Local Government Procurement Initiative – We need your Help Members will be aware of the ongoing joint initiative between the Fair Work Ombudsman (FWO) and ASIAL to improve transparency and fairness in the awarding of local government tenders to private security companies. FWO has focused on an education campaign directly targeting local councils, their procurement managers and councilors to ensure they understand the rights and responsibilities of employers and employees in the security industry regarding compliance with workplace laws. Councils have been made aware of their need to ensure their procurement decisions do not undermine compliance with workplace laws. The next phase of the campaign FWO
will this year focus on audits of the procurement practices of a number of councils in each state.
How you can help If your business has been involved in a tender process with a Local Council (or for that matter elsewhere) let ASIAL know the details of your experience – good or bad. Where appropriate, we will share the information with FWO to identify best practice and areas of concern. Under s550 of the Fair Work Act 2009, FWO may also pursue convictions against individuals and corporations (including Local Councils who are knowingly involved a contravention – like

State and Federal governments and private sector end users need to recognise their responsibility to do more than just go through the motions when considering submissions for tenders.
Raising awareness of members among consumers ASIAL’s ongoing consumer awareness campaign provides value to members by promoting the use of ASIAL members. This year’s campaign will focus on householders and will primarily target commuters travelling by bus, train or car. In addition we will also be promoting the use of ASIAL members to procurement officers in Local, State and Federal Government. Nominate now: 2015 Security Awards for Excellence The 20th Annual Australian Security Industry Awards for Excellence will take on a global perspective with the launch of the Outstanding Security Performance Awards (OSPAs) in Australia. Award nominations are now open until 13 August 2015. All submissions must be made online and nominees may nominate in multiple categories. Winners of the prestigious awards will be celebrated at an awards ceremony to be held at the Westin Hotel in Martin Place on Thursday 22 October. Hundreds are expected to attend the event, which promotes and acknowledges the outstanding achievements of security professionals around Australia.

Next Generation 000 Australia’s Triple Zero service was introduced in 1961 and has been operated by Telstra. With the Emergency Call Provider contract up for review in 2016, Australia’s Emergency Services Organisations (Police/ Fire/ Ambulance) have taken the opportunity to embark on an ambitious strategy to enable any person in Australia to use “any device, anywhere, any time” to contact emergency services. ASIAL’s ongoing consumer awareness campaign provides value to members by promoting the use of ASIAL members.This year’s campaign will focus on householders and will primarily target commuters travelling by bus, train or car. In addition we will also be promoting the use of ASIAL members to procurement officers in Local, State and Federal Government. Here we explain what you need to know about our latest consumer awareness campaign and how to maximise its effectiveness for the benefit of your business. Commuter campaign Utilising the high-impact imagery of our current consumer awareness video that reappropriates the story of Little Red Riding Hood to advocate the use of an ASIAL member – we’ll be targeting commuters on trains, buses and arterial roads. These commuters have homes, valuables, holiday plans, perhaps even a nice car. And for at least one hour everyday, they will provide a captive audience for our colourful, quirky, eye-catching animated adverts as they travel to and from work. #GenMobile workforce compromising Australian business data security Businesses are ill prepared for the high-risk, high-growth mindset of the #GenMobile workforce, creating alarming disparity around security practices in the corporate world, according to Aruba Networks. The ‘Running the Risk’ security threat study, which surveyed more than 11,500 workers across 23 countries worldwide, including Australia, showcases that employee attitudes are swaying towards more sharing of devices yet an indifferent view to security in the workplace. The study shows that highly regulated and tech savvy industries, higher-earning males, and emerging markets pose the greatest risk to enterprise data security. The report highlights three key trends for #GenMobile, who are paving the way for risk-prone behaviour in the workforce – which can be both good and bad for business. • Sharing becomes the norm: Six in ten share their work and personal devices with others regularly. Nearly a fifth of employees don’t have passwords on devices, with 22 per cent of those stating they don’t have security measures in place 24 //SECURITY INSIDER JUNE 2015
so that they can share more easily and over half (54 per cent) of the Australian respondents were not worried about the threat. • Indifferent attitudes toward security arise: Nearly a third (31 per cent) of workers admit to having lost data due to the misuse of a mobile device. Security ranks fifth behind brand and operating system when #GenMobile is making buying decisions for new devices. Alarmingly in Australia, almost nine in ten (88 per cent) assume their IT departments will keep them protected; however, nearly half (43 per cent) have lost data due to the misuse of a mobile device. • Self-empowerment succeeds: Over half (56 per cent) of Australian workers today said they are willing to disobey their boss to get something done, another 40 per cent say that mobile technologies enable them to be more productive and engaged, and over three
quarters (77 per cent) are willing to perform self-service IT. “The findings highlighted that while #GenMobile workers are willing to proactively drive productivity and business growth, these employees are also far more relaxed with sharing company data. Most notably, #GenMobile workers are oblivious to security threats or risks,” said Steve Coad, Managing Director of Aruba Networks in Australia and New Zealand. However, as this high-risk culture enters the enterprise, the report finds an alarming level of disparity among industries, individuals and countries when it comes to the treatment of mobile devices and data.

