Turning tragedy into inspiration Carlsbad-based Mitchell Thorp Foundation assists families in their greatest time of need

The illness and passing of a child is the worst nightmare of any parent. Aside from the devastation of the loss, nearly 80 percent of families in these situations dissolve, with bankruptcy and family separation as frequent outcomes. Beth and Brad Thorp, long-time Carlsbad residents, have taken the strength demonstrated by their son Mitchell during his 5-year battle with an undiagnosed illness to form a foundation that honors him. The Mitchell Thorp Foundation (MTF) provides financial and emotional support to families who desperately need to come through these tragedies. “When Mitchell passed, it was extremely difficult. But we felt that there was nothing out there supporting families in

families per month with average assistance of $2,500 a month. Even more impressively, they have been able to preserve 100 percent of the families that have come to the foundation since they started their services.

“We miss Mitchell every single day,” added Brad. “But we are fortunate to keep his memory and spirit alive through the foundation. He was such a kind, gentle spirit - he would be proud of all the children and families MTF has helped.” MTF has two primary programs – the Medical and Home Assistance program and the Healing and Wellness program. Each of these programs is tailored to provide customized services that families need to relieve the hardship in their situations. “We are overwhelmed with applications for assistance and it breaks our hearts to have to turn a family away,” commented Beth. “We would like to be able to serve 20 families per month. Our two signature events, and individual donations, are the key to meeting our goal.” The foundation is looking for corporate support in either direct donations or through sponsorship of their events.

It’s a good time to review employee handbooks

This next year will prove to be just as exciting, with the completion of more curb cafes, new restaurants and retail shops. Business is booming in the Village, with a variety of newcomers attracting residents’ attention. Hot spots to check out in 2015 include Vigilucci’s new gourmet market. Also riding the wave of new development are Barrel Republic craft beer bar and Perfect Pairings, a farm-to-table eatery. Retail shops have also made their mark in the community. Newcomer Lollies and Jollies toy and candy store recently opened. Accompanying it are places like Lillie’s Closet, a children’s clothing store and resale shop. Most companies have an employee handbook, but do you know what’s in yours? Better yet, when was it last reviewed for legal compliance? Many small companies have a handbook that was based on (copied from?) another employer’s from years ago. While it may have been good at the time, by now it has probably been edited and patched like a quilt, and some of those policies may be downright dangerous. One example is the old “use it or lose it” vacation policy which has been invalid in California for many years. Another is that old prohibition against “employees discussing their salaries” – a no-no. Even your non-discrimination policy may be out of date, and may not protect you from administrative fines or lawsuits. While new labor laws are created nearly every year, small companies routinely neglect to check their handbooks to match those changes. This year we have the

added prospect of the Healthy Workplaces Healthy Families Act of 2014, which mandates paid sick leave after July 1st. Even if you already have a sick leave policy, the new rules have probably made it obsolete. Does your policy include part-time employees? Do you allow some sick time to carry over year to year? Do you pay for time off for certain crime victims? Some employers have rules allowing time off to care for family members under the “Kin Care” law. Those rules may now conflict with the new mandatory sick leave

law. Are you set up to track sick leave accrual and use? Do you require a doctor’s note for time off? All of these issues are danger zones under the new law. If you fire an employee for abusing sick leave, you could be accused of retaliation and heavily fined, or the employee might sue for wrongful termination, exposing your company to punitive damages. Employers and their managers need to know what the new rules are and how to avoid violating them. Other danger zones in employee handbooks include Internet use policies. Do you prohibit employees from damaging the company’s reputation on Facebook? Do you tell them not to complain about the company in front of customers? These may seem like the natural rights of an employer, but the National Labor Relations Board (which no longer focuses only on union shops) has been cracking down on written policies that it sees as having a “chilling effect”

