FROM THE PRESIDENT

Homeownership Is All of It and We’re Innovating To Tell the Story Associations aren’t generally known for being nimble. I’ve been a member of several and served in leadership roles, and you can generally count on the same basic activities each year. That’s not all bad as there’s great comfort in that stability. The industry that the association serves has a clear idea of what to expect, and the association’s annual calendar provides a certain rhythm each year. But we’re in a rapidly changing environment today, and the pace of change has never been more dramatic. That means that being a stodgy association that doesn’t innovate and pivot is hugely problematic. In fact, for many associations, their entire business model is being challenged. The board of directors and staff leadership have been thinking a lot about this at Housing First Minnesota. In fact, we’ve done more than think about it, we’ve been aggressively pursuing new ideas that further our cause of providing the opportunity for homeownership for everyone, everywhere. For example, even prior to the pandemic, we were shifting our educational focus for Contractor University from in-person classes to online, on-demand courses. We obtained the very difficult IACET accreditation required by the Minnesota Department of Labor and Industry to build out an extensive online catalog of classes. And when COVID-19 nixed in-person training, we found our traffic skyrocketed. We’re continuing down this path of online learning—it’s now and the future. One other powerful new initiative will extend our brand and help us tell the all-important story of the value of homeownership and the difficulty

too many Minnesota families have in achieving it. The concept is that of a down payment assistance giveaway tied to the Parade of Homes. This will further elevate the event, showcase housing, and help us bring forward the message that significant change is needed at the legislature and with policymakers to address the cost drivers that are pushing homeownership out of reach for too many of our children and grandchildren. Whether it be online training or the down payment giveaway, we’re seeking to pilot initiatives and innovations that navigate the changing nature of our industry and the societal change brought about by COVID-19. Our legal counsel works with many associations, and they’ve been complimentary and impressed by the spirit of innovation from our leadership and staff. Most associations simply do not pivot and change rapidly to meet market demand and consider new business models. Will all our ideas work? We don’t know. But you can take pride in being a member of an organization that doesn’t rest on its laurels, seeks continuous improvement, and is willing to take significant calculated risks to serve the membership and the cause of homeownership for everyone, everywhere. As I leave office at the end of the year, I’m really proud of what we’ve initiated, and I can’t wait to see these new ideas come to fruition. The legacy we all want as volunteer leaders is to move the organization forward and position it for continued success. I want to thank the entire board of directors and the staff team for doing just that.

Legislature Adjourns with Incremental Housing Progress Y O U R A S S O C I AT I O N F I G H T S O F F A D D I T I O N A L I M PA C T F E E S After a full 18 months of being gaveled in for either regular session or a special session, July marked the first month that the legislature was not in session since the pandemic began. Legislators used nearly every minute before a government shutdown would have commenced, but a full budget was finally passed and signed into law by Gov. Walz on June 30, including an omnibus housing bill.

Meanwhile the House spent their time advancing additional park and street impact fees that would cost homeowners thousands of dollars more and refused to hear any bills addressing Minnesota’s exclusionary zoning practices.”

Unfortunately, nearly all major housing industry priorities that were included in the Senate’s version of the housing bill, including the removal of exclusionary zoning practices, failed to make it through final negotiations. “Despite our state’s already acute and worsening housing inventory and affordability crises, the legislature and Gov. Walz failed to enact any meaningful reform to address the regulatory roadblocks which are pushing homeownership out of reach for far too many Minnesotans,” stated David Siegel, the association’s executive director. “Our housing crisis will only be solved when the legislature fully addresses these roadblocks and exclusionary zoning practices that have taken Minnesota to record-high home prices and the largest homeownership equity gap in the country between white and black Minnesotans.” “All throughout session we saw two vastly different strategies in approaching Minnesota’s housing issues,” said Mark Foster,

Here is a rundown of where the major housing items ended. HOUSING INDUSTRY INITIATIVES & PRIORITIES

ADDRESSING EXCLUSIONARY ZONING THROUGH PLANNED UNIT DEVELOPMENTS

SINGLE-FAMILY HOMES EXEMPTED FROM WINDOW FALL PREVENTION

In an important first step, a bill aimed at addressing Minnesota’s exclusionary zoning practices was sent to the Senate floor after hearings in both the Housing Committee and Local Government Committee. This legislation confronts one of the top affordability barriers head-on, the overuse and manipulation of Planned Unit Development (PUD) contracts as a means to approve housing projects. The goal of the legislation is to lift barriers that drive larger lot requirements and exterior design mandates in new home approvals.

This bill is a first step to addressing the issue that experts have almost unanimously agreed is the key to fixing our growing housing and homeownership problems: lifting local barriers and zoning carve-outs which are currently restricting the construction of affordably priced homes.”

