WORK SAFE IN OCTOBER AND ALL YEAR ROUND October is National Safe Work Month; a time to focus on safety in your workplace to reduce death, injury and disease. This campaign is an opportunity to raise awareness of the importance of safe work environments among staff, while setting the pace for your workplace health and safety performance all year round. The theme of this year’s

National Safe Work Month is ‘Be safe. Be healthy. Because…’ The idea behind this year’s campaign is to make the theme meaningful to individuals and organisations by adding their own reasons for being safe and healthy at work. To find out how you can get involved in this awareness raising initiative and use it to springboard into positive WHS performance throughout the year, go to page 24.

CONSUMER CAMPAIGN CONTINUES TRAVELS AROUND AUSTRALIA Raising awareness of members among consumers, ASIAL’s consumer awareness campaign launched in July with train advertising in Melbourne, supported by radio advertising in regional Victoria. Since, billboards have promoted the Home Security Challenge on billboards in Perth and Adelaide. September saw train advertising in Brisbane and regional radio advertising in regional Queensland, and a similar campaign will be run in Sydney and regional NSW in October. The offline campaign will wrap up in November with bus advertising in Hobart, Launceston, Canberra and Darwin. The offline campaign will continue all year round on Facebook.

Hundreds of people have participated in the Home Security Challenge (www. homesecuritychallenge.com.au), many of them travelling through to

SPOTLIGHT ON LOCAL GOVERNMENT SECURITY TENDERS Metropolitan and regional councils across Australia will be randomly audited as part of a Fair Work Ombudsman campaign to ensure local government procurement decisions are not undermining compliance with federal workplace laws. Joint media release by FWO, ASIAL and United Voice. “It is important that local councils understand that when they sign low-cost contracts to buy in security services, they are not contributing to the underpayment of employees working for their sub-contractors,” says Fair Work Ombudsman Natalie James. The Fair Work Ombudsman has been working with ASIAL and the United Voice union since May last year to educate local councils about their workplace obligations. “Contracting out labour is a legitimate approach to doing business, but councils need to consider whether their procurement processes and subsequent governance of those arrangements create an environment where workers are open to exploitation,” Ms James says.

ASIAL chief executive Bryan de Caires says the campaign will benefit security service providers who are complying with workplace laws by helping to create a level playing field. “If the price is too good to be true, it probably means somebody is not compliant with workplace laws,” he said. “Operators who are gaining

“It is a very positive reflection of the Australian security sector’s commitment to good practice that it is amongst the first group of countries to launch the awards.” 22 October 2015 marks the introduction of the OSPAs into Australia - that is the Outstanding Security Performance Awards, recognising those who excel at what they do. And, there are similar initiatives being conducted in other countries; Norway in September and Germany in November, with two more countries ready to be announced and more on the way. The OSPAs is a global scheme to recognise the best performers around the world. It is a very positive reflection of the Australian security sector’s commitment to good practice that it is amongst the first group of countries to launch the awards (au.theospas.com).

But why is it important to recognise excellence? From the research we have conducted with buyers, one of the interesting things to emerge is that often they are not aware of the difference between what you get from an excellent supplier as opposed to

one that is merely good or average. Security suppliers must take some responsibility for that in not articulating their message in terms that attract positive attention. And perhaps it has never been more important, with margins being squeezed, procurement becoming powerful, with purchases sometimes being guided more by price at the expense of quality. In a worldwide survey on security excellence (which included Australia) conducted under the umbrella of the Security Research Initiative (SRI), we sought to better understand the expectations of both clients on the one hand and suppliers on the other as to what constitutes excellence in security. The results were striking; there was a remarkable level of agreement. The problem came when we asked whether clients and suppliers practiced what they preached. Here there was a clear view that most of the time each side was much less effective at being excellent.

