fter more than a decade, the Security 2014 Exhibition and Conference returns to Melbourne in early June. Judging by the strong response from exhibitors, the long awaited return has been well received.This yearโ€™s event will run from the 4-6th June at the Melbourne Exhibition & Convention Centre. It is now nearly 30 years since a small group of ASIAL industry representatives organised the first industry exhibition. It is pleasing to see that the event continues to go from strength to strength and provide an opportunity for the industry to showcase the impressive array of products and services it offers.Through the ongoing partnership between Diversified Communications Australia and ASIAL, the Association continues to play a key role in helping to showcase the industryโ€™s capabilities. This yearโ€™s expanded exhibition floor space and outstanding conference program provides an excellent opportunity to view the latest security technologies, hear from internationally renowned experts, as well as network and socialise with industry colleagues from across the country. Another important industry event I would like to bring your attention to is the 19th Annual Australian Security Industry Awards for Excellence to be held in Sydney on the 23rd October 2014. Our industry performs an increasingly important role in the Australian economy and it is important that this is recognised through awards programs such as this. Nominations are now open for the awards, so I urge you to consider lodging an application. Further details are available on page 28 and through the ASIAL web site. Later this year ASIALโ€™s board elections will be conducted by the Australian Electoral Commission. Members will be notified in due course by the AEC about

arrangements for the election.This process allows for every Duly Authorised Representative of a financial corporate member the opportunity to submit a postal vote. In my previous Presidentโ€™s Message, I wrote about the importance of good governance practices. Failure to do the right thing more often than not will result in negative consequences for your organisation. As an Association ASIAL actively enforces its Professional Code of Conduct, a position matched by our actions.The ASIAL Boardโ€™s recent decision to expel Hootspah Pty Limited from its membership and to impose a $120,000 financial sanction and specific compliance requirements on the Kings Security Group highlights this.The continuation of the Kings Security Groupโ€™s ASIAL membership was conditional on accepting and complying with payment of the sanction and meeting specific compliance requirements.The company advised that it was unable to maintain its membership as required by the ASIAL Board, and as a result their ASIAL membership was relinquished. Whilst it is important to learn from the mistakes of others, it is equally as important to understand that compliance is not a dirty word. For our industry to grow and flourish, it is vital that we develop a stronger culture of compliance. Finally, I look forward to seeing many of you at Security 2014 in Melbourne or later in the year at the 2014 Australian Security Industry Awards for Excellence.

NBN PLUG BENCH REQUIREMENTS The NBN Co is keen for industry to test the interoperability of security devices with a range of phone and internet services provided over the NBN. This includes testing legacy services devices such as security and medical alarm systems. For this reason NBN Co has engaged Enex TestLab, a third party provider to establish the NBN Plug Bench facility. Testing is typically done by alarm panel manufacturers, distributors, monitoring centres and installation companies so they can reach a view as to whether their alarm systems will work on a range of phone and internet services provided over the NBN.

NBN Co is not involved in the testing that occurs at the NBN Plug Bench, and does not warrant or certify the interoperability of the alarm systems or services of the testing participants. One key objective of the interoperability testing is for industry to share information with end users so thy can make well informed choices about which services over the NBN will support their alarm systems.

Federal Government signals major change to NBN rollout strategy The NBN has completed a strategic review that has recommended adoption of a MultiTechnology mix using existing broadband access networks. In April the NBN Co released the initial proposed product construct for the NBN โ€˜Fibre-tothe-Nodeโ€™ (FTTN) and โ€˜Fibre-to-theBuildingโ€™ (FTTB) product variants.

In releasing the document, the NBN Co sought industry feedback on important FTTN/B product concepts such as speed tiers, voice, installation, migration. The document proposes a high-level FTTN/B product construct, as well as asking a number of questions of industry in relation to what is being proposed. The proposed shift in delivering the NBN will have a significant impact on the electronic security and medical alarm sectors.

