ABOUT THE COMPETITION

he annual Chief Judge Conrad B. Duberstein Bankruptcy Moot Court Competition is widely recognized as one of the nation’s preeminent moot court competitions. The Competition is supported by the generous contributions of bankruptcy law firms and lawyers who purchase tables and tickets to the Gala Awards Banquet and advertisements in the Awards Banquet Program. The Gala Awards Banquet is one of the major social events of the New York area bankruptcy bench and bar. The banquet regularly draws more than 800 attendees, including many of the leading bankruptcy judges and practitioners from New York and around the country.

The competition promotes and recognizes the finest oral and written advocacy on significant issues in bankruptcy practice. Approximately 50 law school teams participate, making this the largest single site appellate moot court competition. This year’s problem involves a Ponzi investment scheme and raises two hot current topics: whether a sophisticated investor who becomes suspicious and withdraws funds is denied the protection provided to good-faith transferees, and whether a bankruptcy trustee can waive an individual debtor’s attorney/client privilege.

The Duberstein Competition is well known for the quality of its judging. New York is a center of bankruptcy practice, and area bankruptcy practitioners judge the preliminary rounds and briefs.
