De când mă știu m-am obișnuit cu românii, cu imparțialitatea lor proverbială, cu știința și priceperea lor în tot ceea ce mișcă pe lumea asta, fie fotbal, politică sau marketing, dar tot nu pot să-nțeleg de unde atâta haos și indecizie în mintea loc când vine vorba de un eveniment.
Ever since I know myself, I have become accustomed to Romanians, to their proverbial impartiality, to their science and skill in everything that moves in this world, be it football, politics or marketing, but I still can’t understand why so much chaos and indecision in mind place when it comes to an event.
Dacă nu-l inviți pe român, se supără pe tine, dacă îi spui că trebuie să plătească ca să vină, vrea discount cât mai mare (de parcă tu n-ar trebui să trăiești ci doar el...), dacă îi dai discount spune că e prea mic și te vorbește peste tot de rău iar dacă îl inviți gratis, nici nu vine. Oare cum se numește asta?

Today we will talk to Romeo Ungureanu, development manager at PowerBet. ➤ Even though it hasn’t been long since the last interview, we know that some changes have taken place in PowerBet. We are curious to know how PowerBet has evolved? We all know that the pandemic period was difficult for the gambling industry, especially for the landbased sector, in other words the changes that took place in society during this period also brought with them changes in the industry. The most significant effect of the pandemic, probably very common in all those involved in this field, is closely linked to these changes which have led to re-evaluations and changes in projects or business plans. I’m glad that now

Cu toții știm că perioada pan demiei a fost di fi cilă pentru in dustria de gambling, în special pentru sectorul land-based, cu alte cuvinte schimbările care au avut loc la nivelul societății în această perioadă au adus cu ele și schimbări la nivelul industriei. planurilor de business. Mă bucur că acum putem discuta de această perioadă la trecut și iată că se conturează și mult aștep tata revenire la normal. Chiar dacă am traversat o perioadă de încercare pentru noi toți, echipa PowerBet s-a adaptat, ajungând chiar la o creștere a congruenței la nivelul grupului nostru. Principala noastră misiune a fost și este în continuare de a menține standardele la cel mai înalt nivel, întrucât pentru noi acest lucru reprezintă, de fapt, îndeplinirea obiectivelor. PowerBet este
deja în toată țara, iar recent ne-am extins din nou echipa, în prezent PowerBet ajungând la un număr de peste 1200 locații, atât proprii cât și în sistem de franciză. Odată cu dezvoltarea în land-based, am mărit considerabil numărul de terminale de pariere, ajungând astfel la un număr de peste 500. Dacă tot suntem la capitolul numere, merită menționat că și portofoliul de slot-machines al companiei noastre s-a mărit, ajungând la un număr de 650 de aparate, toate adaptate la cerințele și rigorile pieței din România.

De asemenea suntem atenți la preferințele clienților, la stilurile de pariere ale acestora, toate acestea pentru a ne adapta cerințelor, luând în considerare tendințele din acest domeniu și de asemenea și competiția. Toate aceste aspecte sunt analizate cu scopul de a ști unde să intervenim și ce să îmbunătățim la serviciile noastre. O noutate în ceea ce privește PowerBet este că de curând am semnat un contract cu una dintre cele mai importante companii de software pentru gambling din Germania, împreună cu aceștia dezvoltând și implementând o nouă platformă de pariere, mult mai accesibilă. Practic, în prezent PowerBet are un soft propriu, rezultatul muncii noastre, începută de mai bine de un an. ➤ Cum au răspuns clienții și partenerii la această schimbare? Feedback-ul pe care l-am primit a fost pozitiv, într-un fel a fost de așteptat să fie așa întru cât la nivel de echipă am muncit și am canalizat toată atenția în acest scop. Market sentiment is positive and growing; it is also nor-

The most important news for our customers is that soon we will make our presence felt online, where we will benefit from a dynamic platform in which the offer of sports betting (prematch) will be similar to that found in retail agencies, at the same time maintaining all the promotions that make us unique in the Romanian betting market. At the moment we are very close to the finish line of this project, a project very dear to us and from which we have high expectations.

– a quick and easy way to recover claims – Având în vedere că în ultima perioadă, dat fiind contextul economic în care ne aflăm, tot mai mulți operatori economici întâmpină dificultăți în a-și recupera creanțele de la debitorii rău-platnici, în acest număr al revistei ne-am propus să vorbim despre procedura specială a ordonanței de plată, o modalitate rapidă și simplificată prin care creditorii pot obține de la instanțele de judecată un titlu executoriu prin intermediul căruia să îi constrângă pe debitori să își execute obligațiile de plată restante. Procedura specială a or
donanței de plată se găsește reglementată în Capitolul IV, Titlul IX, art. 1014 – 1025 din Codul de procedură civilă și reprezintă, în linii mari, o alternativă a cererii de chemare în judecată având ca obiect pretenții bănești, creditorii având libertatea de a alege între demararea procedurii speciale a ordonanței de plată sau a procedurii de drept comun, în funcție de situația de fapt cu care se confruntă și de riscurile pe care sunt dispuși să și le asume, ambele proceduri prezentând atât avantaje, cât și dezavantaje.

1014 - 1025 of the Code of Civil Procedure and is, in general, an alternative to the claim for money claims, the creditors having the freedom to choose between the initiation of the special procedure of the payment order or the common law procedure, depending on the factual situation they face and the risks they are willing to take, both procedures have both advantages and disadvantages. Application domain of this special procedure of the payment order is provided in the provisions of art. 1,014 of

Domeniul de aplicare al acestei proceduri speciale a ordonanței de plată este prevăzut în dispozițiile art. 1.014 din Codul de procedură civilă, conform cărora ordonanța de plată se aplică creanțelor certe, lichide și exigibile care au ca obiect obligații de plată a unor sume de bani ce rezultă din executarea unui contract civil, inclusiv din cele încheiate între un profesionist și o autoritate contractantă, constatat printrun înscris ori determinat potrivit unui statut, regulament sau altui înscris, însușit de părți prin semnătură ori înalt mod admis de lege. Prin excepție, conform alin. (2) al textului de lege anterior menționat, procedura ordonanței de plată nu este admisibilă și nu poate fi folosită de creditori pentru recuperarea creanțelor înscrise la masa credală a debitorului în cadrul procedurii de insolvență a respectivului debitor. După cum se poate observa, definiția statuată de legiuitor limitează domeniul de aplicare al acestei proceduri speciale și condiționează admisibilitatea unei cereri de ordonanță de plată de îndeplinirea cumulativă a mai multor condiții pe care ne propunem să le analizăm în cele ce urmează. În primul rând, în ceea ce privește izvorul juridic al creanței ce face obiectul cererii de ordonanță de plată, aceasta trebuie să rezulte fie dintr-un contract civil constatat printr-un înscris, fie dintr-un statut, un regulament sau un alt înscris, însușit de părți prin semnătură ori în alt mod admis de lege. Prin noțiunea de contract civil constatat printr-un înscris se înțelege fie un contract încheiat atât între persoane fizice, cât și între profesioniști, între o persoană fizică și un profesionist sau între un profesionist și o autoritate de natura celor arătate la alin. (3) din art. 1014, condiția fiind ca acest contract să fie încheiat în formă scrisă și, bineînțeles, semnat de toate părțile contractante.
În ceea ce privește obiectul contractului, acesta trebuie să stipuleze în sarcina uneia dintre părți o obligație de plată a unei sume de bani, putând fi vorba așadar de orice contract civil (prestări servicii, locațiune, vânzare, mandat, etc.) care presupune un „preț” în bani pe care debitorul este ținut să îl suporte în schimbul serviciilor sau bunurilor oferite de creditor. As can be seen, the definition given by the legislator limits the scope of this special procedure and makes the admissibility of an application

