Educational Programs In addition to expanding the number of educational program opportunities this year, ABI introduced a number of new delivery systems to provide members with the latest information on the new bankruptcy law, offer new ways to meet continuing education requirements and accommodate busy schedules.

Webinars on the New Law

Regional Programs

After the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) was signed into law by President Bush on April 20, ABI began offering educational programs on the new law. ABI’s seven-part Webinar series offered comprehensive coverage of both consumer and business bankruptcy practice under the new law.

ABI offered several new regional programs this year. The first-ever Mid Atlantic Conference, held August 4-6 in Cambridge, Md., was well received and will become an annual regional event. Also for the first time, ABI will present the Detroit Bankruptcy Conference on November 11, 2005. Other regional meetings remained popular and included the annual Views from the Bench program, the intensive learn-bydoing Litigation Skills Symposium and the regular roster of regional programs. Cross-border programs included the Canadian/American Bankruptcy Program in Toronto and the Caribbean Insolvency Symposium, held in Puerto Rico.

Annual Spring Meeting More than 1,200 members attended the 23rd Annual Spring Meeting, the first national educational program focused on bankruptcy following President Bush’s signing of the new bankruptcy law. In addition to the wide array of sessions that included coverage of the newly passed law, attendees were treated to a keynote address by syndicated columnist George F. Will. The final night dinner featured comedian Richard Jeni and the all-ABI member band, the Indubitable Equivalents.

Winter Leadership Conference The 2004 Winter Leadership Conference in Scottsdale, Ariz., attended by more than 750, offered numerous educational sessions. In addition to a variety of optional events, attendees were treated to a keynote by bestselling author and political commentator Michael Barone and the Indubitable Equivalents, who brought down the house with their debut appearance at the final night dinner.

“Best of ABI” Programs In 2005 ABI began offering the highest-rated sessions from each ABI program in a teleconference/ Webinar format. Those who were unable to attend these sessions live are now able to experience the original program, including speakers and educational materials, via phone and Web, or access the archived version of the program 24-7-365.

EventXpress The new EventXpress Registration Kiosk system now allows members to check themselves in at ABI educational programs, accurately track CLE credits and purchase optional event tickets onsite.

Nearly eight years of congressional action on bankruptcy culminated in enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act (Public Law 109-8) on April 20. BAPCPA is the most significant legislative development since passage of the 1978 Code and represents a sea-change in U.S. debtor-creditor relations. Most of the provisions apply to cases filed on or after the effective date of October 17, 2005. The mere 180-day effective date window meant that ABI had to immediately plan and implement educational programs for our members. ABI swiftly announced a seven-part series of Webinars on the coming new law. The Webinars utilized advanced distance learning technologies to provide a rich visual and audio experience. The programs were extremely popular: More than 2,000 practitioners registered for more than 10 hours of detailed CLE coverage. Three of the programs were devoted to consumer bankruptcy law and three covered the business bankruptcy changes. The final program featured seven leading bankruptcy judges from around the nation, providing their views on the controversial law’s key elements. The series was offered without charge to bankruptcy judges and their law clerks, as a service to the Third Branch.

Research The ABI Endowment Fund, created in 1989 to provide a resource for the Institute’s mission of scholarly research and education, continued its growth this year. The Fund now totals more than $1.4 million in contributions and pledges from nearly 4,000 members. Many members have donated via the voluntary $30 tax-deductible gift option as part of their annual membership renewal. Since 1998, when the first research grant was made, the Endowment has funded nearly $500,000 in awards.

In late 2004, the Endowment Fund awarded a $346,000 grant to Stephen J. Lubben, Associate Professor of Law at Seton Hall University School of Law, to study professional fees in business bankruptcy cases. The study will provide the most comprehensive, independent look at professional fees in chapter 11 cases to date. It is expected to include 1,000 cases, vastly exceeding the sample size of any prior study on this topic. Preliminary work on the study began in mid-2005, and the final report will be completed by the fall of 2007. This year, the Fund also awarded a $21,100 grant to Memphis-based RISE Foundation to study consumer bankruptcy from the debtor’s perspective. Memphis has the nation’s highest per capita filing rate. The results will assist practitioners and policy-makers in evaluating the factors behind the high filing rate in the Western District of Tennessee and will provide insight into the debtor’s life after bankruptcy.

