his is the last issue of 2010, and what a full year it’s been! We’ve seen an appalling performance at the football World Cup, Brandon Flowers’ solo album (and the accompanying worry that it’s the end of The Killers), a new excuse for travel disruption with the volcanic ash clouds, a new coalition government who have a huge amount of work to do and the worst circumstances in which to impress an electorate, and I had a spectacularly good tomato crop. The construction industry has certainly had its ups and downs this year. I heard a story from the comedian John Bishop the other day, telling about when he had a promotion to Director and how proud he was when telling his sons of his new job.After describing the responsibilities his new job entailed, one of his sons replied “Well, my friend’s dad drives a digger,” which he clearly found far more impressive.That’s how important construction is – and even kids know it! Should any of our readers have been the winner of the recent whopping lottery roll-over, the FC&A team have made our Christmas list, in a ‘money no object’ way (and also, it would seem, with an absence of common sense):

? y r o t s e h t s ’ t t a W One of the UK’s largest zero carbon developments has just been unveiled in Slough, Berkshire. FC&A look at how Greenwatt Way uses the latest construction methods and technologies available to deliver zero carbon housing to Level 6 of the Code for Sustainable Homes.

he development of ten homes comprises two and three bedroom houses, one bedroom flats, an information hub and an energy centre.The homes each have a private patio around a shared garden with space to grow vegetables and will be rented out to SSE and Slough Borough staff, along with local residents. Greenwatt Way will be monitored for the next two

years to improve understanding of energy usage and requirements as the UK moves to reduce carbon emissions by 80% by 2050. The research project, in which SSE is investing over £3.5m, is testing a wide range of solutions and will provide much needed evidence of the real life benefits of living in zero carbon homes. Zero carbon homes are now becoming much more
affordable; Bramall Construction is already building Code 6 zero carbon homes for less than £130,000. The project design team was appointed in summer 2009 with an aim for the development to be designed and built within a year. Planning permission was received for the scheme in November 2009 with work starting on site in December 2009.

The homes were deliberately oriented to have east and west facing façades as this is the most challenging orientation to deal with both in terms of passive solar design and also in maximising south facing roof areas. A high efficiency of heat recovery was necessary on the ventilation system, with summer bypass and a natural ventilation strategy to mitigate overheating in summer.

Although the housing industry is constantly revising design codes and standards, very little is understood as to how much heat and power is needed and how occupants will ‘use’ a zero carbon home.
Careful consideration was given to all penetrations (through floors, walls and ceilings), with the use of specialist tapes and seals to ensure the properties reached the required air tightness level by a good margin. Items such as letter boxes, satellite television penetrations were prewired. Natural daylight A north facing roof light above the stairs in the homes allows natural daylight penetration, also acting as a chimney opening in summer to draw warm air out of the house. John Walsh, Managing Director at Bramall Construction said that it was great to see the new homes at Greenwatt Way completed and ready for residents to move into. “We are excited to see how the technology implemented in the homes will benefit the new residents,” he said. “We hope that the homes will play a large part in the way that communities are created in the future and are proud that Bramall have had the opportunity to play our part in reducing carbon emissions of UK housing.” “Although many of the renewable technologies used on these homes have around for several years,” added Paul

Zero carbon requirements The homes include a grey-water recycling system using bath and shower water to flush toilets and recover waste heat. A centralised rainwater harvesting system will also collect rainwater which will be stored and used to flush toilets and provide water for irrigation and car washing. Low carbon heating and hot water will be supplied to all the homes via an innovative low temperature, low heat loss district heating system that is serviced from the energy centre. This energy centre will include solar thermal panels, an air source heat pump (ASHP), a ground source heat pump (GSHP), a biomass boiler and a spare bay for a future renewable energy technology testing. Each of these technologies has been sized to meet the full heating requirement of the site. The biomass boiler, ground and air source heat pumps will run independently to demonstrate that all of these renewable technologies can be installed to generate enough low carbon heat to enable zero carbon requirements to be met.
Good neighbourhood interaction The roofs of the homes and flats are covered with solar PV tiles (63 kWp in total) which provide enough renewable electricity to achieve net zero carbon emissions in each of the homes irrespective of heat source. Excess electricity will be sold back to the national transmission system. “Although a zero carbon research project, Greenwatt Way is first and foremost designed as a place people will want to live,” said Chris Wilford, Associate Director

at PRP Architects. “The aim is to replicate a larger, ‘healthy’ community where good neighbourhood interaction helps encourage a more sustainable lifestyle. It is important for the UK to trial different low carbon technologies and fully understand their performance in a low energy home. Water is now as critical as energy so we have allowed for communal rainwater recycling under the shared garden and an innovative grey water recycling system to improve water efficiency.” Greenwatt Way innovations include: An energy centre to test five different types of renewable energy generation including: an air and ground-source heat pump, a biomass boiler, solar thermal panels and solar photovoltaic tiles. Use of a low temperature district heat network to reduce heat losses and maximise heat source performance Use of the latest low energy appliances, cooking and lighting technologies Low water use fittings, rainwater harvesting and greywater (including heat) recovery Energy monitoring /smart metering systems

