The American Bankruptcy Institute (ABI) attained new milestones while launching several new initiatives during the past year.Total ABI membership has sailed past 9,500 members, making ABI the world’s largest organization dealing with insolvency matters. Service to the growing ranks of new practitioners is enhanced by a new educational program on the fundamentals of bankruptcy.This popular program, introduced at the 2003 Annual Spring Meeting, is also available online at the ABI World website. Meanwhile, both of the semi-annual membership meetings and each of the regional conferences set new attendance marks this year. Four new titles were added to the growing ABI library of publications, spanning a range of diverse topics from consumer bankruptcy to the European Union insolvency regulations. Several new books are planned for 2004. ABI’s Endowment Fund is now past $1 million. Our strong commitment to research was demonstrated by the funding of several new grants to scholars and the underwriting of an academic symposium marking the 25th anniversary of the enactment of the U.S. Bankruptcy Code.

Our award-winning website now attracts over 2 million views per month and nearly 7,000 unique visits per day. A major overhaul of the site is set for late 2003, to provide both a fresh look and improved functionality. Also revamped is the joint website on asset sales. A new site on international insolvency has great promise as a resource for those dealing with cross border insolvencies. Finally, our service to members was further evidenced by the creation of the new ABI Career Center, to help both job seekers and employers find the right fit in the dynamic insolvency employment market.

Annual Spring Meeting The 2003 Annual Spring Meeting in Washington saw a record 900 attendees.The Seventh Annual “Great Debates” focused on hot topics such as retention bonuses for key executives and critical vendor motions. Educational panels addressed the essentials of effective trial practice, equitable subordination, first-day orders, preferences and out-of-court alternatives to bankruptcy. Consumer bankruptcy sessions focused on chapter 13 trends and ethics.The program featured two former U.S. Attorneys General: Hon. Griffin Bell, who served as the keynote lunch speaker, and Hon. Dick Thornburgh, who spoke on his role as the examiner in the WorldCom case. The event concluded with a gala dinner and concert by Motown legends The Commodores.

More than 600 attended the 2002 Winter Leadership Conference at LaPaloma Resort in Tucson, Arizona. Among the topics were panels on the scope of Section 105 powers, intellectual property issues in bankruptcy, wage and benefit claims and the controversy over indemnification of non-attorney professionals. Noted economist and television host Stuart Varney provided a forecast of the U.S. economy and financial markets during a luncheon keynote.

Regional Programs ABI’s popular regional programs thrived over the past year, with each one setting new attendance marks.The workshop format of the programs allows members to customize their educational experience.The largest regional conference is the Northeast Bankruptcy Conference. In 2003, this program surpassed 600 registrants for an event at beautiful Newport, Rhode Island. Other ABI educational initiatives include programs for state court judges (now in its 13th year) and government agency counsel (new in 2003).

ABI’s Robert M. Zinman Resident Scholars (Prof. David Epstein and Prof. Marianne Culhane) responded to Capitol Hill requests for analysis and comment on various legislative proposals and prospective amendments to H.R 975. Prof. Jack Williams, a previous Zinman Scholar, commented on the impact of a proposed amendment to change the tax attributes of certain actions taken by WorldCom. Comments from ABI are not limited to the academic community. Bankruptcy judges Eugene Wedoff and Thomas Small developed a package of recommendations, titled A Proposal for More Effective Bankruptcy Reform, to address the goals of bankruptcy reform, while limiting unproductive administrative procedures. ABI’s Legislative Committee, co-chaired by judges David Houston and George Paine, regularly invites the key Hill staff to update our members during the Annual Spring Meeting on the prospects for reform. The history of bankruptcy policy is an important part of the ABI’s October 2003 Symposium marking the 25th anniversary of the enactment of the Bankruptcy Code of 1978. Should the current bankruptcy reform bill become law, ABI will sponsor a series of teleseminar programs for members covering the important changes in both personal and business bankruptcy.
This year marks the sixth year that Congress has considered comprehensive bankruptcy reform.The legislation (H.R. 975) passed the House of Representatives in the spring of 2003 and is pending in the Senate. While ABI is not a lobbying group with a particular agenda, our members are frequently called upon to assist Congress’ understanding of bankruptcy issues and policy.

ABI is the largest of 32 member associations in INSOL International, the worldwide federation of insolvency professionals. ABI and INSOL created www.globalINSOLvency.com, a new website devoted to international insolvency.The website was launched during INSOL’s 2003 conference in the Americas (in Las Vegas).The 2003 ABI Southwest Bankruptcy Conference, also held in Las Vegas, held a panel on cross-border current developments as a segue to the INSOL conference. Also new this year is a primer on the new European Union Regulations on Insolvency Proceedings, written by Prof. Bob Wessels, a Dutch lawyer and noted commercial law professor at Vrije University in Amsterdam. The book covers jurisdictional issues, winding up proceedings such as the appointment of a liquidator, recognition of judgments, creditors rights and other provisions.

National Moot Court Competition A record 28 law schools competed in the 2003 Conrad B. Duberstein National Moot Court Competition.The event, now in its 12th year, is the only national competition devoted to bankruptcy. It is held each year at the U.S. Court of Appeals for the Second Circuit and is named in honor of Judge Duberstein, a former member of the ABI Board of Directors and the Chief Judge of the Eastern District of New York.The 2003 competition was won by the University of Miami School of Law, coached by ABI Director Patricia Redmond (Stearns, Weaver et al.).
ABI presented the 2003 Medal of Excellence in Bankruptcy to over 100 top students around the country. Medal recipients are selected by each law school’s bankruptcy faculty, and typically receive their awards during school commencement exercises. Winners receive engraved medals and certificates of achievement, as well as a complimentary one-year ABI membership. Now in its sixth year, the program is coordinated by ABI Director Christopher Graham (Thacher, Proffitt & Wood; New York).
MBA Programs ABI and the Kellogg School of Business at Northwestern University are developing a graduate business school competition, where the nation’s top MBA students would prepare and present business plans to save financially troubled companies.The presentations would be made to blue-ribbon panels of CEO’s, CFO’s, turnaround experts and judges. Kellogg is the nation’s top graduate business school. ABI will administer the program, sponsor a faculty stipend and provide financial awards for the winning schools.

According to the American Board Association, approximately 30,000 attorneys are board certified in one or more practice areas.We have demonstrated the value of the rigorous ABC certification process in that the number of certified attorney continues to rise and our retention rate for certified attorneys averages 97%. ABC will soon grow to over 1,000 certificate holders.This growth reflects the trend among attorneys and law firms in recognizing the value of board certification and firms encouraging their eligible attorneys to become certified.The Board recently implemented new procedures to make it easier for firms seeking to have multiple attorneys certified. Recognition of ABC certification continues at the state level as well.The ABC programs gained additional accreditations from the Ohio Supreme Court and the Indiana Supreme Court, and the Iowa and Arkansas Supreme Courts enacted rules changes that recognize certification.
