Making Valuable Connections My goodness, what a change I’ve seen in the mood of our industry. People are once again feeling positive about their business and are eager to network with their peers. That’s why we’ve added four regional happy hours across the Twin Cities to our calendar. We’re presenting our members the all-important opportunity to build and strengthen connections.

So why add these casual member mixers? It helps us meet our mission. As the leading voice for builders and remodelers, we help our members build their businesses through marketing, advocacy and industry connections. Events such as these are important. We are the glue that brings together this industry, and unites us as a powerhouse in so many ways.

We add these four regional get-togethers to an already full calendar. Just to remind us all of our networking opportunities, we have Member Kickstart every other month; BRS, our Foundation Gala, Contractor University, and Housing Day at the Capitol in the spring; the Member Bash in June; Golf in August and September; the Clay Shoot, Green Path Conference and the BIG Night in October; the Member Buck Auction in the November; and the Launch Party in December. And let’s not forget that these are interspersed among the Spring and Fall Parade of Homes and Remodelers Showcase and the Artisan Home Tour in June.

But as the saying goes, you can lead a horse to water, but you can’t make it drink. In other words, these events are only as successful as you make them. It’s frustrating when I talk to a member who says they got no value from the association, but when pressed, admits that they didn’t attend anything or participate in any way. So as we arrive at the fourth quarter of this year, make it a priority to engage in your association. All of our events are on the BATC-Housing First Minnesota calendar on our website. Visit the site (BATC.org) and mark your calendars for this fall and the coming year.

We’ve already planned out the entirety of 2019, and when you lay all of our activities out on a calendar, it’s impressive (and a bit overwhelming).

Collaboration Yields Strong Results As I began my year as your president, I stressed to our board of directors and our staff my goal of collaboration. I put great value on productive partnerships in my own business, and I’ve seen the positive results. That same philosophy of partnership has served me well in my leadership roles with organizations, and I emphasized the power of working together with our board and staff this year. So as we enter the last quarter of this year and my term as your president comes to a close, I thought I’d reflect on the partnerships and collaboration we’ve strengthened during this past year.

PROJECT BUILD MINNESOTA Nearly three years ago, BATC-Housing First Minnesota brought together a wide array of construction-related associations to address the workforce challenge. That effort ultimately led to a working group under The Builders Group, which spawned the creation of Project Build Minnesota. We officially incorporated Project Build Minnesota this year, kicking off the new enterprise in January. It is a tremendous collaborative effort with BATC-Housing First Minnesota, Minnesota Builders Exchange, The Builders Group and Associated Building Contractors as its founders. If you haven’t yet seen the website, take a look at ProjectBuildMN.org. You’ll be impressed. Then let our staff team know if you are interested in serving on a speakers bureau (contact education and special programs assistant, Trisha Johnson, at Trisha@BATC.org). Project Build Minnesota is a powerful example of collaboration. PARTNERSHIP WITH THE REALTORS® Our partnership and collaboration with the Minnesota, Minneapolis and St. Paul associations of REALTORS has continued to strengthen. What a powerful advocacy voice we create regarding the value of homeownership. Our second Housing Day at the Capitol was a great success, and we enjoyed our continued partnership as we advanced our Housing Affordability Act, which seeks to address the regulatory challenges home building faces. And we had another great Housing Day at the Fair this year. FOUNDATION PROJECTS POSSIBLE WITH COLLABORATION Our BATC-Housing First Minnesota Foundation provides another great model of collaboration. For example, we completely redid eight housing units in an

