Product Liability Bill Passes House

Most of the products we buy and use work pretty well. But occasionally a product fails with serious consequences. Users can be maimed, even killed. Damages can go beyond the physical to include psychological injuries. It can be a nightmare for the buyer. But increasingly in our litigious society, it can be a nightmare for the entire chain of distribution that delivered the product to the buyer.

After the injury come the doctors. And after the doctors, just as surely as God made little green apples, come the lawy-ers. The lawsuits the attorneys file bring with them enormous costs in time, money, lost productivity and an apple orchard of stress. Many times the victims claims are justified. But too often thev are not. But valid or not. the lawyers sue all the way up and down the distribution chain. It's not a pretty picture.

But help may be on its way. The U.S. House of Representatives has passed H.R. 2366, "The Small Business Liability Reform Act of 2000." The National Association of WholesalerDistributors has lauded the legislation, observing

that in product liability lawsuits it would "significantly limit the liability of non-manufacturer product sellers such as distributors, retailers, lessors, and renters only to harms caused by their own negligence or intentional wrongdoing, the product's breach of the seller's own express warranty, and for the product manufacturer's responsibility when the manufacturer is judgementproof."

The bill also eliminates joint (deep pockets) liability for "noneconomic loss" and limits punitive damage awards to $250,000 for cmployers with fewer than 25 full-time employees that become defendants in civil lawsuits. Neither of these provisions would apply to lawsuits involving certain egregious misconduct and states could opt-out by statue.

NAW's vice president for government relations Jim Anderson notes "the efforts of the House...builds significant momentum for the work we need to do to move this legislation through the Senate." We wish them well.

nother year of change shook up the treating industry, as 22 of the Top 25 swapped positions in this year's ranking of the nation's largest.

While Universal Forest Products remained well ahead of the pack, Great Southern Wood Preserving regained the #2 position by leapfrogging GeorgiaPacific-despite G-P's acquisition last year of former #15 Mellco.

Another big storyline was the rise of western treaters. The region's two largest treaters each surged five spots, McFarland Cascade increasing production 257o to reach #12 and Allweather Wood Treaters upping output 27Vo

Answers to common questions about engineered wood panels

lr-THANCES ARE, if you're involved with engineered \-t wood, you've had an occasion to call the manufacturer about some aspect of installation or design. As more

designers specify, more builders use and more dealers stock engineered wood products, more questions arise, from proper installation details to selectingthe right product for the right application.

At the APA Product Support Help Center in Tacoma, Wa., specialists handle hundreds of inquiries a week from dealers, builders, framers and designers who are using or planning to use engineered wood products. Here are some of the most frequently-asked questions:

Q wrrl.r, is stronger, plywood or OSB?

A

A The two products are virtually interchangeable. That's because both products, although different in composition and appearance, are manufactured according to the same performance standards. These standards apply the same performance criteria to both products for their designated snd uss5-sheathing, single-layer i"?Hil?""1*#:'#l'"'*l';ff ii,l- #w* | wood and OSB are qualified were developed to ensure reliable performance in service, to address a changing wood fiber supply, and to remove obstacles to innovative manufacturins technology.

A y"r. Since wood is a biological material and can expand when it absorbs moisture, panels should be spaced at ends and edges. The "Sized For Spacing" notification is intended to facilitate proper installation and specifies that the panels may be cut less than nominal dimensions from the mill to account for any expansion that may occur. The size tolerance of a 4'x8' "Sized For Spacing" panel, therefbre, may be 1/8" less than the specified length and width, e.g.,47-718"x95-7/8". However, since the size tolerance given in the performance standard allows up to l/8" less than the specified length and width, a 471/8"x 95-7/8" panel may or may not be stamped "Sized For Spacing."

How do I know if a particular panel meets the live and dead load requirements? A

The fastest way to determine live and dead load capacities is to check the APA load soan tables for roof and floor applications in the APA Residential and Commercial Design Guide. The tables provide allowable live loads for F panels installed over common support : (oist. truss or rafter) spacing configurations. The guide is available from our publications department or online at www.apawood.org.

Plywood (all-veneer) APA Rated Siding is often used for shear wall sheathing. The thickness of the panel at the point of nailing on the panel edges governs shear values. Other APA Rated Siding panel types may also qualify for shear values on a proprietary basis. To check for specific shear values, refer to the APA Residential and Commercial Design Guide.

Q Wf,", is the difference between Exposure I and Exterior panels?

A npn ftademarked panels may be produced in four exposure durability classifications: Exterior, Exposure l, Exposure 2, and Interior. The exposure durability classification relates to glue bond, and thus to structural integrity.

Exterior panels have a fully waterproof bond and are designed for applications subject to exposure to the weather or to moisture for its entire service life. Exposure I panels have a fully waterproof bond and are designed for applications where construction delays may be expected prior to providing protection.

Exposure I panels are made with the same exterior adhesives used in Exterior panels. However, because other compositional factors may affect bond performance, only Exterior panels should be used for permanent exposure to the weather.

Exposure I panels may also be used when exposure to the outdoors is on the underside only, such as roof overhangs.

