Cariol Horne Whistleblower Fund Established The Western New York Peace Center has established the Cariol Horne Whistleblower fund to assist any police officer in Erie County who steps up as she did and suffers repercussions (suspension with loss of pay, lawyer’s fees etc.) because of it. The center also plans to reach out to churches to partner in a social justice effort. Cariol, a true heroine, was fired in 2008 after she stepped in to save the life of an African American man who had been placed in a choke Cariol Horne hold by a fellow officer, Gregory Kwiatkowski.

The goal is to encourage officers to do – like Cariol – the right thing! We should all give!

Restorative Practice Advocates to Hold a Press Conference to Address School Discipline and PUSHOUT! Tolbert Opens Jefferson Avenue Headquarters Launches 'Get Out The Vote' Campaign Candidate for Erie County Sheriff, Bernie Tolbert last Saturaday opened the doors to his city campaign headquarters at 1327 Jefferson on Buffalo’s East Side. In speaking to campaign supporters, Tolbert noted the importance of the location.

“With weeks to go until election day, it is vital that we focus on getting out the vote throughout Erie County,” Tolbert stated. “The central location of this office will facilitate canvassing and lit drops across the city, as well as offer a strong visual reminder of my candidacy in this core area, where it is needed.”

Tolbert’s office formerly served as the district location for Erie County Legislator, Betty Jean Grant.

“From my years of serving as the legislator in the 2nd district, this office has become a proven base of community outreach," stated Grant. " That’s why it’s important that Bernie Tolbert set up his campaign headquarters here, where people are used to gathering and working for the community. I have no doubt that all who come together at this space between now and November 7th will help elect Bernie as the first Democratic Sheriff that Erie County has had in a long time.”

Tolbert’s campaign is focused on the failings of Erie County Sheriff Tim Howard during his 12-year tenure including 22 deaths and suicides in the county holding center and jails, Howard’s questionable overtime practices that have contributed to many of the wrongful death and other lawsuits involving the county jails, the extensive litigation and associated costs to taxpayers in defending the sheriff in court and the sheriff’s lack of leadership in dealing with the rising opioid crisis across Erie County.

-Sheriff "Coward" Video ReleasedThe Tolbert for Erie County Sheriff Campaign this week released a video questioning Sheriff Tim Howard’s refusal to participate in a series of candidate forums and debates. According to campaign spokesperson, Christina Abt, the end result of Howard’s refusal is a disservice to the voters of Erie County.

"Not only is the sheriff’s disregard for these long-standing election forums a slap in the face to the organizers, his decision to not openly and transparently debate the issues surrounding the 22 deaths in the holding center, 700 opioid deaths in Erie County over the last two years and $2.5 million in county lawsuit settlements with a projected $1.5 million yet to come, is a clear indication of his disrespect for the voters who have elected him and for whom he works,” said Abt. The video can be viewed on Bernie Tolbert for Erie County Sheriff’s Facebook page.

Bernie Tolbert is the former Special Agent in charge of the FBI’s Buffalo office overseeing the Western New York region. He has more than 30 years of professional experience at the highest levels of law enforcement and corporate security. Born and raised in Buffalo, Mr. Tolbert holds a master degree in social work from the SUNY Buffalo and worked in education and social work in Erie County before launching a career with the FBI. Tolbert’s campaign platform includes four primary agenda items: •Clean up the county jails and restore pride and professionalism to the Erie County Sheriff’s Office.

•Beat the opioid and heroin addiction epidemic ravaging Erie County.

•Collaboratively work to turn back the tide of rising street crime.

•Restore a culture of respect and civility in the sheriff's office.

Tolbert cites admonishments issued by the State Office of Correction against Sheriff Howard for covering up suicide attempts to avoid reporting them to Albany and the sheriff’s publicly stated policy of not reporting all suicide attempts to the OOC. In addition, his campaign points out that there have been numerous lawsuits filed against the sheriff and analysis of the litigation fees and associated costs arising from those lawsuits show a known total of $2.5 million in extra, unbudgeted costs to taxpayers and a conservative estimate of $4 million overall once additional and still undisclosed cases.