old Minneapolis building for Avivo, which serves women in recovery who are housed with their children. Three different build partners were engaged (Crystal Kitchen, Soderberg Apartment Services and The Kingdom Builders), dozens of trade partners and Avivo contributed as well. Similarly, the BATC-Housing First Minnesota Foundation and Lennar constructed a home for homeless veterans in partnership with Minnesota Assistance Council for Veterans. More than 90 trade partners were engaged. Talk about collaboration. ELECTORAL ADVOCACY We’ve been deeply engaged with our partner business associations and chambers in the 2018 elections. These include the Minnesota Association of Auto Dealers, AgriGrowth Minnesota, the Minnesota Grocers Association, Hospitality Minnesota, Minnesota Association of REALTORS, the Minnesota Chamber of Commerce and the Minnesota Business Partnership. All of us seek to bring business-friendly candidates into office and we find those can be most effective if we do so collaboratively. It’s been a year of collaboration and partnership on behalf of our association, our industry and our members. We’ve also had great collaboration on our board of directors and I want to thank our engaged leaders. And an association can only be successful with a powerful collaboration between the volunteer leadership and our staff. We enjoy a wonderful staff here at the association that is tremendously passionate about our industry. Our staff-volunteer collaboration is yet another key to our successes this year. I want to thank my family and my coworkers at Cardinal for giving me the support I’ve needed to serve as your president this year. It has been a great experience. Onward.

Gov. Mark Dayton’s Housing Task Force Since January, a task force established by Gov. Mark Dayton has been examining the high cost of housing in Minnesota. Staff has been present at all Task Force meetings and meetings of its Homeownership Work Group. This summer, BATC-Housing First Minnesota sent a letter to the Task Force, saying its initial recommendations did little to address the lack of inventory and the inability to build at lower price points in the state. BATC-Housing First Minnesota heard from Task Force members that our outreach helped to change the direction of the final report.

The Task Force’s Final Report The Governor’s Task Force on Housing Affordability released its report titled “More Places to Call Home: Investing in Minnesota’s Future” on Aug. 21. Among the recommendations included in the report is a call to build 300,000 new homes by 2030, the creation of a regulatory review panel and addressing the industry-wide labor crisis.

Throughout the Task Force process, BATC-Housing First Minnesota advocated for solving our housing supply challenges by increasing affordability across the housing market. We are pleased to see the Task Force embrace the core of this approach, which begins with evaluating regulations and land policies to directly address affordability.

Gearing up for Session As we look toward the 2019 legislative session we expect this report to have an impact on the housing affordability discussion. BATC-Housing First Minnesota worked during the past legislative biennium to advance the Minnesota Homeownership Initiative, a collection of common sense proposals aimed at increasing homeownership and housing affordability for all Minnesotans. We look forward to continuing our work with local, regional and state policy makers. The hard work of addressing the cost drivers impacting housing affordability now enters a new phase. 2.3 Support and expand existing homerehabilitation tools and programs at the state and local levels to serve more homeowners who need to make improvements. 2.4 Substantially increase support for rehabilitation of public housing, much of which is experiencing notable deterioration.

3.3 Increase the capacity of local leaders to implement tools and solutions to address the home-affordability needs of their communities. 3.4 Expand the range of housing types across Minnesota communities. 3.5 Create a statewide review panel to evaluate regulations related to building standards, land use, and environmental stewardship for their impact on housing affordability.

When you lose your home, you lose your community—and the consequences of this major life disruption can last for decades. By doubling our investment in rental assistance, promoting voucher acceptance, preventing displacement, and improving protections for renters, we can reverse this trend, so kids learn, parents earn, and communities grow stronger. 4.1 Enhance and expand state and local rental assistance programs to complement federal programs that are too small to meet the need. 4.2 Define and crack down on predatory rental practices, including excessive evictions and poor condition of rental units. 4.3 Strengthen protections for renters in the private market. 4.4 Increase the speed and flexibility of emergency resources to prevent people from losing their homes. 4.5 Expand and enhance programs that help people navigate the systems to find homes and vital housing resources. 4.6 Incentivize the acceptance of rental assistance vouchers by the private market. 4.7 Prioritize investments needed to achieve the goals in Heading Home Together: Minnesota’s Action Plan to Prevent and End Homelessness.

