission RCMP are warning that both illegal and licensed marijuana grow-ops in the district are in danger of being targeted by a criminal organization performing violent “grow rips.” Both private residences and outbuildings have been targeted by this group, with as many as 32 grow rips in 2011 alone. Of that number, 10 were violent. Once a grow-op has been located, criminals have been prepared to use force to subdue occupants and steal crops, police said. In two cases victims who resisted were shot, though they survived.
A woman is in serious condition after her vehicle lost control on icy, snow covered roads and collided with a tractor trailer 52 kilometres south of Merritt on Wednesday night. According to Merritt RCMP Cpl. Shana Moritz, the female was travelling northbound on Highway 5, when it appears she lost controlled due to the winter conditions. “The female was flown to Royal Columbian Hospital where she remains in serious condition,” said Moritz. “The driver of the tractor trailer did not sustain any serious injuries.”

Billions of dollars have been put towards nipping the drug-trade in the bud, yet the ease of obtaining marijuana and its potency have bloomed, while its price has dropped, according to a prominent group lobbying for cannabis legalization. A new report by the Stop the Violence BC coalition of health, academic and justice experts was released yesterday to demonstrate the result of current antidrug policy. It uses government-funded data to show that cannabis trends are thriving, despite decades of huge cash injections to law enforcement agencies in both Canada and the U.S. “If the goal is to reduce the availability of marijuana, it’s clearly been a dramatic failure,” said Dr.

Time is running out to appeal last month’s B.C. Supreme Court ruling that upheld Canada’s ban on polygamy. The 30-day appeal period ends today, and so far there has been no appeal. Even though the province won the case, it is up to the B.C. or federal government to decide whether to send it to a higher court to ensure the ruling is applicable across the country. B.C. Attorney General Shirley Bond said her lawyers continue to review the decision.
Media outlets are once again being asked by the Vancouver police to turn over any pictures and video they have of Stanley Cup rioters. An earlier request was rejected by a B.C. Supreme Court judge because it wasn’t specific enough, so the police have re-drafted the order and served it to several Vancouver media outlets. The officer leading the Integrated Riot Investigation Team, Inspector Les Yeo, says the footage could lead to more charges from the June 15th riot. Twenty-seven people have been charged so far.

If Finance Minister Jim Flaherty still wants a national securities regulator, the Supreme Court has left him an option to get a deal done with Quebec, Alberta and other provinces who have opposed the idea for years. Though the top court yesterday turned down the minister’s plan for a single regulator, it acknowledged Ottawa has a role in addressing systemic risk to the financial system and left the door open for a national regulator if the provinces agree to a co-operative plan.
“It is open to the federal government and the provinces to exercise their respective powers over securities harmoniously, in the spirit of co-operative federalism,” the court said. Canada is the only country in the G20 without a national securities regulator. The securities industry in Canada is currently administered independently by the provinces and territories, although jurisdictions co-operate under what is called the “passport” arrangement. Ottawa has argued the present approach is cumbersome, costly and not effective in detecting and enforcing fraud. Ontario supports the idea of a national regulator as the province is the home of the TSX, Canada’s dominant stock market. But Quebec, Alberta and British Columbia oppose the plan, saying the current system works fine and Flaherty’s proposal impinges on provincial jurisdiction.

The family of a young man who was gunned down at the side of a highway in Alberta last week thanked their community today for the support they’ve received. The family of 20-year-old Mitch MacLean of Winsloe, P.E.I., says in his funeral program that they have been surrounded by love. MacLean’s funeral was held in a small United Church yesterday near Charlottetown. He was one of four young people shot last week by Derek Jensen, just north of the town of Claresholm, before Jensen killed himself.

The military watchdog investigating Canada’s handling of Afghan prisoners has penned an interim report, but the public won’t get to see it. The volunteer Santa trackers at the North American Aerospace Defence Command are bracing for tens of thousands of calls and emails when their operations centre goes live on Christmas Eve. The military base has been telling anxious children about Santa’s whereabouts every year since 1955. That was the year a Colorado Springs newspaper ad invited kids to call Santa on a hotline, but the number had a typo, and dozens of kids wound up talking to the Continental Aerospace Defence Command, NORAD’s predecessor. A U.S. appeals court has tossed out a lawsuit challenging President Barack Obama’s U.S. citizenship and his eligibility to serve as commander in chief. The convicted Lockerbie bomber claimed yesterday to have new evidence about the 1988 terrorist attack on Pan Am Flight 103 that he said could clear his name. Abdel Baset al-Megrahi was convicted in 2001 over the attack that killed 270 people when the aircraft exploded over the Scottish town. He was freed from a Scottish jail in August 2009 after doctors estimated he had only three months to live due to cancer. In an interview published in British newspapers, al-Megrahi said he had collaborated on a new book about the case, which he claimed would present new evidence.

