he Greater Houston Black Chamber (GHBC) held its 27th Annual Pinnacle Awards, Saturday, October 23, 2021, where several of Houston’s best and most promising black-owned businesses received high honors. The GHBC Pinnacle Award recognizes leading African-American entrepreneurs for their success in business and their positive impact on the communities and industries they serve. This year’s theme was Excellence Has Arrived: Black Businesses Take the Lead. The virtual production opened with a stellar performance by popular Houston-based Se7en the Poet and included well wishes from political leaders including Houston Mayor Sylvester Turner, Harris County Judge Lina Hidalgo and Missouri City Mayor Robin Elackatt. Congresswoman Sheila Jackson Lee and Congressman Al Green also made remarks. Songstress Mary Griffin gave a rousing rendition of Aretha Franklin’s “Rock Steady,” and CBS Sports anchor James Brown and Nate Burleson of CBS Mornings both made a cameo appearance during the awards pre-show online. Each year, five Pinnacle Awards, one Upstart Award and one Rising Star are handed out to some of the most successful small businesses. DMARS: In addition to having expertise, knowledge, and education, what other special elements do you possess that make you a successful family law attorney? CURVEY: The additional special qualities that I possess that make me a successful family law attorney are my ability to empathize with my clients, see things from their perspective, and be a partner who strategizes with them to help them prevail. DMARS: Family law is an emotional area of law. How do you remain professional and compassionate, without allowing emotion to lead you in how you handle cases? CURVEY: When I work with a client, I compartmentalize my feelings. Business and personal feelings never mix. Like a prize fighter, I must stay in control of my emotions or my opponent can use that weakness to overtake me. I always have the best chance of winning a case for my client when I remain in control of my emotions, know the applicable law, and apply the law liberally to the facts of the case. DMARS: Talk about mediation vs. court, pros and cons of each, and how you determine which is best for a particular case. CURVEY: Mediation is a client’s last chance to maintain control of their case. They have the power to craft creative decisions for them and their family that generally would not happen in a court of law. If mediation fails, you move on to trial where an expert in that area makes a final decision about your life and the lives of your children. Taking a case to court vs. mediation depends on the facts of the case. In my experience, I have seen that you generally get the best results when you work out problems in mediation. DMARS: What is your main advice to clients before going to court or mediation? CURVEY: There is no happily ever after in family law. No matter how happy one side may be, there will always be another side that will grieve the loss of a relationship, a child, or even someone’s life. I am a spiritual person and rely heavily on my religious beliefs to counsel clients through tough times. I always advise my clients that they won’t walk out of court or mediation with everything on their wish list. I generally have them write down their top 5 items they want from the resolution of the case. The other things they have on their list are just extras that they can live without. This is pretty difficult for most clients because they want everything on the list. However, helping them to focus on the most pertinent items gives them the ability to negotiate and let go of the things that don’t really matter.

DMARS: Without breaking confidentiality, can you share a client’s memorable case and positive outcome? CURVEY: I once had a family who wanted to adopt a baby boy. During the pendency of the case, the family had taken a road trip to Austin in two separate cars. On the way home, the father’s car was struck by a pick up truck while the wife and adoptive baby watched on from the other car. From the backseat, the child began to wave and say, “Bye Daddy.” The father was killed instantly. She and I liked to imagine that the baby saw the dad’s spirit leave his body. Now, during these times, it was frowned upon for single people to adopt. The mother worried that due to her husband’s death, that would prevent her from adopting. But a provision in the code allowed the child to still be considered as the adoptive son of the father and mother, despite his death. DMARS: Talk about your mentorship program for young attorneys and the success of the program. CURVEY: I have so many young attorneys, or as I call them, “baby attorneys,” who call me “Auntie,” coming to me for advice. Whenever I meet a newly licensed attorney, especially one from Thurgood Marshall School of Law, where I received my Doctor of Jurisprudence, I give them my information and offer to take them to lunch. We talk about their chosen area of law and how I can be of assistance to them. These young people call and text me whenever they need advice, and I always do my best to respond quickly. In addition, I take them with me to court hearings and mediations, so that they gain useful experience to successfully practice law. DMARS: You reference Thurgood Marshall when addressing your goals as an attorney. How has his path in the legal profession been a guiding light in how you practice law? CURVEY: Law school, for some, has been an unattainable goal. But thanks to the bravery of people like Heman Sweatt, the first black person to be accepted to UT Law, but segregated into a room the size of a broom closet, Thurgood Marshall School of Law was built (originally called Texas State University for Negroes). I urge people to read Sweatt v. Painter, a landmark case on separate but equal laws in education that was argued by none other than Thurgood Marshall. Having a history like this to stand on makes me proud of the people from whom I descend. When I begin a difficult case where the odds seem to be against me, I think of the resilience Sweatt showed and the intellect and legal prowess that Marshall possessed, and I know that those same characteristics dwell in me. From there, I grab my sword (my Family Law Code book) and begin to fight.

