NEW YORK’S TRANSIT OFFICIALS have long been trying to convince travelers there’s a better way for getting out to the city’s airports. They even used a catchy jingle, “Take the Train to the Plane,” when $4 got travelers from Manhattan out to John F. Kennedy Airport via an express subway ride and bus transfer at Howard Beach, a service that ran from 1978 to 1990. As the Port Authority of New York and New Jersey now mulls alternatives to the scrapped AirTrain plan for LaGuardia Airport, Gov. Kathy Hochul has made the Q70 bus in Queens a free ride. That means travelers can pick up the bus in Queens for free to get to LaGuardia. The bus already was a free transfer for anyone coming off a subway train connection. However, the public transit options for LaGuardia aren’t just limited to this Queens bus route. The M60 that travels along 125th Street in Harlem accomplishes the same from Manhattan. And for the $2.75 fare, it’s the most accessible way to get to LaGuardia. Travelers who need a car ride, of course, have their personal rides, taxis and black cars, among other options. The public option may not be as comfortable, but it’s certainly far less expensive and one that deserves greater attention. As inflation continues to rise, saving on travel costs will go a long way to helping people go on trips for business, pleasure and to recover from the impacts of COVID-19. It may even be worth a new catchy tune. But taking a train, to the bus, to the plane, will certainly need some creativity in the lyrics department.

ADAMS’ SECOND BUDGET PLAN

New York City Mayor Eric Adams presented his executive budget, a $99.7 billion spending plan laid out in his State of the City address. It included a $5 billion new investment in the city’s crumbling public housing,

additional cash previously promised for the Summer Rising youth program and an expansion of the Earned Income Tax Credit. Adams’ broader speech as he laid out his vision for the city also honored the victims of various tragedies that occured in his short time in office. He once again

spoke about his plans for gun violence and subway safety, highlighted his plan to expand the city’s Gifted and Talented programs and praised recent unionization efforts by Amazon workers on Staten Island. He also took the time to speak to his critics, offering investments that spoke

SUBWAY SCARES The safety of the New York City subways will never cease to be a topic of conversation, but last month’s mass shooting has revived the debate. Yes, it’s true that stories of crime on the subways can be sensationalized to manufacture fear. And it’s true that some straphangers are wary after not just last month’s shooting, but the killing of Michelle Go earlier this year. New York magazine tried to figure out what a system in “permacrisis” actually feels like today.

HOCHUL’S LAGGING POLL NUMBERS

With an election around the corner, a new poll shows that Gov. Kathy Hochul perhaps isn’t doing as well as she might have hoped at this point in the year. Fresh polling from Siena College showed that Hochul’s job approval rating hit a new low, dropping to 36% from 43% about a month ago. A majority of voters in the state also gave her low scores on her handling of crime and economic issues, although her overall favorability (whether voters categorized her as “favorable” or “unfavorable”) only went down 1 percentage point since the last poll. A potential saving grace for Hochul were reactions to changes to the state’s bail law, which she pushed to have included in the budget. Voters overall viewed the changes favorably.

news, and some potential good news, about ongoing investigations into him and his business dealings in New York. In bad news for him, a judge held Trump in contempt of court for failing to turn over requested documents to state Attorney General Letitia James. She had sought the decision from the court, which it granted, and Trump now has to pay $10,000 each day he doesn’t fork over the

subpoenaed documents. But the ex-president may be in luck with a different investigation, this one conducted by the Manhattan district attorney. After internal disarray with the probe made its way into the public eye, a grand jury indictment has become increasingly unlikely – and Trump could wind up free of any charges in that jurisdiction. So overall, a mixed bag.