company data through the misuse of a mobile device, which is 25 per cent higher than the average across all industries surveyed. Conversely, Australian financial institutions appear to be leading the way with more stringent security measures in place, with only 11 per cent admitted to losing company data through the misuse of a mobile device. • High tech is at high risk: High tech employees are nearly two times (46 per cent) more likely than hospitality or education workers to simply give up their device password if asked for it by IT. Worryingly, 93 per cent of high tech workers in Australia have already or would consider sharing their password.
Spotting the Risky Individual • Males more prone to data theft: Men are 20 per cent more likely to have lost personal or client data due to the misuse of a smartphone, and 40 per cent more likely than females to fall victim to identity theft. • Younger employees wreak havoc on company security:
Respondents over the age of 55 are half as likely to experience identity theft or loss of personal/ client data compared to younger employees. The age bracket with the highest propensity of data and identity theft are employees between 25-34 years old.
Mapping Global Risk Trends • High-risk, high growth: The emerging and growth markets of China, Thailand and the United Arab Emirates (UAE), are found to exhibit the highest risk behaviours worldwide suggesting that greater risk-taking is linked to increased growth and opportunity as much as it relates to security risk. • West is playing it safe: To support this connection, the least risk-prone countries are the westernised markets, including the USA, UK and Sweden.

In a connected world, businesses need to nurture creativity, while simultaneously planning for the security risks these behaviours bring with them.”

To support member engagement in the upcoming ASIAL Consumer Awareness Campaign, we’ve answered the five most frequently asked Facebook questions by seeking advice from social media experts.
How do you know if Facebook is the best social media channel for your business? In his Entrepreneur article ‘How to Choose the Best Social Media Platform forYour Business’, Social Media Firm CEO Scott Levy writes: “Facebook is one of the most powerful social platforms in the world. It’s size alone is a positive for any business, because you can assume most people are on it.You can choose what to look at and what to share. This gives businesses more opportunities to represent themselves in various ways. Facebook is about a long-term commitment and building relationships, although there’s some immediacy as you can reply directly to people’s comments or questions. Almost any business can benefit from having a Facebook page.” [Tip: Have a clear idea of who you want to reach on Facebook. The more you know about them, the better you can target your message.]

