STEPHEN PINDER Employment Law Matters

I

have spent over 30 years advising employees and employers about employment law issues and disputes in all types of workplaces. The world of work has always been a place filled with real people, encountering real problems, sometimes doing the wrong thing, and living with the challenges caused by ordinary life, family issues, and disability. My work has involved helping a business manage a difficult TUPE situation, represent a woman sacked for being pregnant, and pursuing a court action for 2000 Claimants underpaid redundancy money due under their contract of employment.

2

I set up the employment law company in October 2020 to deliver a specialist service for workers and employers. This is possibly a time of the greatest upheaval in the labour market. Even before the covid pandemic started

the high street closures and redundancies were having a major impact, but the pandemic has created a whole new level of uncertainty. A year ago I was not being asked questions about why a person was put on furlough, or whether the decision was motivated by discrimination. I was not asked by an employer whether holiday could be taken during furlough, and how redundancies should be managed as lockdown was lifted. For us all a new reality, but one impacting upon all employers, employees, local and central Government. The availability of best advice is crucial for all workers and employers, and never more than now.

I have written recently about the future, and what issues may require advice. Two particular topics will strike a chord with many, firstly the prospect of having the vaccine being a condition of acquiring or retaining a job, and secondly the possible changes to employment rights in the aftermath of Brexit. I enjoy dealing with employment disputes as they are relevant to us all, and to every family. Advising individuals and businesses requires careful analysis and an attention to the different facts which come across my desk. Stephen Pinder Employment Law was formed to assist people and stands ready to help as our new normal becomes our new reality.

SMALL GARDEN IDEAS

Just because you have a small garden or terrace doesn’t mean you can’t turn it into something beautiful and stylish. Here are award winning landscape designer Pip Probert’s tips…..

T

ry porcelain tiles, they are available in so many colours and natural effect patterns, you really are spoilt for choice. It makes it easy to match your interior. Virtually non-absorbent, porcelain paving is very popular – we find most of our client love the contemporary look, but also the fact that they are practical and easy to clean! We often use larger tiles to clad raised planters, built in seating and unsightly existing low walling, giving a clean and tidy finish. Arbors and pergolas are classic small yard landscaping ideas and great ways to frame a view, but you can do the same with small plants and pieces of furniture Create a small path so the space feels larger, it also divides the landscape making it attractive and restful.

LOCAL BUSINESS Lifestyle chats to community fundraiser and Fika coffee shop owner, Anthony Grice, who has been nominated for a Pride of Britain Award for his charity work during the pandemic.

Did you always plan to be at the epicentre of the community? Yes. I always wanted it to be more than a coffee shop, a community hub as it is right in the middle of the city and gives me a platform to use it for other interests. I wanted to invest back into the community, to the people and support my dream. I like to give back. How many family have you helped? 1600 family which is a lot of people. Just from south end of city and ended up being the whole city by lockdown 3 as people financially struggling. 10

Did you think your charity work would get so big? I didn't think this many people would get involved but I have a big social media platform. Celebrities came into the shop and posted on social media too so it just snowballed from there. What things have you done? I created these care packages, so I got these boxes when we went into lockdown. We put a message out to old people at first because there were the first ones shielding and there was a lot of panic buying and no food on the shelves. I was able to get to the shop and identify

who needed those bits and it just went from there. And then we did a Christmas fair and Halloween activity event, we do as much as we can for the community, we re doing a Fika festival later in the year in August to get people back together again and have a bit of normality and people mixing and support local artists and crafts. Fika is more than a coffee shop, it’s a community. What are your plans for the future of the business? I would love to open another one and I

almost did it last year but thank god I didn’t sign a contract as we went into lockdown a month later. It was going to be in the city centre. I want to find a private area and employ people who have been out of work from a long time, maybe ex drug users or people coming out of prison and can’t get a job. The money comes into the shop and it pays their wages and give something back. I would love to open a chain. How many cakes a week do you make? I would say easily 500 as a minimum. But can be 1000 coming up to Christmas. I make them all myself and I don’t employ anyone else as it can be quite demanding but people love them. I am blessed. No better feeling than someone telling you that your cake is amazing because I put a lot of love and effort into making them. How does it feel to be nominated for a Pride of Britain Award? It is