HF1840 (Elkins)/SF915 (Draheim)

“This bill is a first step to addressing the issue that experts have almost unanimously agreed is the key to fixing our growing housing and homeownership problems: lifting local barriers and zoning carveouts which are currently restricting the construction of affordably priced homes,” stated Siegel. “We have heard from government groups that these are simply ‘the market.’ That is wrong. The market does not restrict land availability and drive land costs—local governments and the Met Council do. The market does not demand large lots, large homes, with large garages for starter homes—local governments do. And, the market does not demand stone exteriors on starter homes—local governments in PUDs do.” Local government groups presented numerous testifiers in opposition to measure, arguing that the SF915 would take away “local control” from cities and towns. Where it finished: The bill was included in the Senate version of the housing omnibus bill, but did not receive a hearing in the House and was not in the final bill. Expect further discussion around this in the interim and again in the 2022 regular session.

EXECUTIVE DIRECTOR HOUSING FIRST MINNESOTA

FIVE-YEAR PAYBACK FOR ENERGY CODE PROVISIONS SF910 (Draheim) Minnesota builds some of the most energyefficient homes in the country. By some measures we are number one in energy efficiency. With that in mind, several legislators aim to protect energy efficiency, while also raising affordability as a top issue. This legislation mandates that the costs of any new provisions added to future updates to Minnesota’s energy code must have a payback of no more than five years following completion of a new home project. This bill drew opposition from more than a dozen special interest groups, but advanced following the committee discussion. Where it finished: The bill advanced through one committee in the Senate, but was not heard in the House. Expect further discussion in the 2022 session.

HF1496 (Fischer)/SF802 (Koran) Several years ago, during a building code update process, single-family homes were mandated to include window fall protection devices in certain settings. This bill moved to strike that provision in many locations throughout one and two-family dwellings and townhomes, solving an egress issue and saving homeowners hundreds of dollars in the process. Where it finished: Signed into law, this provision will save hundreds of dollars per home. This updated language states that: window fall protection devices are not required in one and two-family dwellings if: the lowest part of an operating window is 24 inches above the finished floor – OR – the lowest part of the opening of an operable window is located 72 inches above the exterior grade below. This became active starting August 1, 2021.

MODERNIZING BUILDING PERMIT FEES HF1085 (Stephenson)/SF801 (Koran) Substantial valuation variations and large permit fee surpluses in many growing cities have revealed structural problems with valuation-based permitting. There is simply no rationale for the wide disparities in accepted valuation at the time of permit issuance. Home size and features, not arbitrary valuation, is the number one factor in calculating inspection time and costs. HF1085/SF801 would end the valuation method of establishing permit costs, and instead move to a square footage-based system. This move would ensure that building permits and the homeowners who ultimately pay these costs, are charged fees that are fair, reasonable, and proportionate to the actual costs to perform these inspections and plan reviews. Where it finished: This bill was heard in both chambers, but it did not advance to the omnibus stage. CONTINUES ON PAGE 14

HOUSING INDUSTRY ITEMS OF CONCERN AND OPPOSITION INCREASING PARK DEDICATION AUTHORITY Initiated by the city of Rochester, this bill would have created new park dedication authority for cities of the first class who are approving development projects. The House bill was heard and passed in both the Local Government Division and State Government Finance and Elections Committee and now sits on the House floor. Peter Coyle, Housing First Minnesota counsel, testified in opposition to the bill, citing concerns of a nexus, a deadline to utilize the dollars, and the potential for double dipping. The Minnesota Realtors® and the Minnesota Multi-Housing Association have partnered with Housing First Minnesota to express the industry’s concerns with the bill. Where it finished: The bill advanced to the House floor, but it was never heard in the Senate. It ultimately was not included in a final omnibus bill.

STREET IMPACT FEES

As currently written, the proposed language provides new authority for city councils to impose an additional tax on growing businesses, nonprofits, and housing developments. The proposal creates endrun around requirements imposed upon cities under the special assessment laws designed to protect property taxpayers, including the demonstration of benefit and public hearings. The House bill was heard and passed in both the Local Government Division and State Government Finance and Elections Committee after very contentious hearings. Housing First Minnesota led a coalition of nearly a dozen other business and nonprofit organizations that are opposed to this legislation.

Where it finished: The bill was discussed in the House, but not the Senate. The program was not created this year. This idea has been around for many years, so expect more discussion.

