Concurrent Workshops Another One Bites the Dust: Dealing with Failed Banks and FDIC Receiverships

This panel will explore the myriad issues raised by the growing number of bank failures, both in and out of bankruptcy cases, including discussions of regulatory and enforcement actions taken prior to a bank being taken over, cease-and-desist orders, disposition of bank assets, management and enforcement of a failed bank’s loans, and the broad powers granted to a bank receiver under FIRREA. The panel will also delve into issues faced by bank holding companies in bankruptcy, including disputes with bank receivers over standing to bring director and officer litigation, ownership of tax refunds, the validity (or lack thereof) of claims for §507(a)(9) priority by the FDIC as receiver, and related issues.

The ABI Players once again present another Boris Badenough saga, this time addressing ethical issues facing attorneys in representing both business entities who are controlled by hopelessly conflicted persons (and whether those persons are your clients or not) and hyper-aggressive creditors who will stop at nothing to profit from the financial misfortune of others. Our play is a study of Ghoulworld Inc., a revitalized theme park and entertainment center that does not feature popular Monstars, and how its descent into bankruptcy would make Edgar Allan Poe cringe.

Visit the island’s only working ranch, located on a 200+ acre preserve where you can witness dolphins, shorebirds and other sea island wildlife. Saddle up and take a ride on one of the gentle, well-trained horses and enjoy the beautiful beaches of southern Amelia Island! The ride is five miles and takes approximately one hour. There is a 230-pound weight limit. The height requirement is 4’10,” and all riders must be at least 12 years of age. An adult must accompany anyone under 18 years of age.
