DIRECTOR LETTER

WHY WE CHOOSE TO BE THE BIG TENT

David Siegel BATC Executive Director

It’s not easy being the Big Tent as an Association. Each of our member categories has its own special needs and perspectives. Small volume builders have a very different view of the industry than their large volume brethren. Our remodelers have, at times, felt secondary to our new-home builders. Our mid-sized builders will express frustration as they struggle to find land and labor in competition with the large volume builders. The large volume builders want to see greater emphasis on advocacy and a stronger representation at BATC given their market share. Our Associates want to see more builders of all sizes at BATC events to enhance networking. New members sometimes feel that BATC isn’t as welcoming and can be cliquey. Long-time members can be resistant to change and yearn for “the way it used to be.” Each market segment has plenty of issues with its relatives. Hmm, sounds like a typical family. This is the challenge BATC faces as we strive to unite our 4

BUILDERS’ DIGEST

industry, to advance our collective cause and provide benefit to all members. Our basic premise is a simple one – the rising tide lifts all boats. As our immediate past President, Curt Christensen, often highlights, industry differences are put aside as our members enter the Big Tent of BATC. “Outside, we’re fierce competitors. But inside BATC, we come together for the good of the industry.” This past summer, BATC underwent a thorough and powerful branding exercise with a professional PR and branding firm. Our Board of Directors gave significant thought to the brand and made the conscious decision to spread the canvas of BATC and occupy the Big Tent position in the marketplace. It was a gutsy decision. Think about your own business – the more narrowly you can define your target customer, the easier it is to operate your company. As a trade association, though, our purpose is different. Our mission is to help our member businesses grow through marketing, advocacy and industry connections. And our vision is to be the leading voice for builders and remodelers. That mission and vision refer to all builders, all remodelers and all associates. As your professional trade association for the residential construction industry, we believe we must open our doors to all segments of our industry. We must be the Big Tent. As we look to a future with more regulation and more obstacles to our industry, one very clear

Welcome 2013 President, Pamela Belz

ADVOCATING FOR YOU 2013 will be an exciting and challenging time for our industry and association. I feel very honored and humbled to take the reins at BATC as we continue the slow and steady but precarious climb out of a devastating housing recession. We will face legislative, regulatory and economic challenges that will threaten our fragile recovery. But we can celebrate with hope; strengthening signs of our recovery, increasing market demand, climbing permits, historically low interest rates and the fact that we have survived. We are back in the saddle again. And BATC is focused on priorities identified in the Beehive Branding study as important to us and is ready to help us move on down the trail. BATC will utilize its resources and harness our collective power to accomplish what we cannot do alone. At BATC my passion is advocacy and political action. Post-election, we know this is where we will face our biggest hurdles. The Fire Sprinkler mandate tops the list, but energy code changes, environmental regulation, new storm water permit rules and municipal fees all present challenges. Our advocacy team is strong and will be supported by our new dues structure, which creates dedicated funding for our advocacy efforts. As our housing market changed, so has our ability to rely on Parade of HomesSM as advocacy’s primary revenue source. We are now structured so the companies benefitting the most from our advocacy impacts also pay proportionately. And more Parade dollars are 12

BUILDERS’ DIGEST

retained to promote Parade marketing and activities. A win-win. Fighting the Fire Sprinkler mandate is the priority in 2013. We are working with BAM, our state association, as they lead our fight through the upcoming Administrative Law Judge hearing process. We are developing a tactical legislative strategy. We have retained a powerhouse communications firm to research and create a targeted public relations plan. We will use all the horses in our stable for this fight. One way you could truly make an impact is to JOIN US, Wednesday, January 30th at Homebuilder Day at the Capitol. It is a critical opportunity for us to make a show of strength. Please mark your calendar and watch for details! Another tool we utilize is our Housing First independent expenditure fund. I believe it is our most important tool. I have been thrilled to see it grow and wish to thank those who have already supported Housing First. With the $85,000 we generated this year, we supported 27 candidates of which 22 were elected. We will work with them and others to build a coalition supportive of housing.