So while there was no disagreement about the criteria for being excellent (an important finding in itself) there was scepticism that the majority in security failed to achieve it. That is why identifying excellent performers is so important; it highlights what success looks like. Yet security is very important. In my view significantly more important than many acknowledge. The current SRI project that has just been published talks more about this and invites the security world to talk up its achievements and role, rather than often settling for the rather negative image that besets it in some quarters. Security is essential, not just to protection but in so many other ways too.

are increasingly similar / quickly copied. Every business wants to have the best employees, but simply wanting it won’t make it happen. Today, more and more businesses are now realising the importance of training and investing in their staff. Make sure your business meets its WHS compliance obligations If you don’t have a WHS Management System in place (and you should), or it’s time to review your WHS performance and processes, National Safe Work Month is as good a time as any to consider your options. SECURITY MONITORING AND THE

NATIONAL BROADBAND NETWORK (NBN) g

The technology behind the NBN has changed, which will affect how you’ll migrate existing customers on the copper network and what alarm transmission products you will choose for new customers. Here we look at what you need to consider next. Over the top legacy services are generally provided by application service providers (ASP) using a voice service over the copper network. Over the top legacy services include security, medical and fire alarms, lift phones and payment services (EFTPOS and ATMs). The migration off the copper network and move to the NBN represents the next evolution for the security industry, involving technical changes, upgrading of equipment and or wiring at the customers premises. The migration to the NBN will see voice services predominantly delivered over IP technology. Consideration should be given to transmission path that is best suited for your customers’ requirements. This could be 3G, dual path or Nation Broadband Network services only. You should also inform customers about the likely impact of migrating their services (cost involved such as equipment, data plans, labour etc.) and what steps the customer may need to take in relation to ordering a service from their preferred Retail Service Provider (RSP) before the copper disconnection date which will be communicated by NBN™ co ltd. 28 //SECURITY INSIDER OCTOBER 2015

Significant Change The NBN rollout has moved to a Multi Technology Mix utilising Fibre to the Premises (FTTP) –Fibre to the Node (FTTN) – Hybrid Fibre Co-Axial (HFC). HFC is widespread across a number of areas of metropolitan Australia – typically if you have Foxtel via cable you live in the HFC footprint. HFC is scheduled for release in 2016. Below are the key differences when migrating to FTTN or HFC, VOIP networks will equate to 70 per cent of all installations. All wiring within the premises is the occupant’s responsibility and any remedial cabling work needs to be performed by a registered cabler. 94 per cent of the market will be made up of FTTP, FTTN and HFC:

service offered it is advisable to be independent of the NBN for alarm transmissions and battery backup. There are many adaptable alarm communicators that allows the security system to transmit alarm events via 3G networks such as Telstra Next G/Optus 3G thus removing the need for a phone line or NBN connection. NBN™ can help you with information about the copper disconnection timeline, to address this issue NBN™ has a Disconnection Address Database (DAD) which will indicate a list of addresses due for copper disconnection in the next 18 months. All monitoring centres should contact NBN™ (if they have not already done so) to access this information.

INVESTING AS YOU APPROACH RETIREMENT Investment strategies change as we move through different stages of life and decisions you make now can impact how much super you have for your retirement. AustralianSuper financial adviser Denis O’Keefe* looks at some of the investment factors to take into account when nearing retirement to help put yourself in the best position possible.

Q. I’m looking at investing for retirement – where do I start? A good place to start is to decide how much income you need. Doing a budget will help with this; that way, you can structure your investments to provide the income that you need to fund your retirement. Take into account any debts you have then, if there’s money left over, that can fund expenses, such as holidays or a new car.

When is a good time to get serious about retirement planning? Yesterday! But in all seriousness, you can never start planning for your retirement too early. Typically, retirement could become your primary financial focus once you’ve got your mortgage or other debts under control, which frees up money to invest for your retirement.

What factors do you take into account when developing an investment strategy? We do an analysis on the type of investor our members are and the majority of the people we see are cautious or moderate investors. Timeframe is also an important consideration, because of the different mix of investment options and asset allocations available. We suggest members looking to invest in higher-risk investment strategies should roughly have a seven-year timeframe to allow for any downturns in the market. Any shorter than that, and they should reduce the risk in their portfolio and invest in more stable markets, such as cash and fixed interest.