How long can structural wood panels be exposed to the weather?

A t"." are many factors that affect the durability of wood structural panels, and each situation is unique. Although subjective, one way to determine if floor panels are suitable for use after a period of exposure is to walk on them. If they feel solid compared to your previous experiences with similar panels, spans and supports, they are "OK." After exposure to weather, panels often look rough but remain structurally serviceable. After the building is "closed in" and protected from the weather, the floor should be allowed to dry to in-service moisture conditions.

Before installing any finish flooring, the floor deck should be inspected for flatness betweenjoists, and also for smoothness along end and edge joints between panels. Any ridges or thickness swelling at these locations should

be sanded smooth. Wall and vertical surfaces allow water to "shed" quickly. Later, after the roof framing, sheathing and roofing are installed, roof overhangs (if provided) will further protect the sheathing from exposure, although the panels may get wet from exposure to rain especially on the lower parts of walls or if wind-driven rain occurs.

Before installing the exterior and interior finish, wall sheathing should be allowed to dry so that moisture absorbed during construction will not be trapped within the wall cavity. For roofs, APA recommends covering the sheathing as soon as possible after installation. This will allow the interior of the building to start the drying process. If this is not possible, and the roof sheathing has been exposed for a period of time, allow the roof sheathing to dry (from the underside) before closing in the roof cavity or attic.

Last year, the Western Wood Preservers Institute introduced the CheckMark quality assurance identification program for treated wood products.

The mark would help industry professionals easily recognize and distinguish treated products under the American Lumber Standard Committee treated wood quality assurance program. [n order to comply with the Uniform Building Code, treated wood must be marked by an ALSC accredited agency.

Since the program's introduction, enthusiasm has been building fast. All five AlSC-accredited agencies in the West-Bode Inspection, California Lumber Inspection Service,

AFfER BEING quickly incorporated on tags lrom th€ five grading agercies in the West, the Westem Wood Preseruerc Inslilule's Ched<Mark is now being adopted by groups acros the ountry.

Canadian Softwood Inspection, McCutchan Inspection and Timber Products-immediately signed up to use the logo. Since then, the Southern Pine Inspection Bureau and Florida Lumber Inspection Service have also requested use of the mark. What was intended to be a western only program rapidly turned into a national effort.

WWPI predicts that this year potentially all treated wood intended for structural applications could carry the mark.

"The reason for its rapid acceptance was an urgent need for it," said

Jerry Parks, director of marketing services for WWPI.

Before the CheckMark, code officials were confused about what to look for on treated wood. Since each agency has its own unique mark, and because their marks are located in different positions within the stamps or tags, they were not easy to recognize or find.

"Now, it's simple," explained Parks. "Just look for the CheckMark icon and the agency's mark is right next to it."

Bankrupt TreeSource Building ltself Back Up

After paring back operations, TreeSource Industries, Inc., Portland, Or., is now increasing production at several facilities on its hopeful way toward emerging from Chapter I I bankruptcy.

Although the company did suffer a net loss of $1,538,000 for the quarter ending January 31, the loss was less than half the amount lost during the same period last year. As well, net sales rose 357o from the previous

quarter to $59.5 million. compared to a year earlier, lumber sales volume was up l9%o and revenue per unit of lumber sold was up l3Vo.

Consequently, TreeSource has increased the number of shifts at some of its mills, resulting in increased asset utilization and operating efficiencies. "We continue to focus on beginning the process of updating our facilities, and selling non-core assets to pay down debt," said TreeSource

president Jess Drake.

The firm auctioned off mill equipment from Sedro Woolley Lumber Co., Sedro Woolley, Wa., and Philomath Forest Products Co., Philomath, Or., and is looking for buyers for the land.

Three intact mills also are up for sale: the shuttered fingerjoint mill Midway Engineered Wood Products, Corvallis, Or.; Pacific Softwood Co., Philomath, which is used sparingly for small, special jobs, and fully operating sawmill Burke Lumber Co., West Burke, Vt.

TreeSource will retain the other seven operating facilities in Oregon and Washington.

The company, operating as a debtor-in-possession since filing for bankruptcy Sept. 27, is awaiting a court answer on its proposed reorganization plan, which includes cancellation of the company's current classes of common and preferred stock.

LTHOUGH CCA treated wood is lA,sometimes promoted as "maintenance free," treatment alone does little for appearance or dimensional stability. And, to consumers, the appearance of their deck is just as important as its long-term structural integrity.

While CCA treatment makes wood resistant to decay and insect attack, it also causes changes in the wood structure that affect its appearance, properties and finishability. Its appearance changes to a flat, greenish, less natural hue. The treating cycle of drying, saturating and redrying creates internal stresses that can result in cracking, checking, splintering and grain raising. Chemical interactions can weaken wood and make it more brittle, giving rise to splintering and cracking.

Originally, coatings manufacturers responded by shoe-horning "all-purpose" products into the deck category, with disappointing performance results. In the past few years, however, finishes have been developed that specifically address the special requirements of CCA treated wood.