Leicester’s Phoenix Square provides homes, workplaces, and education and leisure facilities. This highly-sustainable development adds some regeneration spirit to the city’s emerging Cultural Quarter.

hoenix Square, one of Leicester’s recent landmark developments, was named ‘Regeneration Project of the Year’ at the recent 2010 East Midlands Property Awards.The building combines digital technology and entertainment with state of the art city living and flexible workspaces. The £21.5 million development, a collaboration between the public and private sectors, was completed in under two years. As well as two cinema screens, a screen lounge and café bar, production studios and an interactive digital art gallery, Phoenix Square includes 63 individuallydesigned new homes, 22 workspaces, seven two-storey office studios and eight incubation units for creative businesses. Its launch was the result of a project designed to create a high-quality sustainable development and a new creative community in the heart of the city’s emerging Cultural Quarter.This area already features Curve, the awardwinning performing arts centre that opened in 2008, and the LCB Depot, which

Cultural focal point “It was fantastic to be involved in the design of a complex, multi use building with sustainable credentials on a brownfield site that will help regenerate this part of Leicester,” declared Mike Askey, Partner at Marsh: Grochowski. “The two storey high glass foyer curtain-wall in the main entrance floods the foyer area with natural light and denotes the main entrance to the building. It has solar control glass and aluminium shading louvres to prevent the foyer from overheating.” A five storey timber grid formed from douglas fir is attached to the south and south west sides of the building to support balconies to the apartments, provide shading to the homes and to create a dramatic feature at the main elevation of

The Film & Digital Media Centre at Phoenix Square provides access to the very latest technology to those working in, or studying, digital media in the city. Stateof-the-art edit suites, production studios, live links to DMU and two dedicated 3D screens will help make the building a centre of excellence, not only for the East Midlands region, but for the country as a whole. “Designed as a lively and active building on the streetscape of Leicester, it certainly has provided a creatively diverse and cultural focal point for the city,” claimed Peter Owen, Managing Director for Willmott Dixon in the Midlands. “For Willmott Dixon this is the latest in a long line of areas we have helped regenerate through the structures we build; these buildings help to bring new prosperity to the local community through the power of the built environment.” Creative collaboration “The completion of Phoenix Square is a significant step forward in the regeneration of St George’s and a key stage in the development of Leicester’s Cultural Quarter,” added Blueprint’s Peter Connolly Prior to the launch. “New homes and office studios have been placed under offer and let, showing how this new community is already starting to establish itself.We believe this is an exemplar project for the city and the region, the building’s unique design enables interaction between residents, businesses and visitors on a public, private and semi-private level, making it quite unlike any other mixed-use scheme. I don’t like to use the word unique but in the case of Phoenix Square it would be totally justified.” Phoenix Square provides a new home for independent cinema in Leicester, as well as an exciting digital programme – the result of a creative collaboration with the Institute of Creative Technologies (IOCT) at De Montfort University. Chair of Phoenix Film & Digital Media,Ted Cassidy MBE, said, “We were all very excited about the opening of this amazing building. University enables us to showcase the latest innovative developments in creative technology.” Phoenix Square is a partnership between Leicester City Council, Blueprint, East Midlands Development Agency, Phoenix Arts and De Montfort University, with additional support from the European Regional Development Fund, EM-Media and Arts Council England through National Lottery funds. A real focal point Professor Dominic Shellard,ViceChancellor of De Montfort University said that the university is proud to be a partner in the Phoenix Square development. “We are a vibrant, dynamic and outgoing university committed to excellence, diversity and the communities we serve,” he claimed. “Our ongoing involvement in Phoenix Square is evidence of the commitment we have to our role locally, regionally and nationally – we aim to enrich cultural life and foster new ideas and practices.The collaboration with Blueprint, Leicester City Council and Phoenix Square Film and Digital Media reflects the commitment to supporting the growth of creative industries and communities in Leicester, and aligns with our arts roots dating back to the nineteenth century.” Ed Reynolds, Operations Director for Willmott Dixon Construction, said: “Phoenix Square is as much about social and economic sustainability as it is about environmental sustainability.This is a great example of organisations working together
for the common good to create a lasting legacy for the people of Leicester, one that will be a real focal point for the whole community.” Plans for phase two of the scheme were announced by Blueprint earlier this year and are expected to result in the construction of new hotels, office spaces and restaurants in a move that confirms the success of this initial phase and its ability to stimulate the economy on a local level.

