EBT 2021 Catalogue by Arabian Horse Magazine

HOW IT ALL STARTED… A small group of breeders from Germany and Belgium debated these problems over the last year and decided to join forces and establish a “shareholding company” to involve all European breeders to work on solutions as well as collect financial and political power to stop the decline of the Arabian Horse Breed in Europe. To ensure financial stability and professional support during the phase of founding the “European Breeders Trust AG” (EBT), the Arabian Futurity Europe – a non-profit organization – that is running since more than 17 years Breeding Auctions and a yearly Foal- & Yearling-Show, was found as a strong partner and initial investor to make sure that the later issue of shares to be bought by participating European Breeders will be based on faire and save ratings. Looking for possible members for the supervisory board, the initial founders of EBT (Mr. Karl-Heinz Stöckle, Mr. Gregor Aymar and Dr. Nils Ismer / all from Germany) gathered a group of high-quality individuals with long time experience in the world of Arabian horses: Mr. James Swaenepoel / Belgium, Mr. Giampaolo Woody Gubbiotti / Italy, Mr. Raphael Curti / France, Mr. Marco Franchini / Italy Mrs. Amira Nasr / NL and last but not least Mr. Sven Schick / Germany. Shares and services will be available ONLY to European citizens and can be purchased only through the Arabian Futurity Europe to guarantee a stable issue price. Become a part of it and work together with us to change the problems of the past and to gain back and fascinate long-time breeders and new people for the Arabian Horse! To become a part of EBT, shareholders must fulfil the following criteria: EBT is open for breeders of the countries mentioned. Portugal, Spain, France, Andorra, Monaco, Corsica, Malta, Italy, Switzerland, Austria, Slovenia, Croatia, Bosnia Herzegovina, Montenegro, Serbia, Kosovo, Albania, Macedonia, Greece, Turkey, Bulgaria, Romania, Moldova, Hungary, Slovakia, the Czech Republic, Ukraine, Belarus, Poland, Germany, Belgium, Netherlands, United Kingdom, Ireland, Denmark, Sweden, Norway, Finland, Lithuania, Latvia and Estonia, the Principality of Lichtenstein, Luxemburg, Iceland, San Marino • Your shareholding must correspond to at least 25 ordinaryor preference shares. • You are an active breeder with at least 3 foals during the last 3 years. TERMS & CONDITIONS Auction Terms and Conditions Future Star Sale 2021 1. The European Breeders Trust AG is the organizer of the online and live auction and sells the horses in its own name and to the account of the seller. Purchase contracts are valid exclusively between the seller and the highest bidder. By participating in the auction, no matter whether bids are placed at the event or via internet, the bidder declares his acceptance of the regulations of auction. All information about the auction horses is given to the best of our knowledge. However, the organizer does not take over any responsibility for the correctness and accuracy of the descriptions on the internet (e. g. our websites) or for other information offered. Possible mistakes do not entitle the highest bidder to withdraw from his or her obligation to buy the offered horse and pay the full purchase price, as the buyer had sufficient time to inform himself or herself about the type and condition of the horses. 2. The organizer guarantees that all offered horses comply with the registration criteria of the World Arabian Horse Organisation (WAHO). The costs of the export certificate for the horse in the buyer’s country have to be paid by the buyer. 3. Each horse which is offered for sale will have been examined by a veterinarian and received a health certificate. For each mare which is offered ln foal, an ultrasonic examination is made by a veterinarian. The result will be noted in the health certificate. A copy of the health certificate is available prior to the auction. Each horse will obtain the veterinary certificate necessary for the country of destination on the day the horse is handed over. The costs of this certificate as well as the transportation from Langenbrettach, Germany to the specified destination have to be paid by the buyer. A later resorption, dead-born foal or miscarriages do not entitle the buyer to claim for damages, for a reduction of purchase price, or for a repeat covering. The auctioneer and European Breeders Trust AG shall be not responsible for the correct description, authenticity, genuineness of, or defect in any lot, and makes no warranty in connection therewith. All lots to be sold AS IS, WHERE IS. 4. The bid currency is € (Euro). 