A Little Competition This year we have created an eventing competition of sorts. We have selected a series of key association events and not only will we offer additional BATC bucks for attending, but those attending most events will be entered in a very special prize drawing at the BATC auction. Those events include: January Dinner meeting;

Like many, I became a horse of a different color four years ago joining Senior Housing Partners, part of Presbyterian Homes and Services, where my focus is development and construction of senior housing campuses. I am blessed to share life with my husband, Rob. I am grateful for his support of my service to BATC. Our “kids” are two energetic Australian Shepherd mates Bogie and Gracie, whom we adore. I’ll show you pictures any time! So, as we enter 2013, I’d like to extend a heartfelt thank you to outgoing President Curt Christensen for his tireless efforts and outstanding service on our behalf. I shall look to our lineage of past leadership, the energy and commitment of our exceptional Board of Directors, and the work of our talented staff members to spur us on to greatness in 2013. READY, SET, REMODEL! TAKING STOCK FOR 2013 BY SHAWN NELSON, PRESIDENT OF NEW SPACES AND BATC 2013 BUILDER VICE PRESIDENT Here it is at the beginning of a new year, and hopefully, you’ve set your plans to make it a great year. If you’re a little behind in that process, still uncertain, or always want more information, here are some interesting tidbits for you to consider: • The Remodeling Market Index rose to 50, its highest level since 2005. Do you remember 2005? It is sort of like cold weather. When you hit 50 on the way down it hurts, but when you hit it on the way up it feels great. • The Housing Market Index is up to 46. Still not to 50 or over, but way better than the eight it recorded in 2009. Strong new construction is positively correlated with strong remodeling. It is about people being confident enough to invest in their homes, and having the ability to make those investments with jobs and access to financing. • The Leading Indicator of Remodeling Activity is projecting double-digit growth next year. They specifically cite

strong growth in new construction as being associated with an upturn in remodeling some months later. • Want more information? Check out: - eyeonhousing.wordpress.com – NAHB’s blog on housing economics - batc.org/blog –BATC’s blog - www.jchs.harvard.edu - Joint Center for Housing Studies of Harvard University Sure there are threats to our industry, nationally and locally, but right now remodeling looks and feels poised to continue to grow strongly. Are you in position to take advantage of that growth? Have you thought about what strong industry growth may mean for your business, staffing and labor, competition, and managing customer expectations? Make a commitment to join with your fellow remodelers this year to network, learn, and advance our industry. These actions will help you make it a great year.

2012 ELECTION REVIEW: HOUSING FIRST TAKES ANOTHER STEP FORWARD BATC’s Housing First Fund (HF) emerged in the 2012 elections as a major player in Minnesota elections. HF took a major step forward, prevailing in targeted races at an 82 percent success rate. This result is especially impressive when considering Housing First’s focus upon the battleground races in the Twin Cities suburbs and in St. Cloud. These races were also targeted by several outside groups and emphasized by the State DFL Caucus. In those races, HF-supported candidates won three of seven races, with one of the losses decided by just 170 votes, less than a half of a percent. Statewide, the elections ushered in a political leadership dynamic that hasn’t been seen in St. Paul for over two decades – DFL leadership across the House, Senate, and Governor’s office. The GOP leadership of the legislature for the first time in 40 years was short-lived, lasting just two years. The DFL swept back into leadership by prevailing in several key legislative races, sweeping suburban communities like Eagan and Edina and winning in several head-to-head races between incumbents who were paired in races following redistricting. Many political observers were surprised by the DFL’s mini-wave of success in the 2012 election. While the President’s successful re-election effort aided DFLers to an extent, a well-mobilized and organized DFL ground game was key to their legislative success. For the GOP, the 2011 government shutdown and constitutional amendments for Voter ID requirement and Marriage definition

Housing First Message: The HF message was bi-partisan and positive, focusing on electing champions for our industry with a proven track record of support. For example, Karin Houseley’s card said: Supporting housing initiatives that grow jobs and strengthen our economy > The Housing Industry is a major driver of the US economy > A strong housing industry means more jobs in our communities and it strengthens our economy locally > A stable housing sector is essential for a robust economic recovery and long term prosperity

Looking Ahead The DFL controlled Capitol will present a change in the tenor of the fiscal and policy debates. For BATC, this could mean revisit-

ing local growth discussions, affordable housing, stormwater/wetland regulations, warranty law, and local approval issues like permitting and environmental review. BATC’s message to the DFL will be similar to the one we’ve given the GOP legislature over the last two years: housing is just beginning its recovery and we must focus on policies that encourage growth. The growing regulatory footprint in homebuilding is a threat to our economic recovery and must be carefully balanced. On the election front, 2014 election discussions began shortly after the dust settled from last November’s elections. Major races for the Governor and US Senate will attract significant attention, as will the Minnesota House battles in the Twin Cities suburbs. HF has begun preparations