It is envisaged the change will reduce the time involved in the consideration of licensing matters. Among the key changes include that the NT licensing Commission Act will be repealed and replaced with the Licensing Act and the Licensing Authority will replace the NT Licensing Commission as the decision maker for applications and licences made under the Private Security Act. It is envisaged that the new framework will create a more efficient licensing scheme which will reduce the time involved in the consideration of licensing matters. The cost to business will also be reduced as protracted hearings will no longer be held.

The Guide - Towards best practice for safety in licensed venues - is a comprehensive guide outlining risk management practices and procedures. It includes information on legislative obligations and suggestions for adopting best safety practices. The publication is compiled in a consistent and easy-to-follow format with each chapter including a summary on what the law says, a brief topic overview, best practice suggestions, implementation ideas and a list of additional resources. While there is an emphasis on processes and procedures for

higher-risk venues, the strategies outlined in this guide can be used and adapted by the majority of licensed venues. Chapters include: risk management and safety audit, management plan, patron bans, accords and community relationships, venue lighting and facilities, designated outdoor smoking area, fire and emergency planning, privacy policy, engagement of a security firm, crowd controllers: employment conduct and standards, crowd controller numbers, supervision of crowd controllers, post-incident management, managing the entry of patrons, alternatives to regular glass containers, ID scanner systems and related procedures, CCTV systems and metal detection wands.

Changes to cabling competencies take effect from 1 July 2014

The Australian Communications & Media Authorityรข€™s regulatory requirements for cabling providers who install specialised cabling within customer premises have been amended. As a result, registered cablers who intend carrying out specialised cabling (such as Structured, Co-axial and Optical Fibre) after 1 July 2014 need to have the training competencies relevant to this specialised cabling work. The new competencies only apply to cabling providers who undertake the relevant specialised cabling work within customer premises. ALL SYSTEMS GO: AVOID DODGY DEVICES Are you responsible for buying and managing wireless communications systems in your workplace? Do you shop online or while overseas? Is your communications set-up relatively simple in design with a few handheld two-way radios in operation or more complex with multiple systems and devices working together? Either way, itโ€™s likely that your wireless communications systems are subject to the requirements of the Radiocommunications Act 1992. The consequences for operating a radiocommunications device that doesnโ€™t comply with Australian law can be serious and may risk your businessโ€™s reputation. Taking some simple steps before buying your next product will help to ensure it operates on the correct frequencies and doesnโ€™t cause interference. So make sure you remember to stop, research and question.

Stop! Research the product first > Can it be legally used in Australia? Seeking other information to that provided by the seller may alert you to potential issues with the product. The Australian Communications and Media Authority (the ACMA)โ€” www.acma.gov.auโ€”has detailed information on many devices, including high-risk items like mobile phone and GPS jammers, illegal mobile phone repeaters and mobile phone boosters. > Is the deal too good to be true? Is the price far cheaper than known reputable brands? This may be a sign that the product hasnโ€™t undergone the required testing to ensure it complies with Australian technical standards. Sellers

Devices made for overseas markets may use the incorrect frequency in Australia and interfere with important services. > Does the seller look reputable? Only buy from websites that you know and trust. Check recommendations and feedback from other customers.

Question > Are you confident about the information youโ€™ve been given? If youโ€™re unsure, ask the seller if it meets Australian requirements and if it can be legally used in Australia. Be wary if the seller does not adequately address your questions or concerns.

Know the consequences > You could block or disrupt important communications systems. If the device operates on the same frequencies as those used for emergency services, there is a risk it could substantially disrupt or block these vital communications systems. > You could receive an unwelcome visit. There are various offences under the Act that could apply to the unlawful operation or possession of a

radiocommunications device. The consequences can include a court-imposed penalty of up to $255,000 for a business making a radio emission from a non-standard transmitter. The same penalty may apply to a business found guilty by a court of operating a radiocommunications device without an appropriate licence (sections 46 and 157).Your businessโ€™s reputation could also suffer a serious blow if it receives a court-imposed penalty. > Your hip pocket could be lighter. A device that doesnโ€™t meet Australian technical requirements may not work here or you may be instructed by an ACMA inspector to stop using it. If you buy a dodgy device from overseas, itโ€™s possible that you wonโ€™t get your money back. Donโ€™t forget to stop, research and question before buying your next radiocommunications product. The laws administered by the ACMA seek to ensure that radiocommunications products supplied in Australia operate on the correct frequencies, meet safe electromagnetic energy (EME) emission limits set by ARPANSA and meet the electromagnetic capability (EMC) requirements so that other devices are not unintentionally interfered with. Know the consequences

Will you disrupt important communications systems? Operating an illegal device could block reception in an emergency and put lives at risk.

