A Letter From The President

This is the fourth edition of the Escambia Medical Society Membership Directory. It includes our physicians’ names, specialties, NPI numbers, practice addresses, phone numbers, fax numbers and email addresses. Additionally, provided are hospital contacts, managed care company contacts, and county health department contacts. There are specifics on CME requirements and licensure renewal. Ancillary services and pharmacies are listed in the back of the book. The Escambia County Medical Society encompasses Escambia and Santa Rosa Counties and we host important CME meetings on: risk management, domestic violence, and medical error, which provide our physicians with needed mandatory hours for relicensure. Annually, we host a doctor’s day celebration where we give gratitude and thanks to all the physicians and their families in the community. ECMS members receive many benefits including: DocBookMD at no cost (a phone application with physician’s names and ease of contacting them), discounted malpractice and workers compensation insurance, the ability to get free consultation from The Florida Health Care Law Firm, and interaction and networking with other physicians in the community at our monthly meetings. Escambia County Medical Society The Escambia County Medical Society in conjunction with Santa Rosa County [ECMS] is a local professional association of medical doctors and doctors of osteopathy (M.D. & D.O.), that addresses political, social and economic issues concerning the level and delivery of healthcare for patients and physicians. Started in 1873, the non-profit ECMS represents over 400 physicians living or working in Escambia and Santa Rosa counties of Northwest Florida. The ECMS supports the Florida Medical Association (FMA) and the American Medical Association (AMA). Mission: The mission of the Escambia County Medical Society is to promote the art and science of medicine in order to improve the health of our community . Vision: Tradition – Honoring the history of medical care in Escambia and Santa Rosa counties Service – Serving the needs of our community through the service of our members in the practice of medicine. Leadership – Meeting the challenges of the future and safeguarding our community’s health through organized collaboration on the local, state, and national level. In 2012 approximately $5 million of free care was given to indigent patients in our community, provided by Baptist Health Care, Sacred Heart Health System and West Florida Healthcare and the approximate 160 physicians who volunteered as providers • Support of new medically-based projects that seek to improve the quality of life for all citizens • GoSeniors! E.C.M.S. Foundation The Escambia County Medical Society Foundation is a non-profit organization dedicated to providing healthcare services on a volunteer and funding basis through its members. The Foundation was created in 1994. • Primary goal is to assure access to adequate healthcare for the medically indigent citizens of the area • To study and promote improved methods and facilities for healthcare • To pursue the protection of public health • Implement the means of financing healthcare at reasonable costs • To cooperate with other organizations and institutions interested in pursuing these goals • Disseminate information concerning healthcare in general • Current Foundation programs include We Care and GoSeniors Voucher Program, which are a Project of the Foundation • We Care Program: Founded in 1992 and now implemented by the Health Department, the We Care program assigns medically indigent patients to physician specialists who provide in-kind medical care as volunteers. • GoSeniors! Voucher Program Transportation Program: The ECMS Foundation operates the GoSeniors! Transportation Program with the financial assistance from the Fellows Memorial Fund. The program started in 2011 to benefit healthcare continuity and has provided local residents, 60 years of age and older, transportation to physician appointments. Escambia County Medical Society Foundation has limited funds to support the We Care Program's patients. In the past, funds have been used for medications, equipment and transportation to care settings. To donate to these causes, mail your check to the ECMS Foundation at the address below. Escambia County Medical Society Foundation

You have a right to be proud of the work of the Escambia County Medical Society Foundation. Not every medical society has a charitable arm. And not all medical society charitable arms are as active as yours. The Escambia County Medical Society Foundation has two major ongoing programs, which, with your participation, provide real help and care to the citizens of Escambia County. You should be very proud. The older of these two programs is the We Care Program. This is the program that was initiated by the Medical Society Indigent Care committee under the Leadership of Drs. Donna Jacobi, Stuart Shippey, Reed Bell and others. The work of setting up the processes, of enrolling physicians and getting the kinks in the system worked out was enormous. As you know, doctors are masters