for a payment order conditional on the cumulative fulfillment of several conditions which we propose to consider below. First, as regards the legal source of the claim which is the subject of the request for payment order, it must result either from a civil contract established by a document or from a statute, regulation or other document, appropriated by the parties by signature or otherwise permitted by law. By the notion of civil contract established by a document it is understood either a contract concluded both between natural persons and between professionals, between a natural person and a professional or between a professional and an authority of the nature of those shown in par. (3) of art. 1014, the condition being that this contract be concluded in writing and, of course, signed by all contracting parties. Regarding the object of the contract, it must stipulate in one of the parties an obligation to pay a sum of money, so it can be any civil contract (services, lease, sale, mandate, etc.) that involves a “Price” in cash that the debtor is required to bear in exchange for the services or goods offered by the creditor. As a result, the payment order procedure cannot be used to recover claims arising from an employment contract or an administrative, tax or customs act. By the notion of statute, regulation or other document, adopted by the parties by signature or otherwise admitted by law, the situations in which the legal relationship between the parties is not regulated by a written contract are taken into account, the obligation to pay the debtor resulting from other types of documents, which in principle should either be issued or signed by him. By way of example, we specify that in this catego-

Cu titlu de exemplu, precizăm că în această categorie sunt incluse pretențiile asociațiilor de proprietari față de locatari, pretențiile creditorului întemeiate pe facturi fiscale însușite prin semnătură de către debitori sau chiar nesemnate de către debitori, dar care îndeplinesc condițiile prevăzute la art. 277 din Codul de procedură civilă privind înscrisurile întocmite între profesioniști, cu mențiunea că practica instanțelor este împărțită în ceea ce privește admisibilitatea unei ordonanțe de plată întemeiată exclusiv pe facturi fiscale nesemnate de debitor, declarațiile de recunoaștere a creanțelor emanate de la, sau însușite de debitori, cum ar fi extrasele de cont contabile transmise și semnate de către debitori în baza OMFP 2861/2009 pentru aprobarea Normelor privind organizarea şi efectuarea inventarierii elementelor de natura activelor, datoriilor şi capitalurilor proprii, precum și orice altă recunoaștere de datorie consemnate în înscrisuri care emană de la organele judiciare, cum ar fi o declarație de martor sau o hotărâre judecătorească pronunțată într-un alt dosar. În al doilea rând, dispo zițiile legale prevăd că creanța constând într-o sumă de bani, existentă împotriva debitorului trebuie să fie certă, lichidă și exigibilă. Potrivit dispozițiilor art. 663 alin. (2) –(4) din Codul de procedură civilă, o creanță este considerată a fi certă atunci când existența acesteia rezultă în mod neîndoielnic chiar din înscrisurile constatatoare analizate mai sus, a fi lichidă atunci când obiectul ei este determinat într-o sumă fixă sau cel puțin determinabil, în sensul că înscrisul constatator al creanței cuprinde suficiente elemente astfel încât cuantumul acesteia să poată fi stabilit cu exactitate și exigibilă atunci când obligația de plată a debitorului a ajuns la scadență sau dacă acesta este decăzut din beneficiul termenului de plată potri-
vit art. 1417 din Codul civil. Cu privire la cuantumul sau întinderea pretențiilor ce pot fi pretinse de creditor de la debitor pe calea acestei proceduri simplificate, dorim să precizăm că, potrivit reglementărilor în vigoare, prin cererea de ordonanță de plată se pot solicita, pe lângă debitul principal, și daune-interese precum penalități de întârziere care se vor calcula și achita de debitor până la data plății integrale a debitului principal sau orice alte cheltuieli suplimentare avansate de creditor în vederea recuperării sumelor neachitate la termen, cum ar fi cheltuielile ocazionate de transmiterea notificării de punere în întârziere. În al treilea rând, suplimentar condițiilor de admisibilitate reglementate prin art. 1014 Cod de procedură civilă, prin art. 1015 al aceluiași act normativ, s-a prevăzut și condiția transmiterii unei somații de către creditor debitorului, anterior formulării unei cereri de ordonanță de plată. Astfel, creditorul are obligația de a comunica debitorului, prin intermediul unui executor judecătoresc sau prin scrisoare recomandată, cu conținut declarat și confirmare de primire, o somație/notificare de plată prin care îi va pune în vedere să achite sumele restante

cedure, a claim is considered to be certain when its existence is unequivocally apparent even from the findings of analysis analyzed above, to be liquid when its object is determined in a fixed amount or at least determinable, in the sense that the statement of claim contains sufficient elements so that its amount can be determined accurately and due when the debtor’s obligation to pay has reached at maturity or if it is forfeited from the benefit of the payment term according to art. 1417 of the Civil Code. Regarding the amount or extent of the claims that can be claimed by the creditor from the debtor through this simplified procedure, we would like to point out that, according to the regulations in force, the application for an order for payment may claim interest such as late payment penalties to be calculated and paid by the debtor until the date of full payment of the principal debt or any other additional costs advanced by the creditor to recover unpaid amounts on time, such as expenses incurred in sending the notice of delay. Thirdly, in addition to the conditions of admissibility regulated by art 1014 Code of Civil Procedure, by art 1015 of the same normative act, was also provided the condition of sending a summons by the creditor to the debtor, prior to the formulation of an application for a payment order. Thus, the creditor has the obligation to communicate to the debtor, through a bailiff or by registered letter, with declared content and acknowledgment of receipt, a summons / notification of payment by which he will consider to pay the outstanding amounts within 15 days. from its receipt. If the debtor does not pay within the time allowed, the creditor may submit the application for a payment order, with the obligation to submit attached to