Will you be out of pocket? If you buy a dodgy device from overseas, itโ€™s possible that you wonโ€™t get your money back.

NSW - VIOLENCE / ASSAULTS ON CROWD CONTROLLERS IN AND AROUND NSW LICENSED PREMISES Violence and assaults in and around licensed premises is an issue that has attracted growing community and media attention over the past year. In response, the NSW Government has sought to crackdown on drug and alcohol-fuelled violence through new alcohol laws involving 1.30am lockouts, 3am last drinks across a new Sydney CBD Entertainment Precinct and the introduction of a NSW-wide ban on takeaway alcohol sales after 10pm. A range of other initiatives, including minimum mandatory sentence for โ€˜one punchโ€™ assaults have also been introduced. An issue related to this that has been raised with ASIAL as one of concern among crowd control providers, is the level of assaults on crowd controllers in and around licensed premises. The issue has also been the sub-

ject of discussion by the Security Licensing & Enforcement Directorate (SLED) Advisory Council. It has been suggested that some crowd control providers at licensed premises may be coming under pressure from clients not to report assaults for fear that it may impact on the venueโ€™s licence conditions imposed by the Office of Liquor & Gaming (OLGR), even if the assaults were not the fault of the venue or security provider. The concern raised is that by not providing Police and OLGR with a true picture of what is actually taking place in and around licensed premises, an environment is created whereby perpetrators of alcohol related violence could re-offend resulting in serious or life threatening injuries. In order to gauge the scope and extent of this issue, ASIAL is conducting a short survey of NSW

Now in their 19th year, the awards recognise outstanding individuals and organisations within the security industry. Award winners will be announced on the 23rd October 2014 at an awards dinner to be held in The Ivy Ballroom in Sydney. Entries are open to both Members and Non-Members of ASIAL.

Award categories Individual Achievementโ€“ General Security This award recognises excellence within the security โ€˜manpowerโ€™ sector of the industry, including service to the customer and outstanding acts. The award will be presented to individuals who have gone beyond what could reasonably have been expected of them in providing a level of service that exceeds the clientโ€™s expectations.

Individual Achievementโ€“ Technical Security This award recognises excellence within the technical security sector of the industry, including but not limited to technical expertise and an outstanding understanding excellence in emerging technologies. The individual will have demonstrated an outstanding level of innovation and service delivery.

Individual Achievementโ€“ Security Student of the Year The security student of the year award recognises an individual who has completed studies in a security discipline resulting in the award of a certified educational qualification of or above Certificate III up to Degree level (including an apprentice or trainee). The award applies to a security student who has completed their course within the past 12 months and demonstrated outstanding achievement in their studies such as career and study achievements, communication, team and leadership skills and the ability to represent the

security industry at a broader level.

Individual - Security Management The Security Management award is presented to an individual who has demonstrated excellence in a senior operational or administration security management role, and who has demonstrated an ability to inspire and lead by example or introduced a significant change in practice.

Organisational - In-House Security Team This award is presented to the in-house security team that has demonstrated collective excellence in delivering the security strategy for their organisation.

Organisational - Training This award recognises innovation and excellence in the development and/or delivery of a training initiative or program that promotes sound working practices in the security sector.

Organisational - Integrated Security Solution (projects above $250,000) This award is presented to an organisation that has demonstrated innovation and excellence in the integration of electronic security systems valued at more than $250,000. The award applies to security installations completed within the past 12 months.

