Prin ordinul 86 am încercat să îndreptăm acele lucruri care lipseau, care erau importante, de exemplu piața era blocată datorită faptului că nu se puteau face aprobări de tip sau includerea metodelor de plată, menționate cu titlu exemplificativ, în acord cu produsele deja existente în piață dar și cu progresul tehnologic. ➤ Despre combaterea spălării

Am inițiat deja consultări cu piața, în perioada următoare avem un calendar în care vom face ședințe de Consiliu Consultativ unde vom dezbate pe larg acest subiect atât de important. ➤D omnule Dan Ghiță, în această perioadă, asociațiile profesionale au transmis anumite propuneri. Au fost propunerile transmise de asociațiile profesionale juste? Scopul asociațiilor profesionale este să reprezinte cât mai bine interesele organizatorilor de jocuri de noroc pe care îi re prezintă. În mod natural, acestea au solicitat obținerea de com pen sații și facilități fiscale care să reducă sarcina cheltuielilor organizatorilor de jocuri de noroc afectați de măsurile de suspen dare a activității și să asigure o revenire cât mai sigură și mai rapidă a operatorilor. Urmare a reducerii veniturilor la Bugetul de stat, coroborată cu creșterea cheltuielilor statului în perioada stării de urgență și alertă, unele dintre măsuri nu au putut fi adoptate. ➤ Ce părere aveți, domnule Alin Teodor? Eu cred, însă, că e important pentru organizatorii afectați de măsurile de restricționare a activității că, pe durata stării de alertă, nu datorează taxe aferen te organizării și exploatării jocu rilor de când sunt închiși, inclu siv taxa de viciu, aceste fonduri putând fi utilizate pentru plata altor cheltuieli, cum sunt, în prin-

Taxa anuală de autorizare – este stabilită și datorată, pe fiecare tip de activitate, în sumă forfetară sau în cotă procentuală din venitul estimat, dar nu poate să fie sub limita minimă stabilită de lege. În ambele cazuri declararea și plata taxei se realizează anticipat iar în cazul activităților unde venitul se estimează, taxa de autorizare se recalculează și regularizează lunar, prin aplicarea cotei la venitul efectiv realizat. Excepția o reprezintă jocurile de tip bingo în sală, pentru care taxa anuală de autorizare, calculată și datorată anticipat, are, pentru fiecare sală autorizată, o componentă fixă și una variabilă; 3. Taxa lunară – stabilită și datorată, în cotă procentuală din taxa de participare la joc încasată lunar, de organizatorii de jocuri de noroc online. 4. Taxe speciale: a) Taxa anuală de viciu – este stabilită și datorată, numai pentru jocurile de tip slot-machine cu risc nelimitat și a jocurilor de tip videoloterie, pentru fiecare post autorizat; b) Taxa specială lunară pentru videoloterie – stabilită și datorată sub forma unei cote procentuale din venitul realizat; c) Taxa zilnică de acces – este stabilită și datorată, ca valoare fixă, de fiecare persoană care intră în locațiile specializate ale cazinourilor și ale cluburilor de poker. 5. Taxe administrative – stabilite și datorate, în sumă fixă, doar în cazul jocurilor de noroc la distanță, pentru analiza documentelor și pentru eliberarea licenței; 6. Contribuții anuale – stabilite și datorate, în sume fixe, pe tipuri de activitate, urmând să fie utilizate în scopul prevenirii dependen]ei de jocurile de noroc. În discuțiile publice precum și la întâlnirile organizate de