In addition to the availability of user-applied surface coatings, manufacturers can now add water repellents, mildewcides and toners during the treating process. Yet, according to the Forest Products Laboratory-sponsored Joint Coatings/Forest Products Committee, such ingredients provide initial protection that may last only a few months to a few years. Eventually, surface coatings are required to provide ongoing protection.

Unlike most other wood preservatives, CCA does not adversely affect finishes. It not only readily accepts most coatings, but has been shown to enhance the service life ofwater repellents, paints and stains. In spite of CCA treated wood's general compatibility with most coatings, there are some potential problems:

Lack of Penetration. Many nonfilm-forming finishes such as stains and water repellents must penetrate the wood's surface to work effectively. If treated wood is not sufficiently dried, excessive moisture can impede penetration of finishes. Air dry lumber that is saturated with water before

coating. In most cases, two to three weeks of seasoning in dry weather should bring the moisture content down to an acceptable level.

Substrate Limitations. Southern pine is the most commonly CCA treated species. Its properties enhance its treatability-but work against it as a coatings substrate. In general, southern pine has poorer finish-holding capabilities than cedar or redwood. However, the deleterious effects are somewhat offset by the performanceenhancement properties of the CCA.

Because they are film-forming coatings, they tend to peel, blister and mar when coated on horizontal substrates subject to weathering and traffic.

Clear or pigmented water repellents, wood toners and semi-transparent stains are the most common deck finishes. To work properly, they must penetrate the surface.

Improper Surface Preparation. Surface preparation is integral to the ultimate performance of coatings for any wood surface. Surfaces must be clean, dry, and free of mildew before coatings are applied. The better preparation products will remove dirt, mildew, grayed wood, loose fibers and coating particles in one step.

Weathering or Seasoning. Most new treated wood decks should be protected with a water repellent, toner or semi-transparent stain as soon after construction as possible. Research shows that exposing unprotected wood to weathering for even short periods of time can cause surface damage, reducing the wood's ability to hold onto subsequently applied coatings. Unless treated wood is still very wet, coat it as soon as possible after construction.

Color Bleed-through. As a reaction to CCA, wood takes on a color of anywhere from a light brown to a bluish-green. Since wood is tremendously variable, the color of treated wood can vary significantly from board to board, even within the same board. Clear or lightly pigmented finishes do little to mask or even out the color; the CCA green may show through. Use darker colors, more opaque finishes or a second coat.

Over-application. Many d-i-yers and contractors believe that when it comes to coating, more is better. This is untrue-and a problem for decks. Most deck finishes are designed to penetrate the wood surface. Applying too much may build up a film that can peel or crack. For water repellent products, over-application can create a surface that is waxy, sticky or slick. Over-applied stains can result in sticky surfaces, because the coating build-up interferes with proper drying.

Unlike most other preservatives, ccA does not adversely affect wood finishes.

Horizontal vs. Vertical. Solid color stains and paints can be used successfully on vertical surfaces such as siding, trim and lattice. Yet most treated wood in home construction goes into decks. Paints, varnishes, and solid color stains usually are not recommended for exposed horizontal deck surfaces, treated or untreated.

Follow the manufacturer's label suggestions on coverage. Rough sawn surfaces can absorb more coating than smooth sawn substrates. However, since most CCA treated wood has a smooth surface, take particular care against applying too much material. One coat is sufficient for most deck finishes. Alaska Dealer Selling Out

Kenai Supply, Kenai, Ak., is liquidating its five plumbing and building materials locations, with the retirement of owners Kevin and Keith Wells after 30 years in the business.

Eleven-unit Spenard Builders Supply has purchased Kenai's operations in Kenai and its distribution facility in Birchwood.

Kenai Supply's Kenai location, now being remodeled, covers 70 acres housing a retail store, warehouses, truss plant and yard/storage area. SBS will close its old Kenai store

May 22 to relocate in time for a midJune reopening.

The Birchwood site will be used for additional yard and warehouse space.

Alaska Pipe and Supply agreed to buy the Anchorage location, as well as the company's plumbing and heating inventory.

Keith Wells anticipates the Wasilla store will give way to a road widening project, while the Homer location remains up for sale.

Home Center Worker Slain

Two suspects pleaded innocent to charges they killed a Glendora, Ca., Home Depot employee during a home invasion robbery.

While entertaining friends at his apartment Jan. 21, Joseph M. Koval, 32, answered a knock at the door. Three men were at the door and a fourth was waiting for them in the car.

"They asked for someone bY name," said Sgt. Richard Longshore. "A struggle took place. Shots were fired, and everybody fled." The men then stole unspecified items frorn the home. Koval died at the hospital of gunshot wounds.

Several days later, two men were apprehended and arraigned on charges of first degree murder with special circumstances, robbery and burglary.

Giants Team Up On E-Marketplace

International Paper, Georgia-Pacific Corp. and Weyerhaeuser Co. are jointly developing a global business-to-business online marketplace to buy and sell paper and forest products.

