Advocacy in Action
Regulatory Affairs Update
State regulators have had a busy summer, with rulemaking progressing across the industry, including development, new construction, and renovation.
NEW CONSTRUCTION STORMWATER PERMIT
The Minnesota Pollution Control Agency (MPCA) released a new construction
stormwater permit, effective Aug. 1. Many of the changes were minor edits made to improve readability or clarity. Some of the more substantial changes include stabilization requirements for soil berms used as sediment control; more frequent inspections including photographs during de-watering activities; photographs showing final stabilization now required for permit termination; a new definition of impervious surface which excludes recreational trails; and relaxed inspections for final stabilization when establishing wildlife-friendly vegetation.
All projects granted permit coverage before Aug. 1 may continue to operate under the previous permit for 18 months. If the project extends beyond 18 months, permittees must update their Stormwater Pollution Prevention Plan to reflect the new requirements.
ELECTRIC VEHICLE CHARGERS
Earlier this year, the State Legislature directed the Department of Labor and Industry (DLI) to create a building code standard for electric vehicle chargers for buildings with four or more housing units.

HERE ARE A FEW KEY UPDATES ON OUR WORK TO PROTECT HOUSING AND HOMEOWNERSHIP.
ADVOCACY IN ACTION
In August, the technical advisory group formed by DLI began holding meetings. The technical review is expected to last through September, and the recommendation of the panel will be forwarded to the Construction Codes Advisory Council.
RESIDENTIAL ENERGY CODE
A technical review of the residential energy code comes after an administrative law judge recommended the commissioner open rulemaking on the 2021 International Energy Conservation Code (IECC).
The technical review of the 2021 IECC will wrap shortly before the 2024 I-Codes undergo their technical reviews in advance of the 2026 code cycle. It is expected that DLI will then examine the changes in the 2024 IECC before moving on to the required durability analysis.
Due to affordability concerns, Minnesota has not adopted a new energy code since the 2012 energy code was implemented in 2014. According to RESNET, Minnesota has continued to be a leader in energy efficiency in higher-growth states even without adopting a new energy code.
LEAD RENOVATION, REPAIR AND PAINTING RULE
For more than seven years, the Minnesota Department of Health (MDH) has been working on taking local custody of the federal lead renovation, repair, and painting (RRP) rule from the Environmental Protection Association. After the State Legislature adjusted state statutes to align Minnesota State Law with the EPA requirements more closely.
The RRP rules govern the renovation of pre1978 homes where lead paint is present.
In August, MDH held a stakeholder meeting to outline recent changes to the proposal. This was the first public meeting on the rule in nearly two years.
Greg Olson, a code official with Olson Associates Consulting, has been an active participant in stakeholder meetings. Olson said there are multiple concerns from the industry over the approach taken by MDH.
“One would think it possible for the state to simply adopt the EPA’s RRP version instead of rewriting it,” said Olson.
If this specific proposal is implemented, Minnesota’s proposed RRP rule would be the one state in which the entire rule was rewritten instead of adopting the rule by reference, in whole or in part.
MDH aims to enter the final stages of rulemaking in October and have the rule implemented by April 2024.
DEMOLITION LANDFILL RULEMAKING
Due to water quality concerns, the MPCA has proposed a new rule regulating construction demolition landfills. The proposed rule says demolition landfills must be lined with leachate collection systems; be capped with an impermeable cover; have more stringent operating, location, and closure requirements; and require groundwater monitoring and financial assurance to facilitate proper closure and to mitigate potential future liabilities.
New Laws Take Effect
Over the summer, several new laws became effective in Minnesota. Here’s a quick rundown of those that impact the housing industry and associated businesses.
CONTRACTOR WAGE LIABILITY
Minnesota has enacted the Construction Worker Wage Protection Act, which establishes that a contractor entering into a construction contract assumes liability for unpaid wages, fringe benefits, and liquidated damages owed to a claimant by a subcontractor of any tier. The new law does not apply to work for which prevailing wage rates apply under statute sections 177.41 to 177.44. This law became effective Aug. 1.
NON-COMPETE AGREEMENTS
Effective July 1, new non-compete agreements between employers and employees, as well as independent contractors are banned. It does not affect already-existing non-compete agreements.
RECREATIONAL MARIJUANA
Under Minnesota’s new law legalizing recreational marijuana, individuals 21 years of age and older are allowed to possess

