Two Steps Forward Your Board of Directors has recently made two very significant decisions that will enhance our association, add value to members’ investment and continue to elevate housing
1.
Housing First Minnesota The first is a new brand for our growing and effective advocacy efforts—Housing First Minnesota. As our advocacy efforts have expanded and our influence at the Capitol and with regulatory agencies has grown, the need for a name for our advocacy efforts that resonates with the public and reflects our growing movement has become increasingly apparent. Focused on our strategic goal of being the voice of our industry, the Board is excited about powerfully branding our advocacy efforts as Housing First Minnesota. It’s important to note that the programs and services you know and love from BATC will remain unchanged: The Parade of Homes, Remodelers Showcase, Artisan Home Tour, The Big Night, Builders & Remodelers Show, Reggies, ROMAS, Golf, Clay Shoot, Member Mixers, the BATC Digest, batc. org website, our new online membership directory, printed membership directory and so on. What will change is that our advocacy efforts will be presented to our many external audiences as Housing First Minnesota. The five major pieces of our modern, comprehensive advocacy program: Legislative, Regulatory, Legal, Issue and Electoral advocacy, will now use Housing First Minnesota as their brand.

Enhanced Communication Through Housing Industry News In addition, we’ll be enhancing our communication to BATC members and the industry statewide with a new, quarterly tabloidsized newspaper called Housing Industry News. Our newspaper will reach every licensed contractor in Minnesota and share with them valuable information about industry advocacy efforts, news they need to know and industry insights, all designed to help their businesses grow. This communications outreach will help mobilize our housing movement so we can reach the standing as an industry that home building and remodeling deserves. We’ve made great strides already, but more can be achieved. And we’re not doing this alone – our partnership with the Minnesota Association of REALTORS® is incredibly powerful. In addition, we continue to collaborate with the other major business groups in Minnesota such as the Minnesota Chamber of Commerce, Minnesota Business Partnership, Minnesota Association of Auto Dealers, Minnesota Grocers Association, Hospitality Minnesota and more.
Parade of Homes Website Rebuild The second major decision our Board made recently is to increase its investment in the Parade of Homes website. Already, this site receives some 350,000 unique users and millions of page views every year. Consumers interested in going on the tours, purchasing a new home or remodeling services, gaining inspiration for a future purchase or resources to help them make better housing decisions use this site. But it was built some five years ago, and it’s not fully mobile-responsive, nor can it take advantage of some of the upcoming technology. With this investment, we will be able to complete an entirely new administrative back-end, making it easier and simpler for our members to enter their homes and profiles. In addition, we will construct a new, fully mobile-responsive front end, with expanded search capabilities and enhanced visuals.

Where Does the Time Go? It’s July 2017 already, and everyone is busy — it was not that long ago we were all looking for the economy and the housing market to improve. Since I was asked to climb the leadership ladder at BATC in 2014, we have seen many changes in the economy, in the housing market and in how we do things here at BATC. For a variety of reasons, we are now able to accomplish more for our Builder, Remodeler and Associate members than ever before. Do you know that 65-70 percent of the new homes in Minnesota are built here in the Twin Cities market? Our Remodelers are quite busy and their remodeling activity dwarfs outstate remodeling as well. Also, and more importantly, Twin Cities builders’ and remodelers’ projects are inspected and highly regulated by cities, Met Council, PCA, Department of Health, DLI, etc. with significant enforcement for violations.

In the last year, your Association has increased its delivery of services to its members. Like most successful enterprises, BATC must constantly improve its “value proposition.” First off, let’s take a look at our current offerings and benefits with an emphasis on what is new.
BATC Political and Regulatory Affairs: • We’ve added a full-time regulatory affairs staffer, Nick Erickson, to help us up our game with state and regional regulatory agencies. • Our accelerated electoral efforts
have increased our association and industry’s prominence with legislators and staff at the Capitol exponentially. • Through our partnership with

the REALTOR® Associations and growth in our membership’s participation, we have catapulted our Housing Day at the Capitol to new prominence.

The code does not require that interior wall finishes such as primer, paint, wall-paper and carpet be in place. Gypsum board needs to be in place if it serves as either a component of the interior air barrier, or as a 15 minute thermal barrier protection for foam plastic insulation or as a component of the house/garage fire separation. The building code does not require the installation of either kitchen or bathroom cabinets, and as such there are no criteria for cabinets in the code. If the stair rise and run could be affected based on the thickness of a floor tile then that tile should be in place prior to the final inspection.