MANDATING ALL NEW GARAGES TO BE ELECTRIC CAR READY

CITIES AUTHORIZED TO ESTABLISH STREET IMPROVEMENT DISTRICT

This concept would mandate all new garages and any remodeled garages of at least 50% need to be electric car ready. This language has the potential to raise the costs of housing by hundreds of dollars for an item that very few consumers are currently demanding. The bill was heard in the House Climate Change Committee.

The street impact fee debate returned in the 2021 session, continuing many years of discussion surrounding the need and appropriateness of off-site transportation fees in new developments. Prior to the Harstad v. Woodbury Supreme Court decision, many cities were requiring these fees despite having no legislative authority to do so. After the Harstad decision deemed these fees illegal, local government groups have asked the legislature to legalize the fee collection, which would create a new tax on housing developments for future, undefined transportation improvements.

A close relative of the street impact fee issue, the proposal for street improvement districts would expand authority by allowing cities to draw street improvement districts where a fee or transportation utility could be required. This would impact both existing and new development. Housing First Minnesota joined dozens of opposing organizations when this bill was heard in the House Local Government Division.

Aimed at better managing flooring waste, this bill would create a new program to recycle carpet and has the potential to increase the costs of carpet by 4-6 cents per square foot. As written, it would authorize the Minnesota Pollution Control Agency commissioner to unilaterally increase the increase the fees even more in coming years. Housing First Minnesota joined with several others in opposition to the bill.

Where it finished: After two very contentious hearings in the House, the bill did not make it to the omnibus stage.

IN THE INTERIM: MAJOR ZONING REFORM ON THE DOCKET FOR NEXT LEGISLATIVE SESSION Following the release of August’s Star Tribune piece on exclusionary housing practices in the Twin Cities, Rep. Jim Nash (R-Waconia) called for the gathering of the Housing Affordability Commission, and Rep. Steve Elkins (DFL-Bloomington) introduced the most comprehensive Housing Affordability bill in decades. In calling for the bipartisan, bicameral Housing Affordability Commission to meet, Nash stated, “Homeownership should be an attainable dream for all Minnesotans, and we need to take a comprehensive look at the multiple inputs that drive costs to skyrocket: zoning, land use, required elements for decorative aspects of homes by a city, inspection fees, impact fees, and many others.

It would allow cities to use cost-based development impact fees to pay for roads and infrastructure-new development should pay its own way, but no more than that.

“I’ve said all along that the solution is like solving a quadratic equation in algebra class: so many integers that need to be worked on separately in order to pull together the entire answer for the problem. Everyone deserves a ‘North Star‘ to head toward, and that comes with the safety and security of homeownership.”

“At the same time, the bill would sweep away zoning restrictions used to promote the construction of expensive homes on large lots and would remove institutional barriers to the construction of new entry-level homes, apartments and condominiums. This is a complex problem which requires a comprehensive solution.”

Elkins introduced a first-of-its-kind Housing Affordability Act as a “grand bargain” of sorts. The extensive bill calls for many positive changes in planning and zoning at the local level, limits on aesthetic mandates, caps on dedication fees, makes changes to building permit structures and reporting, adjusts the disclosure of energy code paybacks, but also authorizes impact fees and street improvement districts.

If there is a special session late this fall, Elkins is expected to introduce the bill. He will also ask to present the legislation to the Legislative Commission on Housing Affordability.

Finishing the Year Strong This year has provided a big leap forward in the discussion of expanding homeownership opportunities for more Minnesotans. The issues are complicated and interconnected, but throughout the summer we saw the evolution of press coverage of housing issues and the introduction of a comprehensive housing affordability initiative. This collection of proposals will be the basis for the housing debate for the rest of 2021 and the coming year. As this proceeds, the Lead Renovation, Repair, and Painting (RRP) Rule for remodeling projects continues to be debated and a legal challenge on the overcharging of building permits moves ahead. As always, Housing First Minnesota’s work is driven by the dedication and expertise from our committee and task force volunteers and our professional staff. Housing First Minnesota Sues Cities Over Excessive Building Permit Fees

This recent article has spurred an even greater interest and conversation on the topic of zoning reform and calls for the Legislative Commission on Housing Affordability to begin its work.

Since Housing First Minnesota’s Housing Affordability Institute first reported on massive building permit surpluses being accumulated by Minnesota local governments in 2019, the topic has been the subject of media reports and legislation at the State Capitol. Now, the issue has found its way to the Hennepin County District Court. In July, Housing First Minnesota filed civil lawsuits against the cities of Corcoran and Dayton over the surpluses these cities have reported in recent years.

