Rakaia man charged with murder BY MYLES HUME

MYLES.H@THEGUARDIAN.CO.NZ

A Rakaia man is the second person from Mid Canterbury to be charged with murder within the past year. The 36-year-old man has been charged with the alleged murder of Rangiora man Tony John Lochhead, 51, whose brother was also hospitalised with injuries after an altercation on Friday evening. Conflicting reports have emerged over where the murder-accused was from, but yesterday a Canterbury police spokesperson confirmed the man was from Rakaia. He appeared in Christchurch District Court on Monday charged with Mr Lochhead’s murder and the aggravated wounding of his brother, Peter, and was remanded in custody without plea. His name was suppressed, as were the reasons as to why he was not allowed to be named. No application for bail was made and he will be back at court on October 11. Yesterday, police confirmed

Mr Lochhead suffered a stab wound, and a knife was recovered from the scene. Rakaia Community Association chairman Neil Pluck said he had not heard any talk within the community yesterday about the alleged murder, and was shocked to hear the news. Yesterday afternoon police charged a second man with the alleged murder of Mr Lochhead. The 39-year-old man was arrested in a Hornby carpark and will appear in the Christchurch District Court today. He was also charged with the aggravated wounding of Mr Lochhead’s brother. An Ashburton youth was charged with the murder of Sina Solomona on December 19 last year. Sina, a mother of one, was found in a pool of blood at her Cass Street home in the early hours of December 15. The 16-year-old, one of New Zealand’s youngest murder-accused, is set to stand trial for her murder on November 4 in the High Court at Timaru. Additional reporting – APNZ

It may be the stuff of fantasy for some people, but it came as a bit of a shock to one couple to discover cold beer pouring out of their household taps. Russell Brown, 31, and his wife Bronwyn came home to find all of their kitchen and bathroom taps - even the shower - were no longer hooked up to the water mains, but a cluster of beer kegs under their central Auckland home. The prank was carried out by Russell’s younger brother, Sean, 29, with the help of beer brewer, Tui, and a host of tradie mates.

Record numbers enjoy cup coverage Nearly one million people tuned in to watch Team New Zealand’s nail-biting efforts on Sunday morning - more than 16 times the number of viewers who normally watch TV One during that time slot. Sunday usually averages 56,000 viewers between 8am and 10am but between 8.15am and 8.45am, the channel had an average audience of 927,000, which was the highest number for all races last week. The channel had 77 per cent of the audience share at that time.

Titanic violin to go on display The violin played by the bandmaster of the Titanic as the liner sank beneath the waves is to go on display at a museum marking the tragedy in Northern Ireland. The instrument belonging to Wallace Hartley was found strapped to his body after he drowned with some 1500 others on board the supposedly unsinkable ship in 1912. For decades the violin was believed lost but it was found in the attic of a house in northwest England in 2006. It will be displayed at the Titanic Belfast exhibition from September 18 until October 13 before it goes to auction on October 19.

A formal affair Sir Peter Jackson (right) says receiving New Zealand’s highest honour was a more formal affair than the “fluff ” of the Oscars - but both awards are likely share the same shelf at home. The acclaimed director received the insignia of the Order of New Zealand at an investiture ceremony at Government House in Wellington yesterday. Sir Peter was made an additional member of the order in the Queen’s Birthday honours last year.

Cat heading into space Iran has settled on a Persian cat as the best candidate for its latest trial for a manned space mission it hopes to make by 2020, state media reports. The feline would be following in the footsteps of a menagerie of dogs and monkeys who were among the early stars of the US and Soviet space programs in the 1960s. Iran, which first put a satellite into orbit in 2009, has previously sent a rat, turtles and worms into space. An attempt to send a monkey into space failed in September 2011.

■ SYNTHETIC CANNABIS

Call for clarity over legal high laws By Myles HuMe

Myles.h@theguardian.co.nz

Rangitata MP Jo Goodhew has accepted an invitation from the Rakaia community who want her to explain why legal highs are allowed to be sold in their community. Rakaia Community Association chairman Neil Pluck sent a letter to Ms Goodhew last week, asking her to visit the community and provide clarity

over new laws aimed at reducing accessibility to psychoactive substances, but subsequently led to the establishment of an R18 shop to legally sell the products in Rakaia. It has caused outrage in the community, prompting many Rakaia locals to sign a petition showing their opposition to the sale of legal highs in New Zealand. Ms Goodhew said she would

like to hold a meeting in Rakaia in a month when more progress had been made around the controversial topic. She said since the new legislation, more than 1000 stores had been reduced to 100 and the hundreds of products on sale had fallen to just 28, and would continue to decrease if those products proved harmful. “What the Government has done has certainly taken these

products out of a lot of retail outlets, but it seems to me Rakaia has flown under the radar until this place popped up in town and that’s clearly created concern.” Mr Pluck said he felt the community’s concerns were not being taken seriously enough, and wanted Ms Goodhew to explain to Rakaia residents why legal highs were allowed to be sold. “We are a small community

standing up for what appears to be a faulty law within New Zealand. We acknowledge the local bloke in charge of the shop is doing nothing wrong and not breaking any laws, but we think there should be a lot tougher and tighter laws around drugs.” “Why not ban them all? I know the Government’s reason is because they don’t want to drive it underground, but this is the wrong thing to do.”

■ WEDDING ANNIVERSARY

Love story still going strong after 65 years By GaBrielle stuart gabrielle.s@theguardian.co.nz

$

After 65 years together, Bill and Margaret Johnson sit in the sunshine with their hands clasped. Mr Johnson held both his wife’s hands as he led her inside, shuffling backwards so he could watch her steps. Her body was frail and dementia has a hold on her mind: the five metre journey to the couch was like a marathon. But when he looked at his wife, there was pride in his eyes. “You get married to a girl because you love her, and you love her for the rest of your life. “When I look at Margaret I don’t see an old girl, I see my wife, just as I did on the day I married her.” The couple’s love story spans years and several continents. She was a girl of 13 the first time he set eyes on her at a town dance – he was 15 and thought he was a man. That year he lied about his age and signed up to fight for his country in World War Two, and it would be five years before he returned to EngAshburton couple Bill and Margaret Johnson celebrate 65 years of marriage today. land. photo tetsuro mitomo 160913-tm-008

But he hadn’t forgotten the girl he met that night. “She was beautiful. She was the best looking girl at the dance. Five years I was away fighting the war, and the moment I was back I went looking for her.” What Mrs Johnson thought of the handsome young soldier, she is keeping to herself. “Handsome?” she scoffed, and laughed at him with dark eyes that still sparkled. “My family thought I was marrying him because I was pregnant. Of course, I wasn’t. We just didn’t want to wait.” It was just three months after his return that the couple went down to the Birmingham registry office to be married - after years of bombings there were no churches left standing. “Those were very hard days, because everything had been destroyed. But that was the brightest, hottest day of the year.” The next 65 years were far from easy. Twenty-seven years ago they moved halfway across the world to be closer to their daughter in New Zealand, and Mrs Johnson still struggles with being so far from her home. But they’ve always had each other. Sixty-five years on, Mr Johnson said they still spend every moment they can together. “My daughter says we’re joined at the hip, but why wouldn’t I want to be with my wife?” He touched her hair as they sat side by side, and his steps were patient as he helped her back out into the sunshine. They will celebrate their anniversary today with their daughter, two grand-children and eight great-grandchildren.