Only three new U. S commemorative coins appeared during the period following World War II, and two of these were tributes to Black Americans. The first was the Booker T. Washington half dollar, authorized by Congress in 1946 to perpetuate the teachings and ideals of the famous Black educator. This was the first U.S. coin to carry the likeness of a Black man or woman It also was the first to be designed by a Black: The portraiture was prepared by well-known Black artist Isaac Hathaway. The coin bears a bust of Booker T. Washington, a man who was born a slave and rose to become the founder and president of Alabama's Tuskegee Institute.

The reverse underscores this dramatic achievement by featuring the inscription "FROM SLAVE CABIN TO HALL OF FAME."

George Washington Carver was the second Black man to appear on United States currency.This coin would honor not just one but TWO great Black figures, this time adding the revered botanist and agricultural scientist Carver, along with his friend and colleague Booker T. Washington.

Great Grandson of Haile Selassie Weds Few love stories resemble a fairy tale as much as the courtship and marriage of Ariana Austin and Joel Makonnen.

Joel Makonnen, known as Prince Yoel, is the 35-yearold great-grandson of Haile Selassie, the last emperor of Ethiopia. Ariana Austin, 33, is of African-American and Guyanese descent; her maternal grandfather was a lord mayor of Georgetown, the capital of Guyana. Their union happened when “Old World aristocracy met New World charm.” The old and new combined on Sept. 9, in a marathon day of events that lasted from 11 a.m. until late in the evening, and took place within two states. The festivities began with a ceremony at the Debre Genet Medhane Alem Ethiopian Orthodox Tewahedo Church in Temple Hills, Md. Hours after the ceremony, the pair celebrated with a formal reception at Foxchase Manor in Manassas, Va., with 307 guests, amid gold sequins, platters of Ethiopian food and preboxed slices of Guyanese black cake for people to take home.Their marriage had been more than a decade in the making. They first met on the dance floor at a Washington, D.C. night club.

U.S . Possesses The Most Destructive Nuclear Arsenal on Earth…

According to a recent New York Times analysis, the U.S could use 1,103 nuclear warheads and decimate China, Russia, North Korea, Iran, Libya, Iraq and Syria… and still have 2,897 left. Yet Trump is pressing for a massive buildup in the already massive American nuclear arsenal, which already contains too many…This fact lends more urgency to the question about President Trumps competency, the man who has his “finger on the button…”

In Somalia: Mogadishu Atrocity Hundreds of Somalis marched in the streets of Mogadishu on Sunday to protest a deadly blast that killed 276 people in a busy shopping district in the country’s deadliest single bomb attack.

About 300 others were reported injured in the attack, Information Minister Abdirahman O. Osman said.

It occurred when a truck carrying explosives detonated Saturday in a crowded street packed with cars and pedestrians, near government ministries and hotels.

Demonstrators on Sunday included many women in flowing gowns, protesting an attack that the Somali government blamed on the Al Qaeda-linked Shabab, a Somali extremist group that has carried out many similar attacks in the past. No one had claimed responsibility for the attack.

The death toll rose sharply Sunday as bodies were recovered, many of them burned in cars and nearby buildings. Somali President Mohamed Abdullahi Farmaajo said the attack showed Somalia’s enemies cared nothing for human lives.

Many of the dead had not been identified, with dozens burned beyond recognition.

Liberia election: Weah and Boakai headed for presidential run-off Former football star George Weah and Vice-President Joseph Boakai are headed for a run-off in Liberia's presidential election.

Nearly all the results from Tuesday's poll have been counted, the election commission says.

Mr Weah, the first African to win the Ballon D'Or football award, is leading with 39%, while Mr Boakai is in second place with 29%.

A second round between the pair has been set for 7 November.

They lead the field of 20 candidates who competed to succeed Ellen Johnson Sirleaf, Africa's first female elected president and a winner of the Nobel Peace Prize.

A candidate needed more than 50% of the votes for victory in the first round.

Fewer than 5% of polling stations have yet to declare results, and lawyer Charles Brumskine is in third place with 9.8%.

Liberia, which was founded by freed US slaves in the 19th Century, has not had a smooth transfer of power in 73 years.

Ms Sirleaf took office in 2006, after her predecessor, Charles Taylor, was forced out of office by rebels in 2003, ending a long civil war.