asociațiile de profil cu reprezen tanți ai autorităților publice responsabile, pe zona de reglementare din domeniu, au fost vehiculate mai multe variante referitoare la conținutul acestor impozite speciale, cele mai multe opinii exprimate susținând ideea că acestea ar reprezenta cumpărări de servicii prestate de stat în favoarea organizatorilor de jocuri de noroc sau mai direct spus, faptul că prin plata acestor taxe a fost cumpărat un drept de exploatare a unei activități ce constituie monopol de stat. În scopul stabilirii, fără nici un dubiu, a naturii și conținutului economic, precum și a locului acestor obligații fiscale, în structura sistemului fiscal european, mai jos sunt prezentate, în extras, definițiile acestora cu trimitere expresă la jocurile de noroc, așa cum se regăsesc în Regulamentul UE 549 din 2013, regulament obligatoriu de aplicat de către toate statele membre: l Impozitele pe produse constau în plăți obligatorii fără contraparte, în bani sau în natură, colectate de administrațiile publice reprezentând impozite pe bunuri și servicii, care sunt de plătit ca rezultat al livrării respectivelor bunuri sau servicii sau ca rezultat al utilizării lor pentru consum propriu sau la formarea de capital pentru uz propriu, acestea inclu-

Special fees: a) Annual addiction fee is established and due, only for slot-machine games with unlimited risk and video lottery games, for each authorized station; b) The special monthly fee for video lottery - established and due in the form of a percentage of the realized income; c) Daily access fee - is set and due, as a fixed amount, by each person who enters the specialized locations of casinos and poker clubs. 5. Administrative fees - established and due, in a fixed amount, only in the case of remote gambling, for the analysis of documents and for the issuance of the license; 6. Annual contributions established and due, in fixed amounts, by types of activity, to be used in order to prevent gambling addiction. In the public discussions as well as at the meetings organized by the profile associations with representatives of the responsible public authorities, on the regulatory area in the field, several variants regarding the content of these special taxes were circulated, most of the opinions expressed supporting the idea that they would represent purchases of services provided by the state in favor of the organizers of gambling or more directly, the fact that by paying these taxes was purchased a right to operate an activity that constitutes a state monopoly. In order to establish, without any doubt, the nature and economic content, as well as the place of these tax obligations, in the structure of the European tax system, below are presented, in the extract, their definitions with express reference to gambling, as find in EU Regulation 549 of 2013, a mandatory regulation to be applied by all Member States: l Taxes on products - consist of mandatory payments without counterparty, in cash or in kind, collected by general government representing taxes on goods and services, which are payable as a result of the deli-

