A

venue Black Box Theatre in Rochester has been gifted a Steinway & Sons Piano signed by Alicia Keys via The Grammy’s MusiCares program. "We're grateful and honored this piano will now have a home in a space that believes deeply in the power of music and performing arts to change lives. We know its legacy will live in the hearts of generations to come," said Avenue Blackbox Founder and Artistic Director Reenah Golden. A Mini Music Marathon featuring Danielle Ponder, Chaz Bruce, Avis Reese, Ari Highsmith, Taryn Highsmith, She Rise and Drea D’Nur officially celebrated the arrival of the Steinway piano. Prominent local artists played the piano during the Mini Music Marathon event last Friday at the theatre located at 780 Joseph Avenue. -BackgroundSteinway & Sons recently held a special auction to support the MusiCares® COVID-19 Relief. On August 15, a generous bidder won the online auction of a beautiful Steinway-designed Boston 126E upright piano—finished in brilliant turquoise and signed by 15-time GRAMMY® Award-winning singer and songwriter Alicia Keys. The final sale generated $35,000 for the MusiCares COVID-19 Relief, which seeks to alleviate the enormous financial burden placed on people in the music industry who are adversely impacted by the global pandemic. "Having performed professional style concerts as a singer at nursing homes for over 25 years, I am aware of the power of music to change lives", said auction winner Andy Nahas. "I bid on this piano on behalf of MusicPower, a charity I established to support exceptional music related initiatives such as MusiCares. I'm further excited because we've chosen to donate the piano to another impressive initiative called the Avenue Blackbox Theatre in Rochester, New York, which will launch an expanded music learning program for inner city youth and adults upon receipt of Alicia's beautiful Steinway piano. We expect this autographed piano will inspire and motivate many people to make music creation an important part of their lives. I give a big thank you to Steinway, Alicia Keys, and MusiCares for offering this multiple win opportunity!" The piano, which was donated by Steinway and used by Alicia Keys in her home for three months, was featured in Keys’ social media and was used for a special Amazon livestream event and in a promotion for the 2020 New York Census. Keys’ signature elevates the piano to a one-of-a-kind collector’s item, and its success as an auction item is a testament to both the artist’s reputation and to the goodwill of MusiCares supporters seeking to help music professionals during this very difficult time. “I feel so blessed that this piano—which has so many personal memories for me—is going to be auctioned for MusiCares, which has helped so many artists and creators and the music community during the pandemic,” said Alicia Keys. “I can’t wait for whoever gets this piano to feel the magic inside of it, and for us to continue to support and love each other.” “This auction was even more successful than we initially anticipated,” said Ron Losby, President and CEO of Steinway & Sons. “We have Alicia Keys and her stunning musical spirit to thank. Not only did the winner gift $35,000 to MusiCares, he also has committed to place the piano at the inner-city venue in Rochester, New York. Alicia’s piano will inspire and motivate many people for years to come.”

Rochester Mayor Lovely Warren is accused of using a political action committee to get around donations limits in her 2017 reelection campaign. On Monday she pleaded not guilty to felony charges of alleged campaign finance fraud. The mayor was released under her own recognizance. Mayor Warren The court appearance comes three days after the second-term mayor and two political associates were indicted. Albert Jones Jr., Warren's campaign treasurer, and Rosalind Brooks-Harris, who was the treasurer of a political action committee for Warren and now serves as Rochester's finance director, also entered not guilty pleas. As with Warren, prosecutors made no bail request for them. All three are scheduled to have their next court appearance Jan. 12. Sandra Doorley, the Monroe County District Attorney, said that she did not believe he indictment “affects her ability to serve as the mayor…" "Lovely Warren is still the mayor of the city of Rochester. Mayoral business needs to continue. The mayor/s attorney, Joseph Damelio told WXXI that she is innocent of the charges. "Her position has not changed one bit and that is she's innocent and that she maintains that she did not intend to violate the law," said Damelio. "She did not knowingly violate the law and she's anxious to get this process started and she's ready to go to trial." -Statement from Council President Loretta C. Scott: "Today, a grand jury indicted Mayor Warren and City Finance Director Brooks-Harris, and while I have not had the opportunity to review the indictment in detail, I am obviously saddened by this news. I believe in due process and that everyone is innocent until proven otherwise. I want to assure the community that the business of the City will continue uninterrupted."

