REACTION FROM AMERICAN TRUCKER readers was swif to the recent report that the Federal Motor Carrier Safety Administration (FMCSA) had awarded $2.5 million to study the impact of a more flexible hours-of-service (HOS) rule, specifically with a split-sleeper option in mind—or, as one of the researchers put it, a “sleep when you are sleepy” strategy.

The conversation on our Facebook page ranged from specifics regarding the hours-of-service rule to broader concerns—and more than a few gripes—about the way trucking is regulated. And several noted the timing of the study coincided with the publication of the ELD mandate.

Steve Armstrong’s comment reflected the opinion of many: “Back before they changed HOS, we drove 10 and could drive it as we wanted. When the 10 was worked, we had to shut down for 8. The 14-hour rule has turned many days into a marathon and many times drivers are tired ... so why are they spending that money when there’s years of evidence?”

Timothy Cooley agreed: “I’ve been preaching the need for this since the rules changed!”

Preventive maintenance equates to fuel savings

By Cristina Commendatore, Associate Editor Want better fuel economy? Preventive maintenance is key. That’s according to the latest Confidence Report released by Trucking Eficiency, a joint operation of the North American Council for Freight Efficiency (NACFE) and Carbon War Room. The report states fleets that implemented rigorous preventive maintenance programs saw fuel consumption improvements in the 5 to 10% range.

“There is evidence that properly maintained trucks will enjoy [better] fuel economy,” said Michael Roeth, NACFE executive director. “The reason you do maintenance is to keep trucks up and running. It was common for people to tell us that trucks could lose 5 to 10% in fuel economy when maintenance was not attended to.”

Key findings of the report include: • Fleets view maintenance as important to their operation, but tend to look at it as a way to reduce downtime rather than improve fuel economy.

• Strong evidence shows that properly maintained trucks will enjoy better fuel economy.

• While reducing downtime is the main pathway to payback from investments in maintenance, adding information about the increased fuel economy enjoyed by well-maintained trucks can make investments in maintenance technologies, tools, bay space, technicians, or sofware an easier sell across fleet management.

According to the report, benefits of proper maintenance include improved vehicle reliability and reduced breakdowns, increased resale value, enhanced driver safety and satisfaction, and reduced CSA violations and fines. Maintenance challenges include scheduling, tracking and ensuring compliance, and demonstrating a return on investment.

Most of the fleet managers surveyed (75%) for the report said they saw a strong link between maintenance practices and fuel economy.

Engine line compliant The U.S. Environmental Protection Agency has certified that the complete lineup of Cummins on-highway diesel and natural gas engines meets the Phase 2 greenhouse gas (GHG) and fuel-eficiency standards, which take efect in January 2017, according to the OEM. That complete lineup encompasses engine platforms ranging from 5L to 15L, Amy Boerger, vice president of sales and support at Cummins, noted in a statement. “For example, efficiency improvements implemented in the 2016 ISX15 400- to 475-hp. ratings will provide customers with fuel economy gains over the 2013 ISX15 ranging from 2.5% on the base engine up to 7.5% with a SmartAdvantage Powertrain with ADEPT features,” she said.

Cummins made a range of improvements to its engines in 2014 and 2015 to comply with the 2017 rules, including meeting onboard diagnostics requirements with enhanced monitors, ensuring that exhaust tailpipe emissions stay within the EPA limits.

Medium-duty demand strong Net orders for Class 5-7 trucks oficially topped 18,850 units in November, according to data crunched by ACT Research Co., while net orders for Class 8 trucks topped out at 16,700 units.

Lingering weakness in the industrial economy coupled with strong capacity additions in 2015 are tilting the supply-demand equilibrium in favor of shippers, helping drive down Class 8 net orders to lows last seen in the third quarter of 2012, noted Kenny Vieth, president and senior analyst of ACT, in a statement. By contrast, however, he said that demand for medium-duty trucks remains robust.

Wabash adds aero devices Wabash National Corp. has expanded its trailer aerodynamic solutions product line with the AeroFin XL tail, a product designed to improve trailer aerodynamics and fuel economy.

According to the company, the AeroFin XL is a lightweight and durable aerodynamic tail device that directs airflow across the rear of the trailer to reduce aerodynamic drag. The device deploys and retracts automatically with swing door operation. It doesn’t require additional interaction from the driver and doesn’t interfere with trailer loading and unloading.

Peterbilt adds auto-start technology Peterbilt has enhanced its SmartAir no-idle system with new auto-start technology that helps keep main and auxiliary batteries charged while running the air conditioning system and using electric-powered devices.

SmartAir has a 7,500 Btu/hour cooling capacity and can operate for up to 10 hours on a single charge. The split-system design is located outside the cab for optimum performance and maximum under-bunk storage capacity.

