Reflections of the Past Year

I

recently attended our monthly AAOC Board of Directors meeting and was reminded of the many challenges our industry currently faces. I moved to California 40 years ago when I entered this industry. As I reflect on how drastically things have changed in the ensuing years, it is a bit depressing. Back then, and for many years thereafter, we operated in a truly freemarket and largely “mom-and-pop” industry with individuals owning properties of all sizes. Today, most “momand-pops” own smaller-sized properties, but they still collectively comprise a potentially formidable force. Managers and prospective renters had been able to negotiate face-to-face in good faith, and so much more, but I know I’m not telling you anything that you don’t already know. Forty years ago — even four years ago — there was no rent control in Orange County, no just-cause eviction, and one could screen their applicants thoroughly. All of that has obviously changed, which now hampers an owner’s ability to operate as well as affects their potential return on investment. AB 1482 has imposed statewide rent control, with maximum annual rent increases of 5% plus the change in CPI. Not a completely unmanageable obstacle, as many of our rent increases over the years have not typically crossed this threshold anyway. However, just-cause eviction and expanded restrictions impacting our resident screening practices have changed demonstrably and

these changes pose significant longterm threats to our industry, as well as to those who reside in our rental communities. Moreover, Orange County, once the bastion of conservatism, has seen Santa Ana’s city council approve extreme and oppressive rent control with other draconian measures thrown in. Will other cities follow? This torrent of change has happened quickly, particularly at the state level. Between COVID-19 and a progressive super-majority in the California legislature, change has been fast, furious and detrimental. I’ve always believed that most rental property owners are good and fair people – as are most of their residents. We’ve seen examples of this during COVID as more than 90+ percent of rents were collected. As always, most owners worked with their residents to negotiate affordable payment plans that would allow their residents to remain in good standing. The doom and gloom that tenant activists trumpeted, namely that there would be an “eviction tsunami” once the evictions moratoriums ended, hasn’t happened. Why? I think one factor is that they, as well as so many elected officials, don’t understand the realities of being in the rental business. Vacancies costs a lot of money! A vacancy costs me between $5,000 and $25,000, depending on the length of vacancy, depth of work, remodeling and rehabilitation needs, etc. What can be done? We must all be more proactive. is always one-sided and potentially dangerous. The unintended consequences of recent legislation — intended for good reasons or bad — have greatly changed our state. It’s my opinion that the California has changed from being the “Golden State” to the “Tarnished State.” Lest you think this is an original reference, it appeared on the cover of Forbes magazine a few years ago. Much of the damage has occurred recently and we desperately need a more balanced state legislature — for the sake of our industry as well as for California’s long-term health! As this year draws to a close, we should reflect on the changes happening around us and their impact on our industry, businesses, and lives, and get involved to effect change if we don’t like where we’re headed. Next year will be another challenging one for our industry and our state. Your board of directors and committees are entirely comprised of volunteers. With a lean and mean AAOC staff, we always need volunteers to step-up and get involved at the committee and board levels. I know many of you, and I know the talent and resources that exist across our membership. There isn’t a better apartment association in the country whose members have stepped up and taken action more consistently than AAOC. I implore you — don’t stop! We need you, our industry needs you, now more than ever.

I am grateful for each member of my team, for the skills and talents they possess, for the contributions that

they make, for the camaraderie that exists among us, and so much more. As we know, however, change is inevitable, and the composition of all teams will inevitably change as individual members pursue other opportunities, enter new stages in life, or move on for any number of reasons. Such is the case with our AAOC team, which is presently going through its own season of change.

This month AAOC bids a fond farewell (for a second time) to longtime controller Janet Proctor, who retired in 2017 but was quickly called back to active duty less than a year later. What she and AAOC anticipated being a shortterm arrangement while the association searched for a new controller, turned into an additional three years of dedicated service being provided by Janet to