în termen de 15 zile de la primirea acesteia. Dacă debitorul nu plătește în termenul acordat, creditorul poate introduce cererea de ordonanță de plată, având obligația de a depune anexat cererii sale și dovada privind transmiterea somației. Dorim să precizăm că, netransmiterea acestei notificări de plată sau neanexarea la cererea de ordonanță de plată a dovezilor privind comunicarea acesteia către debitor, poate duce la respingerea de către instanța de judecată a acțiunii intentate de creditor ca inadmisibilă, dat fiind caracterul de procedură prealabilă obligatorie a somației. Potrivit alin. (2) al art. 1015 din Codul de procedură civilă, somația are valoarea unei puneri în întârziere a debitorului și întrerupe prescripția extinctivă. Conform regulii generale de drept comun, termenul de prescripție extinc tivă este de 3 ani, ulterior ex pirării acestuia creanțele nemaiputând fi recuperate pe cale judecătorească. Însă, prin transmiterea somației către debitor, acest termen se întrerupe, urmând a începe să curgă un nou termen de prescripției de 3 ani, dar acest beneficiu reglementat în favoarea creditorului produce efecte doar dacă se introduce cererea de ordonanță de plată într-un interval de maxim 6 luni de la comunicarea somației către debitor, după cum se stipulează în art. 2540 din Codul civil. Referitor la procedura de judecată a unei cereri de ordonanță de plată, Codul de procedură civilă prevede că instanța competentă pentru soluționarea cererii este cea căreia îi revine competența judecării fondului cauzei în primă instanță, atât după materie și valoare, cât și din punct de vedere teritorial. Din punct de vedere material, dacă creanța dedusă judecății, fără a se lua în considerare penalitățile de întârziere, este până la 200.000 de lei inclusiv, competența va aparține judecătoriei, iar pentru sumele ce depășesc acest
prag, competența va aparține tribunalului. În ceea ce privește competența teritorială, dacă părțile nu au stabilit prin contract competența unei anumite instanțe, caz în care acțiunea se va introduce pe rolul respectivei instanțe, se va aplica, în principiu, regula generală de competență teritorială, cererea de ordonanță de plată urmând a fi introdusă la instanța de la domiciliul/sediul debitorului. Cererea de ordonanță de plată se timbrează, potrivit art. 6 alin. (2) din OUG nr. 80/2013 privind taxele judiciare de timbru cu suma de 200 de lei, indiferent de valoarea pretențiilor formulate, aspect ce reprezintă un avantaj în comparație cu cererea de chemare în judecată de drept comun care se timbrează prin aplicarea unui procent din valoarea creanței dedusă judecării, ceea ce determină taxe de timbru de multe ori, considerabil mai mari decât suma de 200 de lei.

Regarding to the proceedings for an application for an order for payment, the Code of Civil Procedure provides that the court competent to resolve the application is the one that has jurisdiction over the merits of the case at first instance, both in matter and value, and from a territorial point of view. From the material point of view, if the claim deducted from the court, without taking into account the delay penalties, is up to 200,000 lei inclusive, the competence will belong to the court, and for the amounts exceeding this threshold, the competence will belong to the court. With regard to territorial jurisdiction, if the parties have not established by contract the jurisdiction of a particular court, in which case the action will be brought before that court, the general rule of territorial jurisdiction will apply in principle, the application for an order for payment following to be brought to court at the domicile / seat of the debtor. The request for payment order is stamped, according to art. 6 para. (2) of GEO no. 80/2013 on judicial stamp duties in the amount of 200 lei, regardless of the value of the claims made, which is an advantage compared to the common law lawsuit which is stamped by applying a percentage of the value of the claim deducted to the court, which often causes stamp duties, considerably higher than the amount of 200 lei. The request for an order for payment must include, in addition to the identification data of the parties, the amount which is the subject of the claim, the factual and legal grounds for the obligation to pay, the period to which they relate and the time limit the payment. The application for a payment order will be accompanied by the documents certifying the amount due.

Judecarea cererii se face cu celeritate, potrivit dispozițiilor referitoare pricinile urgente, completul de judecată stabilind primul termen de judecată înainte de comunicarea cererii de ordonanță de plată către pârâtul debitor. În acest sens, citația va fi înmânată ambelor părți cu cel puțin 10 zile înainte de termenul de judecată. Pârâtului debitor îi va fi comunicată cererea de ordonanță de plată împreună cu citația și va avea obligația de a depune întâmpinare cu cel puțin 3 zile înaintea termenului de judecată, urmând ca reclamantul creditor să ia cunoștință de întâmpinare de la dosarul cauzei. Un aspect important de precizat constă în aceea că, spre deosebire de procedura de drept comun, în procedura specială a ordonanței de plată, nedepunerea întâmpinării de către debitor poate și considerată, în funcție de împrejurările cauzei, o necontestare a creanței și o recunoaștere a pretențiilor formulate de către creditor. Nedepunerea întâmpinării nu duce automat la decăderea debitorului din dreptul de a contesta creanța dedusă judecării, însă deși debitorul poate contesta creanța pe tot parcursul judecății, dacă acesta nu a formulat întâmpinare sau nu a respectat termenul legal de depunere a acesteia, va fi decăzut din dreptul de a mai aduce dovezi în susținerea apărărilor sale și de a mai invoca excepții, în afara celor de ordine publică. Potrivit dispozițiilor art. 1023 din Codul de procedură civilă, în cazul în care debito rul nu contestă creanța prin întâmpinare, instanța de jude cată va emite ordonanța de plată în termen de cel mult 45 de zile de la introducerea cererii de către creditor, fără a se lua în calcul perioada necesară pentru comunicarea actelor de procedură și întârzierile cauzate de creditor. Legiuitorul a prevăzut acest termen pentru asigurarea soluționării cu
celeritate a cererii privind or do nanța de plată, pe lângă dispozițiile speciale referitoare la citare și comunicarea actelor de procedură, în ipoteza particulară în care debitorul nu contestă creanța prin întâmpinare, fiind astfel decăzut și din dreptul de a mai administra probe în susținerea apărărilor sale. Sub aspectul probatoriului ce poate fi administrat, arătăm că, spre deosebire de cererea de chemare în judecată de drept comun, în procedura specială a ordonanței de plată se pot administra doar înscrisuri, nefiind admisibile alte mijloace de probă, precum proba testimonială sau expertizele judiciare. Această limitare a probatoriului constituie un dezavantaj al ordonanței de plată, căci în cazul în care în etapa cercetării judecătorești, dacă apărările de fond formulate de debitor presupun administrarea unui probatoriu extins ce ar fi admisibil în procedura de drept comun, instanța de judecată va respinge cererea creditorului privind ordonanța de plată prin încheiere, care poate fi atacată de creditor pe calea cererii în anulare conform art. 1024 alin. (2) din Codul de procedură civilă, în termen de 10 zile de la comunicarea încheierii. Totuși, în situația în care se respinge cererea creditorului
The application is judged quickly, according to the provisions regarding urgent cases, the court panel establishing the first trial term before the communication of the request for payment order to the debtor defendant. In this regard, the summons will be handed to both parties at least 10 days before the trial date. The debtor defendant will be notified of the request for a payment order together with the summons and will have the obligation to file an objection at least 3 days before the trial term, following that the creditor plaintiff will take note of the objection from the case file. An important point to note is that, unlike the ordinary law procedure, in the special order for payment procedure, the debtor’s failure to file a complaint may also be considered, depending on the circumstances of the case, a non-challenge of the claim and a recognition of the claims formulated by the creditor. Failure to file a statement of defense does not automatically result in the debtor’s right to challenge the claim against the court, but although the debtor may challenge the claim throughout the trial, if he has not filed a complaint or has not complied with the legal