incredible. I have won the BT Openreach community action award and I was blown away by that, I couldn’t believe my name was on top of the BT Tower in London. And when I was told I was nominated it was like wow, it will eclipse everything. I don’t do things for awards, I do things because it is the right thing to do, to help people. How does it feel to be loved by so many? Mr Fika the pillar of the community! It isn’t being big headed love it as it is the right thing to do and people recognise I do so much and it feels good on

social media to be tagged into conversations I am not involved in but they mention my name. There is a sense of satisfaction that people recognise what I do but I do it because I love helping people. It is important for people to use their platform to change the way we think.

TOP PERFORMANCE COACH AND BUSINESS CONSULTANCY LEADER. I am a business owner and director of Dasala Ltd a performance coaching and business consultancy business. I work across all sectors with a focus on leadership and senior management with a mind to always help individuals and teams to perform at their best. I speak across the UK and Europe as a keynote speaker to audiences of managers and leaders from business.

Quidquid Latine dictum sit altum videtur Sprinkling a bit of Latin into conversation is impressive, don’t you think? Especially if someone has to ask what it means or better still if they have to Google it. This little beauty is my favourite “Quidquid Latine dictum sit altum videtur” ... I won’t make you Google it to find out what it means .. it translates to “whatever is said in Latin appears profound”. Yes, using Latin is pretty much just showing off ... it’s the antithesis of good communication. The language we use to get our message across is hugely important. I’ve sat in front of many presentations over the years and the ones that had the most impact always used everyday language. If you have ever have to do a presentation

or speak in public just think of Catchphrase. Yes, that TV gem from the eighties. It was Roy Walker back in my day and I think it’s Stephen Mulhern that hosts Catchphrase today ... the “say what you see” tag line has endured. The best way to communicate is in a simple, straightforward manner. Do you ‘Touch base’ with people? Or maybe you ‘Reach out’. These are the two most hated forms of office jargon according to a survey of employees conducted by Glassdoor. These are fairly tame examples but they are slightly irritating. But what about the dreaded acronym ... IMHO is a favourite of mine ... and by favourite I mean most

Email: darren@dasala.co.uk or follow me on 14 14

hated! For the those not familiar with IMHO it means In My Humble Opinion. But the H in this acronym is always redundant because when people are offering their opinion (often unsolicited) it is rarely with humility. Communication is your most essential business tool and if you get it right your reputation will go up ... conversely if you get it wrong your reputation may go down ... so always be as straightforward as you can ... and avoid showing off at all costs. BEAUTY THERAPY

Benefits of massage therapy after lockdown By salon owner Jackie Rose Why do I recommend massage? Massage has so many benefits, one in particular is stress relief and now as a lot of people are working from home at inappropriate desks and offices for long periods of time, their backs are hunched over small computers so the rounding of their shoulders can create tightness and shortening of the pecs at the front. This puts extra stress and strain on their lower back and your shoulders therefore massage is absolutely brilliant to release the tension and undo those knots that have been building up because of poor posture. Massage also improves circulation so again your body functions better.

16

What types of massage do you offer? We offer aromatherapy which uses essential oils that penetrate into the blood stream fast, they have many benefits for stress related issues, can improve sleep plus and are excellent with painful symptoms during periods and/or menopause.

We also do Swedish massage which is deep tissue massage, again for knots and nodules which have built up from either working out during exercise, not necessarily stretching properly after exercise allowing lactic acid to build up, often from a lot of driving or sports. We also have a private physiotherapist on board and she runs out of our salon on a Wednesday or Friday. Anything medical related that as therapists we cannot touch can be referred straight to her. Health benefits for a massage are obviously clear mind, clear body. It helps with stress relief, tension, helps improve problems within the gut and relieve constipation due to inactivity again due to lockdown resulting from inactivity. Holistic means ‘whole’ and the whole body comes into play with massage. We recommend you don’t have alcohol directly after a massage because you will get drunk

faster as the body system is moving better and working in a more unified manner, alcohol will travel round your body faster and ruin all the good holistic benefit from a massage. Coming out of lockdown, more people want to look after their bodies and wellbeing whilst pampering themselves and actually enjoy getting back into a routine, which is why it is so much in demand now. People have been stuck indoors and want to treat themselves and feel good again.