AAOC. In early November, Janet informed me that the time had come for her to resume retirement with her husband. I’m sorry to be losing Janet but I’m also happy knowing that she will soon be having new adventures and making new memories. Thank you, Janet, for your dedicated service and unnumberable contributions to AAOC over the years. I will always appreciate your wise counsel, your support and encouragement, and your great sense of humor. With Janet’s departure now just a few weeks away, I am pleased to announce the hiring of Van Vo as AAOC’s new bookkeeper. In addition to her background as a professional accountant and bookkeeper, Van also holds an MBA in Finance and Accounting. I look forward to having Van as part of our newly configured AAOC team and having her get to know our members in the months ahead. I am also pleased to announce that Chip Ahlswede has officially joined the AAOC team as Vice President of External Affairs. Chip was brought on board in September to manage the dayto-day operations of the association’s government affairs program, on an interim basis, while a search was conducted to fill the staff position held previously by Bill Christiansen. When AAOC and its housing industry partners found themselves engaged in an unanticipated, high stakes rent control and just cause eviction battle in Santa Ana, however, that process got tossed on its head. It became evident through his outstanding work and representation of AAOC and its members over the past three months that Chip was the right person — at the right time — to move the association’s government affairs, advocacy, outreach, and communications efforts forward. In so doing, Chip will be engaging with elected officials, community leaders and influencers, organizations, real estate industry interests, the business community, and others to build and maintain support for the association

and its efforts. Chip previously served as CEO of the Greater Los Angeles Association of REALTORS® and brings to AAOC more than 20 years of advocacy and trade association experience, having worked with many local, state, regional, national, and international organizations during that time. He looks forward to working on behalf of the AAOC membership, as well as keeping you apprised of emerging issues and engaged in the advocacy

Local Governments Rush to Curtail Increased Housing Density in Single-Family Zoned Areas

E

arlier this year, housing advocates for denser housing construction in existing single family zoned areas scored a big victory when Governor Newsom signed a bill that will make it easier to build additional housing in existing neighborhoods. That bill makes it much easier to receive a lot split which will allow second units to be added on properties and the conversion of homes into duplexes. The bill, SB 9 (Atkins), could facilitate the building of hundreds of thousands of homes by allowing up to four units on properties that had previously just had one. The law takes effect January 1, 2022, and cities across the state have been ramping up efforts to address concerns before the end of the year, adopting ordinances to limit the law’s impact in their communities. Los Altos Hills, which maintains a standard of a one-acre minimum lot size to “preserve” the simi-rural nature where the homes sell for millions of dollars, recently adopted an urgency ordinance that restricts the type of housing that a property owner can construct if they split their lot. The ordinance lays out design regulations that must be followed if they are applied objectively. Local officials argue it is necessary to protect the safety and priorities of their community. Critics argue that it is a significant loophole that cities are exploiting. Some observe that the “loophole” is being investigated by more than a dozen other cities, from Sonoma to Redondo

Beach. It is argued that cities are rushing to adopt ordinances and undermining the new law by creating obstacles to building new housing that do not exist for other developments. California YIMBY (Yes In My Back Yard) observes: “We’re seeing once again an example where many local governments seem more interested in using their local control to exclude people… the Legislature did leave cities discretion under SB 9 and they’re abusing it.” Others believe that actions like those by the city of Los Altos Hills is leading to a rapidly escalating showdown between the state and local governments over housing policy. The State Legislature passed dozens of bills to boost housing production. Many of those bills, like SB 9, often remove the ability of cities to block certain housing development proposals and recently launched new administrative units to enforce those rules. Those laws frustrate local governments and homeowners who say they are being unfairly targeted for a problem caused by difficult rules and the high financial costs of new development. We sincerely doubt the high costs of development are not being driven by local government requirements. Senator Atkins intention with SB 9 was to be a compromise following years of unbelievable legislative fights over proposals to increase housing density. By placing additional dwelling units into existing neighborhoods, instead of building large apartment developments, the Senator argued that her bill was a far

more modest and equitable approach to housing density which would bring less expensive housing into existing communities. Suburban homeowner groups would have nothing to do with the suggestion that the bill was modest in nature. Under the new law, locals will have to approve applications for lot splits and at least two units on each property if the project meets size requirements and local design standards, are not in historic and environmentally sensitive districts, and do not require the demolition of rental housing that is rent controlled or has been occupied by tenants over the past three years. SB 9 also allows cities and counties to have and enforce local design standards. Several local governments are planning to adopt emergency ordinances this month, which will buy time before adopting permanent design requirements next year. According to Pasadena Now, one planning commissioner in the city of Pasadena has proposed to create several historic districts throughout the city as an attempt to exempt the entire city from the provisions of the law. Stay tuned, as SB 9 will continue to draw attention and challenges by local governments that are looking to maintain control over land use and housing decision making. ORANGE COUNTY LEGISLATIVE WATCH B y C hip A hlswede

