Legislators respond to dive boat disaster with safety bill By Parimal M. Rohit WASHINGTON, D.C. — Three Democratic legislators who represent California in Washington, D.C., introduced a bill, on Dec. 12, to establish stricter safety measures for small passenger vessels. Sen. Dianne Feinstein and Reps. Salud Carbajal and Julia Brownley brought the bill, called the Small Passenger Vessel Safety Act, to Capitol Hill. Feinstein, Carbajal and Brownley introduced the proposal in light of the Conception dive boat fire on Labor Day; the tragedy, which claimed 34 lives, happened at Santa Cruz Island, which is part of the Channel Islands network near Ventura and Santa Barbara counties. The Conception fire could have been prevented had certain safety measures been implemented, Feinstein said in a released statement. “We must ensure that small passenger vessels have the right safety measures in place to prevent disasters at sea,” Feinstein said. “This bill addresses the specific conditions that are being investigated as causes of the Conception fire, conditions that exist on hundreds of similar vessels in oper-

ation today. Congress should act on this bill before another tragedy strikes.” The Small Passenger Vessel Safety Act, if approved by Congress, would require small passenger vessels “to have no less than two means of escape to different parts of the vessel,” according to a statement released about the bill. The bill also proposes to mandate safety standards for how phones, cameras and other electronic devices with lithium ion batteries are handled and stored. Stricter standards for interconnected fire alarm systems would also be established by the Small Passenger Vessel Safety Act, should the bill as currently proposed become law. “Over the years, we have seen enough evidence from previous disasters and other investigations to know that the time to put safety first is long overdue,” Carbajal said, adding “updates to an outdated system” are much needed. The National Transportation Safety Board (NTSB) published an initial report on the Conception fire and found a few smoke alarms sounded below deck. The smoke alarms, however, were not connected throughout the vessel, so crewmembers above deck were not aware of the developing

emergency, according to Feinstein’s staff. “Many of the passengers are believed to have died from smoke inhalation in the bunkroom because flames were blocking an emergency exit,” Feinstein’s staff said in a released statement. The U.S. Coast Guard issued a Marine Safety Information Bulletin shortly after the Conception fire and advised boat operators to limit “unsupervised charging of lithium ion batteries and the uses of extension cords.” An investigative report by the Los Angeles Times, published in November, found NTSB recommendations to

prevent fires aboard boats similar to Conception were overlooked by the Coast Guard. Conception, a dive boat, had 39 people aboard during Labor Day weekend. The boat was anchored near Santa Cruz Island when it caught fire just after 3 a.m. on Sept. 2, killing 34 of the 39 people on board. The tragedy is considered one of the worst maritime disasters in California history. The 75-foot dive boat was built in 1981 and reportedly passed its safety inspections. A full report on the fire might not be available until 2021. The cause of the fire has not yet been determined.

Eagle bites off more than it can chew in battle between tentacles and talons VANCOUVER, British Columbia — A bald eagle and an octopus get into a fight, who wins? Thankfully this story ends with both animals alive. A video captured by staff of Mowi Canada West, a salmon aquaculture company in Canada’s westernmost province of British Columbia, shows a large octopus wrapped around a full-sized bald eagle on the surface of the water off the northwest tip of Vancouver Island. The video was posted on the company’s YouTube page. Several news outlets reported the group of salmon farmers heard screeching and splashing while on the way back to their floating house on

According to company leaders, recycling aluminum emits only five percent of the greenhouse gas emitted in primary aluminum production. The diecasting process that Mercury uses for these engine blocks won the 2018 Casting of the Year Award in the “Over 10 Pounds” category for the sophistication of the engine block design and the execution of the die casting. Mercury Marine and Evinrude were both also named Green Master companies by the WSBC. The Green Masters program works to identify businesses that have taken at least one action within each of the nine pillars of sustainability. Both companies are based in Wisconsin.

Famous SC coastal landmark Folly boat finally finds new home JAMES ISLAND, South Carolina (AP) — The Folly Boat, a South Carolina landmark, has finally found a new home along the road to one of the state’s most popular beaches more than two years after Hurricane Irma tried to sweep it away. Crews used a crane and flatbed truck in December to move the boat, an unofficial landmark famous for its hand painted messages, from the private marsh where it ended up after the 2017 hurricane to a bar called The Barrel on Folly Road. The Folly Boat first became famous in 1989 when Hurricane Hugo washed it up on the road to Folly Beach. Instead of moving it, residents and others started painting homemade messages of love, school spirit, politics and whatever else popped up. The boat was filled with 40,000 pounds of concrete and steel to keep it in place. But the strong waves and high water from Hurricane Irma washed it away even though the storm made landfall some 300 miles away in Florida. Bar owner Chad Reynolds said he was proud to be the boat’s new home. “It’s the Folly Boat,” Reynolds told The Post and Courier of Charleston. “It’s not my boat. It’s everybody’s that’s traveled here. So many people have painted that boat.”

how much oil was released. According to Ocean Conservancy, the well spewed 210 million gallons (795 million liters) of oil before it was capped 87 days later. A federal judge tasked with determining how much oil went into the Gulf of Mexico for purposes of levying penalties ruled that 4 million barrels of oil -168 million gallons - was released from the reservoir. Of that, 810,000 barrels of oil - 34 million gallons - was collected without touching the water and so 3.19 million barrels - nearly 134 million gallons - of oil were discharged into the Gulf. The judge said in his ruling that there was no precise way to know how much oil discharged into the Gulf. The open ocean recovery plan was drawn up by the National Oceanic and Atmospheric Administration with help from the U.S. Fish and Wildlife Service, National Park Service, Bureau of Land Management, U.S. Department of Agriculture and U.S. Environmental Protection Agency. The money is from BP’s $8.8 billion settlement for natural resources damage, said NOAA Deepwater Horizon program manager Rachel Sweeney. The projects, expected to run two to 15 years, were chosen from about 1,600 submitted by the public, non-governmental organizations, as well as local, state and federal agencies. The plan includes $126.2 million to study habitats in deep water and water between 100 feet and more than 490 feet, deep. The longest-running program would spend $5.7 million to create a sea turtle atlas indicating where and when species found in the Gulf would most likely be found, and how they use various habitats. It’s among six programs, totaling $18.9 million, for sea turtles. All five species found in the Gulf are threatened or endangered. About $22.9 million is dedicated to four programs to protect whales and dolphins. Another $57.7 million would protect fish, including $30 million for a program to distribute and promote devices that let deepsea fish released by anglers be returned gradually to the depths where they live.