deadline, it will be revoked to adduce evidence in support of its defenses and to invoke exceptions other than those of public policy. According to the provisions of art. 1023 of the Code of Civil Procedure, in case the debtor does not contest the claim by way of counterclaim, the court will issue the payment order within maximum 45 days from the introduction of the request by the creditor, without taking into account the necessary period for the communication of procedural documents and delays caused by the creditor. The legislator provided this deadline to ensure the speedy settlement of the request for payment order, in addition to the special provisions on summons and communication of procedural documents, in the particular case where the debtor does not contest the claim by default, being thus deprived of the right to he also administered evidence in support of his defenses. In terms of the evidence that can be administered, we point out that, unlike the common law request, only documents can be administered in the special payment order procedure, and no other means of proof, such as testimonial evidence or forensic examinations, are admissible. This limitation of the evidence is a disadvantage of the payment order, because if in the stage of the judicial investigation, if the substantive defenses formulated by the debtor involve the administration of extended evidence that would be admissible in the common law procedure, the court will reject the request the creditor regarding the order for payment by conclusion, which can be challenged by the creditor by way of the request for annulment according to art. 1024 para. (2) of the Code of Civil Procedure, within 10 days from the communication of the conclusion. However, in the event that

pe motivul arătat anterior sau pentru că apărările debitorului sunt considerate întemeiate de către instanța de judecată, încheierea de respingere a cererii de ordonanță de plată nu are autoritate de lucru judecat, motiv pentru care creditorul va putea introduce cerere de chemare în judecată potrivit dreptului comun pentru a își recupera creanțele, desigur, cu suportarea unor noi taxe de timbru și asumarea riscului creșterii stării de insolvabilitate a debitorului său. În cazul în care instanța de judecată, analizând înscrisurile de la dosar și susținerile părților, constată că cererea de ordonanță de plată e înte meiată, va emite o ordonanță de plată, ce constituie titlu executoriu, în care se precizează termenul și suma de plată. Potrivit dispozițiilor art. 1022 alin. (3), termenul de plată nu poate fi mai mic de 10 zile și nici mai mare de 30 de zile de la data comunicării ordonanței de plată, cu excepția cazului în care părțile convin asupra unui alt termen. Împotriva soluției de admitere a cererii de ordonanță de plată, debitorul poate formula, în termen de 10 zile de la comunicarea hotărârii, cerere în anulare. Cererea în anulare se timbrează cu 100 de lei și se judecă, spre deosebire de calea de atac a apelului împotriva hotărârii de drept comun, de un complet de 2 judecători de la instanța care a pronunțat ordonanța de plată, hotărârea pronunțată de acest complet de judecată fiind definitivă. Considerăm important de precizat că formularea unei cereri în anulare nu duce la suspendarea executării ordonanței de plată, aceasta nepierzându-și caracterul de titlu executoriu, având autoritate de lucru judecat până la soluționarea cererii în anulare. Așadar, creditorul își va putea pune în executare hotărârea din primă instanță și va putea să își recupereze creanța chiar dacă debitorul a intentat calea de atac a cererii în anu-
lare. Desigur că, în situația în care debitorul va avea câștig de cauză în fața instanței de control judiciar, creditorul va fi obligat să restituie acestuia toate sumele încasate ca urmare a punerii în executare a ordonanței de plată, motiv pentru care punerea în executare se face pe riscul creditorului. We consider it important to point out that the formulation of a request for annulment does not lead to the suspension of the execution of the payment order, this not losing its character of executor title, having the judge of gain by authority until the resolution of the request for annulment. Therefore, the creditor will be able to enforce his judgment at first instance and will be able to recover his claim even if the debtor has appealed against the annulment claim. Of course, in the event that the debtor wins the case before the court of judicial control, the creditor will be obliged to return to him all the amounts collected as a result of the execution of the payment order, reason for which the execution is done on creditor risk. In conclusion, we consider that, if the factual situation allows the fulfillment of the conditions of admissibility of an application for payment order, recourse to this special procedure is recommended to economic operators, given the advantages conferred, such as stamp duty in a fixed amount of 200 lei, enforceability, even without a final judgment and fast-track procedure which, in the event that the claim is not contested by the debtor, provides for the issuance of the payment order within 45 days of the filing of the application, all of which the needs of economic operators in this period in which the recovery of debts and coverage of losses generated by the economic and health context must be carried out quickly.

he Responsible Gaming Association (AJR) develops and implements specific programs regarding the effects of excessive gambling and social reporting. These programs help prevent gambling addiction, educate the public on the subject, and combat addiction by providing psychological counseling to people who have misunderstood the role of gambling entertainment. The activities of the association are carried out on four main strategic directions: Awareness-Education, Training, Prevention and Intervention. Este implicarea concretă a industriei jocurilor de noroc în procesul de educație și prevenție în rândul adolescenților. Obiectivul campaniei:
Educarea tinerilor pentru a putea face alegerile potrivite, a cunoaște riscurile implicării în activități care nu corespund nivelului lor de dezvoltare psiho-socială şi care le pot afecta evoluţia ulterioară. Programul are un dublu rol - educarea tinerilor astfel încât aceștia să poată lua deciziile potrivite precum și de prevenție cu scopul de a menține practicarea jocurilor de noroc în sfera recreaționalului. Grupul țintă este reprezentat, în principal, de către elevi din ciclul superior al liceului, clasele XI – XII, dar programul se adresează și profesorilor diriginți.

Started in 2011, the program has enjoyed a continuous development: ➣ has been permanently invested in the most modern support tools for players (website, self-test questionnaire, etc.); ➣ the number of offices offering psychological counseling has been expanded (Constanța and Craiova), as well as the number of therapy sessions (from two to five); ➣ actions have been taken to encourage gambling operators to behave responsibly; ➣ action has been taken continuously to promote the principles of social responsibility. 2. The Trained for Adulthood Program is the only program in Romania for educating young people in the last years of high school, regarding the adoption of a responsible attitude towards gambling. It is the concrete involvement of the gambling industry in the process of education and prevention among adolescents. Campaign goal: Educating young people to be able to make the right choices, to know the risks of engaging in activities that do not correspond to their level of psychosocial development and that may affect their further development. The program has a dual role - educating young people so that they can make the right decisions as well as prevention in order to maintain the practice of gambling in the recreational sphere. The target group is mainly represented by high school students, grades XI - XII, but the program is also aimed at