DMARS: Your practice has many services, but talk specifically about your mistaken paternity cases, as we don’t hear much about these types of cases. CURVEY: Mistaken paternity is one of my favorite areas of law. In fact, I used to have an ad that read, “If your kid is starting to look like the milkman, don’t get milked by child support! Call The Banieh Law Firm. We can help.’’ This law comes into effect after a man has claimed paternity without DNA testing and later learns the child is not his. So long as he files a Mistaken Paternity claim within 2 years of learning the child may not be his, then he can be absolved of all duties given to him through his paternity claim. The only downside is that the law does not absolve the gentleman from paying past due child support or from getting any money back for the years he paid.

DMARS: Talk about your run for Judge of the 280th Judicial District Court of Harris County, Texas. CURVEY: This is a Protective Order Court where lives are always in jeopardy. With over 16 years of actual legal experience in family law, I know that I am equipped to read, apply, and distribute the law as the Family Code deems appropriate. To me, a Protective Order is more than a piece of paper. I have a deep understanding that for most, this order is the key to a violent-free life where they can find safety in the law and avoid physical and psychological torment from their abuser. My campaign message to the voter is, “Vote Curvey for Judge because I am Fair, Balanced, and Competent.”

f you are employed in the US, it's more likely than not that you worked remotely this past year. 52% of Americans have done part or all of their jobs from home during the pandemic. That's even more than the number of Americans with a college degree. Over time, we've perfected some aspects of remote and hybrid working - from comfortable chairs to Zoom happy hours. But there's one thing that remains a major problem for most people: cybersecurity.

And the attacks haven't simply grown in amount - they're more costly, too. The average cost of a data breach rose by 10% to a staggering $4.24 million. Why? Because employees aren't following cyber standards and best practices. For instance, the vast majority of employees are using work devices for personal tasks and personal devices for work. Some of you might even be thinking, "What's wrong with that?" Now, more than ever, we all need to take cybersecurity seriously. "Cybersecurity is a top priority because our clients entrust us with their sensitive information and personal finances," says Bashar Abouseido, Managing Director and Chief Information Security Officer at Charles Schwab. "We make it everyone's business. We train every employee on best practices so that our clients can rest assured that their money, investments and financial futures are safe."

• It impacts the employee. Not only can hackers unlawfully access company data through employees, but personal data can also be compromised. From social media accounts to personal finances, sensitive information becomes vulnerable without proper safeguards in place. • It impacts the client. It takes a lot of trust to put your own data in someone else's hands. Sometimes, the stakes are incredibly high. Financial services companies, for instance, are entrusted with everything from employment information and income to Social Security numbers and retirement savings.

What's Here are four ways remote employees can protect themselves, their clients and the companies they work for: • Don't mix business and personal devices: Using personal devices for work-related activities can easily put company data at risk if there is a breach. And that goes both ways: If the company is hacked, personal data may also be stolen. • Avoid public Wi-Fi: It's great when you don't need a password to connect to the internet at your local coffee shop or airport, right? Hackers agree! Public Wi-Fi networks are inherently insecure, and that means it's best to avoid them if at all possible. • Get a virtual private network (VPN): These networks provide encrypted connections, ensuring that sensitive information is safely transmitted. • Use multi-factor authentication (MFA): When transmitting sensitive information over the internet, look for websites that ask you to verify your identity by receiving an email, text or call. Microsoft recently found that MFA prevents an astonishing 99.9% of all cyberattacks.

he U.S. Department of Education recently announced an overhaul of the Public Service Loan Forgiveness (PSLF) Program. Education Department officials said they would implement the overhaul over the next year and make the program live up to its promise. According to a news release, the policy will result in 22,000 borrowers who have consolidated loans – including previously ineligible loans – being immediately eligible for $1.74 billion in forgiveness without the need for further action on their part. Another 27,000 borrowers could potentially qualify for an additional $2.82 billion in forgiveness if they certify additional periods of employment. In total, the Department estimates that over 550,000 borrowers who have previously consolidated will see an increase in qualifying payments with the average borrower receiving another two years of progress toward forgiveness. Many more will also see progress as borrowers consolidate into the Direct Loan program and apply for PSLF, and as the Department rolls out other changes in the weeks and months ahead, officials stated.