Group Voice Opposition to Police Proposed Use of the BolaWrap: “Non-lethal is Not Non-Harmful” The Allies for Black Justice, along with mental health professionals, other community organizations, and activists, held a press conference to speak out against the proposed BolaWrap to be used as a nonlethal way for police officers to restrain people suffering a mental health crisis. The group maintains that “non-lethal is not non-harmful” and “the criminalization of people with mental illness is part of a larger policing problem we have here in Buffalo.” Investing more money in additional weapons, they continued, is a step in the wrong direction. “The mental health community would like to make it clear that investing in new weapons is not the solution. The BolaWrap is not trauma informed and not at all a mental health intervention. As we have previously called for, we need mental health professionals responding to mental health crises, not armed police officers, regardless of what they are armed with,” stated Amy Cross-Viola, LCSW-R founder of WNY Agents of Change.

VOICES

"Street "Votes Matter! W

hen you on the battlefield you need to know who you are. More importantly, you need to know who you are not. Let us start with who I am not. I am not the Bishop, not a pastor, not a politician, not a celebrity. Just a sinner trying to be saved by grace. A lot of time we look to the pastors, politicians, celebrities to carry the load. I think that is a mistake because that makes us complacent. It also made us voiceless. I said a few weeks ago that I did not like what is going on in our country. Deceit, hatred, and diJesse vision. I also Doyle said give me some time. I was gone load up and clap back. That phrase simply means “what the retaliation would be to a White House trying to gangsta this election.” I thought to myself. The people that vote always vote. They will vote regardless of their circumstances. To me that is like preaching to the choir. So, then I said, how do we wake up what sometimes seems like a sleeping society? The underground, the players, the hustlers, the uneducated, and the young single parents that feel like they are drowning in everyone else’s decisions.

"Hood Billboard” located on Kensington and Castle near Burgard High School includes Raymond Kincannon, Mike Jemison, Jesse Doyle, Ben Cook, Mike Ray Jackson (Groove Lounge), and Zack Williford.

God walked me through the violent streets of the 90’s untouched. So many people close to me along the way ended up in jail, hail, drugs, or thugs. I learned so much in the hood. I can hold a conversation with anyone from the bottom of the ghetto to the top of the White House and would not miss a beat. The biggest lesson is if you love and respect the streets, the streets will love and respect you back. Not long ago I woke up in the middle of the night. All I could think about were folks we refuse to include. The same folks we look down upon. In some cases, some of us have become so high class we refuse to even say hello to folk. But the truth is, there is untapped power in the streets. It was clear to me. The difference in this election will be the street

vote. Who better to get the message to the streets than folks that rose from the ashes of the late 80s and 90s? So many times, we see our Black men portrayed on the evening news in handcuffs or in the midst of yellow tape. Just to be clear. EDP is not a gang. EDP is a lifetime fraternity built with men and women over the years. Folks that came before me, during me, and after me. I felt like the MEN of EDP needed to take the lead role in this push for the street vote. This election is so important. We put our money where our heart is. We spent our own money and rented the first “hood billboard” in the city for 30 days. The billboard is located on Kensington and Castle near Burgard High School. Medger Evers, Civil Rights Activist

Medgar Evers was an African-American civil rights activist whose murder drew national attention. Born in Mississippi, in 1925, he served in World War II before going to work for the National Association for the Advancement of Colored People (NAACP). After attempting to desegregate the University of Mississippi Law School in 1954, he became the NAACP field secretary in Mississippi. Evers was subjected to threats as the most visible civil rights leader in the state, and he was shot to death in June 1963. As state field secretary, Evers recruited members throughout Mississippi and organized voter-registration efforts, demonstrations, and economic boycotts of Whiteowned companies that practiced discrimination. He also worked to investigate crimes perpetrated against Blacks, most notably the lynching of Emmett Till, a 14-year-old African-American boy who had been killed for allegedly talking to a White woman. As early as 1955, Evers activism made him the most visible civil rights leader in the state of Mississippi. As a result, he and his family were subjected to numerous threats and violent actions over the years, including a firebombing of their house Continued Page 5