Plata pentru serviciu poate fi substanțială și cuprinde impozitele pe producția de servicii de tip jocuri de noroc; l Impozitele pe venit constau în impozite pe venituri, profituri și câștiguri din capital, evaluate în raport cu veniturile efective sau presupuse ale persoanelor fizice, gospodăriilor, societăților și includ taxele asupra câștigurilor din loterii sau jocuri de noroc, de plătit în raport cu sumele primite de câștigători, deosebindu-se de impozitele pe cifra de afaceri a producătorilor care organizează aceste activități, care sunt tratate ca impozite pe produse; l Printre alte impozite pe producție se numără și impozitele plătite de întreprinderi pentru licențe de funcționare sau profesionale, dacă respectivele licențe sunt acordate automat la plata sumelor cuvenite. În acest caz, este probabil ca ele să fie doar un mijloc de realizare de venituri, chiar dacă administrația publică poate acorda în schimb un certificat sau o autorizație. Cu toate acestea, dacă administrația publică utilizează emiterea de licențe pentru a exercita o funcție de reglementare adecvată, de exemplu, în situația în care administrația publică efectuează verificări cu privire la conformitatea sau securitatea sediilor întreprinderii, la fiabilitatea sau securitatea echipamentelor utilizate, la competența profesională a personalului angajat sau la calitatea sau standardele bunurilor sau serviciilor produse ca o condiție pentru acordarea unei astfel de licențe, plățile sunt tratate drept cumpărări de servicii prestate, cu excepția cazului în care sumele percepute pentru licențe sunt foarte disproporționate față de costurile verificărilor efectuate de administrația publică. și obligatorii pentru România, pot fi evidențiate o serie de observații, strict legate de sistemul special de impozitare a jocurilor de noroc precum și modul de stabilire al nivelului acestora în perioada stării de urgență sau alertă: a) nu are nici un fel de impor tanță noțiunea unei obligații fiscale (impozit, taxă, contribuție…. etc.) pentru definirea acesteia, importantă este stabilirea naturii și conținutul economic al acesteia; b) stabilirea foarte clară a faptului că nivelul unei obligații de plată, pentru a reprezenta o cumpărare efectivă a unui serviciu din partea unei autorități publice, nu trebuie să fie dispro porționată, față de volumul serviciului efectuat; c) atunci când statul intervine, cu restricții sau închidere de activitate, pentru anumite perioade de timp, impozitele datorate trebuie recalculate și ajustate, ca urmare a faptului că acestea reprezintă impozite pe servicii și trebuie să fie plătite ca rezultat al livrării respectivelor servicii. In this case, they are likely to be only a means of generating revenue, even if the general government may instead grant a certificate or authorization. However, if the public administration uses the issuance of licenses to exercise an appropriate regulatory function, for example, when the public administration carries out checks on the conformity or security of the company’s premises, the reliability or security of the equipment used, the professional competence of staff employed or to the quality or standards of the goods or services produced as a condition for granting such a license, payments are treated as purchases of services provided, unless the amounts charged for licenses are very disproportionate to the costs of administrative checks publish. În ultima perioadă de timp, organizatorii de jocuri de noroc s-au arătat interesați de domeniul sporturilor electronice, acesta aflânduse într-un trend ascendent continuu, adunând din ce în ce mai mulți suporteri. Un studiu publicat de o companie specializată în studierea piețelor arăta faptul că în 2021 industria sporturilor electronice a depășit 474 de milioane de telespectatori la nivel mondial, dintre care 234 de milioane urmăresc cel puțin un eveniment lunar. Același studiu indica faptul că urmărind acest trend ascendent, este estimat faptul că industria sporturilor electronice va depăși pragul de 577 de milioane de telespectatori la nivel mondial până la finalul anului 2024.

Această situație a fost în mod clar vizibilă în domeniul jocurilor de noroc, unde am asistat la includerea în cuprinsul ofertelor de pariere a din ce în ce mai multe competiții și evenimente specifice sporturilor electronice. Acestea fiind spuse, în ceea ce privește legislația ce reglementează domeniul jocurilor de noroc pe teritoriul României, menționăm faptul că aceasta nu prevede condiții diferite pentru sporturile electronice, fiind aplicabile aceleași prevederi ca în cazul sporturilor tradiționale. Pe cale de consecință, orice persoană juridică licențiată și autorizată să organizeze activitatea de jocuri de noroc pe teritoriul României are dreptul de a include sporturile electronice în cuprinsul ofertelor de pariere, cu condiția ca acestea să fie prevăzute de Regulile de Pariere al organizatorului. Totuși, includerea în oferta de pariere a evenimentelor sportive electronice doar creează aparența unei proceduri ușor de urmat, în realitate organizatorii de jocuri de noroc întâmpinând nenumărate dificultăți în legătură cu acestea. That being said, regarding the legislation governing the field of gambling in Romania, we mention the fact that it does not provide different conditions for electronic sports, being applicable the same provisions as in the case of traditional sports. Consequently, any legal entity licensed and authorized to organize gambling activity in Romania has the right to include e-sports in the betting offers, provided that they are provided by the Rules of Betting of the organizer. However, the inclusion of electronic sports events in the betting offer only creates the appearance of an easyto-follow procedure, in reality gambling organizers encountering countless difficulties in connection with them. A specific problem of the electronic sports industry is the extreme dynamism that characterizes this field, fact generated by the constant attempt of developers to make changes to the games, with the ultimate goal of keeping interested players and investing in that video game. Over time, there have been many situations in which the developers of a video game have decided to radically change the way the game is played, even in the absence of any prior notification. Such changes were made shortly before a major tournament. Therefore, from the point of view of gambling organizers, this feature of e-sports creates an extremely dangerous environment, as, in the absence of a thorough and continuous analysis of each event included in the betting offers, there is a possibility that a at this point, the odds offered by the gambling organizers do not correspond in any way to reality, as they have no other possibility than to

