Babyface Will Headline The Rochester Summer Soul Music Festival: Schedule Announced

rammy winner Babyface will headline the 26th annual Rochester Summer Soul Music Festival in August. The singer, songwriter and producer caps off a two-day slate of events that kicks off Friday, Aug. 26, and continues Saturday, Aug. 27, at Frontier Field. At 5 p.m. Friday, the festival will host the ROC Summer Soul Tailgate in the Frontier Field VIP parking lot. The evening will feature some live entertainment, food, drink vendors and family fun. Tickets are required for entry. From 10 a.m. to 4 p.m. Saturday, the festival continues with a free ROC Summer Soul Community Block Party at the Frontier Field VIP parking lot. Residents Have Mixed Emotions as Jefferson Avenue Tops Reopens Today marks the two-month anniversary since the tragedy that took the lives of 10 beloved members of our community and injured three on May 14 at the hands of a white supremacist in a racist mass shooting at the Tops Jefferson Ave location, the only local supermarket over the past 19 years for miles in the area. The tragedy shook the community and left families in unforeseen pain that has no measure. Now approaching the end of month two since the attack, Tops will reopen its doors quietly and respectfully on the morning of Friday July 15 despite calls from some community members and local leaders to open in a different East Side location. We spoke with several residents who were in the area of the large memorial who voiced mixed emotions about the store reopening:

Betty Grant’s Non-Jury Trial July 21: Community Support Urged! .
Because the election law she was accused of violating was so outdated, Buffalo City Court Judge Andrew C. LoTempio recently dismissed the charges against her thanks to an Amicus Brief ( “Friend of the Court") filed on her behalf by attorney Peter A. Reese in February. The judge did, however, rule that prosecutors could still proceed to trial on a harassment count against the former Erie County Legislature chairwoman, which will take Betty Grant place on Thursday morning July 21 at 9 a.m. in Buffalo City Court . While Betty Jean Grant has been dragged thru the courts for the past several months, another voting violations case involving a 59-year-old poll worker who was accused of stamping Byron W. Brown's name as a write-in candidate for mayor in the November election, pleaded guilty to a single misdemeanor count of attempting to commit a crime against the elective franchise. It was resolved quickly. She was sentenced to an unconditional discharge and was ordered to pay $100 fine. She had originally been charged with a felony. Even though the judge has disposed of the misdemeanor against Mrs. Grant, the DA’s office still wants to go to trial on harassment. Talk about disparity. This has been a legal travesty from day one and a waste of taxpayers money. The community is urged to come out and show support for activist Grant next Thursday. Hope to see you there!
Attorneys for Tops Mass Murderer Given More Time to Prepare Case Erie County Judge Susan Eagan last week gave defense attorneys for the White supremacist who murdered 10 people in the Tops Market massacre until October 6 to file notice of a psychiatric defense. She also rejected request by the defense to delay the state prosecution a year while the federal case proceeds.
Katherine A. Dukes-Weber: “I’m a little conflicted about it opening because knowing what went on in there it will never change that feeling of being unsafe. Even though we need it open because there are no other stores in the area. I think they should have thought about it before opening up so soon. I wish that the other stores like Wegmans and Aldi’s would come to this area so there are different options for people.” Kareema Morris of Burry the Violence: “I’m very disheartened that Tops is opening so soon in the community that is still in the process of healing. I can only imagine how the citizens that live right here are gonna feel when they have been scared to come out of their homes to even get the free items. I’ve been delivering to their homes. I don’t think they were considering the people who actually live door to door right here in the community.” Marnetta Malcolm: “I think it should re-open. I don’t want to use the word 'desert' but there’s definitely nothing else in the community where you can come and get food. If we can get people in this community back to their normal lives the better it will be and we'll start with having Tops open because it is needed.“ Dayatra Amber Hassan : “My daughter worked at this Tops. She wasn’t there when the incident occurred and we live around the corne. We need a grocery store, but we also need our own voice, our own energy and our own businesses. This Tops ...this structure sort of feels like it’s from outer space. I don’t see anything that looks different from how it was, and it needed help in the first place." Sherline Starks: “I’m grateful that the Tops is opening on Friday, but we are always gonna feel the pain of the tragedy that happened to all of us especially the family members. I’m a Christian and I feel some kinda way.I feel sad. I won’t be going back in there. I’m not trying to down him, but Byron Brown needs to do more, the politicians need to do more, the City of Buffalo needs to do more." Solar The Community's Daughter: “I am excited. We held Tops accountable for not just being able to take away a business that is essential in our community… I would like to say remember that somebody may just need a 'trauma partner.' There are people who are not going to go in there to shop' they're going in there to see if they can rekindle the idea of shopping in their community. So be prepared to hold someone’s hand.” Terry Patterson: “I think the Tops is opening too soon. It’s only been 60 days and the community needs more time to heal. I understand the food desert and people trying to find ways to get food, but I feel it’s too soon to be open." Delaney S. “I don’t mind them opening theTops back up because it’s in our area and we do need this Tops right now. We have too many seniors out here who don’t have transportation and have no choice but to come here. I hope and pray this is the right choice that Tops is making for us out here because for me, I’m coming back.” Earl Williams “I think It’s good the community needs a market but I feel like a ghost spirit is going to be in the Tops. Even though it’s convenient. What happened there is so tragic. Its gonna take me a while to re-enter it that quick. They are doing all the remodeling and all that but what happened is not going to be erased. You can’t erase that."
VOTE THEM OUT! Residents Briefly Shut Down Council Meeting!
On Tuesday the Buffalo Common Council found themselves under significant community scrutiny, as scores of residents filled Council Chambers to express their astonishment and anger at a redistricting process gone awry. For the past six weeks, residents of Buffalo have been writing, calling, and petitioning their Council Members to request that the redistricting process be more transparent, inclusive, and focused on racial equity and keeping neighborhoods together. The Council has ignored these calls, instead presenting a revamped map that is actually less racially equitable and more divisive of neighborhoods. Buffalo residents convened in Council Chambers Tuesday to let the members know how disappointed and frustrated they were by the myopic, self-interested, gerrymandered map. These same residents briefly disrupted the meeting, first chanting, “This is what democracy looks like,” and disregarding the City of Buffalo’s Corporation Counsel’s feeble attempt to dissuade the residents of Buffalo to engage the Council on this issue. Finally, disenfranchised Buffalonians from across all parts of the city chanted, “VOTE THEM OUT,” as the crowds departed from Council Chambers immediately following the agenda item.

Covid Is Not Over: Understanding The New BA.5 Omicron Strain T
he BA.5 variant is now the most dominant strain of COVID-19 in the country, according to the Centers for Disease Control and Prevention. And while it's hard to get an exact count — given how many people are taking rapid tests at home — there are indications that both reinfections and hospitalizations are increasing. More people appear to be contracting the virus multiple times in relatively quick succession, as the BA.5 omicron subvariant sweeps through the U.S. For example: Some 31,000 people across the U.S. are currently hospitalized with the virus, with admissions up 4.5% compared to a week ago. And data from New York state shows that reinfections started trending upwards again in late June. "Not only is it more infectious, but your prior immunity doesn't count for as much as it used to," explains Dr. Bob Wachter, the chair of the Department of Medicine at the University of California, San Francisco, And that means that the old claim that, 'I just had COVID a month ago, and so I have COVID immunity superpowers, I'm not going to get it again' — that no longer holds." Is BA.5 more dangerous? So far there is no evidence that this variant causes more serious illness. And infectious disease experts say that even though new infections are on the rise, the impact of BA.5 is unlikely to be on the scale of the surge we saw last winter — in part because the country is better equipped to manage it. The U.S. is averaging about 300 deaths a day, compared to 3,000 last winter. What can people do to protect themselves? There are steps you can take to reduce your exposure to the virus, like masking up in crowded indoor spaces. Here's how to step up your mask game. "An N95 is more protective because it has a better face seal in general than a KN95 or a KF94, N95s are strapped to your head with headbands, which give them a snug fit — and with masks, a tight fit is key to better protection. In its new guidance, the CDC notes that N95s and other respirators approved by the National Institute for Occupational Safety and Health (NIOSH) are the most protective options. By contrast, both KF94s and KN95s attach with ear loops, which many people find more com-
fortable but that don't seal quite as tightly to your face.