Government legislation, such as the Code for Sustainable Homes and the (soon to be revised) Building Regulations Part L, was introduced to reduce the levels of CO2 produced by new homes. However, says Neil May, CEO of Natural Building Technologies, recent research has shown that, in too many cases, the ‘in use’ performance of new homes has been shown to fall well below their design standard.
O
ne of the key reasons for this is the complexity of the designs, which leads to conflicts in the build process. For example, the airtightness of the building envelope can easily be compromised by the use of technologies, such as solar thermal or photo voltaics, rainwater harvesting or micro wind turbines, as these all require penetrations through the building envelope. The problem is that these regulations and legislation are asking too much of our industry and the current capabilities of the people on site.The reality is that we do not yet have a building industry sufficiently skilled to be able to integrate all of these new requirements at one time. With cost and, therefore, time pressures on contractors, together with the limited

number of skilled tradespeople available, it’s a big question as to whether this situation will ever change. So what’s the alternative? We should keep things as simple as possible and focus on the area of greatest impact, which is the thermal coherence of the building envelope.To put it simply, if we reduce the space heating requirement of a building (typically accounting for over half of the energy requirement in a domestic situation), the need for ultra high efficiency energy generation is dramatically reduced. Achieving a highly insulated building envelope is far easier and consistently achievable if we don’t have to worry about accommodating renewable add-ons that compromise the integrity of that envelope.

A massive impact What’s more, it makes sense to aim for a slightly lower level of performance than, for example, the ultra-ambitious level six of the Code for Sustainable Homes, but one that will still have a massive impact on reducing energy consumption from current levels and, importantly, is eminently achievable with building systems that are readily available and suit the skill levels that we have at our disposal. For example, the AECB Silver standard, which demands an energy consumption of no more than 120 kWh/m2 (40 kWh/m2 of which is for space heating) will deliver a reduction of 70% in energy use compared with the average building stock in the UK today.There are many proven building systems that can deliver to this standard, consistently and repeatedly.

With estimates forecasting that 70-85% of current housing stock will still be in use by the year 2050 (the target date for the 80% reduction in carbon emissions from 1990 levels), the benefits of being able to massively reduce the energy requirement in new homes as soon as possible presents a strong case for adopting tried and tested techniques that have been proven to deliver it.
A simple, well-insulated building envelope
The alternative is to aim for Code level six homes, fail miserably, and be in a far worse position than we could be otherwise. In focusing on the building envelope, we also need to consider how different building systems deliver in reality. Research by world leading authority in building physics, Hugo Hens in Belgium recently showed how some forms of cavity walling were a lot easier to build correctly than others and, when they were built incorrectly (an all too common occurrence), how there was a very large difference in actual performance. For example, a cavity wall with partial fill rigid boards with a designed U value of 0.21 W/ m2K, when built to a poor standard had an in-use U value of 0.99 W/m2K – the same as some uninsulated solid walls. Erroneous assumptions Furthermore, building systems can vary hugely in terms of non-repeating thermal bridging at openings, junctions, lintels etc.The measure of heat loss due to non-repeating thermal bridges is expressed in terms of y values and is critical for determining the overall thermal performance of a building.The deliverability of robust details with a y value of 0.08W/ m2K has not occurred in practice, because with most building systems it is just too difficult to deliver on site. A further problem with the legislation currently in force, and which is currently

being addressed by the latest revision to the Building Regulations Part L, is that certain assumptions for this current legislation has been proved to be erroneous. A critical example of this is the heat loss at party walls. In the last incarnation of the Part L regulations, this was believed to be zero (on the basis that both homes on each side of the wall would be heated and therefore no heat transfer would take place). In reality it has been found that the cavity within the party walls (itself required for sound insulation) has acted as a ‘chimney’ to allow heat from each home to escape into the roof space – an effect known as thermal bypass. This effect was discovered due to the work of Leeds Metropolitan University at the Stamford Brook Development (see www. leedsmet.ac.uk), which showed that the predicted heat loss of these dwellings was as much as 100% more than designed, and half the heat loss was through the party walls, which were not even accounted for in the modelling. A fundamental issue The fundamental problem that we have at the moment is that designs to achieve Part L and the higher levels of the Code for Sustainable Homes are in too many cases based on flawed theory and/or their design performance is not being achieved in practice.

The message is simple. Focus on the building envelope. Use building systems, which themselves are simple and can be reliably constructed and easily repaired if damaged (without affecting the integrity of the structure or its performance). And use building systems that are easy to understand and are predictable in their performance – for example in terms of thermal bridging and airtightness, which have a major impact on thermal performance. Promote building monitoring Going forwards, what will help to provide more feedback on which designs are working and which aren’t is much more use of monitoring and smart metering of building performance. Organisations such as Leeds Metropolitan University, UCL, the Usable Buildings Trust (www. usablebuildings.co.uk) and the Good Homes Alliance (www.goodhomes.org. uk) have for several years been promoting building monitoring as the key tool in radically improving building design and construction. As a result, the Government has now proposed the introduction of smart metering into the Code for Sustainable Homes under a new category ENE 9. The proposal aims to provide a way for residents to clearly see, understand and monitor their energy usage. New ways of monitoring constructed building envelopes, along with post occupation analysis, are also being developed and will be used to see how occupant behaviour affects building performance in reality and how far the building envelope itself is the cause of heat loss and energy use. www.natural-building.co.uk