At some point in our lives, most of us will need a helping hand. Many of us will be seniors who require assistance to stay in the place we’ve long called home. Other Minnesotans have experienced trauma or need health services. We can achieve better outcomes in a more cost-effective way when we coordinate services to meet people where they live. 5.1 Provide a dependable stream of funding for social services that help households maintain stable homes. 5.2 Provide access to a full range of services for families and individuals transitioning into stable homes before, during, and after the transition. 5.3 Improve health outcomes and reduce costs for tenants by developing better partnerships between health care and housing providers. 5.4 Advance the Housing Supports program for residents with disabilities by identifying gaps and potential program enhancements to ensure statewide coverage. 5.5 Expand programs and providers who assist individuals in finding, securing, and retaining affordable rental homes.

SUPPORT & STRENGTHEN HOMEOWNERSHIP Create pathways to sustainable homeownership, with a focus on removing barriers for households of color. Our wealth and our retirement savings are concentrated in our homes. Most Minnesotans want to own a home, and everyone who can sustain homeownership should be offered the tools, coaching, and access to financing they need to make this investment in their own future and in our communities.

6.1 Focus on increasing access to homeownership resources for the large number of income-ready households of color who want to buy. 6.2 Promote alternative models of building wealth through homeownership, such as community land trusts, cooperatively owned housing and manufactured home parks. 6.3 Encourage employers and foundations to support home purchases. 6.4 Increase funding for financial education and counseling programs that expand the capacity of households to pursue homeownership. 6.5 Expand mortgage products and provide extra support to local community banks to expand financing options. 6.6 Expand available down-payment assistance programs.

Advocating For Affordability In The New Building Codes A report on the initial building code recommendations from the Construction Codes Advi­ sory Council (CCAC) of the Department of Labor & Industry (DLI) features comments made by BATC-Housing First Minnesota earlier this year. Following the June 26 meeting of the CCAC, the Department of Labor & Industry released a report that included comments and concerns voiced by the CCAC members regarding the initial review of model code changes earlier this year. The report also included comments submitted by organizations following the release of the Technical Advisory Group reports in mid-May. Of the 10 organizations either submitting comments or co-

signing letters, our comments stood out for several reasons. In a memo submitted by Nick Erickson, BATC-Housing First Minnesota’s regulatory affairs manager, the organization outlined its longtime goal of housing affordability being given equal consideration to energy efficiency, safety and durability. The memo also noted that homes built in Minnesota today already exceed the energy code and that further regulation threatens housing affordability. BATC-Housing First Minnesota was the only group to submit comments on multiple TAG reports and to recommend not adopting the 2018 International Energy Conservation Code for residential construction.

BATC-Housing First Minnesota Feedback Leads To Improved 2018 Construction Stormwater Permit The 2018 Construction Storm­water Permit, in effect since Aug. 1, features significant input from BATC-Housing First Minnesota. The Minnesota Pollution Control Agency released the initial draft permit in April 2018. We outlined several changes our members want­ed changed in the final permit, all of which were accepted. According to the MPCA, while there

was a consensus that the repair time frame should increase, concern over the term “next anticipated rain event” caused the improved repair time frame to be excluded from the final draft. Our executive director, David Siegel, in a letter to the MPCA sent on July 31, asked the agency to increase the repair time frame should the MPCA modify the new permit.

Harstad v. Woodbury Victory BATC-Housing First Minnesota member Marty Harstad secured a major win from the Minnesota Supreme Court on Aug. 15, which ruled against a Woodbury traffic impact fee The ruling upholds BATC-Housing First Minnesota’s longheld belief that developers should not be coerced into paying otherwise unauthorized city fees through a city threatening to withhold the approval of a development.

Next Steps Immediately after the ruling was announced, we sent a letter to the state’s 25 fastest growing cities seeking information about their current traffic fee practices. By the time of printing, several cities had already responded, saying they no longer charge unauthorized fees or had never engaged in the practice. The Housing Affordability Institute, formerly the BATC-Housing First Minnesota Legal Defense Fund, is currently in the field with research that will include an examination of local fees and regulations, including the fees at issue in this case.