Taylor is currently serving a 50-year prison sentence in the UK for war crimes related to the conflict in neighboring Sierra Leone.

Mr Weah, 51, has chosen Taylor's ex-wife Jewel Howard Taylor as his running mate.

Free Community Mental Health Forum Set

African Americans and Mental Illness: “Discussing Service and Addressing Needs”

D

r. Catherine Collins Women’s Radio Program is partnering with the Buffalo Chapter of The Links Inc. and ECMC Community Relations to present a Community Mental Health forum “Discussing Service and Addressing Needs” from 10 a.m. to 12 noon on Oct 21 at Mt. Olive Baptist Church, 701 E. Delavan. The event, which will feature a panel of health professionals, is free and open to the public.

Unfortunately Mental illnesses, including depression, anxiety, bipolar disorder and schizophrenia, widespread in the U.S. and often misunderstood isn’t talked about much in the Black community. It’s almost considered to be taboo, and that really needs to change.

1 in 5 Americans will experience a mental health condition in their lifetime, and African Americans

are no exception.

Because of the stigma surrounding mental health, particularly in the Black community, many people are not aware of how it affects the intersection with crime and criminal justice reform.

Today, Black men and women make up approximately 1 million of the nation’s 2.3 million incarcerated population. For these men and women life in prison can worsen underlying mental illnesses and make it even more likely that they’ll end up incarcerated again after serving their initial sentence.

Lack Of Information And Misunderstanding About Mental Health

In the African American community, many people misunderstand what a mental health condition is and don’t talk about this topic. African Americans may be reluctant to discuss mental health issues and seek treatment because of the shame and stigma associated with such conditions. Many African Americans also have trouble recognizing the signs and symptoms of mental health conditions, leading to underestimating the effects and impact of mental health conditions. Some may think of depression as “the blues” or something to snap out of.

The following information is provided by the African American Community Mental Health Fact Sheet released by the National Alliance on Mental Illness: • African Americans in the United States are less likely to receive accurate diagnoses than their Caucasian counterparts. Schizophrenia, for instance has been shown to be over diagnosed in the African American population • Culture biases against mental health professionals and health care professionals in general prevent many African Americans from accessing care due to prior experiences with historical misdiagnoses, inadequate treatment and a lack of cultural understanding; only 2 percent of psychiatrists, 2 percent of psychologists and 4 percent of social workers in the United States are African American.

• African Americans tend to rely on family, religious and social communities for emotional support rather than turning to health care professionals, even though this may at times be necessary.

The health care providers they seek may not be aware of this important aspect of person life.

• Mental illness is frequently stigmatized and misunderstood in the African American community. African Americans are much

ver the past seven decades the Queen City has given birth to many talented singers and musicians who have gone on to be the premiere voices in the world of music.

The Trendsetters! In the 50's & 60's singers such as Dodo Green (who was a part of Cab Calloway’s Broadway production of "Cotton Comes to Harlem" and was the first female artist signed to Blue Note Records); "FUNKY BROADWAY" creator Arlester "Dyke" Christian, leader of Dyke & The Blazers; and the 70's - 90's rocked with the "Legendary SuperFreak" Multi-Grammy Award Winner - Rick James and "Soulful Balladeer" Multi-Platinum Recording Artist - Brian McKnight to name a few.

With the dawn of a new century the "music industry" has changed through the years proving that "talent is secondary to looks." But some of the best Independent artists "veteran or rising" will not stand for being controlled by the machine and will continue to do shows and create their own opportunities to be heard as their message is one of "Handwork = TRIUMPH!" Next will be the KINGS of R&B! Trina Trina began singing at a very early age. Having come from a family with a strong religious background, she had to go church every Sunday and sing in the choir. “By age 10 I noticed when people would ask me to sing, they would always say ‘she can sing anything and sound like anybody.’ In 1998 I joined an all girl group called Straight Vocals. We began recording at a local record studio/ record label called HOOD RECORDS. While spending time there I worked with producers Kid Cole and JOE PUBLIC'S Kevin Scott. ..She also worked with local artists Tifani and Chauncey "Mr.R and B" Northington just to name a few.