LOOKING AHEAD 2013 LEGISLATURE Our take on what to expect in St. Paul this session Governor Dayton will be joined by DFL majorities in both the Minnesota House and Senate, setting up a legislative dynamic that hasn’t been seen in Minnesota in since the 1988 elections. No issue will get more attention in 2013 than the state’s budget, which currently sports a $1.1 billion dollar deficit. This is a modest problem in comparison to recent budget cycles, but the aim of the DFL- led Capitol is much larger than the two-year deficit. Governor Dayton and a large contingent of DFLers are focused on major structural reform to Minnesota’s tax code. They see this as a once-in-a-generation opportunity to place Minnesota on a sound and equitable financial footing. Changing Minnesota’s tax code will not be easy. While the DFL holds the keys to both legislative chambers and the Governor’s Office, they will be challenged by the more fiscally conservative GOP minority. Also sure to find challenges in the budget debate are the large contingency of newly elected DFL legislators from swing districts. To top it off, more than one-third of the legislature consists of newly elected officials, which could throw an unexpected twist into the debate. While the budget debate is the headliner for the 2013 session, it’s not the only game in town. Policy debates will pepper the legislative landscape throughout the session. Here’s a look at key matters likely to cross BATC’s radar in the session.

Fire Sprinkler Mandate BATC has opposed mandatory fire sprinklers during the past two sessions and continues to do so again in 2013. Currently the Minnesota Department of Labor

24

BUILDERS’ DIGEST

JANUARY/MARCH 2013

and Industry (DLI) is in the process of updating the Minnesota State Building Code. The legislature, or DLI through the code promulgation process, must determine whether or not the code will include mandatory fire sprinkler mandates. The code process and legislative work create timing and process challenges that we will have to address throughout 2013 in search of a favorable outcome on this issue. This is the number one priority for BATC in 2013.

Land Use BATC has been a leader from the business community on land use policy issues for over a decade. A likely item to emerge in the 2013 session is a discussion about park fees required in new developments. Currently, MN law states that park fees must be established based on the average fair market value of unplatted land. This has created challenges as the value of land has dropped dramatically, but the fees have remained at pre-downturn rates. This is an unfair and expensive requirement on homeowners in new development projects. BATC believes that fair market value should be defined as the value negotiated between the municipality and the applicant, or the market value of the property as determined by independent appraisals. Finding agreement with local government groups will be a challenge, but there is acknowledgement on all sides that the current system is unfair and needs repair.

Transportation Since the gas tax increase in 2008 it’s been relatively quiet on the transportation funding front. That is likely to change in

2013, which could mean that traffic impact fees on new development will again make some noise. In past years, several versions of the idea have been floated at the Capitol, all of them attempting to give local governments the authority to charge a per lot fee on new developments to off-set traffic improvement costs. BATC has resisted these attempts as proponents have refused to agree to a policy which would require transparency and proof of a connection between the fee and need created by the development. In the past there was enough agreement with our position that the bills never made it into law. Will we find enough agreement with our position in 2013?

Consumer Protection Over the years BATC has spent significant time in policy discussions regarding homeowner protection through the statutory home warranty law. Lengthening the warranty and discovery periods, as well as requirements for builders to pay attorney fees in legal disputes have been the top items debated. These discussions could be resumed with a DFL majority.

Wild Card With any major change in political leadership there is an element of the unknown. That is certainly the case in 2013 with the sea change of partisan leadership and influx of new legislators. BATC stands at the ready to respond to issues that we haven’t anticipated. Stay tuned to our weekly email, The Voice, for legislative updates.

BATC HONORS LEGISLATORS AND ADVOCATE OF THE YEAR BATC was pleased to honor four Minnesota legislators as Legislators of the Year at the October Gala. Recognizing these legislators is an important step as we continue to strengthen our public policy efforts and add greater clout to our industry. It was powerful to see three of the four in attendance at the event to personally receive recognition and provide remarks to the 300 attendees.

building code. Twice the bill passed the Minnesota House and Senate with overwhelming bi-partisan support only to be vetoed by Governor Dayton. Representative Peppin is a true champion of the housing industry.