Port of San Diego Adopts Resolution Urging Federal Action on Tijuana River Valley Pollution

NEW ORLEANS (AP) — Federal agencies have approved nearly $226 million for 18 projects to restore open ocean and marine habitats that were decimated in the Gulf of Mexico by the 2010 BP oil spill. The projects range from $52.6 million to study deep-sea habitats to $290,000 to find ways to keep sea turtles from swallowing or getting snagged on hooks or tangled in lines set out for miles along reefs. They are described in a 490-page report released this month. The nonprofit Ocean Conservancy said it’s “the world’s first plan to restore the open ocean and deep-sea environment from a major oil disaster.” “Ocean Conservancy welcomes this major conservation milestone for the Gulf of Mexico,” CEO Janis Searles Jones said in a news release. The explosion April 20, 2010, on the Deepwater Horizon drilling rig killed 11 workers. There are varying estimates on

SAN DIEGO — The Port of San Diego has adopted a joint resolution recommending actions for the federal government to take to eliminate transboundary flows in the Tijuana River Valley. The Port is the state-designated trustee of public resources in and around Imperial Beach, which includes the ocean waters just off the Imperial Beach Pier, an area that is frequently impacted by toxic, sewage polluted water. According to the Port of San Diego, the resolution solidifies the most urgent needs that regional leaders request from the federal level to address the underlying causes of the sewage, sediment and trash that have contaminated San Diego land and waterways for decades. It has also recently been adopted by the State Lands Commission, San Diego County, San Diego Regional Water Quality Control Board, the cities of Chula Vista and Imperial Beach and Surfrider San Diego.

RE:“Environmental Impact Report begins for proposed development on Newport Beach’s Mariners Mile” (Nov. 29-Dec. 12) Peggy Palmer’s description of Newport Beach as a “small beach town community” is laughable with Hoag Hospital looming over PCH, restaurants similar to The Winery and Rusty Pelican or shops like A’maree’s that are each large self contained buildings in addition to the huge auto and yacht showrooms give short shrift to that idea! It always amazes me what some of these supposedly “community members” groups can come up with as arguments. I’m not one for unnecessary or over development but much of the “miracle mile” is old and grungy maybe a new look would improve the area and bring more visitors to the area. Apartments are a great idea for Newport Beach but alas they likely will be extremely overpriced and unapproachable for most people. Kevin Chard

Marinas.com Boaters’ Choice award winners heavily lean toward East Coast Only two marinas from California were recognized by the website, with most of the recognized boating destinations located in New England and New York.

NATIONWIDE—Leading off this op-ed with a “Nationwide” dateline is a tad misleading. The point of this opinion piece, as you’ll quickly decipher, is to question the merits of a recent announcement of top marinas in the country, as selected by the website, Marinas.com. More than 200 marinas were honored – a majority of them on the East Coast. Most of the East Coast marinas recognized call New England or New York home. Only two marinas on the list are located in California. Don’t poo-poo this column’s claim of East Coast Bias. California is one of the five most active states when it comes to recreational boating, yet less than one percent – 1 PERCENT – of the marinas recognized on Marinas.com’s annual list were located in Southern California. One – Shelter Cove Marina – is in San Diego. The other – Dana Point Marina – is in Orange County. Marinas in Los Angeles, San Francisco and other coastal regions were mysteriously

Nearly 100 marinas in Massachusetts, Rhode Island and New York, however, were noticeably present on the Marinas.com list – which comprised of “Elite Fleet Winners” and “Boaters’ Choice Marinas.” Representatives with the Marinas. com website stated the selections of Elite Fleet and Boater’s Choice Marina winners were based upon user ratings. Users would specifically rate a marina on the Marinas.com website. Those marinas with a 4.8 rating (out of five stars) and at least 10 reviews during the year qualified to make the 2019 winners list. Why the geographic imbalance of winners, though? Does Marinas. com specifically cater to East Coast marinas? The website’s headquarters, as it turns out, is in Massachusetts. Does this explain why so many of the marinas on the winners list are based in New England? Are Southern California’s marinas truly “inferior”

to their counterparts in the Midwest and East Coast, where a vast majority of this year’s winners are located? Or could it be something as simple as East Coast boaters are more proactive in rating the marinas they patronize than their West Coast counterparts? So many questions! The answer might be simple – perhaps I am overanalyzing this year’s list of winners. But when I see a list of the nation’s “best marinas” with only two locations hailing from California, something doesn’t feel right. Statistics released by the U.S. Coast Guard in 2017 revealed Florida had the highest number of registered boats, followed by Minnesota, Michigan, California and Wisconsin. This isn’t to imply there should be a direct correlation between the number of registered boats in a state and the number of quality marinas within that state for those boats to be docked at – bigger or more isn’t always better. The optics of the 2019 Marinas. com list, however, is not friendly. Massachusetts and Rhode Island, which are neighboring states, dominate a list of top marinas … which was compiled by a website based in Massachusetts. There were nearly twodozen marinas from Connecticut and Maine on the list of winners, as well. Four of the top six states on the winners list are in New England (Massachusetts, Rhode Island, Connecticut and Maine); the other two states at the top were New York and Florida. California, somehow, snuck in with two marinas on the winners list. The only other West Coast marina on the winners list was based in Washington State. The Marinas.com list of winning Boaters’ Choice and Elite Fleet marinas ultimately implies states such as Massachusetts and Rhode Island are ideal destinations for boaters, because they can find the best slips and amenities on their shores. This is not to say Massachusetts, Rhode Island and the rest of New England can’t indeed be home to great marinas. It’s difficult, however, to take an award-winning list seriously when a vast majority of those “elite” or “top choice” marinas are based in the same exact region where the website used to set the winning standard is also based. Marinas.com, of course, is entitled to compile a list of “elite flight” or peer-selected marinas. Boaters, however, should not always take these lists at face value, as we don’t always know the standard applied in compiling such lists. The Marinas.com 2019 list of Boaters’ Choice and Elite Flight Marinas appears to have a bit of an East Coast Bias. Rohit SAN DIEGO — Delays in construction are about as surprising as water being wet. Plans to bring a package of new restaurants to the former Anthony’s Fish Grotto location on the Downtown San Diego waterfront have endured delays. The Port of San Diego, accordingly, decided to amend the rent structure for the restaurant group bringing those (now delayed) plans to fruition. The Brigantine’s plans to bring Portside Pier online caught a slight reprieve, Dec. 10, as the Port of San Diego’s Board of Port Commissioners agreed to retroactively modify its minimum annual rent agreement with the restauranteur. Commissioners honored The Brigantine’s request to adjust the second year of annual rent payments from $733,000 to $550,000. Year two of rent payments from The Brigantine to