Building Code Updates and Agency Rulemaking

Star Tribune Research Elevates Zoning Reform Conversation In August, the Star Tribune released a deeply researched story that illustrated the devastating impact of outdated and harmful rules that persist in Minnesota’s housing market. One of these issues, the report points out, is the use of local zoning ordinances to artificially keep the price of new homes high, effectively regulating who can afford to live in certain communities. For more than two years, the Star Tribune has investigated zoning practices in the Twin Cities and determined that modern-day zoning policies are one of the reasons the region has the nation’s widest housing equity gap.

The Minnesota Department of Labor and Industry has organized two technical advisory groups related to building code changes. The Flood Resistant Design and Construction group has evaluated proposed construction changes when built in a flood plain. Another group has been looking into frost depth maps in northwestern Minnesota, with a particular focus on the Fargo-Moorhead area. For five years, the Minnesota Department of Health has been working to enact its own, more stringent, Lead Renovation, Repair, and Painting (RRP) Rule in Minnesota, which would govern the remodeling practices of any pre-1978 home in the state. Following the release of an updated version of the rule in May, Housing First Minnesota organized a coalition of housing groups seeking continued improvement in the rule and the first meeting on the rule in four years. An updated version of the rule is expected to be released by mid-September when the Housing First Minnesotarequested stakeholder meeting occurs.

BUYING A HOME IN 2021:

More Offers, More Denials, and Fewer First-Time Buyers

Despite low interest rates and a growing desire among renters to buy their next home, a mid-year survey reveals that purchasing a home this year has only grown more difficult. The results from the 2021 Zillow Consumer Housing Trends Report (CHTR) suggest the limited homes for sale and competitive market is forcing more first-time homebuyers to the sidelines. According to the CHTR results, not only are fewer first-time buyers shopping but the downward trend of first-time buyers has accelerated. In 2020 first-time homebuyers made up 43% for the market, but in 2021 that number dropped sharply to 37% of buyers that were first-timers. The share of homebuyers that are forced to submit multiple offers before finding their home is growing as well. According to the survey results, 59% of buyers reported making two or more offers. That’s up significantly from 42% of buyers making two or more offers in 2020. With the competitive market, more buyers (28%) reported that they purchased a home higher than their initial budget in 2021. Consistent with a challenging market where buyers are more likely to go over budget, the share of buyers that faced at least one mortgage denial before getting approved grew from 22% in 2020 to 34% in 2021.

Imagine you are thinking about buying a new car: a Ford, BMW, KIA, Tesla. Without any research, we already have preexisting impressions of these brands (e.g. those cars are reliable, only rich people drive those, those cars are better for the environment, etc.).

For example, if you build and remodel highend custom homes, but your brand conveys budget-friendly homes, you will likely be fielding more calls from budget-minded homeowners. In turn, homeowners seeking custom homes will look elsewhere. You want your brand to align with the values of your target customer.

Q. What advantages would I notice from a welldeveloped brand? Easier Sales – A well-developed brand will inform the potential customer “why choose you” before your first face-to-face meeting. Better Leads – A well-developed brand will better attract your ideal customer and dissuade non-ideal customers. Long-Term Growth – A well-developed brand will lead to long-term familiarity and credibility.

Asking for Client Reviews & Testimonials There’s no arguing that client reviews and testimonials are invaluable marketing tools. They not only highlight the benefits of working with your company but provide social proof to potential clients. Unfortunately, while everyone wants reviews, they rarely happen on their own. More often than not, you have to ask for them—which can be a little intimidating. The good news? It doesn’t have to be! Use the following tips to help you master asking for client reviews and testimonials.

Have a Goal in Mind It’s a lot easier to ask for a testimonial or review if you have a clear goal in mind. Understanding what you want out of the review will help guide the entire process, from how you make the request to the information the client shares. Ask yourself the following questions to help determine your goals. • How will the reviews and testimonials be used? • What kind of details will have the biggest impact? • What methods will be used to collect them? • Where will they be shared once collected?

Asking when they’re still buzzing with excitement increases the chance they’ll say yes. It can also generate a more detailed review because the experience is still fresh in their mind. Try to time your request with a positive experience. For homebuilders, it could be the day the client gets the keys to their new home. Roofing contractors, on the other hand, could make the ask when checking in on a client that experienced their first big rainstorm after installing a new roof.

Ask the Right Questions A great client testimonial is all in the details. The more detailed and thoughtful a review is, the more impactful it will be. Including a few simple questions in your request challenges the client to really think about their experience and why they’re satisfied. The questions you ask should reflect what you want to get out of the review, whether it’s highlighting a particular service, process, or something else. Be sure to use open-ended questions, which will prevent oneword answers and help generate good client quotes.

