Why do you want to be a youth who active in organization?

“Because I think in this world, not only about theory. But we also need adequate softskill. By organizing in ALSA I am sure I can develop my softskill as in making public law argument well, both written and oral. Also in ALSA I can develop my links with many friends and agencies outside the Law Faculty of Universitas Airlangga. This opportunity is very rare and I use it well for my future.”

Mas Alif, as a poject ofcer and project manager of an event, how to be a good leader to make the event success ?

Mbak Devi, as a vice project ofcer of an event, how to be a good leader to make the event success ?

A : First, everyone in the committee must have a trust to each other. If we trust each other, it can motivate the committee to explore their ideas. Second, it requires good teamwor k and comfor table atmosphere will result a good teamwork in the committee. The two factros that i have mentioned are the steps to make a good and successful event.

A : ALSA LC Unair anniversary event can be called as a successful event because of the good communication of the committee. The coordinators and their members have their own intiaive to work on their job. They always remind me or Dika to do our job too. the committee always remind each other's job. Me and Dika always try to unify the committee. We try to make the group chat as active as possible and we use this to make everyone did not bored and always remember to do their job. We also free themselves to choose persons to work with after they communicate it with me or Dika.

What makes Mas Alif wanted to contribute in the events like the one Mas Alif has already created ? A: My motivation to join ALSA LC Unair's events is to practice my soft-skills. If we joined and contributed to some events , we can practice our leadership and we can socialize more and it can be useful for ourselves.

What makes Mbak Devi wanted to contribute in the events like the one Mbak Devi has already created ? A : I wanted to have many experiences especially as a leader. I want to learn how to manage other person to make a good teamwork, and of course to make more friends.

Annual Break-Fasting and Charity ALSA's break-fasting event is a internal division's event. In this year, this event came up with the theme “We Care We Share”. It was held on June, 9th 2017. This year events was different from the previous event because it is not just break-fasting toegther, the members also share Takjil for the motor-drivers passing in front of campus B, Unair. This Break-fasting event also provide some games to make the members of ALSA LC Unair close to each other.

OOTD Competition This funding division's event was held on July, 24th-30th 2017. This event requires the participant who joined the competition to use ALSA merchandise. The one who got the most vote is the winner. This year winner is Bima Ade W. From batch 2014.

Study Trip Japan This ALSA international event's was held on August, 18th-22th 2017. ALSA LC Unai sent its two delegation. Shara Sanina Narisaputri and Chyesza Mega Andhini. There are many events joined by them. One of the the events is table discussion with the theme “Prostitution and Buying Sex”. They also met many delegations from other Asian country such as Singapore, Malaysia, Taiwan Korea, Thailand, etc. The benets for joining this study trip are having more friends and more insight.

Video Reference This event was held on August, 22th 2017 with the theme “Patriarchy System on Sultan Yogyakarta Heir and The Effects on DIY Governor Shifting Position”. The speaker is Drs. Tavip Agus Rayanto, Msi., the head of DIY Development Planning Board (Bappeda). In this video conference event, ALSA LC Unair also had a discussion with ALSA LC UI and ALSA LC Syiah Kuala University.

NMCC Class II NMCC Class II which was held on August, 28th 2017 is one of the pre-event for MA Cup XXI in Sriwijaya University, Palembang. The topic is case position studies NMCC MA Cup XXI with the speaker Iqbal Felisiano, S.H.,LL.M., a lecturer from Faculty of Law in Universitas Airlangga. This NMCC Class II's purpose is to make the delegation could developed the case position well and give the best for NMCC MA Cup XXI.

IMCC Sharing This event was held on August 24th 2017. IMCC sharing is a place to share experiences in joining NMCC and also to intoduce NMCC itself.