In brief Privacy breach The Earthquake Commission has admitted to another breach of privacy after information on up to 260 claimants was sent to the wrong customers. Its chief executive Ian Simpson has launched an inquiry into how the information ended up on a letter that was sent to some clients. One side of the letter had the correct information for the recipient, but the second side of the page had the address, phone number, insurance company and the damage reported by a different claimant. It contained no financial information. The letter was collated manually in Wellington and the error occurred during the collation process. Mr Simpson said at this stage it appeared to be human error. - APNZ

Myles.h@theguardian.co.nz

Many Mid Canterbury parents refuse to send their children to the closest school, but local education experts say that has got nothing to do with the school decile rating system. Mount Hutt College principal John Schreurs said at least 70 pupils from Ashburton travelled to Methven each day to school, while a primary school board of trustees chairman said he had heard of children travelling from far away corners of Ashburton to get to school. It comes after the Post Primary Teachers’ Association (PPTA) released a report into

its discontent with the “blunt” school decile rating system, which it believes parents are hinging their decisions on when selecting the best school for their child, creating “destructive competition” among schools. The decile rating system is a funding tool, which indicates the extent to which a school draws its students from low socio-economic communities, with lower decile schools receiving more Government funding. The Ministry of Education is exploring alternative options to the decile system, but the PPTA has waded into the debate, ask-

ing for a “more accurate” socioeconomic profile of each school using a range of data. In the past, principals spoken to by the Guardian said pupils usually go to their closest school. Mr Schreurs said he did not believe his school’s high decile rating (8) played a part in parents sending their children long distances to Methven. “I think when people look at coming to Mount Hutt, as opposed to another school, they like its small size, and we find a lot of people want to come in Year 7 instead of going to Ashburton Intermediate where they will have to make another

transition into high school,” he said. Netherby School Board of Trustees chairman Paul Skinner said he had children travelling from Tinwald and Allenton each day to his decile three school, the lowest in Mid Canterbury. “I bet if you talk to parents on the street what the school’s decile rating is, I bet under 50 per cent would know. “For me as a parent, I listen to what people say. My son is heading off to high school next year from Ashburton Intermediate and I have got friends at both schools (Mount Hutt and Ashburton Colleges) and I will listen to their ideas.”

■ STORM AFTERMATH

Power almost restored to homes By Myles HuMe and linda Clarke

Myles.h@theguardian.co.nz

The light appears to be at the end of the tunnel for EA Networks as it works to restore power to the about 60 homes estimated to still be without power just over a week since one of the worst storms in almost 40 years. EA Networks district manager Brendon Quinn said the company’s 60 linesmen made significant progress yester-

day to restore Mid Canterbury households still affected by damaged network lines with the last homes on Longs Ford Road revived last night. He said that left about 60 homes still without power due to on-property faults which he predicted would be fixed later this week. “The light is certainly at the end of the tunnel, we made some really good progress,” Mr Quinn said.

Linesmen were working to restore power for homes near the Maronan Bridge on Monday, and yesterday got homes on Gumbrells and Longs Ford Roads and in the Rakaia Gorge back on. With power still out in rural areas, Mid Canterbury Federated Farmers president Chris Allan said a strong message had emerged in the aftermath of the windstorm - electricity-dependent farm businesses need to have

a generator to use in power outages. “Electricity is an essential as dirt or stock and farmers who rely on it to run water pumps and cow sheds need generators,” he said. He said EA Networks had done a fantastic job restoring power to customers. Ealing dairy farmer Rebecca Miller said their 930-strong herd was back to regular milking in their own shed after being

milked at their neighbour’s cowshed for six days because they had no electricity. She and husband Brent had been cooking on a gas stove and gratefully accepting baking and offers to do their washing until the power was restored. They had also been trucking water in for stock and household use. “Our staff, partners and neighbours have been legends,” she said.

■ MT HUTT

Skifield gearing up for world class freestyle action By GaBrielle stuart gabrielle.s@theguardian.co.nz

With near vertical walls that will stretch 22 feet high, the Mt Hutt halfpipe is about to go Olympic-size as the mountain prepares to host an elite freestyle training camp early next month. Thirty Olympic freestyle contenders from across the world will spend more than a month training at Mt Hutt for the 2014 Winter Olympics in Sochi, and include current half pipe Olympic gold medallist Torah Bright from Australia and Burton International team rider Danny Davis of the US. Mt Hutt Ski Area Manager James McKenzie said the training camp would be the largest gathering of world-class athletes in New Zealand before the Olympic events. “It is quite rare for Mt Hutt to attract this calibre of freestyle athlete, so we are all very excited about getting the chance to see them practising tricks at the leading edge of the sport.” Global snowpark design specialists Development Snowparks will begin construction of the superpipe this week, a project that will require specialist equipment and about two weeks to complete. They will also work to modify the advanced freestyle terrain on the moun-

tain, and Mr McKenzie said they would stay at Mt Hutt to maintain the pipe and terrain during the camp. “There is definitely an art to producing a really sharp pipe, and it’s quite a complex process. This will be worldclass.” He said athletes would be using the pipe for most of the month, but he hoped to open it to the public for a few days at the end of the school holidays. “We would like to open it to the public when the athletes are not training, but I think that with 22 foot high sheer walls it will be a pretty daunting prospect even for advanced skiers.” The Mount Hutt snow season will be extended to October 13 to include the full two weeks of school holidays which he said would be a fantastic opportunity for guests to see the athletes in action. Athletes and their support crews will be based in Methven until mid-November for the camp, and Mr McKenzie said economic benefits for the local and extended community in Canterbury were significant. “This camp will attract a lot of media attention and I think the Methven community, and of course Mt Hutt staff, will be pulling out all the stops to make it a huge success.”

■ EMERGENCY HOUSING

In brief

Shelters struggling to cope By Shelley RoBinSon Emergency housing and shelters are struggling to cope with the growing number of homeless women and children in Christchurch city. The Christchurch City Mission and YWCA say they are inundated with women and children desperately seeking emergency housing - at levels never seen before. Both say they have to turn away people, with the YWCA having a regular waiting list of on average 50 women plus their children. Before the earthquakes the YWCA did not have a waiting list - they were never full. “There was no waiting list before the earthquakes. We

■ HOMICIDE

would vary between maybe 30 per cent and 80 per cent occupancy then,” said YWCA community services manager Leigh Steele. And there is nowhere left for those turned away to go after emergency housing. “It’s the end of the line - they couch surf, they stay in their cars with their children, or stay at a friend’s house in very unsafe and stressful situations,” said Ms Steele. Christchurch City Missioner Michael Gorman said he was extremely worried about safety. “I wish I knew where they did go. If they can’t stay with their family, quite frankly I don’t know. God help them,” he said. Mr Gorman said increasing rental prices meant women

could not afford private rentals. The Ministry of Business Innovation and Employment report weekly market rents have risen across the city by an average of $65 in the last year. Mr Gorman said the only option for women was emergency housing or social housing - but this was stretched across the city. He called for city council and Government to “hurry up” their social housing programmes. “They [women] cannot afford private rentals anymore - they are completely out of reach. There is not enough happening. “They should be fixing the housing stock as quickly as possible. There just isn’t enough accommodation for people like

ours on very low income,’ he said. The YWCA agreed. “Mothers with young children just can’t afford the rentals out there and landlords have more choice now,” said Ms Steele. City councillor Yani Johanson, chairman of the committee which oversees city council’s social housing, said their programme had fallen behind due to Earthquake Commission claims and difficulties in finding qualified people to do damage assessments. The city council has a total 2649 social housing units, but 113 have be closed as residential red zone. As at August 13, 2183 or 82 per cent of their units are open. - APNZ

Another Salvaging a slice of station history arrest in murder By GaBRielle StuaRt gabrielle.s@theguardian.co.nz

A second man has been arrested in connection with the murder of Tony John Lochhead in Rangiora last Friday. A 39-year old Christchurch man was arrested yesterday and will appear in the Christchurch District Court today, charged with the murder of Mr Lochhead and the aggravated wounding of Mr Lochhead’s brother. He is jointly charged with a 36year old Rakaia man who was arrested on Sunday night. Detective Inspector David Long says the man was arrested yesterday at a car park in Hornby, as a result of police inquiries over the past three days. Police are not seeking anyone else in relation to the murder investigation, Detective Inspector Long said. “However we are continuing to speak to a number of other people who may face charges in relation to assisting the alleged offenders after the incident occurred.” Detective Inspector Long has confirmed that Mr Lochhead suffered a stab wound, and said police recovered a knife from the scene where the incident is believed to have occurred. Police received a positive response to calls for information about people hitchhiking between Rangiora and Christchurch, he said. - APNZ