The auto-start technology is available as a factory-installed option with Model 579s equipped with SmartAir and either a 72- or 80-in. sleeper. It is fully integrated with the vehicle’s electrical system to monitor battery charge levels and will start the truck if the charge falls below a given threshold.

The company also announced that its lightweight, full-featured 58-in. sleeper is now in production for the company’s flagship aerodynamic Model 579 and vocational Model 567. Available in low- and mid-roof configurations, the new sleeper can reduce weight by up to 100 lbs. A full-length door is included to help facilitate the loading of personal gear from outside the truck. Other features include a television mount, refrigerator, and microwave shelf.

New rating system proposed

By Kevin Jones, Editor THE LONG-PROMISED revision to the way trucking companies are rated by the U.S. government was published Jan. 21, and the Federal Motor Carrier Safety Administration (FMCSA) is sticking to its plan to let roadside data have a big part in the rating—and an on-site compliance review is no longer required to shut down a trucking company.

In addition to refreshing the ratings each month, the proposed new system would replace the current three-tier federal ratings (used since 1982) of “satisfactory–conditional– unsatisfactory” with a single determination of “unfit,” which would require the carrier to either improve or cease operations. Implementing a dynamic, data-driven ratings system has been an FMCSA priority since the launch of the Compliance, Safety, Accountability program (CSA) in late 2010.

The SFD rule will permit FMCSA to assess the safety fitness of approximately 75,000 companies a month.

By comparison, the agency is only able to investigate 15,000 motor carriers annually—with less than half of those companies receiving a safety rating, according to FMCSA.

The Safety Fitness Determination (SFD) Notice of Proposed Rulemaking (NPRM) would update FMCSA’s safety fitness methodology by integrating the inspection data, along with the results of carrier investigations and crash reports, to determine a motor carrier’s overall safety fitness.

In the days ahead of publication, a coalition of business groups wrote to transportation policy leaders in Congress to argue that the expected proposal defies various provisions of the new highway bill, the Fixing America’s Surface Transportation Act. The coalition members were particularly concerned that FMCSA would continue to use the roadside data, even as the law calls for a re-examination of that data and its demonstrated unfairness in measuring small carriers.

But FMCSA emphasized that the proposal “further incorporates rigorous data sufficiency standards” and would require that a significant pattern of non-compliance be documented in order for a carrier to fail a Behavior Analysis and Safety Improvement Category (BASIC). And unlike the comparative scoring used in CSA, the SFD failure standard will be fixed by the rule. A carrier’s status would not be afected by the performance of other carriers.

FMCSA estimates that under the system, fewer than 300 motor carriers each year would be proposed as “unfit” solely as a result of on-road safety violations.

The American Trucking Assns. (ATA) supports greater use of performance data rather than paperwork violations to make motor carrier safety fitness determinations, spokesman Sean McNally told American Trucker.

“However, we have serious concerns about the use of CSA Safety Measurement System data for this purpose,” McNally said. “As FMCSA is aware, a 2014 Government Accountability Office report found that of the 750 diferent types of violations in the FMCSA system, only two had suficient data to establish a statistically reliable relationship with crash risk. In addition, ATA is troubled by FMCSA’s proposal to set diferent ‘failure thresholds’ for carriers based on exposure. In efect, doing so sets a diferent safety bar for small and large carriers.”

The TranSource leasing operation also has rental vehicle discounts for replacement equipment needs, and it manages as many as 500 vehicles under a variety of maintenance plans in company shops. Mobile service trucks are being used increasingly by customers and can be scheduled for on-site service, including afer hours.

“As a member of the Mack Leasing System and Volvo Truck Leasing System, we can also assist customers anywhere by using the Mack OneCall and Volvo Action Service roadside assistance programs,” Underwood relates. “That afiliation also gives us access to management tools we can use on behalf of customers to lower costs and reduce downtime.”

Underwood is referring to the ASIST platform, developed by Decisiv, which is part of Mack and Volvo’s Uptime Protection web-based fleet service management system. “The platform lets us communicate with customers and other dealers in real time to expedite repairs by providing fast and accurate service estimates for approval,” Underwood explains.

“It also gives everyone automated access to specifications, fleet requirements, and vehicle-specific data on recalls, warranty coverage, repair plans, and pricing.”

There are many reasons that leasing is a favorable alternative, Underwood says, including what appears to be the resolution of a long unresolved issue involving accounting standards that will require leases for trucks and trailers to be shown on balance sheets as “right-to-use” assets. While the agreed-upon change will require separate accounting for maintenance and fuel services as well as rental payments, it is not likely to have a negative impact on the lease versus buy decisions fleets have to make.

Setting a proper rate structure goes beyond how many miles a load requires

HERE’S SOMETHING BILL BARHITE, owner of nine-truck Butterfly Express, posted on a social media site recently: “Please do not blame low rates due [sic] to low fuel costs. It is the fundamental law of supply and demand why rates are where they are at right now. I absolutely guarantee you that if fuel was at $4.00 per gallon you would not see a change in rates. Enjoy the low fuel cost while it lasts.