Schools: COVID fears will drive deadly surge in toxic car use

N

ew research reveals that ongoing infection fears are predicted to significantly increase car usage on the daily school run, creating more traffic congestion and toxic air pollution around the school gates. According to a nationallyrepresentative survey of 250 school leaders, conducted by school transport technology specialist Kura, nearly one in four school leaders believe that infection fears are set to drive increased car usage amongst parents. Research from the Department for Transport (DfT) echoes this assertion, reporting that car usage soared to 70% of normal levels since the reopening of schools – the highest levels seen this year. Two in five respondents also highlighted traffic congestion around their school gates as a problem, with a further 22% expressing concern around the level of toxic car fumes around their school. Calls for schools to do more to drive an environmentally-friendly school run have been driven by increasing

demands from pupils and parents. A separate national survey of 1,000 parents, also commissioned by Kura, revealed that over half of parents would like their child’s school to be doing more to prioritise sustainability and green initiatives, with a further 49% reporting that their children feel the same way. School leaders also predict a significant rise in electric vehicles on the daily school run over the coming decade, with nearly half (45.2%) asserting electric vehicles, such as zeroemission school buses, to be the future of school transport. This comes amidst the UK’s wider shift towards making zero-emission transport standard, with sales of new petrol and diesel-fuelled vehicles banned from 2035 onwards. Only a sixth of respondents (16.4%) reported that they believed that more environmentally-friendly shared transport, such as school-managed coaches and minibuses, would rise in prominence – a concern given that one 49-seater coach equates to 31

cars taken off the roads. However, schools have also been working towards making shared transport a safer, more attractive option for their pupils, with a fifth of schools (20.8%) having invested in additional contact-tracing technology to improve infection control on the daily school run. Godfrey Ryan, CEO of Kura, said: “The daily school run remains a major contributor to toxic emissions around the school gates, crippling traffic congestion on the roads, and school staff having needlessly lost thousands of hours on outdated, non automated processes. “However, there is a light at the end of the tunnel. While the past few months have been challenging for all, one side-effect is that schools have been forced to examine all aspects of their offering, from the classroom to the back office, and take stock of where they have room for improvement. Our findings suggest that this may lead to an overdue technologyled revolution in schools in the years to come, with one much-needed area of improvement being safer, greener, smarter school transport for all.

NEWS Charity calls on politicians to fight for children to have safe and happy lives in the Liverpool City Region

A

campaign has been launched by The Children’s Society calling for candidates standing for election in the Liverpool City Region on Thursday 6th May to prioritise the well-being of children and young people as we emerge from the Covid-19 pandemic. The charity’s #Jointhefightback campaign comes as new analysis shows that out of the 317,000 children living in the Liverpool city region, 90,800 live in poverty (that’s 32% of all children in the region), 54,100 households with child dependants are on Universal Credit (1) and there an estimated 42,000 children aged 5-16 with a mental health condition. The charity, which publishes The Good Childhood Report each year, has reported a significant fall in children’s happiness with their lives overall in the past decade. Poverty has risen, the numbers of children in care have increased, and the proportions of children experiencing mental ill health have grown.

With children’s happiness already suffering, the Covid crisis has put even more pressure on young people as they have missed out on months of learning, many families have seen their incomes fall, and the most vulnerable children in society have been out of the view of those professionals and services that help keep them safe. The Children’s Society’s #Jointhefightback campaign is calling for politicians of all parties and at all levels of government in to pledge to make this election count for children and young people. The charity has produced manifestos for representatives in local government, metro mayors and police and crime commissioners. Some of the charity’s policy recommendations include undertaking regular assessments of children’s well-being in the Liverpool city region, developing a region-wide child poverty strategy and better coordinating support in the region for young people who have been in care.