5.European breeders trust AG is not responsible for ERRORS in bidding. Doubts concerning the validity of the highest bid are to be declared immediately. The bidding can be reopened and continued at the decision of the organizer. This is permissible even if the notice of sale has already been signed. Any disputes occurring during the auction will be decided by the organizer. This decision is binding for all parties and does not entitle to any claims for damages and/or costs. Examples for these disputes are: 2 or more bids are made for the assignment of a horse: misunderstandings concerning allocation of the horse or country customs and conditions, obvious mistakes made by the organizer, technical problems during bidding over the internet/using the controller. The auctioneer has the right at his absolute discretion to refuse any bid. If any dispute arises between 2 or more bidders, the auctioneer may decide the same or immediately put the lot for sale again and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. 6. Should the buyer not sign the sale notice (or in case of online-bidding, failure to confirm sale per e-mail), the horse can be auctioned a second time. ln this case, the first buyer will be held responsible for

possible loss of proceeds. 7. The sale amount will be charged to the buyer in the auction office as follows: Knock down price additional 5% commission, the price will be increased by VAT (SALES TAX) 19 %. The VAT will be reimbursed to the buyer who: possess a European Union VAT registration number and will confirm the intra-community delivery of the collected horse(s). - will submit exportation documents, confirming exportation of the purchased horses of the territory of European Union, under the condition, that the costumes export procedure was started in the territory of Germany and will be completed within 3 months from the date of making full payment for the purchased horse(s). 8. With the knock-down, all risks are transferred to the buyer. The right of complaint is out of validity. The horses are sold in the condition in which they are presented at the auction. Possible arising claims are to be made directly to the previous owner offering the horse for auction. The organizer cannot be held responsible under any circumstances whatsoever. The bidder places bids to his own account if he/ she does not declare name and address of his client. The change of ownership occurs after complete payment of the sale price only. No claims whatsoever entitle the buyer to retain the sale price or a part of it. 9. From the knock-down onwards, all fees such as delivery, care, possible vets’ fees, farrier etc. are charged to the buyer’s account. Buyer will be responsible for any costs of stabling and supplies for the horse between this period and delivery. The buyer will be charged for boarding and or other expenses that European breeders trust AG and/or seller may incur. 10. The payment is to be paid after sale in cash, or per bank transfer. The organizer is authorized to receive the payment, and to take action against the buyer for the sale price plus additional fees. The organizer can only be held responsible in case of intent or extreme carelessness. No guarantee for the functionality of the technical equipment. 11. Purchased horses are to be picked up the latest by the 01.09.2021. No horse will be handed over before the payment has been settled. 12. Transports of purchased horses may be negotiated upon request. All horses will be transported back to their origin stable unless the new owner asked for own transportation after full payment was settled. In this case the horse must be removed from the show stable latest till 12.00 am, 09.08.2021. 13. The organizer reserves the right to change the course of the programme. This includes the right to offer horses for auction together, separately, or not at all. 14. Horses are not insured after knock-down. A life insurance can be negotiated upon request. 15. These terms and conditions, and all lawsuits or actions under it, shall be construed in accordance with and under and pursuant to the laws of Germany, and in any lawsuit or any action that may be brought arising out of, in connection with, or by reason of these terms and conditions, the laws of Germany shall be applicable and shall govern of the law of any forum, without regard to the jurisdiction in which any such lawsuit or action may be instituted. Venue shall be in Kempten Germany, with the prevailing party entitled to recover reasonable attorney’s fees and costs.