The boards of the Ashburton railway station are now history - and art as well. A group of Ashburton women have come together to preserve pieces of the historic station for the future, creating collages on scraps of the century-old weatherboard. Each piece is hand painted, and features photographs of the old station as well as ticket stubs and other memorabilia. Julia Crosson came up with the salvage mission just weeks before the station was scheduled to come down, and the women in her art group pitched in to make it happen. “It all had to happen very fast! But we’re opportunists, and we thought, hey, let’s do something to preserve this for the town.” From snapping photographs of the station before it came down to getting handy with a skill saw to chop weatherboard to size, the women handled every step of the project. She said the boards for the project were salvaged in the last stage of demolition, when just a quarter of the building was standing. Carmen Lye is the co-ordinator of the women’s art group, and said each piece was created with a ‘little bit of love’. Each of the 50 pieces will be sold on Boulevard Day with funds raised going towards McLaren lays out some of the memorabilia collage pieces work and repairs of the New Lisa created on weatherboards from the Ashburton Railway StaLife Church building, where tion, which will be sold on Boulevard Day. the art group meets. photo tetsuro mitomo 170913-tm-015

Road still closed A section of State Highway 6 on the South Island’s west coast is expected to remain closed until Friday. A large 40m slip at Diana Falls closed the road between the Gates of Haast Bridge and Haast Pass Summit last Wednesday. A clean-up of the road had resumed yesterday following a safety inspection, he said. - APNZ

He is charged jointly with Steven Kenneth Boskell, 18, of Palmerston; Ryan Warren Geary-Smart, 23, of Oamaru; and a 22-year-old Oamaru farm hand who has interim name suppression, with murdering Justin Conrad McFarlane on September 11. ■ MURDER

Man gets life for double murder A man who executed his uncle and aunt in cold blood after a disagreement about chores has been labelled dangerous and cruel by a judge. Edwin Harvey Maheno, 39, was sentenced to life imprisonment with a non-parole period of 18 years when he appeared in the High Court at Whangarei yesterday. He had previously pleaded guilty to murdering Ivan Maheno and his wife Carmen Maheno at their Pamapuria, Far North home on May 19. Justice Geoffrey Venning said Maheno was a “dangerous man”

who had committed the murders with a “high level of cruelty and callousness”. The court’s public gallery was filled with family members from both sides and grieving family read victim impact statements to the court. The court heard Edwin Maheno and the couple were living at the property where he had grown up raised by his grandmother. When she died in 2009, the property was bequeathed to Ivan Maheno. On May 19 Maheno overheard a conversation between the victims regarding his inability to

stick to domestic chores and accusations he had left coffee granules in a sugar bowl. Edwin Maheno was so incensed by the insults he loaded his .22 rifle, pointed it at Ivan Maheno and shot him in the head, despite profuse apologies from the victim, followed by a shot to the right cheek. “Ivan had crawled out of the bedroom into the hallway. He was still alive and was trying to push himself off the floor. He begged you for his life. You shot him again in the head,” the judge said. Carmen Maheno ran to inves-

tigate, and struggled with the defendant, who punched her in the head, struck her in the abdomen with the rifle barrel then in the head with the butt as she crouched on the floor. Carmen Maheno ran towards a neighbouring farm fence in a desperate bid to escape. “She climbed over the wire fence and kept running. You stayed your side of the fence, raised the rifle, took aim and shot her once in the back of the head. She fell to the ground. You could see she was still breathing. You shot her a second time in the buttocks.”

Opera star to perform with Mid Canty Choir By SuSan SandyS

Hinds professional opera singer Lois Johnston will be performing with the Mid Canterbury Choir for the first time this weekend. The choir will stage its spring concert Opera Favourites at the Ashburton Trust Event Centre on Saturday at 7pm. “There’s not a lot of opera going on in Hinds,” Miss Johnston admits, but has found the rural village the perfect location to base herself. She lives on a dairy farm with partner Patrick, and helps out annually with calf rearing and other tasks. The couple immigrated here from England about four years ago. As a professional and freelance soprano, Miss Johnston travels both around New Zea-

land and the world performing. Later this year she is performing in concerts in Blenheim and Dunedin, and still works in the UK with Scottish Opera. As well as opera singing, Miss Johnston sings baroque and early music and is a member of Canterbury Baroque, an ensemble planning a concert this Sunday in Hororata. Miss Johnston also teaches, from her two studios in Hinds and Christchurch. Among her solo performances in Opera Favourites will be the spectacular and dramatic aria O Zittre Nicht, and What Good Would The Moon Be by Kurt Weill. “I’m looking forward to it,” she said. “As a singer you very rarely get to perform on your home turf.”

She died 12 hours later in Whangarei Hospital. Edwin Maheno then drove away from the house, with the rifle, telling an uncle he met at the bottom of the driveway that he had fatally shot the victims. He eventually turned himself into Kaitaia police. Maheno told police he became angry at the way he had been treated by the victims since they moved into the house after inheriting it, and felt they were not respecting the family homestead. He had killed them so the property would go to the other siblings. - APNZ

The former partner of a woman who was killed in her Wellington home last year has pleaded guilty to her murder. Ernest Smith, 39, yesterday admitted in the High Court at Wellington to killing Amanda Taufale in November last year. The 33-year-old mother of two was killed at her Tawa home and her body was found by her teenage son, Liam. Her father Graham Redman said the guilty plea was a “huge relief ” for the whole family. “This has finally put to rest our fears of attending a trial and re-living the tragic events of last November.” He said the family was grateful for the support they had received. Smith was remanded in custody and would be sentenced next month. - APNZ

Defence Force chief Lieutenant General Rhys Jones will not have his role extended and he will stand down in January, the Government has confirmed. Defence Force Minister Jonathan Coleman confirmed he had told the Defence Force his decision not to extend the role last week, but it was only after he was questioned by media yesterday that he made the announcement publicly. The seasoned officer has been in the role since January 2011 when Prime Minister John Key appointed him for a three-year term in order to monitor progress in a major review of Defence Force spending. Previous heads of defence had had their terms extended by two years to a five-year term, Dr Coleman said. Lieutenant General Jones said a three-year posting cycle for Defence’s senior jobs encouraged talented people to strive for advancement. “As a result of a new Chief of Defence appointment, other senior opportunities will open up for several others,” he said. The Labour Party has accused the Government of making a “scapegoat” of Lieutenant General Jones for multiple safety failures in the New Zealand Defence Force. But Dr Coleman said that was untrue, and the only reason for Lieutenant General Jones to stand down was because he had reached the end of his contract. - APNZ

New Labour Leader David Cunliffe has confirmed David Parker as his deputy after his strongest leadership rival Grant Robertson made it clear he didn’t want the job. Mr Cunliffe has made it abundantly clear in public statements that if Mr Robertson had wanted the role, he would have recommended him for the sake of party unity. Instead Mr Robertson has opted for shadow Leader of the House, Mr Cunliffe confirmed. Until now it has been undertaken by senior MP Trevor Mallard, who is currently in San Francisco watching the America’s Cup. Mr Parker will remain Labour’s finance spokesman. Mr Cunliffe has confirmed Mr Parker was elected deputy leader during yesterday’s caucus meeting. “It’s been a very positive caucus meeting. Our team is incredibly fired up and enthusiastic for the challenge ahead.” David Parker Mr Parker’s appointment was a sign that Labour was prioritising the economy as an issue, he said. Mr Cunliffe also said Labour was adopting a 15-person shadow Cabinet model. The new model was “recognition that we’re going to be to the Government in 12 months’ time and we’d better get ready for it.” He would announce a caucus reshuffle next Monday, “but we have a very high calibre front bench at this stage so I wouldn’t want to over-egg expectations”. Mr Cunliffe also confirmed Sue Moroney would be the new Senior whip and Iain Lees-Galloway would take the Junior Whip role. Mr Robertson’s decision to stay out of Mr Cunliffe’s leadership team has already sparked suggestions that divisions between Mr Robertson’s supporters and Mr Cunliffe have not healed. Prime Minister John Key told reporters at Parliament the decision “shows how deep the rifts are within the Labour Party caucus”. - APNZ