the Port of San Diego began on May 1, 2019 and runs through April 30, 2020. Annual rent payment for years three through 10 were also adjusted, from $1.1 million per year to $1.13 million per year. The original lease agreement required The Brigantine to complete construction by Dec. 31; construction, however, won’t be completed until mid-2020. “While Brigantine has been making a good faith effort to complete construction on schedule, there have been circumstances outside of their control that have delayed the expected completion until mid-2020,” port district staff stated in a report to commissioners. Port district staff stated a limited availability of specialized, in-water work equipment, conflicts with cruise season and an unexpected number of rainy days all contributed to construction delays. SOUTHERN CALIFORNIA — On the outside, the paint below the water line starts to blister and a white powdery substance forms on the metal parts. These outward signs are indications the metal parts are actually getting eaten away by corrosion. Marine corrosion is a fact of boating life, but some basic knowledge and maintenance can prevent some of the worst and most expensive repairs. “Corrosion happens, you need to be aware of it and need to monitor it and be prepared for it,” said Mark Corke, who is a marine surveyor and BoatUS Magazine Associate Editor. In its simplest definition, corrosion is a gradual destruction of materials by chemical and/or electrochemical reaction with their environment. Although several types of corrosion can affect boats, according to BoatUS, metal boat parts underwater are susceptible to two basic types: stray current and galvanic. Both can harm the boat, propeller and motor if not correctly monitored and avoided. Stray current corrosion occurs when metal with an electrical current flowing into it is immersed in water that is grounded, such as an ocean. An example would be a boat sitting between a vessel leaking DC current and the best ground for that current. Stray current corrosion can cause rapid deterioration in just a few hours to a few days.

Brian Gordon, West Marine Content Editor, said a galvanic isolator can be installed to prevent stray current corrosion. According to BoatUS, the device functions as a filter, blocking the flow of destructive low voltage galvanic (DC) currents but still maintaining the integrity of the safety grounding circuit. The second type of corrosion, galvanic, is an electrochemical reaction between two or more dissimilar metals. It can happen whenever two or more metals with different levels of electrical activity are connected – either by actually touching or through a wire or metal part – and are immersed in a conductive solution, such as saltwater. An example being a bronze propeller and a stainless steel prop shaft. The least noble metal will corrode first. In the above example, the bronze propeller would begin to dissolve, leaving the stainless steel prop intact. More noble metals

have less chemical reactivity, making them more resistant to corrosion. “The ones that are most noble will survive but at the expense of the others,” Corke said. Gordon said attaching sacrificial anodes is a relatively cheap form of insurance. Sacrificial anodes are made of a metal less noble than the parts they are meant to protect and will corrode first. Using the example of a bronze propeller and stainless steel prop shaft, attaching a zinc sacrificial anode would lead to the zinc corroding, protecting the bronze propeller. “Anything is going to corrode, what you’re trying to do is protect that by using things like anodes,” Corke said. Gordon said replacing an outdrive damaged by corrosion will cost thousands of dollars whereas a kit of outdrive anodes cost between $25 and $70 at West Marine. “I’ve seen the damage,” Gordon said. “I’ve seen more than one outdrive that has been completely destroyed by corrosion.” Gordon is also a former hull diver and said monitoring anodes should be part of the regular hull cleaning. “A good diver that’s his job,” Marina del Rey Boatyard service manager Victor Espino said talking about checking anodes on a boat. Marina del Rey Boatyard owner Greg Schem said those who ignore regular maintenance often end up at his boat repair shop, some needing thousands of dollars in repairs. A recent worst case scenario boat that was brought to the Boatyard had no sacrificial anodes and a stern drive completely eaten up by corrosion. “When it gets to this stage not only is this owner looking at tens of thousands of dollars in damages but potentially damages to the environment by leaking oil,” Schem said. “So it’s really important to stay on top of this kind of maintenance.” Gordon said when 50 percent of the anode is eaten away it should be replaced, which can be done by a diver. He said the frequency of hull cleanings is dependent on the environment the boat is in, but should typically be done every month or so. Corke said the best thing boaters can do to prevent galvanic corrosion is be aware, stay abreast of routine maintenance and make sure anodes are properly connected. “Provided the right precautions, the boat is well-built and well-maintained, there is going to be less of a problem,” Corke said. When it comes to purchasing anodes, the material of choice should be based on the kind of water the boat is kept and used in. Zinc or aluminum is recommended for saltwater, aluminum for brackish water and magnesium for freshwater. Aluminum has become more popular for saltwater since EPA reports have suggested the metal is more environmentally-friendly than zinc. Gordon said parts that might need anodes but often get overlooked are the inboard engines, trim tabs, keel coolers, rudders, and marine water heaters, particularly those with tanks made out of aluminum.

Cycleboat looking to pedal into Newport Beach Harbor SoCal Cycleboats is interested in offering a pedal-powered boat to small groups for birthdays, bachelor/bachelorette parties, team building, corporate gatherings and other events. By Lindsey Glasgow NEWPORT BEACH — SoCal Cycleboats Inc. has submitted a Marine Activities Permit (MAP) application to run a multi-passenger cycle boat in Newport Beach Harbor. If approved, SoCal Cycleboats owners, Michael Kapusta and Chris Ferren Cirinio, would be the first to run such a business in Southern California, according to Kapusta. The application was up for discussion at the Nov. 13 Newport Beach Harbor Commission meeting. Both Kapusta and Cirinio, who runs a similar business in Sacramento, were at the meeting to explain their concept. “We’re excited about it, we think it’d be a fun new interactive experience and there’s nothing of its kind here,” Cirinio said at the Nov. 13 meeting. They are looking to purchase a 31-foot, built-to-order Pontoon Cycle Boat from Oregon-based Cascade Cycleboats. The boat would have space for 16 passengers; including 10 peddle seats, which power the boat. The boat would have a master captain in charge of steering as well as a deckhand. At no time would a passenger be allowed to steer the boat. SoCal Cycleboats would not provide food or drink service, at least to start, but would allow passengers to bring on their own beer, wine, cider or canned cocktails. Hard alcohol would not be permitted. The operational hours proposed in the MAP application are 9 a.m.-10 p.m., with customers booking for 90 minute rides. Passengers would park at Balboa Fun Tours, where there would be five

designated parking spots for the cycle boat. They would then walk over to the loading area at Mr. G’s at Peninsula Kitchen and Bar. The proposed route would take passengers on a 4-mile loop throughout Newport Beach Harbor and allow for stops at local restaurants and bars. “The other thing we want to do is support other local small local businesses in Newport Beach,” Cirinio said at the Nov. 13 meeting. The cycle boat would have a sound system, with the volume controlled by the captain. The operation would need to follow all the regulations set forth in the MAP section of Title 17, including one stating music and sound from all vessels shall be controlled so as not to disturb a person of normal sensitivity at a point 100 feet from the hull of the vessel. Ultimate approval of the MAP application is up to the harbormaster, but commissioners unanimously voted 6-0 (Commissioner Steve Scully was absent) to recommend approval of the permit, with a few conditions. Those conditions included having a certified master captain on board at all times and having several different routes instead of one to minimize the impact on residents living along the routes. Newport Beach Harbormaster Kurt Borsting estimated a decision on the application will be made in the next several months. The application submission comes as the Harbor Commission is in the process of reviewing and revising the MAP section of Title 17. Borsting said he does not anticipate the process having an impact on the SoCal Cycleboats application or any other MAP application. He said they are continuing to follow

