Housing’s Legislative Priority Signed Into Law Gov. Walz signed the State Government Finance Omnibus Bill that included language to create a new Legislative Commission on Housing Affordability. This multiyear commission ushers in a new era in housing policy as it is charged with analyzing issues relating to housing affordability and will ultimately recommend housing policies that balance safety, durability, and affordability. As our industry is well-aware, the layers of regulation and fees associated with building, developing, and remodeling homes are incredibly complex and costly for homeowners. The Commission on Housing Affordability provides the opportunity to fundamentally reimagine housing by looking at alternatives and efficiency opportunities with development rules, fees, code requirements, inspections, and more.
With this, each of the four caucuses will be appointing two representatives to serve on the commission until January 2021. Speaker Hortman designated one member of the commission to convene the first meeting and a member of the House of Representatives will serve as the first chair of the commission with a member of the Senate serving as the chair beginning in January 2021. The commission is set to expire June 30, 2023. Your Housing First Minnesota advocacy team is looking forward to working with the new commission to advance our goal of building safe, energy-efficient, durable homes at a price Minnesotans can afford.

The duties of the commission are as follows:

Define housing affordability and study issues relating to housing affordability and the construction, preservation, and rehabilitation of owner-occupied and rental housing, including subsidized housing, existing and future government regulations impacting housing affordability, market forces impacting housing affordability, and access to homeownership. Review and provide the legislature with research and analysis of emerging issues affecting housing affordability and homeownership access, including but not limited to construction workforce, innovation, building practices, and building material costs.

Review and provide the legislature with research and analysis of policies to reduce the homeownership equity gap.

The Minnesota Senate addressed the state’s growing housing affordability crisis with the creation of the Select Committee on Homeownership Affordability and Availability
What Else Happened at the Capitol? Senate Select Committee on Homeownership Affordability and Availability:
The Senate took the lead on housing affordability by creating the Select Committee on Homeownership Affordability and Availability. The committee is made up of five senators who will review and study issues relating to homeownership and housing affordability and availability and then report recommendations to the Senate.
Greater Transparency for Building Permits:
SF 998 was signed into law by Gov. Walz after broad bipartisan support. Under the new statute parties seeking “a permit, license, or other approval relating to real estate development or construction” have the authority to request a written, nonbinding estimate of the consulting fees to be charged as part of the permit application.

New Contractor Continuing Education Curriculum: New legislation requires one hour of business management strategies training as a part of 14 credit hours required for Minnesota contractors within their two-year licensing period. This is similar to the currently required energy hour. BATC-Housing First Minnesota’s education and special programs manager, Tom Gavaras, testified in support of the new requirements.
Contractor Recovery Fund Consumer Awareness Campaign:
Under this new provision, the Commissioner of Labor and Industry will conduct a statewide consumer awareness campaign in fiscal years 2020 and 2021 highlighting the importance of hiring licensed contractors as well as the consequences of hiring unlicensed contractors. This will be funded with dollars from the contractor recovery fund, up to $500,000 per year.
Retainage:
Under the provision, public and private entities are required to pay out all retainage within 60 days of substantial completion. After substantial completion, the provision would allow for withholding of up to 250% of the value for incomplete or defective work.
Wage Theft:
Under this provision, wage theft in excess of $1,000 is a felony crime. It also penalizes retaliation against employees who report wage theft. The Department of Labor and Industry and the attorney general are tasked with enforcement.
License Number to be Displayed:
Any vehicle used by a plumbing contractor while performing plumbing work shall have the contractor’s name and license number in contrasting color affixed to each side of the vehicle.

Greater Compliance Needed in City Reporting While working on Priced Out, the research team noticed several local governments failed to submit annual reports on construction and development related revenue and expenses. The annual report, required under Minnesota law, provides a look into permit revenue and expenditures. Following the initial conversations between BATC-Housing First Minnesota leadership and the Department of Labor and Industry, the Housing Affordability Institute called for increased compliance on behalf of local governments.

Few local governments are filing required disclosures of permit and development finances: While the exact number of the 539 municipailities meeting the $5,000 filing requirement is not known, given the cost of permit fees and publically available permit figures, several highgrowth municipalities have not reported revenue or expenses in 2015-2017.

Priced Out Continues to Spark Conversations BATC-Housing First Minnesota's executive director, David Siegel, director of advocacy, James Vagle, and regulatory affairs manager, Nick Erickson, shared Priced Out with the leadership team of the Federal Reserve Bank of Minneapolis in early April. Vagle and Erickson also presented the research to a Scott County housing organization.

