Business approach best for landlords Richard Evans
L
andlords can make mistakes too. Property managers see a lot of the things that can go wrong with a tenancy – and it’s not always the tenants’ fault. Here are some things that should be “no-go zones’’ for landlords. Getting too friendly It is very hard to get tough with an erring tenant if you have become friendly. Even if the house is professionally managed, it’s important owners do not get involved with the tenant. We will often reprimand a tenant for some breach of the agreement _ such as having a dog on the premises _ only to be told the owner agreed weeks ago, but failed to tell their property manager.

Ignoring repairs Amazingly, we came across an owner who told the tenant that if the blocked drains and sewer were the owner’s fault, he would reimburse the cost of clearing them to the tenant. The roots of an adjoining tree were the culprit, so the owner decided it wasn’t his responsibility. The tenant, with our help, took the owner to the Tenancy Tribunal and won full reimbursement, costs and damages.

That owner thought he was so smart and clever and failed to listen to the advice of a property manager. It cost him much more that it needed to have done.
There are rules about tenants having the right of peaceful enjoyment, but some owners feel compelled to stray on site, pop in to say hi and just check the fence.

Owners and agents have to get consent and/or give notice of such visits and, if they are too frequent, that can be seen as harassment. uying or selling your home, you want to make sure you’re getting the best possible value for your money. You may have heard the terms “buyer’s market” and “seller’s market” and are now wondering what effect these conditions have on you as you move ahead with your transaction. A buyer’s market is what you get when there’s more supply than demand. There are more people looking to sell houses than there are people looking to buy
houses. In a buyer’s market, sellers may have to accept a lower price than they want to sell their home and may have to resort to staging and incentives. This is the ideal situation for buyers, because they can get a great deal. A seller’s market is the opposite. The demand is larger than the supply. People have more money to spend on real estate, so sellers will often see several buyers competing to buy their property, which drives up the price. This means that
buyers will have to spend more to get what they want. This is the ideal situation for sellers, because they get a great price on their homes. Tony Alexander the chief economist for the BNZ produces an excellent market summary by surveying real estate agents throughout New Zealand. From his report he has noted a sharp increase in the number of appraisals being requested, but also determines that this is a normal seasonal factor and not necessarily

It is likely New Zealand’s market will follow the same as Australia’s where investors are becoming the key driving force in many markets while first home buyers are being squeezed out.

I thought I would touch on space saver options - or their illusions. I work on many homes where people have either downsized or prefer smaller homes so they can enjoy life rather than doing gardens and housework.

Window treatments can be kept simple and lighter by using blinds and sheers if you want more softness. Blinds can look harsh on their own in a room like this.

T SEEMS everywhere we look at the moment we’re seeing flowers and floral fabrics. The catwalks are filled with glorious blooms of all descriptions, and the soft furnishing fabric Editeurs have also followed this trend in interiors. Floral fabrics are very much part of New Zealand’s heritage. In general, we feel comfortable with them because we grew up with them in our grandparents’ and parents’ houses. Many of us have an English or similarly European heritage where, even today, florals make up the bulk of sales. But florals have come a long way since then and now appeal to all ages and cultures. This movement began a few years back when designers such as Lori Weitzner for Sahco started taking the traditional floral and delving further into ways they could reinterpret it. She explored photography and its negatives to come up with stunning prints that are soft and easy to live with. Inkjet printing has been thoroughly investigated when it comes to florals, resulting in gorgeous prints on cottons, velvets and linens that can look much like beautiful watercolours. These designs are so abstract that often you need to look closely to see they are in fact flowers. The results are not too feminine for the guys, but still with a grace that will add movement to your decor. The simplicity is often created because the pattern
is one colour or subtle tone-on-tone. I often imagine some of the very latest woven florals such as this have been inspired by the subtleties of taking a bird’s eye view of a tropical garden or forest. Of course, at the other extreme are strong graphic prints inspired by the 1950s, usually with a linen base cloth, gorgeous colours and an overblown scale. These are lots of fun to work with, creating a colourful and playful interior. The more traditional fabric houses such as Colefax and Fowler have made moves to answer the
needs of the younger market too. They would never depart from their classic designs such as the late Queen Mother’s favourite hydrangea print (purportedly she chose the same fabric again when her bedroom was renovated), but have moved to an extended colour palette. Their colours now include the palest of lavender, silvery blues and serene greens, all with a Gustavian feel. Floral prints have less impact now on the international furnishing market, having been replaced primarily by exquisite embroideries

in linens, cotton and silk. In New Zealand though, we still love our prints and use them beautifully in drapes, bedding, cushions and upholstery. If you are brave, a floral pattern on a sofa looks simply stunning. I have a small sofa in my nook that is covered in a lovely Manuel Canovas print on linen. The subtle tones echo the adjacent garden view. For a change I whip off the cover and expose the neutral linen and pile on coloured cushions. (The cover also gets a well-earned wash as Zach, my little dog, seems to think it’s his bed when we aren’t home.) So my advice is to put away the notion that florals are for our parents’ generation and be inspired. Damasks too have a new modern twist, but that’s a whole different story. Preparing for sale
Take the time to plan your new fence ahead and put up a fence on the boundary line. You need to serve a notice on your neighbour giving the details of your proposal in writing. The notice must state that it is served under the Fencing Act 1978. and must contain: - Names and addresses of you and your neighbour. - A description of the fence, where it will go, and who will build it. - The material and estimated cost and where the materials are to be bought and paid for. - The date work is to start and finish. - Advice to the neighbour that they have 21 days to object and make any counter proposals. - Advice to the neighbour that if they think they’re not responsible for paying they have to let you know

If you still can’t agree, you can then to go to mediation, arbitration, a disputes tribunal or the district court. Local authorities also have their own rules covering fences. Generally the occupiers of the properties sharing a boundary share the responsibility for work on a boundary fence.

encing is at the forefront of most people’s minds at the moment after last week’s wind storm, and if you, like most of us, need a new fence, now is a good time to plan and understand the laws around fencing so that the new fence adds to your property rather than detracts from it. Fences are such an important part of a property that there are laws that cover what you can and cannot do. Disputes between neighbours over a common fence can make day-to-day life unpleasant, so an understanding of the laws may help avoid potential problems. The Fencing Act 1978 provides a set of rules that govern obligations associated with a fence erected on a common boundary. Generally, if you want to build a fence on a common boundary, or upgrade an inadequate existing fence, you can do so as a property owner. If you are replacing an existing fence, you will need to consult with your neighbour before getting started. If you want your neighbour to contribute to the cost of the fence, you will need to discuss this with them before you start construction, and come to an agreement on the fence type, its construction and cost. A popular misconception is that all landowners must share the costs equally when building a fence along a common boundary, however this is not an automatic requirement. If you do reach an agreement with your neighbour, it might pay to write down what you have agreed, and both sign it. If you can’t reach an agreement, you can’t just go
