MANY people either look forward to the festive pe­ riod and begin their countdown to Christmas in Oc­ tober, while others are left running for the hills to avoid the ‘silliness’ that comes with the season. WAZULU-NATAL Mars One candidate Adriana Marais has proved that women’s bravery goes way beyond what the world has perceived it to be. The 32-year-old Durban woman was among three speakers on Friday, who encouraged women at the Pietermaritzburg Chamber of Business lunch that attracted hundreds of women from various spheres of business in the city. She talked on the theme “Broaden your horizons and conquer your fears to boldly go where no woman has gone before”, which paved the path for her to share details of her daunting deathor-glory Mars journey. “The only way to learn is to get ourselves out of our comfort zone. We need to go out to places no one has ever been before,” she said. Marais, who is eager to leave immediately for Mars, is a theoretical physicist in the field of quantum biology and has been selected as a candidate to possibly go and live on Mars. She said the journey would be expedient to her research she is doing at the University of KwaZulu-Natal on the origins of life. Prepared to give up life on Earth to obtain greater insight into the origins and meaning of life, she said she is more than happy to become one of the first Mars citizens. Marais is among 100 others across the globe provisionally selected to go Mars. The last selection will comprise of only 24 individuals. “I think the fact that we have identified quantum aspects of photosynthesis, one of the earliest living processes to have emerged on Earth, suggests that going down to these tiny scales may help us understand how life emerged in the first place,” she said. She added that what would be really helpful in the quest to understand the fundamental principles underlying the emergence of life would be to find just one other example of the phenomenon. “We have not yet discovered any other location where life exists and all organisms on Earth appear to have evolved from a common ancestor. “The point I want to make is that as far as we can tell, what we are doing here on Earth as living

ETCARE St Anne’s Hospital, in association with Cansa, opened a new cancer support group to provide patients with a safe and empathetic environment for sharing experiences. “Coming to terms with a cancer diagnosis, and the fight against cancer, is a daunting prospect for anyone, whether it is from the perspective of the person who has cancer or their loved ones. “Social and emotional support is a vital aspect of dealing with the disease and developing coping strategies. Our message to those suffering from cancer is ‘no one fights alone’,” said Netcare St Anne’s Hospital general manager, Louis Joubert. The support group, which met for

the first time on Tuesday, 26 July, was led by an experienced social worker, who provided practical information and guidance on cancer, the various treatment options, minimising the side effects of treatments and other tips. The support group also facilitates discussion and shared insights on the emotional burden of the disease, both for the individual and their caregivers, and strategies for coping with this stress in order to maintain strength for healing. “The aim of this support group is to allow those who are further along their journey to share the insights that have helped them to keep strong in the face of this disease,” said Joubert.

He said the key outcome of the meetings is to help people overcome the emotional and mental hurdles presented by cancer in order to better focus on life and their loved ones, to be strong and fight against the disease. Freedom of expression on social media BUKHOSI MBULALI SOUTH Africa is continuously advancing in the communication industry specifically through social media, which has proved to be the most effective and immediate manner to convey informa­ tion to the public. Social media is now arguably the primary instrument of exchanging ideas and opinions. Section 16 of our Constitution entrenches the right to freedom of expression. Our Constitution advocates a progressive attitude towards the rights of the individual. The question now is whether such a right is limitless? May an individual freely express his or her mind without giving due regard to the infringement of other’s rights? The answer is “no”. Section 36 of the Constitution

provides for what is known as the “limi­ tation clause” in terms of which one’s rights are limited where such a right would infringe upon the rights of others. In view of the above two Sections, it is vital for people commenting on social media to think carefully about what they post on social media as posts which infringe other’s rights to dignity and privacy may give rise to a delictual claim known as the actio iniuria injury to personality This legal remedy affords a person the right to sue for damages if they are able to prove on a balance of probabili­ ties that, as a result of another individu­ al’s social media comments, their repu­ tation or dignity has been damaged. In order to succeed with a claim, the aggrieved party must show that the defaulting person has (a) published defamatory matter; (b) that the matter is in fact

defamatory; and (c) that the comment refers to the aggrieved person which infringes on the persons personality right to a good name. In the recent case of Heroldt v Wills 2013 (2) SA 530 (GSJ) the court held that the test in determining whether a publication is defamatory or not is to ask the question as to whether a reasonable person of ordinary intelligence might reasonably understand the words concerned to convey a meaning that is defamatory to the litigant concerned. The court further held that in our law, suggesting that what has been pub­ lished is the truth is not sufficient as a defence or grounds to justify the publication, the post must be in the public benefit or public interest as well. Conclusion Our Constitution provides for basic human rights, which include the right to