Senator Warren Limmer (R-Maple Grove)

Representative Michael Beard (R-Shakopee)

Representative Joyce Peppin (R-Rogers) Representative Peppin was instrumental in helping BATC successfully move its Variance bill through the legislature. That bill, prompted by a Minnesota Supreme Court decision (called the Krummenacher case), was necessary to restore the capacity for cities to issue variances. In addition to the Variance bill, Representative Peppin carried the industry’s Fire Sprinkler bill, which attempted to prevent the Department of Labor and Industry from including a sprinkler mandate in the

26

BUILDERS’ DIGEST

Senjem worked diligently with his caucus and in end of session negotiations for our cause, but ultimately could not hold the preemption as broader issues overtook Fire Sprinklers.

Representative Beard believes strongly in private property rights and entrepreneurship. That belief led him to carry BATC’s Moratoria, Park Fee and Land Use bill, which he masterfully shepherded through the Minnesota House (the bill died in the Senate, short by only four votes last session). Our opponents, led by the Land Stewardship Project, were relentless in contacting Beard, but he stood firm on the issue and carried the ball deeper into opposition territory than has been achieved before. We are so fortunate to have advocates such as Representative Beard, he clearly deserved our Legislator of the Year award.

JANUARY/MARCH 2013

One of the most senior and respected members of the body, Senator Limmer has long been an aggressive advocate for development rights and residential construction. A licensed real estate broker, Limmer has an acute understanding of the challenges builders and remodelers face. He has authored multiple bills and amendments on behalf of the industry, including fire sprinkler legislation.

Bill Burgess The inaugural BATC Advocate of the Year was awarded Bill Burgess, Division President of Lennar Minnesota. Bill serves on the Housing First Committee where he is an active fundraiser. Even more significantly, Bill has a remarkable vision for the growth of BATC’s policy and political efforts. He helped the lead the effort to restructure BATC’s dues formula, to protect the Parade of Homes and grow BATC’s advocacy efforts.

Senator David Senjem (R-Rochester) BATC met with Senator Senjem early in the 2012 Legislative Session, and he committed to doing everything in his power to prevent a sprinkler mandate.

OUR GUY AT THE CAPITOL Meet Peter Coyle Shareholder and formerly the president of Larkin Hoffman Daly & Lindgren Ltd Written by Wendy Danks Peter Coyle has been representing BATC’s interests at the state Capitol for more than a decade. We found out pretty quickly that Pete has the experience, expertise and definitely the chops to do the finest job possible for us. Selected as one of Minnesota’s Super Lawyers® every year since 2005, Pete is the region’s top attorney on land use and regulatory issues. Besides a keen knowledge of our industry’s issues, Pete understands the machinations of state government, and is well-known and respected by officials and legislators on both sides of the aisle. "Government decision-making can be a confusing and frustrating process,” Pete says. “When you remove the mystery, you can solve clients’ problems." And so he does. Here are three of Pete’s major successes for BATC: Variance Issue – The shutdown of variances in 2010 was one of the larger policy issues for builders and remodelers in the past few decades, coming at a time when the industry was in its deepest valley of the market contraction. BATC, with Pete at the helm, led the charge at the Capitol to overturn the Krummenacher decision and 28

get our members back to work, navigating a complex web of business and government interests to find a sensible solution that allows variance consideration for property owners in unique circumstances. Attorney Fees – In 2009 the home building industry found itself faced with the sobering possibility that a builder would have to pay a homeowner’s attorney fees and costs in all home warranty disputes where the homeowner prevailed. In a moment of industry crisis, Pete was instrumental in leading the effort to convince Governor Pawlenty to veto the legislation. Park Fees – Park fees are expensive, yet they serve an important purpose. Homeowners value open space, trails and access to parks, it’s part of the good life in Minnesota. Pete has helped BATC successfully pass several bills over the past ten years that bring greater balance and fairness to park fee costs, principally that every municipality must have a park plan in