Ÿ BACKGROUND

An act which is prohibited, prosecuted, and punished by criminal law is the denition of crime. Bentham explained that actions which harms one or many others are the ones called criminal offense. Based on the deniton of crime, it is clear that the perpretator of every crime wil recieve sanctions. The range of punishments, not only from one crime to another but also from one country to another, is vast. Although, mostly but not always, legally the perprator must go through trial before they are convicted if proven guilty. The purpose of giving sanctions for every violation of law are intended to give the culprit a detterent effect, to discourage others of doing crime and most importantly to give justice to the victim. All of the above are all positive intentions of punishment when the proceedings are done right. Unfortunately, mistakes and imperfections are inevitable. As a consequence, innocent people could be a victim of wrongful convictions. Wrongful Conviction is an issue all around the world. Wrongful convictions are a tragedy which caused huge consequences not only to the innocents sent to prison but also to society. The innocents will be striped from their right to freedom, from their right to spend time with their family and friends, and a whole lot of other things. Meanwhile, the real perpretator remains at large and at liberty to do other crimes. In addition, wrongful conviction doesn't merely happen in cases with light punishment but as well as cases with death penalty. CAUSES OF WRONGFUL CONVICTIONS This picture of injustice, which is not uncommon, is a result of several unfortunate factors. Such factors are misidentication, tunnel visions, plea bargains or false confessions. 1. MISIDENTIFICATION Misidentication can happen either from the victim or eyewitnesses which is inuenced from different aspects such as cognitive and psycology. In detail, trauma, lighting, the duration of looking at the perpretator among other things, can cause misidentication. Fear of being pointed at with a weapon can also cause a person to lose focus on the perpetrator and make them see unclearly. Another reason is that sometimes victims or witnesses compare a person who look like the perpretaro as the perpretator themselves. There are some cases of wrongful convictions caused by misidentication which are revealed years later with the help of DNA tests. Identication of the offender from the victim is the easiest way to solve the case and supposedly reliable. However, as a result of various factors, the certainty of it shoulds be doubted. 2 2

2. TUNNEL VISIONS It is not uncommon to nd tunneled visions in criminal cases. This can happen when prosecutors or the police are convinced with a conclusion of a case that can cause them to focus on a suspect which might be innocent. They are too focused on trying to prove that suspect guilt that they often not consider the facts which point to other directions. The will to close a case as soon as possible is also one of the reason of tunneled visions. A prosecutor and the police should make justice and nding the real perpretator their rst priority. 3. PLEA BARGAINS as well as FALSE CONFESSIONS Plea bargain and false confessions are two things which in some cases could be one and the same. A person who is under an investigation is not seldom to nd themselves being treated poorly or tortured by the investigator. The invsetigators would cut back their meals and drinks, give them an endless interogation or give them false promises and threats. All of those things are done to trick the suspect to give false confessions. In another hand, the innocents think that there is no hope in proving their innocence that they would rather choose to take a plea bargain in order to recieve lighter sanctions. These innocent people would often choose to give false confession of a crime they did not commit not only due to the stress they are recieving, but also due to the believe that it is better to take a plea bargain with the likelihood of lighter sanctions rather than face a long trial which will not guarantee the proof of their innocence.

DISCUSSION Compensation for the Wrongfully Imprisoned Innocents Wrongful convictions, normally, are revealed and proven after decade of imprisonment. Those times are precious time but also wasted time that could have been spent with family and friends, building a carrier od doing things that they love. Moreover, even they have been proven not guilty, it will stil be difcult for them in reentering society. Despite their proven innocence, their crimnal records are rarely cleared and also they would have no money, housing, jobs and health care as they walk free out of prison. It is inevitable that no system is perfect, but ssing the injustice that happens to these people. It is a responsibility for society and state to provide an aqual compensation and a compassionate assistance for those who are wrongly convicted in reentering society. Here are a few things that the state and society could do 1. Financial Support Considering that these people did not work all the years they spent in prison and might not be recieving money, the rst thing state could do is give them nancial support. The state should give them an amount of money for each year these innocents spent in prison. This should be a non-deducible tax money so that these people could recieve the whole sum of money. 2. Help Securing Affordable Housing Just like every person, these people need a place to stay. The state could help them nd or even provide them a temporary place to stay until they could own a place of their own. Furthermore, the state should also help them on nding a decent and affordable place to stay. 3. Counseling Service This tragedy that happend to these people is not a tragedy to be taken lightly. They had faced a terrible event in their life. Even more, the life in prison is a nightmare on its 2 3

own. In consideration of those things, the state should help them on facingand relieving those stress or trauma. Health Care Health is one of the essential things in life. Every person needs to take care of their health. The state could give free health care for the innocents that are wrongfully convicted or they could be given a health insurance for the rest of their life. Education and Development of Work Skills After years of spending their time in prison, they might not be used to what the world is at the moment of their release. They might need help in getting used to how the world is. State should educate or help them in getting used and tting in to the world they know now. Those people should also recieve education on developing their work skill so that they could land a job and live properly. Expunge Criminal Records The criminal records of these innocents are rarely cleared altough their innocence have been proven. In this situation, state should guarantee that their criminal records be expunged and annouced it to society.