or transport in public up to 2 ounces of cannabis flower. Additionally, Minnesotans 21 and older can grow up to eight cannabis plants per residence. Consumption of cannabis products will remain prohibited in all areas not explicitly authorized by law. Many employers are working with their counsel to update their drug and alcohol testing policies.
PARENTAL LEAVE, PREGNANCY ACCOMMODATIONS, AND NURSING MOTHERS
The Minnesota Parental Leave Act (MPLA) now applies to all employers with one or more employees, and employees will be
eligible for up to 12 weeks of unpaid MPLA leave immediately upon hire. Additionally, changes for pregnant and nursing mothers now require all employers to provide accommodations to pregnant employees and time to express milk.
SICK AND SAFE TIME & PAID FAMILY LEAVE
Effective Jan. 1, 2024, Minnesota will require employers to provide paid sick and safe leave to employees who work in the state. An employee will accrue a minimum of one hour of sick and safe time for every 30 hours worked, up to a maximum of 48 hours per year.
Additionally, the new Paid Family and Medical Leave (PFML) program is in the process of being established with a rollout date of Jan. 1, 2026. All Minnesota employees will be eligible for PFML benefits if they meet the financial eligibility requirements. The maximum length of benefits is 20 weeks per year. Beginning Jan. 1, 2026, annual employer premium rates will be 0.7% for employers participating in both the family and medical benefit programs. Employers must pay at least 50% of the annual premiums with the remainder paid by employees via deduction in their wages.

Mortgage Rates Impact New Construction Activity
The housing market this year has seen noticeable shifts in activity, much of which is due to the impacts of rising mortgage rates. Last year, the Federal Reserve began making incremental interest rate hikes in an attempt to get a handle on growing inflation concerns. Consequently, mortgage rates have now more than doubled since 2020 and are currently sitting at a 20-year high.
This current level of rates is having significant impacts on the housing market from both a buyer and seller perspective. According to data from the Minneapolis Area Realtors, inventory of homes in the Twin Cities metro area was down 16% in July from the same time last year. Meanwhile, closed sales were down 21% for the same period.
Buyers are waiting to see if rates will come down, and many wouldbe sellers are reluctant to give
up their generally more favorable mortgage rates.
As the existing market falters, buyers have started to turn to new construction to fill the missing supply of homes. Builders, in response, have started to increase production. In the Twin Cities metro, homebuilders pulled permits for 446 single-family homes during July 2023, a 38% increase from 2022. Likewise, applications for mortgages on new homes were up 35% year-over-year in July, according to the Mortgage Bankers Association. In the first half of the year, builders reported an increasingly positive sentiment toward the market, according to the National Association of Homebuilders (NAHB). NAHB’s monthly survey measures builder outlooks of various market factors such as future sales expectations and potential buyer traffic.
Though the new construction sector is seeing increasing activity due to a lack of supply in the existing market, it is not unaffected by the impacts of higher mortgage rates.
“Although builders continue to remain cautiously optimistic about market conditions, the quarterpoint rise in mortgage rates over the past month is a stark reminder of the stop and start process the market will experience as the Federal Reserve nears the end of the ongoing tightening cycle,” said Robert Dietz, NAHB’s chief economist.
Builder confidence fell for the first time in July after a seven-month streak of increases. NAHB reports that although demand for housing has not waned, higher rates are making for higher monthly mortgage payments and putting pressure on what buyers can afford.