“Borrowers who devote a decade of their lives to public service should be able to rely on the promise of Public Service Loan Forgiveness,” U.S. Education Secretary Miguel Cardona stated in the news release. “The system has not delivered on that promise to date, but that is about to change for many borrowers who have served their communities and their country,” Cardona continued. “Teachers, nurses, first responders, servicemembers, and so many public service workers have had our back especially amid the challenges of the pandemic. Ways to Focus on Fitness, No Matter the Season

any Americans may be rededicating themselves to getting outside and focusing on their fitness. This may be especially important after so much time spent inside due to the COVID-19 pandemic, which contributed to unwanted weight gain for 61% of Americans.

"Whether you are ready to return to public fitness centers or are pursuing an at-home workout routine, the same priorities may remain key: daily exercise, proper nutrition and sufficient sleep," said Dr. Donna O'Shea, chief medical officer of population health, UnitedHealthcare. To help with those efforts, here are three strategies to consider to help make health a priority year-round. Round out your home workout routine. While public gyms and group exercise classes may have appeal for many people, working out at home may have several advantages. At-home exercise is typically less expensive than a gym membership, which may also help improve your financial fitness. Exercising at home may provide greater flexibility and convenience when incorporating a workout into a daily routine, while offering a more private experience. he holidays are an opportunity to spend time with your family and friends and enjoy food and fellowship. However, there are some individuals who spend the holidays alone as they may not have a close network of family and friends. These individuals spending the holidays alone may encounter bouts of depression they may not experience during other times of the year. This type of depression is identified as seasonal affective disorder (SAD), which is a recurring form of depression that occurs during the changes in seasons, usually beginning in late fall and continuing into the winter months. SAD (also called winter blues) depression typically subsides in the spring or early summer, which is usually a period of exuberance and energy. According to the Diagnostic and Statistical Manual of Mental Disorders (DSM-5)[1], SAD is classified as a major depressive disorder with seasonal pattern, which is a subtype of depression that consists of mood changes linked to seasonal changes. The diagnostic specifier “with seasonal pattern” can describe a seasonal pattern of symptoms in both major depressive disorder and bipolar disorder. While men are not exempt from experiencing this form of depression, women are four times more likely to experience SAD and the age of onset is estimated to be between 18 and 30 years[2]. SAD is prevalent amongst individuals already experiencing social isolation, have minimal exposure to (sun) light, financial stress, working during the holidays and unable to spend time with family and friends, substance abuse, and other mental health disorders. Some of the signs and symptoms include feeling depressed most of the day nearly every day, fatigue and decreased motivation, disruptive sleep patterns, increased/ decreased appetite, hopelessness, and occasionally passive or active suicidal ideation. While all symptoms may not subside, some of the following treatments may be helpful: •  Regular exposure to bright light,

preferably sunlight during the fall and winter months. •  Selective serotonin reuptake inhibitor (SSRI) antidepressants increase serotonin which is involved in regulating mood, sleep cycles, hormonal activity, cognition, and metabolism. •  Talk therapy to discuss feelings and emotions affected during this period. •  Initiating or increasing social connections with friends and family, avoiding social isolation.

fizer and BioNTech officials have confirmed that they have approached federal regulators to authorize emergency use of their coronavirus vaccine for children ages 5 to 11. It’s estimated that more than 28 million children would become eligible if the request meets approval. With school re-openings contributing to an uptick in Covid-19 diagnosis, many have expressed a desire for vaccines for children. “Over the past nine months, hundreds of millions of people ages 12 and older from around the world have received our COVID-19 vaccine,” Albert Bourla, Pfizer’s Chairman and Chief Executive Officer, said last month after a clinical trial reportedly found that the Covid-19 vaccine was safe and generated a “robust antibody response” in children ages 5 to 11. The September study counted as the first such results released for that age group for a US Covid-19 vaccine. “We are eager to extend the protection afforded by the vaccine to this younger population, subject to regulator y authorization, especially as we track the spread of the stantial threat Delta variant and the subit poses to children,” Bourla said. “Since July, pediatric cases of COVID-19 have risen by about 240 percent in the U.S. – underscoring the public health need for vaccination. These trial results provide a strong foundation for seeking authorization of our vaccine for children 5 to 11 years old, and we plan to submit them to the FDA and other regulators with urgency.”

