BATC activities reinforce our strategic goals

One key to making BATC’s strategic plan a living and vibrant document is to keep it prominently before us as we engage in activities during the year. Let me share a few with you this issue. GOAL: CONNECT OUR MEMBERS TO THEIR CUSTOMERS Right now, we’re making significant progress on our goal to become the leading resource connecting our builders, remodelers and associates to their customers, thereby growing their businesses. SPRING PARADE OF HOMES NEARS 400

Our spring Parade of Homes has nearly 400 homes and the Remodelers Showcase remains strong at 73 spring entries. New to the consumer marketing efforts for BATC is our Artisan Home Tour, which is rocking its kickoff at 25 homes for this summer’s inaugural event. KARE 11 BACKYARD PARTNERSHIP

In addition to our home tours, BATC has this year expanded its marketing on behalf of members by sponsoring the KARE 11 Backyard and showcasing its redesign. Our KARE 11 Backyard Redesign

Contest kicked off during the Sochi Olympics (which were on the station) and thousands have already voted. What great exposure for BATC and our professional builders and remodelers. We’ll have more exciting KARE 11 Backyard developments ahead of us as we enjoy our three-year partnership with one of Minnesota’s iconic brands. Did you know that one out of three Minnesotans watches KARE 11 consistently? PARADE OF HOMES YEARROUND ENGAGEMENT

To maximize the exposure our members gain from our Parade of Homes website year-round, we’re working on interactive elements to engage consumers and allow them to create and share their dream homes. Longer term, our goal is to capture more data from our website visitors to create marketing avenues for members.

BUILDERS AND REMODELERS SHOW

The other major marketing activity that’s less than a month away is BATC’s Builders and Remodelers Show: A Product and Service Expo. We are already 95 percent sold on booth space and fully expect this event to sell out as it did last year. Builders and remodelers, make sure you register for the April 3 event (registration is open at www BATCBRS.com). New this year is our BATC Fast Forward educational series preceding the show floor as well as an exciting lead retrieval system ensuring you get product information that can help you grow your business. I almost forgot to mention that every builder, remodeler, architect and interior design company receives four free meals at the show – you can’t beat that.

GOAL: TO BECOME THE LEADING VOICE A second major strategic goal in BATC’s plan is to become the leading voice for BATC builders and remodelers. The Minnesota legislature convened on Tuesday, February 25, at noon and it must adjourn by midnight on May 19. While predicting anything at the

a word from our president

Calling our remodelers to serve When BATC completed its branding study just a few years ago with the help of Beehive Public Relations, our Board adopted a strategy we call The Big Tent. The Big Tent calls upon BATC to effectively represent the breadth of our industry, from custom builder, to remodeler to mid-volume builder to large-volume builder to associate. The strategy also weaves together BATC’s core mission: To help our member businesses grow through marketing, advocacy and industry connections. Each of these areas is important and is to be encompassed under BATC’s big tent. As your president, I took an oath of office to serve as your leader for all aspects of the The Big Tent. I take that charge seriously. As a remodeler, I see particular opportunity for BATC to reach out to remodelers, and for remodelers themselves to become better integrated into all that BATC has to offer. I hear some remodelers say that their voices aren’t always heard at BATC, and that they aren’t involved in decisions. The best way to ensure that remodelers are being heard is for me to help remodelers get involved in all of our committees and groups. In this column of the Digest, I want to urge, cajole, suggest, ask, request – you get the idea – that my fellow remodelers get more engaged in BATC. I assure you, BATC is an industry association with a Big Tent philosophy that wants your involvement and I really do want to hear your voices across all of our activities. Here are several specific opportunities for you to become engaged and ensure that remodeling gains all that BATC has to offer 6

and that BATC serves our remodelers well. • Education Committee plans and executes the efforts of BATC University, career fairs, Fast Forward industry needs educational courses, speakers bureau and leadership development program. • PR Advisory Committee helps guide BATC’s messaging to both internal and external audiences. • Awards Committee plans The Big Night, a celebration of residential construction in the Twin Cities, including the ROMA, Reggie and Trilium awards. • The Remodelers Committee guides BATC’s efforts in support of our remodelers, plans and executes the activities of our Remodelers Council and Remodelers Showcase. • The Artisan Home Tour Planning Task Force guides our new high-end consumer event launching in June 2014, and opening to remodeling projects in 2015. • Public Policy ensures that BATC addresses legislative and regulatory issues that have a direct impact on our members. • Associates Committee plans the Builders and Remodelers Show (BRS), BATC’s golf outing and ensures that associates, remodelers and builders have opportunities to connect. • BATC Foundation our charitable arm, providing a unique opportunity to help others in need while casting a halo over our industry and your company.