Ÿ CONCLUSION

Every nation must form some kind of law to ensure order, peace and prosperity in their country. Although, it is inevitable that some citizens will violate those law and do harm to others. To uphold justice, the state must give sanctions or punishments to those offenders. These proceedings must be done carefully to prevent mistakes such as wrongfully convicting an innocent person. These misfortunes have happened in the past until now in various country and only to be revealed decades later. In some cases, the wrongfully convicted victim has been excuted with death penalty which only to be proven later that they were innocent. This is a horrible event that could happen to anybody. Society has an obligation to give some compensation to these innocents after a lifetime of being punished for something they have been worngfully accused of. Even then, these compensations might not be comparable to the stress or trauma they might have endured, moreover when they recieve no compensation at all from the state. T

he Financial Services Authority (OJK) has issued a regulation on fraud control and the application of anti-fraud strategies for insurance and reinsurance companies. The regulation was stated in an OJK circular letter number 46 of 2017. Under the regulation, insurance companies are obliged to control fraud, which includes active supervision of the management, monitoring, education, and training. It also said that the companies are obliged to implemented anti-fraud strategies that include prevention, detection, investigation, reporting, imposing of sanction, monitoring, evaluation and further actions. he Constitutional Court rejected on Thursday a judicial review request to challenge the 2006 Citizenship Law's Article 41, which stipulates that children of mixed marriages are required to register to attain Indonesian citizenship. The court said it could not nd any legal basis to grant the judicial review request led by Ira Natapradja Hamel, whose daughter Gloria Natapradja Hamel lost the chance to obtain Indonesian citizenship after the 2006 Citizenship Law was enacted. Justice Anwar Usman said the petitioner had failed to register her child from her marriage to a foreigner as required by the law. “Negligence cannot be used as a basis to le a petition," Anwar said, in a hearing led by Chief Justice Arief Hidayat.Anwar said children of mixed marriages who missed the period to register were still able to obtain Indonesian citizenship by fullling requirements stipulated in the 2006 Citizenship Law. Gloria, born to a French father, made headlines in August last year when she nearly failed to join the prestigious Independence Day national ag-hoisting team, as she only held a French passport. Through registration, the law says, children of mixed marriages are allowed dual citizenship until they turn 18, after which they are required to choose their citizenship. he Constitutional Court has ruled in favor of a judicial review petition challenging the 2012 law on Yogyakarta's special status, paving way for Sultan Hamengkubuwono X of the Yogyakarta customary sultanate to make his daughter a successor. Chief justice Arief Hidayat told the hearing on Thursday the court had scrapped a "discriminative" provision in Article 18 (1), Point M of the law, as requested by the plaintiffs, the royal servants of the Yogyakarta Palace. The article stipulated that gubernatorial candidates of Yogyakarta should submit a curriculum vitae outlining their education record and the occupation of their siblings, wife and children to the Yogyakarta Provincial Legislative Council. Under its special status, the sultan is the ex-ofcio governor of Yogyakarta. "The phrase 'education records, occupation ... of siblings, wife and children' has contradicted the 1945 Constitution," Arief read out the ruling. The plaintiffs disputed the term "wife" in the provision, as it implied that only men could take the governor seat, hence also meaning only the male lineage of the royal family can take the reign of the sultan. Hamengkubuwono, who became the sultan in March 1989, has ve daughters and no sons. In 2015 he issued a sabdaraja (king's proclamation), naming his eldest daughter, Gusti Kanjeng Ratu (GKR) Mangkubumi, as the crown princess. Yogyakartans criticized the move, saying the position of sultan was only for men, as it was part of the tradition of the Javanese Palace, hence Hamengkubuwono's younger brother should be his successor. "Hot spots were identied at 06.00 in the morning," Pekanbaru Meteorology, Climatology and Geophysics Agency head Oto Sukisno said on Sunday (3/9). Sukisno stated that South Sumatra contributes the highest number of hot spots with 31 spots. Bangka Belitung places second with 16 spots, Lampung comes third with 8 spots, Jambi places fourth with four spots, Bengkulu has only one hot spot, and Riau Islands also has one spot. Meanwhile, Riau has nine hot spots with condence level higher than fty percent, Sukisno revealed. To anticipate the annual disaster of forest and land res, Riau Provincial administration has declared the status of forest and land re emergency since January 2017, extended to November.