OUR VIEW

Prepare for the worst Coen Lammers EDITOR

F

or most people in Mid Canterbury the storm of September 10 is already slipping into distant memory, but for others the effects of the record wind gust will linger for some time yet. A few households in the outer regions of the district may still be without power, which is getting really tough after a week off the grid, while others will spend months repairing their irrigators and other damage. Those who have lived through major snowfalls and the impact of the earthquakes will tell you that just about every detail of your daily life gets affected by the lack of electricity and it makes everyone more appreciative of the invisible volts streaming into our power sockets. It is especially painful when your business is stopped in its tracks. And when the cows could not be milked it became an animal welfare issue, aside from the economic impact. The tireless men and women at EA Networks have been working around the clock to get everyone hooked up. The number of fallen trees is simply mind-blowing and it has taken a few days longer than initially expected to get every household powered up. Some homeowners may still be cut off by fallen trees damaging powerlines within their property boundaries. EA Networks understandably has focused on getting the main grid up and running and are now working through the properties that have been cut off within their gates. As people in Mid Canterbury have been doing it tough, community leaders have been reluctant to pull out the “told you so” speech, but privately some have been fuming at the relaxed attitude among some home and business owners. Questions have been raised why property owners do not keep their trees clear of power lines, and how numerous multimillion dollar businesses that vulnerable to power losses do not invest in a generator. If a number of snowstorms and the Canterbury earthquakes were not convincing enough, last week’s record gale was an unwelcome reminder that we all need to be prepared for the worst.

YOUR VIEW Council elections Okay, so I may have lost some votes by being an individual, but can I just say thank you to those that have the strength of character to say so publicly. I think it’s wonderful that your opinions are strong enough, that you wish to share them. There is only one thing I would like to point out, being an individual doesn’t mean I do not understand the democratic process and adhere to it. But transparency is the key. Democracy practised in secret behind closed doors tends to push the boundaries of the meaning of the word. It goes without saying that no matter whether one is an “aye” or a “nay”, when it comes to a democratic vote, the majority rules. I learned a long time ago that to try to be something to eve-

ryone, was to sell everyone, including oneself short. That is why I will always attempt to listen to all sides and educate myself on issues, before voting with my heart and my gut; NOT with the majority that may or may not have been bullied into it. You can be assured that should you choose to tick a box beside my name you will not be voting for a “sheeple” but for an individual that will do her best for those who voted in her favour. Thank you for the opportunity to respond. Vicki Smith

importantly, control of council functions. Too often in the previous two or three councils it has make decisions to suit themselves and and instructed new entrants to sit back and learn. For some this became an easy lesson, no work, no thinking and easy money. Maybe the odd photo shoot and the mewling of occasional platitudes, the lifestyle easily acceptable and usually matches the ego. I would urge new councillors to quickly accept the burden of duty owed to the electors, without question your first loyalty and, for example, any consideration of a $50 million stadium would have been under strict council control and not as we have. The mayor and some friends meeting behind closed doors and announcing decisions for council rubber stamping. What I personally would ap-

preciate is legislation reintroduced requiring council to have ratepayer approval prior to any loan raising with an added provision that councillors be as legally responsible and accountable as company directors. If their own pockets were in similar dangers as the district ratepayers, perhaps then some integrity may return and maybe respect. M. N. Richards

Many councils make up Canty Andrew Dalziel

FROM YOUR COUNCIL

L

ast Friday The Press ran a half-page feature article on the up-and-coming Canterbury local body elections. The headline said: “In Selwyn, the only Canterbury region other than Christchurch with a mayoral race this year, the contest is interesting with sitting mayor Kelvin Coe facing challenges from deputy mayor Sarah Walters and long-serving Canterbury District Health Board member Olive Webb.” The article went on to focus on the Selwyn mayoralty race, also identifying Selwyn councillors Sam Broughton and Malcom Lyall contesting the mayoral position. There was an ending reference to two other North Canterbury local authorities, the Hurunui and Waimakariri districts having no mayoral elections. Their mayors are returning unopposed. We’ll mark The Press four out of 10 for knowledge of what local authorities make up Canterbury. They missed a few of us out. Ashburton is part of Canterbury, and as the Guardian has been at some pains to point out, there is a mayoral race here. Ashburton Mayor Angus McKay is up against sitting councillor Don McLeod and businessman Russell Ellis. The Mackenzie District is also in Canterbury. There’s a mayoral race there. Mayor

Canterbury does not just cover Christchurch, it’s a massive province made up of many towns.

Claire Barlow is up against sitting councillor Graeme Page. Kaikoura is in Canterbury. There is a mayoral race there. Mayor Winston Gray is up against councillor Darlene Morgan. Timaru is in Canterbury. Mayor Janie Annear is standing down and two councillors are

competing for the mayoral position. Waimate is in Canterbury. Mayor John Coles is standing down and there are two councillor mayoral candidates. The Waitaki District also forms part of the Canterbury region (and part of the Otago region as well). Mayor Alex Familton is standing down. There are seven mayoral candidates – two sitting councillors and five others. With the inclusion of the regional council (Environment Canterbury), which has appointed commissioners until 2016, the Canterbury region is made up of 11 local authorities. The respective mayors, along with Dame Margaret Bazley as the commissioner chair of Environment Canterbury, meet on a regular basis as a group with their chief executives. This group is called the Canterbury Mayoral Forum. There is a requirement under the Local Government Act that all local authorities within each region must enter into protocols for communication and co-ordination amongst ourselves during the three-year election cycle. The triennial agreements are signed off by all the respective councils. The Mayoral Forum’s real power comes from being able to speak in one collective voice, usually to central government, on behalf of all the people of Canterbury. Christchurch Mayor Bob Parker is the current chairperson of the Canterbury Mayoral Forum. With four Canterbury mayors stepping down at the October elections, another four being challenged, and a couple of new chief executives coming

in (my replacement in Hurunui and one for Christchurch City at some stage in the near future), it’s clear there is change and potential for more change occurring at that Canterbury wide governance level. The next Canterbury Mayoral Forum will have a different look about it, and it will be interesting to see who chairs it. The mayors collectively decide on their chair. In Ashburton at a councillor level we have 12 positions around the council table. Our five sitting rural councillors are returning unopposed and in town we have 13 people competing for seven seats. With three sitting Ashburton Ward councillors standing down at the elections there will be some change. I’ve worked in the New Zealand local government sector for 22 years, in district, city and regional councils. Ashburton District Council is the fifth council I’ve worked for. I am reasonably comfortable with change, incremental or transformational. Councils are often viewed as slow-moving bureaucratic organisations, but I have a strong view that we need to be agile, adaptive and flexible enough to respond quickly to changing community needs. In my role as CEO I am politically neutral. I will be working with whoever is returned or newly arrives to help shape the district’s vision and direction, and to lead the organisation in delivering on that. Andrew Dalziel is the chief executive of the Ashburton District Council

Trust-worthy? Or are there better ways? K

iwis love trusts. By 2010 there were approximately 400,000 family trusts in New Zealand which, between them, held an estimated $93 billion dollars’ worth of assets. However, trusts are not for everyone and careful consideration of the pros and cons are required before deciding whether or not to establish a trust. The essence of a discretionary family trust is the moving of personally owned assets into trustee ownership. When the asset is transferred to the trust you receive an acknowledgment that the trustees owe you a debt. The person (or people)