What is key to a successful Facebook page? Create compelling content – it’s as simple as that, according to Facebook for Business. “Your recipe for success is to create Page posts and adverts that are interesting and valuable to your customers – and to target your messages so that the right people
see them.” [Tip: Experiment with different kinds of posts (photos, videos, links, etc.) and replicate your success on posts that get more engagement.]
What should I post and how frequently? Social Media Today advises publishing around 80 per cent original and curated content that provides value to your followers and no more than 20 per cent promotional content. “Be mindful of the content your post on your page to make sure you provide value to your visitors and fans. Provide a mix of content related to your products or services Don’t stray too far off your topic! Posting at random or not regularly enough can leave a negative impression on your page visitors and affect your reach. Also, posting too frequently can have an adverse effect on your Page engagement. childcare and a boost for small business and infrastructure in focus for the 2015 Federal BudgET Whilst changes to super and new taxes do not feature in this year’s Federal Budget, it did announce changes to Age Pension eligibility, a $3.5 billion child care package for working parents, tax cuts for small businesses and increased spending on infrastructure in northern Australia. Here’s a rundown of highlights.
Age Pension eligibility changes From 1 January 2017, there will be changes to eligibility for the Age Pension, which will impact on retirees on part-pensions. Couples with assets of more than $823,000 outside their family home will no longer be eligible for the part-pension. Previously couples who owned their own homes could have up to $1.15 million in assets. For single homeowners the threshold has been cut from $775,000 to $547,000. The assets taper test rate will increase from $1.50 to $3, which means the pension payment reduces by $3 a fortnight for every $1,000 in assets above the asset threshold. Retirees who are entitled to the full Age Pension will be able to own more assets and still qualify. The asset limits for single home owners will increase
from $202,000 to $250,000 and from $286,500 to $375,000 for home owning couples.
Indexing and deeming thresholds will not change The Government has decided not to proceed with the changes to indexing of the Age Pension it announced in last year’s Budget. This means the Age Pension will continue to be indexed to average male weekly earnings and not the Consumer Price Index. The Government also reversed its decision to reduce the deeming thresholds for the income test it announced in last year’s Budget.
Access to super for people with terminal Illness Rules that determine early access to super for people suffering from a terminal medical condition will be amended from the current life expectancy limit of 12 months up to a period of 24 months. The Government is proposing this change take effect from 1 July 2015.
Families Package The Government will add $3.5 billion to childcare for working parents.
From January 2017, families who earn between $65,000 and $185,000 a year could be $1,500 a year better off with the new childcare subsidy. However, families with one stay-at-home parent will lose this subsidy once their income goes above $65,000. With the Government’s Paid Parental Leave Scheme not going ahead, employees who receive paid parental leave from their employer will no longer be eligible for the government’s ‘minimum wage’ scheme.
Investment in road, port and power infrastructure A $5 billion Northern Australia Infrastructure facility is being introduced to help develop Australia’s north through better road, port and power infrastructure. The investment has added to the $50 billion in transport infrastructure the Government announced in last year’s budget.

In the previous issue of Security Insider, Chris Delaney, ASIAL’s Industrial Relations Advisor, caught up with Cletus Brown, Director of Knowledge Solutions at the Fair Work Ombudsman to find out about the role of the FWO. It proved so popular that we have invited Cletus back to tell us more about the FWO and he accepted the challenge! Chris: Welcome back Cletus, good to see you again. I thought you might have sent someone else after the last interview! Cletus: Always good to see you Chris and thanks once again for the chance to reach your members. Chris: OK, let’s get down to it. Last time we spoke you mentioned you were about to release a shiny, new policy about compliance and enforcement. I’ll let you talk about that in the next issue but this time I want to find out more about what your Inspectors do, the powers they have and what ASIAL members should do if they are contacted by one of them. Cletus: You are right, our new Compliance and Enforcement Policy was released in March and I will happily come back and talk about the various elements of it because it sets out how we want to work in the future but, just for you, I will talk about our Fair Work Inspectors (FWIs) – but you owe me!

Chris: OK then, what powers do your Inspectors have? Cletus: Our FWIs are appointed under the Fair Work Act 2009 and this piece of legislation gives them certain powers to investigate suspected contraventions of the Act and Modern Awards. In simple terms, if we think people are not getting their full entitlements we can investigate. Chris: I have read the Act and it doesn’t give them the right to go around scaring security industry employers. Cletus: (laughs) No it doesn’t and I am sure none of our FWI’s try to scare anyone. And anyone meeting all their obligations will have nothing to worry about. Chris: Well, I know it’s the: “I’m from the Government and I’m here to help you” comment that scares us! It is difficult for employers not make a mistake in such a complicated system, an inspector will always find something even if it is minor.
Cletus: We are not in that business. We genuinely want to help business to get it right without penalising them. Chris: I think some businesses will need a little more convincing. Can an Inspector, or FWI as you keep calling them, enter an employer’s premises? Cletus: Yes they can. They can enter any premises where the employer operates or visit a location where the employer has an employee working. In most cases, an FWI will give an employer notice that they are coming and explain what they are looking for. There are times though, when we have to use the element of surprise so that we can be sure we get the full picture of what is actually happening on the ground. Importantly, when an FWI arrives at a workplace they must produce identification of who they are and state the intention of their visit. So your members are well within their rights to ask for this identification if they are visited by an FWI.