The defence team says Manning was nearly paralyzed by internal struggles over his belief that he was a woman trapped in a man’s body. The year 2011 in television will go down as one of spectacular departures. TV icons who achieved single name status, such as Oprah, Regis and Lloyd, all left the scene. It was the departure of Charlie Sheen, however, that made the most headlines. His messy exit from Two and a Half Men was 2011’s most sensational real life soap opera. It happened in a year when one of TV’s longest-running soap operas – ABC’s All My Children – ďŹ nally faded to black. Besides Oprah Winfrey (back on a new show on her OWN network in January), Lloyd Robertson (who departed The CTV National News anchor desk after 35 years) and Regis Philbin (gone from Live! after 28 years), other big names moved on in 2011. Katie Couric gave up her anchor seat after ďŹ ve years at The CBS Evening News. Mary Hart left Entertainment Tonight after 29 years. The few viewers who still relied on analog signals in Canada were faced with saying goodbye to TV itself as the nation switched to digital transmission. Among the show cancellations in Canada in 2011, none was more shocking than the recent decision not to renew Combat Hospital. The series had a spectacular summer run on Global but was not renewed after U.S. partner ABC passed on their involvement in the series. The result was the impression of a Canadian hit being cancelled by an American network. The shutdown of So You Think
You Can Dance Canada after four seasons also took many observers by surprise. The year also saw the passing of several TV personalities, including ďŹ tness guru Jack LaLanne, longtime TV Ontario movie host Elwy Yost, MASH favourite Harry Morgan and Air Farce comedian and co-founder Roger Abbott.

The TVA Group announced yesterday it is selling its half interest in the Mystery TV specialty channel and 51 per cent interest in The Cave specialty channel to Shaw Media, which includes the former Canwest television business. Financial terms of the transaction with the media division of Shaw Communications were not disclosed. A licence transfer request, which is subject to approval by the Canadian Radio-television and Telecommunications Commission, was submitted earlier this week, TVA said in a release. Pending CRTC approval, the proposed transaction could be ďŹ nalized in the spring of 2012. The Vancouver Canucks are starting to resemble last season’s Stanley Cup finalists as they prepare for their final game before Christmas. Heading into tonight’s home contest against the Calgary Flames, the Canucks are challenging for the Northwest Division lead and a chance for home-ice advantage in the first round of the playoffs. Vancouver has lost only three of its past 12 games since November 20, evoking memories of a similar strong run (18-1-3) around this time last year. “You’d have to say now, for almost six weeks here, our game has been pretty good on most nights,” coach Alain Vigneault said earlier this week. “We’re not perfect, but on most nights, we play the right way.” As usual, the Canucks (20-11-2) are getting considerable offensive input from the Sedin twins. Prior to last night’s games, Henrik Sedin sat second in NHL scoring with 40 points while Daniel, who led all point-getters last season, had a share of third with 39. But Vancouver is also getting offensive help from unlikely sources. Mason Raymond and Jannik Hansen have been two of the biggest surprises. The 25-year-old Herlev, Denmark native is on a threegame points streak and has contributed offensively in 10 of the past 15 games while shifting between the first, second and third line. Since beginning their winning tear with a 2-1 win over Ottawa on Nov. 20, the Canucks have allowed 30 fewer goals than they have scored, netting 56 while only surrendering 26. Nazem Kadri’s latest audition with the Toronto Maple Leafs is off to a roaring start. The winger snapped the winning goal past Ryan Miller’s glove in the third period as the Maple Leafs beat the Buffalo Sabres 3-2 last night. It came one day after Kadri was recalled following a 22-game stint in the American Hockey League. The former first round pick looked poised with the puck all night long and scored the winner at 5:52 of the third period after taking a nice drop pass from Clarke MacArthur. David Steckel and Phil Kessel also had goals while James Reimer made 40 saves for the Maple Leafs (16-13-4), who moved up to sixth spot in the tight Eastern Conference standings. Jason Pominville and Derek Roy replied for Buffalo (16-14-3). Kadri’s winning goal was an important one for a Leafs team that has been sliding of late. They won for just the third time in 10 games and gained valuable points on a division rival that they’ll likely be battling for a playoff spot down the stretch. Buffalo is also reeling as it heads into the Christmas break. The banged-up team can use the time off as leading scorer Tomas Vanek left in the third period, making it seven regulars out of the lineup.

RECAPTURING GOLD A TOUGH TASK AT WORLD JUNIORS
Canada is again a contender for gold at the world junior hockey championship, but the host country will have to fight off stiff challenges from the United States, Russia and Sweden. Canada opens the 2012 world junior tournament Sunday in Edmonton against Finland, a dark horse in the race for gold.
Tennis | Former Australian tennis player Brad Drewett has been named the new head of the ATP men’s tennis tour. Canadian teams have reached the final of this tournament every year for the last decade and won half of them. Fair or not, Canadians have come to depend on seeing their country in the championship game. So the biggest challenge Canada’s 2012 edition faces is avoiding a sense of entitlement in this tournament. On the back of the Don Hay players’ T-shirts during selection camp earlier this month was the slogan “Earned, not given.” “There’s no rule that we deserve gold every year,” Canadian head
coach Don Hay said. “Other countries want it too and there’s other countries that believe they play the right way.” After a run of five straight gold, Canada lost in overtime to the U.S. in the 2010 final and spectacularly collapsed in the 2011 final, when Russia scored five unanswered goals in the third period to win 5-3. Canada plays its Pool B games against Finland, the Czech Republic, Denmark and the U.S. Defending champion Russia, Sweden, Switzerland, Slovakia and Latvia play Pool A games in Calgary.