My income was down $12,000 [2015], but my fuel cost was down $28,000. I am netting more profit this year [2015] than last. Net

profit is what it is all about, ladies and gentlemen. Not gross income.

Think about it... If your income is based on fuel surcharges, it might be time to make a change.”

Barhite has some very valid points.

Supply and demand for both freight and fuel determine whether rates increase or decrease. When load availability is lower, freight rates will go down. When fuel prices have decreased, fuel surcharges and rates based on fuel cost will go down.

the same will happen to that carrier’s profits.

If a carrier focuses only on a static per-mile revenue and refuses to take freight that pays less per mile, then the company will find itself short on both cash flow and profit when fuel costs and/or freight volumes decrease.

In trucking, nothing happens in a vacuum. One event impacts vital areas of cost or revenue, sometimes to the trucker’s benefit and at other times to his/her disadvantage. A problem occurs when a trucker looks at the fuel surcharge as a separate revenue line.

All revenue on a load, regardless of source, must be added to the total revenue. The load’s costs must then be subtracted from the total revenue figure to determine the profit margin for the load. In other words, all revenue must be combined before subtracting costs.

It’s all about net profit.

Now let’s look at the changing environment in trucking. By December 2017, all CMV drivers except those operating pre-2000 model-year trucks will be required to use electronic logging devices, unless a federal court challenge by the Owner-Operator Independent Drivers Assn. is upheld, blocking the rule. This is going to be a game-changer. Time and its associated costs will become the predominant factor in calculating your hauling rates. The per-mile rate method will nickel and dime a carrier to failure.

Whether freight volume and fuel prices drop—or the reverse happens—the rules of the trucking game are changing. Making the necessary adjustments is paramount to being successful. The limited hours a truck-

er can operate and the difficulty of adding hours due to delays (because of the 14-hour clock drivers can’t turn of ) must be paid for by those utilizing the trucker’s services. And this not only includes shipper/receiver-caused delays at loading or delivery but weather and trafic congestion delays as well. The bottom line is that time just became a major commodity for trucking, a commodity for which shippers and receivers will have to pay.

With all that in mind, here’s how to establish a time/miles rate calculation:

1 Establish your daily fixed cost, i.e, all expenses that must be paid regardless of whether the truck is parked or rolling (ofice expenses, utilities, insurances, equipment payments, employee salaries, etc.).

2 Look at your profit margin based on a time calculation by the day. Total your combined daily fixed costs and daily profit margin to determine a daily time rate.

3 Calculate your operational cost per mile (maintenance, tires and repairs) and driver per-mile pay if required. This becomes your operational cost per mile based on destination-to-destination miles (from point of last delivery on the last load to point of final delivery on the current load).

4 Determine your fuel cost per mile based on the current fuel price (this replaces the fuel surcharge). Use 6 mpg as your fuel average. Using that baseline (per-gallon cost and per-mile amount), raise or lower your per-mile rate 1¢ for every 5¢ increase or decrease in fuel cost.

5 Determine the load-specific costs on each load, e.g., tolls, load/unload labor, special permits, pilot cars, etc.

6 Determine your time-related revenue to calculate your rate. This is your daily fixed cost plus your daily profit margin multiplied by the number of days from destination to destination.

7 Calculate your total distance cost.

This is your operational cost per mile plus your fuel cost per mile multiplied by total miles from destination to destination.

8 Add your time-related revenue, total distance cost, and load-specific costs to determine your hauling rate for the load.

The very last calculation, if needed, is the per-mile rate for the customer or broker. Take your hauling rate for the load and divide it by the origin to destination miles on the load.

This might look complicated, but remember that a spreadsheet is your friend. Don’t just make a rough guess.

By utilizing a rate calculation that incorporates your profit into a timebased number rather than a mileage-based one, you’ll never be giving away profit because of fewer miles in a load or because a load required more time, even when sitting waiting to pick up or deliver. This formula will help you increase your net profit even when revenue is reduced.

Don’t nickel and dime your business into failure by continuing to use the static per-mile hauling rate structure.

As Barhite added, “I’ve seen too many O/O’s lose their businesses because they’re stuck on what they think they need to make per mile instead of focusing on their net profit. Not getting paid for your time is the greatest threat to your success.”

WITH RECENT PASSAGE of the Fixing America’s Surface Transportation (FAST) Act, tire manufacturers were successful in their efforts to switch the tire registration system from voluntary to mandatory. Under the current version of 49 CFR Part 574—Tire Identification and Recordkeeping,

have a tremendous impact on operations. Tire dealers will eventually be required to gather all of the information and electronically transmit that along with the TIN(s) to the manufacturer every time they sell a tire.