Acknowledging The Brigantine’s good faith efforts opened the door for port district staff to extend the construction deadline until Aug. 31, 2020. Both parties entered into a 40-year lease on April 27, 2018. The Brigantine would build a group of restaurants where the old Anthony’s Fish Grotto used to stand (1360 North Harbor Drive in San Diego’s North Embarcadero district). Lease terms called for The Brigantine to complete construction of a $13 million restaurant redevelopment project. “The Brigantine expects construction of Portside Pier to cost $20 million to create an enhanced dining establishment, including enhanced public improvements,” port district staff stated in a report to commissioners. “The redevelopment will include a two-story restaurant structure, new pilings and platform, an expanded

dock-and-dine facility and promenade improvements.” Portside Pier will have four unique restaurant concepts, port district staff added. Once completed the Portside Pier plaza would include a second-level viewing deck, second-level perimeter walkway and an expanded dock-and-dine. “All three public features will be maintained solely by Brigantine at no cost to the [port] district,” port district staff stated in their report to commissioners. Antony’s Fish Grotto was one of San Diego’s longest standing seafood restaurants before it was recently demolished to make way for Portside Pier. The former restaurant operated on the Downtown San Diego waterfront since 1964, but its lease with the port district expired in January 2017. The port district and Anthony’s did not sign on to a new lease, opening the door for The Brigantine to come in and propose Portside Pier.

Newport Beach to replace guide piles with a floating swim dock

Port of San Diego holds off on illegal charter deliberations

What Happened: The California Coastal Commission approved Newport Beach’s request to remove two concrete guide piles and replace them with a 160-squarefoot public floating swim dock and two new concrete guide piles. The dock and new piles would be located on the bay side of Balboa Island, at the end of Ruby Street. A public swim dock existed at the same location between 1947 and 1970. “The proposed dock float is generally consistent with past commission-approved public dock floats, and there are no expected impacts to eelgrass,” Coastal Commission staff told commissioners in a report. Newport Beach removed the old public dock in 1970, due to deteriorating conditions. Coastal Commissioners approved the proposed project on Dec. 12; the Coastal Commission met Dec. 11-13 in Calabasas.

What Happened: The Port of San Diego held off on deliberating proposed changes to the port district’s policy on charter vessel operations in San Diego Bay and surrounding tidelands. A possible port district code amendment to address illegal charter operations in San Diego Bay was initially placed on the Port of San Diego’s Board of Port Commissioners agenda for Dec. 10. The item was pulled prior to the meeting. Port district staff stated the board would consider the issue at a future meeting. Illegal charter vessel operations have been a problem in San Diego Bay. Charter vessels must meet certain Coast Guardmandated regulations, but there are individuals/groups who circumvent these requirements and sell charter services to the public. Illegal charter vessels might not meet basic safety requirements or regulations.

What’s On Tap: Newport Beach has yet to provide any official plans of the proposed public dock. “The city states that the public dock will maintain typical design features that identify it as a public dock, such as white finial(s) mounted on top of the dock piles that signify public docks within Newport Harbor, and improved signage,” Coastal Commission staff stated in a report to commissioners. “While no plans have been submitted, the city stated that they will install visitor-serving/coastal access directional sign(s) on the existing informational signage located on the sandy beach landward of the swim platform at the Ruby Avenue street end and on the swim dock itself.”

What’s On Tap: It’s unclear when port staff and the board will discuss the charter vessel operation amendment. Local boaters and charter companies have been urging the Port of San Diego to take action against illegal charter operations for years. The port district has been working with the Coast Guard to try to come up with a resolution, but nothing formal has been offered yet. The board, at one point, was expected to weigh in on a proposed policy at the Dec. 10 board meeting, but it now appears the deliberation will happen at some point in 2020. The Log will continue to monitor the illegal charter issue in San Diego and report on when a formal proposal is finally presented to the Board of Port Commissioners.

La Paz is also an ideal destination for whale sharks, as the shallow waters just off the city’s coasts are ripe with plankton – the main food source for the world’s largest fish.

What Do Whale Sharks Look Like? What Are Their Characteristics?

h, Capt. Ahab, you chased the wrong sea creature. You would have survived if you were obsessed with chasing the whale shark. Whale sharks might be the world’s largest fish, but they are “allergic” to humans. The fish mostly eat plankton and small fish. Getting up close and personal with a whale shark, which can grow up to 40-some feet in size, is quite easy to do – and you won’t need a harpoon (or any other weapon) when you finally meet this “gentle giant.” A whale shark, to be sure, isn’t a whale. It’s a shark. One might even describe the fish as a “vegan shark.” So don’t let its large, rectangular mouth fool you – the whale shark isn’t inclined to swallow you (either partially or whole). “Moby Dick,” of course, is a fictional story set in the 1800s. Swimming alongside whale sharks, however, is quite the real experience – particularly this time of year. It’s whale shark season in the Sea of Cortez, and there are no shortage of thrill-seeking humans who are making a “pilgrimage” to the Baja California Sur city of La Paz, just to have the opportunity to swim side-by-side with the world’s largest fish. This writer was one of those thrill-seekers, arriving in La Paz at the start of the 2019 whale shark season. It was a sunny and warm day on Nov. 2, when this writer boarded a boat chartered by Baja Adventures Co. (which is based at Marina Costabaja, home of one of the largest marinas on the Sea of Cortez). We navigated around the Sea of Cortez for an hour before finally arriving at a section of the La Paz coast where several whale sharks were wading. There must have been a dozen boats in the area, each one with five to 15 people aboard. Spend enough time here – both aboard the boat and in the water – and you quickly realize whale sharks are

National Geographic states the whale shark population is in decline. “Although massive, whale sharks are docile fish and sometimes allow swimmers to hitch a ride. They are currently listed as a vulnerable species; however, they continue to be hunted in parts of Asia, such as the Philippines,” a National Geographic fact sheet about whale sharks stated. The World Wildlife Foundation added whale shark meat does have some value on international markets. WWF researchers also stated human interaction with whale sharks can indeed pose a risk to whale shark reproduction. “Whale sharks are highly valued on international markets. Demand for their meat, fins and oil remains a threat to the species, particularly by unregulated fisheries,” WWF researchers stated. “They are victims of bycatch, the accidental capture of non-target species in fishing gear. And whale shark tourism presents a threat to the species as it can interrupt their feeding and sharks can be injured by boat propellers.”