• Membership Committee ensures that new members become engaged, seeks to retain them and assists our membership staff in recruiting new members. • Housing First our Super Political Action Committee is in the throes of the 2014 election already and will direct BATC’s candidate endorsements and independent expenditures on behalf of candidates who are champions of our industry. • Minnesota’s Green Path offers a green certification program for our remodelers as well as new home construction. Every one of the groups above needs remodeler input. It is a personal goal of mine to see remodelers become more involved and more integrated into all areas of BATC’s Big Tent. It’s not going to happen overnight, I know. But I’m asking my fellow remodelers, not to mention all of my fellow members, to step up and get engaged. If you talk to a BATC volunteer, they will tell you they get more out of the involvement both personally and professionally than they put in. They learn. They grow. They contribute. They gain. And their business succeeds, just as our mission calls for. So remodelers, take a moment to send me an email right now and let me know you are willing to deepen your engagement with BATC. Remodelers Council BATC’s Remodelers Council is a special interest group of BATC members who engage in remodeling, or Associate members who work closely with our remodelers. The Council holds Remodeler Roundtables several times a year to bring members together to discuss areas of interest, share successes and concerns, and bring issues to BATC. We have a Linked In Group and are exploring other electronic forum options to connect more effectively. If you aren’t currently receiving our Remodelers Council emails or aren’t sure, please email Wendy Danks (Wendy@batc. org) to make sure you’re counted among our Remodelers Council membership.

FALL 2014 PARADE OF HOMES AND REMODELERS SHOWCASE: AN OUTDOOR EXTRAVAGANZA

As you may know, BATC is sponsoring the new KARE 11 Backyard, that iconic space where you see KARE’s weather people, rain or shine. We’ll be building a gorgeous new space with the help of Southview Design and a whole lot of trade partners (hopefully you saw the design theme vote promotion during March). Our goal is to complete the build-out this summer and then open the new Backyard for limited times during the fall tours. With all the publicity surrounding the new Backyard, we felt it was the perfect opportunity to showcase some of the gorgeous outdoor spaces that we know you are creating as part of your Parade Homes and Remodelers Showcase projects. We’ll be adding a Backyard editorial feature to this fall’s Guidebooks, and plan to include a Mini-Tour of outdoor living spaces (backyards, front yards, even neighborhood community outdoor spaces). Meg Jaeger, BATC Treasurer MEGA HOMES Meg Jaeger grew up in a family that moved around a lot. By the time she was nine years old she had lived in five homes in four different states. Luckily for our industry, touring new homes and settling into new spaces inspired an affinity for houses that would later translate into a successful career. Meg is the President of Mega Homes, a small custom builder that seeks to construct homes with character; homes that are thoughtfully designed to answer the question: how does your family live?

What does being on BATC’s leadership team mean to you? “I was asked to be on the BATC Board last fall and I took the “ask” very seriously, as time commitments are a big factor when you own your own business and have a family. After much soul searching and consulting with people close to me, I decided to come on board. Our industry is still working its way out of a very long downturn and there are many facets of the industry that have changed; in good and bad ways. I feel that being a part of the BATC board will allow me to give my time to an Association that is there strictly to help its members be successful, be heard and to be the builders and remodelers that our consumers deserve. I believe that the joint experience and brain storming that the board and committee members bring to the table will always make BATC stronger.”

In her own family, Meg was one of the last in line. She grew up with five older brothers, an older sister, and a younger brother. She was the baby girl of the family, but you sure can’t tell that today. Meg is a true leader in the housing industry and serves as the Treasurer of BATC, and is expected to fill the role of BATC President in 2016. She’s also a mother to three fabulous daughters, which, according to Meg can be “challenging at times…but they are the most important job I have.” This year, Meg is on our Executive Board of Directors at BATC but, like most members of the Exec Board, she started getting involved at BATC several years before when she attended one of our many events - specifically a Parade of Homes Awards Committee meeting. “It was the first meeting I

went to and it was a good eye opener for me,” she explained. “To be on the inside of an Association that I hadn’t given enough attention to prior to that time was so beneficial to me because I was a part of such a great group of staff and Association members.” The Parade of Homes has been a game changer for Mega Homes–which participated in their first tour in 1997. “We’ve missed a few tours since that first one, but the Parade of Homes has truly always been one of the most important items in our marketing budget due to the way it is marketed and presented throughout the Twin Cities,” Meg shared. “The amount of media and consumer reach that the Parade of Homes brand touches cannot be matched dollar for dollar, especially for smaller building businesses like mine.” When it’s not all about business, it’s all about family for Meg. When she’s not working you’ll find her spending time with her three girls and enjoying outdoor activities like biking and traveling. Finding time to balance the busyness comes with its challenges but Meg knows how to get it all done. This makes sense when you realize her business goals line up so effortlessly with her family goals. At Mega Homes every design is “family-centric,” and built around how families really live.