Building Codes The Minnesota Department of Labor and Industry is expected to begin releasing preliminary new building codes this summer, opening up the public comment period. A decision on adopting a new residential energy code has not yet been made. Any new codes adopted are likely to go into effect on March 31, 2020.

Technical advisory groups review proposed changes
In May, the Minnesota Department of Health (MDH) released its first draft of its proposed lead paint rule. The May 2019 version included many of the changes requested by BATC-Housing First Minnesota from 2017 when the MDH released three separate drafts. In June, BATC-Housing First Minnesota sent MDH a letter outlining further requested changes. A new version is expected later this year, with the rule potentially taking effect in early 2020.
Construction and Demolition The Minnesota Pollution Control Agency (MPCA) is moving forward with its construction and demolition waste efforts by forming groups to look at its rulemaking and waste reduction efforts.

Dayton To Remove Development Moratorium The city of Dayton is moving to end its one-year development moratorium early and will shift to using 429 assessments to fund city streets. When the moratorium went into effect last September, Housing First Minnesota asked the city to drop the moratorium as there are many other legal ways to pay for street improvements, including the 429 process that is widely used by cities across the state. Dayton was the only city to enact a development moratorium in the wake of the unanimous decision the Minnesota Supreme Court in the Harstad v. Woodbury case last summer.
Street Fee Outreach In April, political engagement manager, Mark Foster, and regulatory affairs manager, Nick Erickson, met with representatives of Scott County local governments about their push to legalize street impact fees. Attendees of the meeting included the League of Minnesota Cities, Prior Lake, Elko New Market, Spring Lake Township, and local legislators. Additional meetings on this topic will continue as local governments seek to legalize the street fees banned under the Harstad v. Woodbury and Country Joe v. Eagan decisions.
U.S. Supreme Court Issues Victory for Property Owners Written by Larkin Hoffman
The United States Supreme Court overruled a 30-year-old precedent that had barred property owners from federal court on claims that state or local governments had taken their property without paying for it, in violation of the Fifth Amendment to the United States Constitution. In a 5-4 decision written by Chief Justice John Roberts in the case of Knick v. Township of Scott, the Court overruled the 1985 decision known as Williamson County that required landowners to exhaust their remedies in state court before filing a takings claim under the Fifth Amendment in federal court. The Knick majority recognized that Williamson County created a Catch-22 for a landowner stating, “He cannot go to federal court without going to state court first; but if he goes to state court and loses; his claim will be barred in federal court. The federal claim dies aborning.”
The decision by the Court means that landowners alleging a taking of their property without the payment of
compensation in violation of the Fifth Amendment now have a choice.
They may either pursue state court
remedies, which often means filing suit in
the local state court, or they may seek relief in federal court before a federal judge, without first resorting to state court. The decision may also have broader
significance as it serves as another recent instance where the conservative majority has declined to apply the doctrine known
as stare decisis, which requires the Court to follow its prior rulings in deciding new cases.

Multifamily construction continues to boost residential homebuilding activity, while single-family construction activity continues to fall flat. Several permits pulled for large projects in Minneapolis and Minnetonka pushed the number of multifamily units up to 1,306 for the month of May, a significant increase over this month last year. With 637 permitted units in May, single-family construction is down 3% compared to May of last year. That’s four consecutive months of downward trending permit numbers in single-family construction.

After submitting an application for a building permit for a new house, how long should we expect to wait for the building permit to be issued?

The Minnesota code does not address a timeline for permits and every municipality needs to consider what is a reasonable time period in their area. Most municipalities probably have timelines that they try to meet in order to properly serve the public and builders in their area, and this is often the basis for staffing levels in the department. Other issues can slow down the permit process, such as engineering criteria (elevations, grade slope, etc.), zoning issues (location on lot, development agreements, etc.), and poorly drawn house plans (lack of information, incorrect details, etc.).

Are there any special requirements for the attachment of overhead garage doors for new houses?
Q
Yes. Although there seems to be a lot of discussion in Minnesota about special provisions in the code for the fastening of overhead garage doors related to high winds, it appears that some of this information is not based on facts. There is some language in the code for high-wind areas where special provisions will apply, but in Minnesota (and our neighboring states) the code only requires that overhead garage doors are installed and fastened meeting the requirements in DASMA 108 (Door & Access Systems Manufacturers Association International) for 90 mile per hour wind load. In addition, the door installer is to affix a DASMA label to the completed door verifying compliance with DASMA 108.