Can New York court and regulate crypto at the same time? New York City Mayor Eric Adams is still boosting cryptocurrency as a can’t miss opportunity for economic development, education and financial equity in New York City. Three paychecks deep in converting his salary to bitcoin and ethereum, who could blame him? Adams appeared virtually at a cryptocurrency and digital asset summit hosted by the Financial Times, a London-based newspaper, last week and repeated the pitch he’s made for months that New York City can be the world’s cryptocurrency hub. “Crypto, and blockchain as well, are here to stay. We can’t let this opportunity pass by,” Adams said. “We can integrate these new technologies in a smart way, prioritizing equity and inclusion as we’re building out blockchain (and) crypto campuses for our young people to have a real understanding of this new industry.” Just the day before, the Assembly passed a bill that would place a two-year moratorium on any new or renewed permits for fossil fuel-burning plants being used to power behind-the-meter proof-of-work mining. It would also require an environmental statement on the effects of proof-of-work mining. Environmental groups and community activists who live near bitcoin mining sites have been advocating for this moratorium, arguing

that the emissions produced by mining will harm the state’s climate goals. An earlier version of the bill – like this one, sponsored by Assembly Member Anna Kelles – failed to pass the Assembly last year, but it did pass the state Senate last year. The proposed moratorium has produced an outcry from the crypto industry and some sizable lobbying spending in Albany. Though the bill’s sponsors and environmental advocates said they’re not against cryptocurrency trading or exploring new uses of blockchain – they’re just against the energy-intensive proof-of-work authentication method – industry insiders have said that a moratorium would send a message that New York is unfriendly to crypto and blockchain companies. Such a message might make it difficult for Adams to push New York City as the crypto capital of the world, they said. “It’s a bad signal,” said John Olsen, New York state lead for the Blockchain Association, on the proposed moratorium. When asked about whether he thought the move to regulate mining at the state level could harm Adams’ pitch to court cryptocurrency companies to come to New York City, Olsen said he thought it already had. – Annie McDonough

BY THE NUMBERS ERIC ADAMS’ LATEST BUDGET PROPOSAL By Annie McDonough After 116 days in office, New York City Mayor Eric Adams delivered a 54-minute State of the City address and a second budget proposal at the Kings Theatre in Brooklyn. Adams presented his $99.7 billion executive budget, marking a $1.2 billion increase from his initial proposal in February. In its response to the mayor’s initial budget proposal, the City Council called for roughly $1.3 billion in additional funding, with specific investments in social services that critics said lacked sufficient attention from Adams. His new budget plan addresses some of the council’s requests. In addressing the crowd of elected officials, local lawmakers, administration leaders and other invited guests, Adams suggested that he was fulfilling a lot of what people asked of him. “Let me tell you something, it’s going to be hard for people to hate me,” he said. A Q&A with Black Car Fund Executive Director

We’re there to take care of the drivers and we take that mission seriously.

Please discuss how the Black Car Fund came about and how it benefits independent black car drivers. The Black Car Fund is a not-for-profit that provides black car drivers who are independent contractors with workers’ compensation insurance. In a joint effort by the industry and Albany, (both) came up with a unique and, I believe, innovative model where a nominal surcharge (would be) added to each ride. That has provided (extra) revenue (for) drivers, (who) would not have it otherwise as independent contractors. Please discuss how the fund went beyond

providing just workers’ compensation. Over the years, we’ve also been able to expand the benefits that we offer drivers. For example, we pay them to take certain classes, such as the New York City (Taxi and Limousine Commission) required enhanced defensive driving class, where drivers are given $300. This includes transportation network companies, Uber and Lyft drivers. We also offer a wellness program, handsonly CPR, opportunities to learn additional safety tips about sharing the road with pedestrians and cyclists, and even health tips for drivers, which covers nutrition, stretching

and other tips relevant for someone that may be seated for long periods of time. Drivers also learn how to respond to Amber Alerts. They receive $150 for taking that class. Outside of program offerings, drivers also get dental, vision, and telemedicine plans, as well as support for mental health and wellness. Some of the newer benefits, including dental exams, cleanings and vision coverage, will end under legislation that expires at the end of this year. You’ve been lobbying to have a renewal of the benefits in place before the end of this legislative session.