Today he works as their Sales Manager for Residential and Commercial Sales, and is a proud member of the Builders Association. I am very involved at my Church and I love coaching my five kids – 3 daughters (Kassidi, Brittani and Kirstin) and 2 sons (Blaine and Bennett) in their various sports. Most importantly, enjoying life with my wife Kari. WHAT’S ONE COOL THING OTHERS MIGHT NOT KNOW ABOUT YOU?

I can quote the entire movie Tommy Boy with Chris Farley and David Spade. In fact, I have used some of the lines to make sales! My favorite line is: “I can get a good look at a T-bone steak by sticking my head up the bull’s…but wouldn’t you rather take the butcher’s word for it?” Ok, I have not actually used that line, but I would like to try it someday.

Moving at light speed How is it possible that I have been with the BATC Foundation for nearly a year? Just goes to show

that time really does fly when you’re having fun! Your BATC Foundation has accomplished a lot in the past year; you’ve earned some bragging rights! We’ve completed two projects for Minnesota veterans, helped an older disabled gentleman with some home repairs, entered into a new partnership to help transform bedrooms for kids with life-threatening illnesses into dream retreats and by the time you read this, we will have finished a house for Zack – a young man who has surmounted incredible odds by surviving and thriving after a vicious hit and run that left him with brain injuries and resulted in a leg amputation.

Many thanks to our community partners of the past year, including Rebuilding Together Twin Cities, Special Spaces and Project for Pride in Living. Thanks also go to our Build Partners of the past year, John Kraemer & Sons, and J.K. Anderson Builders. the house that Most of you have probably read something in the last few months about Zack’s House. While a lot of our promotion around Zack’s house focused on Zack CHERYL YOUNG himself, his mom Cheryl deserves most of the credit for getting this home built. From the moment that Cheryl received that horrible phone call from doctors in Anchorage, Alaska, telling ZACK MOHS her that her son Zack had been terribly injured in a hit and run accident, Cheryl has been Zack’s biggest cheerleader and most ardent advocate. Doctors initially told Cheryl that Zack would not survive. They told her that he would never recover past a vegetative state, that he had massive, permanent brain damage. Once Zack proved all of those

predictions wrong, doctors told Cheryl that Zack would never talk, would never walk and would need 24 hour care for the rest of his life. Cheryl has never believed any of it. She has always believed that given enough support, Zack could and would come back from his terrible injuries. What he needed most was a safe home where he could heal, recover, and eventually even raise a family. Cheryl quit her job to become a full time advocate for Zack, getting him into the Courage Center even when doctors there were initially doubtful about Zack’s ability to walk again. Even when Cheryl was dealing with her own diagnosis of kidney cancer last fall, she barely slowed down. She continued to plan fund raisers and get donations of materials for Zack’s house. It’s been wonderful seeing the rallying of support among the BATC members for Zack and Cheryl. Many, many of you have given donations of product, labor and money to see this project finished. Cheryl has marveled at the outpouring of generosity by our building community, usually sobbing “I can’t believe it, I can’t believe it!” and smiling from ear to ear. Zack is excited to be leaving the group home and being reunited with his dogs after a twoyear separation.

Growth debate continues as Met Council releases updated forecasts The Metropolitan Council’s 25-year forecast, titled Thrive MSP 2040, was released preliminarily last Fall and set off an intense debate on the future growth pattern of our region. Are the suburbs dying? Will Millennials leave the urban core when they achieve major life milestones like job promotions, marriage, and kids? What does the increase in minority share of the population mean for growth? Have previous forecasts been accurate? These are all good questions, ones that BATC has considered as it has become more deeply engaged in the regional growth debate. Regardless of their actual accuracy, the population forecasts take on a life of their own and influence real-life budget and infrastructure decisions. Not surprisingly, they also become political footballs, weaving their way into the policy dialogue of our region. In short, these forecasts matter. THE TRENDS, UPDATED The Met Council’s latest forecasts predict that a changing mix of households will continue to increase demand for development in the central cities and developed suburbs. BATC has publicly expressed concerns that the Met Council has overstated the central cities demand while understating the developing cities demand, a major departure from the region’s stable growth pattern over the past two decades. The Met Council did moderate their original forecast by stating in their second draft:

“One significant change from the preliminary forecasts is more balanced growth between developing and developed suburbs.” The Council forecasts a gain of almost 400,000 households by 2040 — and thus new housing units. Of that household and housing growth:

• 17% will be in the central cities; • 27% in the fully developed suburbs; • 47% in the developing suburbs; and • 9% in rural areas and outlying rural centers. This is a significant step in the right direction when you consider that the preliminary forecast had unsustainable 25-year population gains in cities like Edina (22,000 new residents); Hopkins (10,000 new residents); St. Louis Park (23,000 new residents); and Bloomington (31,000 new residents). These communities had less than one-half of one percent (0.005) of the current vacant developed lot inventory. Growth to the levels forecasted was virtually impossible. The updated forecasts spread the growth more evenly across the region, though more study by BATC will be necessary to assess the impacts and feasibility of the forecasts.

WHAT’S NEXT? Through the end of April, the Met Council will receive comment on the updated forecasts. BATC will be commenting on behalf of the industry. The Council will consider adoption of Thrive MSP 2040 along with regional and local forecasts in May. Beyond May, there will be additional opportunities for discussion of local forecasts. In 2015, the Council will once again review and revise regional and local forecasts in order to reflect policies now emerging through the regional systems, and policy plans that the Council will adopt in 2014 and early 2015. Of particular interest to BATC is the Housing Policy Plan, which will be the first such plan published by the Met Council in almost 30 years.

Good News for Property Owners: Court Decision on Sixty-Day Rule By Peter Coyle and Julie Nagorski Governmental agencies “must approve or deny within 60 days a written request relating to zoning” and a failure to do so results in an automatic approval of the application pursuant to Minnesota’s so-called “60-day Rule,” Minn. Stat. § 15.99. Under earlier Minnesota appellate court decisions, the 60-day Rule had been interpreted narrowly to apply only to zoning applications. The key case from 2003 had rejected a landowner’s claim that the 60-day Rule applied to a building permit application, instead determining that it covered only applications arising under the zoning ordinance, including special-use permits, conditional-use permits, variances, and site-plan approval. The Minnesota Supreme Court and the Minnesota Court of Appeals, however, have now issued decisions that interpret the 60-day Rule more broadly. This is good news for landowners, builders and developers. The Court of Appeals recently considered whether a landowner’s application to the Minnesota Department of Transportation for a permit for an ingress/egress access point for his property was subject to the 60-day Rule. In

Kottschade v. State of Minnesota, No. A131034 (Minn. App. Dec. 23, 2013), the landowner applied to MnDOT for permission to create and construct a driveway access from his property to the adjacent highway frontage road, without which his parcel lacked direct access to the public roads. MnDOT did not act on the request until 63 days after it was submitted, when it wrote a denial letter to the landowner. The lower court decided, based on the 2003 appellate decision, that the driveway access application was not a “written request relating to zoning” because it was not a zoning application and, therefore, MnDOT was not obligated to act on it within 60 days. The landowner in Kottschade appealed the lower court’s decision and, while the appeal was pending, the Minnesota Supreme Court issued its decision in 500, LLC v. City of Minneapolis, No. A11-1705, 2013 WL 5348308 (Minn. Sept. 25, 2013). In that case, the Minnesota Supreme Court held that an application for a certificate of appropriateness (for the alteration of a historic landmark under Minneapolis’s heritage preservation ordinances) was a written request relating to zoning and controlled by the 60-day Rule. continues on page 64

Welcome, New Staffers Hannah Morford, Graphic Assistant We’re thrilled to introduce the newest member of BATC’s creative team, Hannah Morford. Hannah has already proven to be an exceptional addition for BATC, bringing plenty of experience, talent, and enthusiasm. You’ve seen her design work in our BATC Deck post cards as well as a number of pages in the Spring Guidebooks. She’s also been a key player in getting our Artisan Home Tour off the ground, working with our builder partners to schedule photo shoots, video shoots and collecting materials for the architectural review panel — proving she’s a darned good cat herder. Hannah received her BS in graphic design from South Dakota State

Tom Gavaras, Marketing and Education Manager We were very pleased to welcome Tom Gavaras to BATC in late February. Many of you already know Tom from his 17 years with Greenspring Media or his previous employment with WCCO Radio. At BATC, Tom will take on BATC University, management of MN Green Path, producing job fairs, as well as handling consumer events for the Parade of Homes and Artisan Home Tour, plus a variety of other responsibilities for the Marketing department. Tom’s skill and knowledge in promotions, marketing and operations is well known. He’s been recognized with 10 awards at the Minnesota Magazine Publishing Excellence Awards as well as winning the Paul Foss Award from the Ad Fed of Minnesota. Tom’s experience will be a huge benefit to BATC