Artificial intelligence (AI) writing tools, social media platforms, scheduling tools, automated processes—the list goes on. For small businesses with lean teams, these tools are essential for efficiency. When digital marketing, blogs, and social media fall to the bottom of the to-do list, AI can be a powerful aid. Programs like ChatGPT, Grammarly, or DALL∙E 2 can reduce your team’s workload, save time, and increase content outputs. You just have to know how to use them and where to start!
WRITING TOOLS
Tools like ChatGPT are language processing technology that can be useful in shortform writing. By inputting commands or guided prompts, these AI tools generate ideas or write copy in a matter of seconds. ChatGPT can craft human-like social media captions, interview questions, email copy, or brief customer communications in a matter of seconds. You can even input a caption you’ve written for Facebook and ask ChatGPT to reformat for other platforms. It will tailor content to each app, using the right hashtags and keywords to maximize engagement. Since it’s created in conversation format, you can ask multiple questions in a row, ask for clarification, or provide new prompts to refine answers. While not ideal for drafting blog posts or long-form text, ChatGPT can provide creative title options, general outlines, or section titles. Instead of doing these menial tasks yourself, start with a few prompts, edit copy to your liking, and incorporate into your marketing.
There are also AI tools for writing enhancement, like Grammarly. Grammarly is a program on your computer that will analyze your writing and offer suggestions for improvement. This can be anything from spelling errors, to changes in tone, to conciseness. While you will still be writing the bulk of the content, this is a great tool to take your writing to the next level.
DESIGN TOOLS
Tome, Canva, and Adobe Firefly are specifically designed to create eyecatching visuals and organize content quickly. Whether it is for social graphics or slide decks, these AI design tools are extreme time-savers. The next time you’re set to present your work or schedule a social post, don’t spend time lingering over the design details.
SCHEDULING PLATFORMS
Platforms like Sprout, Hootsuite, and Buffer streamline social media scheduling. Instead of worrying about manually posting each day, lean on these digital tools to schedule batched content across every type of social media! They will also make your posting even easier by handling all the details of posting, like tagging other accounts or adding hashtags to posts.
CUSTOMER SERVICE BOTS
Communicating with your clients online is one of the best ways to establish relationships and credibility. However, it is impossible to be available at all hours of the day and night, and even during work hours, it is difficult to respond immediately. This is where AI customer service comes in.
AI customer service chatbots provide easy answers for clients in a personable tone. When visiting your website, clients will see a chat-box where they can ask you any questions they have. They will then receive customized AI help, leaving you to work on other projects.
A word of warning: AI tools will never be perfect, and there are currently many limitations. Responses can be repetitive or unnecessarily wordy, information may be inaccurate, and content might include mistakes. Q. How do I get my home or product featured in a magazine?
First, it’s helpful to know your goal for having the home or product featured and who the audience is of the magazine you have in mind. At Mpls.St.Paul Home & Design, we are on the hunt for local inspirational and aspirational homes; people, places, and products that reflect how people are living (or can live) their best lives in the Twin Cities. Think about how your project or product speaks to readers, then reach out to the editorial staff with a brief email to pitch your story idea. Include a few visuals (or a link to images) and a short write-up of your idea that highlights
what it is and why you think it’s a timely fit for the publication. Editors love exclusive stories, so be sure to let them know if you are able to offer that.
Q. What makes a story pitch stand out to you as an editor?
Whether it’s for the Home & Design or regional or national publications, editors want to know what’s in it for their readers. We like to pull back the curtain about how a home comes to life: What were the goals of the resident or homeowner? What challenges did the design team have to overcome? What excited you, as
the design pro, about the project in the first place? How is the story unique or different? Are there takeaways you can tick off in your pitch to the editor? Were there uber cool materials used to bring the dream to life? And since we are in the business of visuals, always include images along with your story pitch.
Q. Besides pitches, how do editors find the homes and products they feature?
Editors for all shelter magazines scour Instagram on the regular for story leads and ideas. (Often editors will check out a business, designer, or subject first on