ABI World ABI continued to expand the scope of its online resources for members this year, adding a number of new features to the ABI World Web site (www.abiworld.org), offering online Webinars, Web chats and much more. The popular ABI World Web site continued to add to its wide variety of online resources, which are available to members 24-7-365. The Web site offered minute-to-minute news and analysis as bankruptcy reform legislation made its way through Congress in early 2005. The site offered in-depth analysis of the new provisions, up-to-the-minute votes on amendments, debate transcripts, media coverage and much more. Once the new law was signed by the president on April 20, ABI began offering numerous resources to address practice under the new law. The ABI World Web site offers many popular features, including a newly upgraded “Cracking the Code” interactive newsletter, back issues of the popular ABI Journal and ABI Law

Review, an online Membership Directory, daily bankruptcy headlines, the ABI Career Center, Circuit Case Updates, bankruptcy opinions and much, much more. With more than 110,000 searchable online documents, ABI World is the best online resource for bankruptcy professionals. Due to the sheer amount of information offered at the Web site, in the spring of 2005 the ABI staff created easy-to-understand tutorials demonstrating the many features of the Web site. The full series can be accessed at any time from the ABI World home page.

Online Programs ABI enhanced its online educational offerings this year, offering the “Best of ABI” program from each of the regional conferences, online question-and-answer sessions and a Webinar series on the new law. With a growing number of states offering continuing education credit for online programs, the new delivery system provides a convenient alternative to traveling to a meeting. An archive of past events allows members to register and receive content on-demand in the convenience of their offices.

New Titles and Updates ABI introduced several new titles to its diverse array of publications this year and began updating the entire catalog to account for changes made by the new law. Getting Paid: Retention and Compensation in Bankruptcy Cases– A Guide for Non-attorney Professionals, released in the spring, discusses the various aspects of the professional retention and fees process. Also introduced this year was the second edition of the ABI Health Care Insolvency Manual, a significantly expanded and updated version of the first edition published in 1997. The manual, which includes the significant health care and nonprofit provisions of BAPCPA, is designed to be an easily accessible and user-friendly introduction of the basics of business bankruptcy for the health care professional and the basics of health care law for the bankruptcy professional. New titles and updates to current ABI publications covering the new law will be released in 2005 and 2006 and made available through the online bookstore at ABI World (www.abiworld.org). The bookstore provides a full description of all ABI publications and allows for online purchase at any time.

ABI Committee e-Newsletters ABI’s 20 committees publish quarterly e-newsletters that provide committee members with the latest news and information. All members can read these electronic newsletters online at ABI World.

Membership surpassed 11,000 during 2005, just 15 months after breaking the 10,000member mark, making ABI not only the largest and most diverse insolvency organization, but the fastest-growing as well. ABI members are experienced leaders in the practice. Surveys show that 44 percent have over 20 years in the field and 72 percent have at least 10 years in practice. All disciplines are well represented: While most are involved in commercial and business bankruptcies, nearly a third do at least some consumer bankruptcy work.

Many members join ABI via conference or seminar attendance. Nearly 250 members joined during the first eight months of 2005 by this method. Many also value the ability to network with professionals across disciplines nationwide. Responding to members’ desire for more local networking events, ABI hosted several receptions in cities not served by regional conferences, including Cleveland, Seattle, San Antonio and San Francisco, with other events planned for Orlando, Boston and St. Louis.

The new “Get Involved” initiative makes it easy for all members to play an active role in ABI by writing for publications, moderating a listserve and helping to plan committee programs. Each of ABI’s 20 member committees has produced at least one electronic newsletter this year, featuring content of interest and providing new opportunities for members to be published.

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 dominated this year’s bankruptcy news coverage, followed closely by the financial crisis facing the nation’s airlines, pending asbestos litigation and pension funding crises. ABI leaders from all over the country were interviewed by news outlets as diverse as The Washington Post, The New York Times, The Wall Street Journal, the Los Angeles Times, CNBC, the Associated Press, CNN, NPR, C-SPAN, The National Law Journal and Voice of America, and ABI was cited more than 1,500 times. Among the most requested information was the law’s effect on consumers, whether people/companies will rush to file ahead of October 17, and consumer credit issues.