The Fight For Justice Continues as “Buffalo 5” Survivors File $224 Million Lawsuits Against Buffalo and Erie County
L
ast Thursday on the steps of City Hall attorneys for “Buffalo 5” survivors John Walker and Darryl Boyd announced that they were filing a $224 million lawsuit against Buffalo and Erie County for their 1970s wrongful conviction. Walker and Boyd , who were wrongfully convicted of murder in 1976, each filed $112 million lawsuits against the City of Buffalo, the County of Erie, and several former detectives for causing them to spend a total of 50 years in prison and another 40 years on parole. Walker and Boyd each seek $84 million in compensatory damages for the years they spent in prison, plus $28 million in punitive damages. “This case is a permanent stain on Buffalo and Erie County – how many other young Black men suffer the same injustices but lack the resourcefulness and courage of John and Darryl to fight their convictions?” said New York civil rights attorney Joel B. Rudin. According to the lawsuits, Buffalo detectives coerced two teenaged friends of John and Darryl to testify falsely against them, knowing the testimony was false. In addition, the suit accuses the Buffalo Police Department and the Erie County District Attorney’s Office of covering up powerful evidence that a neighbor of the murder victim committed the crime. The lawsuits seek to hold the City and County responsible based on evidence that alleged wrongdoing by the detectives and prosecutors, including their alleged failure to disclose evidence favorable to the defense as required by law, resulted from unlawful policies and practices of these municipalities. “We are prepared to fully litigate this case and expose the policies and practices of the Buffalo police department and the Erie County District Attorney’s office,” said Rudin. Their actions the suit alleges, resulted in John and Darryl and other defendants unlawful convictions. “The Remarkable thing about this case in terms of evidence…. Tops Set to Open While the Survivors are Left to Struggle