Correct sizing is key to Heat Pump Performance In order to ensure an efficient system, a heat pump must be sized correctly, not in isolation but as part of the whole heating system. Nu-heat offer help with the calculations.
C
onsideration must be given to the quality of the building in terms of insulation, and full heat loss calculations should be carried out.The target building heat loss is 35 – 40W/m². A heat pump works more efficiently the cooler the heating temperature so the most suitable partner is warm water underfloor heating, although using oversized or high efficiency radiators is another option.The heating temperature will depend on the heat loss; for example with a heat loss of 30W/m² the system could potentially run at 35°C. Nu-Heat designs systems to run at 45°C to a design load based on an outside temperature of -3°C, the temperature to which the company has traditionally designed its underfloor heating systems. This ensures equality of performance. Next, the bivalent point must be determined.This is the outdoor temperature at which supplementary heating cuts in. A system designed to -3°C will cover the majority of weather conditions, but if the temperature drops lower, the heat source still needs to deliver heat to the property. Optimum range A heat pump should not be sized to cope with these worst-case scenarios as it would then be working outside of its optimum range for the majority of the time, which is
not energy efficient. Supplementary heating will therefore be required.The temperature that the heat pump is sized to ultimately influences how much this is used. Once the bivalent point has been set NuHeat will recommend the heat pump size, taking into consideration other factors if necessary, such as a situation where single phase won’t satisfy the requirement and three phase cannot easily be taken on site.The question in that case would be whether to accept a higher bivalent point or spend considerable amounts to bring in a three phase supply. When the size has been decided, NuHeat’s calculation of a year’s heating and hot water requirement will enable an assessment of the seasonal performance factor, giving an estimate of the total heating and supplementary energy usage and providing an approximate cost for running the system. Inverter technology With traditional systems, the size of the boiler is based on the heat load of the
property plus ‘a bit extra’ for domestic hot water.This doesn’t work the same way with heat pumps, as no extra allowance has to be made for the hot water. Heat pumps with a weather compensating control will be working at part load for most of the time, meaning that there will be enough spare capacity for hot water production. This part-load situation means that a buffer tank will be required which Nu-Heat will size according to the output of the heat pump. Essentially the buffer tank will store enough energy to prevent the heat pump coming on too many times.With the inverter technology present in some heat pumps a buffer tank may not be required to store energy, although it may be used for other applications such as to defrost the evaporator and as such will be sized accordingly. We firmly believe that even the smallest change can make a big difference – especially when it’s repeated every day. If, with every shower, bath or WC flush we save a little water, this mounts up to very large volumes conserved. Having shorter showers instead of baths, and not leaving the tap running while brushing teeth (it can waste up to five litres of water a minute), will help us reduce our water consumption in the bathroom without too much effort, making an enormous difference to our carbon footprint. A multi-faceted approach Recent government regulation should
also help steer us in the right direction. In April 2010, new building regulations regarding the use of water were put in place concerning new dwellings and dwellings created by a change of use of an existing building. Now, recent buildings must not exceed a water efficiency standard of 125 litres per person per day. Calculations can be made using the ‘Water Efficiency Calculator’, which is a methodology and calculation tool for new dwellings, introduced as part of the Part G regulation.The tool helps to calculate the theoretical water usage per person per day in a domestic building. Modern WCs, for example, often require less water than
they used to and by specifying a dual flush suite the smaller flush will be measured in a 2:1 usage ratio – dramatically reducing the amount of water consumed. Sustainable water use is a key priority for Ideal Standard but it isn’t just about reducing water wastage - it is about using water responsibly.The next decade will see us at the forefront of developments to enhance sustainability. However, our efforts will be in vain unless it is seen as part of a multi-faceted approach to the problem that combines product innovation, government intervention and widespread consumer education.

perating from Harold Wood in Essex the factories have excellent access to the M25 motorway and the arterial routes into the Stratford and Central London areas. With a current turnover in excess of ÂŁ6m, split between the supply only and glazing operations, glass is produced 24 hours a day and six days a week, currently employing 60 people. Stocking a comprehensive range of glasses from 4mm-19mm clear float and low iron, tinted glasses, fire resistant glass, mirrors and able to process these using modern CNC cutting and edgework equipment offers clients a one stop shop for all of their glass requirements and a reliability which maintains their repeat business.