Know Thyself

Legislature Chairwoman Baskin Announces New Program for Vacant & Abandoned Properties Erie County Legislature Chairwoman April N.M. Baskin announced the roll out of the Erie County Legislature Vacant & Abandoned Properties (VAP) Community Resource Team on the steps of Old County Hall last Tuesday morning. This program was made possible by a $200,000 allocation Baskin secured in the 2020 Erie County budget to address properties that are not bank-owned but may need remediation or rehabilitation. After a 2019 meeting with the local Board of Block Clubs, Baskin approached the Western NY Law Center with an idea focused on community resource collaboration that would address the high number of vacant properties across Erie County. Unlike “zombie properties”, many of these houses in the City of Buffalo are privately owned without bank involvement. Often times, families inherit properties from deceased relatives or landlords may abandon them after damage caused by tenants. The continued decay and lack of upkeep causes many of these homes to fall into disrepair, while inviting crime and pests into residential neighborhoods. Tax delinquency is another common cause of owner abandonment, especially during times of economic distress like the COVID-19 pandemic. With the help of the WNY Law Center, a dedicated team of legal professionals and a community liaison will now be able to service these homes, the residents, and the neighborhoods where they exist by addressing the legal and community issues that may prevent the owners from either occupying or selling. “This idea came directly from community leaders, and I am always proud when we are able to deliver for the people, especially when it comes to safe and fair housing issues. These services, offered free of charge, will transform blocks in the City of Buffalo and neighborhoods across Erie County in very positive ways,” Chair April Baskin stated. “I’m grateful my colleagues unanimously supported this idea in the 2020 budget, and I truly appreciate the work of Kate Lockhart and her entire team.”

“Knowing when to stop, you can avoid any danger.” -Tao Te Ching

“ No More of This!” March to End Black Homicides will take place this Saturday, October 10 at 3 p.m. Marchers will meet at the corner of Best and Jefferson and proceed down Jefferson Avenue to East Utica. The community is urged to participate!

B

ehind the morning headlines, family, friends and relatives were left grieving; three little children left motherless; a young life gone too soon; and a community asking itself once again, “why?” Rayshonna Johnson was just 23 years old when she became the single fatality in the latest street party violence to rock the city. It happened September 19 on Jefferson Avenue at Glenwood. Five people were shot. "Ray Ray” as she was affectionally known, was among them but the only one who did not live. Last Monday, Bishop Frederick A. Gelsey of One In Christ Church on Broadway, preached her funeral to a packed house of worship to mostly young adults. Taking the opportunity to address a captive audience, Bishop Gelsey’s theme was “No More of This!” from the book of Matthew. He explained that those were the very words Jesus spoke when he disarmed Peter after he cut off a man’s ear. “The Lord told me to tell you ‘no more of this…no more killing one another! ” He talked about the root of a murderous spirit from a biblical perspective, explaining that what goes into one’s mind and spirit, ultimately comes out. He gave expamples of the lyrics in some of today’s music, glorifying killing, drugs and murder. The drugs and alcohol, he said, are killer concoctions to create a murderdous mindset. He prayed and he taught and he put the dilemma we are facing in perspective. Using a parable about Judus, he made clear the role of betrayal. "We always think its rival gangs killing one another but sometimes its friends killing friends…somebody you know." His own son, Frederick Jr.

he said, was murdered by his friend in 2012. “When my son got murdered I was devastated….. but the only way to stop it is if the PEOPLE say something.” Bishop Gelsey also educates and helps families suffering the pain of murder thru his Homicide Education and Prevention Project, something that’s much needed. The Buffalo News October 2 front page cited a shooting surge in the city with 8 of 10 victims being Black. By the end of August, the article cited 217 people had either been injured or killed in a shooting in the city - 82% higher than last year. “No more of this”! Bishop repeated throughout the service, referring to “this murderous spirit” coming from the hood. “When are we going to stop?” Looking within, he acknowledged that the church should be doing more to ad-