The paper and forest products industry leaders believe that a joint electronic marketplace will benefit customers by simplifying transaction processes, improving information flow and increasing speed of delivery, thereby reducing costs. They hope it serves as a foundation for common industry standards to simplify and accelerate industrywide adoption of electronic commerce.

Providing both procurement and sales functions means the online marketplace could enable participants to streamline purchasing operations, reduce inventories, cut internal costs and increase capital efficiency in the industry.

The business will operate as an independent entity with its own board of directors and management team. Initially, the three founding companies will hold equal equity positions, but expect additional partners to join. Based on its success, the companies eventually may take the business public.

The companies are searching for a chief executive officer for the new operation and are assessing potential technology partners.

The steering committee includes IP's executive v.p. Marianne M. Pars and v.p.-e-business John N. Balboni, GP's v.p.-e-commerce David J. Paterson and director-e-commerce Robert A. Renner, and Weyerhaeuser's senior v.p.corporate affairs Mack L. Hogans and v.p.-strategic planning Darien E. Roseen. Morgan Stanley Dean Witter will provide financial consulting services for this initiative.

Until the marketplace is up and running, which is subject to appropriate governmental and other approvals, the companies will continue to conduct sales and procurement activities as normal, including continuation of IP's previously announced relationship with PaperExchange.com.

"This initiative will aggressively shape the electronic marketplace in the paper and forest products industry to ensure our industry meets the current and future needs of our customers," said Steven R. Rogel, Weyerhaeuser's chairman, president and chief executive. "It will also promote better relationships with other trade partners, such as suppliers."

Special Orders Via Web

Payless Cashways, Inc., is developing a new e-commerce system to help streamline special orders and improve profitability.

The initiative is being tested with several vendors and one store before being rolled out with multiple vendors to all stores in the second halfofthe year.

The retailer hopes the business-to-business system will provide a variety of e-catalogs for each type of professional customer, such as electricians and plumbers.

To achieve this, Dennis Smith, Lewis Logan, John Cramer and Jim Hollingsworth have been reassigned to an e-commerce development team.

Lowe's Casting Off Eagle Name

Lowe's is well underway converting all its Eagle Hardware & Garden stores to Lowe's Home Improvement Warehouses by year's end.

Since acquiring Eagle last April, Lowe's had moved forward slowly, first by switching Eagle stores to Lowe's computer system and in-store credit cards.

More noticeable will be changes this year, including reconfigured store layouts, addition of some new, Lowe's exclusive products, signage, store colors and the name itself.

The first Eagle to be converted, in Norwalk, Ca., closed last October and reopened in January as a Lowe's. Next up are the four remaining Eagles in California, which will be changed over without closing, then stores in other states, with Puget Sound, Eagle's strongest market, saved for last.

The conversions coincide with continuing layoffs at Eagle's former Renton, Wa., headquarters as well as transfers to Lowe's smaller, regional office, located above an Eagle store in Tukwila, Wa.

Eventually, Lowe's also may close Eagle's 265,000-sq. ft. Auburn and

306,000-sq. ft. Kent, Wa., distribution centers, which are dwarfed by Lowe's latest 1.25 million-sq. ft. superwarehouses.

"The facilities we operate are much larger, highly automated and serve up to 100 stores," explained Lowe's corporate spokesman Brian Peace.

Copeland Finds More Buyers

Copeland Lumber is down to operating 26 lumberyards after finding buyers for four more locations.

Three-unit Frontier Industries, Anacortes, Wa., agreed to purchase Copeland's Freeland, Wa., unit, while Home Lumber, San Bernardino, Ca.. agreed to buy yards in Bishop, Ca., and Yerington, Nv.

Parr Lumber, which last year acquired seven Copeland yards, will also purchase the Albany, Or., facility.

Bruce Oswald, assistant mgr. of Parr's Hillsboro, Or., location and an employee of the chain since 1981, will be the new manager in Albany. Most of the Copeland staff will remain, with the addition of a new contractor salesman. Jon Rae. former-

Copeland closed yards in Ferndale and Oak Harbor, Wa., Feb. 4.

Ziggy's Merging Businesses

Ziggy's continues integrating the electrical and plumbing outlets it acquired last year into its building materials locations.

In July, Ziggy's acquired four-unit Zig's Electric & Plumbing from Dave Moore. who founded the business in 1969 with Vern and ErnieZiegler.

Two of the locations. which shared a roof with Ziggy's stores on Valley and North Point streets in Spokane, were easily combined with the hardware stores by tearing down a divider wall and merging the sales forces.

The company is just finishing remodeling its Market Street store in Spokane, since the local Zig's was in a separate building, requiring its operations be relocated. The unattached businesses in Hayden Lake, Id., have yet to be merged.

Ziggy's stores built in the 1990s in Post Falls and Lewiston, Id., already have electrical and plumbing departments.

In addition, Ziggy's continues scouting for sites in new markets, including Moses Lake, Wa.

NAWLA Annual Meeting

A full roster of educational programs, activities and the like will be held during North American Wholesale Lumber Association's l08th annual meeting April 29-May 2 at the La Costa Resort and Spa, Carlsbad, Ca.