Float glass is made by combining several components sand, soda ash, dolomite, limestone, salt cake and cullet.This mix is heated by gas burners to approximately 2900°F, this is then allowed to cool slowly for delivery to the float furnace.The molten glass forms a continuous ribbon that floats on the molten tin with the thickness being regulated by the speed that the glass is drawn through. After the annealing process the glass the glass appears as the finished product and is cut into stock sizes.This is a very brief description of a complex manufacturing and quality controlled series of processes ending with the stock glass product. Glass can be toughened using the Cooltemper tempering furnace also based at Harold Wood to maximum sizes of 3000mm x 5000mm, and in combination with the laminating facility and sealed unit production line produces products for use in structural glazing projects. These all glass structures can accommodate pivoting or sliding doors, framed and frameless options and including the Swiss-made Sky-Frame system which combines a minimal aluminium frame with outstanding thermal performance.
Total flexibility Double glazed systems generally use combinations of clear and low emissive glasses, however these can also be designed to include for a solar control glass to be used on the outer leaf, with varying degrees of performance. Living in suspense The beauty of this house is that you cannot easily see it! England’s first certified Passive House is dug in to the hillside, with, amazingly, the original 300 year old barn suspended above. FC&A take a look at this hidden gem.
U
nderhill House, designed and lived in by Helen Seymour-Smith of SeymourSmith Architects and her family, is located in the heart of an Area of Outstanding Natural Beauty (AONB). The unique building, the first certified Passive House in England, is dug into the hill beneath and adjacent to a 300 year old barn, which was suspended on a steel framework during construction.The project has been recorded for the latest Channel 4 Grand Designs series. Invisible from the surrounding countryside, the development is designed to have minimal visual and environmental impact. Planning was granted under paragraph 11 of PPS7, a policy which gives special dispensation for new houses in open countryside which are considered to be ‘truly outstanding and ground-breaking’. Underhill House was only the 10th in the country to be granted such dispensation, with its eco-credentials winning it support. There are three walls of the existing barn that the planners were promised would be kept intact during the building of the house below; this was instrumental in planning permission being granted to build in such a prominent location in an AONB.The

The standard requires very high levels of insulation, a design that makes the most of solar energy and superb sealing throughout. “Insulation that can perform effectively in its environment for the expected lifetime of a building is key,” said Helen Seymour-Smith. “There’s no point installing photovoltaics or a ground source heat pump if you’re still leaking heat through the building fabric!” Produced at Dow’s facility at King’s Lynn in the UK, distinctive blue STYROFOAM-A products FLOORMATE™-300-A, ROOFMATE™ SL-A and PERIMATE™DI-A insulate the floor, roof and basement walls of the structure, and played a vital role in the house getting Passive House certification.

Getting the architect’s perspective: Helen Seymour-Smith describes the project which was both professional and personal. Why did you choose this part of the UK to create your design, and why select such a challenging site? It’s been a life-long ambition to design and build my own house – and what better place to do that than the area where you grew up? My father owns the land the original barn was built on and we used to come up here for picnics when I was a child.We can even see the church my husband and I got married in from the site, so it’s a very special place for us. Why was getting Passive House certification so important to you? Passive House design achieves a staggering 90% energy saving compared to that of an average house, and we really believe it is the best standard available for achieving the reductions in carbon emissions that are so desperately needed. My husband and I believe there’s no excuse not to build a new structure according to Passive

House standards, given 27% of the UK’s carbon emissions come from residential buildings. How did you go about choosing the materials to turn the vision into a reality? Choosing a pre-cast concrete structure and exposing the material internally enabled us to make the most of its thermal mass properties and avoid the need for artificial heating and cooling. It was also a vital part of the design that we would have no visual impact on the surroundings, meaning an earth-sheltered building was the obvious choice. In order to meet Passive House standards we needed a material which could maintain good thermal performance outside of the waterproofing envelope, as this would allow us to expose the concrete internally and make the most of the space. Only extruded polystyrene insulation has the right level of moisture resistance and durability required to maintain thermal performance in such a challenging environment, and as STYROFOAM™A is the only product of its kind produced in the UK – and it has a Global Warming Potential of less than five – it was the perfect choice. Once the concept was agreed and planning permission achieved, how technically difficult was the build? Well, suspending a 300-year-old barn in mid-air whilst we excavated and built a brand new building beneath it was quite a challenge! This obviously required specialist help from very brave structural

