As we approach the final two months of the year, I want to take a moment to reflect on our accomplishments and express my heartfelt gratitude for your continued support and involvement in our community

First and foremost, I would like to extend a huge thank you to everyone who participated in our recent Parade of Homes. This event was a resounding success, showcasing the incredible talent and creativity of our builders. Your presence and enthusiasm made a significant difference, and I deeply appreciate those who volunteered their time to help at the parade houses. It was inspiring to see the community come together to celebrate what we can achieve when we work hand-in-hand.

Additionally, I want to highlight the recent election and casino night, which proved to be an entertaining gathering We were thrilled to welcome new members to our Board of Directors, who we hope will bring fresh perspectives and ideas that will undoubtedly enhance our future initiatives Your participation in these events not only fosters camaraderie but also strengthens our organization

I am excited to share that we successfully raised $2,900 for scholarships to be awarded in the 2025 school year at the Casino Night This achievement speaks volumes about our commitment to supporting education and empowering the next generation

As we look ahead, I encourage each of you to get involved and share your goals for 2025. Together, we can make a meaningful impact on our community and ensure that we continue to grow and thrive.

I hope this message finds you well. As we look ahead to the upcoming months, we are excited about the opportunities that lie ahead for our association and community. We are eagerly anticipating another sold-out Home Show, scheduled for March 28 through 30. This is a fantastic event that showcases the talents and innovations of our members, and we encourage you to mark your calendars! Applications and registration are now open, and if you’re interested in sponsoring this event, please don’t hesitate to call the office. We typically see over 7,000 attendees over the threeday span, making it an excellent opportunity for visibility and engagement.

Additionally, we are thrilled to announce our upcoming Pub Crawl! The committee has set ambitious goals this year, aiming to raise $90,000 to support three deserving families. We are actively seeking donations for our live and silent auctions, and any contributions you can make would be greatly appreciated. Your generosity plays a crucial role in making this event a success.

These events not only bring our community together but also help fund and sustain the operations of our association. It is truly the involvement of our members that keeps the Black Hills Home Builders Association thriving. We sincerely hope to see more of you engaged in our activities this year. Lori grew up in Mitchell, South Dakota. At the age of 16 she moved to Phoenix and finished high school. This is where her passion for design was ignited. She pursued her Bachelors of Science in Design Degree from Arizona State University. After gaining valuable experience working as a designer in Scottsdale, Arizona and later transitioning to a role as a sales representative in the furniture industry, Lori found herself drawn to the vibrant design scene in Dallas, TX. She then spent 8 years honing her skills as an Interior Designer with a design studio in Dallas. With a wealth of experience and a deep love for the industry, Lori returned to her roots in South Dakota to establish her own design firm, with a desire to help guide people to create the home of their dreams.

In recent months, workforce development has been a major focus, especially as we work to inspire the next generation of builders and trad espeople. This summer, we had the privilege of partnering with the Boys and Girls Clu b in Hill City, where the kids completed their cornhole board project last week. T he day was filled with painting and stenciling, marking the successful conclusion of th eir summer endeavor. It was rewarding to see their creativity and effort shine, especiall y now as these colorful boards pop up throughout the community, symbolizing the transitio n from summer fun to the start of the school year.

With school back in session, many of these students are diving into new career exploration activities. Fall brings exciting opport unities through local AGC Construction Camps and career fairs, which introduce students to various trades. Ross Jones and I focused on carpentry, guiding students as they buil t boot jacks from scratch. It was incredible to watch their skills develop and see th em take pride in working with their hands.

Beyond carpentry, the students experienced a wide r ange of hands-on activities. They explored welding with Mitchell Tech and gained insi ght into plumbing, HVAC, and electrical work alongside Loyal Plumbing, Muth Elec tric, and Midwestern Mechanical. They also learned to operate heavy equipment with L EI and practiced concrete pouring with Seco Concrete, broadening their understanding of the diverse career paths within the construction industry.

While much of our focus has been on workforce devel opment, we’ve also had important discussions on community safety and government affa irs. Recently, we participated in a presentation with the Rapid City Fire Department ab out upcoming fire code upgrades scheduled for this fall. Through the Government Aff airs Committee, we provided feedback to the Fire Chief and his team, advocating for cost-effective solutions to meet the challenges of an increasingly high-priced housi ng market. We are also excited to see where the Rapid City Cit y Council will allocate the Vision Fund money, as it plays a critical role in supporti ng key community projects. Additionally, the Government Affairs Committee is a ctively working on a letter regarding OSHA's new heat standard, ensuring that the voices of our industry are heard in this important conversation.

As we move toward the end of the year, these experi ences remind us of the value of investing in both workforce development and thought ful collaboration on government regulations. Together, these efforts strengthen our community and prepare us for a resilient future.

IMPORTANT UPDATE

FEDERAL DEPARTMENT OF LABOR LAWS ON EMPLOYEE CLASSIFICATION AND NEW SALARY THRESHOLDS EFFECTIVE JANUARY 2025

Dear Members of Black Hills Home Builders Association:

I hope this newsletter finds you well. As we approach the new year, I would like to bring your attention to significant updates from the U.S. Department of Labor (DOL) regarding employee classification and salary thresholds that will take effect in January 2025. Understanding these changes is crucial for ensuring compliance and maintaining fair labor practices within your organization.