Organisational - Technical Security Solution (projects below $250,000) This award is presented to an organisation that has demonstrated innovation and excellence in the installation/application of electronic security systems for a project valued at less than $250,000. The award applies to security installations completed within the past 12months.

Organisational - Special Security Event or Project This award is presented to an individual or group who has/have demonstrated excellence in the provision of security services to an event or completed a security project of significance with regard to its outcome, benefits, initiative, complexity or challenges. The award applies to a security event or project completed within the past 12 months.

Judging criteria and process An independent panel chaired by an ASIAL representative will judge each nomination based on the criteria set out above for each award category. An ASIAL representative chairs the panel, but will not have a vote in choosing award category winners. The 2014 judging panel will include: โ€ข Damian McMeekin, Head of Group Security, ANZ. โ€ข Alan Ross, CEO, Construction and Property Services Industry Skills Council. โ€ข Vlado Damjanovski, CCTV Specialist, ViDi Labs Pty Ltd. โ€ข Michael Gale, Manager - Security, Sydney Water. Judges reserve the right to not give an award in one or more categories if, in their opinion, the quality of entries are not of an appropriate standard. Judges also reserve the right to transfer an entry into another category if it is considered more appropriate. The decision of the judges is final and no correspondence will be entered into. A fee of $105.00 (incl GST) is payable per nomination per category. ASIALโ€™s new look web site has been recognised by Enterprise Web Content Management Software Leader, Kentico CMS, as among its top 10 sites worldwide. Kentico selects 10 websites from around the world out of hundreds every month using its content management system that represent the highest quality and set the standard of excellence. The developer of the new ASIAL site, BlueArc applied best practice user experience design to create an industry leading website for ASIAL. The new site clearly displays ASIAL member benefits, key services and industry information to meet the needs of the target audience in an engaging way. The new look site went live in December 2013. The aim was to provide a more modern and

responsive site recognising the growth in mobile traffic to the site. Through the use of a responsive web design, with an optimized mobile layout, site visitors can now access information they need with a sense of security. Regardless of their device or screen size, the ASIAL website is agile enough to adapt to every web browser. Highlights of the new site include a robust โ€œResource Centreโ€ section with information for ASIAL members, a โ€œConnect with usโ€ area with direct feeds from Twitter, Blog and Forum enabling industry professionals to engage with other like minded peers. The most significant changes, based on direct requests from site users, is easier navigation including the addition of log in buttons on every page of the site and visible renew and join buttons. The website redesign features a secure login for both members and registered cablers. For new members interested in accessing industry news, guidelines / templates, forums & webinars, or to shop online, they can apply to receive full website access using an easy to use web form. With the new design, ASIAL wanted to meet the needs of its key audiences, including members, registered cablers and consumers looking for home security tips, without overlapping.

Two factors that did not change with the redesign are the functionality of the siteโ€™s search tool โ€œFind an ASIAL memberโ€ and the online application, though both have aesthetic changes. The site has more than just information on how to become a member, it also features helpful links to legislation and regulations, information on security industry licensing, standards/codes, blogs, forums, webinars, industry articles, news and events. BlueArc implemented Kentico CMS platform and applied best digital practice in user experience design to create and produce a secure, industry leading website for ASIAL. The new site clearly displays ASIAL member benefits, key services and industry information to meet the needs of the target audience in an engaging way. Social media engagement with each member and target audience was key and required social media channels to be integrated to the website to increase brand awareness and thought leadership. Hiring is an important decision for your business. The right approach can benefit your workplace and save you time and money. Hiring a new employee isnโ€™t a single event; itโ€™s a process. Understanding each step in the process will help your business find the right person for the job. The Fair Work Ombudsman has created some simple and practical steps you can take to improve your hiring practices.

Think about hiring Firstly, it is important to assess your businessโ€™ current and future needs and define the role that needs to be filled. Consider if hiring is the only option, or whether there is already someone on staff who can be trained for the role. If you decide to go to market,

think about what you need from the role and develop a job description to match. Consider the employment status (casual, part-time or full-time) and the skills and qualifications required.