engineers. Installing the pre-cast concrete sections and waterproofing also required support from specialist contractors. Do you have a favourite part of the building and if so why? I think it’s the view of the house from the South.We get to see it in context of the old barn that I remember so well from childhood and how well it fits within the stunning landscape beyond. It’s fantastic to think we’ve been able to build the striking development that we wanted without impacting on the landscape that’s so special to us, either visually or environmentally. Do you have any advice for people looking to make their homes more sustainable? Insulation that can perform effectively in its environment for the expected lifetime of a building is key.There’s no point installing photovoltaics or a ground source heat pump if you’re still leaking heat through the building fabric! There are also lots of really simple and cost effective things that everybody should do, such as changing tungsten bulbs for low energy compact fluorescents or LEDs, and fitting low-flow and aerating taps and shower heads, for example. Would you do this again? I’m not sure we’ll ever want to move away from here – our hearts and souls have gone into creating this building as well as a lot of blood, sweat and tears! But we hope Underhill House will inspire others and help set standards for the future. Watching the defectives
When construction disputes arise, it is quite common for a client to assert that the contractor has been paid too much. Sometimes the client is right. But, asks Mark Clinton, Head of Construction at Thomas Eggar LLP, how does he get his money back?
T
he familiar JCT valuation rules say that payments are to include the total value of work “properly executed”. Often the overvaluation claim will be based upon an allegation that the valuation wrongly included defective work, which by definition is not “properly executed”. The client’s most obvious route to recovery of the overpayment is to have the situation rectified in the next payment or to ask an adjudicator, arbitrator or court to review and revise the relevant payment certificate. But what happens if the contractor is unable to make repayment? In that case no amount of reviewing and revising will get the client’s cash back for him. If the contractor cannot repay, who is liable for the client’s loss? Is it the quantity surveyor who carried out the valuation or the architect who certified the payment? Quality issues These issues were addressed earlier this month in the decision of Mr Justice Coulson in Dhamija v Sunningdale Joineries, Lewendowski Wlilcox and McBains Cooper. The three defendants were, respectively the contractor, the architect and the quantity surveyor. The quantity surveyor applied to strike out the claim against him on the basis that quality issues were for the architect to deal with. He argued that the quantity surveyor was only required omit defective work from a valuation when the architect notified him that there were such defects. Previous authority points a finger at

the architect. In Sutcliffe v Chippendale & Edmondson (1971) 18 BLR 149, the court said “the architect … should first satisfy himself as to the acceptable quality of the work, before requiring his employer by way of certificate to make payment for it, and in particular should keep the quantity surveyor continually informed of any defective or improperly executed work which he has observed.” No written appointment In Dhamija, matters were not helped by the fact that that the quantity surveyor had no written appointment.The court rejected the argument that their appointment included an implied term that the quantity surveyor would “only value work that had been properly executed by the contractor and was not obviously defective”.The court held that the term to be implied was a rather less onerous duty to act with the reasonable skill and care of quantity surveyors of ordinary competence and experience when valuing works properly executed for the purposes of interim certificates. On the facts, the judge decided not to strike out the claim against the quantity surveyors but was doubtful of the claimants’ ability to prove a breach of the skill and care based duty. What does all of this tell us? First, quality is primarily the domain of the architect. He should make sure that he has systems in place for notifying the quantity surveyor of defective work which should be excluded from valuations. Secondly, the quantity surveyor should be mindful of his duty of skill and care. If

he sees things that he should recognise as defective but nonetheless includes them in his valuations, he could still find himself footing the bill for the contractor’s errors. Thirdly, it is important that a proper written appointment is put in place, paying particularly careful regard to the scope of what the professional is engaged to do and, equally importantly, what he is not engaged to do.The industry in general remains very lax in getting contracts in place in good time and many professionals have still not grasped the importance of making sure that the scope of their obligations is defined clearly and in detail. Finally, in these difficult economic times, clients should take appropriate security in the form of bonds and/or guarantees to give an additional line of recourse in the event that their contractor is unable to meet a claim from his own resources. Dhamija addresses a traditional procurement structure with a quantity surveyor and architect dealing with valuation and certification. In many cases a different structure will be used, particularly these days, design and build. In this case, the JCT form assigns the valuation and payment administration duties to the client. Normally, he will discharge those duties through the ‘Employer’s Agent’. The client will need to be sure that the appointment of the Employer’s Agent places responsibility for proper valuation, identification of defective work and payment recommendations with the Employer’s Agent. www.thomaseggar.com

Class monitor Property users are beginning to invest heavily in renewable energy solutions based on feed in tariffs. To evaluate this, Will Grafton, MD of Wattsure, says that monitoring will become increasingly important.
A
ttitudes to renewable energy are changing all the time. No longer is it seen as the remit of those who want to save the environment, it now offers real investment opportunities with the introduction of Feed-in Tariffs in 2010 and, next year, the Renewable Heat Incentive scheme, all delivering up to 10% return on investment across the different technologies. Interest in renewable energy has lead to an explosion in the range of technologies available, making it vital to provide a more intelligent solution to monitoring the health of what is a major investment. Buildings managers are now tasked with not just whether to install solar panels, but decisions that will require a thorough analysis of what is needed and which renewable energy solution can deliver over the longer term. Key aspects of that decision making are likely to include the site’s energy consumption, future energy supply, likely energy price hikes, local geography, most reliable and efficient technology, and which package offers the greatest return on investment. Without effective monitoring of the key indicators these decisions often have to be made with a lack of concrete evidence. A more intelligent solution to monitoring is required and now there is greater need than ever before for a bespoke, failsafe system that provides easily accessible, live energy and financial data. HVAC CASE STUDY: Keniston Housing Project Eighty-seven social housing projects across the UK are set to benefit from a share of government funding to test low carbon building technology in a programme entitled ‘Retrofit for the Future’. It is the first of its kind in the UK, and will see social housing units across the country retrofitted with new, innovative technologies. Naturalwatt worked closely with architects, Broadway Malyan on the prototype house at Keniston Housing Association in Orpington, Kent. “The aim of the project is to demonstrate that it is possible to achieve 80% cuts in carbon emissions,” says Stephen Choi, Associate at Broadway Malyan. “We looked at a variety of energy efficient measures across all aspects of the house design that would provide a cost effective solution that could then potentially be rolled out across the UK.”