LA PAZ, Mexico — The fate of Capt. Ahab at the end of “Moby Dick” was anything but happy. Ahab, as anyone who read the novel would know, engaged in a climatic battle with the sperm whale he obsessively chased throughout the story. The end-of-story battle between man and whale features the use of a harpoon and rope. Ahab strikes the whale with the harpoon before becoming entangled with the attached rope – and is pulled out to sea as the large mammal swims away.

indeed worthy of the “gentle giant” moniker. I personally witnessed 10 whale sharks during my excursion, many of them coming within inches of a human being. Never once was there a threat of harm or injury. Each whale shark – most of them measuring 20 to 30 feet in length, by my estimation – navigated around the herds of boats and human beings as if they were white noise, nothing worth paying any attention to during quests for simple pieces of marine vegetables. We’ll never know for sure, of course, if humans are doing more harm than good each whale shark season. Are we invading their space? Perhaps they don’t care we’re there? There are some regulations already in place, as to how many boats can be occupy the whale shark habitat at the same time – but should these regulations be stricter? It’s unclear if there is any definitive

Long Beach City Council approves contracts, new permits for four marine businesses

Harbor Breeze will continue to pay five percent of annual gross receipts for the initial 15-year term. The city will receive an estimated annual revenue amount of $400,000 during the initial 15-year term.

Long Beach is green lighting Wheel Fun Rentals to operate Swan Pedal Boats in Rainbow Lagoon.

By Lindsey Glasgow LONG BEACH — Two new marine-related operations were approved and leasing agreements were extended for two current businesses in Long Beach at the Dec. 10 City Council meeting. In a vote at the Dec. 10 meeting, the City Council authorized the city manager, or designee, to award a contract to Dion and Sons, Inc. to operate and maintain boat fueling facilities in the City of Long Beach Marinas, for a period of five years, with the option to renew for two additional five-year periods. The contract for fueling operations expired in December 2018 and a new Request for Proposal (RFP) was issued to identify the best provider to operate and maintain the boat fueling facilities in City Marinas. One proposal was received on April 30, 2019, from Dion and Sons, Inc. and the selection committee determined the local Long Beach-based company was qualified to provide the service. The fueling facilities are located at Alamitos Bay Marina between Basin 1 and 2 and at Shoreline Marina at dock GG. The city will receive an estimated annual revenue of $48,000 from the operation. Wheel Fun Rentals was also awarded a permit agreement. Wheel Fun Rentals currently operates a bicycle and Segway scooter rental location out of Shoreline Village and was awarded a permit to provide Swan Pedal Boat rentals at the Rainbow Lagoon. Under the permit, Wheel Fun Rentals can operate 30 Swan Pedal Boats in Rainbow Lagoon for an initial term of five years, with the option to renew for two additional two-year peri-

ods. One kiosk facility may be placed at the west end of Rainbow Lagoon for Wheel Fun Rentals to conduct business, upon approval from the city manager. It is anticipated the operation will be open in February 2020. The city is estimated to receive annual revenue of $80,000 during the initial five-year term. The City Council also voted to terminate the current permit for Dockside Boat & Bed and enter into a new agreement. The new permit agreement allows Dockside Boat & Bed to occupy and use portions of the docks, slips, and end ties in Rainbow Harbor, for the purpose of operating bed and breakfast inn accommodations and charters, for a three-year term, from January 1, 2020 to December 31, 2022, with the option to renew for two additional three-year periods. Dockside has operated a bed and breakfast inn on private yachts from Rainbow Harbor since 1999. After falling into financial hardship in 20082009, Dockside was unable to stay current with percentage rate and slip rent payment. Their permit was not extended after 2012, but Dockside was authorized by the Parks, Recreation, and Marine Department to continue operation as long as monthly percentage rate and slip fee payments were made on time. The Parks, Recreation, and Marine Department said in a report to the City Council, they are supportive of Dockside’s request to enter into a new permit, describing the operation as unique and essential to supporting a vital waterfront and thriving commercial harbor area. Harbor Breeze Corporation was another business on the Dec. 10 docket. The company was first granted

SAN DIEGO — David A. Hall, who served as the Port of San Diego’s Harbor Police chief between 1999 and 2003, has died, it was announced. Hall passed away on Dec. 6 after a months-long battle with cancer, according to the port district staff. He was 78. He also spent 30 years serving with the San Diego Police Department, where he was a captain. Yet his relatively short stint with the Port of San Diego Harbor Police came with set of realities: Hall was the chief during 9/11. Developing professional training and fostering leadership concepts within the police department were Hall’s priorities, but he also took on an initiative in light of the Sept. 11 terrorist attacks. Hall specifically worked with port district staff and the Harbor Police to “develop a homeland security program to ensure officer and public safety.” The federal government recognized Hall’s efforts, as the Department of Homeland Security awarded him with a Distinguished Public Service Award. “Chief Hall’s legacy continues in the men and women he hired, many of whom have risen to positions of leadership in the Harbor Police Department,” Harbor Police Chief Mark Stainbrook said in a statement released by the port district. “Chief Hall diligently mentored, coached and inspired these leaders to be highly trained and competent police professionals. He will be dearly missed.” Hall also spent six years as a law enforcement consultant and bureau chief with the California Peace Officer Standards and Training. He also spent time working with the Center for Leadership Development, an organization focused on analysis and development of leadership, management and supervisory courses, programs and workshops. Other stops along Hall’s public service career: interim director of public safety for Fresno Yosemite Airport; senior police advisor for Montenegro; federal grant project director for public safety issues along the U.S.-Mexico border; interim police chief for the city of Emeryville; and, 11 years as an independent contractor for a security firm. Hall was also an elected retiree representative of the San Diego City Employees’ Retirement System Board of Trustees and president of the City of San Diego Retired Fire and Police Association. Hall was survived by his wife, Linda, of 58 years; son, Larry and daughter-in-law Juliette Hall; son Andy Hall; son Jeff and daughter-in-law Melissa Hall; five grandchildren (Jonathan, Lauren, Hailey, Max, Alyssa); and, sister, Lois Willoughby. There are plans for a memorial service in January 2020.