Make It Easy Make it as easy as possible for clients to write a review or testimonial for your company. One of the biggest roadblocks people run into is not knowing what to say. In addition to posing questions that let them know what kind of feedback is helpful, give clients several options so they can pick the one that is most convenient for them. • Create a questionnaire or online survey • Invite them to record a video testimonial • Ask them to write a Google or Houzz review • Keep a tablet in the office dedicated to collecting client on-site reviews • Print out and share a flyer with online review instructions

Develop a Process Sadly, writing a review doesn’t always make it to the top of a client’s to-do list. They may get busy or simply forget. To keep it top of mind, consider mapping out a request process with multiple touchpoints. Making requests in different formats lets you ask more than once without bothering or overwhelming the client. It also catches clients at various points of the process, which offers a well-rounded view of what it’s like to work with your company. Try using the methods below to collect client feedback. • Include a call to action and review link in a marketing email • Add a review link to your company email signature • Work it into your social media strategy • Make the request in a thank-you note • Add a call to action to the bottom of an invoice or proposal

Be Gracious Finally, remember that clients who write a review or testimonial for your company are doing you a favor. So, it’s important to show them that you value them and their feedback—even if that feedback reveals areas your company can improve. Send a quick thank-you note when someone writes a testimonial, and always be sure to write a thoughtful response to a Google or Houzz review. With a bit of practice, asking for reviews and testimonials will become a natural part of your business operations.

Search Like a Connector What do you do in your spare time when you’re not working? What is your favorite hobby or activity? My husband Steve always responds with, “I collect people” and he means it! And for him, it is a wonderful outlook. For me, though, making those connections doesn’t come as easily. For some of us, we may not be strong in this area, but after living with someone where socializing is required to survive, I have learned how to improve myself in such “people-facing” situations. You can too. It takes practice but the more you do it, the better you become at it.

They derive satisfaction from breaking the ice and making a connection with another person. As CliftonStrengths explains, we all have certain natural talents. They come to us easily. However, this does not necessarily mean those habits are our strengths (yet). We have to work on, focus on, and practice our talents to turn them into a strength. And who knows, you may have a talent or talents you aren’t aware of yet. Author, Marcus Buckingham, calls this a “Connector” in his StandOut assessment. Connectors look at people and automatically ask themselves who they can connect them with to make everyone more effective, as well as what idea can I give them to help them do something they didn’t imagine themselves. This talent is the source from which you get your power, trust, fear, intelligence, etc. It goes back to one of your strengths. Connecting people is what motivates you to act. This is where you get energy from to move forward, set goals, and follow through.

Our companies, departments, and teams all need Woos and Connectors. It’s how we reach out to others and build relationships. None of us knows when we might need the assistance of someone outside our close family and friends zone. This hit home to many of us when the pandemic began and everything was chaos. With so much disruption and unknowns as to whether or not our companies could survive, we were all reaching out and connecting to others (not necessarily close to us) just to figure out options and gain insight. It may have been out of our comfort zones, but it can be an empowering experience that improved relationship-building abilities. The same goes for finding candidates. Are you truly exploring all your options to fill that next job opening? If not, start with the personal. It’s about reaching out to your connections and relationships. If you rely solely on an online recruiting platform, you might be disappointed. The feedback we’ve gotten from employers and employees is that there may be candidates applying, but many aren’t the right fit and there’s a high incident of ghosting. All of this wastes valuable time.


always about what you need from that person. More often than not, it is about helping the other person. If you’re trying to figure out how you could implement a strategy around this, consider this: A strategic partner of ours just sent us a short summary of what their company is up to as well as a templated email we can copy and paste so we can easily send their job opening (links included) to anyone within our web of relationships who might be a good fit. How easy for us to just copy, paste, and send when someone comes to mind.

CONNECTING HAPPENS OUTSIDE OF WORK TIME Connecting isn’t a 9-5 job. Even when you’re not at work, you should still be connecting. We recently spoke with an individual who is desperately trying to find a job. However, she is doing nothing as far as reaching out to existing relationships or building a network of connections. She is simply putting in her time (i.e. her workday) and applying through online recruiting platforms. She considers her time outside of work family/private time even though she has been to church, shopped in her local community, volunteered, and attended sports activities —all excellent connecting opportunities!

CONNECTING IS NOT AN EVENT Making connections is a continuous “reach out” to others. Strengthen relationships today, even though there may not an ulterior motive. Plus, when you reach out to someone with an ulterior motive in mind, it’s usually a little obvious. People don’t appreciate that. What they do appreciate are honest connections. From this relationship, one can go back to a person when you have a particular need, like searching for a candidate introduction. The key phrase here, for us not-so-strong connectors, is “take the time.” I often wonder how so-and-so is doing and sure would like to find out, but because of my busy schedule, I tend to forget the physical act of reaching out by phone, email, text, or LinkedIn.