An 8:30 a.m. board meeting starts things off Saturday, April 29, the day's sole event.

Sunday's events include a business breakfast, brunch, silent auction, golf tournament, and a Manufacturers Council advisory committee meeting.

The general session and keynote address begins at l:fi) p.m., including presentation of the Mulrooney Award. Jim Livermore, NAWLA chairman, will moderate an educational program panel discussion afterwards, followed by a welcoming party.

Lowe's Giving Stock Options

Lowe's Cos., North Wilkesboro, N.C., wants to establish an employee stock options plan to recruit and retain workers.

The proposal, which is awaiting Securities and Exchange Commission approval, allows eligible employees to purchase Lowe's shares from biweekly payroll deductions, ranging from l7o to2l%o.

Under the plan, full-time employees can exercise their stock options twice a year.

Sears & AOL Form Alliance

Sears and America Online have agreed to market each other's products and services.

As the retailer's preferred service provider, AOL will issue a new cobranded software edition with special offers and links to sears.com, which sells tools, appliances, lawn and garden equipment and other products.

In turn, Sears will promote AOL's products and services in its stores and in its media advertising, the latter, providing special offers to the service provider's subscribers.

The firms will create online home improvement content that will enable consumers to communicate with Sears' customer service in real time.

A new, fully computerized pressure treating system has been added at California Cascade's Fontana, Ca., facility.

The Sacramento, Ca.-based firm also added a new pressure treating cylinder, doubling capacity, as well as adding 100,000 sq. ft. ofnew covered storage at Fontana.

Anderson Lumber Agrees To Sale

Growing closer to becoming "a national player," Carolina Holdings, Raleigh, N.C., the nation's largest pro dealer, agreed to purchase I lO-year-old, family-owned Anderson Lumber, Ogden, Ut.

Anderson, the largest independent pro dealer in the Intermountain region, operates a distribution center, seven truss plants and 34 yards, mostly in Utah and ldaho, with one each in Montana, Oregon, Washington and Wyoming.

Anderson's Ogden headquarters are expected to serve as Carolina Holdings' western regional hub, headed by Anderson's longtime president and ceo, James C. Beardall.

Carolina Holdings operates more than 150 outlets in 15 states-of which only two are in the West, California, home to 24Tetry Cos. locations, and Colorado, site of six Denpak and Kroonenberg Lumber yards.

The acquisiton, anticipated to close by May l, would boost the company's annual sales to more than $2.5 billion.

With record 1999 sales of $400 million, Anderson quadrupled sales and quintupled earnings during the decade.

Hit The Road, Jack!

Federal officials have proposed rules that will close some existing forest roads and make it tougher to build new ones.

Reporledly, over 380,000 miles of roads wind through national forest lands, mostly in California and the West. Of these, only 2OVo can be maintained, according to the U.S. Forest Service, which said the majority of the roads are crumbled and causing environmental damage.

While the Clinton Administration issued a moratorium

last year on building roads on 50 million acres of roadless national forest land, a final decision on how much land will remain roadless is expected later this year.

The new regulations emphasize maintenance and reconstruction of existing roads rather than new ones, said Agriculture Secretary Dan Glickman, much to the delight of environmentalists.

Loggers, on the other hand, claim the proposals are helping to run them off federal land.

Gonsolidation Creates Mega-Firms

The rapid number of worldwide consolidations has quickly changed the ranking of global lumber companies, according to Wood Markets.

Consequently, U.S. companies are being displaced as the world's largest and most dominant lumber producers.

Weyerhaeuser improved its domination as the world's largest softwood lumber producer in 1999 by acquiring MacMillan Bloedel, increasing capacity to more than 5.5 billion bd. ft.

After Big W, come five tightly grouped firms with capacity ratings between 2.55 and 2.7 billion bd. ft.

The proposed UPM-Kymmene/Champion International merger finished second with 2.7 billion M. ft., followed by StoraEnso of Finland whose acquisition of Austria-based Schwieghofer enabled the firm to produce roughly 2.7 billion M. ft.

Georgia-Pacific Corp. came in fourth with 2.65 billion bd. ft., and Canfor Corp. surged into fifth place with 2.55 billion bd. ft., thanks to its late-1999 purchase of British Columbia's Northwood.

International Paper rounded out the top six, with 2.55 billion bd. ft.

what else it could be," he said, elaborating that when laid and polished, the floor gleams with red and cream tones that emit a bronze glow.

The idea for the product came from a vintage-style flooring job Whiteman Lumber did with Atlas Building Center at the circa 1878 Officers Quarters at North Idaho College.

Well aware that similar flooring could be found in countless turn-of-the-century Northern Idaho homes and storefronts, Whiteman Lumber's two mills (the other is in Smelterville, Id.) began producing Bittenoot floors.

"We're a small mill, and can't compete in the commodities market," Corkill said. "The only way we can survive is by making things that are difficult to make."

Corkill, who bought the firm in 1988, reports that the product accounts for roughly SVo of his sales, a figure he wants to increase to259o.

"There's kind of a revival for this type of flooring," he said.

