The new assisted living licensure rules effective August 1, 2021, have many providers scrambling to update their knowledge, policies, and procedures to meet regulatory compliance. This learning session will compare and contrast the new nursing assessment requirements and documentation with that of the current home care statute. The session will also include a review of adult protection requirements and mandated reporting requirements. May 18, 9:00-11:00 AM THE GOOD, BAD & UGLY: ASSISTED LIVING CONTRACTS, TERMINATIONS, AND DISCHARGES UNDER NEW ASSISTED LIVING LAW The process for terminating housing services will be changing significantly once the new assisted living law becomes effective in August 2021. Currently, housing terminations fall under the Minnesota landlord–tenant law. Will this still be the case once the assisted living law goes into effect? This session will address how providers can terminate their housing relationships under the new assisted living law, and how housing terminations may be affected by service issues. A housing provider’s obligations when terminating a relationship with a tenant/resident will be discussed, as will a variety of scenarios, including when a tenant stays after health-related services end. In addition, presenters will discuss new contract requirements.

Minnesota’s new assisted living licensure (ALL) requires compliance with new emergency preparedness requirements for your newly-licensed assisted living or assisted living with dementia care. While the ALL 144G statutes include a basic set of emergency preparedness requirements, the anticipated ALL rules include a substantial number of new emergency preparedness requirements. This session will provide an overview of what ALL facilities will need to work on to have compliant emergency preparedness programs. P resenters Doug Beardsley, Vice President of Member Services, Care Providers of Minnesota Doug Beardsley has been involved in the field of long-term care since 1982, when he became a nursing home administrator. Mr. Beardsley has a Bachelor of Science degree in healthcare administration from the University of Wisconsin–Eau Claire. His experience includes 20 years as a nursing home administrator, three years as a long-term acute care hospital CEO, manager of an in-house LTC pharmacy, and other long-term care related activities. Mr. Beardsley has been the vice president of member services with Care Providers of Minnesota since 2005, where he is responsible for the regulatory activities pertaining to nursing facilities, home care, housing with services, assisted living, and hospice. April J. Boxeth, Of Counsel, Voigt, Rodè, Boxeth & Coffin Ms. Boxeth practices in the areas of health law, assisted living, long-term care, senior housing, home care, hospice, and adult day. Ms. Boxeth advises clients in the areas of regulatory compliance, behavior issues, guardian/conservator issues, probate law, accounts receivable, and general corporate matters and is a frequent presenter on all these topics. Ms. Boxeth has worked in health law for more than 25 years; she is a former adjunct professor of the Business Law Practicum at William Mitchell College of Law and currently serves as faculty at the University of MN in the HSM/Long-Term Care Management and Law course. Michelle Klegon, Attorney, Klegon Law Office Ms. Klegon practices in the areas of health law and employment law and has been representing nursing facility, home care, and housing with services providers since 1991. Ms. Klegon advises nursing facility and home care providers on survey and other regulatory matters and assists housing with services providers with fair housing issues, contract drafting and review, and conflict resolution. She also advises employers regarding discrimination issues, policy and procedure drafting, conflict resolution, and a variety of other employment law matters. Ms. Klegon regularly conducts provider trainings on all these topics. Jill Schewe, Director of Assisted Living, Housing & Home Care, Care Providers of Minnesota Jill Schewe has worked in and with assisted living communities her entire career. As a former assisted living manager, her experience was in startup, management, and operations of several assisted living communities. In her current role, Jill works with assisted living providers on any topic they need help with to aid in their success, including licensing, policy, payment, and operational systems. She understands the needs of older adults and homeand community-based services alike. Jill has a BA in sociology and gerontology from Winona State University and an MA in management from St. Mary’s University of Minnesota. Lores Vlaminck, Principal Consultant, Lores Consulting Lores Vlaminck is a provider of consulting, training, and mentoring for hospice, assisted living, home healthcare, and palliative care providing mock surveys, audits, regulatory consultation, education, mentoring, and advice, as well as assistance in developing post audit correction plans. Through Lores Consulting, Lores draws on her 44 years of professional nursing experience to empower her client providers to reach their greatest potential. Her extensive nursing background includes clinical practice in cardiac and intensive care, clinical services, as well as serving as a founder/director of a home care and hospice agency for 19 years in greater Minnesota. In addition, Lores is an approved trainer for the ELNEC curriculum.