of hard work. To their credit, they got it done. The first patients were seen in March of 1992. The program had a clinic one day a week. From that clinic, referrals were made to specialists on a rotating basis, as needed. In 1994 the next big step forward was made. The Escambia County Clinics opened their doors in a new facility on Palafox and the We Care Clinic, being no longer needed, was closed. That same year, the name of The West Florida Medical Foundation, Inc. was changed to The Escambia County Medical Society Foundation, Inc and its bylaws were rewritten to cover the mission of the We Care program. Under the new bylaws and incorporation, an agreement was struck with the County Health Department to manage the screening of patients and assignment to specialists. The administrative costs were shared by agreement. We Care was a very complex operation to set up. It has been running more or less smoothly for so long now, that we may forget all the work that actually still goes on within it. Its service to our community still depends on your participation. Patients who are seen in the clinics or in private physician offices who cannot afford the specialty care or treatments are still processed out to the doctors and facilities in the community who donate their time on a rotating basis. If not enough specialists in one specialty volunteer then the ones who do have a disproportionate burden. The more who volunteer, the easier it is for the patient to be seen and the less the burden on any one physician. The more of us who volunteer, the better the outcomes for everyone. Last year between, December 1, 2011 and November 30, 2012, physicians in our community donated $1,045,547.68 through the We Care Program. In that same time period hospitals and other health care facilities here donated $3,971,704.87. Those are amazing figures. We are a good community full of good people. The more recent program, begun in May 2011, is called Go Seniors. This is a voucher program funded by a grant from the Fellows Memorial Fund. The Foundation issues vouchers worth $10 each to doctor’s offices. These vouchers are to be given to selected senior patients to provide cab fare to and from medical appointments. After a successful first year in which $30,000 in vouchers was distributed, the program was reviewed and the grant renewed for another year and another $30,000. It works through the doctors’ offices that give the vouchers to the seniors who need them. Without your help for the seniors, it does not get done. Over the years the Foundation has initiated and participated in various charitable activities. At different times the Foundation has sponsored other charitable causes. It has given prizes to winners of the local science fairs for students. It provided money for a public service billboard. It piloted a project designed to bridge the gap between hospital and home care for elderly patients living alone. The two current projects are keeping the Foundation fully engaged. It is your participation in the programs and your tax deductable donations that keep it all going. By the way, if you see a need in our community that might fit with the Foundation’s purpose, please let us know.. The money for the Foundation comes largely through tax deductable donations from the members of the Escambia County Medical Society. 3. Write on personal stationery, your organization’s letterhead, or on plain paper. A personal letter is best! Your return address should be on the letter, not just on the envelope. This will enable your legislator to reply. 4. Do not use post cards or form letters except when advised to do so by the FMA Department of Governmental Affairs. 5. A good rule to follow is one subject per letter. Try to keep your letter to one page no matter how important the issue. This gives your letter more impact and makes a reply easier. It also takes up less of the staff’s and legislator's time. 6. Make clear the position of the issue you are on, and ask the legislator to support your position. 7. Refer to exact bill numbers if available and short or popular titles. Your FMA Governm have it. 8. Don't threaten or write in a belligerent tone. 9. Don't remind them of broken promises. 10. Don't write so often that your letters lose their impact. 11. Illustrate your position with a local example. 12. Sign your name legibly, and type your name under your signature. The Escambia County Health Department has placed great emphasis on increasing accessibility and availability of immunizations for children and adults. All child and adolescent immunizations in accordance with the Bureau of Immunizations Schedule and the Florida School Guidelines are available to eligible children ages 0-18 free of charge. The immunization department works closely with the Immunization Coalition and the Kiwanis Club of Pensacola to increase vaccination rates among children and adolescents.

WIC The Federal Supplemental Nutrition Program for Women, Infants and Children (WIC) provides vouchers for free food to use at local grocery stores as well as nutrition and breastfeeding counseling for Women, Infants and Children under 5 years old.