Another potential factor generating difficulties is that, unlike traditional sports, which enjoy most of the comprehensive regulations in the betting regulations of gambling organizers, e-sports have been introduced in a very short time and are briefly regulated. Lack of regulation causes confusion among players and has the potential to generate misunderstandings, or even disputes between gambling organizers and players.

Of course, this problem could be easily solved by the gambling organizers making comprehensive betting regulations for each e-sport included in the betting offer. In practice, this is extremely rare, if not non-existent. A compromise solution would be for the betting regulations to include comprehensive provisions for each type of game that is part of the betting offer. In this way, even when e-sports are briefly regulated, there are still a number of rules that can guide the resolution of any misunderstandings between players and gambling organizers. De la început aș preciza faptul că publicitatea și promovarea unei activități desfășurate legal, așa cum este cazul operatorilor licențiați, este legitimă. Dar, în același timp, așa cum prevede legislația domeniului, această promovare trebuie să se desfășoare ”(…) cu respectarea principiilor privind protecția minorilor și participarea responsabilă la jocul de noroc.”1 Din păcate, în lipsa unor norme de punere în aplicare a legii, a rămas o zonă aflată la limita prevederilor legale, zonă de care ”profită” în special afiliații, considerând că nu se încalcă cadrul legal prin care să se asigure această promovare ”responsabilă”. Mai jos am spicuit câteva expresii folosite în materialele de promovare a jocurilor de noroc, exemple luate la întâmplare, pentru a ne face o idee despre ce înseamnă ”responsabil” pentru unii: - câștiguri la câteva click-uri distanță - pariurile ca investiție - învață să pariezi eficient - cum să câștigi bani pe internet (cu referire și la jocurile de noroc) - cum să învingi casele de pariuri - ai nevoie de un venit suplimentar? - cum să câștigi mai des la pariuri - profit garantat la pariuri – ponturi - dublarea banilor la pariuri - pariază acum! Notă: cuvântul ”pariu” din expresiile citate nu se referă doar la pariurile pe evenimente sportive, fiind vorba de jocuri de noroc – în mod generic. Aș invita la un auto-control, o auto-cenzură, pe cei ce promovează jocurile de noroc în acest fel, ceea ce cred că ar fi benefic pentru întreaga industrie. From the outset, I would point out that advertising and promoting a lawful activity, as is the case with licensed operators, is legitimate. But at the same time, as required by the legislation of the field, this promotion must take place “(…) in compliance with the principles of protection of minors and responsible participation in gambling.” 1 Unfortunately, in the absence of law enforcement rules, it remained an area at the limit of legal provisions, an area that “benefits” especially affiliates, considering that it does not violate the legal framework to ensure this promotion “responsible ”. Era un prim demers de a sensibiliza operatorii cu privire la ”responsabilitatea” în marketingul jocurilor de noroc, fără a institui însă o normă obligatorie. Prevederile din acest Cod etic au fost inspirate de coduri similare din mai multe state, preluând parțial chiar unele prevederi cu putere de lege în unele jurisdicții. Cu toate că în capitolul ”Asumare” din Cod am precizat clar ca ”Prezentul cod etic se dorește a fi un ansamblu de norme, la care toți cei implicați în domeniul jocurilor de noroc consimt în mod liber (…)”, reacțiile venite din partea unor reprezentanți ai operatorilor au fost de respingere a acestei inițiative. Această reacție a fost cu atât mai surprinzătoare, cu cât am simțit nevoia să subliniem: ”Prezentul set de reguli privind comunicarea comercială responsabilă în domeniul jocurilor de noroc este un document supus dezvoltării și permanentei adaptări la evoluția domeniului jocurilor de noroc, a noilor metode și canale de comunicare. În acest sens, ONJN este deschis oricăror propuneri și sugestii de îmbunătățire, atât din partea industriei de gambling, a jucătorilor, a altor instituții, cât și din partea publicului, a reprezentanților mass-media, a unor ONG-uri sau alte organizații interesate de comunicarea responsabilă în domeniul jocurilor de noroc.” O explicație a opoziției față de un cod etic neobligatoriu a fost faptul că este posibil (de așteptat) ca această formă de conformare benevolă la un set de norme privind comunicarea comerci-