Attract the right people Once you have a clear idea of the role you want to fill, the next step is to advertise the job and attract the right candidates. Youโ€™ll want to make sure suitable applicants hear about the opportunity, find it appealing and can match it with their skills, qualifications and expectations. The best way to advertise will depend on the job itself. Consider advertising on online job sites, social media, in newspapers or industry publications, or on a poster in the shop window.

Choose the right person The next step is to create a shortlist of candidates you want to invite to interview from the applications received. A shortlist is particularly useful if you get a lot of interest in the position. Interviews can be formal or informal. The Fair Work Ombudsmanโ€™s Online Leaning Centre โ€“ www.fairwork.gov. au/learning โ€“ has a course titled Hiring new employees, where employers can test their interviewing skills through an interactive video scenario.

Offer of employment Once youโ€™ve selected the best candidate, the next step is to offer them the job. This can be done over the phone, but itโ€™s a good idea to follow up in writing with a letter of offer. There are template letters available at www.fairwork.gov.au/templates. This is also a good opportunity to provide a copy of the Fair Work Information Statement, which must be given to every new employee when they start work.You can download a copy at www.fairwork.gov.au/fwis. Itโ€™s also a good idea to include copies of any relevant company policies and any forms that need to be completed, such as a tax file declaration or superannuation choice form.

Start on the right foot Investing time in a thorough induction will ensure you get the most from your new employee. A well thought-out induction helps employees feel wellinformed and equipped to do their job. The induction might include things like: a tour of the workplace, an overview of the business, an explanation about the employeeโ€™s role and responsibilities, a discussion about relevant policies and procedures and a run-down of health and safety protocols.

Be a productive workplace During the first few weeks of employment, meet with the new employee to set goals and expectations and identify any training

that might be required. Regular meetings are a good way to give new staff members feedback about their performance and monitor their suitability for the role. The Fair Work Ombudsmanโ€™s Online Leaning Centre has a course for managers and business owners titled Difficult conversations in the workplace, which has practical tips for handling difficult conversations and reaching successful outcomes. Know the law There are workplace laws that apply to all casual, part-time and fulltime employees, as well as some contractors. The laws cover things like wages, record-keeping, pay slips and discrimination. Before hiring, itโ€™s important you understand your workplace obligations. Be familiar with the National Employment Standards (NES). There are 10 in total and they apply to all employees. They cover things like maximum weekly hours, parental leave and public holidays. For more information about the NES employers can visit www.fairwork.gov.au/nes. Itโ€™s also important to know which modern award/s or registered

agreements apply to your workplace. A modern award is a document that sets out the minimum wages and conditions for an industry or occupation. They apply on top of the NES and cover things like pay, hours of work, rosters, breaks, allowances, penalty rates and overtime. The Fair Work Ombudsman has launched A guide to hiring new employees for businesses that outlines these steps and provides straight-forward advice about hiring new staff. Chris Twal for intervening at personal risk to stop a man who had punched a 62-year-old man in a shopping centre. Mahmoud (Chris) Nemra for

protecting a group of eight-to 10-yearold boys from a gang of 30 youths who were threatening them, by putting himself between the boys and the gang. Ross Chapman for breaking up a fight in which he was hit, headbutted and threatened with being shot. Jovan Jovanov for intervening in the attack of an elderly man by another man and dog. โ€œThe ASMV is awarded to recognise security operatives for an outstanding act or acts of valour; an action or

actions demonstrating valour, courage and decisiveness above and beyond the call of duty,โ€ said ASMF patron, MP Philip Ruddock. Two Australian Security Medals (ASMs) were also awarded to Julian Talbot and Bill Forbes. โ€œThe ASM is awarded to recognise the outstanding career and character of the security professional receiving it,โ€ said Ruddock.โ€œRecipients have demonstrated a consistent, high-level contribution to the wider community, sometimes through innovative noncore business activities and projects, or through extraordinary performance in their professional role. This award is about more than how a person runs their business or operates in an organisation, but emphasises what they do above and beyond their dayto-day responsibilities.โ€ Senior corporate security managers form the judging panel for the Medals. โ€œThis means that the nominations are carefully considered by major buyers of security and peers to fellow security managers,โ€ said Jackson. โ€œThe Panel not only discusses โ€“ at length โ€“ the merits of each case but follow up where necessary with further investigation and checking references. The final stage of that process is to submit the finalists to the Patron, not so much for approval but a final proofing, if you like.โ€ Not every nomination is successful, but is nonetheless worthy of mention,