ops Market has announced the reopening of its Jefferson Avenue location for Friday July 15, 2022.
The community is divided on whether the store should open at all, and that’s due to the trauma that exists around the place. There’s one survivor’s story that described the scene as she exited one of the break room that day. She said the inside of the store was so hot and there was so much blood that it formed a steam in the air that she could taste. She had to leave out of the front door as she stepped over bodies with her 14-year-old daughter at her side. Two ladies who were shopping InstaCart that day for their first time. There has been no union to advocate for them, no state benefits to kick in from their contract job, and no effort made by the multiple organizations to help organize them through mental health, financial or legal help. Story after story, describes the helpless state that so many of our community members are left with. Outside of gift cards and food drives, people haven’t seen much in the way of assistance to help deal with the trauma that was endured that day. Those who were in the store on May 14th and who were not employees of Tops have not received any direct compensation for their loss of employment unless it was provided by their employer. Even the Tops employees are no longer compensated for their loss of work, as the store is set to reopen. It’s difficult for anyone to understand exactly what assistance is available, and who it is available for. Workers Compensation (877-632-4996) is available for the Tops employees that were there that day, and anyone on the clock for their employer who meets the qualification requirements as outlined by NY State. The compensation board claims that mental illness brought on by a traumatic workplace experience makes an individual eligible for benefits, but they must have an evaluation performed by an approved provider. New York Crime Victims’ Compensation Program provides the Erie County District Attorney’s office as the point of contact (716-858-2400) has compensation available, and according to their website, the Office of Victim Services may be able to help with medical bills and counseling expenses; burial and funeral costs; lost wages; and other types of assistance. The program will replace salaries up to $600 per week or $30,000 for the year, which equates to roughly $15 per hour. Victim services requires proof of employment and hours, and they claim to be the last resort with respect to direct compensation. Resource Council of WNY (716-783-8259) is located at 347 East Ferry St. and has been the site of the daily food giveaways featuring the Tops trailer. Here is where they have the applications available for Victim Services support and the Home Energy Assistance Program to aide with energy costs. The organization has also raised over $11,000 which it claims will be used for distribution of food and household staples to the community. Buffalo 5/14 Survivors Fund organized by the Compassion Fund (855-484-2846) had collected nearly $3 million in their update from June 13th, but there is no easy way to understand how much money they have collected since. The first meeting for the compassion fund will be July 21st at City Honors High School and the planned roll out of benefits will be October/November time line. There is no known dollar amount or percentage that will be distributed to those impacted, just a base guideline in which the families of the deceased will have the higher portion, followed by those physically injured and then those present and not physically injured. There are provisions in the fund that open it up to those who were not in the store but present in the area as well. Community Organizations Jalonda Hill from Colored Girls Bike Too, Phylicia Brown from Black Love Resists in the Rust (BLRR 716-402-8313), and Drea D’Nur from Feed Buffalo (716-588-0137) are some of the Black led organizations who have provided direct assistance to those impacted in the way of money, mental health, fresh food, and other household staples. They can arrange delivery and have access to other organizations to help with other needs as well. The bottom line is that the state programs and the millions raised haven’t made its way to the people yet. No known survivors have received any direct compensation from workers compensation or victim services at this time, only phone calls and qualifier interviews with no set time frame on when benefits will kick in. The direct compensation from the survivor’s fund is still under debate with a time line months away. While Tops Market is on a fast track to re-open their facility, those impacted are still awaiting the bureaucratic and arduous process before they can start receiving benefits.

5th Annual Teaching Black History Conference UB Center for K-12 Black History and Racial Literacy Education will be presenting its 5th annual Teaching Black History Conference July 22 through 24 from 8am–4pm at City Honors School, 186 East North Street with face to face, virtual or in a hybrid format. What's Next?
hat’s next? On May 14, 2022, on the EAST SIDE of Buffalo, the Tops market was proven to be a very vulnerable soft target for a white supremacist. On that day African Americans of Buffalo became victims of domestic terrorism. As a people nationwide we have three enemies. The first enemy is ourselves. In 2019, at least 7,484 African Americans were killed at the hands of other African Americans. That number shot up to 9,941 in 2020. We can only imagine the final count of this ensuing year. Darvin The second enemy is local police agencies. In 2021, 1,051 people were killed ADAMS by law enforcement. Some 27% of those killed were African American, despite the fact that African Americans make up only 13% of the population. The third enemy, and the one that has plagued us since we hit these shores, is white supremacy, which continues to raise its ugly head. And it’s on the rise, evidenced by the number of hate crimes. As African Americans, we need to take lessons from the Jewish people. They have their own intelligence agency and they monitor all hate groups that pose a threat to the Jewish people. According to the Department of Homeland Security, the gravest threat to the United States are the White Supremacists. Since the May 14th massacre, not one of our Black political leaders have said anything or raised the critical issue regarding security of the African American community. Their top priority issuing resolutions to change our name/identity as a community. What should we be called, the East side, or East Buffalo? Really guys? Is that more important than the security of the African American community? We can’t depend on the government to protect us. Fine example - the Buffalo police. How many times has one dialed 911 and once officers arrive some act unconcerned, unprofessional and uncaring. They look for reasons to arrest our young men and women also opposed to their sworn duty to “protect and serve.” Until Black lives matters to Black people, only then will Black lives matter to the rest of society. We as a people have to come off all the stigmas that keeps us down and oppressed. We have to go back to the old way of living. It takes a village to raise a child, and it takes warriors to protect the village! Come on Blackman! It’s time to stand up for your village, for your families and for your children. I'm just sayin...