Requirements Licensed medical doctors are renewed by the department in two groups: Group 1 – current license will expire at midnight, Eastern Time, January 31, 2014 Group 2 – current license will expire at midnight, Eastern Time, January 31, 2013 The department will renew your license upon receipt of: 1. Completed Renewal application 2. Evidence that you have practiced medicine or have been on the active teaching faculty of an accredited medical school for at least two years of the immediately preceding four years* 3. Verification of your current status relating to prescribing controlled substances for the treatment of chronic nonmalignant pain 4. Required fees (renewal and background screen fees). 5. Your current primary place of practice address 6. Login to complete Physician Workforce Survey 7. Login to verify your practitioner profile 8. Complete the financial responsibility form * If you have not actively practiced medicine for at least two years of the immediately preceding four years, the board shall require you to successfully complete a board-approved clinical competency examination prior to renewal of your license. The board has approved the Special Purpose Examination of the Federation of State Medical Boards of the United States (SPEX) as the board-approved clinical competency examination that must be completed prior to renewal of the license. For the purpose of this section, “actively practiced medicine” means the practice of medicine by physicians, including those employed by any governmental entity in community or public health, as defined in Chapter 458, Florida Statutes, including physicians practicing administrative medicine. Any person holding an active license to practice medicine in the state may convert that license to a limited license for the purpose of providing volunteer, uncompensated care for low-income Floridians. The applicant must submit a statement from the employing agency or institution stating that he or she will not receive compensation for any service involving the practice of medicine. The application and all licensure fees, including neurological injury compensation assessments, shall be waived. To ensure you receive notification from the department regarding the renewal, you must have on file with the department your current mailing address. Failure to renew an active or inactive license by the expiration date will result in the license being placed in delinquent status. Failure by a delinquent licensee to become active or inactive before the expiration of the current licensure cycle renders the license null and void without any further action by the board or the department. A licensee who remains on inactive status for more than two consecutive biennial licensure cycles and who wishes to reactivate the license may be required to demonstrate the competency to resume active practice by sitting for a special purpose examination or by completing other reactivation requirements. www.escambiacms.org 35

Once you have taken the course for the first time, you have 6 years to complete it again. If you were initially licensed after 8/1/06 you have 3 bienniums (6 years) to complete the course. Example: A Physician expiring 1/31/13 initially licensed 5/31/08 would not have to complete Domestic Violence until the 13/15 biennium and would not follow the chart above. CME Requirements & Licensure Renewal • 38 hours of general CME • Up to five credit hours per biennium may be fulfilled by performing pro bono medical services for entities under the Department of Health, Volunteer Health Care provider programs, in an area of critical need and in Community and Migrant Health Care Centers. • Three to six credit hours may be fulfilled by serving as a monitor • Up to five credit hours may be fulfilled by any volunteer expert witness who is providing expert witness opinions for cases being reviewed pursuant to Chapter 458 or 468, F.S., in the area of risk management for each case reviewed up to a maximum of 15 hours per biennium • Five credit hours in the subject area of risk management or medical ethics may be obtained by attending one full day or eight hours, whichever is more, of disciplinary hearings at a regular meeting of the Board of Medicine in compliance with the following: • The licensee must sign in with the Executive Director of the Board before the meeting day begins. • The licensee must remain in continuous attendance. • The licensee must sign out with the Executive Director of the Board at the end of the meeting day or at such other earlier time as affirmatively authorized by the Board. A licensee may receive CME credit in risk management or medical ethics for attending the disciplinary portion of a Board meeting only if he or she is attending on that date solely for that purpose; he or she may not receive such credit if appearing at the Board meeting for another purpose NOTE: Up to 5 hours, per biennium, of continuing education credit may be fulfilled by performing pro bono medical services, for an entity serving the indigent or underserved populations or in areas of critical need within the state where the licensee practices. Frequently Asked Questions www.CEatRenewal.com Department of Health, Medical Quality Assurance will verify a practitioner’s continuing education record in the electronic tracking system at the time of renewal. Practitioners will be able to view their course history in the continuing education tracking system free of charge. The course history will show all the courses that have been reported for the practitioner. If the practitioner’s continuing education records are complete, they will be able to renew their license without interruption. If the practitioner’s continuing education records are not complete, they will be prompted to enter their remaining continuing education hours before proceeding with their license renewal. Why is continuing education being verified at renewal? Continuing Education is a requirement to renew a professional license. Section 456.025(7), F.S. requires the Department to implement an electronic continuing education tracking system for each biennial renewal cycle and to integrate such system into the licensure and renewal system. The two systems are now integrated. When will this change become effective? Beginning with licenses expiring May 31, 2013, practitioners will be prompted to report continuing education credits during the renewal process. Can I create an account in the tracking system prior to being licensed? No, you will not be able to create an account until you receive a license number from the Department of Health. Students need to know this information and once they are licensed begin reporting their continuing education.