Dealers that sell tires will be required to register the TINs with the manufacturer on behalf of the buyer. What nobody talked about was recovery.

Registering tires is important, but the primary focus should be on recovering the tires that were subjected to the recall in the first place. In the event of a passenger or light truck

tire recall, the manufacturer notifies the consumer, who simply walks out to their vehicle to see if the recalled TINs match the TINs on their tires. For truck tires, it’s not quite that simple.

The bottom line is that truckers will be the ones ultimately responsible for locating recalled tires and without leveraging technology, that process will be incredibly labor-intensive and marginally efective. Now is the time for truckers to combine their influence and demand electronic identification from their tire suppliers. Unlike retail, the nation’s trucking industry has the buying power in the truck tire market so the tire manufacturers will be forced to listen.

Radio frequency identification or similar technology is the only way that trucking companies can effectively locate recalled tires in a nationwide system with hundreds of thousands of wheel positions. Without it, the trucking industry will be forced to find defective needles in the stacks of needles the old-fashioned way, with a clipboard and flashlight.

Before worrying about ELD specs and data options, truckers need to be compliant with hours of servce

by Kevin Jones, Editor The new electronic logging device (ELD) rule is finally here—now what?

For starters, the Federal Motor Carrier Safety Administration (FMCSA) has built in a transition window to make sure everyone involved is on the same page. And for the time being, FMCSA, roadside enforcement, and ELD providers are still working out exactly how the policy specifics will be converted to day-to-day operational reality.

“Roadside enforcement is a wild card.

I don’t think even FMCSA knows what that’s going to look like for the next two years,” says Annette Sandberg, CEO of TransSafe Consulting and a former FMCSA administrator. “It’s hugely problematic because they don’t know how quickly the state enforcement agencies are going to adopt—I’m told they don’t even have the e-ROD (electronic records of duty) sofware going. It’s a very heavy lif that FMCSA has to do in the next several months to address the technical considerations.”

Along with official policy and guidance on the FMCSA website and upcoming informational sessions, ELD providers have rolled out numerous white papers and presentations.

“It really is top of mind for our customers,” says Tom Reader, director of marketing—ELDs, forms, & services, for J.J. Keller. “Inevitably, the big deal is about how these fleets are going to implement this big change

with their drivers. They’re going from paper-based recordkeeping to electronic—and that’s a huge change.

You’re putting drivers in the middle of this where they have to adapt to a new method of work.”

With an estimated 3 million drivers who fall under HOS limits, Reader suggests that more than half have used some sort of electronic logging technology. But that still means more than a million drivers, or their companies, will now be actively looking for ELD solutions for the first time.

But even drivers new to e-logs shouldn’t sweat the change, says CalArk driver Pat Dunn. He’s been trucking for 16 years—including several as an owner-operator—and made the transition two years ago.

“It’s been amazing,” Dunn says. “It was easy because it’s actually better with an e-log. You can get your rest because you don’t have anyone pushing you. Your time is right there for everyone to see. I still make my money and get my miles.”

Dunn does acknowledge that the clock stops for nothing, so drivers accustomed to fudging a paper log now and again to make up for unexpected delays will have to get used to working a little diferently.

“You have to plan,” he says. “You can’t stop at every truck stop and mess around. You’ve got to get down the road and do what you’re supposed to.”

For company drivers, Dunn emphasizes the importance of communication—of letting dispatch know if anything unexpected has come up.

Indeed, being proactive will save a driver a possibly unpleasant chat later.

“They know we manage the program,” explains CalArk vice president of safety and compliance Dennis Hilton, who reports the 250-truck fleet has an HOS compliance score near the top 10%. “If there is a violation, we’re going to call and ask the driver about it.”

CalArk advises drivers to enter a note in the system if a situation forces them to push the driving time limits.

Hilton emphasizes the importance of the new driver coercion rule and suggests shippers will now have to get on board with the eficient management of truckers’ time at the dock.

“Planning is the whole deal,” he says.

“Murphy always raises his ugly head.

What you have to do is just regroup and redesign your plan.”

Simply, ELDs will make drivers “more conscientious,” Hilton believes. And good drivers should appreciate the precise recordkeeping.

“You could be as honest as can be and keep your paper log just like you would an electronic log—and nobody would believe it,” he says. “Just overcoming that hurdle is a big relief.”

Still, the Owner-Operator Independent Drivers Assn. (OOIDA) is no fan

of the new rule, even with the procedural and technical provisions to prevent harassment resulting from ELD-generated information. OOIDA argues that use of an ELD should be an option, not a requirement. And the association once again has filed suit to block the rule, saying it has the potential to have “the largest, most negative impact on the industry” of any regulation FMCSA has imposed.

While OOIDA successfully argued that FMCSA had not addressed driver harassment in the 2010 rule, that argument will be tougher to make this time, suggests Tim Wiseman, managing partner of Scopelitis, Garvin, Light, Hanson & Feary, a law firm that focuses on regulatory compliance.