Juanita Simmons Duncan Singing since the age of 9, Juanita grew up in the church singing in the choir. In the year of 1979 she joined her first female group under the leadership of Tyrone Johnson. Juanita was in several groups such as Rize, Frenz, Lance Diamond and the Family Jewels, Harold Travis and HQ, Unity Band with Special Blend, Taylor Made Jazz and Evolution. She also was very active in the theater, being in several plays at the Paul Roberson Theater. Juanita sang has performed in the Juneteenth, Pine Grill Reunion and the Rick James Funk Fest. “MuthaSoul” Nikki Hicks Nikki started singing at the age of 2 years old . As a child she was drawn to gospel music and the blues. Her first solo was the Aretha Franklin version of "Precious Lord" at the age of four for her Head Start graduation ceremony.

At the age of 23 she entered a talent show at former club Jasmine and won first place, and was sent to represent Buffalo at the famous Apollo Theater in Harlem, New York.

She won the talent show competition there three times in a row in 1993 and 1994. After that she joined various local bands Living Proof and Animal Planet and toured with both bands doing the USO tours to entertain our troops around the world. She sang in 32 different countries from 1996-2002.

Since 2011, the CHANGEMAKERS 30 Under 30 Awards has honored over 150 young professionals under the age of 30 who have made an incredible impact in the community and their respective fields of work. CHANGEMAKERS has become the premier networking and fundraising event, drawing some of the best and brightest young professionals in or from Western New York.

ust Buffalo Literary Center’s ambitious new program, THE CIVIL WRITES PROJECT, dares to confront the history of segregation through a series of over 12+ interconnected programs leading up to Nobel Prize winner Toni Morrison’s appearance at Just Buffalo Literary Center’s BABEL series on November 9, 2017—exactly 50 years to the day of Dr. Martin Luther King’s historic speech at Kleinhans Music Hall.

Artistic Director Barbara Cole frames the project through Dr. King’s legacy, confronting the present moment while honoring the past and looking to the future. Cole explains, “Buffalo is now in the midst of a rebirth and yet remains one of the most segregated cities in America.

Dr. King dared to imagine a future free of segregation. We must challenge ourselves with where we want to be 50 years from now. What do we want to achieve right now?”

On Thursday, October 19th at the Evergreen Commons (67 Prospect Ave.) at 7:30pm, Just Buffalo Literary Center’s STUDIO series presents New York Times Magazine poetry editor Terrance Hayes. His most recent collection, How to Be Drawn, received the 2016 NAACP Image Award for Poetry. His honors include a National Book Award for Poetry in 2010, Whiting Writers Award, a National Endowment for the Arts Fellowship, a Guggenheim Fellowship, and a MacArthur "genius" grant. Free and open to the public.

Joining Hayes will be Birch Kinsey, a youth writer from the Just Buffalo Writing Center and the Massachusetts Avenue Project; Kevin Thurston, who recently published Color Me White with illustrator Mickey Harmon; Scott W. Williams, author of Bonvibre Haiku; as well as Silo City Alumni Sherry Robbins and Annette Daniels Taylor.

Hayes has an impressive resume, having appeared in ten editions of The Best American Poetry as well as editing the 2014 anthology. He has read poems everywhere from Carnegie Hall to high schools and has taught at Carnegie Mellon University to prisons throughout the United States. He is a Distinguished Professor of English at the University of Pittsburgh.

A Message From Jennnifer Parker, Founding Organizer of "The Pitch"

hylicia Dove is the winner of the "Main Street" category of The Pitch, a part of Buffalo's 43North entrepreneur competition. The accompanying prize for her first place win was a hefty $15,000. On top of that, Mrs Dove was awarded an additional $10,000 for winning the vote as the audience's favorite presenter of the evening bringing her grand total winnings to $25,000!

As her name was announced, the assembly went wild while she slowly fell to her knees in a moment of both disbelief and gratitude. Her ever supportive husband, Averill Dove, was at her side expressing equal measurements of joy and bewilderment himself.