In the current climate, do you have a particular type of investment you recommend? When investing for a retiree, we aim to consider a mixture of conservative and higher-growth investments. This allows income to be drawn from the more stable investment option and, at the same time, to have money in a more balanced, high-growth type of option that is going to grow along the way to keep up with inflation.

Is there a risk associated with investing too conservatively? The problem with going too conservatively is your money may not keep up with inflation, so you could run out of money a lot quicker. That’s why it could make sense to have some money in a conservative investment option and also in a more balanced type of investment, where you’ve got exposure to growth assets as well.

How do you help people balance their long-term and short-term retirement needs? There certainly are different stages of retirement that you need to look at. Pre-retirees are generally looking to accumulate as much wealth as possible, so the things you’re probably looking at for them are salary sacrifice and using the tax system to maximise their savings. Then you typically have the newly retired, and that’s about setting up an income stream for their retirement and making sure that any other capital expenses they’ve planned – such as overseas holidays or car upgrades – are accounted for in that planning as well. Then you move to the more senior generation, who might be considering estate planning, so looking at some options for passing on their wealth to the next generation in the most tax-effective manner.

CASE STUDY 1 A member was constantly experiencing problems with disciplinary and dismissal arguments. After some discussion we identified a lack of knowledge and confidence among front line supervisors in being able to deal with counselling and disciplining employees. They were unaware of their rights and responsibilities and did not have the skills to deal with these issues. As a result the mistakes made early in the disciplinary process became major problems later on. It was costing the member a lot in defending unfair dismissal allegations, not to mention taking a hit on their credibility with

the client, other employees and the Fair Work Commission. ASIAL put together and delivered a training package which helped to overcome these shortfalls and gave the supervisors the confidence and tools to be more effective and avoid costly unfair dismissals. The result was a more confident and professional supervisory group, better senior management support and an overall improvement in the performance and conduct of employees because they were being managed effectively.

CASE STUDY 2 The member dismissed an employee during the probationary period for poor performance. Two weeks after the dismissal the employee claimed workers compensation for stress related to the dismissal. ASIAL gave advise to the member on how to deal the workers compensation insurer and the claim was rejected. Not to be deterred the employee then sought the assistance of lawyers and commenced proceedings in the Human Rights and Equal Opportunity Commission (HEREOC) claiming discrimination on the basis of a disability. With ASIAL’s representation HEREOC determined, after conciliation, that the matter should not continue. Still undeterred the solicitors for the former employee wrote a letter threatening the employer with commencing proceedings in the Federal Circuit Court unless the employer paid to the employee a sum in the tens of thousands of dollars. This was a clear attempt at recouping the financial losses of the legal representatives out of pocket from continuing with a hopeless case. ASIAL drafted a reply for the member rejecting the demands

and reminding the other side of the costs claim that might ensure from failed litigation. These matters can go on for some time and if not depending on ASIAL members may be exposed to extensive legal costs defending frivolous and/or vexatious actions.

CASE STUDY 3 A member called for advice concerning an employee who had resigned with notice after an unsuccessful bid to gain a pay rise. ASIAL advised that the employer ask the employee for the resignation to be provided in writing. The employee never “got around” to providing the written resignation and at the end of the notice period refused to leave. Eventually the employee claimed that he had been unfairly dismissed stating that he had “withdrawn the resignation” in a meeting with his supervisor. ASIAL represented the member at conciliation and later in arbitration arguing on behalf of the member that the Fair Work Commission had no jurisdiction to hear the matter as there was no dismissal. FWC dismissed the employee’s application. This was successful because the employer and ASIAL worked closely together from the outset to ensure that all facts were properly discovered and the employer could always prove that their actions were fair and reasonable.