This is the third time the Fairplex will host the Los Angeles Boat Show – the boating exhibition was also here in 2018 and 2019. The 2020 Los Angeles Boat Show runs through Jan. 12, 2020. By Lindsey Glasgow NEWPORT BEACH — Newport Beach City Council member Brad Avery has been appointed as the mayor pro tem for 2020.

The annual City Council mayoral nomination took place at the Dec. 10 City Council meeting. Will O’Neill was appointed the mayor and Avery mayor pro tem, both in unanimous votes. “It’s an honor to be selected by my fellow council members” Avery said. “I’m looking forward to supporting Mayor O’Neill in the coming year.” Council member and outgoing Mayor Diane Dixon nominated Avery. “I am delighted to nominate Mr. Avery, Council member Avery for his outstanding work on this council,” Dixon said at the Dec. 10 meeting. Avery said homelessness and afford-

able housing will be among the major focuses of the council next year. He said two key harbor issues for the next year will be helping the Harbor Commission in finding more funding for the new harbor department and continuing to secure funds for dredging. “Two major issues I will certainly be supporting and working with Council member Duffield on and the rest of the council,” Avery said. Avery has been on the City Council since 2016 and is serving a term that runs through 2020. Avery is running for reelection in 2020. He is also the Director of Orange

Santa Barbara Sea Level Rise subcommittee expected to release draft adaption plan in February 2020

By Lindsey Glasgow SANTA BARBARA — Planning for sea level rise (SLR) has been a focus of coastal communities up and down the California coast. In Santa Barbara, a subcommittee has spent the past year or so working on recommendations for actions for the city to take in the next 10 years to address the potential effects of sea level rise. Santa Barbara Project Planner Melissa Hetrick said the Santa Barbara Sea Level Rise Subcommittee will release a draft Sea-Level Rise Adaptation Plan in February 2020. The plan will address adaptation strategies for low-lying flood areas, waterfront beach areas, the harbor and Stearns Wharf, coastal bluff areas and downtown. Changes are still being made, but

Once the draft is released in February, the subcommittee will conduct public outreach.

The SLR vulnerability assessment identifies areas of Santa Barbara projected to be affected by sea level rise and related hazards through the year 2100 if there is no intervention. The SLR Adaptation Plan will evaluate the city’s vulnerabilities to sea level rise and analyze the feasibility, economic impacts, and environmental consequences of various adaptation strategies to address impacts. Findings from the plan will be incorporated into the policies and development standards in the city’s Local Coastal Program. The plan is part of a program funded by the California Coastal Commission and California Coastal Conservancy to assist local governments in meeting new state requirements addressing sea level rise. SLR has been on city agendas across the state, Avalon on Catalina Island released a similar Sea Level Rise Vulnerability Assessment in October. SLR is also being addressed on a statewide level. In December, the California Legislative Analyst’s Office released a report titled: “Preparing for Rising Seas: How the State Can Help Support Local Coastal Adaption Efforts.”

AVALON —Boaters who live or frequent Catalina Island looking to buy or sell a boat now don’t have to leave the island to meet a broker. Silver Seas Yachts opened an office in Avalon in November. Jerry Reeck, the Sales Manager of the Newport Beach Silver Seas Yachts and the new Avalon office, said they were looking for the next location for Silver Seas and after considering some other options, including Los Angeles and Ventura, decided on Catalina Island. “Just really felt like this would be a good opportunity to reach some boaters we don’t normally reach,” Reeck said. The office is located right off the pier at 507 Crescent Ave. Legend Island Outfitter occupied the space before closing down. Reeck said they had their eye on the spot for more than a year before acquiring the space a few months ago.

The new Silver Seas Yachts in Avalon is located at 507 Crescent Ave., right off of the pier. The yacht dealer also has a location in Newport Beach and has an inventory of both new and pre-owned boats.

The office is open about 20 to 30 hours a week, generally Thursday through Sunday, between about 10 a.m.-4 p.m., according to Reeck. Once boating season kicks back up in the spring, the office will be open seven days a week. A ribbon cutting ceremony is also planned for the spring. The office is currently being supported by staff from the San Diego and Newport Beach locations, including Reeck, who rotate out to Avalon. Dec. 31, 9 p.m.-1 a.m. • Maritime Museum of San Diego invites the public to join them in ringing in the New Year. The event will take place on the center deck of the historic steam ferryboat Berkeley overlooking San Diego Bay. Tickets include music from the 70’s, 80’s and 90’s, appetizers, desserts, dancing, midnight champagne toast and traditional party favors, noisemakers, and beads to help ring in the New Year. Second SoCal boat show of 2020: San Diego Sunroad Marina Boat Show SAN DIEGO—The San Diego Sunroad Marina Boat Show returns for its 11th year, Jan. 23-26, with more than 90 exhibitors and 100-plus boats on display at Sunroad Marina. An in-water display will showcase new and pre-cruised sailboats and motor yachts. 2020. The series continues with races in Santa Monica Bay (March), Pt. Dume (May) Catalina Harbor (June) and Eagle Rock to Marina del Rey (June). Racers competing in the first Berger-Stein Series event on Jan. 4 will begin and end at Malibu. The scheduled warning is at 11:55 a.m. PHRF class boats will have a race course of

21-23 nautical miles; the cruising distance is set for 12-14 nautical miles. The entry fee for the first race of the Berger-Stein Series is $35. (Races 2, 3 and 5 will also be $35; Race 4 is $45 and includes beverages and use of barbecue grills at Del Rey YC’s facilities at Catalina Harbor.) Entry fees must be paid by 6 p.m. on the day before the race (Jan. 3, 2020, for the first race). Two divisions will be featured in the series: PHRF (Berger), and Cruising (Stein). “These divisions will be divided into