My Opinion on the Reopening of Tops Supermarket on Jefferson Ave.
I
am not going to hedge around this topic. Is it a controversial topic in our community? Absolutely, it is. Will everyone agree on whether Tops should reopen or not? Absolutely not. Should we boycott the store if we don't agree with it reopening? Sure, if we believe in cutting our nose off to spite our face! I understand the hesitation many, including some members of the families who lost loved ones, have about going back into that store. I respect and honor their decision and I know they will do what is best for their families and households. I also respect and admire those family members and community residents who say that even though they, personally, would never again shop there, they recognize the fact that many senior citizens and residents, without cars, utilize that store almost on a weekly basis. I appreciate the fact that people are smart enough to know that they can shop there if they wish and are wise enough to allow those who want to shop there, to do so in peace and without disruption. The Tops Market on Jefferson has been my place to shop since I was part of the City of Buffalo officials that funded it in 2001. I have not gone to another food market since the massacre. I have supplemented my food supply by shopping for milk, bread and canned goods at Dollar General and Family Dollar stores. Even though I appreciated and utilized the fresh produce given away by Tops, Wegmans and a generous community of donors, It will be nice to purchase fresh meats, fruits and vegetables from a well-stocked supermarket again. The reopening, rededication service will be at the store on Thursday, July 14th @ 2 PM for the special guests and dignitaries. A program that includes prayer services to pay tribute and respect to the injured and those whom we lost will be conducted by pastors and messages of hope and inspiration will be delivered by Mayor Byron Brown and other elected and community leaders. The supermarket will open for regular business on Friday, the next day.
The Wall Street Journal has a pictorial essay of the neighborhood around Tops and mentions the Fruit Belt. See: https://www.wsj.com/story/as-buffalo-redevelops-east-side-is-left-behind-22bbbc20 This article is far more realistic than the rosy advertisement posing as journalism in a recent New York Times article. Dennice is quoted in the WSJ: "People over on this side of the city are paying taxes for a neighborhood that has received no investment from the city in generations." Dennice Barr, who has lived on the East Side for over 20 years." The WSJ also acknowledges the transportation problem in getting groceries-- the first time I've read in news reporting of this serious issue. It is acknowledged that many in the neighborhood take two buses for a 45 minute commute to get to the nearest grocery store from the Jefferson Ave Tops. Transportation to food sources is no small issue, especially since Buffalo census figures cite that 28% of all Buffalo residents regardless of race do not own a vehicle. Contrast Erie County statistics where 12.5% do not own or have access to a vehicle. For census tract 33.02 (Cold Spring): "An estimated 598 households (±166) have no vehicle available, or approximately 50.5% (±10.8%) of all households." Nationally, 8.5% are without vehicle availability. From the National Equity Atlas: " Black households are least likely to have access to a vehicle." For those using the Jefferson Ave Tops, they are likely getting there by walking, bus, or bicycle. Also of interest in the WSJ reporting: "Black people make up roughly 80% of residents in the ZIP Code [14208] where the May shooting took place. The average household income is about $45,160. Less than 2 miles away in another ZIP Code, which extends west from Main Street, roughly 60% of residents are white and the average household income is about $88,000."

If the Council’s proposed map remains unchanged prior to adoption, legal action is imminent. Buffalo residents are tired of fighting tooth and nail for something as basic as due process by its city government. They have been misled and lied to by Council Members for the entirety of this process, from being erroneously told that the maps had to be drawn around seated Council Members’ homes, to the illegal rushed attempt at voting in the Council’s preferred maps on the Friday before the 4th of July long weekend, to this latest debacle: late filing and then putting off a vote on a map that is actually more retrogressive than its predecessor.

OR a Bachelor’s Degree from an accredited college or university in a related field. OR a combination of an Associates’s Degree and one year of experience in the above.