What specifically are the benefit extensions you’d like to see? We would like to see an extension for three years or more. Potentially, we would also like to take out the sunset provision permanently. How did the Black Car Fund survive during the slowdown in ridership during the pandemic? From a benefits perspective, it was a nonfactor. Even though we had a drastic reduction in revenue, there was also a commensurate reduction in the number of claims we were receiving. From the Black Car Fund perspective, we got through it.

Early on, we distributed about 20,000 personal protective equipment kits to the drivers, especially the ones doing meal deliveries or people that were shut in their homes. Later on during the omicron surge, we purchased approximately 3,500 test kits and distributed them to drivers, primarily at John F. Kennedy and LaGuardia airports, but we also sent shipments up to Buffalo and to other Uber and Lyft drivers outside of New York City as well. New York’s highest court shatters the new district maps Elections for Congress and state Senate are thrown into disarray. By Jeff Coltin and Rebecca C. Lewis

T

HE LONG REDISTRICTING saga in New York will only continue, as the state Court of Appeals upheld a lower court ruling that deemed newly drawn state Senate and congressional maps unconstitutional. The decision immediately rocked the state’s political world, but it will have massive impacts on the average voter as well. New Yorkers will find themselves in new districts (again), and they will need to keep track of changing primary dates. In a 4-3 decision, New York’s highest court concluded that the state Legislature

did not have the constitutional authority to draw the maps at all – independent of the gerrymandering question – so it tossed the state Senate and congressional lines on procedural grounds. But the Assembly map will stay in place because it was never named in the lawsuit, so the court couldn’t make a decision about it despite its view that lawmakers had no right to draw the maps. So now, an independent expert will help redraw two of the three new sets of legislative lines for this year’s elections. If redrawing the maps for a June 28 primary date sounds impossible, that’s because it probably is. As part of its decision, the Court of Appeals said that the primary elections for state Senate and Congress will be delayed, possibly until Aug. 23, but left it up to the state Board of Elections to figure out the details. Every other primary – for Assembly, U.S. Senate, governor and lieutenant governor, and lower level offices such as district leader – is still expected to take place on June 28 as originally scheduled. That means New York will briefly return to its old model of bifurcated primary elections, a practice the state only recently abolished when it consolidated the congressional and state primaries in 2019. Previously, primaries for state office occurred in September, while those for Congress took place in June. “The court’s

right that the state had a bifurcated process in the past, but that stunk,” said Blair Horner, executive director of the government watchdog New York Public Interest Research Group. “The good news is we’ll get better lines, the bad news is that it’s going to be painful to keep track of what’s going on.” And don’t expect a push from the state Legislature and the governor to move primary day and consolidate the elections. There could be legal challenges, and it probably wouldn’t be helpful for the governor, who is facing primary challenges

They want a nice short campaign,” said a former state legislator who asked for anonymity to discuss former colleagues. “They start out with the name recognition and the money.” It would be logical to simply combine the primaries, the source conceded, “but logic doesn’t always hold in Albany.” The court reasoned that given the state’s history with holding primaries on different days, state election officials could handle this sudden change in the political calendar. A spokesperson for

the state Board of Elections did not immediately return a request for comment and immediate details about what the new political calendar might look like remained scarce. New draft maps are due by May 16, with the state Supreme Court – rather than lawmakers – responsible for approving them. The ruling is also shaking up just about every congressional and state Senate campaign in the state. Incumbents whose districts did not change much in the last round of redistricting will now have another stressful waiting period to see if the