CASE STUDY 4 A member came to us with a unique problem. He had a seasonal contract outside of his home state that would last for about four months – the cessation date was open. He had to supply accommodation for a dozen or more employees, 24/7 coverage, specialised uniforms and equipment, supervision and training

– all in a remote area. ASIAL created an Enterprise Bargaining Agreement (EBA) that focused on ensuring all contingencies were covered, a reasonable rate of pay and conditions would ensure that he could not only attract and retain the best possible employees but importantly win the tender, which he did. Included in the EBA were provisions to deal with disciplinary matters, dismissal, specialised training and uniquely matters which may arise outside of work hours which impact adversely on the business and or the client.

QUESTIONS GOOGLE CAN’T ANSWER. What is the definition of a shift worker? Do casuals get the 25% loading when working overtime? Does an employee accrue annual leave when on Worker’s Compensation? Just some of the many member queries ASIAL responds to every day. Do Leave entitlement accrue during Workers Compensation? Accrual of personal leave, long service leave, and annual leave entitlements, whilst receiving workers compensation payments is covered by the National Employment Standards (‘NES’) in the Fair Work Act 2009 (Cth) (‘the Act’). Section 130 of the Act make reference back to a relevant State’s compensation law, and if that law permits the accrual, or taking, of leave. Each States’ compensation law treats the issue of taking and/or accruing of leave slightly differently. In most cases the States’ legislation is silent on how the matter is to be treated. For example: • New South Wales and Queensland – all entitlements, such as leave continue to accrue g Continued Page 36

as long as the contract of employment exists, irrespective of whether workers compensation is being paid. • Victoria – legislation is silent on the issue of leave accrual and the inference is that entitlements cannot be taken nor do they accrue. • Tasmania – workplace standards advise that it is an industrial relations matter and unless an award or agreement stipulates that annual leave or long service ceases to accrue after a certain period of absence it will continue to accrue. • South Australia – annual leave continues to accrue for the first 12 months of incapacity and for incapacity extending beyond 12 months, that leave is deemed to have been taken and no more accrues. • Western Australia – workers compensation legislation does not provide for annual or other forms of leave. Annual leave and long service leave only accrues for the first 15 days of incapacity, but being on compensation leave does not break a period that counts towards long service leave. In all States’ legislation regarding long service leave provide for accrual during a period of absence for injury or sickness.

WHAT IS A SHIFTWORKER? Following a recent decision by

the Fair Work Commission (FWC), employers may want to reconsider how they structure their workplace rosters to avoid their obligation to grant an additional week of paid leave to certain employees. The National Employment Standards (NES) provides, as do most Modern Awards, that a “shiftworker” is entitled to an additional week of paid annual leave each year. Under the Fair Work Act 2009 (Cth) (the Act), an employee is entitled to five weeks of paid annual leave each year if: • a modern award or enterprise agreement, which describes the employee as a “shiftworker” for the purposes of the NES, applies; or • the employee is not covered by an award or enterprise agreement, and: • is employed in an organisation in which shifts are continuously rostered 24 hours a day for seven days a week; • is regularly rostered to work those shifts; and • regularly works on Sundays and public holidays. In the recent decision, the FWC considered and sought to clarify what an employee, that is not covered by an award or enterprise agreement, must do in order to “regularly” work on Sundays and public holidays and therefore trigger an entitlement to a fifth week of paid annual leave. It was determined by the FWC that an employee must work a minimum of 34 Sundays and 6 public holidays in a given year to have the entitlement to an extra