Matt Marshall A POINT OF LAW

that set up the trust are called the settlors. The trustees are the people (or companies) that own and manage the trust assets. The people that will eventually get the assets are the beneficiaries. You can be one or more of either settlor, trustee or beneficiary, but if you are going to have multiple roles in the trust you should also consider includ-

ing an independent trustee (a person or company that is not a beneficiary of the trust). The independent trustee will have an objective perspective on what is in the best interests of all of the beneficiaries. The potential benefits of a family trust are derived from no longer personally owning the asset that has been transferred to the trust. Although there are exceptions, the asset is essentially protected in circumstances including a relationship coming to an end, a business failure or claims made against your estate after your death. Trusts can also be set up for a specific purpose such as provid-

ing for the education of family members. There are some potential pitfalls. If trusts are not established or managed correctly then there is a risk of having the trust declared a ‘sham’, meaning ownership of the asset will revert to the person that transferred it to the trust. Trusts do require initial establishment fees and on-going costs of administration. Also, as the asset is now owned by the trustees they (often unanimously) will make the decisions regarding the assets held in trust. If the asset transferred to the trust is a family home the

settlors may have the right to live in it but they cannot make decisions as to renovations/repairs or its sale. The starting point for determining whether or not a family trust is right for you is to take professional advice from your lawyer and accountant. It may be that there are other effective ways to protect your assets. This article is necessarily brief and general in nature. You should seek guidance from your legal advisor before taking any action related to the matters raised in this article. In brief

■ UNITED STATES

Shooting leaves 13 dead A former US naval reservist killed 12 people in a shooting rampage at a military base in the heart of Washington before himself being killed in a shootout with police. Police identified the alleged gunman as Aaron Alexis of Fort Worth, Texas, who served in the navy from 2007 to 2011 before becoming a defence subcontractor for computer giant HewlettPackard. US authorities probing the shooting spree at Washington’s Navy Yard, which local news outlets early yesterday reported also injured 14, said the gunman appeared to have acted alone. “We do now feel comfortable that we have the single and sole person responsible for the loss of life inside of the base today,” police chief Cathy Lanier said yesterday. The Federal Bureau of Investigation (FBI) appealed to the public for information on the 34-yearold, whose military service was marked by disciplinary problems and who reportedly had once been arrested but not charged in Texas for shooting a bullet through his apartment ceiling. “No piece of information is too small. We are looking to learn everything we can about his recent movements, his contacts and his associates,” said Valerie Parlave, assistant director of the FBI’s Washington field office. The FBI released a photo of Alexis, who held the rank of an Aviation Electrician’s Mate 3rd Class and had served full-time in a logistics support squadron in Fort Worth, according to the navy. The shooting left Washington on edge and there was a security scare hours later at the White House when a man who apparently threw firecrackers over a fence at the US president’s residence was swiftly arrested.

Even hours after the shooting, Alexis’s motivation for opening fire, reportedly with an AR-15 assault rifle, was unclear. His fouryear stint in the navy was troubled, officers said. “There is definitely a pattern of misconduct during his service,” a US military officer, who spoke on condition of anonymity, told AFP. Friends in Texas told US media that Alexis had an interest in Buddhism and was conversant in the Thai language and had thought about moving to Asia. Most recently, Alexis was employed as an IT subcontractor for a company called “The Experts”, which was working on a Hewlett-Packard contract to upgrade equipment for an intranet network used by the US Marine Corps and navy, HP said in a statement. The suspect’s work as a naval contractor suggested he may have had a pass that could gain him entry to the Naval Sea Systems Command, which oversees shipbuilding programs carried out by defence firms. It was unclear if the military or HP had been aware of Alexis’ brushes with the law, including reportedly two shooting incidents, before he was hired for the IT job. The shooting sparked a massive show of force as police and federal agents descended on the Navy Yard, which is located on the Anacostia River, less than three kilometres from the Capitol. President Barack Obama ordered that flags be flown at half mast in the US capital until Friday as a mark of respect for the dead. Obama called the shooting a “cowardly act” and said that America was confronting “yet another mass shooting”, saying troops in People hold their hands to their heads as they are escortthe military should not have to ed out of the building where a gunman was reported at face danger at home. - AFP the Washington Navy Yard. ap photo

The son of a Finks bikie was in bed when he saw a disguised intruder fire four shots, two of which hit his 11-year-old brother, an Adelaide court has been told. DNA on a hammer found on top of a toy box in the boy’s bedroom matched that of Arron James Cluse, whose father is a senior member of the Hells Angels, the South Australian District Court heard. “There clearly had been some sort of plan to terrorise the occupants of the house,” Prosecutor Sandi McDonald SC told Judge Gordon Barrett, who is hearing the trial without a jury. Cluse, 23, has pleaded not guilty to ag-

gravated serious criminal trespass and two aggravated counts of endangering life in September 2011 at a Semaphore home. Finks bikie Mark Sandery, who lived there with his partner and his four sons, was out at a club meeting he regularly attended on Friday nights. Ms McDonald said the woman was watching TV in her room with one boy when she heard loud banging and crashing noises, then more noises as if the front door was being kicked in. She heard at least two sets of footsteps come down the corridor before they stopped and went out the door. “At that time she heard (the boy) screaming out that he’d been shot,” Ms McDonald said. - AAP

Execution ordered Bangladesh’s top court has sentenced to death a senior Islamist opposition official for murder during the 1971 liberation war against Pakistan. Former regional commissioner of the Hunter Scouts, Allan Currie, told the second day of the royal commission into child sex abuse in Sydney the suggestion was made to Steve ‘Skip’ Larkins that he should resign from the movement in 2003. Larkins had been suspended three years previously after a former scout, known as AA, came forward and said he had been sexually assaulted by Larkins in 1992. - AFP

Sixty-one people have died and 70,000 residents been displaced since the standoff in the major southern city of Zamboanga began more than a week ago when hundreds of Moro National Liberation Front (MNLF) gunmen sought to plant an independence flag. Hundreds of other civilians had remain trapped as the rebels seek shelter from a military assault in the Muslim neighbourhoods of the city, with the military saying the guerrillas are using some residents as hostages or human shields. - AFP

Damages against kindy A Japanese court has ordered a kindergarten to pay $A1.85 million to parents of four children who died after being put on a bus that drove towards an incoming tsunami. Minutes after the giant undersea earthquake of March 2011, staff at Hiyori Kindergarten, which sits on a hill in the badly-hit city of Ishinomaki, sent children home on a route that took them towards the sea. Five children and one woman were killed when the bus was engulfed by the huge waves that swept over the seaside road as the bus was trying to turn around. Sendai District Court ordered the kindergarten and its then head teacher to pay a combined Y170 million ($A1.85 million) yen in damages to bereaved families. The ruling is the first of its kind against a business in northeast Japan over deaths in the disaster, media reported. More than 18,000 people died in the tsunami and tens of thousands of people were made homeless in Japan’s worst postWorld War II disaster. - AFP

Lynn Matia, 37, was convicted of the manslaughter of 33-year-old Wilson Duque Castillo in the District Court yesterday. Mr Duque Castillo and his brother Wilmer approached the Trademark Hotel in Kings Cross, where they were refused entry by security guards on December 18, 2010. After a violent altercation, Mr Duque Castillo went into a coma and his life-support was turned off by his family two weeks later. Water dumped into sea The operator of the leaking Fukushima nuclear plant says it has dumped more than 1000 tons of polluted water into the sea after a typhoon raked the facility. Typhoon Man-yi smashed into Japan on Monday, bringing with it heavy rain that caused flooding in some parts of the country, including the ancient city of Kyoto. The rain also lashed near the broken plant run by Tokyo Electric Power (TEPCO), swamping enclosure walls around clusters of water tanks containing toxic water that was used to cool broken reactors. Some of the tanks were earlier found to be leaking contaminated water. - AFP