Founded in 1929, Whiteman Lumber Co. began as a timber supplier for a local mining company. Nowadays, the firm does a lot of custom work, including manufacturing wall and ceiling paneling and log cabin siding.

"For a guy like me to survive in a business such as this, you have to have a lot of friends," Corkill joked.

Builders Forsake Old Growth

Under seige by environmentalists, two of the nation's largest home builders, Kaufman & Broad and Centex Corp., agreed to phase out the use of old growth wood products.

After convincing retailers such as Home Depot and Lowe's to agree to stop selling old growth, enviro groups such as the Rainforest Action Network identified home builders as their next target. Protesters at the International Builders Show in January

threatened to begin demonstrations at Kaufman & Broad and Centex new home developments across the country if within two months the firms didn't give in.

Court Refects Enviro Appeal

A Humboldt County, Ca., activist was ordered to repay Pacific Lumber Co. parent Maxxam Inc. $110,122.65 in attorneys' fees for filing frivolous litigation.

In January 1995, Robert E. Martel

filed suit against Maxxam, chairman Charles Hurwitz and other parties, erroneously alleging their misconduct caused the 1988 failure of a Texas thrift. A trial court dismissed the case, finding it "regurgitating political half-truths" and describing Martel as a man who "knows nothing, saw nothing," and 'did nothing. "

Martel's appeal was denied by the Fifth Circuit Court of Appeals.

"Mr. Martel and EarthFirst! have tried for almost a decade to abuse the law in an effort to inflict damage on Maxxam's subsidiary, The Pacific Lumber Co., and destroy the jobs of Pacific Lumber's 1,300 employees," said Joshua Reiss, spokesperson for Maxxam. "The decision sends an important message that such behavior will not be tolerated."

Crown Pacific May SellOut

Plagued with an inexplicably depressed stock price, Crown Pacific Partners, L.P., Portland, Or., has engaged investment bank Warburg Dillon Read LLC to explore strategic alternatives to enhance value for the company's unitholders, including the possible sale of the company.

Other options, according to the company, include a merger, strategic alliance, or management buyout.

According to Crown Pacific president and ceo Peter W. Stott, "Our board and management have determined that despite our continued growth in revenues, earnings and distributions since we went public in 1994. the financial markets are not rewarding our performance and are undervaluing our timberlands and operations. Because the dynamics in the financial markets are outside of our control, we feel it incumbent to seek other alternatives to increase unitholder value."

Last year, the company increased net income 22Vo to $34.4 million on record revenues of $667 million. Operations include more than 835,000 acres of Pacific Northwest timberlands, conversion facilities in Oregon, Washington and ldaho, and wholesale marketing and sales offices in Oregon, Arizona, Nevada, Utah, New Mexico, California and Minnesota.

Pact For Loggers & Enviros?

Six British Columbia timber firms reportedly are close to reaching a pact with environmentalists that would temporarily appease both sides.

The deal forbids logging in specific pristine coastal forests for the next l8 months and prohibits environmentalists from urging customers to shun the companies' products.

The two groups hope to eventually sign a long-term conservation plan for l7 million acres stretching from the province's central coastline up to the Alaskan border.

The timber companies initiated the talks, according to Linda Coady, a Weyerhaeuser Co. spokesperson, who said, "We're concerned with the pressures and market-access restrictions we could be facing if we don't do something."

The five other firms are Western Forest Products, a Doman Industries Ltd. subsidiary; International Forest Products Ltd.: West Fraser Timber Co.; Fletcher Challenge Canada Ltd.,

and Canfor Corp., all of which expressed concern about Home Depot's announcement that it would eliminate wood products from "environmentally sensitive areas" by the end of 2002.

Lowe's Mobile Ad lrks Depot

A trio of trucks brandishing Lowe's Cos. billboards recently paid two surprise visits to a Home Depot in Murietta, Ca., recently, annoying employees and customers alike.

On both occasions. the trucks drove through the store parking lot in

plain view of customers, who called the tactics "immature, insecure and childish," according to assistant manager Ernie Cuellar.

The Temecula Lowe's store manager apologized for both incidents, reported Cuellar, but said the firm's North Wilkesboro, N.C., headquarters directed all marketing campaigns.

While Lowe's spokesperson Suzanne McCoy said the mobile billboards help acquaint area residents with the firm, her Depot counterpart, Carol Schumacher. called the matter friendly competition, nothing more.

Oregon's Gerretsen Gets New Digs

The last time Gerretsen Building Supply Co., Roseburg, Or., opened a new retail store, Lyndon Johnson was president and gasoline was about 25Q a gallon.

Over 35 years later, it's an election year, gasoline is approaching $2 a gallon, and the 77-year-old firm is moving again, this time to a larger location near the Roseburg airport.

"We had outgrown the old store," said co-owner Donda Gerretsen-King, who noted that a third of the store's inventory couldn't be displayed in the old location. Gerretsen's also owns a store in Sutherin, Or.

The company bought the 3-acre airport site and its 26,000-sq. ft. building in 1998, and immediately began a year-long remodel that included expanding the 30-yearold building to include the administrative offices.