Online Newsroom ABI’s online Newsroom offers a wide range of information to journalists, from bankruptcy statistics to grant awards and ABI events. More than one million “hits” on ABI World’s Statistics and Press Room sections from September 2004 to August 2005 confirm the site’s value to news organizations.

Dow Jones Daily Review Small Cap ABI leadership continued to provide commentary to Dow Jones Daily Review Small Cap, an initiative that began last year. President John D. Penn and Immediate Past President Michael P. Richman provided commentary on the new bankruptcy law and the efficacy of the U.S. bankruptcy system. The articles can be found at www.abiworld.org.


Law Review

The American Bankruptcy Institute Law Review is the nation’s largest-circulation bankruptcy law journal. Edited by top students at St. John’s University School of Law, it is published semi-annually by Thomson West. An advisory board of more than three dozen bankruptcy judges, practitioners and academics help to plan thematic issues, edit articles and assist in the production of each issue. The board is headed by Prof. G. Ray Warner, director of the bankruptcy LL.M. program at St. John’s and a former ABI Director and Resident Scholar. The Law Review has been cited in more than 900 law reviews and court opinions and is frequently on the leading edge of trends in the law. The past year continued this tradition. The Spring 2005 issue featured a special roundtable on the cutting-edge issues involved in the bankruptcy filings of several Roman Catholic dioceses. The cases have enormous implications for the rights of religious institutions in civil society. Leading constitutional law scholars such as Douglas Laycock (University of Texas) joined bankruptcy scholars such as David Skeel (University of Pennsylvania) and Jonathan Lipson (Temple University), as well as practitioners experienced on both the creditor and debtor side of church bankruptcies. The roundtable discussion predicted accurately the recent bankruptcy court decisions expanding the scope of estate property. Other feature articles in the spring issue were written by Prof. Ralph Brubaker (University of Illinois) and Prof. Marie T. Reilly (University of South Carolina). Prof. Brubaker wrote on state sovereign immunity in the wake of the Supreme Court’s Hood decision, while Prof. Reilly wrote on the “reasonably equivalent value” standard after BFP v. Resolution Trust Co.

International Activity As globalization increasingly impacts the insolvency world, the need for the sharing of experiences, techniques and strategies among lawyers, accountants, trustees, restructuring professionals, government officials and lenders continues to grow. ABI offers a number of tools, resources and educational programs to help insolvency professionals meet the growing cross-border challenges insolvency professionals face today.

Cross-border Educational Programs In February 2005 the Canadian/American Symposium, attended by nearly 300 insolvency professionals, featured prominent practitioners and judges from both nations and covered leading issues such as ancillary proceedings and judisdiction, personal liability for directors, Faculty for the 2005 Toronto program. officers and professionals, workouts under both nations’ legal regimes and negotiating labor issues under both the Code and the CCAA (Canada). Dean Ian Holloway of the University of Western Ontario called it the “insolvency event of the year” in Canada. More than 80 insolvency professionals from Puerto Rico, Latin America and 15 U.S. states attended ABI’s first Caribbean Insolvency Symposium, held in San Juan Nov. 11-12. Special guests included Puerto Rico’s Secretary of State Jose M. IzquierdoCaribbean program planners: Encarnacion and Julio David Friedman, Josefina Fernandez Fontanet, president of the McEvoy and Judge Jerry Carlo. Puerto Rico Bar Association, along with bankruptcy judges Gerardo A. Carlo and Enrique Lamoutte. The program was simultaneously translated in Spanish-English. Other cross-border educational sessions include the International Insolvency Symposium, held Sept. 23, in London, and the next Caribbean Insolvency Symposium, planned for February 9-10, 2006, in Miami.

International Committee Activity ABI’s International Committee held two continuing legal education programs this year and published four electronic newsletters, covering broad ancillary relief in Canadian and U.S. Bankruptcy courts and the new chapter 15. “European Update” is now a regular feature in the ABI Journal.