Wake up everybody! It’s time to celebrate the success of those in the past and now in the present who represent brave Black men and women who are rewriting the scripts, illustrating that Black people can – and are creating wealth. We must channel our consumer buying power of $1.4 trillion to create the new Black Wall Street. Now is a great opportunity for us to embrace what Tulsa’s Black Wall Street symbolized: Black excellence; the power of community; and, the importance of unity. Ever since the death of George Floyd, we are realizing that we have to fight for social justice, but we also have to do what our predecessors did in Tulsa: They created a blueprint for wealth creation within our community. BankGreenwood.com reports that a dollar circulates six hours in the Black community, 20 days in the Jewish community and 30 days in the Asian community. According to a study by the American Journal of Economics and Sociology, “If 1,200 median priced houses in Tulsa were destroyed today, the loss would be around $150 million. The additional loss of other assets, including cash, personal belongings, and commercial property, might bring the total to over $200 million.” What’s maddening is that this demonstrates the level of oppression faced, and the intention to upholding white supremacy. Despite on-going efforts by the family members of those loved ones lost, they have repeatedly denied their claims for reparations. This gives us greater urgency for us to take control of our own destinies and move from words to actions to understand these three valuable lessons that we can apply today: 1) We must create wealth within the Black community; 2) We must buy black; and, 3) We must create safe spaces/communities where majority of commerce is Black-owned. The pandemic has only highlighted the tremendous racial wealth gaps in this country. For Blacks, the median annual wage is nearly $10,000 more than White

employees, a recent McKinsey study reported. The study goes on to show how Blacks are more likely to get hired in traditionally lower-paying jobs that prevent us from ever gaining the wealth we deserve even though we put in hours to get the jobs done. The tragedies of the past year have fueled a new energy in buying Black. #BlackWallStreet, #BuyBlack and #BankBlack are trending. WeBuyBlack.com has become one of the largest online marketplaces for Black-owned businesses. The Official Black Wall Street app offers another invaluable tool for Black-owned businesses and consumers. That’s all good, but ultimately, it’s all about ownership and equity. It’s not just about access. It's about actual ownership of businesses. The ability to create jobs through entrepreneurship and share resources crafted for us, and by us. While information is information, our experiences are unique and require the context and/or experience of people of our ethnic backgrounds. What the new Black Wall Street needs is a community that combines culture and group economics so we can collectively accumulate wealth. We need commerce where Blacks can spend money and those dollars circulate within the Black community around the world so they can do business with other blacks seamlessly. We need technology, creating social networks for-us-buy-us and those that allow us to access blockchain. ydia Pope counts among the fortunate, and she knows that. Pope also doesn’t pull any punches when advocating for African Americans – particularly as it pertains to generational wealth. Her father worked throughout Cleveland, Ohio, to help turn around the lives of gang members. Pope’s mother worked a lunch program that fed those individuals after her father tutored them about the importance of homeownership and generational wealth. “My father passed away in 1991, and my mom told me that we were the second Black family to move onto our block when I was younger,” Pope, the president of the National Association of Real Estate Brokers (NAREB), said during an interview inside the television studio of the National Newspaper Publishers Association (NNPA) in Washington, D.C. “My mother told me about the real estate card she possessed that prompted her to own a home,” Pope reminisced during a conversation with NNPA President and CEO Dr. Benjamin F. Chavis, Jr. The entire conversation will air this season on PBS-TV and PBS-World during a telecast of The Chavis Chronicles. Today, Pope’s brother owns the

family’s Cleveland home, which she said will eventually pass to his son.