Phylicia just opened her SoHo inspired boutique, Black Monarchy, this past August on W. Utica at the west side's famous 5 Points intersection. Her store is an eclectic potpourri of jewelry, clothing, fabrics and mementos with an African and "World Beat" feel. Some are pieces she's created. Some hale from exotic locales like India, Argentina, Senegal and The Philipines, brought back by buyers on their visits. Her vision for the store is to become THE go-to place in town for culturally diverse fashion. Just as we now think light fixtures--Home Depot, Phylicia plans that you will think first of Black Monarchy when shopping for a look that is unique and striking.

The 5 Points retail store is only a part of her over all brand, IAmPhyNomenal, which will also encompass personal styling, online shopping and events. She has always had a fervor for design. But her initial schooling and career trajectory were sending her in a completely different direction.

Originally from Brooklyn, her undergraduate studies took her to Geneva, N.Y. She met her husband there, a Buffalo native, and eventually followed him back here where she finished her master's degree in Executive Leadership and Non-Profit Management. She began building a career in the non-profit sector but as the grants for each project dried up, Phylicia found herself sending out resumes again, by now with two small sons in the picture. She credits her husband with keeping his eye on her true calling. Over the years, Averill would find store fixtures, mannequins and other necessities on the cheap and store them in the garage for future use. "He held my dream for me until I could hold it myself" she says. In the meantime, Phylicia did vendor tables at various shows and events around Buffalo making a name for herself and garnering a bit of a following.

Finding herself again in that familiar place of having to dust off her résumé, she gave up, spent a year in depression and soul-searching, decided to just open the paper, find any job, and call it a day. Averill convinced her to look at just one more store front site. This particularly lovely space on W. Utica called to her. She recalls thinking the windows, even the sidewalk in front, appeared to be everything she'd asked for. She and her husband pooled the last of their resources, hauled the stored artifacts out of the garage, and determined to give it a go. Only by happenstance did she come to enter The Pitch, a friend sent her the application info. In fact, her entry was originally rejected. Phylicia found herself having to put together a presentation together in one day after getting word that a new spot had opened.

After four years of looking, her store was finally a reality. The $25,000 windfall from the September 28th presentation is the icing on the cake. Phylicia now has the ability to make money moves that start her from a new tier all together like investing in trademarks, patents, and search engine optimization. (Not to mention mannequins that actually have heads...) And, of course, more inventory. She is happy too that she can now pay it forward in real cash to those who have helped her before, an integral component of her business and over all life philosophy. That means more money to the Ghanaian refugee seamstress who makes her clothes, and perhaps even hiring one more, improving their lot along with her own. And being able to double her t-shirt order with the artist that stenciled her windows. "I believe when I get up, we all should get up. It's all about redistributing."

In keeping with that theme, look for what she calls "Monarchy Market" in the future. Phylicia plans to make a portion of the space in her store regularly available to other local vendors whose product lines are in keeping with her boutique's global artisan fashion offerings.

The biggest take away from winning The Pitch for Phylicia has been not just the money, but the affirmation. "It's believing in your dream and realizing the city believes in it too. They buy into your vision."

The Pitch, a collaborative initiative that includes the City of Buffalo (Mayor Byron W. Brown, 43North, Erie County Industrial Development Agency (ECIDA) and New York Business Development Corporation (NYBDC), was created to encourage an entrepreneurial spirit among Buffalo area minority and women business owners. Seeing the excitement and entrepreneurial spirit among local small business owners was a dream come full circle. As the founder of the Black Capital Network I have always been a champion for minority and women small business enterprises. I have always believed that Buffalo was a Mecca for innovation and that there were opportunities for minority businesses to grow.

I feel blessed to see this vision come true. The Pitch is an opportunity for local small business owners to thrive and young entrepreneurs to visualize business success.

As the inclusion consultant for 43North I saw that this popular entrepreneurial competition was leaving many local small businesses behind. The competition did what it was created to do - it sparked a culture of entrepreneurship and branded Buffalo nationally as an innovative tech startup city. However, the problem was that not all entrepreneurs were tech or life science startups. Therefore, I felt there was a need to encourage local minority business growth and cultivate new business owners.

On September 28 it was all about entrepreneurship and celebrating diversity - creating a stronger Buffalo one region and one business at a time," said Jennifer J. Parker, 43North Inclusion Consultant, owner of Jackson Parker Communications, and founding organizer of THE PITCH.