What will happen if I do not have the required continuing education for renewal? Beginning in 2015 you will not be able to renew a license without having your continuing education reported into the continuing education tracking system. If you do not have the hours to report, your license will move to a delinquent status at expiration. In order to renew a delinquent license you will be required to complete the continuing education requirements. Additional fees may apply. Do I have to wait until license renewal to report my continuing education credits to the electronic tracking system? No, you can report your hours free of charge anytime during the biennium by registering for the Free Basic Account. The Department encourages you to report early to avoid a delay in the license renewal process. For more information please visit www.CEatRenewal.com. Please note, if you take a course from a Florida Board approved Provider they are required to report on your behalf. If you take a course from a National organization it is your responsibility to report completion. There may be other ways for you to obtain credit towards continuing education required for license renewal. If you are using the Basic Free Account it will be your responsibility to know the continuing education requirements for your Profession and calculate your compliance using the data listed on your course history. If you enter your hours prior to renewal in a basic account the system will not generate a compliance status, however, the system will check compliance during your renewal period using the basic account. What is the difference between viewing my course history using the basic free account or subscribing to the continuing education tracking system? With a free Basic Account you can view your basic course history, which will list the course name, educational provider name, date of completion and hours reported. of your specific continuing education requirements. You can also self-report any continuing education that may be missing. A Professional Account (paid subscription) provides you with all of the tracking tools that CE Broker offers. CE Broker Bureau of Operations Continuing Education Integration Project Release Plan www.CEatRenewal.com The Department of Health will now verify a practitioner’s continuing education record at the time of license renewal. Opening or Relocating Your Practice BUSINESS LICENSE Before opening your office, you will need a business license. This will be issued either by the city or county or both. Your local county medical society can provide you with the information on how to contact the city or county licensure units. LABORATORY LICENSE If you will be performing any laboratory services in your practice, you must comply with the Clinical Laboratory Act (CLIA) of 1998 and state licensure requirements. Please refer to the FMA article on laboratory licensure for additional information. TAX IDENTIFICATION NUMBER As an employer, you will need an Employer Identification Number (EIN) from the IRS. To apply for an EIN, you must fill out Form SS-4. If you will be providing “taxable” services or selling “taxable” items out of the office, you will need a state tax number. PROFESSIONAL LIABILITY INSURANCE In Florida it is not mandatory that all physicians purchase malpractice insurance. However, 67 physicians are required to demonstrate financial responsibility. Stark Regulations It Helps to Review Stark Reg Issues By: Jeffrey L. Cohen The Florida Healthcare Law Firm The Stark Regs (1) forbid doctors and their immediate family members from referring their patients to businesses they own which provide Adesignated health services,@ and (2) contains a long list of permitted financial relationships between health care providers. The list of what constitutes a “designated health service” (DHS) includes PT, rehab, diagnostic imaging, clinical lab, DME, and home health. A “physician” means an M.D., D.O., chiropractor, podiatrist, optometrist or dentist. An “immediate family member” is a husband or wife; birth or adoptive parent, child, or sibling; stepparent, stepchild, stepbrother, or stepsister; father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, or sister-in-law; grandparent or grandchild; and spouse of a grandparent or grandchild. In short, if you or your family member owns a DHS, don’t refer to it. Unless of course your situation falls within one or more of the gazillion exceptions. A few key changes from the third set of revisions (so called Stark III) which affect physicians are helpful to keep in mind. For instance, the way fair market value of physician compensation is determined in the Stark II regs has been simplified and now depends on an amorphous consideration of the transaction, its location and other factors. The clear formulas contained in Stark II was dropped and this makes the need for an expert FMV study even more compelling. Perhaps the most impactful change for physicians deals with marked up service fees. Under the Stark III regs, the technical and professional components of diagnostic testing may not be marked up unless the party providing the technical or professional service is a full time W-2 employee of the billing entity. Any physician with a component billing arrangement or time share arrangement