It was built on the model of the medical practice triage procedure in order to establish the priority and the level of care required. Thus, depending on the severity, the callers of the service are classified in one of the four codes: green, yellow, orange and red. It is a 24-hour service available 24 hours a day, 7 days a week. The development of the chat platform allows the extraction of statistics and the qualitative and quantitative evaluation of the services offered. 4. În perioada pandemiei, Asociația Joc Responsabil s-a folosit de experiența pe care a dobândit-o până acum în consilierea psihologică online și pe expertiza psihologilor săi în terapie comportamentală pentru a se implica și în alte proiecte de responsabilitate socială. Spre exemplu, serviciul non-stop de consiliere psihologică online 24/7 a fost dedicat și pacienților COVID-19 internaţi în Institutul de Pneumoftiziologie “Marius Nasta” din Bucureşti, aparţinătorilor şi personalul medical din spital, cu scopul de a contribui la ameliorarea stării psihologice și emoționale a cadrelor medicale și personalului asistent. De asemenea, în perioada stării de urgență, numărul de telefon TEL-VERDE, precum și programul Consiliere 24/7 au fost puse gratuit la dispoziția persoanelor direct implicate în gestionarea Covid-19 ori a persoanelor vulnerabile sau

La data de 14 Martie 2022, CEPD a adoptat GHIDUL 3/2022 privind Modele întunecate în interfețele platformei de social media: Cum să le recunoașteți și să le evitați1, instrument aflat în cosultare publică până la data de 2 Mai 2022. Ghidul oferă recomandări practice designerilor și utilizatorilor platformelor de social media cu privire la modul de evaluare și evitare a așa-numitelor „modele întunecate” în inter fețele de social media care încalcă cerințele RGPD. Trebuie să rețineți că lista modelelor întunecate și a celor mai bune practici, precum și cazurile de utilizare, nu sunt exhaustive, având doar caracter exemplificativ.

Principiul de prelucrare echitabilă prevăzută la articolul 5 alineatul (1) litera (a) din RGPD servește drept punct de plecare pentru a evalua dacă modelul de design constituie de fapt un „model întunecat”. Alte principii joacă un rol în această evaluare sunt cele ale transparenței, minimizării datelor și responsabilității - articolul 5 alineatul (1) literele (a), (c) și (2). RGPD, precum și, în unele cazuri, limitarea scopului articolul 5 alineatul (1) litera (b) RGPD. - închiderea unui cont de social media. În concluzie, Ghidul este un instrument preventiv, de control și verificare util pentru operatorii din industrie, în elaborarea design-ului și dezvoltarea platformelor de social media specifice activității acestora.
ing laid down in Article 5 (1) (a) GDPR serves as a starting point to assess whether a design pattern actually constitutes a “dark pattern”. Further principles playing a role in this assessment are those of transparency, data minimisation and accountability under Article 5 (1) (a), (c) and (2) GDPR, as well as, in some cases, purpose limitation under Article 5 (1) (b) GDPR. In other cases, the legal assessment is also based on conditions of consent under Articles 4 (11) and 7 GDPR or other specific obligations, such as Article 12 GDPR. Evidently, in the context of data subject rights, the third
chapter of the GDPR also needs to be taken into account. Finally, the requirements of data protection by design and default under Article 25 GDPR play a vital role, as applying them before launching an interface design would help social media providers avoid dark patterns in the first place. Examples of dark patterns in use cases of the life cycle of a social media account: The GDPR’s provisions apply to the entire course of personal data processing as part of the operation of social media platforms, i.e. to the entire life cycle of a user account. The EDPB gives no less than 60 concrete examples of dark pattern types for the following different use

cases within this life cycle: - the sign-up, i.e. registration process; - the information use cases concerning the privacy notice, joint controller ship and data breach communications; - consent and data protection management; - exercise of data subject rights during social media use; and, finally, - closing a social media account. Connections to GDPR provisions are explained in two ways: - firstly, each use case explains in more detail which of the above- mentioned GDPR provisions are particularly relevant to it. - secondly, the paragraphs surrounding the dark pattern examples explain how these infringe on the GDPR. Best practice recommendations: In addition to the examples of dark patterns, the Guidelines also present best practices at the end of each use case. These contain specific recommendations for designing user interfaces that facilitate the effective implementation of the GDPR. Checklist of dark pattern categories: A checklist of the 6 categories of dark models is presented in the Annex to these Guidelines. The Annex it provides an overview of the above mentioned categories and the dark pattern types, along with a list of the examples for each dark pattern that are mentioned in the use cases. In conclusion, the Guidelines is a preventive, control and verification tool useful for industry controllers in establish design and developing social media platforms specific to their activity.

Proiectul chiar de la început este unul atipic pentru piața jocurilor de noroc deoarece perspectivele sunt lărgite foarte mult în direcția experienței de care se poate bucura orice jucător.
Amplasare: Ne-am dorit încă de la stadiul de proiect să ducem experiența BONUS la următorul nivel iar pentru asta am ales unul dintre cele mai frumoase orașe din România. The first unusual event for a game room organized at BONUS QOSMO was the debut party of the pilot Octavian Ciovică in this year’s season of the National Coastal Speed Championship. It was a party with over 200 guests who were able to wish good luck and hold Octavian’s fists for this season in a spectacular setting but at the same time different from a classic party. The partnership we started with Octavian is the first in a series that we are preparing to support initiatives and people with great ambitions in succeeding in completing projects that benefit primarily the community. We had fun, we drank, we ate and we managed to enjoy quality time around a car launch like never seen before in Brasov and we are glad that we managed to offer a part of the GO WILD experience.

La nivel european jocurile de noroc nu sunt reglementate de norme sectoriale dar, cu toate acestea, Curtea de Justiție a Uniunii Europene (CJUE), `n conformitate cu legislația Uniunii Europene (UE), a stabilit că serviciile de jocuri de noroc intră sub incidența articolului 56 al Tratatului privind Funcționarea Uniunii Europene (TFUE) și sunt reglementate, prin urmare, de normele privind prestarea serviciilor. Conform acestor norme, operatorii autorizați `ntr-un stat membru pot presta servicii consumatorilor din alte state membre, cu excepția cazului `n care acestea impun restricții justificate de motive imperioase de interes public, precum protecția consumatorilor sau necesitatea generală de a menține ordinea publică. At European level, gambling is not regulated by sectoral rules, but nevertheless, the Court of Justice of the European Union (CJEU), in accordance with European Union (EU) law, has ruled that gambling services fall under Article 56 of the Treaty on the Functioning of the European Union (TFEU) and are therefore governed by the rules on the provision of services. Under these rules, operators authorized in one Member State may provide services to consumers in other Member States, unless they impose justified restrictions on imperative grounds of public interest, such as consumer protection or the general need to maintain law and order. These restrictions must also be compatible with EU secondary legislation and the general gambling policy of the Member States must be proportionate and consistently and systematically applied. Article 56 TFEU prohibits restrictions on the freedom to provide services to beneficiaries in other Member States. In the case of Schindler, the CJEU confirmed for the first time that the provision and use of cross-border offers of gambling is an economic activity falling within the scope of the Treaty. In Gambelli’s case, the Court also stated that services provided by electronic means are covered by the Treaty and that national law prohibits operators established in one Member State from providing online gambling services to consumers in another Member State, or who restricts the freedom to receive or benefit as a recipient of services provided by a provider established in another Member State, constitutes a restriction on