GESCHÄFTSBEDINGUNGEN Auktionsbedingungen Future Star Sale 2021 1. Die Die European Breeders Trust AG ist Veranstalter der Online- und Live-Auktion und verkauft die Pferde im eigenen Namen und auf Rechnung des Verkäufers. Kaufverträge gelten ausschließlich zwischen dem Verkäufer und dem Meistbietenden. Mit der Teilnahme an der Auktion, unabhängig davon, ob das Gebot auf der Veranstaltung oder über das Internet abgegeben wird, erklärt der Bieter sein Einverständnis mit den Auktionsregeln. Alle Informationen über die Auktionspferde werden nach bestem Wissen und Gewissen gegeben. Der Veranstalter übernimmt jedoch keine Gewähr für die Richtigkeit und Richtigkeit der Angaben im Internet (z. B. unsere Websites) oder für sonstige angebotene Informationen. Eventuelle Fehler berechtigen den Meistbietenden nicht, von seiner Verpflichtung zum Kauf des angebotenen Pferdes und zur Zahlung des vollen Kaufpreises, da der Käufer genügend Zeit hatte, sich über Art und Zustand des Pferds zu informieren. 2. Der Veranstalter garantiert, dass alle angebotenen Pferde den Registrierungskriterien der World Arabian Horse Organisation (WAHO) entsprechen. Die Kosten der Ausfuhrbescheinigung für das Pferd in das Land des Käufers sind vom Käufer zu tragen. 3. Die Jedes Pferd, das zum Verkauf angeboten wird, muss von einem Tierarzt untersucht und ein Gesundheitszeugnis haben. Für jede Stute, die trächtig angeboten wird, wird von einem Tierarzt eine Ultraschalluntersuchung durchgeführt. Das Ergebnis wird im Gesundheitszeugnis vermerkt. Eine Kopie des Gesundheitszeugnisses ist vor der Auktion erhältlich. Jedes Pferd erhält am Tag der Übergabe die für das Bestimmungsland erforderliche Veterinärbescheinigung. Die Kosten dieses Zertifikats sowie der Transport von Langenbrettach zum angegebenen Zielort sind vom Käufer zu tragen. Eine spätere Resorption, totgeborene Fohlen oder Fehlgeburten berechtigen den Käufer nicht zu Schadensersatzansprüchen, Minderung des Kaufpreises oder Wiederholungsdeckung. Der Versteigerer und die European Breeders Trust AG haften nicht für die korrekte Beschreibung, Echtheit, Echtheit oder Mängel des angebotenen Pferdes und übernehmen keine Gewährleistung im Zusammenhang damit. Alle Lots werden verkauft, wie diese am Auktionstag sind. 4. Die Gebotswährung ist € (Euro). 5. Der European Breeders Trust AG ist nicht verantAwortlich für Fehler bei Geboten. Zweifel an der Gültigkeit des Höchstgebots sind unverzüglich zu erklären. Das Gebot kann nach Entscheidung des Veranstalters erneut eröffnet und fortgesetzt werden. Dies ist auch dann zulässig, wenn der Kaufvertrag bereits unterschrieben ist. Etwaige Streitigkeiten während der Auktion werden vom Veranstalter entschieden. Diese Entscheidung ist für alle Parteien verbindlich und berechtigt nicht zu Schadensersatz- und/ oder Kostenansprüchen. Beispiele für solche Streitigkeiten sind: Es werden 2 oder mehr Gebote für die Zuteilung eines Pferdes abgegeben: Missverständnisse bezüglich der Zuteilung des Pferdes oder des Käufers, offensichtliche Fehler des Veranstalters, technische Probleme bei der Vergabe über das Internet/Verwendung des Verantwortlichen. Der Versteigerer hat das Recht, ein Gebot nach eigenem Ermessen abzulehnen. Bei Streitigkeiten zwischen zwei oder mehr Bietern kann der Auktionator dasselbe entscheiden oder das Lot sofort wieder zum Verkauf stellt und an den neuen Meistbietenden weiterverkaufen. Die Entscheidung des Auktionators ist endgültig und unanfechtbar. 6. Die Sollte der Käufer die Verkaufsanzeige nicht unterzeichnen (oder bei Online-Bieten die Verkaufsbestätigung per E-Mail widerrufen), kann