Chris: Do you only go in when an employee lodges a Request for Assistance? Cletus: No, there are other events that may trigger an investigation. We undertake targeted campaigns in industries or regions and investigations may result if we find evidence of contraventions. We also receive information from a range of sources such as other businesses or the media and we will consider investigations in certain circumstances. And we even get ‘tip offs’ from industry parties who, like us, want a level playing field for participants in their industry.
Chris: OK, once they are there, what can FWIs look at? Cletus: One of the main things is time and wage records – and I could fill a whole session on how to comply with those requirements! Chris: Please don’t – just give us the basics. Cletus: OK – FWIs have the power to look at any document or information they feel is relevant to their investigation. They can also interview anyone they believe will assist with their investigation. Chris: What if an employer refuses to cooperate and provide the information requested? Cletus: We have powers under the FW Act to issue a Notice to Produce. This is a document which compels the holders of documents to provide them to us. Failure to comply with a Notice to Produce can result in fines of up to $10,200 for an individual and $51,000
for a corporation. Chris: Let’s go back a step – what prompts the FWO to start an investigation? Cletus: There are several things that may lead to an investigation. We receive over 20,000 Requests for Assistance each year. These largely come from employees who feel they have not received their full entitlements. We make an assessment of their claim and decide what is the most appropriate course of action to take. Chris: So you take the employee’s word for it and go after the employer? Cletus: No we certainly do not! We consider a range of factors including any evidence the employee may have, the number of other Requests for Assistance we may have had regarding that employer, the nature of the allegations and the employee’s individual circumstances.
Chris: What should employers do if they receive a visit or a call from an FWI? Cletus: in the first instance cooperate with any request from an FWI. Employers should feel free to ask questions about the nature of investigation. FWIs don’t only investigate, they also try to help employers to comply. As I said last month, we know most employers are trying to do the right thing. If an employer cooperates and complies with all their obligations we are less likely to consider taking further enforcement action such as litigation. And of course, if they are members of ASIAL they should ring you as soon as they can. We are always happy to work with employer organisations and employers to reach a good outcome that sets the employer up for ongoing success with their compliance obligations. DEALING WITH ALCOHOL AND OTHER DRUGS IN THE
WORKPLACE g

It is difficult for employers to know what can and cannot be done to meet their statutory obligations of providing a safe work place, safe system of work and ensure that employees are fit to work. What can be included in a policy? Can it be enforced? What is reasonable? In this article we discuss the impact of recent decisions of industrial tribunals relating to drug and alcohol testing and how these may affect employers in the security industry. The security industry (including Cash in Transit) operates 24/7, 365 days each year and is considered to be “high risk” in many of its activities. Customers expect licensed, trained and professional security officers to watch, guard and protect their property and their people. The responsibilities are as high as the expectations and employers must ensure that employees are “fit for work”. That means not suffering from fatigue or the effects of alcohol and or other drugs. The first step towards meeting these responsibilities is to develop a policy on alcohol and other drugs which outlines how, when and by whom testing will be conducted, the type of testing and whether there will be zero tolerance or a predetermined and agreed cut off level commensurate with Australian Standards.
How testing may be conducted 38 //SECURITY INSIDER JUNE 2015
In a recent decision of the Fair Work Commission (FWC) an employer was successful in gaining approval to conduct random tests using either saliva or urine testing or both in combination. The Commissioner commented that the benefits of adopting both methods in random combination “significantly outweigh any privacy detriments…and provided “significantly enhanced deterrent properties”.
Saliva or Oral Fluid Testing Oral Fluid Drug Screen tests should meet Australian Standard 4760:2006 and be capable of screening for: • THC (marijuana,“weed”,“grass”) • Methamphetamines (ice, ecstasy) • Amphetamines (speed) • Opiates (derivatives of the opium poppy including heroin, morphine, codeine) • Cocaine
Urine Testing The most common way to test for drugs is a urine test. This involves giving a urine sample, which is then either immediately screened through an on-site immunoassay test and/
or sent for full laboratory analysis. The initial screening informs the testing officer whether the donor has traces of drug in his/her body or not. When there are indications of the urine containing drugs it is commonly called a “non negative” result. Any urine test procedure should be fully supported by Australian Standard AS4308:2008. As with any screening there is a small error rate, however, if the initial screening is conducted in accordance with the manufacturer’s instructions the results are approximately 99% accurate.
Breath Testing A breath test is used to determine the amount of alcohol a donor has in his or her system. The principal of breath analysers is based on Henry’s Law, which states that the concentration of gas in the air immediately above a liquid is proportional to its concentration in liquid. ASIAL recommends that any policy should allow the employer the opportunity to use whatever test is most effective in the detection of substances used by an employee.