Instagram and then their website.) Locally, we also regularly attend home and garden tours and retail openings, and we have long-term relationships with industry pros — from builders, architects, and designers to photographers, stylists, shop owners, and area tastemakers — who often share new projects or people to check out.
Q. How important is it to have good imagery when pitching?
For story pitches, iPhone photos work great as scouting shots to give an editor the general idea and the scope of a story. Prior to publication, most publications require professional photography. At H&D magazine, we feature a hybrid of both supplied images (which we pay
photographers to license for publication), and we commission our own photoshoots, working with national-level professional photographers and stylists.
Q. How far in advance should I be pitching to an editor?
Magazines produce stories seasonally as much as possible, so that could mean photographing a story a year prior to publication if possible (for example, we photographed locations this summer to be featured in summer 2024). Publications typically go into production — meaning assigning stories to writers, scheduling last-minute photography, and designing stories — about six weeks prior to the publication date.

Foundation breaks ground on apartment remodel for families in need
In July, the Housing First Minnesota Foundation began the final phase of construction on a project to renovate the four remaining units in an apartment building in North Minneapolis. This endeavor is the latest and final chapter in the renovation of the entire 100-year-old building.
This Family Recovery Housing community build project will provide transitional housing to women who are in AVIVO’s addiction recovery treatment program. The local nonprofit works to help individuals achieve recovery from substance addiction by providing safe housing, education resources, and other means of support.
The remodeled units will allow these women to get the help they need while being able to live with their children and families.
This latest phase of unit renovations is being completed with build partner Nor-Son Custom Builders, Inc. Since the start of this project in 2020, Mega Remodel, Cardinal Remodeling, Plekkenpol Builders, John Kraemer & Sons, Inc., and The Kingdom Builders have renovated units in the building.
“Our community build projects are a truly unique model that impact so many lives over multiple years,” said Jessica Ryan, executive director of the Housing First Minnesota Foundation. “We are grateful to be a part of such an important project for Avivo, and for the generosity of our build partners. Without them, these build projects would not be possible.”
The Family Recovery Housing is expected to be complete by the end of 2023. After completion, four families will call these apartments home for an average of 12-18 months.

New Minneapolis home and ADU helps veterans experiencing homelessness
The Housing First Minnesota Foundation/HomeAid Twin Cities, in collaboration with build partner Lennar, proudly handed over the keys of a brand-new four-bedroom home in North Minneapolis to the Minnesota Assistance Council for Veterans (MACV) in August. The new home will help MACV in its mission to end veteran homelessness, a segment of the community that is in growing need of services.
This home is the fourth project completed by the Housing First Minnesota Foundation with partners MACV and Lennar in 2023 – the biggest endeavor accomplished by the Foundation thus far. This significant milestone marks another step forward in the mission to end veteran homelessness
and address the growing need for services within the community.
“Since 2017, this partnership has constructed over 20,000 square feet of housing for Minnesota veterans,” said Ryan. “Our unique, collaborative housing model pools together the expertise, resources, and philanthropic arm of the homebuilding industry and community funders.”
All four of these completed homes were also constructed with an accessory dwelling unit (ADU).
“This is the final step of an ambitious project — construction of four Housing for Heroes homes each with an ADU,” said Jim Fuschetto, 2023 president of the Housing First Minnesota Foun-
dation. “As this home opens for veterans to live in, we are one step closer to our goal of ending homelessness in Minnesota.”
With the completion of this project, a total of 20 new beds will be made available to veterans in need. These beds provide a safe and secure environment for veterans to rebuild their lives and regain their independence.

So, when Housing First Minnesota launched its Association Health Plan (AHP) at the end of 2019, opting to enroll in the memberexclusive health insurance was an easy choice.
AHPs are a category of insurance products that allow small businesses from within the same industry to obtain health care coverage as if they were a single large employer, explains Blue Cross and Blue Shield of Minnesota, Housing First Minnesota’s AHP insurance provider. Under the Affordable Care Act, companies with 50 or more employees are required to offer group health insurance. Those with fewer than 50 employees can purchase optional coverage through the Small Business Health Options Program, but it’s typically pricier than large group insurance. Accessing those large company rates for Housing First Minnesota members “was really the premise of starting this plan,” says Housing First Minnesota’s chief operating officer, Janice Meyer.
Though AHPs have existed in Minnesota for decades, a new final rule for AHPs was released by the U.S. Department of Labor in 2018, expanding the circumstances under which a group of employers can join together and form an AHP, says the Minnesota Department of Commerce.