Tips for selecting event venues There are so many events that come up in people’s lives, and finding the right location seems simple enough, but is it really? Events can range from an intimate cocktail reception to a full-on fundraising gala for hundreds of people. So, what should you be thinking about when you’re sourcing a venue? Here are some considerations to keep in mind. BUDGET
L O C AT I O N
The budget will drive every decision made down the road — know this number and commit to it.
Location is key both in real estate and for events. Consider the atmosphere of the venue: Does it align with the vision? Many unique spaces may already have that ambiance. Restaurants are sometimes overlooked and could be a great option. Hotels provide a great blank slate but could cost more with décor to create the desired aesthetic.
Many venues will require a room rental fee to contract the space. Venues with catering services also will require a food and beverage (F&B) minimum which does not customarily include plus plus (++), which is the tax and service charge added on top of the menu price. For example, the F&B minimum may be $3,000 but out-of-pocket expense could be closer to $4,442 when adding 7.375% tax (or more depending on the city/county) 2.5% alcohol tax, and 18% service charge.
Don’t forget about parking/transit: Are guests paying for parking or is it hosted? How close is parking to the event space?
EVENT SCHEDULE & F O R M AT The purpose of the event will determine the schedule. Networking can be done at any time, socials work well as afternoon and evening activities, and educational programing works best as a breakfast, lunch, or dinner. F&B is usually less per person for breakfast when compared to dinner. Room set is also dependent on the format. Will the focus be on a presenter, will it be a more interactive experience, or a mix of both?

If considering a specific month be mindful of peak seasons and holidays which impact availability and pricing: October and June (weddings), April (fundraising galas), spring/fall (trade shows), summer (resorts).
Access to the room: Account for the time to load in and load out — especially if utilizing third-party vendors.
Thoughtfully selecting a day of the week provides an opportunity for savings. Business events work well on weekdays, and you can expect higher rental fees and F&B minimums on Fridays and Saturdays.
Acoustics: A venue might be everything you want visually, but if the acoustics fall short, you’ll hear about it (no pun intended).
C A PAC I T Y Allow guests enough room to navigate comfortably. Many venues will list event space capacity as well as square footage on their floor plans and capacity charts. Venues usually calculate the capacity to allow as many guests as possible — which can lead to guests being packed in like sardines. Their calculations don’t typically account for space needed for a stage/podium, lectern, AV, live music, décor, food stations, etc. Allow the following square feet per person: reception 10 sq. ft., theater style 12-13 sq. ft., banquet 13.5 sq. ft. Plus, don’t forget about ceiling height if utilizing a screen and projector.

Convention & Visitors Bureau (CVB): their job is to bring business to their local hospitality and tourism industry. You don’t have to be out of town to use their service. (Meet Minneapolis, Visit Saint Paul, Minneapolis Northwest Tourism, Bloomington Convention & Visitors Bureau, Explore Minnesota, etc.)

Accessibility: Consider accessibility needs for your guests.
Cancellation: Make sure to understand this clause — who can cancel, when, and for what penalty. Guest Rooms: Use a hotel or consider guest transit when selecting the venue. Insurance: What insurance does the venue require you to provide (additional insured, etc.)? Third-Party Vendors: Some venues require use of in-house catering and AV. Check to see if you can bring in an outside vendor and, if so, if there is a fee paid to the venue for that opportunity. Some venues may already have a preferred vendor list. Wi-Fi: Is it needed? Is it included? Is it secure? Be sure to include this in the budget. Other Fees: Other fees can pop up including corkage fees, attrition on guest rooms, bartender fees per event bar (negotiate waiving the bartender fee if a minimum (ex $500) is met in bar sales), etc.

Our Spring Parade of Homes and Remodelers Showcase wrapped up this March with 472 new homes and 59 remodeled homes on display. Hundreds of builders and remodelers participate in the tours every year to connect with consumers and showcase their best work. Starting this fall, we’ve introduced a new look to the home listings: a redesigned layout with an emphasis on images and a quick look at the specs for new homes and a half-page layout with additional images and space for project details for remodeled homes.