dress the issue. “The church is asleep…. and it’s time for the church to wake up. Everybody is marching for everything, who’s marching for Ray Ray…who’s going to say ‘no More of this?” Rallies and marches organized by groups are good, he acknowledged. “I’ve marched with Black Lives Matter,” he told the Challenger. “And I respect the movement, but I want to march to end Black homicides. When are we gonna march for one another ?" By the end of the funeral, he had called for a small march to take place the next day. A week later he was announcing a “ No More of This" march to end Black homicides. It will take place this Saturday, October 10 at 3 p.m. Marchers will meet at the corner of Best and Jefferson and march down Jefferson Avenue to East Utica. The community is urged to participate.

CARIOL SUES THE CITY lawsuit seeks to restore her job and pension

A

ttorneys for Cariol Horne filed a lawsuit last Thursday in State Supreme Court against the City of Buffalo and the city's police department. Her new lawsuit aims to restore her position as a police officer, with full payment of lost wages and benefits. Former Buffalo Police Commissioner H. McCarthy Gipson and then-Deputy Police Commissioner Byron Lockwood are named in Thursday's lawsuit filing Her attorneys, from Kirkland & Ellis partner Neil Eggleston and Harvard Law School Professor and Director of the Criminal Justice Institute at Harvard Law School released the following statement: “Today, we filed a motion on behalf Cariol Horne, asking a New York Supreme Court judge, in the interests of justice, to vacate a 2010 judgment that upheld an administrative decision to fire Cariol from the Buffalo Police Department for intervening during a chokehold delivered by a fellow officer against an unarmed Black man. Rather than being praised for potentially saving a life, Cariol was fired in May 2008, only months shy of her police pension vesting. “We are committed to achieving justice for Cariol

Cariol Horne

and have asked the court to reinstate her retroactively as a member of the Buffalo Police Department through 2010 so that she can access the pension and benefits she has been wrongfully denied. “We are confident that the court will correct this injustice that occurred 14 years ago because Cariol intervened to protect an unarmed civilian. “Today, police departments across the country recognize that officers need to intervene when they see another police officer put a life at risk. Indeed, the Buffalo Common Council passed Cariol’s Law on Tuesday, making it mandatory for police officers to intervene and stop acts of brutality by fellow officers, and providing protection against retaliation for those officers who fulfill “We await the court’s ruling, and look forward to the day when Cariol is vindicated and celebrated for the prudent decision to deescalate a potentially dangerous situation.”

“I still stand for India, and I Coalition of Concerned Citizens won’t stop speaking her name.” Seek Justice: Demand Officers in Legislature Chair Baskin Responds to NYS AG Decision Morgan Eaton Case be Fired The following statement from Erie County Legislature Chair April N. M. Baskin was released in the wake of the New York State Attorney General’s Office decision to not file criminal charges in the death of India Cummings. “In July 2018, I joined with leaders and activists to call on the New York State Attorney General’s Office to conduct an investigation into the death of India Cummings. Our community is deeply committed to achieving justice for India. I am profoundly disappointed and disturbed by the announcement that no deputies or persons involved in the death of India Cummings will be prosecuted. To Ms. Cummings’ family, I once again offer my condolences that your grief has been intensified by the results of the investigation. I obviously wanted a different conclusion in this matter. I had only been in elected office a few weeks when The New York State Commission of Correction reported and ruled that her death in February 2016 was a homicide due to negligence. The Commission stated that ‘the medical and mental health care provided to Cummings by Erie County during the course of incarceration, and her care, custody and safekeeping by Erie County sheriff deputies was so grossly incompetent and inadequate as so to shock the conscience.’ I was and remain disgusted such negligence occurred in our County Jail. When former Attorney General Underwood announced the investigation in September 2018, I was overcome with hope that India might receive justice. Today, I am overcome with grief learning that there will be no charges and that grand jury secrecy rules don’t allow for transparency as to why. I am planning legislation to ensure consequences in cases where the negligence of sheriff’s deputies or guards leads to the death of a detainee. There have been several notable instances where deputies have run amok under Timothy Howard’s leadership. Systemic inequality persists across our justice system. Without drastic changes to the laws that govern our law enforcement officers and our judicial system, we will continue to see injustice served. The entire system needs to be deleted and rewritten in order for true justice to prevail. I still stand for India, and while presiding over the County Legislature Chambers, I won’t stop speaking her name.” (Ed Note. The attorney for India’s family at the time of her death wrote: “…In the throes of mental illness, clearly incapacitated and incapable of taking care of herself, (India, pictured above) was put in custody at the Erie County Holding Center on February 1st, 2016 after a series of irrational actions. She had originally called the police for help. “Despite frantic efforts by family members and others to have her transferred to a hospital where she can be stabilized, she was stashed away mysteriously in the Holding Center for a two and a half week period. On February 17, 2016, Erie County Sheriff Timothy Howard states a “medical event happened,” and India was transported to Buffalo General Hospital.. “Upon her admission, she had a broken arm, broken ribs, severe dehydration, a blood clot in her leg that would have required the amputation of her leg, and her kidneys were failing. She was brain dead and in cardiac arrest. Sheriff Howard fails to mention what conceivable medical event occurred that could have caused all those conditions simultaneously.“On February 21, 2016, Ms. Cummings remaining organs crashed, and she died. Howard went on record today to say everything was all good, and he was more than satisfied with the care that India received."