new lines leave them with a radically different constituency. Insurgents taking on incumbents may have to change their game plans, or decide if they still want to run at all. And every congressional and state Senate candidate will likely have two more months to campaign. “RIP to NY Campaign Staffers summer plans,” tweeted Chris Walsh, the former campaign manager for state Sen. Alessandra Biaggi’s congressional campaign. “What I’m telling my clients is to stay cool but to start preparing for an August primary,” said Camille Rivera, a political consultant with New Deal Strategies, who is working with multiple candidates this election cycle. That later date could be a good thing for candidates with lower name recognition, Rivera said, who would have more time to introduce themselves to voters. But there’s no doubt the court’s decision has flipped New York politics on its head. “Chaos ensues,” Horner said, summing up the situation. “The court’s decision will lead to chaos.” The best comparison Rivera said was when Letitia James announced she wouldn’t be running for governor after all, and all the potential candidates who wanted to become state attorney general dropped out of the race in short order. “Literally 30 campaigns didn’t have one anymore!” she joked. The candidates for which the ruling means the most may be those running in the newly created state Senate districts in New York City. Reflecting population shifts in the state, the Legislature’s redistricting plan created a new District 27 in southern Brooklyn, and a new District 17 in northern Brooklyn and southwestern Queens. Iwen Chu, a former Assembly staffer, was uncontested in the Democratic primary for the new Asian American plurality District 27 and was well on her way to becoming a state senator. There’s no telling if the new district lines will create a similar district where Chu could run. She declined to comment. Kristen Gonzalez is facing a similar situation if the Ridgewood, Queens-centered district she was planning to run in gets erased. “We’re still processing what this means for the race and for our volunteers,” Gonzalez’s communications director Andrea Guinn said of the ruling. Will she keep running for office? “We haven’t even gotten that far in the discussion,” Guinn said, but adding that she expected the campaign would continue talking to voters while awaiting the new lines. “I’m quite shocked.

The man with the golden pen Meet Jonathan Cervas, the expert who will redraw New York’s district lines By Rebecca C. Lewis

W

ITH NEW YORK’S congressional and state Senate maps tossed out by the state Court of Appeals, all eyes now turn to one man: Jonathan Cervas, who is tasked with drawing new lines. A state Supreme Court judge appointed Cervas as a neutral special master to submit new maps for court approval should the need arise. It was a preemptive move before an intermediate court had even heard arguments for an appeal, but ultimately a warranted one as Cervas can immediately begin his work to offer new draft maps to the court by the May 16 deadline. If reading Cervas’ name has left you scratching your head, you’re not alone. He is not a well-known politician, a pundit who offers opinions on cable news or a famous attorney who hosts a podcast. In fact, he’s not even from New York. But Cervas has lots of experience cleaning up redistricting messes, a doctorate in political science and has done extensive research on reapportionment. As he goes about his new task of evaluating the state Senate and congressional maps in order to create new ones, here are four things to know about the man entrust-

ed with drawing lines that could impact the national balance of Congress. THIS IS NOT CERVAS’ FIRST RODEO Cervas most recently served as a consultant for the Pennsylvania Legislative Reapportionment Commission, tasked with redistricting in his home state. The maps he helped draw had bipartisan approval, with four out of the five commission members representing both Democrats and Republicans voting in favor of the lines he helped create. And when the maps headed to the Pennsylvania Supreme Court for final approval, the court backed them unanimously – a rarity in a state where the courts often split along party lines. Cervas received praise for his work in Pennsylvania, with commission Chair Mark Nordenberg telling Spectrum News that he is “smart, well-educated, experienced, knows the law and really is committed to basic fairness under the law.” BUT CERVAS IS FLYING SOLO FOR THE FIRST TIME Although he comes in with extensive experience and credentials, this is Cervas’ first time serving as a court-appointed special master. In the past, he worked as an assis-