classes for the series and will be posted at dryc.org by 1900, the day before Race 1,” according to the Notice of Race. Non-spinnakers can enter the series under the Cruising Division; the event chair will determine whether the non-spinnaker can actually compete. A series pre-launch party will be held at Del Rey YC on Jan. 3, 2020, 6:30 p.m. Race trophies will be awarded after each competition; please read each race’s Sailing Instructions for information about the trophy presentations. Del Rey YC will present perpetual and race trophies at an awards presentation and barbecue event at noon on June 27, 2020. Winner of the PHRF Division will have his or her name engraved on the William Berger Perpetual Trophy. Whoever wins the Cruising Division will have his or her name engraved on the William Stein Perpetual Trophy. The second race of the series will be on March 7, 2020 and takes place in Santa Monica Bay; Race 3 will be at Pt. Dume and takes place on May 2, 2020. Races 4 and 5 will be on June 6 and 7, 2020; the first day will be a Catalina Harbor layover, followed by an Eagle Rock-to-Marina del Rey race on June 7, 2020. U.S. Sailing Release Updated Schedule and List of Keynote Speakers for San Diego Forum SAN DIEGO (LOG NEWS SERVICE)—U.S. Sailing has recently released an updated draft schedule of courses and list of keynote speakers for its upcoming Sailing Leadership Forum 2020, which is scheduled in Mission Bay in February 2020. The conference, which would kick-off with a welcome reception on Wednesday afternoon, Feb. 5, 2020, is scheduled to run from Thursday, Feb. 6 through Saturday, Feb. 8, 2020. U.S. Sailing said instructors, coaches, race officers, program directors, class/ fleet leaders, yacht club management, organization leaders and volunteers would find key takeaways from this unique event. In addition to having the opportunity to attend scheduled events, attendees will also have an opportunity for meaningful discussions with sailors representing other interests in the sport, types of sailing, and industries and will be able to observe and reflect on the common issues they share and how they can work together to achieve better results. Reservation information and fee schedules for the forum, which is scheduled to be held at the Hilton San Diego Resort and Spa in Mission Bay, is posted on the U.S. Sailing website. The hotel is presently undergoing a change of ownership and will be rebranded as the San Diego Mission Bay Resort and any reference to either the Hilton San Diego Resort and Spa or San Diego Mission Bay Resort during the transition period is correct. Long Beach YC kicks off new decade with a ‘pursuit’ Two Gates Pursuit Race will be held during first weekend of 2020. By Parimal M. Rohit

High school and college fleets prepare for 2020 Rose Bowl Regatta USC sailing team will host the prep and collegiate regatta in Long Beach, Jan 4-5, 2020. By Parimal M. Rohit LONG BEACH—The University of Southern California (USC) sailing team and U.S. Sailing Center (Pacific Coast Sailing Foundation) will host the 2020 Rose Bowl Regatta at Long Beach Harbor; the regatta for high school and collegiate fleets will be held at Long Beach Harbor. As many as 30 teams will compete in the college fleet (A&B divisions), while up to 90 teams would be allowed to race against each other in the high school competition (Gold, Silver and Bronze, A&B divisions in each class). All teams will be competing in a round robin format. The schedule of events begins with a “report time” at 9 a.m. on Jan. 4, 2020, followed by end of registration at 10 a.m. and a skippers’ meeting at 10:30 a.m. Racing begins at 11 a.m. on both days of racing. A dinner and college sailing forum will be held at 5 p.m. on day one of racing. Jan. 5, 2020 begins with a 9 a.m. report time, followed by a Pacific Coast Interscholastic Sailing Association (PCISA) meeting at 9:30 a.m. The skippers’ meeting for day two of sailing will be at 10 a.m., followed by racing at 11 a.m. Warning signals will not be given after 3 p.m. for college teams and 3:30 p.m. for high school fleets. A

trophy presentation will take place at 5 p.m. on Jan. 5, 2020. Trophies will be awarded for first, second and third place finishers in each fleet. There were 21 colleges listed as competing in the regatta, as of Dec. 20. Those colleges were: Arizona State, Boston College, Cal Maritime, Cal Poly, College of Charleston, Cornell University, Georgetown University, Jacksonville University, Northwestern University, San Diego State University, St. Mary’s College of Maryland, Tufts University, U.S. Coast Guard Academy, UC Irvine, UCLA, UC Santa Barbara, UC Santa Cruz, UC San Diego, University of North Texas and University of Washington. The long list of high school teams competing in the regatta include: Port of L.A. High, Alameda High, San Pedro High, Palos Verdes High, Redondo Union, Santa Monica High, Sage Hill School, Mission Bay High School, The Bishop’s School, Oaks Christian High, Corona del Mar High, The Bay School, Point Loma High, Mater Dei High, Santa Barbara High, Walter Payton College Prep and Newport Harbor High. LONG BEACH—Monohulls and multihulls larger than 20 feet in overall length (Area C PHRF RLC rating of 228 or less) are among the sailboats invited to compete in the Two Gates Pursuit Race; the regatta is hosted by Long Beach Yacht Club and will be held on Jan. 5, 2020. XS Racing or ORCA rated boats with valid certificates and any member of a recognized yacht club are also invited to enter the regatta. The Race Committee will determine class breaks (based upon entries); entries will be divided into three classes, according to the Notice of Race. Entries can be submitted online through the Regatta Network or via the Long Beach YC official entry form at the club. All entries must be submitted by 11 p.m. on Jan. 2, 2020.

Late entries could be accepted and would be judged on a case-by-case basis. The entry fee is $30. “Starting times will be staggered according to each boat’s assigned rating,” the Notice of Race stated. The list of starting times will be posted online (www.lbyc.org) and available at the yacht club by 5 p.m. on Jan. 4, 2020. First warning will be at 11:55 a.m. A no host bar and trophy presentation will begin at the yacht club at 6 p.m., after sailing. Sailing Instructions will be available by noon on Jan. 3. The venue will be Los Angeles and Long Beach harbors. Course 1 (the default) will start at the exit of Long Beach Harbor, through Queen’s Gate and into Los Angeles Harbor through Angel’s Gate. The course then exits Long Beach Harbor (through Queen’s Gate), around Mark 10 (east end of Long Beach Breakwater) to port, around Mark 32 to port, and then to the finish. The total handicap distance is 13.2 nautical miles. The Racing Committee could add a second course featuring challenging weather conditions. Competitors should pay attention to VHF 68 prior to the attention signal, according to the Notice of Race. This course would be 5.17 nautical miles in distance. Trophies will be awarded after the race and awarded for both class and overall. All of Long Beach YC’s facilities are open to competitors and guests throughout the regatta. U.S. Senate committee advances fishing conservation bill America’s Conservation Enhancement Act would fund restoration projects and could protect lead fishing tackle. By Parimal M. Rohit