The store and lumber warehouses take up less total room than before, according to Gerretsen-King, allowing space for over 5.000 new inventorv items.

"This store is set up more for the do-it-yourselfer than the old one," she said, adding that about 407o of her customers are d-i-yers.

The old location now houses storage and the firm's trucking division, although plans call for a discount lumber shop to open there in the future.

The company's other owners are Eric and Bill Gerretsen and Doug Carl.

Metal Connectors Inspire New Tools

The entire West Coast, particulady Los Angeles, has perhaps the most stringent building codes in the U.S. Not only do California codes often serve as a bellwether for the rest of the nation, but its high standards likely will become more universal with the adoption of the International Building Code 2000, and its enforcement in 2002.

As a result, manufacturers, contractors and code officials are working together to develop solutions for enhancing buildings' ability to withstand catastrophes such as earthquakes and hurricanes.

In California there has been a marked increase in the use of metal

connectors to strengthen joints where beams and posts intersect. While everyone agrees that the addition of metal connectors results in a sturdier connection, some contractors are struggling to keep pace with the trend.

The biggest problem is that metal connector installation is a time intensive process. As more metal hardware is used, contractors are forced to hire additional labor, increasing costs for framing hours. The problem is exacerbated by nationwide labor shortages in the building industry.

Dick Perkins, vice presidentSouthwest Division for connector manufacturer Simpson Strong-Tie Co., says, "Although we have made consistent strides in developing connectors requiring fewer fasteners, the sheer number of connectors required in construction is increasing rapidly, frustrating the contractor. With labor rates running from $12 to $15 per hour for unskilled labor and as high as $50 to $60 per hour for a skilled carpenter or framer, it's clear that timeintensive metal hardware installation can be a major concern from the contractors' perspective, especially with the current labor shortage."

In response, Simpson Strong-Tie recently worked with code officials and tool maker Paslode to develop a power fastening system specifically for installing metal connectors. The Positive Placement System reportedly increases productivity at least threefold, using heat-treated, ICBO-recognized nails, rather than bolts, for a

more structurally

sound connection

Many still believe that bolts are superior to nails for hardware installation. But nails generally perform better, according to Simpson Strong-Tie.

When using bolts to fasten the connector, the process involves attaching markings or using a template, drilling long holes, and disassembling and reassembling prior to securing the fastener. In many instances, the tendency is to over-drill, or correct a hole that's not exactly straight by enlarging one side of the boring. As a consequence, the bolt tends to move in the hole, degrading the overall performance of the connection.

The primary problem with nails has been that most builders in the field simply use the wrong size or type of fasteners. However, if the proper nails are used, you generally get a cleaner connection, despite having to use more nails than bolts to securely attach the hardware. In addition, installing nails is less labor intensive than installing bolts.

The new power tools can shoot l0 nails per second and eliminate hand nailing thousands of nails per day on framing alone.

While contractors initially may balk at the expense of purchasing power nailers and connectors, they usually recover the costs quickly. Eliseo Escobedo, a framer in Orange County, Ca., was among the first to use Paslode's system. At the time, he worked as an hourly framer. But after receiving the new system, he soon became the company's resident metal connector installation specialist.

Today, he owns his own framing company, The Hardware King, and employs l5 to 20 full-time framers, all who use the system exclusively.

Ace Ups Conservation Etforts

Nearing the 30th anniversary of Earth Day April22, Ace Hardware is stepping up its ongoing Conservation Initiative.

Efforts includes national retailer advertising and merchandising support, promotional events, and customer recycling programs to help retailers sell d-i-y products that reduce energy and water consumption or are made of recycled or less toxic materials.

According to retail merchandising mgr. Jimmy Alexander, "\Ve've adopted the Earth Day motto of 'Shop Ace and Make Our World a Better Place' to let our customers know that many of the d-i-y products on the Ace retail shelves can help them save natural resources and money and protect our planet for the future."

Last year, for example, Ace's recycling program collected I 1,000 lbs. of rechargeable Ni-Cd batteries, salvaging over 2,000 lbs. of toxic-heavy cadmium. A similar program to reclaim mercury by recycling fluorescent lamps is expected to expand nationwide by next year.

Among other programs:

o Ace Kids Club features conservation projects;

o Hplpful Hardware Club for Ace customers has special conservation product buys and articles on conservation in its consumer magazine;

o Monthly retail end-caps offer conservation item selections, and

o Conservation-related products are highlighted in national circulars.

Hoping to provide another tool for hedging the price risk of buying lumber, the Winnipeg Commodity Exchange is considering adding contracts for the North American lumber industry.

The Exchange is working with C.C. Crow Publications to study the feasibility of offering derivative, nonagricultural "products which are relevant to the lumber industry and regionally based," said Terry James, chairperson of the new product development committee.

Portland, Or. based market reporter Crows is surveying industry firms to

gather input to be used in designing the contracts.

Currently, the non-profit WCE, Canada's only agricultural futures and options exchange, offers futures contracts on oats and field peas, as well as both futures and options contracts on canola, flaxseed, feed wheat and western badey.