The provisions in the building code will require a permit for a deck if the deck surface is 30 inches or greater above the adjacent grade level, is not attached to the house (dwelling), and does not serve as an accessible route. The “accessible route” only applies to dwellings that require an accessible route under the State of Minnesota accessibility code, which generally means that most single family dwellings do not require an accessible route. Refer to your local municipal zoning ordinance to verify requirements related to setbacks and open space.

SESSION REVIEW
The 2017 legislative session has concluded and we are pleased to report that housing won big! Last summer we charted an ambitious plan to take our industry

to the next level. Key to this plan was our growing partnership
to inspire legislators to act. Legislators addressed our issues
with the Minnesota REALTORS®, who shared our vision
in a way we’ve not seen previously. With a half-dozen major

First-Time Homebuyer Savings Account Representative Greg Davids (R-Preston) Senator Karin Housley (R-Stillwater) The First-Time Homebuyer Savings Account was a leading proposal of the homeownership initiative. Importantly, this program is NOT a government handout. Instead, it encourages Minnesotans to save more of their own money by providing tax deductions and incentives to help achieve the dream of owning a home. That’s why we proposed the First-Time Homebuyer Savings Account Act — a new idea to help people get into their first home.
SIGNED Into Law
EFFECTIVE DATE: For taxable years beginning after December 31, 2016
The plan applies to firsttime homebuyers and those re-entering the housing market, if they have not owned a home within three years.
The Law Provides: • Individuals can deposit money annually into a FDIC-insured savings account. • The account can be opened at any Minnesota bank or credit union. • Contributions to the account receive a state tax deduction on interest earned. Individuals can deposit up to $14,000 annually, while married joint filers can deposit up to $28,000 per year.

Remove Barriers to Developing Owner-Occupied Condos/Townhomes Representative Dennis Smith (R-Maple Grove) Senator Kari Dziedzic (DFL-Minneapolis) A healthy housing market includes a wide variety of options to meet the needs present in the market. Condos and townhomes represent a key segment of the marketplace and face serious challenges. A key barrier to a healthy condo/townhome market was the state’s current construction defects law, which created a disincentive to new condo/ townhome development.

EFFECTIVE DATE: Applies to common interest communities created on or after August 1, 2017.
Requires the Homeowners Association to receive majority approval from its members to proceed with a construction defect claim.
The Law Provides: • Requires that a Homeowners Association mail each member of the association the nature of construction defect claim, the relief sought, and the HOA proposal to fund the litigation. • Requires the Homeowners Association to receive majority approval from its members to proceed with a construction defect claim.
• Prior to any construction defect claim, both parties must agree to mediation. • The association’s board of directors shall prepare and approve a written preventative maintenance plan, maintenance schedule, and maintenance budget for the common elements. The association shall follow the approved preventative maintenance plan.
• Expands the definition of a construction defect claim to “a civil action or an arbitration proceeding based on any legal theory including, but not limited to,…the loss of use of real or personal property caused by a defect in the initial design or construction of an improvement to real property that is part of a common interest community, including an improvement that is constructed on additional real estate.”

III. Public Notice for Housing Moratorium

Representative Jim Nash (R-Waconia) Senator Dan Hall (R-Burnsville) Minnesota law previously allowed a municipality to enact, without notice of a public hearing, a development moratorium that suspends a property owner’s right to use property for up to one year. Now, property owners must be notified of any proposed housing moratorium to limit the use of their property, and provided an opportunity to raise objections or concerns at a public hearing.

V. Twin Home Sprinkler Fix, Continuation of BATC v DLI

For the past four years, BATC has been fighting against mandated sprinklers in any single-family or twin home construction. Following our landmark victory in BATC v. DLI where the sprinkler mandate was struck down in one and twofamily homes, the industry faced a new challenge – the court decision and code definition weren’t aligned. The 2017 legislature addressed this technical issue with both the Senate and the House of Representatives voting unanimously for HF 792. The law directs the Department of Labor and Industry to modify Minnesota’s Building Code to match the national building code. The legislation follows the Minnesota Court of Appeals’ directive in BATC v. DLI, where the sprinkler mandate in one and two-family homes was struck down. BATC will continue to seek a permanent statutory solution to the sprinkler policy issue. Absent establishing an affirmative position in statute, the sprinkler debate will begin again in the next code cycle, which starts in late 2017.

Reminder: Contractor Registration Requirements Since September 2012, all contractors providing residential or commercial building construction or improvement services that do not require a license must register with Department of Labor and Industry through the Construction Contractor Registration Program.