St John Ambulance Chancellor, Mark Compton presented the inaugural Save a Life Awards along with a First Aid Kit to Damien Stewart and Adriano Villella. Funds raised from the night will go to beyondblue, which in partnership with the ASMF launched the beyondblue National Workplace Program in the security industry. Kate Carnell, beyondblue CEO, said common mental health problems, such as depression and anxiety, can lead to increased absenteeism, high staff turnover and lost productivity. โ€œMale-dominated industries such as the security industry are particularly at risk because men are less likely than women to take action if theyโ€™re having a rough time,โ€ said Carnell. โ€œSecurity staff are often the first responders in emergency situations which may be distressing and if the

distress is not addressed, it may put people at risk of developing mental health problems. โ€œThe nature of the work often means security staff have little control over the demands of their work environment which is a high risk factor for job stress.โ€ Subsidised NWP workshops are available to male-dominated workplaces through funding provided by the Federal Department of Health and Ageingโ€™s โ€˜Taking Action to Tackle Suicideโ€™ strategy. Managing CoMplianCe and Market risk The meteoric rise of social media has brought with it new commercial and marketing opportunities. But for all its advantages, social media is fraught with risk and market compliance obligations that make it a minefield for companies whether they use social media or not. In the past two years alone, there have been several high-profile incidents involving false and misleading information being broadcast through social media platforms. As a result, new continuous disclosure requirements have been introduced by the Australian Securities Exchange (ASX) that have put social media front and centre for the Board and Senior Management of every listed company across Australia. In practice this means that companies will be expected to have systems in place to deal with market disclosures, not within days or hours, but within minutes. Prudent management will require companies to monitor social media on an ongoing basis to meet this expectation, together with having clear strategies to anticipate and respond to emerging or unforeseeable risk.

We are now in the fourth year of the modern award system. Many pre-modern awards from states and territories have been transitioning since 1 July 2010 and that process will be completed on 1 July 2014 when only the Modern Award for a particular industry will have application. Over the past few months ASIAL has been surveying members to gain insight into the need for changes to our modern awards ready for the 4 yearly review. An outline of the review process, which will be in two parts, common issues and individual awards, appears below. Where it is necessary and meets the Fair Work Commission (FWC) guidelines ASIAL will make submissions to vary the awards in which we have a major interest โ€“ the Security Services Industry Award 2010 and the Electrical, Electronic and Communications Industry Award 2010. The FWC has made it clear that any submissions for variations to an award will need to be supported by compelling evidence. Findings from ASIALโ€™s Small / Medium Business Survey Of those who completed the survey: โ€ข 87.4% were Incorporated Companies โ€ข 7.55% were Sole Traders and โ€ข 4.72% were Partnerships โ€ข 58.49% were Small (1 to 19 employees) โ€ข 41.51% were Medium (20 to 199 employees) โ€ข 75% were in the Security 42 //SECURITY INSIDER JUNE 2014

Services and CIT โ€ข 25% were in Electronic Security Award conditions that had the greatest adverse effect were: โ€ข Penalty Rates 75.24% โ€ข Public Holiday Penalties 71.43% โ€ข Shift Work Provisions 56.31% โ€ข Overtime Rates 60.95% โ€ข Unfair Dismissal Provisions 61.54%