Sixth Annual Artisan Home Tour Comes to a Close In its sixth year, the Artisan Home Tour continued to bring qualified buyers to homes crafted by BATC-Housing First Minnesota builders and remodelers. This year’s tour was a hit, with 50,000 total combined visits over the three weekends. Thank you to all the builders, remodelers, suppliers, and sponsors who made this year’s Artisan Home Tour such a success. And thank you to all our members who toured the 32 incredible homes. A portion of the proceeds from the tour helps to support the work of the BATC-Housing First Minnesota Foundation.

RENEWED HOUSING INSTILLS HOPE
The Avivo apartment complex is home to women and their children who participate in Avivo’s family treatment program. Housing is critical for mothers to focus on recovery, go back to school, and find employment.
When you are in recovery from an addiction, having a home that provides a sense of stability, consistency, and organization can provide great benefits to your overall wellbeing. Just ask Theresa Brown, a former resident of the Avivo apartment complex that was renovated thanks to the BATCHousing First Minnesota Foundation/ HomeAid Twin Cities and build partners The Kingdom Builders, Crystal Kitchen Center, and Soderberg Apartment Specialists.
“When you suffer from an addiction, you always keep repeating yourself — making the same mistakes over and over again,” says Brown. “That’s why experiencing the remodeling of the apartment I lived in showed that change is possible, and this is a huge concept for a recovering addict to accept. You have to work for it, but change can happen. The feeling of newness that the renovation provided was wonderful.”

Avivo is one of the largest behavioral health and workforce development nonprofits in Minnesota and has been around since 1960. An important part of Avivo’s family treatment programs is the housing the organization provides so mothers and their children can focus on recovery. Approximately 96% of the 15,000 individuals Avivo serves each year live in poverty or extreme poverty. They may struggle with addiction or mental illness, experience homelessness, or cannot find work that pays living wages. About 68% of individuals the organization serves are women.

“One of the many things that makes Avivo unique is our substance abuse treatment program that serves pregnant and parenting mothers,” says Kelly Matter, president and CEO of Avivo. “We are one of the only providers in the state where mothers may enter treatment with their children, ages infant to 17.” That’s why the quality of the housing provided to these women and children is vital. So in 2018, the BATC-Housing First Minnesota Foundation and three build partners completely renovated all of the units in Avivo’s eight-plex apartment building that is family recovery housing. Specifically, the remodeled apartment building is home to 40 women and their families each year. As Brown explains, the apartments were in bad shape. “The appliances functioned and were clean but were really old and the bathroom fixtures were not the best,” Brown says. “The entire apartment badly needed to be renovated.” Avivo simply couldn’t afford to do the renovation of the complex so that’s where the Foundation stepped in. The building and remodeling team stripped all eight apartments down to the studs and plywood flooring and then completely remodeled the units, which included installing new bathroom and kitchen fixtures, cabinets, plumbing, walls, trim, flooring, electrical fixtures, and appliances. Brown agrees that living in clean, updated, and freshly painted apartments instills hope, and a sense that the women can take the next steps to living lives of recovery.

“Living in a nice space makes it so much easier to maintain and focus on recovery,” says Brown, who has since moved out of Avivo’s housing and is continuing in the next phase of recovery. The women in Avivo’s outpatient treatment program stay in the transitional recovery housing for nine months to over a year. “For Avivo, we are grateful that we have an asset that reflects the quality of our mission and we can fulfill our mission better with up-to-date facilities that don’t require constant attention and expense,” Matter says. The builders, remodelers, and trade partners that helped make this housing a reality are proud to see how this work impacts real lives. “Hearing some of the stories of the people that have come through the program and
how this housing has blessed them, it puts a smile back on my face,” says Lee Juvland, owner of The Kingdom Builders. Brown shared her journey of living a sober life and establishing a stronger relationship with her daughter at the Foundation’s 2019 Hearts in Housing Gala. Her story resonated with many in the room, and over 400 attendees raised to their feet, roared with support, and thanked Brown with a standing ovation at the event. “We believe everyone deserves the chance to live well and work well,” Matter says. “The remodeled apartments are amazing. The women who live here, many for the first time, experience that they deserve a nice place to live. This gives them a feeling of self-worth, which is really important to the recovery process.”