On October 7 an emergency press conference was called at 25 Delaware demanding that Erie County District Attorney John Flynn charge the officers involved in the March 2020 Morgan Eaton case - Officers Andrew Moffet & John Davidson. Also that he releases Cortez Foster. DA Flynn has never prosecuted an officer that’s committed a crime against a Minority. The officers are caught on camera committing perjury and tampering with evidence. This occurred seven months ago. The Buffalo Police had the footage and the negative lab results since April but the district attorneys office continued to pressure Eaton into taking a plea, although they were aware what was on the video. It took the reform from the Coalition of Concerned Citizens to demand the footage be released, which it was the last week of June when they did. Almost four months after the arrest. Once the video was released all charges were dismissed for the vaginal suppositories he was charged for, claiming by the officers to be cocaine. These officers have been suspended for 30 days without pay. We the community are asking these officers be fired and charged accordingly for arresting Mr. Eaton and charging him with a felony. This case shines a bigger picture on how hungry some of these officers are for overtime. They are willing to ruin a man’s life with felony drug trafficking charges. Prior to this Morgan Eaton only had minor traffic infractions on his record. If asked by an employer Mr. Eaton will always have to disclose the felony arrest even though the charges were dismissed. Not to mention him loosing a paid basketball coaching position or the fact he was on mobile patrol & labeled a drug dealer. Mr. Eaton has been coaching the youth in Buffalo for 15 years and had a non profit he started seven years ago called Sports Unlimited Inc. of Buffalo, which is funded through his own money and his own fund raising efforts. The fact that a community member can once again be violated by these bad officers and they still have not charged these men seven months later is outrageous! Tampering with evidence and perjury are both felony charges that both officers should be charged with. As can be seen from the 9min video footage, Officer Andrew Moffet puts the negative test of the vaginal pills in his pocket & never submits it into evidence or with the report. John Davidson Swears on his report under perjury the pills were cocaine. LT. Mark Ambellan co-signed everything. They tried to ruin Mr. Eaton’s life over made up charges and overtime which John Davidson has a history of. Currently Cortez Foster has been sitting in jail since January awaiting grand jury because of the false charges from Officer John Davidson, the same officer. It has been pushed back due to the investigation of officer Davidson. Three Black men have three claims of three different stories to internal affairs cases against Davidson for perjury (all outlined in the Buffalo News article written by Matt Spina.) Cortez Foster’s entire case depends on the testimony of a perjurer! This man should be set free. They have pushed back the grand jury from last week until this week while they look into claims regarding Davidson’s perjury! The fact he has been suspended gives them the answers they were waiting for. Mr. Foster has had to sit in jail under covid conditions. This case needs to be dismissed in it’s entirety as everything they are relying on is dependent upon Davidson who has proven to lie and produce drugs on reports that are not actually there. In July 2019 Mr. Foster saved Mayor Byron Browns son from a car that flipped over & almost caught on fire but his letters and pleas to the mayor over the past 9 months have not been returned. Wednesday the Community showed up to demand that John Flynn charges these officers.