Procedura de acordare a unei licențe trebuie să respecte principiul egalității de tratament și pe cel al nediscriminării, precum și obligația de transparență care decurge din acestea.” ~n legislația secundară a UE, relevantă `n domeniul jocurilor de noroc, regăsim prevederile Regulamentului (UE) nr. 549/2013 al Parlamentului European și al Consiliului, din 21 mai 2013, privind Sistemul european de conturi naționale și regionale din Uniunea Europeană, care stabilesc, prin definiții clare, modul de armonizare al normelor interne ale acestei activități cu normele europene obligatorii, astfel: „Loterii și jocuri de noroc, 4.135. Definiție: „Sumele plătite pentru bilete de loterie sau pariate constau `n două elemente: plata pentru un serviciu către unitatea care organizează loteria sau jocul de noroc și un transfer curent rezidual către câștigători. No 549/2013 of the European Parliament and of the Council of 21 May 2013 on the European system of national and regional accounts in the European Union, which sets out, by way of clear definitions, how to harmonize the internal rules of this activity with binding European rules, as follows: „Lotteries and gambling, 4,135. Definition: “The amounts paid for lottery tickets or bets consist of two elements: payment for a service to the unit that organizes the lottery or gambling and a residual current transfer to the winners. Payment for the service can be substantial and includes taxes on the production of gambling services. In the system, transfers are considered to be made directly between participants in lotteries or games of chance, ie between households. In the case of non-resident households, there may be significant net transfers between the household sector and the rest of the world. TAXES ON PRODUCTION AND IMPORTS (D.2) 4.14. Definition: taxes on production and imports (D.2) consist of compulsory payments without consideration, in cash or in kind, collected by general government or institutions of the European Union, depending on the production and import of goods and services, employment labor, right to own or use land, buildings or other assets used in production. Impozitele pe venit includ: (d) taxele asupra câștigurilor din loterii sau jocuri de noroc, de plătit `n raport cu sumele primite de câștigători, deosebindu-se de impozitele pe cifra de afaceri a producătorilor care organizează aceste activități, care sunt tratate ca impozite pe produse.” La nivel național, plecând de la prevederea art. 2 din Directiva 2006/123/CE a Parlamentului European și a Consiliului din 12 decembrie 2006, privind serviciile `n cadrul pieței interne, și conform căreia „această directivă nu se aplică la activitățile de jocuri de noroc care presupun pariuri cu o miză cu valoare pecuniară `n jocuri de noroc, inclusiv loterie, jocuri de cazinou și tranzacții referitoare la pariuri” jocurile de noroc sunt reglementate de norme sectoriale naționale, constituite `ntr-un pachet special, sub forma: Ordonanței de urgență, nr. 77 din 24 iunie 2009, actualizată, care prevede că organizarea și exploatarea activității de jocuri de noroc, pe teritoriul României, constituie monopol de stat și se desfășoară `n condițiile acestei ordonanțe de urgență; Ordonanței

