FAN MOTORS The fan motor that works in conjunction with the air handler is the motor that actually blows the air throughout the home or building. These fan motors work hard in our Arizona heat, and if your unit starts making strange noises or fails to run at all, the main air conditioning fan motor may need to be replaced. Rainforest can repair, install and service your broken or problematic fan motor system to operate at maximum efficiency. Give us a call today!

Clearing the Air AMA’s Arizona Smoke-Free Living program helps rental community owners and residents breathe a little easier By Peter Madrid
When the AMA’s Arizona Smoke-Free Living program was announced in early 2015, several community managers said the news was greeted with an unexpected but positive reaction.

“When we first started down this journey, communities thought they would lose residents,” said Sharon Hosfeld, the AMA’s Smoke-Free coordinator. “It was just the opposite. Some communities that are smokefree have a wait list. More residents would rather live in a smoke-free environment. It’s the hot new amenity.” In 2015 the AMA partnered with Maricopa County to launch its statewide smoke-free program for the apartment industry. Using tobacco-cessation funding, the AMA is contracted to provide education and assistance to apartment owners, developers and managers regarding the dangers and health risks of smoking and the cost savings of going smoke-free.

Hosfeld says the benefits AMA member properties enjoy by going smoke-free include a healthier lifestyle especially for the non-smokers and the second hand smoke that kills more than 41,000 people per year (according to the American Lung Association). “Not to mention the cost savings when turning over a smoked-in apartment and a nonsmoked-in apartment,” Hosfeld says. “Moreover, a non-smoked-in unit means that it can be placed back into inventory that much faster.” The stakeholders involved in helping properties transition to non-smoking communities include the AMA; the Maricopa County Department of Public Health, which funded the grant; and the American Lung Association, a

Cheryl Davis, Senior Regional Portfolio Director with Shelton Residential, is taking eight of her communities smoke-free. She is on the AMA committee that oversees the program. “The program has evolved over the years, has streamlined the process and provides a manager ‘tool box’ that is very helpful to the onsite teams,” Davis says. “They are there for any assistance that is needed, from team training to meeting with the residents and assisting with resident functions. “The program has been successful at the com-

“In addition, we offer a smoke-free housing directory broken down by city on the Arizona Smoke-Free Living website and it gets good traffic,” she says.
Volunteers that make the program successful include AMA attorney members who speak on the benefits and legal processes of going smoke-free; property management leaders who speak on transitioning to smoke-free; and associate member insurance companies who offer property insurance premium discounts to smoke-free properties.

The proof is in the (clean) air and grounds In 2015, Robin Graul, CPM, Senior Regional Property Manager with Greystar, sent a survey to residents at six of her apartment communities seeking feedback on going smoke-free. “Overall it was a ‘yes,’” Graul says. “So, in January 2016 we started it at Chazal Scottsdale.

“As I walk through the property there are no cigarette butts on the ground, so it has a cleaner feel and look. We also have some apartment turn cost savings as we have less full paints when someone moves out. We also get people looking for apartments only at communities that are smoke-free.” Shelton Residential’s smoke-free communities vary in size, ownership and demographics, Davis says. They include 52 units in Winslow, 64 in Pinetop, 96 in Kingman, 644 in Phoenix (4 communities), 120 in Mesa and 128 in Casa Grande. Arizona Smoke-Free recognizes two levels of policies: Gold Standard Smoking* is prohibited on the entire property, including, but not limited to, individual apartment units, balconies, patios, parking lots, both private and work vehicles on the property, swimming pool area(s), and all other common areas. All residents, guests, property management staff, and outside vendors must abide by this policy at all times and, if they choose to smoke, must do so off premises. Silver Standard Smoking* is prohibited on the entire property except in a designated outdoor smoking area. Prohibited areas include, but are not limited to, individual apartment units, balconies, patios, parking lots, both private and work vehicles on the property, swimming pool area(s), and all other common areas. All residents, guests, property management staff, and outside vendors must abide by this policy at all times and may only smoke in the designated outdoor smoking area in compliance with the Smoke-Free Arizona Act (see above).

Serving notice A brief overview of proper service of notices under the Arizona Residential Landlord and Tenant Act By Theodore Horowitz Say it with me: “When in doubt, use certified mail.” Owners and managers of real property, often referred to as landlords, are frequently required to provide their tenants with various notices for a multitude of different reasons. The delivery, or service, of these notices is usually governed by the Arizona Residential Landlord and Tenant Act or “ARLTA” for short. On occasion, certain public housing assistance programs such as Section 8 or Section 42 have additional delivery requirements. This article will focus only on delivery of notices to non-public housing residents. If you have a resident who receives public or private housing assistance and have a question about how to properly serve them with a notice, please consult with your attorney. What is notice The ARLTA states that “(a) person has notice of a fact if he has actual knowledge of it, has received notice or notification of it or from all the facts and circumstances known to him at the time in question he has reason to know that it exists.” While this general definition of notice holds true, nearly all of the notices that landlords serve to tenants (and vice versa) must be written