“I think the agency has done a pretty good job of considering and taking into account driver harassment and driver privacy,” Wiseman says, and he notes numerous other groups, including the American Trucking Assns., will be filing briefs in support of the rule. “I think the odds of the 7th Circuit sending FMCSA back to the drawing board this time, given the breadth of research and analysis, is unlikely. It’ll be interesting to see how the litigation goes.”

And even the doubters will come around, adds Sandberg. “The reality is, once we get these things installed and the technology evolves, it’s going to be fine,” Sandberg says. “There are still a lot of folks who aren’t using them and I think they’re leery. That’s what led to some of the concerns.”

To kick of the transition to ELDs, below is a basic Q&A. WHAT ARE THE KEY DATES? The efective date is Feb. 16, 2016—60 days afer the rule’s publication in the Federal Register on Dec. 16, 2015.

ELDs will vary in price and functionality.

The compliance date is Dec. 18, 2017, two years from the publication date. FMCSA is calling the time between now and then the “awareness-and-transition” phase.

Paper logs, logging sofware, automatic onboard recording devices (AOBRDs) and ELDs that are registered and listed on the FMCSA website may be used for records of duty status (RODS).

The two-year period from the compliance date to the full compliance phase (four years following ELD rule publication) runs to Dec. 16, 2019.

During this period, carriers and drivers subject to the rule can use either AOBRDs that were installed prior to Dec. 18, 2017, or certified, registered ELDs following rule publication on Dec. 16, 2015.

Afer Dec. 16, 2019, in the full compliance phase, all drivers and carriers subject to the rule must use certified, registered ELDs that comply with requirements of the ELD regulations.

WHAT SHOULD A DRIVER DO FIRST? First and foremost, the ELD rule doesn’t change hours-of-service requirements, so every driver needs a

thorough understanding of the regulation (§ 395.8).

For those drivers who have not yet begun to use e-logs, the first step to a successful transition isn’t choosing the right ELD system; it’s making sure operations are compliant with HOS regulations.

ELDs will very quickly identify and record violations so, without a good compliance management plan in place, the transition could be a costly one.

The secret to complying is to be compliant before the switch to ELDs, according to J.J. Keller. Simply introducing e-logs to your current operation can result in increased violations and greater risk.

WHAT ARE THE EXCEPTIONS TO THE ELD REQUIREMENT? Essentially, any driver who currently has to keep a log will be required to use an ELD. Oficially, the following are not required to use ELDs (but carriers may choose to use ELDs even if they are not required):

• Drivers who use paper logs no more than 8 days during any 30-day period;

• Driveaway-towaway drivers (transporting an empty vehicle for sale, lease, or repair);

“Do your due diligence. Don’t just rely on a supplier’s blanket statement that a device meets the requirements.”

• Drivers of vehicles manufactured before model-year 2000 because not all engines built before then have an electronic control module (ECM) suitable to ELD compliance; and • Drivers who do not use RODS because of the timecard exception (i.e., short-haul drivers).

IS AN AOBRD THE SAME THING AS AN ELD? No, but some devices will be capable of making the transition with a sofware upgrade and others will have to be replaced.

FMCSA is developing sofware to test ELD compliance—yet the rule doesn’t require that providers use the test software. Still, Sandberg suggests that carriers should ask providers if they used the sofware before self-certifying—and if not, why not?

Reader expects that, even though the FMCSA certification site isn’t up and running yet, J.J. Keller’s ELD solution will be certified with a sofware upgrade of its current electronic logging package—and that other providers should already have a good idea of what needs to be done for certification under the new rule.

“We’re seeing a lot of these ‘garage’ providers: little, tiny companies that say they’re building an ELD, but I don’t think they’re going to be remotely compliant,” Sandberg says. “We’re just urging caution. Nobody needs to jump in right away, but we still need to see more from FMCSA on what kind of testing protocols it would expect.”

“Some people are going to wait for the certified list to come out, but folks are going to look at the vendors that have been in the industry for a number of years,” Reader says. “They’ll make decisions based on believing the vendor has a solution that’s going to be compliant.”

HOW DO YOU DECIDE WHICH ELD TO BUY? The easy part is that the rule requires use of a certified ELD, and while providers are allowed to self-certify, only those units listed online by FMCSA meet the requirement.

Both Wiseman and Sandberg express concerns about providers promoting uncertified solutions.

“There are a lot of AOBRD vendors out there now that are ofering what they say are compliant devices that really don’t meet the technical requirements,” Wiseman says. “So do your due diligence. Don’t just rely on a supplier’s blanket statement that a device meets the requirements.”

In the new rule, FMCSA has allowed for two different types of devices.

Electronic data transfer must be made by either (1) wireless web services and email or (2) Bluetooth and USB 2.0.