Concordia Quadruple a unique S Y U B Y L F challenge StorewideEPT & THU 19 S **

Salvage crews pulled off a major engineering feat when they straightened the listed Costa Concordia cruise ship from the rocks it had been wedged against for the past 20 months. The delicate operation took 19 hours and was completed at 4am (1200 AEST) yesterday. Engineers had initially hoped it could be done in 10 to 12 hours, but always insisted that getting it right was more important that doing it fast. “I am relieved and I am a bit tired. I will have a beer and go to sleep. I am sending a kiss to my wife,” the South African-born chief salvage master, Nick Sloane, said as he emerged from the barge where the control room had been set up. The salvage is the biggest for a passenger ship ever undertaken and the position of the ship posed unique challenges to salvagers. They have also had to take special care against spillages since Giglio is in the heart of one of Europe’s biggest marine sanctuaries. A vast system of steel cables, pulleys and counterweights were used to roll the half-submerged carcass of steel upright. The side of the Concordia that was lifted out of the waters appeared covered in brown mud and looked heavily crushed. “There is a lot of damage on the ship and we have to take stock of it,” Sloane said. The damage he said was caused by the capsizing, bearing 20 months of the ship’s weight and the operation to rotate the ship. Meanwhile, the Concordia’s disgraced captain is being tried for manslaughter and other serious crimes. Francesco Schettino was preparing for his next court hearing, due to take place in Grosseto on September 23. He is accused of having taken the ship dangerously close to the shore to perform a stunt, and to have badly mishandled emergency procedures on the night of the disaster. He left the Concordia before all passengers had been evacuated. - DPA

ext month’s New Zealand Healthy Food Guide gives us a bonus weight-loss toolkit lift-out. It features one month of menu plans and healthy recipes, and some of those recipes look divine. Thai chicken with crunchy coleslaw, chicken rolls with sundried tomatoes, harissa lamb with kumara and avocado salad … the list goes on. It would certainly not be a hardship to follow their plan for a month. The good thing is that most of the recipes are not expensive and they’re not hard to make, although for some families the fish dishes may stretch the budget a bit. Also in Heathy Food Guide next month the experts discuss the raw milk versus pasturised debate and five golden rules for digestive health. Next page are some of the recipes featured in Healthy Food Guide’s weight-loss toolkit:

Left – Chicken rolls with sun-dried tomatoes.

Call to stop broadband intervention By Hamish Fletcher Vodafone has hit out at “ill-conceived” intervention in the copper broadband market proposed by the Government and labelled it as corporate welfare to lines company Chorus. On the other hand, former Telecommunications Commissioner Ross Patterson has emerged on the other side of the debate and supports the Government wading into copper pricing regulation. The tussle over copper phone lines regulation flared recently with the launch of a campaign by Coalition for Fair Internet Pricing, which argued proposed Government intervention would effectively put a new tax on broadband consumers. New Zealand’s second biggest telco, Vodafone, is not named as part of the coalition but in its submissions on the issue yesterday said the Government “must

stop this ill-conceived intervention to raise copper prices above cost”. The brouhaha over Government intervention stems back to last December when the Commerce Commission suggested it could cut what Chorus charges retailers for access to wholesale copper internet services by $12 a month. This sent Chorus’ share price tanking, and about $190 million of shareholder value was wiped off the company on the day of the announcement. Chorus said the commission’s draft pricing decision could shave $150m to $160m off its pre-tax earnings if finalised. It complained if copper pricing was pitched too low, it would kill customer appetite for fibre services being rolled out as part of the Government’s $1.5 billion ultra-fast broadband network. The Government signalled it would intervene and, in Febru-

Dubai-based consultancy firm. His views were included in Chorus’ submission to the Government that backs intervention in the copper market. Mr Patterson said the type of intervention proposed in the Government discussion document last month was a practical option. “The relative pricing of copper and fibre services was a key element of the migration strategy that was built into the contractual component of the regulatory environment,” he said. Mr Patterson said contracts between fibre companies and the Crown included a loss-leader entry level fibre product, which was “deliberately set to undercut the then anticipated copper price”. Changes to copper pricing that could be made under the existing regime would completely undermine the loss leader fibre pricing strategy, he said. - APNZ

deliver unnecessary corporate welfare to Chorus, at expense of all consumers who will pay more for telecommunications services.” “Stop the intervention on copper prices. Existing policy settings are correct, clear and certain. The Commission should be allowed to set copper prices as intended. Intervention to stop this is not required, and only highlights the Government’s conflicted role. “All three options [presented in the discussion document] will damage competition, raise prices for consumers and do nothing to address issues that are equally important for securing a fibre future.” But Mr Patterson has emerged as a supporter of intervention, saying the current regulatory environment did not support the move to fibre services. ary, fast-tracked a review of telecommunications law. As part of this review, Communications and IT Minister Amy Adams issued a discussion document proposing setting Chorus’ wholesale charge for copper line services between $37.50 and $42.50 a month - the same price as faster fibre services. This is up to $10 higher than the Commerce Commission’s proposal last year. The Coalition for Fair Internet Pricing is rallying against the change, saying it was effectively a $600 million tax on broadband customers. Vodafone’s argument is much the same. “This intervention is quite simply a stealth copper tax on all consumers with no justification,” Vodafone’s submissions said. “There is no evidence to suggest UFB objectives are at risk. This proposal acts on a whim to

Move over gourmet cupcakes, the cronut is here. On a bustling Saturday morning at Moore Wilson’s bakery counter in Wairarapa, a woman points out one to her daughter. “Do you want a cronut?” “A what?” says the girl. A cronut is a golden, sugarcrusted half-croissant, halfdoughnut and is the latest food craze. Sometimes filled with custard or cream, the decadent franken-pastry has become popular all over the world and Wairarapa is now catching on. The cronut was invented in the oven of French chef Dominique Ansel’s bakery in SoHo, New York. Since he debuted his creation in May, a cronut craze has ensued with people lining up for hours outside his bakery to get a taste. Wairarapa people seem keen to get a taste too. Karen Maulder, manager at Moore Wilsons, said the bakery department started selling cronuts about two weeks ago and they were proving popular. “They are very nice.” Customers must also agree they have been selling well every day. “Most days we sell most of them.” The cronuts are delivered daily from Bordeaux bakery in Wellington and there are two varieties - chocolate and vanilla.

The Ten O’Clock Cookie Company has picked up on the trend and may do a trial run, said duty manager Julianna Hema. “We aren’t selling them at the moment, it’s something we are looking into. “I haven’t tried one but I’ve heard all about it.” Moise Cerson, the owner of The French Baker in Greytown, said it doesn’t sell cronuts and they have no plans to sell them in the future. He said the bakery just sticks to a core product range. Cronut creator Mr Ansel has even trademarked the name cronut in the US, leading to a flood

of creative names such as “Doissants”, “Crognets” and “CroNots.” There is apparently a black market for his pastries - they can go for as much as $40 each. On Twitter, Mr Ansel said one woman “legitimately cried” after the bakery sold out of them. Mr Ansel has also just released another creation - the never-collapsing souffle, which sold out within 15 minutes after its debut. Called the Magic Souffle, the Grand Marnier chocolate souffle has a soft chocolate centre, entombed in a toasted orange blossom brioche. - APNZ

In brief Blues’ new CEO The Blues have appointed Michael Redman as their new chief executive. Redman, 47, a former CEO of Ateed, former Hamilton Mayor and later chief executive of Hamilton City Council, said being given the opportunity to lead the Blues through a time of change was exciting. “The Blues are such an important part of this region’s identity and having moved into a new era with the private equity partnership, this is a fantastic opportunity to be part of the Blues future direction.” Redman was a founder and director of the NZ Breakers basketball franchise and has served on the board of the Northern Districts Cricket Association. - APNZ

Another Red axed It cost the Wallabies dearly at the last World Cup but Ewen McKenzie has gambled just like his predecessor, Robbie Deans, by overlooking a specialist backup No.7. McKenzie continued to surprise after just four Tests as Australia’s coach by dumping his latest former Queensland Reds favourite - ball-scavenging flanker Liam Gill - yesterday. Gill joins Quade Cooper and Will Genia as influential Reds stars overlooked at some stage by their former Super Rugby mentor with his omission from the latest Wallabies’ 28-man tour party. Instead versatile backrower Ben McCalman will once again play the role as back-up openside flanker to in-form No.7 Michael Hooper in the Rugby Championship clashes with South Africa and Argentina. - AAP

Folau craves more ball Fullback Israel Folau admits he is not seeing enough ball to be at his damaging best for the Wallabies, but says he is working hard to make sure he does. Folau has flourished at No.15 since making the switch from the wing for this month’s Rugby Championship clash with South Africa at Suncorp Stadium. The code-hopping star scored the Wallabies’ only try in Saturday’s 14-13 win over Argentina in Perth, busting through a trio of defenders to help break their four-match losing run. Folau said he doesn’t believe he is getting his hands on the ball enough to make his mark in attack. - AAP

Rebels sign Veainu The Melbourne Rebels have moved to add more speed to their 2014 side by signing young New Zealand winger Telusa Veainu from the Crusaders. The 22-yearold, a former national under-20s player, will move to Melbourne to take up the two-year contract after finishing up the ITM Cup season with his club Hawke’s Bay. Veainu has made eight Super Rugby appearances for the Crusaders and his previous club, the Highlanders, highlighted by a length-of-the-field try in Dunedin for the Crusaders this season. He’s also been in strong form in the ITM Cup, having scored 21 tries in 34 games over three NPC campaigns.