C O N N E C T I N G I S S T R AT E G I C Create a reason to connect and revisit with someone. My husband is genuinely concerned about making a connection. That takes thought and a connecting of the dots between an idea or conversation and someone who might benefit. It is a part of strategic thinking as well as wanting to be helpful. When meeting people, put on your thinking cap and always ask yourself how you can help this person or connect them to someone else. It is not

I recently reached out to a Facebook friend whose son works at a large company and might be interested in meeting another friend’s daughter (who happens to be looking for a career move). What a complicated web, but it makes sense if you are willing to make the first move, break the ice, and reach out with an introduction. If I hadn’t had a trusting, respected relationship with multiple people here, it would never have crossed my mind to connect. It is up to each of us to create awareness of who we are and what we are looking for by connecting and building relationships before they are needed. Reach out and align with others. Create that web of connections that will serve you well down the road.

ARE YOU A WAGE THIEF? AN INTRODUCTION TO MINNESOTA’S WAGE THEFT PREVENTION ACT

Minnesota passed the Wage Theft Prevention Act (WTPA) in 2019, a series of modifications to existing statutes providing additional protection for workers whose employers do not pay what is owed for work performed. Wage theft occurs when an employer, with an intent to commit fraud, pays an employee less than has been earned. The employer may require an employee to falsify the hours worked, require an employee to return any portion of their earnings, create a record showing the employee was paid more than was actually paid, or misclassify an employee as an independent contractor. The Federal Fair Labor Standards Act (FLSA) classifies employees as “Exempt” or “Non-exempt.” Exempt employees

are typically management, supervisors, or make financial decisions that impact the health of the business. The exempt employee is often paid a salary, no overtime, and does not make a record of hours worked. A word of caution: many office and field personnel are paid a salary but do not qualify as exempt employees. Most employees are non-exempt under the FLSA, meaning they must be paid hourly at a rate no less than minimum wage and must be paid overtime at a rate of no less than 1½ times their hourly rate for all hours worked over 40 hours in each seven-day work week. Failure to track hours and pay a non-exempt employee for the hours worked, including overtime, may constitute wage theft.

The FLSA does not allow “banking” of hours. Banking occurs when a nonexempt employee is paid for 40 hours during a seven-day period when the employee worked more than 40 hours. The ‘extra’ hours are banked for a slower week when the employee works less than 40 hours but still receives a 40-hour paycheck. Employers believe banking is okay to “save” the overtime hours for a time when the employee works less than 40 hours, and because many office personnel prefer a salary to punching a clock. Intentionally misclassifying employees (W2) as independent contractors (1099) may also constitute wage theft. Engaging independent contractors is a common business practice for contractors that

allows for scaling of working forces as projects come and go. Examples include trade subcontractors, sales representatives, and professional service providers. Several “tests” are used to determine independent contractor status, most of which boil down to whether the employer retains the right to control the means and manner of the performance of the work, and whether the worker operates as a business. The WTPA increases the penalties for misclassifying employees, so readers should consult their legal advisor to verify the classification of all workers. The WTPA imposes new recordkeeping requirements on Minnesota employers. When they start work, new employees

must receive an employment notice with nine pieces of information and a copy of the company’s employment policies. If any of the information changes, they must receive written notice. Employers must retain a signed copy of the notice, policies, and time records for at least three years. The WTPA gives the Minnesota Department of Labor and Industry (DLI) and the Minnesota Attorney General (AG) greater enforcement authority. DLI has more power to enter your business and inspect employment records. DLI can subpoena records, collect evidence, and interview witnesses, including private interviews with non-management personnel. The AG can also enforce these

employment laws. COVID-19 has kept DLI busy for the past nearly two years pushing enforcement of the WTPA to the back burner. That’s given Minnesota contractors extra time to get to know the WTPA and make changes to ensure compliance. As we learn to live with COVID and return to business as usual, DLI can be expected to step up WTPA enforcement. The penalties for violating the law include large fines and jail time. Contractors should get familiar with the WTPA and use this time to make necessary changes to business practices. Contractors should consult their legal advisor to learn about the WTPA.

So, where is this money going? The funds raised will go toward our work to build and renovate housing for Minnesotans who are experiencing homelessness or at risk of becoming homeless. CURRENT PROJECTS SIX FAMILY RECOVERY APARTMENT UNITS Service Provider: Avivo Mothers living in these apartment units with their children are taking steps toward their sobriety. As Kelly Matter, CEO of Avivo says, “This is some of the hardest work these mothers will ever do.” Our build partners Plekkenpol Builders, The Kingdom Builders, and John Kraemer & Sons, Inc. have worked to restore these substandard units to give families a chance to raise their kids in a safe and nurturing environment, while receiving counseling and career coaching through Avivo’s recovery program. As we went to press, the six apartment units were nearly complete with a key ceremony planned for September 22.