Other Resources The ABI Journal’s “The International Scene” column provides in-depth articles on cross-border issues; all past articles are available to members at ABI World. The GlobalINSOLvency.com Web site is another useful resource on crossborder issues. The site, partnered with INSOL International, features daily economic and insolvency news from around the globe, links to international organizations, international legislative developments and much more.

Corporate Restructuring Competition The Institute’s inaugural Corporate Restructuring Competition, held Nov. 11-14, 2004, at the Kellogg Graduate School of Management at Northwestern University, included eight of the nation’s best business schools. The 2004 winner was Stanford University’s Graduate School of Business. Sponsored by Houlihan Lokey Howard & Zukin, the competition encourages second-year MBA students to find creative solutions to real-world problems and provides them with opportunities to network with some of the top professionals in the fields of finance, corporate renewal and restructuring accounting. The 2005 competition, expanding to 12 top schools, is scheduled for Nov. 11-13, 2005.

National Bankruptcy Moot Court Competition The 13th Annual Conrad B. Duberstein National Moot Court Competition – the only national competition devoted to bankruptcy – included nearly 40 law school teams. The 2005 winner was the University of Connecticut School of Law. More than 600 insolvency professionals attended the final night awards dinner at Pier 60 in Manhattan. The competition, hosted by ABI and St. John’s University School of Law, is named in honor of Judge Duberstein, a former member of the ABI Board of Directors and the Chief Bankruptcy Judge of the Eastern District of New York.

Annual Bankruptcy LL.M. Scholarship Each year ABI awards a $15,000 scholarship to a student in the bankruptcy LL.M. program at St. John’s University School of Law. The LL.M. program is the only one of its kind, and the award reflects ABI’s long-standing partnership with St. John’s.

Annual Medal of Excellence More than 100 law school students around the country were presented with ABI’s Medal of Excellence Awards this year. Medal recipients, selected by each law school’s bankruptcy faculty, receive engraved medals and certificates of achievement, as well as a complimentary one-year ABI membership. ABI Director Christopher F. Graham (Thacher Proffitt & Wood; New York) is the program director. William & Mary Law School’s Prof. A. New Bankruptcy Act Recognizes Value of Certification The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (S. 256), signed by President Bush in April 2005, includes a provision that allows bankruptcy courts to increase professional compensation awards to attorneys who are board certified. Specifically, the new law amends 11 U.S.C. §330(a)(3) to include a new section as follows: with respect to a professional person, whether the person is board certified or otherwise has demonstrated skill and experience in the bankruptcy field . . . Legislators and the courts recognize that the successful operation of the bankruptcy system depends on the involvement of professionals with Business Bankruptcy ....491 special expertise. Board certification provides a Consumer Bankruptcy ..296 simple, meaningful and objective measure of skill and Creditors’ Rights ..........114 expertise in the bankruptcy field. The American Board Total: 901 of Certification (ABC) administers the only national legal specialty certification programs in consumer bankruptcy law and business bankruptcy law. The ABC Faculty Committee jumped to action after passage of the new law and began developing a new exam. All exams administered in 2006 will be based on the new law.

Current ABC Certifications Issued

ABA Recognition of Certification In August 2004 the American Bar Association (ABA) House of Delegates granted reaccreditation of the ABC business bankruptcy, consumer bankruptcy and creditors’ rights programs for an additional five years. The programs have been ABA accredited since 1993. Sixteen states recognize ABA accreditation as the sole or partial criteria for approving certifying organizations in the state. The ABA accreditation process includes a review of examinations, application requirements and organization policies and procedures.

Dear Members: During the 2004 calendar year, the American Bankruptcy Institute again strengthened its financial position. As a result of growth in membership, the income from numerous educational programs and publications, and the many contributions from supportive sponsors, total net assets have increased by approximately $560,000. This solid financial position shall permit ABI to continue to implement and provide the highest quality and varied programs for its current and future members. Tate & Tryon issued financial statements for 2004 that were presented by the Chief Financial Officer and me to the ABI Board of Directors at its Annual Spring Meeting last April. We reported that the independent auditors issued an unqualified "clean report" in conformity with generally accepted accounting principles.