The former would include units with additional telematics capabilities, typically used in conjunction with fleet management systems. The latter would be a less expensive design for local data transfer, with only the essential functionality built in.

Sandberg anticipates the certification website will not be fully functional until mid-February. She notes that

that an enforcement oficer can see it at roadside) or a printout. Standardized display information must include the daily header, graph grid, and log details for the current 24-hour period and previous seven consecutive days.

Sandberg has some concerns about the more affordable local devices, specifically that there’s no real-time communication between the ELD and dispatch—only a requirement that the data must be provided to the carrier within 13 days.

“It’s an electronic log that’s tied to the truck, but a carrier still has no visibility into what that log actually says. “I know some carriers will pick them because they’re going to be the low-cost device. The log is locked down, but you don’t know if your drivers are any more compliant until afer the fact— and you’re accumulating violations in the meantime.”

HOW ARE UNUSUAL OPERATIONS LOGGED? Along with questioning how rigorously the ELD provider has tested the system, truck operators should ask specifically about implementing diferent rule sets for operations that run under HOS special exceptions.

“If I’m a carrier that has a tendency to use a couple of those exceptions on a regular basis, does the ELD provider ofer the sofware to accommodate those exceptions?” Sandberg asks.

“Carriers need to think about their operations and then ask questions of the

ELD provider about the way they’ve written their sofware. If the vendor is providing a solution to your business, you shouldn’t have to change your operations to meet the ELD’s limitations.”

Reader adds that operators need to be cautious. “If you have exceptions and if the vendor doesn’t support that unique rule set, then you’re going to be out of compliance and subject to fines and penalties,” he says. “That’s what folks have to be aware of.”

HOW MUCH WILL ELDS COST? FMCSA estimates the annualized cost for an ELD with telematics to be $419, compared to $166 for an ELD with USB 2.0 and Bluetooth. Prices will vary based on features.

But the agency points out that the use of ELDs will significantly reduce the “paperwork and recordkeeping burden” associated with HOS regulations. Drivers’ time spent completing RODS and forwarding RODS to their employers will be reduced by more than $600. Further, the agency’s analysis estimates that the savings in clerical time spent retaining paper RODS and eliminating the need to purchase paper log books is almost $200. All told, this amounts to a total annual paperwork savings of $809 per driver, according to FMCSA. Adds Reader, “It’s not so much about the equipment. It’s really about the HOS compliance and the auditing infrastructure that’s in the application.”

HOW IS DRIVER HARASSMENT AND/OR COERCION ADDRESSED? Harassment is very specific: It applies if a carrier uses ELD data to pressure a driver to take action that results in an HOS violation or to drive when ill or fatigued. In the new rule, FMCSA establishes a process for filing harassment

“If the vendor is providing a solution to your business, you shouldn’t have to change ... to meet the ELD’s limitations.” reports. Carriers will be subject to a penalty for harassment as well as the penalty for the HOS violation.

Additionally, the ELDs will come with a mute function to silence communication or alerts when the driver is in the sleeper berth, for instance.

Coercion is much broader and is not limited to HOS violations. Coercion is subject to a separate FMCSA rule published at the end of last November and efective Jan. 29.

WHAT SUPPORTING DOCUMENTS ARE REQUIRED NOW? ELDs are designed to verify driving time, so supporting documents will be used to verify on-duty not driving time. A carrier must retain up to eight supporting documents from five general categories per driver for each 24-hour period [§ 395.11(c)]:

• Bills of lading, itineraries, schedules, or equivalent documents that indicate the origin and destination of each trip; • Dispatch records, trip records, or equivalent documents; • Expense receipts; • Electronic mobile communication records reflecting communications transmitted through a fleet management system (FMS); and • Payroll records, settlement sheets, or equivalent documents that indicate payment to a driver.

“I think a lot of carriers were under the initial perception that once they convert to electronic logs, they don’t need to audit logs anymore because the system itself audits them,” Wiseman explains. “But that’s not true at all. You still need to make sure the driver is not mischaracterizing his on-duty and of-duty time.”

MAY ELD RECORDS BE EDITED? Limited editing is allowed to correct mistakes, enter missing information, and provide notes or explanations (annotations) for ELD records, according to FMCSA. Driving time and other information that is automatically captured cannot be edited.

Driver edits must be accompanied by an annotation, and the ELD prompts the driver to annotate edits. A carrier can suggest or request edits for accuracy, but the driver must confirm these changes and then recertify and resubmit the RODS. Carriers must retain original ELD information (on the device, or on a separate backup system) for at least six months, along with the associated required supporting documents.

Drivers must also be provided access to six months of their log data, including drivers who have lef the carrier.

“Some of the ELD providers have said they’re going to set up a site where a driver would be able to log in and access the data,” Sandberg explains.