P.I.L. — Our Public Image is Limited

J

ohnny Rotten became a punk rock legend in the 1970s as lead singer of The Sex Pistols, by biting back at what society — the establishment — considered normal and acceptable. In the 1980s, he maintained his iconic rebel nature as he fronted a new band along with fellow punk pioneer, former Clash guitarist Keith Levene. Staying relevant, however, required the two of them to reposition themselves and how the music industry saw them. They shed their previous personas — Johnny Rotten went so far as to start performing under his given name, John Lydon — and their punk band pedigrees to become the “anti-rock” and alternative-music defining band, Public Image Ltd. This article serves as a nod to Lydon and Levene’s success repositioning themselves and changing public perception of them in an era of change within their industry. However, it also serves as an example for which parallels can be drawn with where the rentalhousing industry presently finds itself. We are in a rapidly changing political and societal landscape where maintaining our standing among public policy makers and the communities we serve is becoming increasingly challenging and complex. Disappointed. That’s one word to describe how it felt coming out of a campaign that you believed you were Warrior ready to bring Home a win but ended up falling short. Santa Ana’s Rent Control and Just

Cause Eviction ordinances are now the law of the land — having taken effect on November 19, 2021 — but we aren’t Out of the Woods. As mentioned previously in the pages of Apartment News and in other member communications, AAOC fully anticipates seeing these policies spread to other nearby cities. Don’t Ask me to predict which city will be the next to consider them, but we know that those with large renter populations are the most probable: • Anaheim • Buena Park • Costa Mesa • Fullerton • Garden Grove • Irvine • Westminster And others will, at the very least, have tenant activists Banging the Door. This issue is almost becoming Religion to the current generation of tenants’ rights activists. With their zeitgeist for Rent Control and Just Cause Eviction as solutions to housing affordability and related issues, and other perceived inequities and injustices, their messages you’d recognize as the Same Old Story: • These Four Enclosed Walls are all their family has • Many people are having Hard Times • They fear a future of Worry and a

Bad Life • Their cost for housing is the hands of the Low Life in The Suit • That their Home will be lost unless rent increases are controlled • This puts them on Unfairground Which brings us to the tenant activists’ next tactic — attacking our Public Image. Over the past few months, we shared some the Cruel things that they alleged rental housing providers were responsible for either having caused or contributed to. Go Back and Ease your way into their Fishing expedition for an Albatross to hang around our necks. In their Chant, they Covered everything from profiting off people’s misery to outright racism to, believe it not, global warming. Their accusations were a literal Graveyard of societal ills blamed on the industry. It was more than enough to leave you Angry. However, that Public Image narrative they harped upon also provides us an opportunity to Open Up. Our industry makes many positive contributions, but it has become apparent that we need to change our messaging and take control of the narrative that has been monopolized by our detractors. We need to find ways to showcase all the Good Things that we provide as rentalhousing providers. The public — and specifically elected officials, community leaders, and other local influencers — need to hear more


substantive messages from us and receive information about what our industry represents in their communities. In the coming months, you will start to see a shift in how we present our industry and how rental-housing providers contribute to the communities where they operate. As an industry, we are:

The narrative that they have created about our industry being comprised of “rich, white, racist, greedy landlords” is dead wrong and we need to stop the perpetuation of that myth. We need to rebrand. We need to redefine who we are. We need the stereotypical characterizations and views of “landlords” to change and become nothing more than Memories. This process is going to take time and it will present challenges. We are also going to take some punches from our detractors along the way. But we are going to have to take those hits and remain committed to reframing the narrative about our industry. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, you can’t let the utilities be shut off. Your tenant’s actions are a breach of the

rental agreement and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit — Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utili-

ties in their name, and reimburse you for the amount of utility charges that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdictions, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. I can’t seem to keep my apartments maintained. Lately, it seems like they are falling apart. I do the best I can, I fix most stuff myself, and contract out some, but it seems like some of my tenants are sabotaging the apartments. I’ve replaced the smoke detectors in one of my rentals three times in the last year. I know something’s up. What do I do?