(d) taxes on lottery or gambling winnings payable in relation to the amounts received by the winners, excluding taxes on the turnover of the producers who organize these activities, which are treated as taxes on products.” At national level, starting from the provision of art. 2 of Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market, and according to which “this Directive shall not apply to gambling activities involving in gambling, including lottery, casino games and betting transactions” gambling is governed by national sectoral rules, constituted in a special package, in the form of: Emergency Ordinance, no. 77 of June 24, 2009, updated, which stipulates that the organization and operation of the gambling activity, on the territory of Romania, constitutes a state monopoly and is carried out under the conditions of this emergency ordinance; Emergency Ordinance, no. 20 of March 27, 2013, regarding the establishment, organization and functioning of the National Office for Gambling (ONJN); Government Decision no. 111, of 2016, comprising the Methodological Norms for the implementation of the Government Emergency Ordinance no. 77/2009 on the organization and operation of gambling; Government Decision, no. 298 of May 29, 2013, implementing the Emergency Ordinance, no. 20/2013 on the organization and functioning of the National Office for Gambling; a series of Orders, instructions and clarifications, of the ONJN, for the implementation of the main or secondary rules. The conclusion that emerges, after reviewing the national and European norms, is a clear and urgent one: the special regulation of gambling in Romania must be revised and modernized, in order to correspond to the principle of quality of internal norms, but especially to correlate with the principles and objectives to be achieved, in order to harmonize with the rules contained in the official documents of the European Union. Stima de sine, cât de important este să o conștientizăm C ând vorbim despre stima de sine, ne gândim la teoria dezvoltării psihosociale a lui Erikson (1963), care spune că în primul an și jumătate de viață al copilului, ceea ce determină traseul evolutiv al viitorului adult (direcțiile de dezvoltare a vulnerabilităților și a potențialului psihologic și social al copilului) este tocmai capacitatea de a-și construi o poziție fundamentală de încredere în viitor. Teoria atașamentului oferă specificații suplimentare. Pentru aceasta, încrederea în disponibilitatea, sensibilitatea și capacitatea de reacție a figurii de referință (persoana sau persoanele la care ne adresăm atunci când suntem obosiți, triști, speriați, când avem nevoie de îngrijire și sprijin) este pivotul în jurul căruia mintea construiește modelele interne de funcționare echilibrate (schemele cognitive și afective ale sinelui, ale celorlalți și a relațiilor), iar așteptarea de a primi sprijin, reasigurare și susținere din partea acestuia (fie în formă reală sau simbolică, dacă nu este disponibil în practică) este considerată esențială pentru dezvoltarea unei personalități reziliente, proactive, deschise, capabile să își mențină echilibrul în condiții de stres (Mikulincer & Shaver, 2009). Persoanele cu o stimă de sine ridicată tind să fie optimiste și sunt capabile să facă față cu seninătate evenimentelor negative; dimpotrivă, persoanele cu o stimă de sine scăzută tind să fie pesimiste, să dezvolte mai ușor crize depresive și nu sunt capabile să își folosească potențialul pentru a fa-
ce față evenimentelor negative. De asemenea, persoanele care au o bună stimă de sine înainte de a întreprinde o activitate, de a rezolva o problemă sau de a se confrunta cu o situație, par mai încrezătoare în sine și sunt convinse că au șanse mari de reușită. Aceștia sunt oameni care au obținut deja succese în trecut și acest lucru le alimentează așteptările, dar chiar și atunci când au eșuat în sarcini similare, tind să fie optimiști. Situațiile dificile sunt văzute ca fiind stimulative, ca o provocare de a-și dovedi valoarea; ei sunt orientați spre o îmbunătățire constantă și spre atingerea unor obiective din ce în ce mai mari. Persoanele cu stimă de sine scăzută se află în situația opusă: înainte de orice activitate, se simt anxioase și îngrijorate, simt dorința de a evita situația în loc să o înfrunte. Au multe îndoieli cu privire la rezultatul eforturilor lor, nu au încredere în capacitățile lor și nu văd situațiile ca pe niște provocări stimulatoare, ci ca pe niște amenințări la adresa valorii lor personale, ocazii în care riscă să demonstreze că nu sunt suficient de capabile, de interesante sau de inteligente.
Persoanele cu o stimă de sine ridicată, deși sunt mulțumite de ele însele, lucrează adesea din greu pentru a-și îmbunătăți zonele de slăbiciune, în timp ce persoanele cu o stimă de sine scăzută, fiind înclinate să „renunțe la joc” chiar înainte ca acesta să se termine, au tendința de a depune puține eforturi, de a se lăsa copleșite de anxietate și de a nu persista în efortu-
rile lor dacă primele încercări sunt ineficiente. Atunci când experimentăm un eveniment înregistrându-l ca fiind un succes sau un eșec, ne măsurăm performanța în raport cu un standard interior, dar dacă standardele noastre sunt prea stricte riscăm să ne simțim adesea nemulțumiți de noi înșine. Așteptările de succes trebuie, prin urmare, să fie măsurate în mod realist în raport cu propriile abilități și caracteristici. Acest lucru ne va permite să menținem o atitudine obiectivă și să nu fim prea stricți în ceea ce privește rezultatele pe care le obținem. Este preferabil să ne propunem un obiectiv pe care îl considerăm ambițios din punctul de vedere al resurselor noastre interne, stabilindu-ne câteva etape intermediare, obținând astfel succese mai ușor de atins în mod realist, hrănindu-ne astfel stima de sine și ajungând treptat la obiectivul final. Învățăm să nu atribuim toată vina pentru un eșec, exclusiv incompetenței noastre și învățăm, de asemenea, să nu ne evaluăm prea rigid. Chiar dacă suntem forțați să atribuim eșecul nostru exclusiv unor cauze interne, acestea nu ar trebui privite ca părți stabile și neschimbabile, ci ca expresiile noastre la un anumit moment al vieții, întro anumită situație și în urma unui anumit curs de experiențe. hen we talk about self-esteem, we think of Erikson’s (1963) theory of psychosocial development, which states that in the first year and a half of a child’s life, which determines the evolutionary path of the future adult (directions of development of vulnerabilities and potential psychological and social development of the child) is precisely the ability to build a fundamental position of confidence in the future. Attachment theory provides additional specifications. For this, the confidence in the availability, sensitivity and responsiveness of the reference figure (the person or persons we address when we are tired, sad, scared, when we need care and support) is the pivot around which the mind builds inter-
nal models balanced functioning (cognitive and affective patterns of self, others and relationships) and expecting to receive support, reassurance and support from him (either in real or symbolic form, if not available in practice) developing a resilient, proactive, open personality, able to maintain balance under stress (Mikulincer & Shaver, 2009). People with high self-esteem tend to be optimistic and are able to deal with negative events with serenity; on the contrary, people with low self-esteem tend to be pessimistic, develop depressive attacks more easily, and are unable to use their potential to cope with adverse events. Also, people who have a good self-esteem before undertaking an activity, solving a problem or facing a situation, seem more self-confident and
are convinced that they have a high chance of success. These are people who have already achieved success in the past and this fuels their expectations, but even when they have failed in similar tasks, they tend to be optimistic. Difficult situations are seen as stimulating, as a challenge to prove their worth; they are geared towards constant improvement and the achievement of ever-increasing goals. People with low self-esteem are in the opposite situation: before any activity, they feel anxious and worried; they feel the desire to avoid the situation instead of facing it. They have many doubts about the outcome of their efforts, they do not trust their abilities and they do not see the situation as a stimulating challenge, but as a threat to their personal worth, occasions when

they risk proving that they are not capable enough, interesting or intelligent. People with high self-esteem, although satisfied with themselves, often work hard to improve their areas of weakness, while people with low self-esteem are inclined to “give up the game” even before to end it, they tend to make little effort, to be overwhelmed by anxiety and not to persist in their efforts if the first attempts are ineffective. When we experience an event as a success or failure, we measure our performance against an internal standard, but if our standards are too strict we may often feel dissatisfied with ourselves. Success expectations must therefore be measured realistically in relation to their own skills and characteristics. This will allow us to main-

Există trei componente esențiale ale unei stime de sine: iubirea de sine, viziunea de sine și încrederea în sine. O doză echilibrată a acestor trei componente ar fi indispensabilă pentru a ne simți competenți și demni de iubire. Iubirea de sine este cea care ne permite să ne apreciem în ciuda limitărilor și defectelor noastre. Această iubire de sine nu depinde de performanțele noastre, chiar dacă ne permite să facem față adversităților și să ne revenim după ce am ratat un obiectiv pe care ni l-am propus. În caz de dificultate, nu previne nici suferința, nici îndoiala, ci protejează împotriva disperării. Iubirea de sine depinde în mare măsură de dragostea pe care ne-a oferit-o familia noastră când eram copii și de hrana emoțională pe care am primito. Iubirea de sine este fundamentul stimei de sine, componenta sa cea mai profundă și mai intimă. Viziunea de sine este cel deal doilea pilon al stimei de sine, este privirea pe care ne-o acordăm nouă înșine, evaluarea subiectivă pe care o facem asupra calităților și defectelor noastre. Stima de sine este un aspect plastic al personalității. De fapt, valoarea pe care ne-o acordăm nouă înșine nu este statică, va varia de-a lungul
vieții, dar este mai ales un aspect care poate fi sporit. După cum am văzut, un nivel bun al stimei de sine este strâns legat de calitatea vieții și de starea de bine psiho-fizică; de aceea este important să ne angajăm să dezvoltăm atitudini și comportamente care să fie mai funcționale pentru o percepție sănătoasă a propriei persoane și a valorii sale. Ceea ce putem spune cu siguranță este că fiecare dintre noi este unic, special, meritoriu și demn de afecțiune. A ne aminti acest lucru ne poate ajuta să ne percepem mai clar valoarea și să facem față mai eficient încercărilor vieții.