11 VOICES Mayor Brown, Sign Cariol's Law The New Faces Of Racism: Why Reconceptualizing Bias Is Essential To Our Lives Challenger Community News • t hec hallengernews.com •October 7, 2020

As Soon as Possible!

I

n 2006, Cariol Holliman Horne, a Black female police officer, intervened in an arrest that had gone seriously wrong. The suspect, Neal Mack Sr., was being held in a chokehold by an officer named Greg Kwiatowski, and was struggling to breathe. Mr. Mack had yelled out several times, "I can't breathe"! Officer Horne intervened by trying to pry Officer Kwiatowski's arm and hand from around Mr. Mack's neck. One has to only look at George Floyd's murder in Minneapolis (MN), to see what could happen when good officers do nothing to stop a situation that could result in serious bodily harm or murder. Unfortunately, two years later in 2008, Cariol Horne was fired by Buffalo Police Commissioner G. McCarthy Gipson for her brave intervention. Not only that, she lost the rights to her police pension that she was short of by only a few months to fulfil the requirements for full retirement from the police department. Last Tuesday, Sept. 29th, the Buffalo Common Council approved a Resolution, 8-1, to name a "Duty to Intervene" Buffalo Police Department policy " Cariol's Law." This resolution, sponsored and supported by Council President Darius G. Pridgen, was approved and is now laying on the Mayor's desk for his signature. Mayor Byron W. Brown is charged with signing the resolution into law, objecting to it with a veto or simply not doing a thing. If the mayor does not sign it or veto it, it lays on his desk until a period of time has elapsed and then it becomes law by default. However, due to an edit by Gov. Cuomo, the timeline has been suspended due to Covid 19. That means that the law can remain on Mayor Brown's desk until this Coronavirus crisis ends. This writer encourages Mayor Brown to sign Cariol's Law as soon as possible. Ms. Horne, her family and the community, overall, has waited and prayed long enough for her to receive vindication, justice, and for the City of Buffalo to right a terrible wrong.

wastikas, white hoods, burning crosses, lynchings and racial epithets. In contemporary America, these overt acts and symbols of racism are generally deemed unacceptable. However, systemic racism (systems and institutions that subtly, or not so subtly, disadvantage people of color) persists. Why? Despite recent shifts toward understanding that racism is systemic, many still fail to identify the covert ways racism is embedded in our society. I am the assistant dean for diversity, equity and inclusion at the School of Law. From my lens, one of the biggest tasks of anti-racism work is getting people to reconceptualize what racism looks like. It is making sure that our students, faculty and staff understand that racism is not always packaged in racial slurs or overtly racist acts. The inability to identify and call out covertly racist systems has brought our country to where we now stand: There are two harmful groups in America. One places a presumption of criminality on people of color, particularly Black people. The other accepts blissful ignorance of the reasons why social and economic disparities exist between people of color and their white counterparts. Both represent a large part of America’s population, and they are why we as a nation can’t identify and call out racist systems. I thought about this last month while doing something as mundane as purchasing liquor at my local liquor store. I opted to purchase Hennessy, a cognac that gained popularity among Black Americans because it was one of the first mainstream liquor brands to advertise in Black media. What struck me, as I purchased my alcohol of choice, was that I was not allowed to simply collect the Hennessy from the shelf. Instead, I was required to have a store clerk retrieve the bottle for me. When I asked the clerk why, she offered that this was protocol for their more expensive liquors. The problem was that I saw other liquors that were much more expensive than Hennessy available on the shelves. The only conclusion I could draw was that this store presumed that the kind of person who would purchase Hennessy, a drink well known to be popular among Black Americans, might steal it. Unfortunately, this presumption of criminality has caused me to find myself in several situations where I have feared for my safety and for those around me. One incident took place in 2016, shortly after I was sworn in as an attorney. As a newly minted lawyer I, of course, felt as though I had a clear understanding of the rights granted to me under the Constitution. That view was shattered one evening when I was hanging out with some friends in a Buffalo apartment. During the evening, my friend’s neighbors called the police on us because they felt that we were too loud. When the police arrived, they asked that everyone show their IDs. When my friend questioned why this was necessary, one of the responding officers placed my friendunder arrest. In response, I calmly told the officer I was that person’s attorney and asked why my friend was being arrested. He pulled his gun from his holster and pointed it at me after I challenged him.