WASHINGTON, D.C. — Passage of America’s Conservation Enhancement Act, or ACE Act, out of the U.S. Senate Committee on Environment and Public Works on Dec. 17 was hailed as a major victory for recreational fishing. The proposal, if ultimately supported by Congress and the White House, would provide support for fisheries programs and protections on fishing tackle. One of the senatorial authors of the bill stated the ACE Act would protect wildlife habitats from invasive species, promote fish conservation and help recover endangered or threatened species. “The ACE Act ... enshrines in statute partnerships among public agencies and other interested parties that promote fish conservation. [It] also includes studies that will help inform how to improve successful conservation and recovery of endangered and threatened species,” Sen. John Barrasso, R-Wyoming, said. Barrasso, who is chair of the Environment and Public Works Committee, introduced the ACE Act with Sen. John Carper, D-Delaware. Several fishing and outdoors organizations expressed support of the ACE Act, including the American Sportfishing Association (ASA). “Multiple bipartisan wins were

included in this major legislation such as the authorization of the National Fish Habitat Partnership program and support for programs important to fisheries conservation in the Great Lakes and the Chesapeake Bay,” Mike Leonard, ASA’s vice president of government affairs, said in a released statement. The National Fish Habitat Partnership program is one of the key elements of the ACE Act. The conservation program provides funding for restoration projects, both nationwide and regionally. The ACE Act would also exempt lead fishing tackles from federal regulations or bans, according to an ASA statement on the bill (which is chaptered as S. 3051). A restoration program to clean up the Chesapeake Bay and its tributaries was also included in the ACE Act. The fisheries of the Great Lakes would receive support from the ACE Act, as well – particularly in fisheries data collection and biological assessments. The Senate Committee on Environment and Public Works vote was unanimous. The ACE Act now goes to the full Senate for a vote. Other provisions of the ACE Act addressed hunting and other outdoor-based recreational activities.

California continues to advocate for statewide Marine Protected Areas program Department of Fish and Wildlife continues to conduct outreach, research, monitoring and policy development of designated protection zones. By Parimal M. Rohit SACRAMENTO—California’s Fish and Game Commission received its annual management update of the statewide Marine Protected Areas (MPA) program during its December meetings in Sacramento. The states’ Department of Fish and Wildlife (DFW) staff specifically provided updates of the program’s

four components: outreach/education; research/monitoring; enforcement/ compliance; and, policy/permitting. DFW staff stated they are still continuing efforts to increase public awareness of the MPA network, specifically to improve compliance of regulations and overall understanding of the program. The department specifically finalized and released the “California MPA

Network Outreach and Education Guide,” a resource providing messaging about the state’s MPAs. DFW staff also updated the state’s Ocean Sport Fishing Web Map, a mobile phone app informing anglers of fishing regulation boundaries. Department officials also continue to conduct research and monitoring activities for California’s MPA network, according to DFW staff. Some research/monitoring projects include: evaluation of kelp forest ecosystems; evaluating the performance of California’s MPAs through sandy beach

and surf zone ecosystems; integrated ocean observing systems for MPA assessments; and, establishing a statewide baseline monitoring program for MPAs. Several MPA monitoring projects were conducted throughout 2019, DFW staff continued. Most of those projects were conducted in partnership with See PROTECTED page 31

Divers release white abalone into the wild SOUTHERN CALIFORNIA—A group of divers released endangered white abalone into the wild, just off the Southern California coast, in mid-November. The release of white abalone into the wild was part of a recovery effort to revitalize the white abalone population and bring the species back from the brink of extinction. The white abalone population began to drop significantly in the 1970s, due to heavy commercial fishing in Southern California. “Now, the white abalone that remain in the ocean are too few and far apart to reproduce and recover the populations,” according to a report published by the National Oceanic and Atmospheric Association, or NOAA. White abalone is a marine snail found in rocky reefs. Most white abalone can be found along the coasts of Southern California and Baja California. The species was listed under the Endangered Species Act in 2001. Releasing the white abalone was part of a breeding program led by the Bodega Marine Laboratory (BML) at University of California, Davis. The program, according to NOAA Fisheries staff, “has produced and

reared thousands of health white abalone in labs and aquaria throughout California.” “Now, some of those white abalone are ready to enter the ocean, where they will live, grow and hopefully reestablish self-sustaining populations,” NOAA Fisheries staff said. A batch of white abalone produced and reared at BML earlier this summer were transported down to Southern California and held at holding facilities, where scientists prepared them for life in the ocean. Divers with NOAA Fisheries, the California Department of Fish and Wildlife, Paua Marine Research Group, The Bay Foundation and Aquarium of the Pacific placed 800 white abalones into temporary homes, or “outplant modules.” The modules are made of PVD and mesh, which protects the abalone from other marine life as they acclimate to ocean conditions. The diver scientist will regularly visit the modules during the next few years and observe the growth of the white abalone population. The goal is to have tens of thousands of white abalone planted into the ocean during the next five years.

The two-dozen anglers aboard Stardust’s Dec. 19 three-quarter-day fishing excursion came back to shore with several chuckleheads, but these two anglers were quite happy with this lingcod brought over the rails. There were only six lingcod caught on this three-quarter-day trip, complementing the 190 rockfish and 50 red rockfish. A half-day trip aboard Stardust on Dec. 18 brought back 120 rockfish, 40 whitefish, eight sheephead and one sand bass for 12 anglers.

the Partnership for Interdisciplinary Studies of Coastal Oceans, Reef Check California, Multi-Agency Rocky Intertidal Network, California Collaborative Fisheries Research Program, Marine Applied Research and Exploration and the National Parks Service. Two DFW vessels – R/V Garibaldi and R/V Mystinus – provided 55 days of on-the-water support for long-term MPA monitoring, department staff stated in a report to commissioners. Several advances were made this year in the enforcement and compliance component, as well, according to DFW staff. The department’s Law Enforcement Division made frequent contact with individuals navigating in and around MPAs, DFW staff told commissioners during the Dec. 12 meeting. Law Enforcement Division staff specifically reported 11,611 contacts, 422 warnings and 224 citations for the first half of 2019. These numbers compare to 33,000-some contacts, 1,000-plus warnings and more than 900 citations in 2017. In 2018 there were almost 19,000 contacts, 800-some warnings and nearly 500 citations issued. This year also saw one piece of legislation go into effect: AB 2369 increased the penalties for commercial fishing operators who were caught and convicted of violating MPA regulations. AB 2369 went into effect on the first day of 2019. DFW’s Law Enforcement Division also implemented a new electronic records management system in September. The system helps identify hot spots and repeat offenders.

The department also issued 54 new “Scientific Collecting Permits” within 85 MPAs, 41 state marine reserves, 35 conservation areas and seven no-take areas in 2019. Almost 750 such permits have been issued since 2012, according to DFW staff. California’s network of MPAs was established as an attempt to protect and enhance marine life off the state’s coast, but the program has been met with controversy or disagreement ever since its inception. Anglers who either disagreed with or weren’t fans of the network of MPAs consistently stated the conservation zones or no-take areas limit recreational fishing opportunities. The Fish and Game Commission approved the final MPA master plan in August 2016. DFW staff agreed to provide annual updates; the first annual update was provided in December 2018.