Understanding How Homeowners Associations (HOAs) Work By Marla Lewis President of the Houston Black Real Estate Association

I

f you plan to buy a home or condominium this year, keep in mind that the property may be governed by a homeowners association, or HOA. More than 63 million people live within communities that are overseen by HOAs, according to the Community Associations Institute. That means 24 percent of U.S. homes are part of community associations. Many buyers appreciate the benefits provided by HOAs, but the mandatory dues and covenants, conditions and restrictions (CCRs) occasionally rub some people the wrong way. Before you make an offer on a property governed by an HOA, here are some factors to consider.

Whatdo doyou youget getfrom fromthe theHOA? HOA? What Homeowners associations often provide access to amenities that individual residents couldn't otherwise afford – pools, gyms, tennis courts, walking trails – and their rules can protect property values. Some associations also take on services traditionally provided by government, such as trash pickup, landscaping, street lighting and street and sidewalk maintenance. Your perfect condo may have a great

pool or your dream home might be sitting on the first tee, but remember that those things are only part of the HOA's scope. When you purchase a property governed by an HOA, you enter into a legal contract with the association. You agree to abide by the association's regulations and pay its dues. In exchange, you get a community guided by an HOA and the access to its facilities and perks.

Readbefore beforeyou youbuy buy Read Make sure that any uses or freedoms you expect to come along with your property are allowed in the Covenants, Conditions & Restrictions (CCRs). Want to store your boat trailer in your driveway? The association's CCR s may not allow that. Want to paint the house? Some HOA s have restrictions on permissible colors, so check the palette allowed by the association. You may have heard horror stories of home repossessions and other legal squabbles involving property owners and HOAs. A common theme among many of these

cases is homeowners not understanding the regulations or ignoring them. Review the CCRs carefully before you purchase the property and you'll be much less likely to run afoul of your HOA.

Inquireabout aboutdues dues Inquire HOAs run on dues, your annual fee for living in the community. These fees can range from $100 to thousands of dollars, depending on the neighborhood or building and what amenities it offers. Ask how much the dues are and if they've increased during the past few years. Find out what the dues cover and what they don't. For example, your condo association may p e r f or m a l l exterior maintenance. That means when the roof leaks, your dues pay for its repair, even if you live on the ground floor of a three-story building. If you live on that third floor, however, you don't have to pay to repair the entire roof yourself. If the association manages a pool, you're paying for it, even if you can't swim and never use the amenity.

Who's Who’sinincharge? charge? When you review an HOA's documents, be sure to inquire about its finances. Is the HOA solvent? Does it have a reserve fund? Who controls the money? What kind of oversight is that person subject to? Find out who manages the HOA and what role residents have in its governance. There may be a board or other group of property owners who manage the association. Take some time and talk to people who currently live in the community. How do they feel about the neighborhood, development or building? Find out their impressions of how the HOA is run. Perform due diligence before signing a contract to purchase a property governed by a homeowners association. You will be able to make an informed decision about the HOA's pros and cons, as well as your responsibilities, without jeopardizing the transaction or subjecting yourself to regulations that aren't consistent with your lifestyle. Most Americans point to curbside restaurant service (46%) and grocery pickup (45%) as the pandemic-driven services they would most like to see stay. Entertainmentbased outings are still at lower levels, too, the survey found. Dependence on car travel is growing One in five (19%) Americans bought a new - or used - car because of the pandemic. This emphasizes another trend the latest research unveiled: a steadily growing dependence on vehicular transportation. Understandably, the pandemic changed the way many viewed highly crowded mass transit options. And while air, train and public transportation seems to be quickly gaining steam again, most (78%) Americans still rank automobiles as the mode of transportation they are most likely to use through the end of the summer. That includes using cars for travel, too. Seventy percent of those planning travel anticipate using a car as their primary method of getting to their destination. flexibility (49%), an added feeling of safety over other forms of transportation (45%), in addition to general preference (47%).

However, car maintenance skills still need some tuning up Despite this increased dependence on cars and road travel, the survey found that while many Americans have the equipment to handle an on-the-road emergency, they don't necessarily know how to use it. For example, two-thirds (64%) of drivers own a tire jack, but 20% don't know how to change a tire. However, it is promising that most people (77%) owned their car maintenance tools prior to the onset of the pandemic. Perhaps the next evolution of Americans' relationship with vehicles will be ensuring they're kept in tip-top shape, for whatever the road ahead may bring.