paid week of annual leave. While this particular decision is confined in scope, it is likely that the principle in this decision will extend more broadly than just to employees not covered by an award or enterprise agreement. This is very similar to advice ASIAL received from FWO in September 2013, which said: “As a general guideline only, the FWO considers that an employee is likely to be entitled to the additional week of annual leave when they have worked a combined total of 34 Sundays and public holidays in a 12 month period. Note that a meaningful number of both Sundays and public holidays would need to be worked”. Do casual security guards get the 25% loading when working overtime? Clause 10.5 (b) specifies that the casual loading applies when working ordinary hours including shift work, weekend work and public holiday work. ASIAL’s advises that this means that the loading is not payable at times that are not specified. Overtime as provided for under clause 23 is not one of times when the casual loading in clause 10.5 is specified as payable. We have discussed this with the FWO, who share our view that the casual loading is not payable for overtime hours under the Security services Industry Award 2010 MA000016. CHRIS: Welcome back Cletus, good to see you CLETUS: Thanks Chris, it’s great to be back again. Where are we heading this month? CHRIS: Why don’t we start with supply chains and see where that takes us? CLETUS: Sure. We are doing more and more work in this area. CHRIS: and security firms often get caught when the squeeze happens as the supply chain goes further and further. So what are you doing about it? CLETUS: it’s not just security firms who end up in trouble, but yes there is a fair percentage of them involved. In response we have developed a supply chain strategy which we will implement over the coming months. CHRIS: (laughs) Here we go again – if it’s not a shiny new policy, it’s a shiny new strategy. Come on, what are you actually doing to help security providers? CLETUS: do you treat all your guests like this! OK, in practical terms, our focus on supply chains will be on the price setters rather than the price takers. We know from experience that some firms will accept contracts for amounts that don’t enable them to meet all their obligations towards employees just to get market share or in some instances to make money while avoiding their obligations to their employees. The Fair Work Act sets out that businesses must not enter contracts where they know the amount they are paying means employers cannot meet all their obligations towards their employees. We believe businesses that purchase services and head contractors have a moral and ethical obligation to ensure that anyone doing work for them is getting their full entitlements.

In the latest instalment of his Q&A sessions with Cletus Brown (Director of Knowledge Solutions, Fair Work Ombudsman), Chris Delaney (ASIAL’s Industrial Relations Advisor) finds out more about FWO’s activities to tackle sham contracting.

CHRIS: that’s also a legal responsibility isn’t it, under s550 of the Fair Work Act 2009? So ASIAL members paying correct wages won’t get undercut by unscrupulous operators. CLETUS: that’s our goal – not just for security operators but all businesses in all industries. It is simply not fair if a business is trying to do the right thing and they can’t compete for contracts because their rivals are not paying the right wages. CHRIS: (interrupts) or using sham subcontracting arrangements CLETUS: Absolutely. We’ve also had feedback from some industries that they have concerns about the quality of work and worker they end up with when sub-contractors pay the wrong wages. You and I have talked about this before but it’s worth repeating, if you only pay a guard $17.00 an hour, you are likely to get what you pay for - that is a pretty poor guard. CHRIS: did you just agree with me on something? CLETUS: (laughing) it must have been by accident - or I thought of it first. Anyway, they hide us far back in the magazine no-one will ever know! CHRIS: they only do that because of your photo. How is your fancy new strategy being implemented? CLETUS: there will be a number of different initiatives and ways we work but the most prominent in the security industry in the coming months will be the Local Government Procurement Initiative. CHRIS: Another fancy name! – what’s it all about? CLETUS: we are looking into how local governments source their security services and making sure that any contracts they enter enable contractors

to meet all their obligations and that anyone doing security work for a council is receiving their full entitlement. When we hear stories about contracts being let for $25 an hour we know we need to take a closer look at what is going on. We know legal minimum award wages cannot be paid at those prices. CHRIS: so are you ‘looking into it’ or are you actually doing something? CLETUS: we have spent the last 12 months or so undertaking an education campaign and now we are starting the compliance part of the initiative. We will be contacting in excess of (insert number) local governments in all states and asking for detailed information about their procurement processes and their contracts. We will then follow up with the sub-contractors and their employees to make sure everything adds up. If we find anyone doing the wrong thing we will take appropriate action to correct the situation, including taking legal action if necessary. CHRIS: this is just the tip of the iceberg but it is important work and I hope you prosecute the top of the supply chain as well as the offending employer. CLETUS: it certainly is the tip of a very large iceberg and we have been really grateful for the assistance that ASIAL and United Voice have given us. The industry expertise that ASIAL in particular have provided to us has meant we have reached this point a lot quicker than we would have. And this will mean we can continue to eradicate unscrupulous operators and create a level playing field for security businesses. CHRIS: we wish you all the best for that. Catch you next month.