Who Needs To Register
Why is Registration Important?
An individual or business entity that performs commercial or residential building construction or improvement services must register with DLI unless they:
•
The Contractor Registration Program was created by the legislature to assist DLI in its investigation of worker misclassification (treating employees as independent contractors).
•
By law, an unregistered “subcontractor” is presumed to be an employee of any contractor that hires them.
•
The hiring contractor can rebut this presumption if they can prove that the relationship between them and the subcontractor complies with all nine factors of the Nine Factor Test found in Minn. Stat. § 181.723, subd. 4.
•
Hiring an unregistered subcontractor is a violation of law, though the monetary penalty is forgiven for the first violation.
•
Even if your subcontractors are registered, your relationship with them must meet the Nine Factor Test or they will be deemed to be employees of your company even if they operate as a business entity (corporation or LLC) and maintain their own liability and workers’ compensation insurance.
•
Have a current license, certificate or registration issued by DLI
•
Are an employee of a business performing construction services
•
Hold a current residential building contractor or remodeler certificate of exemption issued by DLI
•
Were excluded from registration requirements by state law
Subcontractors not involved in the construction or physical improvement of a home, such as landscapers, cleaners and painters are examples of contractors not required to register with DLI.

Housing-Related Regulatory Changes in the Works 2017 is shaping up to be a year full of regulatory changes and code updates for Minnesota’s housing industry. BATC will be deeply engaged with these issues: Building Codes Updates
2018 Construction Stormwater Permit
On May 2, Gov. Dayton signed legislation requiring the Department of Labor & Industry (DLI) to immediately move to modify the department’s definition of a townhome to be three or more attached units. With Dayton’s signature, twin homes are no longer required to be built with fire sprinklers. This bill brings a technical fix to the landmark BATC v. DLI case, in which the Minnesota Court of Appeals ruled sprinklers cannot be required in new, single-family homes. The 2017 National Electric Code was adopted by the state’s Board of Electricity at its April 11 meeting. No major housing-related changes were included in the 2017 National Electric Code. The International Code Council will release its updated guide to the International Building, Energy and Mechanical Engineering codes in September. DLI has indicated it will hold meetings of its Technical Advisory Groups later this year to begin the work of preparing Minnesota’s new codes for adoption in 2019.

The Minnesota Pollution Control Agency (MPCA) is in the process of drafting the 2018 Construction Stormwater Permit. Minnesota’s current permit, adopted in August 2013, is required when any construction or development activity disturbs more than one acre of soil or if the MPCA determines that the activity poses a risk to water resources. MPCA is currently meeting with interest parties, including environmental groups, local government entities, state agencies and representatives from road construction, commercial construction and residential construction entities. Industry groups, such as the Builders Association of the Twin Cities, have already provided verbal comments and written recommendations to the MPCA. Few changes related to new home construction and development are expected for the 2018 Permit. The draft 2018 Permit will be made available for public comment in the coming months and MPCA aims to adopt the final 2018 Permit before the end of the year. Once adopted, the 2018 Permit will immediately replace the current permit.

Lead-Based Paint Renovation, Repair and Painting The Environmental Protection Agency (EPA) is currently reviewing its LeadBased Paint Renovation, Repair and Painting (RRP) Rule in accordance with an executive order issued by President Trump. Fully enacted in 2010, RRP requires the any contractor or subcontractor renovating a home, childcare center or kindergarten built before 1978, where lead-based paint is present, to maintain EPA or state certification and must use certified renovators. Any work that disturbs lead paint must follow specific method of work and cleaning practices to prevent lead contamination. Industry groups, including the National Association of Home Builders, have
provided comments to the EPA outlining industry concerns with the current RRP Rule. Here in Minnesota, the EPA is currently engaged in negotiations with the Minnesota Department of Health (MDH) to reach a deal that would allow MDH to take over statewide enforcement of the EPA’s Lead-Based Paint Renovation, Repair and Painting (RRP). Currently, the EPA enforcement division based out of Chicago has responsibility to ensure contractors renovating homes where lead is present are in compliance with EPA regulations. Once the EPA and MDH have agreed on the draft RRP rule for Minnesota, MDH will make the draft rule available for public comment, after which the final rule will take effect.

5 Housing Market Predictions From Metrostudy The Minnesota housing market has a lot going for it right now. Across the state there is low unemployment, wage growth, and job growth, which is leading to growth in new residential construction. Here’s what Mark Gianopulos, Metrostudy’s Midwest Region Director, had to say about the future of Minnesota residential construction.