It also provides a value-added service to the end user ensuring maximum efficiency is maintained through fault monitoring thus guaranteeing the greatest possible financial returns. Monitoring renewable energy production will become an essential element of modern, intelligent building design.
Providing real-time data 1. Renewable energy system feeds into an inverter converting the energy into AC power. 2. The Wattsure Controller box sits between the inverter and the building’s broadband router. 3. It takes the data from the inverter, summarises and condenses the information and sends it to the Wattsure servers. 4. The servers convert the data into an energy monitoring dashboard on an individual webpage for each end user. 5. The system is monitored 24/7 by a telecommunications grade monitoring system to ensure action to fix faults.

Take a direct route… What was your first job, and when did you join the industry you are currently in? In 1975 I joined the construction and engineering giant Tarmac Construction Ltd after leaving university in my home city of Edinburgh. I was able to work across various sectors and my time at Tarmac included two years of formal secondment to design consultancies. In 1978 I took an estimating position at civil engineers Jeavons, based in the West Midlands.Three years later I moved south to Kent to join East Peckham construction firm Arnold and Nathan. By 1988 I was ready to become my own boss and with a like-minded partner – now retired – we set up Directline Structures in tiny premises near Maidstone.We expanded into larger offices in Goudhurst before we were finally able to practice what we preach in 2009 by designing and building a new company office for ourselves in boom town Ashford.
Did you have plans to achieve this, or was it a series of (lucky?) events? It was probably inspired by trying to keep the sea out of sandcastles and diverting streams on the beach – interested in controlling natural forces, I guess. But even from my early days in university, my ethos has been that everything in life should be done efficiently, whether it’s the recycling of waste and water or the efficient use of materials. What has happened along the way that helps you in your position today? I have nothing but praise for Tarmac.They steered me towards things that I was good at and also encouraged me to become very commercially minded. Looking back at my career, I have been lucky enough to have roamed across various disciplines in both design and construction and to have developed a reputation as a troubleshooter for awkward or tightly-budgeted projects.

Another change in recent years has been the dash to create environmentally-friendly buildings, which I am bemused about. Someone said to me the other day that we were at the forefront of a green building revolution but I pointed out that there is nothing revolutionary in what we do. After all, we’ve been designing sustainable, costeffective and stylish buildings since 1988!

In fact I have always thought outside the box when it comes to truly efficient and sustainable design and construction. But I have spent years swimming against the tide. It’s not just about waste reduction but about using less materials in the first place. More people are now coming around to this way of thinking but it has been a long time coming.

What advice do you wish you’d been given at 25? I didn’t really know how good I was at combining practical and commercial knowledge. I was being eased towards it and thought I was out of my depth when actually I was good at it. If I was asked to give advice now to someone aged 25, it would be never stop learning, you must research new technologies and don’t be too proud to learn from others. I would also encourage people to think their way out of a problem, instead of just throwing money at it, and I’d urge a youngster not to panic – there is always another way and a solution. Finally don’t forget that the client is an expert in his business – work together to optimise the project and always think of the client’s costs as if they were your own.

Do you think advice can be given to people, or does everyone have to make their own mistakes? Advice should always be sought, and offered if people want to accept it.Why have to learn from mistakes or be over-cautious? All my staff are encouraged to learn as much as they can and develop their skills and potential. Because our company is special and offers the full process of design and construction (not delegated to consultants as is the norm, even with design and build contracts) the whole team has to work closely and see the projects holistically, considering style, function, cost and safety, and most of all practicality and value.We are especially noted for good value, and our sustainability skills save money for our clients. Where do you see yourself/your industry in five/ten years’ time? Hopefully still following my mantra that ‘sustainable design is simply good design’ – it saves money for the client as well as helping the environment. I’d also like our company to continue to enjoy the recognition it deserves for its commitment to excellence in the design and build sector. For example, in 2010 we scooped two major awards for sustainable design and construction – the SME category in the South East in the Constructing Excellence Awards; and at the Kent Environment Awards.