Legal Q&A — continued from 12 itability defects. It is critical to identify tenants who engage in damaging and destructive conduct. Although the code specifically precludes a tenant from benefiting due to his inflicting damage to the apartment, often it is difficult to prove the tenant caused the habitability defect. A good practice to enact is to create a maintenance log of repairs to each unit. Many owners will require a tenant “sign off ” when the repair is completed, other owners photograph the repaired item upon completion as proof of completion. These practices will support your claim that the “selfdestructing” smoke alarm is being damaged by the tenant. Several pieces of legislation have been enacted to crack down on the small minority of landlords who fail to properly maintain their buildings. Depending upon the severity of the defect, and providing that it is not tenant caused, a landlord may be cited by one of several governing agencies and given a period of time, ten to thirty-five days to make the repairs. If the repair is not completed as required, there are provisions that would allow the governing agency to make the repair and add the fees and costs of correction as a lien against the property. Additionally, legislation eliminates the tax benefits to the owner during the period of non-compliance, and in extreme circumstances, precludes an offending owner from demanding or accepting rent. Now more than ever before, it is critical that you document your repairs and identify the residents who are engaged in sabotage or other destructive conduct. What is a Just Cause eviction? And what is the difference between “At Fault” Just Cause, and “No Fault” Just Cause?

require “Just Cause.” There are two types of Just Cause: 1) At Fault Just Cause; and 2) No Fault Just Cause. At Fault Just Cause includes the following: • Default in the payment of rent, or a breach of a material term of the lease, after being issued a notice to correct the violation if the breach is curable. A three-day notice to terminate the tenancy may then be served; • Maintaining, committing or permitting a nuisance; • Committing waste; • Refusal to execute a written extension or renewal of a lease that terminated on or after January 1, 2020 for an additional term of similar duration with similar provisions; • Criminal activity on the rental property, including the common areas; • Criminal activity or threat on or off the property directed at the owner or the owner’s agent; • Assigning or subletting the premises in violation of the lease; • Tenant’s refusal to allow entry to the premises as authorized by law; • Using the premises for an unlawful purpose as described by law;• Employee, agent or licensee’s failure to vacate the premises following termination of employment; • Tenant’s failure to vacate the premises after tenant’s delivery of notice of the tenant’s intention to vacate the premises. • Relocation Assistance: When terminating based on At Fault Just Cause, the tenant is not entitled to receive relocation assistance. No Fault Just Cause includes the following: • Intent to occupy the premises by

the owner or certain defined relatives [provided lease entered on or after July 1, 2020 includes specific language]; • Withdrawal of the property from the rental market; • Government Agency or Court Order, or local ordinance requiring the property to be vacated (relocation assistance not required if Order issued due to tenant fault); • Owner intends to demolish or “substantially remodel” (as defined) the rental property. • Relocation Assistance: When terminating based on No Fault Just Cause, the tenant is entitled to receive the equivalent of one (1) month’s rent through either a direct payment or a waiver of the last month’s rent. Note: The tenant is not entitled to retain the relocation assistance if the tenant fails to timely move out. The owner can recover these damages in an unlawful detainer complaint. I just closed escrow on a small building and I’m trying to figure out who’s who. I received the rental agreements, but the tenant information seems incomplete. The applications — the few that I’ve found so far — are old and outdated. I can’t seem to find any telephone numbers for the residents, and I’m not real sure that the names on the agreements are the same people who actually live in the units. I’ve read your articles before and I know the importance of reviewing the files and doing thorough due diligence before closing escrow, but this deal just happened too fast. Now that I’ve closed escrow, what can I do to clean up the records?

Compile whatever contact information you have, home phone number, work and cell number. Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. Visit the building about dinner time, most residents will be home, and go door-to-door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the information in your files and gathering any missing information. Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will

co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust. This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues, than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new monthto-month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixed term leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is non

rent control, and month-to-month tenancies, the rental rate and term can be adjusted with either a thirty or a sixtyday notice of change of terms, depending on the extent of the change, and ensuring that you comply with the mandates of AB 1482. Replacing a sliding glass door and frame as a DIY job is not for the faint of heart! It is not really that difficult, but it is unwieldy and the doors are large and heavy. You state the door is a nonstandard size, so this might be a good time to standardize your glass door. Start by removing the door, bottom track, and frame. This will expose the rough opening in your doorway. Measure the rough opening for a standard sliding door of your choice. It is sometimes easier to enlarge the rough opening to accommodate the new door. The reason for a larger opening is because you will not need to find or install new outside siding or stucco nor patch the inside drywall. “Rough opening” refers to the dimensions inside the trimmer studs and between the floor and the bottom header. This opening will be slightly larger than the patio doorframe. The extra space allows a little fudge room for squaring the frame with shims. If you decide to have a con-

The drawers can store hair dryers and all manner of personal bath items. A unique system we like utilizes the space between the studs in the wall. Cabinet doors or mirrors can be used to cover storage in the walls. The wall storage is perfect for toilet paper, rolled up towels, toothbrushes, and most other small items. Install multiple towel racks on the back of the bathroom door for additional towel storage. The space above the toilet can easily accommodate an overhead cabinet for larger items. Reversing the swing of the bathroom door from inward to outward will greatly increase the usable room and make the bathroom appear larger.