Growth Ahead
With all of the positive economic signs we’re seeing in Minnesota, you can expect to see new home development. The Minnesota market has all of the golden signs we like to see. New construction has steadily grown for the last 18 months. At the end of 2016 we were up 16 percent, we’re up about 16 percent in 2017.

More Attached Housing
We’re predicting townhomes and condos will become more of a factor in the market. At one time, the majority of units in Minnesota were attached homes, but for the past few years, attached housing has made up only 15 percent of the market. State law allowing attorneys to go after homebuilders without recourse has thrown a damper on condo and townhome development. A new law passed by BATC during the 2017 legislative session should help solve this issue, and we should see a boost in townhome development in 2017. It will give Minnesota much needed lower priced units and bookend the market.

Millennials Will Prove They’re Not So Different
Millennials really are an interesting group. People think they are so different, but they really are more similar than we think to every other generation. They want the same things. The one difference, they are the reluctant adults. They need more of a push to be more responsible. It takes them being

Price Points Will Continue to Have an Impact
Price points are a problem in the Twin Cities market. Of all the Midwest metro markets, the Twin Cities is by far the most expensive. For the first quarter of 2017 the median price of a new detached home was $410,000. With household incomes barely above other markets, it makes it difficult for homebuyers. That’s the biggest headwind in Minnesota’s housing market. If you can control the price point, you’ve got great growth ahead.

Labor Problems Ahead
While Minnesota’s low unemployment rate in general is a big plus for the housing market, it has the potential to hold back new construction. It’s becoming increasingly more difficult to find labor with employment as low as it is. Even just office labor. In order to ramp up for housing starts you’ve got to have the support team behind it.

Lennar Tops the List of Twin Cities Builders for 11th Year in a Row.
Results from a recent survey by the Builders Association of the Twin Cities (BATC) show that Lennar - Minneapolis/St. Paul was the region’s top ranked builder once again in 2016. Lennar has held the top spot since 2006. Rankings are based on annual gross revenue as reported by respondents for for-sale housing. Lennar reported gross revenue at $262 million for 519 single family and 63 multi-family homes (582 total) closed in the 2016 calendar year.

What is Coming Down the BATC Pipeline? As I am sure you can tell by reading your emails from BATC, there is never a dull moment in our office. And that is the way that we like it. Keeping this in mind, I wanted to share what is coming up in my own words with hopes that you will participate where it suits you. As always, my first push will be our Kickstart events. Whether you are a new member who wants to learn about BATC or an existing member looking to “Kickstart” your membership, this is a great event for you. We hold them bi-monthly at our office and they are very well attended. BATC staff attends so that you can meet them and place a name with a role for any future questions. We also have about 45 minutes of networking after the presentation, which gives you a great opportunity to learn more about your peers. I hope you have been paying attention to the information being disseminated regarding our Public Policy work. We had another exceptional session at the Capitol this spring with many new laws benefitting our members directly in big ways. My personal favorite place to get all public policy updates is the BATC blog. You can find it at blog.batc.org. You may think that Public Policy doesn’t affect
your business day to day, but I am willing to bet it has more of a direct impact than you think. You may have heard that our BATC Open golf event has expanded to one morning and two afternoon shotguns. If golf isn’t your thing, you can STILL take advantage of the networking. Feel free to join us for the dinner portion of the event. You can hear all about the day of golf, enjoy some cold beverages and great food and win some sweet prizes! After a day of golf and fun, our members are in a relaxed mood and ready to enjoy some down time with great friends. Consider joining us! It is on August 3rd at Majestic Oaks Golf Club. Registration can be found on our website! Next is an event that I am extra excited about! We have joined forces with the Minnesota REALTORS® for Housing Day at the Fair. The first opportunity will come on Thursday, September 7, 2017 when we hold our second annual BATC Member Volunteer Day. We will be laying sod and landscaping at the brand new Minnesota Assistance Council for Veterans house, 1654 Minnehaha Ave., St. Paul, constructed by build partner, Lennar. The house will be operated by MACV as a Supportive Independent Living (SIL) home for veteran-headed families who are transitioning from homelessness.

9/11 National Day of Service—A volunteer opportunity for BATC Members and their families On Monday, September 11th, the BATC Foundation will provide a second volunteer opportunity by teaming up with The Sheridan Story to help fight child hunger. (Children ages eight and up can volunteer.) There are over 200,000 children in the state of Minnesota who live with food insecurity. The Sheridan Story fills the food gap between Friday and Monday, when children are not able to participate in the free or reduced meal programs at their school. To learn more about this program, visit www.TheSheridanStory.com The Sheridan Story provides food bags for children in over 60 schools in the Twin Cities metro area.
Before September 11th, 2017 BATC members are encouraged to participate in a food drive in the weeks leading up to the 9/11 National Day of Service. The Sheridan Story would like members to collect some specific items for the food bags: • • • • •

Before & After — the Rachel Project It was an emotional reveal as Rachel Dickinson stepped into her newly remodeled basement for the first time! The BATC Foundation, Special Spaces and build partner Ispiri were happy to present her with an amazing space that she will be able to use for years to come.