When testing should be conducted
Who should conduct screening/testing?
Testing/Screening should take place under the following circumstances: • Pre-employment. As a precursor to employment, as a condition of employment, and part of a medical examination. • Post Incident or in the circumstances where a major incident or specific event has occurred or may have almost occurred – a “near miss”. • On re-employment of a casual employee after a lapse of employment for a period of thirty or more days. • On a random basis, inclusive of all employees. o In each calendar year a minimum of 4 alcohol tests and 4 other Drug(s) screenings. • Where the company has reasonable cause to believe an employee is affected by alcohol and/or other Drug(s). • Where the company has reasonable cause to believe the employee has brought into the workplace alcohol and/or other drugs and those drugs are possessed, sold, solicited or supplied. • Where the company finds alcohol and/or other drugs in the workplace. • Upon the report of such usage in the workplace by reliable information. • Where the company is informed of a breach of Policy. • Where there is evidence of tampering of previous testing in the workplace. • Where an employee has returned a previous positive test result • Where an employee notifies the company of a dependency issue in relation to the use of alcohol and/or other drug(s).
Employers can engage external specialist organisations to conduct screening activities. This can be beneficial in providing third party objectivity to the process. Accredited training can be conducted on-site, offering full certification for the collection of urine or saliva specimens by direct employees of the employer. It is important also to ensure that programs are accredited for AS/ NZ4380:2008 Urinary Drug Screening – “Recommended practice for the collection, detection and quantitation of drugs of abuse in urine” and Oral Drug Screening – AS/NZ4760:2006 Procedure for specimen collection and the detection and quantitation of drugs in oral fluid.
Tolerance Levels Because of the nature of the security industry and the role(s) played by security guards, ASIAL recommends strong consideration of a zero tolerance for employees testing positive (or non negative) to either alcohol or drugs in the workplace. The Federal Court (Full Court) of Australia recently dealt with a case where an employee dismissed for testing positive to marijuana challenged the right of the employer to terminate his employment. The employer had in place a Code of Conduct and a Zero Tolerance Drug and Alcohol Policy. This decision indicates industrial tribunals are willing to support the enforcement of zero tolerance workplace drug and alcohol policies when it comes to considering a valid reason for termination of employment.
Education However the purpose of any policy that deals with alcohol and other
drugs in the workplace should be to focus on the importance of its staff and their wellbeing. Not termination of employees who fail. An initial and ongoing education program for all staff should be at the core of the policy. The primary emphasis is the need to ensure that all workplace employees work in a safe environment. To achieve this goal, staff education about: (a) the harmful effects of illicit drugs and alcohol, both in the short and long term; and (b) the over-use of prescription or over-the-counter medication will be necessary. Attention is to be focused on the risks to the safety of themselves and others that occurs when drug and alcohol affected employees present themselves for work and in fact commence work. The employer should also seriously consider education awareness sessions for all employees relating to the effects of Alcohol and Other Drug use (including prescription & other medicines) using the ASIAL On Line Learning Tutorials for Drug Awareness. The tutorial also covers the effect on performance, which may occur when a workplace employee is affected by alcohol or other drugs and the ability to utilise avenues such as random testing/screening to seek to identify problems early. Management and Supervisors should be trained to differentiate between what people Perceive as constituting a drug and alcohol problem and what the problem actually is in terms of individuals and industry.