TWO HOUSING FOR HEROES TRANSITIONAL VETERAN HOMES IN NORTH MINNEAPOLIS; ONE WITH AN ACCESSORY DWELLING UNIT (ADU) Service Provider: Minnesota Assistance Council for Veterans (MACV) Housing for Heroes homes provide veterans experiencing homelessness the space and security to rebuild their lives. This is the first time an ADU will be built on a Housing for Heroes property, increasing our shelter capacity by an additional 1-2 people. Build partner Lennar along with dozens of its industry trade partners will donate labor, materials, and time to these projects. Once complete, the homes will be used by MACV as transitional housing for individual veterans or veteran families. A groundbreaking is anticipated later in the fall of 2021.

Building for the Future Meet four members of the Young Professionals Committee who are defining the next generation of the housing industry. by Taylor Hugo

There’s a sentiment echoed by many in the housing industry: As the baby boomer generation retires, trade professions face labor shortages, leading to extended project timelines, increased labor costs and home prices, and lost profits. Recruiting the next generation of housing professionals is the answer to this challenge, but getting bodies on job sites is easier said than done. Enter Housing First Minnesota’s Young Professionals Committee, which aims to attract and develop tomorrow’s workforce by providing young talent within the building industry a chance to foster relationships, become active in the organization, and grow as professionals through regular networking events and charitable activities. Here, four members of the Young Professionals Committee share what drew them to the housing industry, the benefits of their jobs, and why it’s crucial for more young people to consider a career in construction.

Natalie Velez stumbled into the housing industry by accident. The year was 2011, and Velez was looking for a career change when she came across an advertisement for an office assistant at Great Northern Builders. She took the job not knowing how long she’d stay with the company. Now, 10 years later, Velez is the general manager, handling everything from human resources and scheduling to production and customer service. “It felt like I was meant to be here,” she says. “I love building relationships with customers, the flexibility to balance my work and mom life, and that I always get to meet new people and create relationships with vendors and trade partners. I love that every day is different.” Her job at Great Northern Builders has also given Velez the opportunity to fuel her passion for learning and leadership. In an effort to learn more about her new industry, Velez took builder licensing courses and Housing First Minnesota seminars,

got involved with the National Association of the Remodeling Industry, and even completed the Housing First Leadership Institute program in 2017. This primed her to take on leadership roles within the Young Professionals Committee, serving as vice chair in 2019, and chair in 2020 and 2021. It’s all part of her mission to get more people with diverse backgrounds involved with Housing First Minnesota and the housing industry in general. “There is such a need to get more young people involved in the industry,” she says. “Although young people see the hard work it takes, it would be nice for them to see how rewarding it is. Being able to transform and bring a customer’s project to fruition, and see the smile on their face, is an amazing experience. There are so many opportunities for the youth in the building and remodeling industry, and the room for advancement, or even owning your own company, is definitely at an arm’s reach.”

Housing First Minnesota: How did you get involved in the housing industry? Madeline Landis: I was 20 years old when I started as a receptionist at a remodeling company. I sort of stumbled into it, but I'm really glad I did. The company that hired me was very big on internal promoting, which I find to be the case a lot in this industry. HFMN: What training programs or certifications have helped you succeed in your job? ML: I attended the 2019 Leadership Institute through Housing First Minnesota. That class really helped me to gain confidence professionally, and it taught me that you can be a leader even if you aren't necessarily in an upper management position. HFMN: What do you love most about your job, and what is the most challenging aspect? ML: I really love when I can assist a customer by turning a poor experience into a great one. I also enjoy the people and attitude of the industry

as a whole. The most challenging thing would probably be adapting to the ever-changing schedule. It's always something different every day. HFMN: Why is it important to recruit the next generation of housing industry professionals? ML: If the trades don't have proper support, then you see a big hike in labor costs because of the demand. It affects the whole housing market. HFMN: Why did you join the Young Professionals Committee? ML: I joined the Young Professionals as a way to branch out and make connections in the industry. It helped me to come out of my shell. I'm currently vice chair of the committee. I really want to encourage other young professionals to join the group, or be more involved in Housing First Minnesota. I know how much it's helped me, and I think it's really important to learn how to create and maintain professional relationships if you want to grow and thrive in the industry.