Housing First Minnesota’s Association Health Plan provides members with accessible, affordable health insurance.
When that happened, Housing First Minnesota jumped at the opportunity to create its own AHP for members. “Prior to aligning with Housing First Minnesota on the AHP, we found that gaining new employees was more difficult because of the unaffordability of health care premiums as it relates to the employee’s compensation package,” says Carlson. “After joining Housing First Minnesota’s AHP, our premiums were cut in half.”
When the new AHP rule was initially proposed, health care research firm Avalere predicted AHP premiums would be between $1,900 to $4,100 lower than the yearly premiums in the small group market and $8,700 to $10,800 lower than the yearly premiums in the individual market.
Beyond the cost savings, the AHP is beneficial for recruitment and retention, crucial for an industry plagued by labor shortages. A recent report from the National Association of Home Builders states the construction industry currently needs about 723,000 new construction workers each year to meet demand. At least 90% of single-family builders reported a shortage of carpenters, and 80% to 85% reported a shortage of subcontractors in six other trades. Further, the number of construction workers aged 25 to 54 dropped by 6% over the past seven years.
“When we’re faced with low unemployment and a workforce shortage in the industry, health insurance benefits are even more important,” says Meyer. “It was important to us as an association to provide our members and their employees with better access to health insurance that can save them money while providing great coverage.”
To enroll in the plan, you must be a member of Housing First Minnesota and participate in the practice of building or physically putting something into a home. For example, window installers, plumbers, and landscapers qualify for the AHP, while architects, insurance agents, and engineers do not.
In partnership with Blue Cross and Blue Shield of Minnesota and insurance solutions firm North Risk Partners, Housing First Minnesota boasts eight fully insured plans for members to choose from — some with lower deductibles and copays, and others with higher deductibles and health savings accounts. Each plan includes coverage for doctor visits, preventative care, hospitalization, emergency care, and outpatient care, as well as health and wellbeing benefits.
“As homebuilders, we can sign up for a couple different plans, so if an employee doesn’t like one plan, they can look into another. You can better tailor the insurance to their circumstances,” says Dennis Galligan, who was motivated to enroll his company, In-Focus Systems, in Housing First Minnesota’s AHP for the consistency of the annual insurance costs.
The AHP has been well-received by Housing First Minnesota members, as evidenced by the growing number of participants. Today, there are 53 companies — 43% builders and 57% associates — signed up for the AHP, totaling 1,100 lives.
“It’s a credit to the leadership and the rest of the staff at Housing First Minnesota. They identified this need,” says Todd Polifka, president of Custom One Homes, past president of Housing First Minnesota, and AHP advisory board member. “It’s another value add to membership. Not only does Housing First Minnesota go out and unify the housing industry, partake in lobbying and networking, and provide education and marketing, but now there’s another level of value that you get with your membership.”

Parade of Homes 75th Anniversary
The Parade of Homes only turns 75 once! As an association, we went BIG celebrating our legacy and our communities.
America’s favorite pastime
Who doesn’t love celebrating homeownership AND baseball?
The Parade of Homes sponsored two St. Paul Saints games this summer at CHS Field. We threw the first pitch, gave away prizes, and handed out guidebooks to promote the fall tours.
Launched a signature brew
Partnering with Bauhaus Brew Labs in Minneapolis, the Parade of Homes launched a home tour-inspired hazy pale ale. Ope’n Haus was named after the low-pressure, open house-style tours the Parade of Homes in known for, plus a little Midwestern flair! We hosted a launch party for our limited-edition brew at the taproom and invited the industry and the public to celebrate with us. Cheers to homeowner-sip! Ope, we meant homeownership.

Every Saturday during the tour, we hosted community pop-ups at new neighborhood developments.
Tour-goers and families joined us for morning fitness, puppy parties, coffee carts, and food trucks.