■ RUGBY

Judicial process ‘a farce’ By GreGor Paul He’s a smart cookie is Stuart Barnes, the former England first-five and now media commentator. He’s always insightful, measured and analytical and in his recent decree that the All Blacks are currently earning undue favour from referees, he’s right. But only up to a point and not in the way he portrays either. No question that Bismarck du Plessis could have hammered any other All Black than Dan Carter and not been yellow carded. His crime was to pick on the wrong bloke and the entirely legal was immediately adjudged by Romain Poite to be illegal. It was a poor call from the French referee, but not one that in itself should be extrapolated as evidence he unduly unfavoured the All Blacks throughout the game. There were five turnover penalties in the second half against the All Blacks. That’s not to say South Africa weren’t excellent over the ball but, in the lottery which is the breakdown, a referee bent on helping the All Blacks could have found fault with how the Boks were operating. This debate has perhaps been blown out of perspective by one clanger of a mistake by Poite. The initial yellow card only became the drama it did because du Plessis then followed it up with an idiotic and dangerous forearm smash.

Bismarck du Plessis makes his infamous tackle on Dan Carter

Barnes’ contention that this would normally be ruled okay in one of five games is hopefully codswallop. Rugby is in serious trouble if it is now okay for players to lead with their forearms and crack them into windpipes, jaws and other breakable structures. It’s not, and the awful justification that rugby is a man’s game is ironically right: real men don’t do that. Du Plessis is the world’s best hooker. He was having a belter of a game at Eden Park but gave Poite no choice. Those who want to believe in a wider conspiracy should wait for the return test at Ellis Park where it’s inevitable the Boks will get a better deal from the officials. That’s not because they are owed it based on what happened in Auckland, but because in all probability, at Ellis Park, they will be able to put the All Blacks under colossal pressure and win

the judgements that pressure will deserve. That’s how it has always been. Referees tend to be influenced by the flow of the game and given the desire the Boks will have, the advantage of home ground, their obvious set piece excellence and muscularity, they will most likely be in charge for long periods and win the benefit of any doubt. There’s a fair chance they will also win the game and, if they do, everyone should accept it’s because they were the better team on the day. The danger otherwise, as Barnes is suggesting, is that all victories should be attributed to favourable refereeing rather than the skill and endeavour of the players. That’s kind of what the All Blacks are facing at the moment every time they win, there’s allegations they cheat and get away with it or the referee copped out and went soft on them. The facts are a little different.

Since winning the World Cup, the All Blacks have picked up eight yellow cards while their opponents have collectively gathered nine and one red. And what about the game in Brisbane last year: no sanction for Scott Higginbotham’s knee to Richie McCaw’s face until after the game? Dean Greyling got yellow when everyone, even the Boks, said it should have been red. Why didn’t the IRB investigate Aurelien Rougerie’s eyegouging in the World Cup final? Why did the chief executive of the IRB intervene in the Adam Thomson case and no other - giving an immediate opinion to taint the judicial process? Go further back and it’s no different. Andy Powell nearly decapitated McCaw in Cardiff 2009 and nothing. In the same game Carter commits a high tackle that started at the shoulders and rode up and yet is banned for one week - after the chief executive of the IRB demanded he be cited. There is no conspiracy - referees just make mistakes and the judicial process is a farce that impacts on everyone. The only plus of Poite’s error is that it has heightened the tension and expectation of the rematch, a test that, regardless of outcome, has to be a celebration of a great rivalry where the victor is given due credit for what they achieve. - HOS

■ MID CANTERBURY TOA TRIALS

Going the distance Stayer and part-time hurdler Tuscan Fire, which won at the juicy odds of $101 at Flemington last month over 1400 metres, is moving into distances where he is most comfortable starting with Saturday’s Naturalism Stakes over 2000 metres at Caulfield. His trainer Dan O’Sullivan said Tuscan Fire’s last three races over 1400, 1500 and 1600 metres respectively, were the ideal stepping stones for the longer distances in the major Cups races over spring. The Mornington Cup winner, who has nominated for the Melbourne Cup, is a definite starter on Saturday after 30 horses were nominated for the Naturalism. - AAP

Whips crack as they head for home Little Cullect (Robbie Holmes) leads the field into the straight in the Qualifying Pace at the Mid Canterbury Owners and Trainers Association trials at the Ashburton Raceway yesterday. Unfortunately the effort of leading most of the journey told, and Little Cullect faded to seventh, whereas Jacko (Michael Hay) had enjoyed a perfect trail for the best part of the race and took full advantage, going on to win in a sizzling 3-09.6, in fact the entire field of 10 made it under the qualifying time. photo tetsuro mitomo 179013-tm-019

A flash of form from a horse which had previously shown little has encouraged premier trainer Peter Moody to expect a vast improvement from his Frenchbred stayer Kesampour. One of four well-credentialled imports Moody will saddle up at Caulfield on Saturday, Kesampour had shown little in either his track gallops or his racing since joining Moody. At his only Australian start Kesampour finished seventh behind stablemate Ibicenco. They meet again in Saturday’s Group Three Naturalism Stakes and their trainer is expecting there to be little between them. “I saw the improvement in him in his work today that I’ve been hoping to see for a couple of months,” Moody said. - AAP

A barrier trial win at Rosehill yesterday has primed Snitzerland for her first-up assignment in the Group One Moir Stakes. Trainer Gerald Ryan has no doubts the mare can realise her Group One destiny this spring in either the Moir or the Manikato Stakes. Her smooth trial experience was in contrast to the one her stablemate Dothraki encountered earlier this month when Ryan feared his spring was over before it began. The talented colt was withdrawn from his scheduled heat after he cut himself when he took fright as the horse in the neighbouring stall played up. “Snitzerland was very pleasing and she has come through her trial well.” - AAP

Cheri in Metropolitan Up-and-coming galloper Prince Cheri has figured in one of biggest pre-post betting moves of the Sydney spring carnival. On the back of the news the former French stayer would be staying in Sydney for the time being, Prince Cheri firmed into favouritism for the Group One Metropolitan. As much as $16 was available early yesterday about Prince Cheri’s chances in $400,000 Metropolitan at Randwick on October 5. But the David Vandyke-trained stayer is now less than half that quote. Vandyke’s announcement that Prince Cheri would try to win his way into the Caulfield Cup by contesting the Metropolitan triggered the collapse in his odds. “It’s definitely a reaction to connections stating the horse is staying in Sydney,” TAB’s Glenn Munsie said. - AAP

Erakovic moving on up Marina Erakovic has edged closer to the world’s top 50 after reaching the Bell Challenge final in Quebec yesterday. The New Zealand number one moved 13 placings up the latest WTA rankings to world number 55. Her career high is 39th which she reached last year. Erakovic lost the Bell Challenge final in straight sets to Czech Lucie Safarova 6-4, 6-3. The 15-yearold Kiwi has earned $US520,179 ($637,127) in prize money this year and has a singles record of 27 wins and 20 defeats. - NZH

Stewart in . . . Manly have named star fullback Brett Stewart for Friday night’s NRL sudden death finals clash with Cronulla at Allianz Stadium. However, the Sea Eagles admitted Stewart still faced a fitness test on a troublesome hamstring strain before receiving the green light. Last week’s replacement at No.1 Peta Hiku is on standby. Richie Fa’aoso has been named on a seven man bench despite leaving the field with a horror head knock in last weekend’s bruising finals loss to Sydney Roosters. - AAP