1. EMPLOYEE CLASSIFICATIONS: Understanding Exempt vs. Non-Exempt Status

The classification of employees is essential for determining their eligibility for overtime pay and other benefits. The DOL differentiates between exempt and non-exempt employees based on specific criteria:

Exempt Employees- Generally, these employees are NOT entitled to overtime pay. They typically fall under categories such as executive, administrative, professional, and outside sales roles. To qualify as exempt, employees must meet certain duties tests and a minimum salary threshold.

Non-Exempt Employees- These employees are entitled to overtime pay for any hours worked over 40 in a workweek.

2. NEW SALARY THRESHOLDS STARTING JANUARY 2025

Beginning January 1, 2025, the DOL will implement an increase in the salary thresholds for exempt employees. The new salary thresholds are as follows:

Standard Salary Level- The minimum salary threshold will increase to $58,656 annually.

Highly Compensated Employees (HCE)- The threshold for HCEs will rise to $130,000 annually.

These adjustments mean that many employees who were previously classified as exempt may need to be re-evaluated based on their job duties and compensation structure.

3. REQUIREMENTS FOR INDEPENDENT CONTRACTORS VS. W-2 EMPLOYEES.

SD DOL Has Increased Scrutiny on Classification: Regulatory agencies are sharpening their focus on the proper classification of workers, with significant penalties—including taxes and fines—awaiting those who misclassify employees. The South Dakota Department of Labor is now auditing construction companies that have workers designated as 1099 employees. Click HERE for more information.

Revised Guidelines: New federal and state guidelines emphasize the importance of the "economic reality" test, which looks at the overall relationship between the worker and the employer. Key factors include:

Degree of Control: Evaluate how much control the employer has over the worker’s daily tasks and schedule.

Investment in Tools: Consider who provides the tools and resources necessary for the job.

Opportunity for Profit or Loss: Assess whether the worker has a chance to make a profit or incur a loss based on their own business decisions.

Written Contracts: It is now recommended (and in some cases required) to have clear, written agreements outlining the nature of the relationship, payment terms, and scope of work for independent contractors. This helps clarify expectations and protects both parties.

4. NEXT STEPS FOR COMPLIANCE

Review Employee Classifications- Employers should conduct a comprehensive review of their current employee classifications and ensure that those who are classified as exempt meet both the duties tests and the new salary thresholds as well as reviewing the status of their independent contractors. Conduct a thorough audit of employee classifications and compensation. Identify any positions affected by the new salary thresholds.

Adjust Compensation Structures- Businesses may need to adjust salaries or consider reclassifying employees to comply with the new thresholds. This could involve increasing salaries for currently exempt employees or reclassifying some positions to nonexempt status, which would require paying overtime.

Update Policies and Training- It's essential to update company policies regarding overtime and employee classification. Training HR personnel and management on these updates will help ensure proper implementation.Communicate changes to employees clearly and transparently.

Update Employee Handbook- Having an updated Employee Handbook is crucial for companies, as it provides legal evidence that your policies align with and promote compliance with employment laws. This helps ensure that both management and employees understand their rights and responsibilities.If you currently do not have an Employee Handbook, I highly recommend that you create one. I would be happy to be a resource.

5. STAY INFORMED

It is vital to stay informed about changes in labor laws to maintain a compliant and fair workplace. If you have any questions or need assistance in navigating these changes, please do not hesitate to reach out. Your proactive approach will help ensure a smooth transition as we enter 2025.

On March 16, 2024, Tanner Williamson was involved in a devastating car accident in Timberlake, SD, after helping a local rancher with calving He was ejected from the vehicle, sustaining severe injuries, including a dislocated and fractured C6/C7 in his neck, which left him paralyzed from the chest down, as well as fractures in his thoracic spine and sternum. Tanner was airlifted to Monument Health in Rapid City for emergency surgery and spent two weeks in ICU before being transferred to Craig Hospital in Englewood, CO, where he has faced numerous challenges but has shown remarkable improvement in his arm and hand function through dedicated therapy. The Williamson family is incredibly grateful for any community support as they navigate substantial medical bills and home modifications to make their home wheelchair accessible, hoping to bring everyone together for Tanner during this difficult time

Legend was born three and a half weeks early and spent time in the NICU due to respiratory issues. After multiple hospitalizations, he was diagnosed with severe asthma in May 2024. He became critically ill with pneumonia, MRSA staph, acute respiratory disease, pulmonary hypertension, and para-influenza

On May 16, 2024, Legend was placed on a ventilator, and after his condition worsened, he required CPR twice during the night. Doctors warned that he might not survive the transfer to a specialized hospital by noon the following day He was life-flighted to Omaha Children’s Hospital, where he was placed on a ventilator again and contracted pneumonia a second time.

On June 6, 2024, he finally opened his eyes after what felt like an eternity. Following several more days of treatment, he showed progress but had limited mobility He was transferred to Madonna Rehabilitation Hospital and discharged on June 15, 2024

Now four years old, Legend continues to improve every day with the help of occupational, physical, and speech therapy. His mother, a devoted single working parent, balances her job with the need to take time off for his care.

Aaron Rahn, a vibrant 20-year-old who recently married Jennifer and became a devoted stepdad to her daughter Weslynn, suffered critical injuries in a vehicle rollover accident on August 14th He sustained a broken back that has left him paralyzed from the waist down, along with extensive facial injuries, including the loss of his left eye. Despite these challenges, Aaron’s passion for the outdoors and his big-hearted nature shine through; he is deeply loved by his family, including his six siblings, with whom he shares countless adventures As his family navigates the long road ahead facing medical expenses, the need for a wheelchair that accommodates his love for the outdoors, and necessary home modifications they are determined to support Aaron’s recovery and ensure his future is filled with hope and love