“Because I want to and I will arrest you, too, little Miss Attorney,” he retorted. In that moment, I knew my priority was ensuring the safety of myself and my friend rather than defending our right to be free of unreasonable searches and seizures. I made this intellectual and emotional calculation while confronted with the officer’s gun. Even while practicing law, the very thing I had just been given permission to do, my behavior was deemed to be criminal. This is the same presumption of crimiTolulope Odunsi nality that was given to George Floyd, Breonna Taylor, Amadou Diallo and countless others who died at the hands of law enforcement officers. This same association between Blackness and criminality impacts Black people in all aspects of criminal justice — from higher rates of childhood suspension, expulsion and arrest at school to higher rates of probation and parole revocation. The public’s inability to address covert racism such as bias, micro-aggressions, and coded racist language and policies (such as my local liquor store) is why an officer felt emboldened to kneel on George Floyd’s neck for 8:46, responding to an accusation that Floyd had proffered a counterfeit $20 bill. It is why studies tell us that Black women with natural hairstyles are less likely to be called back for job interviews and that Black newborn babies are three times more likely to die when looked after by white doctors. If racism has no place at the University at Buffalo School of Law or in our society, the question becomes, how do we disrupt racism where it may exist? For me, building an anti-racist culture requires first looking inward and critically examining our own individual impact on people of color. Do we believe them when they share their experiences of racism, or do we deflect and deny that race is an issue? Do we acknowledge the trauma they may feel due to the unprecedented level of national attention on the racial injustice in the U.S., or do we just go on with our day as if nothing is happening? At a systemic level, this work includes swift action to examine and dismantle policies and practices that have a disparately negative impact on people of color. Attorneys and law students are positioned to leverage their legal analysis, research, writing and advocacy skills to do just this. As the late Charles Hamilton Houston once told his Howard University law students, “a lawyer is either a social engineer or a parasite on society.” As lawyers, even though we might not directly contribute to systemic racism, our silence and failure to act allows it to thrive. Finally, we must understand that the power in being able to identify covert racism is the power to disrupt it.