“But some carriers don’t want to do that because they’re worried about a

driver who’s been fired trying to hack into a site. So some providers are planning for carriers to be able to give a driver six months’ worth of logs on a jump drive when they leave.”

WHAT ARE THE TECHNICAL SPECS? Because every FMCSA-certified unit will meet the technical requirements, operators shouldn’t have to fret over these details. Nonetheless, the basic elements include date, time, location information (GPS accuracy within 1 mi. while on duty, 10 mi. during a driver’s personal use), engine hours, vehicle, and motor carrier.

These elements are captured at change of duty status; intermediate recording; change in special driving category; certification of driver’s daily record; log in/log out; engine power up/shut down; authorized personal use; and malfunction and data diagnostic event.

WHAT HAPPENS IF AN ELD MALFUNCTIONS? If an ELD malfunctions, a motor carrier must either repair or replace the ELD within eight days of a driver’s notification or carrier’s discovery of the malfunction, whichever comes first.

A carrier may request an extension, if needed, by notifying the carrier’s state FMCSA division administrator within five days of the driver’s notification.

Similarly, the driver still must be able to provide data or documents for the current 24-hour period and the past seven days in that vehicle, either as RODS loaded into the new or reset ELD or in paper format.

Again, ELD providers need to have answers to a carrier’s questions.

“How hard is it to set a driver up in the system? How long will it take to get another device?” Sandberg asks. “If a driver is out on the road, can he or she replace it, or does [the truck need] to come back to the terminal?”

All ELDs must be FMCSA certified.

HOW ARE SPECIAL DRIVING CATEGORIES DESIGNATED? There will be only two automatic duty statuses under the new rule: driving once the truck begins moving; and on-duty, not driving afer five minutes of not moving (unless a driver responds to the pop-up alert to confirm he or she is still driving).

A driver can use an annotation for other special driving categories such as bad weather that cause adverse driving conditions or oil field operations.

WHEN WILL THE NEW, COMPLIANT ELDS BE AVAILABLE? Procedurally, the ELD final rule is not actually final until 60 days afer publication. So while the industry may be rapidly gearing up, nothing is oficial quite yet.

Wiseman notes that he was “somewhat disappointed” that FMCSA didn’t define what exactly is permitted under personal conveyance and that he anticipates further guidance.

“We’re in that waiting period,” says Elise Chianelli, director of safety and compliance at PeopleNet, when asked about a product development timetable. “Most of the supplier industry feels that it will take 12-24 months to comply with all the details included in the rule.”

How are maintenance/minor repairs handled?

I use a small independent shop near my home terminal to handle most regular maintenance and repairs, and I only use other shops if I’m on the road and can’t wait. If it’s a warranty issue, I’ll use a Freightliner shop.

What are the major challenges with your maintenance/repair program, and how do you resolve each?

Money and time, of course, are the two big ones. Because I live about 800 mi. from my home terminal, I can’t just go home and get the truck in the shop.

Timing is critical, so when I get to the terminal, everything is scheduled.

The shop knows what I need, and it has parts ready. Another consideration is making sure I can aford any downtime at that point, which really ties back into [how much] money is available, so I make sure that’s doable.

How do you handle the maintenance on your trucks and/or trailers to minimize downtime?

I follow the manufacturers’ recommended service intervals for all maintenance and lubrication.

How do you ensure good tire mileage?

Which brand do you prefer? Retreads?

Tom Winn started driving in 2002 and has been an owner-operator or lease driver since 2006. His 2012 Cascadia Freightliner pulls a reefer in the lower 48 states (except California), and he hauls “whatever can fit in the box.”

Checking tire pressure on a regular basis is important and I do that weekly, but having a good quality tire is essential. I prefer Michelin because the tires wear better than any other tires I’ve tried. I don’t claim to have used all brands available, but of those I have used, these are the best. I’ve tried retreads but have been disappointed every time because I always lose one when it comes apart. Any savings are lost because of the resulting downtime and added cost of replacing that tire. So I don’t use them at all on my truck or trailer.

How do you determine when it’s time to replace a truck/trailer?

When the cost of fuel and repairs (not maintenance) equals or exceeds the cost of replacing a truck or trailer— whether it’s new or used—then it’s time to start taking a serious look into replacement.

What are your specifications for the truck?

My current truck is spec’d for fuel economy and was ordered that way.

What do you do to meet CSA standards for your truck/trailer?

I have the annual inspection and follow any other requirements by the federal government. If the company I currently lease to has anything else they need me to do, I comply with them also.

What do you enjoy most about trucking and hauling the freight you do?

Driving over the open road is the best.

As far as the freight, I’ve had all kinds, which is interesting in itself because I get into a lot of diferent places I never would’ve been before. I especially enjoy driving out West where you really have open road and sometimes little to no trafic. You just cruise and look at the scenery and realize what a beautiful country this is—there’s nothing like it.