Forestry lnitiative Revised

Seeking to further revolutionize forestry practices, the American Forest & Paper Association has revised the Sustainable Forestry Initiative Standard.

The new 2000 standard includes five sustainable forestry principles, I I objectives and 3 specific performance measures detailing obligations that program participants must abide by. Sixteen companies have been expelled from AF&PA for failure to uphold the SFI Standard since it was adopted in October 1994.

The program's exacting standard and conservation practices encompass wildlife and water quality protection, biodiversity conservation, harvesting practices and a range of other conservation goals. An independent panel, comprised of experts from the environmental, professional, conservation, academic and public sectors, regularly reviews the program and advises AF&PA on its progress.

Robert Weiglein, executive vice president of the Wood Moulding & Millwork Producers Association, Woodland, Ca., has received the

Fred K. Saunders, Jr., 88, retired former co-owner, Economy Lumber Co., Campbell, Ca., died March 20 in Los Gatos, Ca.

A graduate of San Jose State University, he worked for McCloud Lumber, McElroy Lumber and Hubbard and Johnson before joining Economy Lumber in the late 1940s.

He and his partner, Lewis Woodfill, bought the firm in the early 1950s and ran the operation until its 1978 sale to their sons, John Saunders and Bill Woodfill, who remain owners.

James H. Carr, Jr., 85, former ceo, American Lumber Standard Committee, Inc., and retired owner, James H. Carr, Inc., died after a stroke Feb. l7 in Wilmington, De.

A native of Hopedale, Ma., and graduate of the Massachusetts Institute of Technology, he started working for Timber Engineering Co., Washington, D.C., in 1936.

Heran James H. Carr, Inc., Washington, D.C., from 1949 until his retirement in 1977 and served as secretary and ceo of ALSC through 1965.

Stuart MacDonald, 86, retired vice president, Contact Lumber Co., Portland, Or., died March 7 in Prineville, Or.

He began his tenure in the industry in 1939 with Shevlin-Hixon, Bend, Or., where he remained until 1949. save for a stint with the U.S. Navy during WWII.

He worked as a sales manager for Alexander-Yawkey Lumber Co. for several years before joining Contact Lumber in the mid-1950s as a lumber wholesaler.

He was named vice president of the firm in 1959 and served in that capacity until his retirement in 1993.

He was a former member of the Western Wood Products Association and the North American Wholesale Lumber Association.

Ethel T. Miller, 99, owner, Miller Lumber Sales (a.k.a. M.C. Miller Lumber Co.), Cle Elum, Wa., died March 14.

A 70-year veteran of the lumber industry, she began working for her father, the firm's founder. in 1930.

Delbert L. Ivie, 67, founder of Ocotillo Lumber Sales, Inc., Phoenix, Az.. died March 6.

A native of Centerella, Ok., he began his lumber career in the late 1940s with Foxworth-Galbraith, Wickenburg, Az., before serving in the U.S. Army in Munich, Germany.

Following his discharge, he worked for Hamman Wholesale Lumber Co., Phoenix, and Georgia Pacific until he started Ocotillo Lumber Sales in 1961.

A onetime partner in Sun Valley Door, Phoenix. he retired in 1995.

Robert E. Canton, 73, retired chairman, Canton Lumber Co., Minneapolis, Mn., and former chairman, North American Wholesale Lumber Association, died from emphysema and pneumonia March 9 in David, Republic of Panama.

A graduate of the University of Minnesota. he served in the U.S. Army during WWII and worked for Canton Lumber for 40 years, before retiring in 1988.

He was a member of NAWLA and in 1972 was named Lumberman of the Year by the Twin Cities Hoo-Hoo Club.

James Greeley McGowin, 1I,72, current chairman of the American Lumber Standard Committee. died after a brief illness Feb. l8 in Chapman, Al.

A graduate of Princeton University and Pembroke College, Oxford, England, he stayed on with the family business, W.T. Smith Lumber, Chap-

man, after its 1966 sale to Union Camp, becoming v.p. and general mgr.-woodlands & building products, until retiring in 1991. The firm was since acquired by International Paper.

He was a member of the Tax SubCommittee of the American Forest & Paper Association, a director of the Forest Industries Council of Taxation, and a board member and former vice chairman of the Southern Pine Inspection Bureau.

Stan Hayes, 60, owner/operator, Ponderosa Home Center, Pagosa Springs, Co., died of bone marrow cancer Jan. 2 in Pagosa Springs.

He and his family purchased the business in 1984, after previously owning and operating Country True Value Hardware, Granby, Co., for five years.

His family continues to run the business.

Merger Temporarily Derailed

The proposed union of the Burlington Northern Santa Fe and Canadian National Railway is stuck at the station for l5 more months, awaiting the creation of new consolidation rules.

In applying the brakes to what would have created North America's largest railroad, the Surface Transportation Board called the industry "already fragile," and said additional mergers could bring destabilization.

Canadian Northern quickly appealed the decision, while BNSF said it planned to do the same.