Two years ago, Rachel experienced a series of health events that led to a diagnosis of Crohn’s Disease and a type of malformation of the spine. For more than two years, Rachel’s world has consisted of hospitals (her longest stay was 86 days!), doctors and multiple surgeries. Because of her illness, Rachel is homebound much of the time and has missed a lot of school. One of the things that got Rachel through this tough time was creating art. The BATC Foundation, Special Spaces and Ispiri designed Rachel’s new basement to feature plenty of space for her to create.
The House That Refused to Give Up We began talking with MACV in late 2015 about building a home that would house veteranheaded families who were transitioning from homelessness. Although they currently operate more than a dozen homes for single adults, when a veteran who has children comes to MACV, they have no place to house them. When Lennar contacted the BATC Foundation this spring looking for a project to become involved in, they decided to take on the MACV project. Lennar has designed a beautiful five-bedroom home with an accessible first floor. The lot was donated by the City of St. Paul and by the time you read this, the project should be well underway! Your chance to see this beautiful home will come with this Fall’s Parade of Homes
because it will be featured as a “special” Dream Home and will be open to the public. Each $5 donation at the door will be dedicated to the next MACV project. A BATC Member Volunteer Day is scheduled for September 7 to lay the sod and finish the landscaping in time for the start of the Parade of Homes on September 9.
BATC Foundation Provides Help to Disabled in St. Michael The Saint Michael Foundation is a tax exempt charitable and educational organization established to provide financial and educational assistance to individuals with developmental delays. The focus is on helping them build life long relationships and work on their life skills in the process. After seeing the great work we did for Homeward Bound last year, the St. Michael

Foundation contacted the BATC Foundation to see if we could help them solve some problems with a similar group home in St. Michael. We are delighted to be working with build partner Minnesota Design and Construction based in St. Michael. The Foundation will be adding an addition at the back of the house, which is home to four young people with special needs, to expand the kitchen and dining areas.

Parade of Homes Research: Building for the Future

Regular research is key to good marketing, so we were thrilled to partner with the University of St. Thomas Opus College of Business this winter/spring on another Parade of Homes research project. Our goals included assessing the Parade of Homes Guidebook and website, as well as getting a glimpse at how our brand can adapt as the millennial market moves into prime homebuying. Our team of five graduate students conducted spring tour exit interviews, an online survey, focus groups and extensive secondary research.

Housing Day at the Capitol Earns Outstanding Meeting/Event Award
Congratulations to The Builders Group (TBG) for receiving the 2017 Company Award of Excellence from the Minnesota Independent Insurance Agents and Brokers Association (MIIAB). TBG is the premier self-insured fund in Minnesota with 900 members from the construction trades.
We’re proud to share that BATC’s own Nicole Coon won Outstanding Meeting/ Event of the year from MPI MN for this year’s Housing Day at the Capitol. The award was determined by a panel that judged based on influence, innovation and transferability.

Len Pratt, Pratt Construction, Inc., was asked to serve on the NAHB Land Use Policy Subcommittee for 2017. Len has accepted this appointment and will work to identify and evaluate key emerging land development issues and establish research and advocacy strategies to address them.

Say hello to a new face at BATC Olivia Wicklund joins BATC as our Receptionist BATC is excited to welcome Olivia Wicklund to our staff as our receptionist. Olivia is currently a student at the University of Minnesota-Twin Cities studying a major of her own design that includes nonprofit management, leadership and communications. Prior to joining BATC, Olivia served as the National VP of Competitive Events at the Family Career and Community Leaders of America and as a bridal consultant at a number of wedding shops throughout the Twin Cities. Olivia will be responsible for helping our BATC office run smoothly and efficiently by answering calls and emails, directing visitors, scheduling meetings and other administrative tasks. She will welcome you when you stop by BATC, so be sure to say hello! Olivia has a passion for motivational speaking, especially on anti-bullying, leadership and team building. She also is a part-time nanny and is engaged to be married in August 2018. She and her fiancé, Dan, live with their pug and house-trained rabbit in Minneapolis.