JANUARY/MARCH 2013

place prior to charging a fee, keep the fees in a segregated account and double-dipping of park fees is prohibited. Our work isn’t complete, but BATC, with Pete’s help, has ensured that the rules for collecting and spending park fees are fair and that they benefit our customers. When he’s not lobbying, lawyering, or taking care of BATC’s business, Pete is usually spending time with his family. Pete’s wife, Sandy, keeps the home fires burning when she’s not at her part-time Pier One job. And their aging Westie, Max, snoozes most of the day away. They have three kids, all pretty much out of the nest, and not an attorney in the bunch. Their first son, Chris, is 25 and in sales for a Red Wingbased firm. Daniel is in the middle at 22 and a mechanical engineering senior at the University of Minnesota. Their youngest, daughter Maureen, is 20 and studying fashion design (look out Stella McCartney). As far as down time, Pete enjoys a few thrills. He likes to

ski when he can get to the mountains, and is planning to add Lake Tahoe to his downhill experiences this year. His boat on Lake Pepin lets him keep up his ski-skills on the water during the summer, too. And he does enjoy facing off against the mighty Minnesota Walleye. But Pete also knows how to relax. He and Sandy enjoy their backyard pond complete with a coterie of gold fish. He definitely likes to catch a good movie (he recently saw Argo and says it was really good). He also likes a good book, especially when he gets to just “lollygag on the boat, reading and drifting.” His literary tastes range from crime mystery novels to biographies, and, who would have guessed, political histories. We expect to keep Pete busy in 2013 with plenty of issues at the legislature. Lucky for us, Pete is our guy at the Capitol.

FORWARD THINKING Meet Chris Contreras BATC Treasurer and Vice President of Sales & Marketing for Ryland Homes. Written by Katy Ervin The housing market had just begun to slip when Chris Contreras moved to Minneapolis in 2006. He started his role as Ryland Homes’ Vice President of Sales and Marketing Manager with an optimistic attitude but, “I spent three years waiting for the bottom to drop out, and it didn’t.” The downcast market was not enough to derail our 2013 Board of Directors Treasurer then, or ever. What you need to know about Chris is that he is smart, driven and focused. “I like to formulate a plan and then execute that plan,” he explains. Chris is not just motivated by a smart business proposition or project, but by the outcome and future success that a plan can possess. Being able to adequately tweak, adjust and perfect a plan can take a project to a whole other level. “It’s interesting to watch how events unfold,” he explains, “The assumptions we make are not 100 percent accurate, but there is always an adjustment we can make that will help make us all winners. I am motivated to make the people around me successful and I am blessed to have the most 30

talented sales team in the Twin Cities (but of course I think that).” This kind of thinking has allowed Chris to reach new heights in his personal life as well. His can-do attitude means that a New Years Resolution isn’t necessary. “New Years is not a monumental moment for me,” Chris jokes. “Any changes that need to be made in my life happen as they come. If I waited for New Years to change, nothing would ever get done.” There is one change that has yet to take place, however. Three years ago, when

JANUARY/MARCH 2013

Chris and his wife Kelly were approached by their son, Zachary (then 8 years old), about getting a dog, Chris pushed off the conversation saying “Come see me when you’re 12.” Today, Zachary (11 years) and Jordon (8) have been constant reminders of this conversation and are hoping to finally add a dog to their family by next year. “I have been trying to get out of this for the past three years. This summer I even offered a pool in the back yard, but was rejected!” I guess, for now, their family cat will have to suffice.

Regardless of the outcome of the Contreras family dog debate, we know that the leadership Chris exemplifies will lead to a winning solution. We’ve seen this over and over again in the way that Chris has navigated a challenging housing market with ease and determination. “The last few years have been tough on everyone in our industry. My goal has always been to make sure that my team continues to be the most successful sales people in the Twin Cities.” Chris has done just that.

Build in the best energy value by building with natural gas. When you look at all of the energy choices, natural gas still stands alone as the best value. Natural gas is a long-term choice, with plentiful supply and positive forecasts. Plus, compared to fuel oil or propane, 95 percent of natural gas is from North America, which reduces our reliance on overseas imports. Natural gas. It’s an advantage you can build on. BECOME A SPIKE?

Join our elite Spikes, contact Deb Earl, 651-6977562, deb@batc.org for more information.

