SDLT UPDATE

Paul Clark has been a commercial property solicitor for over 40 years. He is an expert on many aspects of commercial property law and is a popular and engaging speaker.

A consultation on the abolition or major revision of SDLT on mixed-use property, and on how multiple dwellings relief should work, closed in February this year.

We do not yet know whether, how, or when changes will be introduced, but since the reason for the changes is to reduce the number of futile tax appeals brought by “internet claims advisers” (as HMRC calls them) changes are expected sooner rather than later.

If the changes are announced in time, they will be the principal topic for the afternoon, as we will need to work through the impact of the changes on many different scenarios.

Otherwise we will look at some significant reported SDLT appeals, and work through a variety of the residential and commercial cases on which I have given advice in the past 12 months or so, and which illustrate some of the ways we can work out what SDLT is payable following two simple rules.

(1) What land transactions are taking place - and if there is more than one, are they linked or in exchange for others?

(2) What is the chargeable consideration for the transactions, and the appropriate rate of SDLT, and is any exemption or relief available?

The session is designed for both commercial and residential practitioners.