Stannah: restoring Victorian romance A Stannah Goodsmaster 500B goods lift is playing a vital role in the rebirth of the Isla Gladstone Conservatory, an idyllic Grade II Listed Victorian glass house located in the grounds of Liverpool’s Stanley Park. As part of Liverpool’s urban regeneration programme, this fine example of glass architecture is the centre piece of a £25m project to restore all the dilapidated buildings. Originally constructed in 1870 as a showcase for exotic flora, the Isla Gladstone Conservatory has been a multifunctional venue for events and celebrations since its re-opening in August 2009. The Goodsmaster contributes to its 21st-century performance, distributing a whole range of deliveries between the two storeys.
Available in 500kg to 1500kg capacities, the lift operates inside a rapidly erected, structure-supported frame, making installation swift and simple with the minimum of builders’ work. It can be installed almost anywhere in a building and does not rely on an outside structural wall for support. It also allows for flexible positioning as it is does not require significant headroom or pit depth.With the motor/drive unit fitted to the side of the lift, the lift does not require a dedicated motor room which makes a considerable saving on space. The gleaming white ceramic granite exterior envelope of the new ward complex at Chesterfield Royal Hospital is one of the most striking aspects of this impressive £12 million building. The 2000m2 of prefabricated ceramic granite panels used to create the ventilated facades of this sleek and minimalistic development were supplied by Shackerley and have been installed using the company’s Queen’s Award winning Sureclad Access System.The facades were specified by The Manser Practice and installed by Task Contracts for main contractors GB Building Solutions (Wakefield). Project Architect Guy Barlow, one of the first UK specifiers to recognise the many aesthetic, technical and environmental benefits of ceramic granite as a ventilated facade material in the 1990s, was responsible for delivering the new wards for the Chesterfield Royal Hospital NHS Foundation Trust. “This new three-storey building significantly extends the hospital’s capacity, providing almost a hundred additional beds for patients,” he said, “We were seeking a simple aesthetic, with crisp clean lines and
flush glazing, but with a very high quality finish.We’d always planned to clad the building with ceramic granite rainscreens, and as this practice has considerable experience of using Shackerley’s ventilated facades, the Sureclad system was an ideal solution.The decision was clinched when Shackerley introduced us a new style of panel which hadn’t previously been used in this country in an exterior cladding system.We knew straight away that the ‘almost-white’, monochromatic coloured panel with its polished surface and high degree of reflectivity was just what we were looking for.”

Ecodan is a CERT! Mitsubishi Electric has announced that the Ecodan® range of residential air source heat pumps is now CERT (Carbon Emissions Reduction Target) funded meaning that all equipment installed and working before 31 March 2011 will be eligible for an average rebate of £500. “The actual amount that can be claimed will depend on the size of the property and the Online Enquiry 061 type of heating being replaced but it could be anything from a couple of hundred pounds for a small flat to around £1,400 for a large house replacing solid fuel,” explains John Kellett, General Manager of the company’s Domestic Heating Systems Division.
Hamworthy: visibly effective St John’s House, a 250 year old building, part of the Warwickshire Museum, has undergone an extensive refurbishment programme. A 65kW biomass boiler supplied by Hamworthy Heating has been installed as part of the project, and the visiting public will soon be able to see just how ‘green energy’ works in reality, via display boards and a viewing window into the plant room.The installation of the biomass boiler and a built-in fabricated fuel store to house the wood pellets, also supplied by Hamworthy, is in line with the County Council’s replacement programme which aims to install renewable products where feasible.

Foremans are part of the nuclear family A recycled modular building from Foremans Relocatable Building Systems was selected to provide project offices at Sellafield in Cumbria for the delivery of Sellafield Limited’s Evaporator D project – one of the largest nuclear construction schemes in the UK. Foremans’ contract is its second at the Sellafield Nuclear Plant. A recycled and refurbished modular building has already been provided for VINCI Construction UK for the Silos Direct Encapsulation Project – a major waste retrieval scheme.The use of recycled building modules is highly sustainable, up to 70% faster and provides cost savings of up to 50% compared to new build. Resembling an inverted ‘ziggurat’, a terraced pyramid of successively receding storeys, it partly overhangs the Canada Water basin. Technal’s MX SSG structural sealant glazing and CD commercial doors in bronze anodised
aluminium finish have been specified for the ground floor, MX Visible Grid for the strips of curtain walling to the three upper floors, with MX top hung concealed vents and PXi doors providing access to the balconies. The curtain walling is complemented by FXi65 tilt/turn casement windows used as ‘punched hole’ openings set into the cladding.

Sadly we’ll not be at SED later in the year, following the closure of SEM magazine and the cancellation of the show.The downturn continues to shock us all with the loss of such big-hitters as Connaught and Rok, but here’s hoping that those who take over their contracts will be able to also take on the staff. According to theconstructionindex.co.uk insolvency experts believe that “construction will be hit harder than any other sector by the public spending cuts. A survey of members by R3, the Association of Business Recovery Professionals, found that 48% of them think that construction will be hardest hit. However, public spending cuts are not the greatest threat to business in 2011, according to the survey. A half of insolvency practitioners believe that the impending VAT increase is the biggest challenge facing businesses during 2011.” So we may not be in the clear yet.