ală resposabilă, să fie urmată de prevederi legale obligatorii, având ca punct de pornire acest cod. Aș mai menționa, fără a fi malițios, că printre cei mai vehemenți opozanți ai Codului etic au fost unii avocați ai operatorilor, chiar în situația în care propunerea nu era una cu putere de lege. Am încercat să explic operatorilor, reprezentanților acestora la discutarea codului, faptul că este dovedit că un set de norme la care cei vizați pot adera de bună voie, are o eficiență mult mai mare decât instituirea unor reguli obligatorii. Fără (prea mult) succes, din păcate. În numărul următor al revistei voi reveni asupra Codului etic de comunicare responsabilă în domeniul gamblingului, prin prezentarea prevederilor cuprinse în acest demers din perioada în care am condus ONJN.

Although in the “Assumption” chapter of the Code we have clearly stated that “This code of ethics is intended to be a set of rules, to which all those involved in the field of gambling freely consent (…)”, the reactions from some representatives of the operators were rejecting this initiative. This reaction was all the more surprising as we felt the need to emphasize: “This set of rules on responsible commercial communication in the field of gambling is a document subject to the development and permanent adaptation to the evolution of the field of gambling, new methods and communication channels. In this regard, the ONJN is open to any proposals and suggestions for improvement, both from the gambling industry, players, other institutions, and from the public, media representatives, NGOs or other organizations interested in responsible communication in the field of gambling.” One explanation for the opposition to a non-binding code of ethics was that it is possible (expected) that this form of voluntary compliance with a set of rules on responsible commercial communication would be followed by mandatory legal provisions, starting with this. code. I would also mention, without being malicious, that among the most vehement opponents of the Code of Ethics were some lawyers of the operators, even in the situation when the proposal was not one with the force of law. I tried to explain to the operators, their representatives when discussing the code, the fact that it is proven that a set of rules to which those concerned can voluntarily adhere, has a much higher efficiency than the establishment of mandatory rules. Without (too much) success, unfortunately. ă ocup de business coaching și în activitatea mea folosesc destul de frecvent eneagrama, un instrument puternic, care facilitează înțelegerea comportamentului uman și care m-a fascinat stârnindu-mi curiozitatea de a-i aprofunda utilizarea. Într-o companie, cu cât un angajat înțelege propriul tipar comportamental și pe al celorlalți, cu atât mai mult cresc rezultatele pe care le obține și ca urmare se dezvoltă optim întreaga echipă. Astfel cu cât un antreprenor investește mai mult în personalul său, facilitând utilizarea de instrumente și metode eficiente, cu atât crește succesul companiei sale. Cred cu tărie în dezvoltarea personală permanentă a angajaților;