Chief Executive of The Children’s Society, Mark Russell said: “The strain of the past year and the trends of the past decade require us all to think hard about how we can restore children’s hope and optimism. We need to consider how we narrow the divides this pandemic has exposed and widened, and address the weaknesses in our society and economy which Covid exploited so successfully. But we also need to do more than just think – we need to act. “That is why The Children’s Society has set itself the bold and audacious goal to turn around the damaging decline in children’s well-being and set a path for long lasting growth by the end of this decade. This isn’t a goal we can achieve alone – it requires politicians in the Liverpool City Region and up and down the country to share our commitment to put children first and prioritise policies that gives every child what they need to live a happy, safe and fulfilling life.”

DIARY

RADIO & TV PRESENTER. SASSY MUM & SOCIALITE.

I

t’s great to be back after a short break due to moving out of my family home, if, like me, you are trying to buy a house – then good luck! The old fashioned word for it was being “gazumped” and if I hear the words “It’s a seller’s market” one more time – I may just scream. Anyway, a friend has kindly let us stay with them – whilst we try and find a house – so as sad as it is to move on – I’m looking forward to the next chapter of my life and starting afresh with my boyfriend, kids – and it appears my sons girlfriend as well. It’s made me realise that the memories you make in your home will always be in your head and no one can take them away. It’s been wonderful for not only the arts but the hospitality industry to see things starting to open up again, and for us all to get back to some sort of normality. My son, Michael, celebrated his 18th birthday on 10th April – so the following weekend we were sat outside The Clubhouse

drinking cocktails and celebrating! It’s also been great to be able to support local businesses again in Ainsdale – and also gave me a great excuse to sit in the beer garden of Champs in Ainsdale! I am also excited to announce my first adult pantomime, thanks once again to my wonderful friend Lee Kelly and LHK Productions I will be appearing in “Aladdin and his Magic Ring” at the Joe Longthorne Theatre in Blackpool from Saturday 24th July to Saturday 14th August, you can book tickets via https:// www.ticketsource.co.uk/ whats-on/blackpool/thejoe-longthorne-theatre/ aladdin-and-his-magic-ring/ e-lxdpyp. I will be starring alongside the fabulous Kim Woodburn and an amazing cast – I worked with Kim in Snow White and the 7 Dwarves in Christmas panto – and she is wonderful, a real character and made me laugh every day with her quick wit and sense of humour, she also

has the kindest heart, which is something you probably don’t know about her, so I’ll be counting down the sleeps until July 24th. With outdoor rules relaxing, we also had the chance to celebrate our good friend’s wedding – Matty and Sally, the last couple to be married at the Town Hall in Southport, and we got to share their special day – and thankfully the sun was shining. It was also like a light at the end of a pandemic tunnel to see the “test” festivals in Sefton Park – we are certainly looking towards a much brighter summer than last year, lets hope this continues! 21

BEAUTY THERAPIST

CLAIRE WHITTLE

A

Liverpool business woman suffering from chronic bipolar who watched her business fold under the pandemic has launched a new business to motivate others never to give up. Award winning beauty therapist and skin specialist Claire Whittle was forced to close her salon, CJ in the City, during lockdown. Whilst at home she developed Papillon Beauty, developing an exclusive range of false lashes that can safely be reapplied 30 times as well as fragrant cuticle oils. Claire, 45, whose condition often forces her to stay in bed for days on end, refused to let the pandemic defeat her and kept her mind busy developing the new beauty products which sell online.

22

Claire said, “I have always spoken out about my mental health because it

if can just help one other person then I feel I have helped someone. I have a wonderfully supportive family and friends network but it can still be very lonely when you have mental health issues. I needed to keep my mind active and strong because it is so easy to hide under the duvet and forget the world. But my passion has

always been beauty and it was devastating watching the salon close and see my income nosedive. I had the choice to despair but I dig deep and thought, no, I am going to fight this.” Papillon Beauty has a growing instagram following and works with influencers such as… Melissa Jacques.