on the employees’ right to discuss complaints with fellow employees – even on the web. Finally, do you have an arbitration provision that employees sign? Many employers have chosen not to use arbitration for fear the arbitrator will make a mistake and there’ll be no right to appeal. But a properly written arbitration provision can include limited appeal rights, and there may be good reason to use arbitration. Recent federal and state cases have allowed employers to enforce a ban on class-action lawsuits, which can be very expensive to defend even when very little harm has been done. Employers should consider using arbitration clauses to limit the risk of a catastrophic lawsuit. And when you look for updated handbooks and policies, make sure they’re written for California use. Carlsbad’s economy showed gains in 2014 Last year was a good one for Carlsbad’s economy, as key industries added employees, retail sales grew and real estate development gained momentum. Carlsbad’s core industries, which are composed of life sciences, information and communications technology, action sports manufacturing, and clean technology, experienced growth during 2014, with life sciences leading the way. This Carlsbad-based high tech cluster added dozens of companies last year, rising to 180 from 131, for a 37 percent expansion. Life sciences firms also added more than 400 new employees, a growth of 5.9 percent. Two other high tech clusters — information and communications technology, and clean technology — saw small decreases in the number of firms, but significant increases in employment. Information and communications technology dropped to 249 firms from 254, but added 355 employees, a growth of 3.9 percent. Clean technology saw a similar decrease in the number of firms, dropping

to 85 from 90, but a similar expansion in employees, adding 387 workers, for a nearly 8 percent increase. Only the action sports manufacturing cluster contracted, losing two firms for a drop of 4 percent, and 200 employees, or 7 percent, but we see promising numbers in 2015 in this cluster. On the retail front, sales tax revenues were on the upswing, with gains in new auto sales, restaurant sales and consumer building materials. Year-end data were not available, but sales tax revenue showed an increase of 3 percent during the first four months of the new fiscal year, compared with the same period in 2013. Carlsbad continues to be a popular tourist destination,

ViaSat Inc. was one of the Carlsbad companies that helped the city see significant increases in the information and communications technology industry cluster. as indicated by the ongoing increase in transient occupancy tax revenue. For the first four months of the fiscal year, hotel room tax revenue was up 11 percent over the previous year, and on average the hotel room occupancy rate was at 67 percent, 4 percentage points higher than the prior year’s average. Developers continue to show faith in Carlsbad’s future, with more than $2.7 billion in private development projects either under construction or in the planning stage.

Significant commercial projects include the $300 million Westfield Carlsbad renovation, the first phase of which is nearing completion as this is being written. This remodel includes a new 24 Hour Fitness Super Sport, which opened in October, and a new Regal Carlsbad 12 movie theater, which opened last month. The mall will have 1.1 million square feet of leasable space and a new open air, beach themed footprint when the renovation is completed in autumn of 2016.

Another large project is the $75 million La Costa Towne Square shopping center, which is partially open now and scheduled to be completely open this spring at Rancho Santa Fe Road and La Costa Avenue. This 83-acre mixed-use center will offer 267,400 square feet of retail space, featuring a Vons Lifestyle store. The largest project under construction is the Carlsbad Desalination Project, which is hard to avoid if you work along Faraday Avenue. This $1 billion project

includes the desalination plant at the foot of Cannon Road, and 10 miles of pipe that will convey the water to the San Diego County Water Authority aqueduct in San Marcos. The desalination plant will convert 50 million gallons of seawater into drinking water daily when it comes on line later this year, making it the largest desalination plant in the Western Hemisphere. Lastly, many of the industrial buildings that came on line just as the recession hit have been filling up with tenants. Cushman & Wakefield noted in a recent report that the overall vacancy rate for industrial space in Carlsbad was 11 percent, down drastically from the worst of the recession. Available warehouse space is scarce and hard to come by in Carlsbad, as vacancy is down to 2.0 percent. Lease rates, meanwhile, have risen by 10–15 percent as the supply of vacant industrial space has decreased, another sign that the economy is on the upswing. The year 2015 looks promising as many indicators continue to point in the right direction — economic vitality.

As a small-business owner, you’ve worked hard to create a successful enterprise. While it can feel challenging to set aside money for retirement while running a successful business, when you reach the golden retirement age, you’ll be glad you did. Consider the following five retirement planning activities for small business owners.