das Pferd ein zweites Mal versteigert werden. In diesem Fall haftet der Erstkäufer für den möglichen Erlösverlust. 7. Der Kaufpreis wird dem Käufer im Auktionsbüro wie folgt berechnet: Zuschlagspreis plus 5% Provision, der Preis erhöht sich um die Mehrwertsteuer von 19%. Die Mehrwertsteuer wird dem Käufer erstattet, der eine EU-Umsatzsteuer-Identifikationsnummer besitzt und die innergemeinschaftliche Lieferung des gekauften Pferdes die Ausfuhrdokumente vorlegen, die die Ausfuhr der gekauften Pferde aus dem Gebiet der Europäischen Union bestätigen, Voraussetzung ist, dass das Ausfuhrverfahren auf dem Gebiet der Bundesrepublik Deutschland begonnen wurde und innerhalb von 3 Monaten ab dem Datum der vollständigen Zahlung für das/ die gekaufte Pferd (e) abgeschlossen wird. 8. Mit dem Zuschlag, gehen alle Risiken auf den Käufer über. Ein Wiederspruch ist danach nicht mehr zulässig. Die Pferde werden in dem Zustand verkauft, in dem sie auf der Auktion präsentiert werden. Eventuell entstehende Ansprüche sind direkt an den Vorbesitzer zu stellen, der das Pferd versteigert. Der Veranstalter kann unter keinen Umständen haftbar gemacht werden. Der Bieter gibt Gebote auf eigene Rechnung ab, wenn er/ sie/ Sie gibt keinen Namen und keine Adresse seines Klienten an. Der Eigentümerwechsel erfolgt erst nach vollständiger Zahlung des Kaufpreises. Keine Ansprüche, gleich welcher Art, berechtigen den Käufer zur Zurückbehaltung des Kaufpreises oder eines Teils davon. 9. Ab dem Zuschlag werden alle anfallenden Kosten wie Transport, Unterbringung, eventuelle Tierarztgebühren, Hufschmied usw. dem Käufer in Rechnung gestellt. Der Käufer trägt die Kosten für die Stallung und die Versorgung des Pferdes zwischen dem Zuschlag und der Lieferung. Dem Käufer wird für die Unterbringung und andere Kosten, die der europäischen Züchter Trust AG und/oder Verkäufer entstehen können, in Rechnung gestellt. 10. Die Zahlung ist nach dem Kauf in bar oder per Banküberweisung zu leisten. Der Veranstalter ist berechtigt, die Zahlung entgegenzunehmen und gegen den Käufer Klage auf Zahlung des Kaufpreises zuzüglich Nebenkosten zu erheben. Der Veranstalter kann nur bei Vorsatz oder grober Fahrlässigkeit haftbar gemacht werden. Auch wird keine Gewähr für die Funktionsfähigkeit der technischen Ausstattung übernommen. 11. Das/die gekaufte/n Pferde sind bis spätestens 01. 09. 2021 abzuholen. Es wird kein Pferd übergeben, bevor die Zahlung vollständig beglichen ist. 12. Der Transport von gekauften Pferden können auf Anfrage vermittelt werden. Alle Pferde werden zurück in ihren Herkunftsstall gebracht, es sei denn, der neue Besitzer hat nach der vollständigen Zahlung einen eigenen Transport verlangt. In diesem Fall muss das Pferd spätestens bis 12. 00 Uhr, 09. 08. 2021 abgeholt werden. 13. Der Veranstalter behält sich das Recht vor, den Programmverlauf zu ändern. Dazu gehört auch das Recht, Pferde gemeinsam, getrennt oder gar nicht zu versteigern. 14. Pferde sind nach dem Zuschlag nicht versichert. Die Auktionsbedingungen und alle sich daraus ergebenden Ansprüche sind nach deutschem Recht auszulegen, und für alle Klagen, die sich aus diesem Zusammenhang mit oder aufgrund der Auktionsbedingungen ergeben, ist das Recht der Bundesrepublik Deutschland maßgebend und unterliegt dem Recht des jeweiligen Gerichtsstands, an dem eine solche Klage erhoben werden kann.