The 4 yearly Review Process The first 4 yearly review of modern awards (the Review) consists of three stages. In the Initial stage a Full Bench of the Fair Work Commission (the Commission) issued a decision on 17 March 2014, which determined the scope of the Review and addressed a number of legislative issues. A Statement issued on the same day confirmed the first tranche of common issues to be dealt with and included a preliminary timeline for dealing with these issues. The Security Services Industry Award will be dealt with in the first award stage. Following on from the initial stage, there are two concurrent stages โ€“ the common issues stage and the award stage. The common issues stage has commenced and is dealing with issues such as: โ€ข Annual leave โ€ข Award flexibility/facilitative provisions โ€ข Casual employment โ€ข Part-time employment โ€ข Public holidays โ€ข Transitional/sunsetting provisions relating to accident pay, redundancy and district allowances

NB Penalty Rates have been identified as one of the most important impediments to doing business in the Security industry. In todayโ€™s society where service industries like security, operate 24/7, penalty rates increase labour costs, reduce employment, and impede business attempts to service customers late at night, on weekends, and public holidays. This along with the rights of employees to refuse work on public holidays, and the refusal of clients to pay the higher rates makes it extremely difficult for security providers to operate. However, penalty rates in Australian awards are not a recent addition. They go back 95 years when the Commonwealth Conciliation and Arbitration Commission held that penalty rates for work on Sundays were intended to compensation employees for working unsociable times and in 1947 Saturday became 125% of the base rate, and the rate for Sunday work double time, or 200% of the base rate. Recently a full bench of the Fair Work Commission handed down its decision on penalty rates as part of the 2012 Modern Award Transitional Review, declining to vary the penalty rates in the hospitality and retail industry awards. It was successfully argued that penalty rates in services industries are integral in supplementing the incomes of low paid workers. This coupled with the social implications for the removal of penalty rates altogether from awards is a significant hurdle for

The Award Stage The award stage will formally commence on 13 May 2014 with an initial conference. The review of each modern award

will not be finalised until the common issues and the award stages are completed. Therefore we will not have a finalised award before late 2015. The process is anticipated to run until mid-2015. An initial conference was held on 13 May 2014 to determine the timetable for dealing with the awards in Group 1, identify any issues affecting awards within this group including coverage. ASIALโ€™s submissions will be in relation to the following matters: โ€ข Consultation Clause (Change of Roster). ASIAL will seek a variation to this clause to bring it in line with other clauses in the award relating to rostering and posting of rosters. โ€ข 12 Hour Shifts - Removing the requirement for employers to have individual or collective

agreements with employees with what are standard practices in the industry. Broken Shift Allowance - A clarification of application. Stand By Allowance - A new allowance for Patrol Offices on

Standby โ€ข First Response - ASIAL proposes a definition for first response. Subsequent to decisions under common issues ASIAL may make submissions on Part Time work and/or Penalty Rates. For each group of awards the steps will include: โ€ข a conference at the commencement of each award group to determine the timetable for dealing with the awards in that group, identify any issues affecting awards within this group including coverage and to confirm the awards in each cluster in this group. Parties will provide a short outline of any identified issues prior to the conference. โ€ข the Commission will publish a

proposed running order outlining the sequence in which they will call on each award or cluster of awards during the initial conference. โ€ข directions, including a timetable with deadlines for submissions. โ€ข further conferences to work through particular issues before a single member of the Commission who will report back to the Full Bench. โ€ข one or more hearings at which parties will be required to present evidence to support any proposed changes. โ€ข the Full Bench issuing Exposure Drafts of modern awards including changes arising from the submissions and hearings, along with any technical and drafting changes proposed by the Commission. โ€ข parties will be given an opportunity to make submissions on the Exposure Drafts. โ€ข if necessary, further hearings may be required. โ€ข the Full Bench may issue one or more determinations varying modern awards to reflect the outcome of the proceedings. Determinations will generally come into force from the date they are issued. โ€ข if a modern award is also affected by the outcome of a โ€˜common issueโ€™ matter, additional determinations may also be issued which will operate from the date they are signed. The Review could involve an award being amended several times, both during the award stage or as a result of one or more of the common issues matters. After all awards and common issues have been dealt with, the Commission will hold a hearing to formally conclude the Review in order to be satisfied that the final content of the each award reflects the outcome of any decisions arising from the Review and meets the Commissionโ€™s obligations under s.156 of the Act.