Joe Swalve likes to say the housing industry runs in his blood. Growing up, his dad was a union carpenter who started his own historical remodeling company when Swalve was in second grade. Even though Swalve didn’t directly follow in his dad’s footsteps by becoming a carpenter—instead choosing to study finance and marketing at Bethel University—he’s been able to create a career in the housing industry for himself as a private mortgage banker for Wells Fargo the past 11 years. “It’s wonderful to be part of the team that’s creating the home. You can build anything, but someone’s got to be able to finance it and afford it at the end,” Swalve says. “Doing mortgages for new construction can be difficult because the loan that you start with isn’t always the loan you end with. You have to be able

to pivot and really figure out how to get these loans done. Complexity is one of my specialties, and I love being able to creatively finance things and think outside the box.” It’s this kind of creative thinking that demonstrates why it’s crucial to recruit young people into the housing industry, says Swalve, who joined the Young Professionals Committee to celebrate and support the housing industry with a like-minded group of colleagues in the same age demographic. “We’re always going to need people who can build houses because people need a place to live. It’s one of the basic necessities that turns into one of the greatest investments people will ever make. But as technology evolves, you need other ways of thinking and new ways of doing things.”

Housing First Minnesota: How did you get involved in the housing industry? Savanna Forster: My goals and ambitions were to be an aerospace engineer, but then I was in a car accident, so I ended up not being able to go into the Air Force. I stumbled into marketing and telemarketing when I was 19, which transferred over to the home improvement industry five-and-a-half years ago, when I was recruited by my current company. HFMN: What does your current role entail? SF: As the IT and marketing strategist, I do all the planning and budgeting for where we’re going to spend our marketing dollars, and I decide on any new technology that may be needed. I also oversee the telemarketing and our event marketing. I love the variety that I get every day. I’m never doing the same task. HFMN: You’ve been a member of the Housing First Young Professionals Committee for three years. Why is it important

for the younger generation to get more involved with the housing industry? SF: One of the biggest things I’ve taken pride in being a part of is helping to raise money to build housing for homeless veterans. I think by getting more people involved, especially the younger generation, we’re going to be able to make bigger transitions and make housing more affordable for everybody. HFMN: What piece of advice would you give to young people considering a career in the housing industry? SF: Work today for what you want to make tomorrow. HFMN: What is an accomplishment you are especially proud of? SF: The Rising Star Award [from Housing First Minnesota]. It’s an award for emerging leadership and dedication to the homebuilding and remodeling industry, given to somebody under the age of 35 within their first 10 years in the industry. I won that award in 2020.

Embracing Our Cause Changes in brand names can reflect much more than simply a rebrand. For example, on Jan. 9, 2007, Apple Computer announced that it was dropping the word computer from its name and simply rebranding as Apple. In September 2018, Dunkin’ Donuts announced it was dropping donuts from its name and simply becoming Dunkin’. For Apple, the change reflected a shift from being a computer manufacturer to becoming a personal device company. For Dunkin’, it reflected a shift from a primary product of donuts to a much broader array of products that make the stores a hub for families and friends. While simple in act, they reflect a far deeper assessment of the purpose of these companies and demonstrate that they are thinking differently about their very identities. I share these two examples because Housing First Minnesota has undergone a similar transition. Where we once thought of ourselves narrowly as representing builders, remodelers, and their suppliers, we now know that our purpose is much broader—advocating for providing the opportunity for homeownership for everyone, everywhere. Through this

important shift, we’ve become much more influential with policymakers, regulators, and all who impact the ability of our members to operate successfully. Perhaps in the past, members, nonmembers, policymakers, and the media knew us as the organization that put on the Parade of Homes. That was our identity. And while this powerful and vital industry marketing event will continue to be a major focus of our association, like Apple and Dunkin’, we must better tell the story of our game-changing association purpose. Whatever activity we engage in, from serving as the leading voice of advocacy for the industry to the Parade of Homes and Artisan Home Tour; from solid online educational content to high-energy connection events; from our leading green building program to our charitable foundation, we present it through the lens of homeownership and demonstrate how it contributes. This powerful purpose of elevating and advocating for homeownership provides the opportunity to launch new initiatives that expand our reach and help us tell the story of why homeownership is so important and powerful. We have several major

programs in the development stage. One I want to mention here, our down payment assistance program, has great potential to further elevate the story of homeownership. This program, along with several others under consideration, reflects the power derived from integrating all our programs and services under the banner of homeownership and drives that messaging forward with relentless consistency. That will help every builder, remodeler, associate, and homebuyer. And it will help future generations so that our children and their children will enjoy the benefits of homeownership: better educational outcomes, better health outcomes, wealth creation, and stronger community engagement. We’re so glad you’ve joined us in pursuing this powerful cause. Now, onward!