Failure is not proof of one’s worthlessness; each of us has shortcomings and flaws that must be noticed without being hypercritical. A positive view of oneself, an awareness of one’s strengths, and an ability to forgive are aspects that allow us to see our failures in a healthier perspective, and they will almost certainly be reduced. There are three essential components of self-esteem: self-love, self-vision, and self-confidence. A balanced dose of these three components would be essential to feel competent and worthy of love. Self-love is what allows us to

appreciate ourselves despite our limitations and shortcomings. This self-love does not depend on our performance, even if it allows us to cope with adversity and recover after we have missed a goal. In case of difficulty, it prevents neither suffering nor doubt, but protects against despair. Selflove depends largely on the love our family gave us when we were children and the emotional nourishment we received. Selflove is the foundation of self-esteem, its deepest and most intimate component. Self-vision is the second pillar of self-esteem, it is the look we give ourselves, the subjective assessment we make of our qualities and flaws. Self-esteem is a plastic aspect of personality. In fact, the value we place on ourselves is not static, it will vary throughout life, but it is especially an aspect that can be enhanced. As we have seen, a good level of self-esteem is closely related to quality of life and psycho-physical well-being; that is why it is important to commit to developing attitudes and behaviors that are more functional for a healthy perception of one and one’s worth. What we can say for sure is that each of us is unique, special, deserving, and worthy of affection. Remembering this can help us to see our value more clearly and to face life’s challenges more effectively.

Ediția din aprilie a iGB Affiliate London, care a revenit la ExCeL Londra după o absență de doi ani impusă de Covid, a fost o sărbătoare internațională a sectorului, cu profesioniști din industrie atrași dintr-un total de 87 de țări. Primele 10 națiuni reprezentate au fost Marea Britanie (1.522 de participanți), Malta (490), Israel (223), Cipru (115), Suedia (99), Bulgaria (90), Spania (83), Țările de Jos (83), Portugalia ( 71) și Statele Unite (67). Will the Ukraine crisis affect our industry?

Let’s consider the financial situation of what is happening right now. Sanctions are being levied on Vladimir Putin and his government, oligarchs, and, of course, Russian banks, including the Russian Central Bank. The Russian ruble has lost close to half of its value against the US

This will interrupt international trade in Russia massively, threatening Russian firms with bankruptcy if they can no longer conduct business effectively. All of this is going to make it all but impossible for Russian players to transfer money to and from online poker platforms, almost in the same fashion as what US-based players experience post-Black Friday. One saving grace for the Russian poker community could be the prevalence of crypto poker sites or regular platforms that conduct transfers in cryptocurrency, but this will still limit playing options to some degree.
Moral support
It’s a fact that regardless of what the financial restrictions are for Russian players, many poker businesses might now take the view
that they are not welcome anyway. The world has turned to support Ukraine during this crisis almost exclusively. The only support for this act of Russian aggression comes from the likes of Syria, Venezuela, Iran and North Korea. Even China is starting to make public statements that indicate a lack of support, and abstained from the UN Security Council vote. So where does this lead? Having every Russian player pulled out of the player pool overnight would harm online poker considerably. Post-Black Friday, Russian players have made up a large percentage of the player pool and losing those numbers overnight risks forcing some major platforms into making changes to compensate in some way, and it won’t be positive for the rest of us. There is also going to be a huge shift in terms of game toughness. Not to say that Russian players are any worse than other nationalities, but when such a large number of players are removed from the player pool at once it stands to reason that many recreational players who feed the poker economy will be seriously missed. We saw this dynamic postBlack Friday when Americans were dragged out of the worldwide player pool. Players who considered themselves professionals all of a sudden couldn’t win at the same stakes, or even one level below. It was a harsh lesson on how quickly poker can change.

la masa finală oficială cu opt poziții, dar au fost eliminați la sfârșitul Zilei 4. Până la pauza de cină, au existat doar două confruntări all-in, ambele avându-i pe Marcelo Simoes Mesqueu și Jaime Cervantes. Americanul a dublat mai întâi și apoi i s-a refuzat încă o dublă. În timp ce toate stivele medii au schimbat jetoanele înainte și înapoi, Mesqueu și-a asumat controlul mai devreme și a intrat într-un avantaj dominant datorită folosirii avantajului său în creștere cu o agresivitate necruțătoare. Brazilianul aparent nu a putut greși nicio mână și a acumulat un avantaj enorm față de ceilalți cinci concurenți. Pe măsură ce finalul de șase s-a întors la o configurație foarte înțelegătoare, cu cele mai scurte stive sub zece blind-uri, Dragoș Trofimov a fost cel care a dublat prin liderul de jetoane Mesqueu. Cu toate acestea, brazilianul a compensat
prin eliminarea lui Erkan Soenmez la scurt timp după aceea. A deschis porțile pentru o perioadă frenetică în care turneul a trecut de la șase la doi aspiranți în doar o jumătate de oră. The top prize of €939,840 represents the far biggest cash of his career The 2022 PokerStars European Poker Tour stop presented by Monte-Carlo Casino has come to a thrilling conclusion and it was Brazil’s Marcelo Simoes Mesqueu who topped a field of 1,073 entries in the 2022 EPT Monte Carlo €5,300 Main Event. After a short-lived heads-up duel with Morten Hvam, Mesqueu secured the biggest portion of the €5,204,050 prize pool in the second-biggest EPT Main Event in the history of the stop at Le Sporting Monte Carlo. While players from the South American poker powerhouse nation have made several deep runs in the marquee event of the popular live poker tour and sponsoring site PokerStars features three countrymen on their roster of ambassadors, it was the first EPT Main Event for Brazil. Prior to his victory on the French Riviera, most of his live poker results came from home soil. Mesqueu won the leader board of the Brazilian Series of Poker (BSOP) in 2019 and currently sits in second place with a decent shot of a repeat victory. The top prize of €939,840 represents the far biggest cash of his career and the same also applied for runner-up Hvam. In December 2019, the Dane already came close to glory and finished 13th in the EPT Prague Main Event for €55,690, which he now eclipsed more than ten-fold with a consolation prize of €564,640. Cardot had reached the official eight-handed final table but were eliminated at the end of Day 4 to set the stage for the grand finale. Until the dinner break, there were only two all-in showdowns both of which featured Marcelo Simoes Mesqueu and Jaime Cervantes. The American first doubled and was then denied another double. While all middling stacks traded the chips back and forth, Mesqueu sooner than later assumed control and stormed into a commanding lead thanks to using his growing advantage with relentless aggression. The Brazilian could seemingly not put any foot wrong and amassed an enormous lead over the other five contenders. As the final six returned to a very cagey setup with the shortest stacks below ten blinds, it was Dragos Trofimov who doubled through runaway chip leader Mesqueu. The Brazilian however made up for it by knocking out Erkan Soenmez. It opened the floodgates for a frantic period in which the tournament went from six to two hopefuls in the span of just half an hour. Mesqueu also came from behind to crack the ace-king of Pingray with king-nine as he spiked a nine on the turn much to the delight of his Brazilian rail, which went nuts once the river bricked off. Cervantes was flipping for his tournament life against Hvam with ace-jack versus pocket nines but found no help to bow out in fourth place. He was followed to the rail by Trofimov, who laddered up a few spots but missed a maiden EPT Main Event title for his home country of Moldova. Brief deal discussions came to no conclusion and Mesqueu never lost his commanding lead.