Earthquake Retrofits are a Good Business Investment

H

umans, in ancient times, believed earthquakes were caused by huge animals, angry gods, and giants. Current folklore attempts to find causal links between moon phases and earthquakes, but this theory has been debunked by science. What we do know is that earthquakes are frequent in California, and that Southern California is long overdue for a temblor of epic proportions. Will it strike in Orange County? It very well might. The Federal Emergency Management Agency’s Geographic Information System technology estimates physical, economic, and social impacts of disasters such as earthquakes. This nationally applied standard, called HAZUS, has put Los Angeles/Orange County at the top of this list for annualized damage from an earthquake: • Los Angeles/Orange County

• Inland Empire • San Jose • Seattle Active earthquake faults in Orange County run along the coast and mountain ranges, hitting places such as Huntington Beach and Yorba Linda. And the hillside communities of Laguna Beach, San Clemente, and Santiago Canyon are prone to landslides that can be triggered in a major earthquake, potentially undermining the foundation of a home, or sliding into one. Liquefaction areas can be found throughout the county, most notably wherever water flows either above or below the ground: In the aquifer-rich region of central and coastal Orange County, Garden Grove, Santa Ana, Irvine, Huntington Beach, and Yorba Linda, to name a few.

The ROI of retrofits

Studies show that retrofits are a good investment — averting damage or total destruction of a property at a minimal cost. Caltech researchers determined that for every dollar spent in retrofitting soft-story structures, property owners could expect to save up to $7 — not counting loss to contents, alternate living expenses, or deaths and injuries, all of which would have significantly increased the cost-to-benefit ratios. In a separate study, the university determined that seismic retrofits are cost-effective when projected annualized loss would be reduced by 50 percent or more at a cost of no more than 10 percent of the replacement cost of a building. The Federal Emergency Management Agency found similar cost benefits in a two-year analysis of seismic retrofit scenarios in California. “The benefit/cost analysis suggests that a retrofit is strongly justified economically, even without including the value of life,” FEMA determined.

There are other strong economic factors to consider when weighing the cost benefits of a seismic retrofit. These include potential loss of income and liability associated with damage, death, and injury from an earthquake. Holding vs Letting Go

D

uring the holidays last year, I wrote about new traditions emerging as we adjusted to living in the midst of a pandemic. Family gatherings were discouraged and everyone struggled to stay connected. My article in the December 2020 issue of Apartment News focused on the importance of listening and really hearing what family members had to say. The goal was to learn and acknowledge without necessarily making any

decisions, because at that time no one knew what the future would bring. The past year has been a roller coaster of ups and downs — both in terms of the pandemic and for the rental housing industry. Just as everyone started to think that a level of “normalcy” had been reached, something else happened. Even today, as restrictions start to ease, an onslaught of enacted and proposed legislation has put in place new forms and procedures that make col-

lecting rents owed even more challenging. The legacy that you so carefully nurtured likely seems a little more precarious. Yet all your hard work need not have been for nothing. Perhaps the greatest lesson learned during the past year is that connections, especially among family members and heirs are very, very important. So, this year, the holidays are apt to take on even greater meaning. That said, so too are the opportunities for seeing that the legacy you envisioned serves an even greater purpose. But first, just as required last year, you need to do some asking, listening, and sharing. Our lives have changed. Some of us are now working exclusively from home, which creates an entirely new level of defining space, time, and priorities. Others are questioning where and how they want their future to evolve. While the same is essentially true for many of their Millennial predecessors, Gen Z’s tendencies as renters are vastly different from prior generations. From search behavior, fondness for video clips, occasional frugality and preference for simple over flashy, the generation has its share of idiosyncrasies, as panelists discussed at NAA’s Apartmentalize 2021 session, “Meet Gen Z: Understanding the Next Generation of Renters.” Having grown up on social media, their attention spans might be shorter than usual. But that doesn’t mean it’s impossible to capture their attention.