HOME FOR HEROES We are excited to start construction on another Home for Heroes project. After months of planning, designing, and revisions to a 58-page development agreement, we are nearing a groundbreaking ceremony for a transitional housing residence for veterans in Bloomington. We could not have secured a better partner, the Bloomington HRA, for this project as the home will reside close to public transportation on a beautiful lot in Bloomington. Once constructed, this Home for Heroes project will provide temporary comfort and serve the needs of veterans experiencing homelessness. The BATC-Housing First Minnesota Foundation is committed to ending homelessness in our area. We do so by partnering with local service organizations and utilizing the expertise of our builders to construct or renovate shelter spaces for those experiencing homelessness.
The Foundation’s leadership has worked diligently with Lennar and MACV to open the doors of transitional housing in the city of Bloomington. This project was well received by officials.

We are very fortunate to have the support from the Bloomington HRA, and our many partners, builders, trade partners, and supporters who help to build new lives through housing in the Twin Cities area. Construction is planned to begin this fall — follow the progress of this Home for Heroes build on social media and our blog.

CONGRATULATIONS :: US LBM ANNOUNCES NEW POSITIONS & PROMOTIONS US LBM Holdings, LLC, a leading distributor of specialty building materials in the United States, has announced that Tim Liester has been named executive vice president of operations & sales for the company. Tim had spent more than 20 years with the Minnesota-based Lyman Companies, a division of US LBM, where he had been president since 2016. In this newly created role, Tim will be responsible for executing US LBM’s strategic initiatives and priorities to achieve continued and sustainable market growth. In addition, a number of Lyman Companies employees took on new roles within the organization. Congratulations on your promotions!

NICOLE COON SWORN IN AS MINNESOTA MPI PRESIDENT Congratulations to Nicole Coon, BATC-Housing First Minnesota’s meeting and event manager, who was recently sworn in as the 2019-2020 President for the Minnesota Chapter of Meeting Professionals International (MPI). MPI is the largest meeting and event industry association worldwide (serving more than 400 members in Minnesota and 17,000+ globally), and is dedicated to advancing awareness, professionalism, and excellence in the meetings industry through communication, education, and recognition.

JIM WARNER Our deepest condolences to the friends and family of James “Jim” Warner, founder of Warners’ Stellian, who passed away peacefully surrounded by his loving family on June 7 at age 90. Jim founded his company on hard work and family values, and he will be remembered as an icon in the industry and community. He will be missed by all who knew him.

ROBOTIC CEILINGS
There’s a company called Bumblebee Spaces that manufactures robotic ceilings. Your bed comes down from the ceiling on your command. Your closet comes down when it’s time to get dressed. When you want to watch TV, your couch comes down. “Using smart robots and an AI stack, we increase usable space and reduce your footprint by storing, managing, and retrieving objects on-demand in your ceiling,” says their website. The broader picture for our industry is that robotics and artificial intelligence will be vital parts of homes of the future.

SELLING GREEN HOMES
Surveys show buyers are increasingly likely to choose green products, and nearly half say they are willing to pay more for them. A 2017 Dodge Data & Analytics report found that single-family builders are increasingly determined to build a larger percentage of green homes, and 71% of them believe that their buyers are willing to pay for them. Yet builders report having difficulty selling green homes. Why the disconnect? Shelton Group research indicates buyers are primarily concerned with what green homes can provide for them and their families (i.e. a healthy place to live), while builders are focused on the actual mechanics such as materials, insulation, and construction techniques. Builders need to tailor sales messages to how green homes provide quality and health to buyers.

VOICE SEARCH OPTIMIZATION
By 2020, more than half of all internet searches will be made without the use of screens. That means consumers will get answers while conversing with smart speaker devices, their cars, TV remotes, and more. It’s estimated by the end of this year, almost half of U.S. households will own a smart speaker, according to Amy Webb in Inc. magazine.

Scott Sedam, contributing editor to Professional Builder magazine and industry consultant, has found $5,000 to $10,000 worth of wasted materials in almost every house, due to broken processes, misordered items, lack of plan consistency, and poor communication with trades.

STRATEGY VS. EXECUTION
Most managers understand their company’s strategic plan and have an appropriately limited number of goals that are specific and measurable. Additionally, they feel they have the funds needed to achieve them. Fully 84% of managers say they can rely on their boss and direct reports all or most of the time. But alignment doesn’t equal execution. What are the major issues? It appears to be commitments across functions and business units. Only 9% of managers say they can rely on colleagues and other functions and units all the time, and just over half say they can rely on them most of the time, according to Harvard Business Review. The single biggest challenge is failure to coordinate between functions and units.