BATC-Housing First Minnesota played an essential role in the Harstad v. Woodbury case. Along with member Frank Kottschade and the National Association of Home Builders, we filed an amicus brief in support of Harstad. BATC-Housing First Minnesota provided additional support to Harstad in his multiyear battle, resulting in this landmark victory for our industry.

What The Harstad v. Woodbury Ruling Means HOUSING AFFORDABILITY Like the Eagan v. Country Joe ruling from 20 years ago, the Minnesota Supreme Court said in Harstad v. Woodbury that cities cannot charge unauthorized fees. The court’s opinion, written by Justice G. Barry Anderson, went further than the Country Joe case. Not only can cities not charge fees not authorized under

I N S T I law, T U cities T E also cannot Minnesota use development agreements to force unauthorized fees upon developers. The court also ruled that a development agreement does not open the door for negotiations of otherwise unauthorized fees, unless the developer is willing to pay these fees.

Outreach Follows Harstad v. Woodbury Landmark Ruling Immediately following the Minnesota Supreme Court’s decision in the Harstad v. Woodbury case, BATC-Housing First Minnesota sent a letter to 25 cities across Minnesota seeking information on how each city plans to comply with Court’s ruling. In the weeks since the Aug. 15 ruling, BATC-Housing First Minnesota has heard from more than half of the top 25 cities for new home construction, with both Lakeville and Savage saying they no longer charge unauthorized fees. With the exception of one city, Dayton, Minn., all have indicated they do not, never have or will now stop seeking these fees. The City of Dayton is looking to enact a one-year development moratorium as it reviews its fee structure. Our staff and members affected by the mortarium will be engaging in conversations with Dayton.

The Minnesota Residential Building Code, in Section R501.3, “Fire Protection of Floors,” now requires floors constructed with other than 2 x 10 solid sawn floor joists to be protected on the bottom side with ½ inch gypsum board or 3/8 inch wood structural panel that serves as a means to provide an extra margin of safety during a fire rescue mission. There are some exceptions for crawl spaces, utility areas and alternative engineered joists that can be considered. This code section does not require any joint treatment or address vertical penetrations through this membrane.

Are exterior house foundation sill plates required to be preservativetreated?

Not necessarily. IRC Section R317, “Protection of Wood-Base Products,” requires that foundation sill plates that rest of a concrete or masonry exterior foundation wall and are less than 8 inches from the exposed ground be preservativetreated or be a naturally durable wood, such as Redwood, Cedar, Block Locusts and Black Walnut. In other words, if the foundation is 8 inches or greater from the exposed ground it can be of any species recognized by the code structurally capable of carrying the load above without being preservative-treated or naturally durable wood. Some code officials recognize that the use of a sill sealer between the sill plate and the foundation wall provides the separation needed to prevent moisture from being absorbed by the sill plate. Check with your local code official.

We would like to replace some existing windows in three bedrooms of a 1960s-era house. It was suggested that if we replace these windows that at least one in each bedroom will need to meet the current code for egress (emergency escape and rescue). Is this correct?

No. The State of Minnesota amended IRC Section R310 to include some wording that addressed this situation. It basically states that window replacements are exempt from the minimum net clear height (24 inches), net clear width (20 inches), and net clear overall size (5.7 square feet) as long as the replacement window is the manufacturer’s largest standard size window that will fit into the existing rough opening and of the same operating style or a style that provides for an equal window opening area. For example, under this provision, if an existing sleeping room only had 24 x 24 double-hung windows then the replacement windows could also be 24 x 24 double-hung windows (even though they would not meet the 5.7 square feet needed for windows in newly constructed homes).

We have been asked to remodel the basement level of a home constructed in the 1940s and we are concerned about the lack of ceiling height for a proposed sleeping room and recreation room. Does the code have any exceptions for these types of existing situations?