12 SPORTS/BILLS REPORT

Bills Defeat Raiders in The Desert 30 – 23 The Buffalo Bills continue to impress with solid play and very few penalties so far into the season. Bills QB Josh Allen has been very impressive with his accuracy and allowing his players to go up and fight for the ball. Bills slot receiver Cole Beasley was turned into Helicopter wings as he had to go up and come down with a TD pass. Yes, Josh Allen has showed some serious improvement over last season with a shorter throwing motion and his footwork in the pocket has vastly improved. He actually thew the ball away when no one was open like a veteran QB. Allen is maturing and is following good coaching advice as well as not allowing the moment to get bigger than him. Allen must continue to grow his football IQ in order for this team to not only make the playoffs but be able to win some games in January 2021. The Bills defense improved against a mistake prone Raider offense that seemed to turn the ball over in critical situations. Bills cornerback Josh Norman had extended play time due to Levi Wallace’s ankle injury.Norman caused a forced fumble and recovered the ball. This turned out to be a key play in the win. Josh said his Marital Arts training in Jitsu is a mindset, assuring, “ I’m going to get it either in the air or on the ground I’m going to get the ball.” Josh added, “The Raiders were playing off what we gave them, and smartly made plays and we finally started to get three and outs.” I believe that Josh’s cat like instincts can partly be attributed to his off-season Marital Arts workouts. He has traveled to Thailand to learn more and train in the martial Arts. The Bills defense gave up 383 yards along with 24 first downs. This is a serious problem as the Bills will be playing very potent offenses in the coming weeks. The Bills must search waiver wire to find a run stuffing nose tackle to fill the void of Star Lotulelei opting out of this season. We do know former Buffalo Bill Marcell Dareus is available and could fit for a very reasonable price tag. Its obvious the Bills current defensive front can’t stop the run and most future opponents will focus on running in between the tackles. Bills special teams returner Andre Roberts is having an excellent season. Roberts is the first Bills returner with back to back returns of 39 yards or more in consecutive weeks since Justin Rogers in 2011. The Bills concern on special teams must be with rookie kicker Tyler Bass missing his third extra point this season. When you get into tight games every point counts and being able to kick 50 to 60 yarders are fine but missing on 30 to 40 yarders is unacceptable. Our former kicker Stephen “MONEY” Hauschka was picked up by Jacksonville Jaguars last week. The Bills might get a week off to heal its injured players if the game in Nashville, Tennessee against the Titans is postponed due to a COVID 19 outbreak within the Tennessee Titans organization. The Bills would then play their next game on Thursday, October 15 against the Kansas City Chiefs. This primetime matchup will be much anticipated in Western New York. If the Bills play Titans on Sunday, I see Buffalo t winning 28 – 20 in another slugfest with Titans running back Derrick Henry rushing for over 100 yards, while Bills defense continues to bend but not break mentality. I would like to see more use of running back TJ Yeldon out of the backfield and more screen plays down field. The Bills offensive tackle Daryl Williams is playing quite well at left tackle and seems to be regaining his All Pro form from 2016. Bills now have so many weapons on offense and can spread the field with receivers allowing Josh Allen to pick the open receiver. The Basis of Venue is that the subject action is situated in Erie County. To the above named Defendants–YOU ARE HEREBY SUMMONED to answer the Complaint in this action and to serve a copy of your answer, or, if the complaint is not served with this Summons, to serve a notice of appearance, on the Plaintiff’s Attorney(s) within 20 days after the service of this Summons, exclusive of the day of service (or within 30 days after the service is complete if this Summons is not personally delivered to you within the State of New York); the United States of America may appear or answer within 60 days of service hereof; and in case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the Complaint. That this Supplemental Summons is being filed pursuant to an order of the court dated September 3, 2020. NOTICE-YOU ARE IN DANGER OF LOSING YOUR HOME – If you do not respond to this summons and complaint by serving a copy of the answer on the attorney for the mortgage company who filed this foreclosure proceeding against you and filing the answer with the court, a default judgment may be entered and you can lose your home. Speak to an attorney or go to the court where your case is pending for further information on how to answer the summons and protect your property. Sending a payment to the mortgage company will not stop the foreclosure action. YOU MUST RESPOND BY SERVING A COPY OF THE ANSWER ON THE ATTORNEY FOR THE PLAINTIFF (MORTGAGE COMPANY) AND FILING THE ANSWER WITH THE COURT. HELP FOR HOMEOWNERS IN FORECLOSURE; New York State law requires that we send you this notice about the foreclosure process. Please read it carefully. SUMMONS AND COMPLAINT You are in danger of losing your home. If you fail to respond to the Summons and Complaint in this Foreclosure Action, you may lose your home. Please read the Summons and Complaint carefully. You should immediately contact an attorney of your local legal aid office to obtain advice on how to protect yourself. SOURCES OF INFORMATION AND ASSISTANCE The State encourages you to become informed about your options in foreclosure. In addition to seeking assistance from an attorney or legal aid office, there are government agencies and nonprofit organizations that you may contact for information about possible options, including trying to work with your lender during this process. To locate an entity near you, you may call the toll-free helpline maintained by the New York State Department of Financial Services’ at 1-800-269-0990 or visit the Department’s website at http://www.dfs.ny.gov. FORECLOSURE RESCUE SCAMS Be careful of people who approach you with offers to “save” your home. There are individuals who watch for notices of foreclosure actions in order to unfairly profit from a homeowner’s distress. You should be extremely careful

about any such promises and any suggestions that you pay them a fee or sign over your deed. State law requires anyone offering such services for profit to enter into a contract which fully describes the services they will perform and fees they will charge, and which prohibits them from taking any money from you until they have completed all such promised services. We are attempting to collect a debt. Any information obtained will be used for that purpose.