What are the benefits of becoming a Spike? • Increased visibility, recognition and networking opportunities at industry events • Unique and valuable lapel pins for each level of achievement (unfortunately the NAHB stopped rewarding Spikes with sports coats, Al Tewinkel looks pretty darned good in his purple one - at right) • Additional VIP treatment throughout the year

|| FOUNDATION

ALL WRAPPED UP, BUT NOT FORGOTTEN Even as our charitable arm, The BATC Foundation, wraps up another year of projects and programs, the amazing transformations that took place in 2012 will not fade quickly from our memories. In 2012, The BATC Foundation experienced a powerful spirit of hope as they saw three major projects come to fruition, and countless lives impacted through the donors, volunteers and builder partners who gave their time and talents in 2012. It was a year of gifts and life changing renovations that won’t be forgotten. A safe home was given to a true American hero, war veteran Noah Gordon. The BATC Foundation, and builder partner Soderbeck Design and Construction, Inc., remedied several water intrusion problems to successfully welcome Noah Gordon home to a safe and structurally sound house in November. Similarly, safety issues were addressed in the home of a young Minneapolis woman who pur-

chased a home that had been cosmetically covered up by house flippers. Today, she rests easy in a beautiful home that is free from hazardous chemicals. Our partnership with Project for Pride in Living helped give her a safe home, packaged perfectly from the inside out. One of our most memorable events in 2012 was at the celebration open house for Jack Jablonski. The BATC Foundation and builder partners Awad & Koontz Architects Builders and Kuhl Design & Build were humbled to add wheelchair accessible features to the home of this incredibly courageous and positive young man who suffered a serious spinal injury during a high school hockey tournament. But the renovations that we were able to give to the Jablonski family was nothing compared to the hope that they gave to us! We were so inspired by the perseverance and strength that Jack has demonstrated throughout his recovery journey and were encouraged to bel13ve in miracles.

FOUNDATION PROFILE

Sara Anderson– A Bundle of Balanced Energy Written by Katie Harms, BATC Foundation Vice Chair

The BATC Foundation has had the distinct pleasure of having the energizer bunny, aka Sara Anderson, involved in our organization for the past four years, the last two as our chair. And while her term leading our Foundation comes to an end this year, her involvement will not stop — thank the good Lord! Sara knows exactly what her purpose in life is — to give back to others. She believes in putting faith and her family, (husband Ross and sons Austin, 4 and Cameron, 6), first and she also takes great pride in her career. Much like the legs of a stool, balance is critical for Sara. She believes that she

must cultivate all areas of her life to receive the natural boost that comes from living in balance. Sara is a sales professional for Dennison Technologies and offices from home, which lets her do things like getting her son on the bus each morning. She is extremely focused and uses her time wisely, knowing that once she walks into her home office, she is “at work.” Her focus and flexibility gives her more time to do the work of the Foundation. How did the Foundation get so lucky? Sara’s involvement started at a time when the industry was suffering. Sara said it was heartwarm-

NEWS EVERYDAY ON THE BLOG: WWW.BATC.ORG/BLOG

ing to focus on the good that was being done by the Foundation within an industry that was struggling. It allowed for much personal growth and eventually she saw a difference in how she approached business. Sara believes that perspective is the key and the fact that she is able to find the silver lining in the darkest clouds is one more thing that makes her one very special person. Sara brought a passion to the Foundation as chair. The laughter has been plentiful and the memories wonderful. Sara’s greatest joy in working with the Foundation has been the ability to be around the families

whose lives we have impacted. “Getting to know the Vang family and their incredible work ethic was amazing,” she said. One has to wonder where Sara finds the energy to accomplish so much. In true comedic form, she tells me that her husband Ross is always looking for her batteries, but up to this point has not found them. If he did, I believe they would have to be Eveready. You know - the ones that power the energizer bunny?! It’s only fitting. Read the full story about Sara online at the BATC blog (www.BATC.org, click on blog and look for the Sara Anderson story).

GET SMART ABOUT YOUR INSURANCE RISK COMPLIANCE FOURSTAR, from Corporate Four, BATC/BAM Endorsed Insurance Agents Written by Mike Hoppe and Larry Larson, Corporate Four and FOURSTAR Risk Compliance Solution If you’ve been in the construction industry for any time at all, you know that insurance carriers come and go, and construction defect claims can be as harsh as our winter temperatures. Right now, we are trending toward a cycle in the insurance industry known as a “hard market,” where premiums are generally increasing, the number of insurance companies willing to insure general contractors is decreasing, and underwriting standards are strict. Currently, insurance carriers view Minnesota as a very

challenging state, relative to residential general contractors. Key factors that influence this perception are the MN legal climate, namely pro-consumer oriented laws; burdensome regulations; and increased loss history combined with declining production. Some insurance companies view MN right behind CA in this looming insurance crisis, and that is not good. We need to change this negative perception. The above key factors won’t change overnight, but there is opportunity for contractors to improve their

standing. We are excited to partner with BATC locally and BAM at large to launch the FOURSTAR program. As an association member, you will learn how the FOURSTAR contractor risk compliance solution, can protect your hardearned reputation as a MN builder. The FOURSTAR program emphasizes the framework to better protect your business. S.T.A.R. is an acronym for: S - Shifting appropriate risk; T - Transferring risk through insur-