As such, multifamily marketing teams are aiming for quick-hit engagement on the front end. “We’ll start with a 15-second video that links to our website, where we have a one-minute video that lives there,” said Garin Hamburger, Senior Director of National Property Management for Cushman & Wakefield. “When they are already engaged and want to learn more, they will be more inclined to watch a little bit longer of a video. That’s our strategy and it’s been great so far.” While it might be difficult to catch their immediate attention, Gen Z individuals are more detailed in their initial searches. According to the REACH by RentCafe Gen Z Renter Study, they average 4.9 words per search—more than any other generation—and are inclined to use words and phrases such as “best,” “cheap” and “how to.” And

despite their fondness for social media, only 13% start their search there, with 43% beginning with a search engine and 39% in a marketplace environment. “Gen Z renters might not start their search on Instagram or social media, but I think it’s still a super important part of your marketing mix,” said Brooke Atsalis, Marketing and Training Manager of The Management Group. “They might not be starting there, but they are definitely going to go there throughout their journey, and it’s going to be a big factor in their decision.” According to the REACH by RentCafe study, when asked to rate their top three social media outlets, 46% rated Instagram in their top three followed by Facebook (43%), YouTube (39%) and TikTok (33%). And there are also rising costs for repairs and shortages of materials and skilled labor that have become common issues for everyone. These challenges may total up to the question of why continue? What is the purpose? The reason remains the same — to provide financial security for yourself and the assurance of a better life for your heirs. However, defining what “a better life” means may be a lot different today than it was just a year ago. Perhaps one of your children is now in the position to take a more active role in managing your rental properties. Having an heir involved and participating is possibly what you envisioned and

hoped would ultimately happen. At the same time, the complexities of rental housing laws and regulations in today’s world require much greater knowledge and expertise. So, using a professional management service may make the best sense for everyone. Hiring outside help and/or bringing in closer involvement with a family member is apt to mean some loss of control. The holidays just might be the time to broach this subject, share your thoughts and concerns, and start asking your heirs about their desires and opinions. 2021 AAOC Legislator of the Year: Senator Tom Umberg

T

he Apartment Association of Orange County (AAOC) is pleased to announce Senator Tom Umberg as its Legislator of the Year for 2021. Senator Umberg is an independent, deep thinker whose balanced, practical, and sensible approach as a lawmaker has made it possible for AAOC and the greater rental-housing industry to work with him to address problematic legislation and related policy matters. As the chair of the Senate Judiciary Committee, Umberg is looked upon as shaping most every landlord and tenant legislative measure. Take for example AB 889 (Gipson), a bill that was set to be heard in the Senate Judiciary Committee. With only 11 days before the bill was to be heard, the author stripped the contents of the bill and made it into a controversial landlordtenant bill that would have required anyone who has a beneficial interest in residential rental property to disclose that fact to the Secretary of State (SOS). Changes in the names or percentages of ownership would have had to be reported to the SOS. Senator Umberg not only shaped the discussion during the committee’s lengthy debate on AB 889, but he was also instrumental in the bill’s defeat when it failed to pass out of committee. He took elements of AAOC’s committee testimony in opposition to the bill, and combined with his own reasoning helped provide the necessary guidance to keep the bill from advancing to the

Senate floor. Should the bill have advanced, we would have faced an uncertain outcome. As a member of the California legislature, Umberg served three terms representing central Orange County in the State Assembly, working across party lines, authoring 76 laws, and bringing more than $563 million in funds to Orange County. As a member of the State Senate since 2018, Umberg has chaired the Senate Elections Committee and the Senate Judiciary Committee. He has also served since 2020 as a Trustee for the Judicial Council of California, the constitutionally created policy making body of the California courts. Umberg has also served our nation in both military and civilian roles. He is a retired U.S. Army Colonel who began his military service at the Korean DMZ and served three overseas tours. He retired from active duty in 2009, leading the U.S. military effort to attack corruption within the Afghan Army and Police, for which he was awarded a Bronze Star for meritorious service in a combat zone. He also served as a federal criminal prosecutor and had a 100% conviction rate, trying numerous white collar, civil rights and gang cases. Additionally, Umberg served as Deputy Drug Czar under President Bill Clinton where he was responsible for foreign drug interdiction, counter-drug intelligence, and international drug policy. Umberg’s continued public service, as well as his recognition of the threat AB 889 posed and his leadership in ensuring that the bill was held in committee rather than allowing it to progress further through the legislative process.