Scenes from The Pitch: The Growth Companies category grand prize winner was ZANDRA Beauty and the Main Street Category Grand Prize Winner was Black Monarchy. Each was awarded $15,000 with Black Monarchy winning an additional/$10,000 bonus in a category called the People’s Choice Award, where attending audience members were able to vote on the spot. The runner ups in both categories were Coolture, PneumaGlide, P.C., Empire Transportation and Buffalo Healthy Living each winning $5,000 each. When the King came to Buffalo: The 1967 Address by Dr. Martin Luther King, Jr.

On Wednesday, October 18th, 5:30 pm at the Buffalo Academy for Visual and Performing Arts, the Michigan Street African American Heritage Corridor is hosting a commentary and reflection by Dr. Steve Peraza and George K. Arthur. on the historic visit made by Dr. King to the City of Buffalo on November 9, 1967.

Dr. Steve Peraza, Assistant Professor, history and Social Studies Education, SUNY Buffalo State and legend, George K Arthur will discuss King’s Kleinhans Music Hall speech and the impact his visit had on local leaders. Tragically, the speech King delivered on November 9th was five months before his assassination and four months after protests erupted on the city’s eastside. This program will shed light on Dr. King developing resistance to the War on Vietnam, his dwindling support from African American clergy and his being labeled an extremist and Communist by many on the political right and left.

Dr. King was invited to Buffalo by the UB Graduate Student Association (GSA). His speech was entitled “The Future of Integration” and was presented to a mostly white audience of 2100. Given the soon to be released prognosis by the Turner Report, King’s topic was eerily significant. Known as the “Long Hot Summer” of 1967, there were 159 protests across America. The ”riots” led President Johnson to establish the Kerner Commission which was charged with investigating the causes of the protests. The report’s most famous passage warned, “Our nation is moving toward two societies, one black, one white-separate and unequal.”

Martin Luther King, Jr. pronounced the report a “physician’s warning of approaching death, with a prescription for life.” One month after the release of the Kerner Report, King was assassinated.

Unfortunately, there were approximately 700 empty seats at Kleinhans on November 9th according to the archival records kept by the University of Buffalo. Local political and religious leaders who may have benefitted from hearing Dr. King’s speech were probably not in attendance. (only three politicians were present and only a handful of Black clergy). The UB Archives include a number of photos taken at Kleinhans that evening along with an audio cassette of King’s talk, the formal invitation to King from the GSA, and press clippings from the Buffalo News, the Challenger and other press sources.

Dr. Peraza will present excerpts of the audio from Dr. King’s speech. Everyone is invited to attend.

President Trump’s Executive Orders The Death of Obamacare?

Will We Ever See Truth and Justice On the Question of the Deaths of India Cummings and Richard Metcalf?

n March 23, 2010, the 44th President of the United States, the Honorable Barack Hussein Obama signed the Patient Protection and Affordable Care Act into law.

The title was later shortened to “ACA”. The ACA was nicknamed Obamacare by Republicans who voted against it. They put a bullseye on the back of Obamacare and vowed to repeal it citing its cost to taxpayers as their reason for opposing it. Some believe the real reason was because it was the signature legislation of the first African American President who delivered on a campaign promise to bring parity to healthcare in America.

Republicans nicknamed the Affordable Care Act (ACA) Obamacare so they would in no way be associated with its passage.

This brought confusion to some Americans who didn’t realize that the Affordable Care Act and Obamacare are actually the same thing.

One of the most important aspects of Obamacare is Expanded Medicaid. This part of the law required states to give Medicaid to ALL ADULTS between the ages of 18 to 65 whose annual income falls 138% below the federal poverty level ($26,347 for a family of three OR $15,417 for a single person) regardless of their age, family status, or health. States are allowed to choose whether they want to participate in the Expanded Medicaid program or not. New York chose to participate. California did not.

Expanded Medicaid is what pays for insurance subsidies.

Over the last 7 years Republicans in Congress have tried to repeal Obamacare. Their efforts were unsuccessful until Donald J. Trump became the 45th President of the United States. On Friday, October 13, 2017, President Trump signed an Executive Order that seeks to reduce the cost of health insurance to some taxpayers at the same time it pushes access to health insurance out of reach to others.