Aware of the indecisive nature of millennial brits, and born from the belief that people are spending too much time on dating apps, this launch is set to carve new waves in the dating world by only being live on one day of the week, Thursdays. The app is tech to get you OFF tech. Coming to life at 00.01 every Thursday morning it encourages users to spend less time swiping and more time meeting others, enjoying the journey of being single. Thursday cuts out the crap, meaning less time making boring small talk. It’s all about getting out and meeting people and making Thursday the most exciting day of the week to be single, every week. All matches and conversation disappear at midnight, so you have to act quickly and be a bit spontaneous if you want to secure a date that night. Thursday serves no catfish. All users are verified before they join with either an upload of their passport or driving license, this is a key safety feature on the app. In addition, the app will take abusive messages extremely seriously and not tolerate hate speech, including

racism, body shaming or misogynistic commentary. The app will block these users meaning they will not be able to return and encourages users to speak up and report issues where possible. A spotlight has been shone on mental health like never before and the team could not be happier that it is at the forefront of conversation. The app only works one day a week, encouraging users to enjoy time for themselves aiming to eliminate those who spend countless evenings scrolling and matching for the sake of it, solving boring ‘dating app fatigue’. App mechanics Users upload five photos and share topline information about themselves, images can be taken from apps including Facebook, Instagram as well your camera roll. There are prompts to answer questions for users to engage with personality. Thursday also offers users to upload ‘stories’, similar to other social media sites, allowing users to share short video clips with potential matches that are automatically deleted after 24 hours. Potential matches are based on rough location, so you can work out a convenient place to meet up - exact location is never shared.

Users are encouraged to only log on in the morning if they are free that evening. Users can match with up to x10 people a day. There are also a limited number of VIP memberships available. For a monthly fee, VIP members will be boosted all day (x60 increased visibility), be able to send unlimited likes, but also be able to unlock Saturday. Double the fun every week. Following the continuation of endless Covid lockdowns, thousands of singletons signed up have been patiently waiting and wondering if Thursday was going to be the Fyre Festival of dating apps, but no, Thursday is here. The app will roll out to Manchester, Birmingham, Cardiff, Liverpool, Glasgow, and Dublin later in May and other global cities this summer including Paris, Amsterdam and Berlin. Being single should be celebrated, because it’s not forever.

Thursday is available to download from the App Store and Google Play.

ENTERTAINMENT

Lifestyle columnist and Liverpool Live Radio presenter CLAUDINE HOPE Hello Darlings! I recently chatted with actor and writer Daniel P Lewis about his short 5 minute film made back in 2016 called “Thomas”. His performance won himl 5 Best Actor awards in 3 different countries and 11 best actor nominations in 7 countries. Not a bad day at the office Daniel! Thomas is a 30 year old man who suffers from cerebral palsy and receives devastating news that his mother has cancer and loses a very short battle leaving his father to care for Thomas and his other young rebelling 12 year old son. Bafta contacted Daniel encouraging him to use the 5 minute film as a pilot to make a feature film. Wow, nice recommendation Bafta! Testimonials on the film include Hollywood actor Michael Masden, heavyweight world champion boxer Tyson

Fury and the multi award winning singer Michael Bublé. Thomas is set to be a feature film and Daniel told me about amazing opportunities for businesses to invest and advertise in the movie. The cast line up is awesome although I’ve been sworn to secrecy. For information on this business opportunity email: daniel@dockhouse.tv The Boss Birds recently interviewed James Mac who calls himself The Wild Welshman, adventurer and fundraiser and who was also a contestant on Channel 4 program “SAS Who Dares Wins” which is about five ex special forces soldiers that recreate the SAS’s secret selection process and put 30 men through the ultimate test. James told us of the amazing experience and

how it’s much harder than it looks on TV. Are you kidding? I’m exhausted just watching. James had to exit the program whilst filming in Chile due to his son being born but he has raised over 20K for MS Society and spinal research crossing the Arctic. He is extremely passionate about these charities due to his brother being tragically paralysed in a car crash and his father had MS. Check him out on Instagram @ mrmac.3 Catch me on the Radio, Thursdays on Roy Basnett’s Mid Morning show from 11am and Sundays on The Boss Birds show from 5-6pm liverpoolliveradio.com or Instagram: claudine_hope_