acesta este unul dintre motivele pentru care folosesc eneagrama, tocmai pentru că este un model care permite analiza și evaluarea comportamentală în interiorul companiei. Cu ajutorul eneagramei se pot identifica punctele forte ale angajaților, dar în special vulnerabilitățile (de exemplu, unde se cheltuie energia resursei umane) și se poate interveni pentru a transforma, remodela, direcționa eforturile, astfel încât angajații să devină mai productivi și mai receptivi. Eneagrama descrie nouă tipuri diferite de personalitate, include nouă viziuni distincte asupra lumii și modul în care acestea interacționează în contextul lor de viață, oferind totuși o abordare profundă și foarte dinamică a oricăruia dintre angajații companiei. Este un instrument antic, folosit pentru observarea și explorarea comportamentului uman și care conectat la neuroștiința modernă ajută la înțelegerea diferitelor comportamente umane. De exemplu, ajută la înțelegerea modului în care diferitele tipuri de oameni preferă să ofere și să primească feedback, care sunt preferințele lor în abordarea conflictului, care sunt strategiile lor de luare a deciziilor și ceea ce îi motivează. De asemenea se pot identifica diferitele stiluri de negociere pe care le poate folosi o persoană, punctele tari și punctele slabe care trebuie îmbunătățite în procesul de comunicare organizațională, etc. Mai jos vă prezint câteva dintre ariile în care poate fi folosită eneagrama: Comunicare. Toate cele 9 tipologii umane analizate prin intermediul eneagramei au strategii diferite pentru filtrarea informațiilor și fiecare are propriul mod de a-și exprima ideile. Eneagrama ne învață limbajul tuturor celor 9 tipologii, ceea ce duce la o comunicare mai productivă și fără conflicte la locul de muncă. Conducere. Scopul este ca liderul să-și înțeleagă punctele forte și limitele, ceea ce va spori capacitatea de a avea perspective multiple. Liderul poate beneficia de cunoașterea modului în care stilul său de conducere este perceput de ceilalți, poate învăța cum să convingă, să instruiască și să susțină în mod eficient diferitele tipuri de oameni pe care îi conduce. Dinamica echipei. Eneagrama încurajează oamenii să observe cum interacționează între ei și cum se angajează în cadrul unei echipe; acest lucru creează conștientizarea și coeziunea echipei. Astfel, echipa învață să se adapteze la ceea ce este important pentru fiecare dintre membrii săi și subliniază modul în care fiecare dintre ei este înclinat să ia decizii. In a company, the more an employee understands his own behavioral pattern and that of others, the more the results he obtains increase and as a result the whole team develops optimally. Thus, the more an entrepreneur invests in his staff, facilitating the use of efficient tools and methods, the greater the success of his company. I strongly believe in the permanent personal development of employees; this is one of the reasons why I use the enneagram, precisely because it is a model that allows behavioral analysis and evaluation within the company. Ceea ce pot adăuga din experiența proprie este că, folosind acest instrument am obținut rezultate deosebit de bune în companiile în care l-am aplicat. Angajații s-au simțit mai implicați, comunicarea și colaborarea lor s-a îmbunătățit și, în sectorul vânzărilor s-a evidențiat clar o creștere semnificativă a calității și performanței. Este un instrument care permite angajaților să îi înțeleagă mai bine pe cei din jur, pentru că a fi conștienți de faptul că fiecare are propriile provocări interioare îi face mai plini de compasiune, mai flexibili în gândire și mai puțin rigizi în a judeca. Așa cum scheletul susține corpul, comportamentele noastre sunt susținute de un nucleu psihologic din care provin gândurile și unde sunt stabilite credințele, valorile, prioritățile și aspirațiile care alcătuiesc personalitatea noastră, a fiecăruia. Astfel, putem considera eneagrama ca un manual de instrucțiuni al condiției umane prin care putem înțelege motivațiile mai profunde, adesea inconștiente din spatele comportamentelor și atitudinilor noastre.

Thus, the team learns to adapt to what is important to each of its members and emphasizes how each of them is inclined to make decisions. Gaining this knowledge allows the development of an efficient team. So, there are many advantages to working with enneagram in a company. It highlights how employees develop behaviors in the workplace. He also points out that no matter how open some people are, they all have behavioral patterns of thinking, which can make it difficult to recognize and accept other points of view.