R - Reducing high severity risks.

While these basic principles of Risk Management are simple, the benefit is only realized when these principles are consistently and accurately implemented. The FOURSTAR categories are more involved. We will expand on them in future Builders’ Digests and at BATC-U. Join us for the CE course titled “How to Avoid the Looming Insurance Crisis.”

For those striving to attain higher and more holistic green certification further down the path, the Advanced and Master Certifications allow for that option as well. Every project on the path from Tested through Master Certified receives a Home Performance Report (HPR). The HPR highlights the project’s performance results and green features. It also ensures MN Green Path’s original objective of radical transparency. It’s not necessary, to be

After a solid first year in business MN Green Path continues to evolve and position itself to meet our region’s demand for energy efficient and green certification. With well over 100 entries into the program and 60 certifications granted already, we’ve learned a lot about homeowners, builders, suppliers and raters’ experiences with Green Path. Some of the major themes in their feedback include: • MN Homebuilders build an incredibly efficient product. Nearly all MN Green Path projects have met the Green Path HERS Index minimum, which is at least 30% more efficient than the national standard for new homes. • Verification and testing must continue to be integrated into the rating process to ensure timely certifications • Homeowners are interested in green building, but are much more interested in energy efficiency and its payback. Taking this feedback and coupling it with the anticipated requirements forthcoming in the new energy code, MN Green Path is adjusting its path to allow for maximum participation among BATC builders and remodelers. Starting in 2013, the Green Path continuum will begin with energy tested homes. This first step is manageable for

WINNERS

2012 BATC AWARD WINNERS BATC’s 2012 Award of Excellence Gala was held at the Marriott Southwest in Minnetonka on Saturday, October 13th. It was an excellent night, especially for the 14 Reggie and 16 Trillium winning companies. We also honored our new Builder of the Year (Gonyea Homes), Associate of the Year (Fireside Hearth and Home), Spike of the Year (Bob Michels, Bob Michels Construction), Advocate of the Year (Bill Burgess, Lennar) and four Minnesota legislators (read more about our Spike of the Year on page 46, and our Advocate and Legislator of the Year honorees on page 26).

2012 Builder of the Year: Gonyea Homes, Inc. Gonyea Homes, Inc. in Golden Valley was given high honors at the 2012 Awards of Excellence Gala after receiving the coveted title of 2012 Builder of the Year. This award recognizes a deserving company that has achieved the highest level of professionalism in the areas of trust, communications, loyalty and ethics throughout the entire year, and beyond. Gonyea managing partner Tony Sonnen says they anticipate substantial growth in 2013. “We’ve already sold twice as many homes this year than in 2011 and we’re anticipating more growth in 2013,” he said, adding that they doubled their staff this year. “This is a business where it’s easy to cut corners. This award means a lot because it recognizes we produce a high-value product that will stand the test of time.”

Robert L. Hanson Industry Service Award Daryl Doehr, Marvin Windows and Doors, received the Robert L. Hanson Industry Service Award in 2012 for his outstanding service to BATC, including continual contribution to our industry and support of BATC’s mission: Helping our members build their businesses – through marketing, advocacy and industry connections. BATC is pleased to welcome Daryl to the Executive Board as Secretary in 2013. He will be a great addition to our leadership team.

2012 Associate of the Year – Fireside Hearth & Home Our 2012 Associate of the Year, Fireside Hearth & Home, manufactures all of their products in the United States, and nearly all of their products are made directly in Minnesota. They have a longstanding commitment to “quality, function and reliability,” and a strong loyalty to the Twin Cities market. The Associate of the Year Award is given to the company that exemplifies the highest standards in business conduct as voted by a panel of 20 BATC members with which they’ve done business.