tant to a special master in three different cases that required judicial remediation. The first was in 2017 in Utah, the second a year later in Virginia, where he helped to redraw a quarter of the state’s House of Delegates district lines, and most recently in Georgia in a case involving school districts that garnered national attention. This time around, Cervas will act as the special master himself, taking charge of the map drawing process. CERVAS LIVES AND BREATHES REDISTRICTING Cervas has both an undergraduate degree and doctorate in political science, the latter of which he earned in 2020. He wrote his dissertation on the Electoral College, exploring both its history and its consequences. Cervas is also a specialist in mapping technology, which will be a helpful tool in evaluating the fairness of legislative maps and assessing the influence of potential gerrymandering. Until relatively recently, he worked as a research associate for the Princeton Gerrymandering Project, which is dedicated to ensuring fair representation during redistricting. And now, when he isn’t helping courts and states with re-

districting, Cervas is a postdoctoral fellow at the Institute for Politics and Strategy at Carnegie Mellon University. Last year, he recorded a 14-minute video in which he explained “13 keys to understanding contemporary U.S. politics.” HE THINKS DONALD TRUMP SHOULD SUPPORT RANKED-CHOICE VOTING Cervas has published several academic papers relating to redistricting, democracy and the Electoral College. But one paper entitled, “Why Donald Trump Should be a Fervent Advocate of Using RankedChoice Voting in 2024,” would catch the eye of any ranked-choice voting enthusiast, particularly in New York City, which just implemented its first elections with the system last year. He makes the case, with co-author Bernard Grofman, that Trump could have won more states had the country implemented ranked-choice voting in the 2020 presidential election due to votes likely drawn away by the Libertarian candidate. Why? To show that ranked-choice voting is not just something that would benefit Democrats. Not related to redistricting, but both interesting and a testament to Cervas’ nonpartisan mindset.

Vice President Kamala Harris is the first Asian American (as well as the first woman and the first Black person) to occupy her post. A record number of Asian Americans serve in Congress. And while Andrew Yang fell short in his campaign to become New York City’s first Asian American mayor, politicians in other major U.S. cities reached that milestone, including in Boston and Cincinnati. An unprecedented six Asian Americans were sworn in as New York City Council members this year, following several “firsts” in the state Legislature in recent years – the first Asian Americans in the state Senate, the first South Asians in the Assembly, the first Asian American elected from upstate New York. Yet, even in New York, known for its large – and growing –

Asian American population, representation lags. Nearly 1 in 10 New Yorkers are Asian, yet Rep. Grace Meng is the sole Asian American in the state’s 29-member congressional delegation. In the state Legislature, Asian Americans hold just seven out of 213 seats. Even after impressive gains, Asian American New York City Council members constitute 12% of the 51-member body, below their 14.3% share of the city’s population. At a time when anti-Asian hate is on the rise, securing greater sway in government is a key objective. Taiwanese and Hong Kong immigrants broke through a generation ago. Other groups are now making progress. By Jasmine Sheena

O

N MARCH 31, 1996, an actuary named John Liu was taking the subway to work when he read something that changed his life. A story he was reading in The New York Times that described the discomfort that some longtime Flushing, Queens, residents felt about the growing local Asian American population. Julia Harrison, Liu’s representative on the New York City Council at the time, assailed the influx of immigrants in the neighborhood as “an invasion, not an assimilation.” The article galvanized Liu to run for office. He mounted an unsuccessful challenge against Harrison in 1997, then won the seat four years later when the longtime incumbent stepped down due to term limits. Liu, who is Taiwanese American, became the first Asian American to serve in the New York City Council. After two terms, he went on to be the first Asian American to serve in a citywide

post as comptroller. Liu, whose groundbreaking career in city and state politics paved the way for other Asian American politicians in the first decade of the 2000s, was elected to the state Senate in 2018, just as a new group of Asian Americans began winning legislative seats in Albany and New York City. While the first waves were made up primarily of politicians who are Taiwanese American or originally from Hong Kong, more recent breakthroughs reflect the fuller diversity of the Asian American community, including immigrant groups that arrived later in the U.S. Following on Liu’s heels were two other trailblazing Taiwanese Americans. One was Jimmy Meng, who became the first Asian American in the state Legislature when he assumed office in the Assembly in 2005. Meng’s daughter, Grace Meng, also served in the Assembly before becoming New York’s first Asian American woman elected to Congress in 2012. In 2009, Margaret Chin and Peter Koo, who emigrated from Hong Kong in the 1960s and early 1970s, were elected to the New York City Council. The first major waves of immigrants from Taiwan and Hong Kong in the past century began arriving in the U.S. in the 1960s. For the first generation, the overarching priority was often to find work and put down roots in the United States. Only after some time, typically in the second or third generation, do members of an immigrant community become more politically involved.