University with a minor in theatre and art. She’s worked as a freelance designer plus on the design staff for Blueprint Design and Print Center and LaMode Advertising. On the personal side, Hannah’s engaged to Mark Swan, who she met in college when they both worked on the theater production of All My Sons. Mark is a project auditor at Energy Management Collaborative, LLC. They have a Jack Russel/Cairn Terrier mix named Pico, who, Hannah says, keeps them both on their toes. Hannah also loves to cook, and is working on cooking her way around the world by trying out local dishes from other countries. We’re waiting for her to share those creations with the BATC gang soon!

MN Green Path Continues to Grow We were very pleased to have 170 of the 390 homes on this Spring’s Parade of Homes participate in the Green Path Energy Tour in Partnership with Xcel Energy. All of these homes were energy tested by RESNET raters, and were awarded Green Path Home Performance Reports (HPR). BATC fully supports builders (and their home buyers) who want to become certified, and we believe we have the most effective and efficient certification options on the market. But, we have added an Energy Tested category to MN Green Path for a couple of reasons.

Once the next generation of the MN Energy Code goes into effect, a blower door test and extended labeling for your home is going to be mandatory.

First, it meets one of BATC’s primary goals — to show consumers why new homes are better. With the Green Path HPR labeling combined with independent testing and the nationally recognized and ANSI Standard HERS score, we can graphically show prospective home buyers that new homes will save them energy dollars over resale housing (our biggest competitor). It also serves BATCs mission to be a valued and trusted resource to consumers. With the Green Path HPR, we help consumers by creating a concise and accurate way to get a handle on just how energy-efficient a home will be. Certainly, you can explain your construction techniques, insulation, windows, R-values and HVAC equipment until their eyes glaze over. But with a comparable Green Path HPR, you can give them the word of an independently certified energy tester that this particular home a specific percent more efficient than the average new home in the United States. That’s something they can understand. Finally, once the next generation of the MN Energy Code goes into effect, a blower door test and extended labeling for your home is going to be mandatory. When you work with a RESNET rater and MN Green Path, you’ll meet these new requirements while getting some excellent advice, an attractive third-party label, and likely at little or no cost as local utilities’ programs subsidize energy testing.

MLS Update MLS launched the MN Green Path Green Certification and HERS score listings 10 months ago. As more people become aware of this newer option, listings in these categories will continue to grow.

Oliver Erickson On January 30, at age 91, Oliver Eickson, passed away. Ollie was born in MN, graduating from Mpls Central H.S. and the University of Minnesota. He was President of Bronson-Erickson, Inc. and Erco, Inc., developing and selling residential properties in the Twin Cities. Highly dedicated to the industry, Oliver served as Past President of the Mpls. Builders Association and was an NAHB Sr. Life Director.

The horse trading will be intense. There will not be a special session. It’s an election year and neither party wants to be saddled with the bad PR. The Republicans will talk about the state’s business climate. The Democrats will talk about income inequity and the educational achievement gap.

In doing so, the Supreme Court determined that the 60-day Rule applies to “a written request that has a connection, association, or logical relationship to the regulation of building development or the uses of property.” The Supreme Court found dispositive the facts that (a) the application affected a specific parcel and particular property rights, (b) the heritage preservation statutes authorizing those ordinances connected those ordinances to the zoning ordinance and (c) the heritage preservation ordinances and the zoning ordinance both referenced and implemented the city’s comprehensive land use plan. Because these facts showed that an application for a certificate of appropriateness “related to zoning,” the Supreme Court decided that the 60-day Rule governed it. The Court of Appeals in Kottschade used the 500, LLC decision to determine that the 60-day Rule applied to the driveway access application. It reasoned that (a) the application affected a specific property and the landowner’s rights to alter and use it, (b) the statute giving MnDOT authority to issue the permit connected the decision on the application to the use of the property, and (c) the Minnesota administrative rules adopted by MnDOT

Property owners and developers should be aware of the deadlines that state law imposes on agency actions involving applications relating to zoning. The nature of requests to which the 60-day Rule applies is broader than previously-controlling law provided, which limited the Rule to applications arising directly under zoning ordinances. Under the recent appellate decisions, if sufficient connections exist between the application and the regulation of building development or the use of property, then the 60-day Rule controls.