Provides readiness support eforts at Eglin Air Force Base in Florida

PROBLEM Eglin Air Force Base oficials recently shared an interesting story regarding the eforts of the 96th Logistics Readiness Squadron (LRS) in repairing one of Eglin’s much-needed fire trucks.

The 96th LRS faces a wide range of duties at Eglin: dispensing millions of gallons of aircraft fuel, shipping military cargo all over the world, and taking care of 1,800 vehicles ranging from police patrol cars on up to heavy trucks. In fact, the unit handled 35,000 vehicle repairs in 2014 alone.

Yet when one of Eglin’s fire trucks— called Tanker 46—needed serious repairs, Tech. Sgt. Golangia Jenkins, the vehicle control oficer for the 96th Civil Engineer Group within the 96th LRS, knew he couldn’t just run out and drop nearly half a million dollars to buy a new one.

But fixing the broken front axle on Tanker 46, a 1989 model 54,000-lb.GVW fire truck equipped with a 2,000gal. water tank, wouldn’t be easy because of the truck’s age.

“Its parts are obsolete, and there is no funding in the foreseeable future to replace that vehicle,” Jenkins says.

required to have a certain amount of water on hand based on the number of aircraf and range size.”

What to do?

First, LRS personnel made a fourhour round-trip to Tyndall to get the old fire engine to Eglin, then spent eight hours removing the axle and diferential assembly from the Tyndall truck for reinstallation into the frame of Tanker 46.

SOLUTION Old-fashioned elbow grease and luck provided the answer for the airmen and civilian contractors within the 96th LRS Fire Truck Maintenance Section.

“These days, it’s dificult and expensive to obtain parts for a 1989 model truck,” David Ostrander explains. “We decided to try to find a cost-efective alternative first and look for a vehicle in our area.”

Afer a detailed search, the group discovered the same model fire engine, one slated for the salvage yard, at nearby Tyndall Air Force Base. Fortunately, the 5,000-lb. front axle the 96th LRS crew needed to fix Tanker 46 proved serviceable.

“We were very lucky to find that fire engine,” Ostrander notes. “The fire engine is a critical vehicle [as] Eglin is

Yet the job saved some $25,000, according to Jenkins.

Without that repair, Eglin would have been down one fire truck, which would have brought down readiness levels at the base, points out First Lt. Rachel Lyons, the 96th LRS vehicle management flight commander.

“A new fire truck would have been unlikely as the Air Force is trying to do more with less,” she says.

Fifth wheels DURING 2015, notes Rich Carroll, vice president of sales and marketing at Jost International, 30% of the company’s OEM fifth wheel shipments were air release products.

“We expect that to increase moving forward,” he says. “While the simple operating principle of fifth wheels hasn’t changed, we are now experiencing an evolutionary progression toward automation of the coupling process using cab-actuated air release mechanisms.”

Cab-actuated fifh wheel release and locking systems are being adopted for both ease of operation and as a

release arm and is protected by an interlock. The system requires that the vehicle be stopped and trailer brakes set before air is provided to the cab controls.

Another solution, introduced in 2014, is the Fontaine dual assist camera system featuring two video cameras that give drivers a view of both the fifh wheel and the trailer. Mounted back-to-back behind the fifh wheel and wired to a display in the cab, the cameras are turned on automatically when the vehicle is shifed into reverse.

The Fontaine fifh wheel electronic lock indicator solution, an option on the company’s 7000 and 7000CC Series top plates, uses wedge and kingpin sensors and a control module to communicate kingpin lock status on an in-cab visual indicator.

to couple with a trailer, the in-cab monitor displays video from the rear-facing camera, and crosshairs are superimposed over the screen to help the driver properly center the vehicle,” explains Gregg Stohler, vice president of sales and marketing. “As the camera setup passes under the kingpin, the video feed in the cab automatically switches to the camera facing the fifh wheel, allowing the driver to watch the kingpin enter the fifh wheel.”

While automation of the fifh wheel coupling process is taking place, manufacturers also continue to enhance their products in different

ways. At SAF-Holland, Jason Howe, director of fifh wheel engineering, says the company’s FW16 model is a low-lube version of the FW17, which does not require top plate greasing.

“Low-lube assemblies minimize maintenance requirements and allow for more consistent articulation in all applications and weather conditions,” he states. “The fifh wheel also comes standard with a tube for easy lubrication of the kingpin lock, which can be done when attached to a trailer.”

Weight is also still a focus of fifth wheel design, notes Doug Dorn, vice president of fleet/end user development at SAF-Holland. “Cast steel fifh wheels allow for the optimal balance between weight and strength,” he says. “Fleets get the best overall durability at the lightest weight possible with cast steel fifh wheels compared to ductile iron and fabricated steel models.”

Fontaine’s 6NWB air slide assemblies, which are direct replacements for NTLWO models with 6000 Series top plates, are also light in weight, notes Stohler.