express our opinion. However, we are not free to say what we feel like without respecting the rights of our fellow citizens. It is therefore vital to be mindful of the consequences of posting something which may infringe another’s rights. The following questions can assist a person in determining whether a post would violate another’s rights: • Whether a reasonable person of ordinary intelligence would reasonably understand the comment to convey a meaning that is defamatory. • Whether the personal interest of an individual outweighs the public benefit or interest to be informed about the facts. If the answer to both questions is positive, then one should refrain from continuing to post the comment on social media as it would give rise to a defamatory statement.

FTER being ranked the best debater in KwaZulu-Natal last month, Carter High pupil Adam Butler (17) got another linguistic feather in his cap this week. Adam was placed second in the regional De Beers English Olympiad, which won him free tuition for his first year at Rhodes University and R29 500 cash. He received his award at a prize giving during the National Schools’ Festival in Grahamstown last weekend. The English Olympiad is a regional competition that receives over 8 000 entries from across southern Africa. Drawing inspiration from people he meets every day, Adam said writing along the topic of “Darkness in man’s heart” allowed him to be creative.

FEVER “Whenever I write anything, I start with a character, so all of my writing stems really from small parts of people I meet - whether it’s the way they walk or a particular phrase they use.” Growing up he was always surrounded by books and became interested in forms of prose, especially drama, which led to his involvement in debating. Coming second in the Olympiad, Adam said the achievement merely validated his passion for writing and expressing himself. “It has also enabled me to continue in my exploration of language and expression by providing a scholarship to Rhodes University that will pay all my tuition fees for first year,” he said. Adam plans to register for a Bachelor of Arts degree majoring in politics and drama next year at university. He added he also plans on getting a postgraduate certificate in education qualification “so I can return to Carter and teach my own works”. “But I don’t want to get too ahead of myself as I am concentrating on my upcoming trial and final examinations and want to do well at the SA National Schools Debating Championships in December,” he said. Adam thanked his English teacher, Allen Mabasa Zimunya, for his guidance and support in the build-up to the Olympiad. “I also had the support of my best friend, Sne Dlamini, who attended the prize giving in Grahamstown with me last weekend,” he said.

EBOGANG Phalula (Boxer) flew through the finish line in Sunday morning’s Maritzburg SPAR Women’s 10/5km in a respectable time of 34:41 - slicing off one minute 29 seconds off last year’s winning time. The athlete said after her run: “I managed to break away from the seeded runners in the first kilometre of the race, and I was pretty much alone from there on. I asked my friend Cornelia [Joubert] to stick with me for this race but she was unable to. “This was my first Maritzburg race, and I was not expecting so many hills, which were pretty tough, but I did

enjoy it, especially from the eight-kilometre mark where it was pretty much a downhill stride for me - it felt like I was floating.” There is much excitement in the Phalula household as her sister, Lebo, will be representing South Africa at the Rio Olympics in the marathon this coming Sunday. For Lebogang, her next focus is on the Totalsports 10 km Race taking place in Johannesburg on Women’s Day. Finishing 75 seconds behind Phalulua, Jenet Dlamini (Umzimkhulu) crossed the line in a time of 35:56, followed by Joubert (Boxer) 45 seconds later in 36:41. Dlamini from Umzimkhulu said that overall she was happy with her race, “It was a tough run for me having

run the Hammarsdale 10km race last week, so my legs were a bit tired.” It was also Joubert’s first experience at the Maritzburg SPAR Women’s race, and although she was unfamiliar with the route, she was aiming for a top five position. “I was pleased with my result and my time even after having rested quite a bit this week as I had pushed myself in the 21,1 km SA Champs in PE, where I finished 10th last weekend.” There was a record number of entries this year, with 4 039 competing in ideal running conditions. The KZN capital was slightly overcast with a bit of a nip in the air. The youngest runner was nine years old and the oldest was 73-year-old Beryl Trussler, who finished in a time of 53:29.

Alexandra High athlete Thembekile Mthimunye (17) took the honours in the five-kilometre race, breezing through in a time of 25:47. “Well done to everyone who came out to brave the slight chill in the air. It was particularly festive this year,

perhaps young and old alike have been inspired by the spirit of the Olympic Games in Rio.” said MD for SPAR KZN, Rob Philipson. The official race charity, Choc, will receive an R8 000 donation from the race entries. - Supplied