. . . Carney out In a huge blow to Cronulla’s NRL finals hopes, Sharks playmaker Todd Carney has all but been ruled out of Friday night’s clash with Manly due to a hamstring complaint. A Sharks official said Carney would be monitored during the week despite not being named in their side yesterday. Carney suffered the hamstring complaint late in their controversial 20-18 elimination final weekend win over North Queensland. - AAP

Move on, says Gallen If Paul Gallen wasn’t already public enemy No.1 in Queensland, the Cronulla skipper is sure to irk a few more Cowboys after calling on North Queensland to stop using the seventh-tackle try saga as an excuse for being bundled out of the NRL finals. Gallen said the Cowboys needed to move on from their claim that Saturday’s refereeing howler at Allianz cost them the 20-18 defeat. “I think they are (carrying on) now,” Gallen said yesterday. “It’s a mistake and we don’t want to see it happen. But to say it’s cost them the game and a conspiracy theory ... no-one knew it was seventh tackle on the field.” - AAP

Hayne leaving Eels? Denials by Jarryd Hayne’s manager have not stopped speculation mounting that the star fullback will leave Parramatta - and Eels great Brett Kenny admits he wouldn’t blame him. Hayne’s agent Wayne Beavis dismissed a weekend report that the Bulldogs would make a million dollar move on his client as “ill informed”. However, Beavis told AAP he would speak again with Hayne - who is contracted with the Eels until the end of 2015 - when the flyer returned from a New Zealand trip this week. - AAP

Coaching the coaches It was all about coaching future cricket coaches at Ashburton College yesterday. Canterbury Cricket development and coaching manager Richard Pithey returned to his former home as part of a coaching system which sees Mid Canterbury cricket representatives given training so they can go out to clubs and coach youngsters in Have A Go cricket sessions. Ashburton College pupils and Mid Canterbury cricket representatives Tom Ravenscroft (left) and Gareth Hunt, both 14, along with Cameron Jopson, 13, were given coaching booklets from Pithey as part of the programme. ■ AMERICA’S CUP

Oracle learning lessons from Team NZ By Dana Johannsen They say imitation is the sincerest form of flattery, so Team New Zealand take it as a compliment that Oracle Team USA have been copy-catting some of their strategies and manoeuvres. Other than making significant strides with their upwind performance, particularly in heavy air, one of the reasons behind the Oracle team’s sudden improvement is they have learned to get the boat around the racecourse better. During the early races, skipper Jimmy Spithill mentioned on several occasions they were struggling to match Team New Zealand’s efficiency with their tacks. The Kiwi crew were gaining a lot of ground early on as they were able to perform a hull-tohull tack - when the boat rolls

from one hull to the other in the tack, limiting the wetted surface area in the manoeuvre. The Oracle crew have spent a lot of time studying Team NZ’s choreography of this move and have begun executing it themselves. Oracle also seem to have copied Team NZ’s upwind foiling technique, where their hulls skim the water, rather than full foiling mode, which is faster but less stable. Team NZ skipper Dean Barker said given Oracle haven’t really had the luxury of racing their boat in proper match race conditions until now, they were always going to pick up a few things as they go. “We’ve been in a race environment for a lot longer than they have, so we probably learned things a little bit earlier than they did,” said Barker. “If there’s good ideas out there then you obviously try

your best to match them and they have obviously had a good look at what we’ve been doing, they’ve simulated a lot of those and it’s working for them.” Barker said just as his team improved at an exponential rate during the Louis Vuitton series, he always expected his opponents would get better as the America’s Cup match wore on. But he remains confident in the performance of the Kiwi boat. While Oracle’s drastic changes come with big risks, Team NZ continue to make subtle improvements to their boat. “We’re refining the whole time. Every day we learn a little bit more about how to sail the boat consistently better, just in the moding and how quickly you accelerate out of tacks and everything else and you’ve just got to keep pushing the limits of that,” he said. - NZH

and on the evidence from Invercargill, has shuffled slightly ahead. From the moment she came on court last Sunday she looked like she had a point to prove. Mobility may have been an issue in the past but her fitness and speed have improved significantly over the last 18 months, which allowed her to handle the relentless attention of Renee Hallinan, known as one of the toughest markers in the sport. willingness to throw the long pass and the eye for a gap in the circle. “Anna’s background as an attacker means she is very effective on the circle edge,” says Ferns assistant coach Vicki Wilson. “She’s a natural feeder and has good vision.” However Tairi is by no means out of the picture and their battle for the wing attack position will be one of the fascinating subplots of the Constellation Cup series. - HOS

■ NETBALL

She’s already ‘world famous’ in Christchurch - now Anna Thompson has the chance to finally make her mark on the national netball landscape. Thompson was one of the more impressive performers in the first Constellation Cup test, at the heart of New Zealand’s strong third quarter effort which ultimately took the game away from Australia. Playing in the unfamiliar position of wing attack, Thompson combined well with Laura Langman, providing the platform for Irene van Dyk and Maria Tutaia to send the home side clear. It’s a marked change for Thompson, who has always been fringe rather than forefront for the Ferns. Now the Tactix captain, she is the only foundation player remaining at the franchise (77 ANZ Championship games) and a recognisable Christchurch identity; let’s face it, you know you have made it in the Garden City when you have a cocktail named after you at a local bar (‘Spannerlicious’ - mango, berries, lemon, Red Bull and vodka). But Thompson, who carries the nickname ‘Spanner’, has never been front of mind in the international arena. First selected for the Ferns squad in 2008, she made her debut a year later but has only accumulated 12 caps since then. Her ambitions were mostly thwarted by the presence of Maria Tutaia and Irene van Dyk, who have played 71 tests together and monopolised the New Zealand shooting circle for the last eight years. Now the unexpected vacancy at wing attack, with the injury to Camilla Lees and the withdrawal of Liana Leota, has provided the chance for a second coming. Thompson is jousting with Courtney Tairi for the WA spot

Tourney looms for football girls BY MYLES HUME

MYLES.H@THEGUARDIAN.CO.NZ

Football coach Byron Pearson and his 14th grade girls Mid Canterbury team will be given a sneak peek into how they rate against teams from across the South Island on Saturday. His team will be among 45 teams from 10th-16th grade who will be competing in the Pre-South Island Football Tournament, a warm up event held in

Ashburton prior to boys’ and girls’ age-grade South Island tournaments next month. Last night Pearson’s squad trained at Argyle Park before their outing this weekend that will see them playing three matches in one day. “It’s about creating tournament fitness and getting up to scratch, basically this tournament is a yardstick to see where we are against our opposition.”

He felt his team had prepared well, with the core sticking together throughout the regular season and really beginning to show a real understanding about each other’s games. The tournament is set to lure teams from as far south as North Otago and as far north as North Canterbury, with 68 games to be shared between the Ashburton Domain and Argyle Park venues.

Watson century gives Australians rare victory BY ADAM HATHAWAY Shane Watson’s heroics with the bat ensured Australia finished their tour of England in style as they clinched the one-day series 2-1 with a 49-run win over the hosts at Southampton. England were bowled out for

249 in 48 overs in reply to Australia’s 298 all out, with James Faulkner taking 3-31 as the tourists signed off their trip with a decisive win. Watson’s eighth one-day hundred was the decisive factor as Australia won their first trophy of an English summer in which

they have contested the Champions Trophy, the Ashes and this five match series. Two matches were rained off but wins in Manchester and Southampton were enough for Michael Clarke to get his hands on the silverware. Watson hit 143 from 107 balls with 12 fours and six sixes, pass-

ing 5000 one-day runs in the process and Clarke made 75 as the pair shared a partnership of 163 for the fourth wicket. England were never up with the rate as Australia’s bowlers kept them pinned down until Ravi Bopara and Joss Buttler had a brief flurry. They took 26

off two overs but when Buttler went for 42 and Bopara for 62 the win was in the bag as England fell away. England’s reply had got off to the worse possible start when Kevin Pietersen was run out for nought after not responding to Michael Carberry’s call. - AAP