President Trump’s Executive Order impact Obamacare in many ways, however these are 2 important changes:

1.Health Insurance subsidies are eliminated: Subsidies pay the difference between what a person can afford to pay for health insurance and what the insurance company is charging. Without that subsidy, Jason, like about 52 million other people with preexisting conditions in the United States, would be uninsurable because access to quality healthcare would be priced beyond his ability to pay. The government pays about 7 billion of our tax dollars annually to insurance companies in the form of subsidies for those who otherwise would not be able to afford health insurance.

Erie County DA Flynn passed the Metcalf case on to DA Rieman because two of his assistant DA's had relationships with corrections officers involved in the case. But Flynn's office has other assistant DA's who could have taken the case.

2.The Executive Order expanded the use of Association Health Plans and Short-term Health Insurance Plans. While these plans are cheaper, they are very complex and exempt from the mandated 10 essential health benefits required in EVERY plan under Obamacare (ambulatory care and outpatient services, emergency service hospitalization, maternity and newborn care, mental health, substance abuse and behavioral health, prescription drug coverage, rehabilitative services and devices, lab services, preventive, wellness and chronic disease management and pediatric services including oral and vision care). These bare bones plans give minimal coverage, leave those with pre-existing conditions vulnerable, and lastly, allow insurance companies to hike your rates or cancel you if you get sick.

At this time, it is not known how President Trump’s Executive Order will affect the upcoming annual open enrollment, as well as the mandate for every American to keep insurance in force or be fined. This shell game could ultimately result in rich people pocketing the extra dollars from a tax cut while the middle class and working poor are stuck using theirs to pay for health care co-pays and premiums that will no doubt skyrocket without regulation and the subsidies. Months ago, I thought that Erie County DA John Flynn should never have given the Richard Metcalf case to a rural DA; in particular to no one in Cattaraugus, Allegeny, or Wyoming Counties. Sentiment against the SAFE Act, which Sheriff Howard refuses to enforce, runs very high in those counties. Far better to have given the case to a county with a strong urban core, much like Erie County, in which Mr. Metcalf died. Rochester’s Monroe County and Syracuse’s Onondaga County come to mind. Or perhaps a special prosecutor should have been empaneled by Albany to handle the case.

Now, Cattaraugus County DA Lori Rieman has refused to even call Dr. Baden, the state review board recommended and nationally renowned forensic pathologist, because she "lacks confidence" in him (whatever that means).

The Buffalo News tells us today that now, the Cattaraugus County DA may be less likely to lodge charges against any of Sheriff Howard's deputies involved in the Metcalf case, contrary to the State Commission of Corrections recommendations for a criminal prosecution.

As of November 29, the statute of limitations expires on two of the charges; manslaughter and criminally negligent homicide. Personally, I think that the more important date is Election Day, November 7. And in this regard, Cattaraugus County DA Rieman may be giving Sheriff Howard cover so that the Metcalf case doesn't blow up in his face before Election Day.

So it looks to me as if Flynn wiggled out of having to prosecute anyone in the Sheriff's department for Richard Metcalf jr’s death. In so doing, it may be said that he maintained that ‘special relationship’ so historically notorious among DA's and law enforcement.

And, by DA Flynn's giving the case to DA Rieman, it looks like Sheriff Howard and those Erie County corrections officers involved in the Richard Metcalf case will all be in the clear... at least until November 8.

Given the foregoing, I wonder if we will ever see truth and justice on the question of India Cumming's death in the Erie County Holding Center two years ago.

This Advertisement for Bids is for multiple Job Order Contracts (hereinafter called JOC). A Job Order Contract is an indefinite quantity contract pursuant to which the Contractor will perform a series of individual repair, alteration, modernization, maintenance, rehabilitation, demolition and construction projects at different locations. Work is accomplished by means of issuance of a Job Order against a master contract. Under the JOC concept, the Contractor furnishes all management, documentation, labor, materials and equipment needed to perform the Work. The State has published Construction Task Catalogs containing a series of work items with pre-established Unit Prices.