1. INVEST OUTSIDE OF YOUR BUSINESS

Your business is your livelihood today, but there’s no guarantee it will continue to generate income into your retirement. Like other investors, small business owners should consider diversification. For them, it’s also critical to invest outside their business to grow retirement savings. Ideally, your net worth will be spread over a variety of investments that are in line with your time horizon and risk tolerance instead of solely coming from your business assets.

2. SAVE WITH A TAX-ADVANTAGED RETIREMENT PLAN

Small-business owners can choose from several different retirement plans according to their needs. The 401(k) is the most common option for small businesses and features important plan design options such as penalty-free withdrawals in the event of an emergency and higher contribution limits compared to other retirement plans. a 401(k) that’s especially designed for the sole proprietor. One of the downsides of the 401(k) can be the paperwork. If you prefer less IRS reporting and will accept fewer options, look into a Simplified Employee Pension (SEP) or Savings Incentive Match Plan for Employees (SIMPLE) to start saving for the future. There’s also the traditional IRA, where taxes are deferred until retirement and the Roth IRA, which is taxed up front, so owners can withdraw funds in retirement tax-free if they have met all the rules.

3. LEAVE YOUR NEST EGG ALONE

It’s not unusual for small business profits to fluctuate from year to year, creating inconsistencies in your annual income. If you’re serious about retirement savings, resist the temptation to dip into your retirement funds even when your business isn’t performing up to expectations. A retirement

nest egg that’s left alone can benefit from compound growth, potentially helping you reach your goal sooner.

4. CREATE AN EXIT STRATEGY

Because you’re arguably the most valuable asset in your business, it’s important to plan for the day when you’re no longer at the helm. Do you have an employee or adult child capable of stepping in to run your business? Will you be able to sell your business at an attractive price to fund your retirement? You’ll want to make plans that include assigning a successor or documenting the business value to facilitate a sale if others will be counting on your business to be there, even when you’re not.

5. WORK WITH A PROFESSIONAL

You’re an entrepreneur, so you’re accustomed to wearing many hats. Yet when it comes to retirement planning, it’s wise to consult financial professionals rather than going it alone. A financial planner can help you project what you’ll need for a comfortable retirement and help you devise strategies to reach your goals. If you plan to sell your business one day, consult a business broker for market valuation assistance. GlenBrook adds skilled nursing unit GlenBrook Health Center, a Medicare 5 Star community, has announced the addition of a 24-bed Medicare-Certified unit focusing primarily on rehabilitative care opening this month. This addition will raise the center’s number of skilled beds to 94. The new unit will specialize in the three disciplines of rehabilitation: physical, occupational, and speech therapies, in addition to quality skilled nursing care. Each patient room will be filled with warm, natural light. Semiprivate rooms will offer state-ofthe art ceiling tubes letting in diffused light and will have the restroom in between the residents, providing the effect of a private room. Large private rooms will have the shower included in the restroom. An Activity Department will have an additional space conveniently located in this unit in order to offer patients a myriad of activities throughout the day. Creative crafts such as ceramics, a variety of engaging musical events, thought-provoking discussions and daily exercise are but a few of the expansive program that will be offered. Weekly events will be scheduled to meet the spiritual needs of patients, catering to all aspects of their daily lives. Short-term patients needing skilled nursing care and rehabilitation following an acute illness or surgery are currently managed by a professional staff 24 hours a day/7 days a week. They may require wound care, feeding

It will open this month. tube, IV fluid or anti-biotic management or other specific treatment, and medications ordered by the physician. Occupational, physical and speech therapies enable the patient to better achieve positive results and are under the direction of a physician. Speech therapy encompasses not only speech training but swallowing issues and cognition deficits. The goal is to return patients to their prior level and give them the tools to achieve those goals. These patients are usually “short term” so discharge planning starts upon admission to ensure that all is in place once discharge is at hand, and a Social Services/ Discharge Planner can make the proper home arrangements for care and equipment. Long term custodial care in GlenBrook provides the patient with assistance in the normal activities of daily living (ADL’s). These ADL’s include personal hygiene, dressing, ambulation, transferring (moving from bed to chair or chair to commode), feeding and toileting.