“Even for Korean Americans, we came earlier but not as early as some of the diasporas in the Chinese and Taiwanese communities,” said New York City Council Member Linda Lee, who made history this year as the first Korean American woman to serve in the legislative body. “When you’re coming over as an immigrant, you’re just thinking in survival mode, and you’re thinking about how to set up shop and provide for your family. Once you become a little bit more established, that’s when people begin to sort of look upwards, and they start seeing around them how important it is to have that political voice and power to help out the community.” While New York elected its first Korean American, Assembly Member Ron Kim, nearly a decade ago, South Asian Americans have won legislative seats in the state for the first time only in recent years – likely due in part to the fact that South Asian immigration particularly flourished slightly later, from the 1970s forward. Kevin Thomas, a Long Islander who is Indian American, joined Liu as the first Asian Americans in the state Senate in 2019. In 2020, voters elected Jeremy Cooney, an orphan adopted from Kolkata, India, who grew up in Rochester, to the state Senate, making him the first South Asian person elected to state office from upstate New York. Voters also elected in 2020 Assembly Members Zohran Mamdani, an Indian Ugandan man who came to New York City as a child, and Jenifer Rajkumar, an Indian woman who grew up in Queens.

This past election cycle, a record six Asian Americans won contests for the New York City Council, including Shekar Krishnan, an Indian American man, and Shahana Hanif, a Bangladeshi American and the first Muslim woman to win a seat in the legislative body. Despite the recent gains, Susan Kang, an associate professor at John Jay College of Criminal Justice, said that Asian Americans as a whole are still catching up with other racial and ethnic groups that are more well established in New York’s political sphere. “Asian Americans in New York City and New York state entered into political representation later than other groups like the Latinx community. We’re a bit later entering,” she said. “That could be for a number of reasons, like our

immigration patterns are more recent. After basically overturning the Chinese Exclusion Act and the reforms to immigration, people like my parents were able to come over. There’s more representation on the West Coast than compared to the East Coast because there’s greater populations there too.” Political consultant Neal Kwatra said South Asians have to continue to build on their noteworthy successes. “Other communities have done that work of cultivating and bringing forward candidates and organizing their communities very effectively,” Kwatra said. “I think it’s great that the South Asian community is beginning to coalesce, but I do think like any community, there are challenges even within the South Asian community. It’s not a monolith. Bangladeshis and

Pakistanis and Indians don’t always agree on the same thing.” Other obstacles loom, notably redistricting and the need to cultivate political leaders and address the unique issues different Asian American communities face. The state Legislature’s redistricting plan that was just thrown out would have created some new districts built around specific Asian American communities. But critics argued the plan would have proven detrimental to future South Asian American candidates as certain neighborhoods with strong South Asian populations, such as Flushing, Richmond Hill and South Ozone Park, would have been split up. Often, Asian American communities have long been represented by entrenched white politicians who may not

have a strong grasp on the issues or needs of the people they represent. Only recently have Asian American voters seen more candidates with a shared background run for office and have a meaningful chance at winning. Political consultant Trip Yang observed that the new generation of Asian American candidates are winning support not just among members of an immigrant enclave but with the larger public. “There was this type of discourse politically that Asian Americans can only represent Asian Americans,” Yang said. “What we’ve seen with the success of the recent class of Asian American elections is that’s simply not true. Asian Americans are able to communicate and build trust across different communities and build various multiracial coalitions.”