will need to have them reexamined in light of the new regs. Another significant change deals with group practice physician bonus compensation, which now prohibits diagnostic x-rays, diagnostic lab tests and other diagnostic test revenues from being billed incident to the physician service and from being figured into a physician bonus calculation unless the group practice physician personally performed the test. Some of the other provisions that impact physicians include: • Independent contractor physicians have to provide their services directly (not through employee leasing organizations), via a contract and in the group practice’s facilities • Productivity bonus compensation may be based on services personally performed by a group doctor and incident thereto (e.g., PT and prescription drugs, but not a diagnostic test or hospital admissions) • Parties to rental arrangements who want to change the rental rate of a rental agreement after the initial 12 month period must terminate the rental agreement and enter into a new agreement with the different rental rate • Clarification that space and equipment leases must provide for the exclusive use of such space and equipment during the leased periods • There may be certain restrictions placed on physicians recruited by hospitals to group practices, which can include prohibition on soliciting patients and employees, requiring the recruit to pay for losses above any hospital recruitment payments, reasonable liquidated damages if the physician ceases to work for the practice but remains in the community • Each physician in a group practice is deemed to have the same compensation arrangements with the same parties that the group practice has • The rules regarding hospital recruitment have been loosened up with respect to rural hospitals 90 E.C.M.S. Stark Regulations The so called “75% Rule” continues to be confusing to doctors. As most physicians know by now, there is a mechanism in the Stark regs that allows them to refer their own patients for DHS provided by their own practices. That so called Agroup practice@ exception is key for the provision by practices to a multitude of ancillary services and is quite complex. It is only pertinent if the practice wants to provide DHS to its patients. Being a group practice requires, among other things, a single legal entity, a tax identification number, a Medicare group number, billing and collecting everything through the tax identification number and Medicare group number. It also requires that the doctors who are part of the group practice to devote substantially all of their professional time to the group practice. They could not, for instance, be in five different groups. So what does Asubstantially all@ mean? Under Stark, it means that the doctors in the practice devote, on average, 75% of their total professional time working through that particular group practice (that provides the designated health service to its patients). As such, if there are two physicians in the practice, and if one of them spend 100% of his total professional time working through the group, but the other spends only 25% of her total professional time working through the group, they fail the group practice test because they do not spend, on average, 75% of their total professional time working through that practice. They spend only 62.5% (125% divided by 2Bthe number of doctors). Florida confuses the issue. While it has a law like Stark, it has not clearly said what Asubstantially all@ means, though at least one declaratory statement from the Board of Medicine opines that the federal definitions will be applied (at least by that licensure board). Florida law further confuses the issues by doing two tricky things: (1) not allowing a practice that provides DHS to its patients to provide DHS to anyone who is not a patient of the practice, and (2) making one small exception for diagnostic imaging services. Moreover, if the practice obtains the exception that allows it to take in outside patients for diagnostic imaging, then EACH DOCTOR in the practice has to comply with the 75% Rule! Generally speaking, a Florida medical practice that provides, for instance MRI, clinical lab or physical therapy services to its patients, may not provide those services to people who are not patients of the medical practice. Those Aoutside patients@ cannot receive designated health services from the group practice. As mentioned, however, the state exception that applies to diagnostic imaging services (which does not apply to any designated health service other than diagnostic imaging) allows up to 15% of a practice’s diagnostic imaging services to be performed on Aoutside patients@ if the practice registers to do so through Florida’s Agency for Healthcare Administration (AAHCA@). So, to rehash: 1. A Agroup practice@ or solo practitioner can provide designated health services to their own patients; 2. One of the requirements of the Agroup practice@ exception is the 75% Rule, which applies on average to the physicians in the practice; and 3. If the practice also provides diagnostic imaging services to Aoutside patients@ via registration with AHCA, EACH doctor in the practice must devote at least 75% of his or her total professional time working through the practice.