Medications and treatments are given by the nursing staff as ordered by the patient’s physician. GlenBrook Health Center works very closely with the families of its patients and physician to provide a quality-filled environment and life. In order to offer a full spectrum of care, GlenBrook works with a variety of hospices to offer routine hospice care in the skilled nursing unit when end-of-life issues arise. Quality of life while ensuring comfort is GlenBrook’s primary goal. Hospice staff works in conjunction with the nursing staff to provide the ultimate comfort and palliative care in a quality setting. County’s industrial vacancy rate continues quarterly drop An industrial report released by Cassidy Turley says that industrial vacancies have dropped to levels not seen since 2001. According to the report, San Diego County generated 386,000 square feet of positive net absorption across all product types in the third quarter of 2014, bringing year-to-date activity to 1.2 million square feet, more than half of which occurred in North County submarkets. Current vacancy is 160 basis points (bps) lower than the vacancy rate of 8.7 percent a year ago, and 560 bps lower than the peak rate of 12.7 percent recorded five years ago in fourth quarter of 2009. “The last time countywide vacancy below 7.1 percent was 13 years ago, in the fourth quarter of 2001,” said Aberg. Over the past four years, the countywide monthly asking rent for all product types has only increased from $0.78 to $.80 per month, per square foot triple net (NNN). CBRE Inc. announced that San Diego-based Cruzan, a commercial real estate development, re-development and investment firm, sold Pacific View Plaza, located at 5973 Avenida Encinas in Carlsbad, for $13 million. The three-story, 51,825-squarefoot office building was 96.7 percent leased at the time of sale. Cruzan purchased Pacific View Plaza in June 2013 and completed renovations including a redesign and build-out of new lobbies, resort-style restrooms and showers, landscape upgrades, enhanced aesthetics and usage of the common areas with teak seating, and the creation of Class A speculative office space, according to a press release from CBRE.

Still, industrial rental rate growth remains strongly dependent upon the age and quality of product on the market. “That being said, with the expectation of continued healthy absorption levels and falling vacancy, we anticipate that rental rate growth will expand throughout the region’s industrial sector, as will the tightening of concessions, in the months ahead,” said Dennis Visser, managing director with Cassidy Turley. In 2015, all employment sectors combined are forecasted to grow 2.3 percent, or by 31,100 jobs, countywide, with the manufacturing and wholesale sectors forecasted to grow by 0.7 percent or 980 jobs, positively affecting demand for industrial space. “Tenants currently in the market are looking for 4.4 million square feet over the next 24 months countywide,“ said Mr. Davis. “Until new speculative construction returns, the steady absorption of existing inventory will continue to drive vacancy rates lower.”

brief ceremony to dedicate the sign and light it for the first time from 5:30-6:30 p.m. on Jan. 8. The public is invited to join the Chamber and City officials to mark the historic occasion. “This sign, which will be enjoyed by current and future generations of Carlsbad residents and those who visit our city, adds a distinctive touch to the Village area,” said Ted Owen, president and CEO of

the Carlsbad Chamber of Commerce. “It’s a testament of the positive impact that businesses and the Carlsbad Chamber of Commerce have had in forging the future of the City of Carlsbad over the years.” Established in 1923, the Carlsbad Chamber of Commerce was instrumental in the city’s push for incorporation in 1952. In its early days, the Chamber took responsibility for some of the civic

duties that came under the purview of the City Council after incorporation, including tree-trimming and street repairs. The sign was spearheaded by Carlton Lund, the immediate past chairman of the Chamber’s board of directors. It was made possible by a contribution from the TaylorMade Golf Co., a long-time supporter of the Chamber and of numerous

philanthropic efforts in the region. “The Carlsbad Chamber of Commerce is in the position that it is — the second largest in San Diego County and the 10th-largest in the state, because of its passionate and dedicated members,” Owen added. “I thank TaylorMade Golf for its generous contribution and Carlton Lund for his dedication to make this sign a reality.”

The Carlsbad City Council approved the sign in June. At the time of approval, Councilman Keith Blackburn said he’s often felt jealous of communities that had similar signs. “It just sends the message that we’re proud of our community,” Blackburn said. “I really like the idea that we’re mimicking our 1930s sign — that has a lot of historical significance.”