Artisan Home Tour Success! RECORD-BREAKING NUMBERS

Five years in, the Artisan Home Tour has solidified its place as the premier high-end home tour. This year’s tour was an outstanding event that brought qualified buyers to homes from BATC-Housing First Minnesota builders and remodelers throughout the Twin Cities. The Artisan Home Tour grew in attendance by 10 percent, with a new single-day record of 9,671 visits on the final day.

RESPONDING TO SOCIAL MEDIA ATTACKS

PROACTIVE MEASURES

Harm posed by an attack is greater if the victim company has no detection or response plans in place. There are steps a company can take to limit the harm caused by an attack.

Businesses increasingly rely on the internet and social media to attract and retain customers. Responding to online attacks is critical to maintain a strong online reputation. Even one incident can ruin a company’s reputation and cause customers to go elsewhere.

MANAGE AND MONITOR. A company should invest in continuously monitoring its online presence. COMPLAINT PROCEDURE. A company should create clear procedures with a designated team to investigate and respond to posts containing damaging rumors or misleading information. The faster a company responds to complaints, the more likely any single attack will be contained.

Gone are the days when complaints were spread through word of mouth. Attacking a company online is easier and more effective. Anyone can post a bad Yelp review or damaging Twitter post. More sophisticated attackers can impersonate a company online, hack accounts, and reach millions of users often before a company ever notices.

COMBATTING AN ATTACK DO NOT ACT IMPULSIVELY OR RETALIATE. The initial reaction to a social media attack is to strike back. A vengeful response, without fully understanding the attack, can do more harm than good. Instead, take a deep breath, consider options, and make a proper response.

Contact the Known Attacker Directly. A disgruntled customer or employee may respond more positively if contacted personally. Research has found that approximately 1/3 of customers receiving a personal response to their negative review deleted the negative review and/or posted a positive review.

IDENTIFY THE NATURE, SOURCE, AND EXTENT OF THE ATTACK. It is crucial (but not always easy) to identify the attackers. Anonymous posting is very common. If the attacker(s) cannot be identified, a company should at least identify the type of attacker, who may be an angry or dissatisfied:

Reaching Out to Unknown Attacker. By posting a polite message asking the attacker to contact the company directly, a company may cure the underlying problem that triggered the online attack, and will show other viewers that the company is attentive to its customers.

Issue Public Statement. The more individuals publicly expressing concern, the more appropriate a public statement becomes. To the greatest extent possible, a company should carefully draft its response to frame the issues positively. The message should focus on affirmative steps taken to remedy a legitimate concern raised by an attacker.

To determine its response, a company should search online to identify all social media platforms (e.g. YouTube, Facebook, Twitter, Snapchat, Yelp, Google Reviews, etc.) on which the attack is taking place or being discussed. STEP

Contact Media Platform. Contact the platform provider directly or utilize the provider’s reporting mechanisms. For example, Yelp allows reporting and removal of fake or defamatory reviews, and Twitter and Facebook allow reporting and blocking of harmful or abusive users. If the damage can be contained using these procedures, this should be the first option.

CONCLUSION Time and money are well spent monitoring social media and having a team in place to respond quickly to an attack. Rapid and effective action can mean the difference between a minor annoyance and a major PR disaster.

LEGAL ACTION. A final option is to pursue legal action, including hiring an attorney to send a cease and desist letter, or file a defamation claim. While defamation claims are notoriously difficult to prove, some organizations have been successful against blatant and unfair attackers. STEP

Progress on the New Home for Homeless Women Veterans The BATC-Housing First Minnesota Foundation/HomeAid Twin Cities and build partner Lennar are hard at work on the construction of a second home to be donated to Minnesota Assistance Council for Veterans (MACV). This five-bedroom home will be used by MACV to house homeless women veterans, a population of the community that MACV says is in growing need of services. The Maplewood lot for this home was donated by the Minneapolis Area Association of REALTORS® (MAAR) Foundation.

This exhibit is an awareness campaign designed to honor women veterans. Watch for more details on the reveal of the home and the exhibit in our next Digest.
