Proposed legislation is approved in committee, setting the stage for bill to be considered by full upper chamber roster. By Parimal M. Rohit
WASHINGTON, D.C.—A federal bill aiming to improve the safety of those who spend time on the water has cleared its first hurdle. The U.S. Senate’s Commerce, Science and Transportation Committee approved Senate Bill 2297 (S. 2297), also known as the Coast Guard Reauthorization Act of 2019, in late July. The Coast Guard Reauthorization Act would affect recreational boaters, should the proposal clear both houses of Congress and ultimately become signed into law. One provision of S. 2297 calls for boats measuring 26 feet in length or smaller to have its operators maintain an engine cut-off switch once the vessel is operational and navigating. The mandate follows-up on another federal provision requiring manufacturers install the cut-off device on boats of 26 feet and smaller. S. 2297 would also grant the Coast Guard “equivalency” authority. Such authority, according to a statement released by the National
Marine Merchants Association (NMMA), would allow the Coast Guard “to streamline approval of the recreational boating industry construction standards and new technology, while maintaining the highest level of safety.” The federal legislation would also address Coast Guard funding whenever a government shutdown is in effect. “Currently, the Coast Guard is the only branch of the Armed Services that has a lapse in appropriations during a government shutdown, but this legislation would ensure that members of the Coast Guard continue to receive a paycheck The Coast Guard Reauthorization Act would have an effect on recreational boaters, if passed and signed into law. NEW YORK CITY—Three years after the body of a young woman was discovered along the shores of New York City, volunteers cleaning the coast recently made a jaw dropping discovery. The Charleston, S.C.-based nonprofit Wounded Nature reports volunteers found a human jawbone while cleaning up a marsh along the Jamaica Bay shoreline in May. The nonprofit works year round to remove debris from hard to access coastal areas. Police were called and confirmed it was human and handed the appendage off to

NY Gov. signs law requiring all powerboat drivers take safety course ALBANY, New York—All power boaters in the state of New York will need to take a boating safety course by 2025 before taking the helm. New York Governor Andrew Cuomo signed Brianna’s Law, Aug. 6. It goes into effect Jan. 1, 2020 and will be phased in over five years. Rudy Socha, the CEO of Wounded Nature, said they have found a lot of unique items during past cleanups but nothing like this. “Finding this jawbone is the most unusual item we have found so far,” Socha said in an email. Australia wins SailGP event in England COWES, England (LOG NEWS SERVICE)—In extreme conditions at the European debut of SailGP, Australia’s Tom Slingsby proved once again that he is the one to beat in the league’s first season. The Australia SailGP Team dominated the field with a sweep of the races while becoming the first crew to break the 50-knot speed barrier in sail racing. Races scheduled on Saturday, Aug. 10 were cancelled because of strong winds, which reportedly gusted to 50 knots.

LOCAL Neal Confirmed for Long Beach Harbor Commission LONG BEACH—The Long Beach City Council on Aug. 6 voted unanimously to confirm Mayor Robert Garcia’s appointment of Steven Neal to the Board of Harbor Commissioners. He was appointed to a sixyear term through June 2025. He is replacing Commissioner Lori Ann Guzmán, whose term began in December 2013 and ended Aug. 12 when she left for a new position as the city manager of Costa Mesa. Neal’s first meeting as a Harbor Commissioner is scheduled for Aug. 26. Neal is a former City Council member who represented the 9th District from 2010 to 2014. He is the senior pastor for LIFE Gospel Ministries and a longtime leader in the Long Beach community. He has served on the Long Beach Transit board and the Pacific Gateway Workforce Investment Network board and was chairman of the Measure A Citizens’ Oversight Committee. He is also co-founder of the Economic and Policy Impact Center, a new nonprofit agency working to advance economic opportunity for working families.

In front of a packed crowd on Sunday Slingsby set a new sail racing speed record, clocking in at 50 knots while crossing the finish line of the first race. Earlier in the week, the Australian team sustained damage to its wing in practice and was unsure whether it would be able to race, but Sunday morning saw all damage repaired and Slingsby raring to go. The United States SailGP Team capsized within 30 seconds of the start of race one, but surprisingly was able to compete in the rest of the day’s racing with quick assistance from the SailGP tech team. The Great Britain SailGP Team wasn’t as lucky. On the second to last leg of the first race, the team dug its bow into the water, sending flight controller Chris Draper tumbling over Stuart Bithell in a dramatic crash. No injuries were sustained; however, the boat was too damaged to continue sailing. After four events Australia tops the leaderboard with 169 points followed closely by Japan with 165. The United States team is in third place with 123 points. SailGP’s final stop for Season 1 is Sept. 20-22 in Marseille, France with three full days of competition planned, including an ultimate winner-takes-all match race between the two top teams for the SailGP championship trophy and a $1 million purse.

By Lindsey Welling MARINA DEL REY—This photo of Marina del Rey in 1956 comes courtesy of the Marina del Rey Historical Society. It shows an aerial view of what then mostly wetlands and is now Marina del Rey and its harbor. The dream for that harbor dates back to 1887 when a developer named M.L. Wicks sought to create a commercial harbor for the city of Los Angeles from the estuary and inlets of the village of Playa del Rey. His company went bankrupt before the dream could
be realized. Despite periodic renewed interest from various governmental and private developers in creating a harbor, it wouldn’t be until 1949 that plans would be revived and seriously pursued. Formal dedication of the Marina del Rey Harbor was held on April 10, 1965. Marina del Rey continues to evolve today, with projects constantly ongoing. NEWPORT BEACH—If a newspaper or any other media outlet doggedly asks whether a simple action or decision was authorized but the questions lead to, well, more questions, then has the publication/outlet reached a point whether the efforts to seek answers isn’t worth the paper these words are printed on? We here at The Log, as you might be aware of by now, have spent the past few weeks persistently asking whether a Sheriff’s Department lieutenant – Christopher Corn – had the authority to change the time limit on a set of docks in
Newport Beach from 72 hours to 20 minutes. We presented a legal question or two in the previous issue of The Log. Our questions were not answered prior to press time – but they were answered, eventually. A public information officer with the county sent us a section of the Orange County Code, showing us someone did indeed have the power to make time limit changes to the public docks in Newport Beach. A careful analysis and interpretation of that code – and others – however, still does not fully answer whether Corn had the specific authority, without explicit direction from the proper channels, to drastically reduce how much time boaters had available to access a set of public docks at Newport Beach Harbor. Title 2 of the Orange County Code addresses the maintenance of public facilities. James Keating, the first keeper of Point Loma Lighthouse, owned the shipyard responsible for building the first boat in San Diego. The schooner was, at the time, the largest merchant vessel in the world, according to the Los Angeles Herald. • Aug. 23, 1800: Betsy, reportedly the first American ship, arrived in San Diego under the command of Capt. Charles Winship. • Aug. 30, 1910: Omega, a German ship, arrives in San Diego after being at sea for 157 days. The cargo ship departed out of Newcastleon-Tyne, England, according to the Los Angeles Herald. “The Omega was forced to lay outside most of the day because of the inability of the tug to locate her in the dense smoke that hangs over this city for a considerable distance out to sea,” the Herald reported. “San Diego Bay has been hidden in the pall since Saturday afternoon, and it is claimed the smoke is from the big fires that have been raging in Montana, Idaho, Oregon and Washington. What’s On Tap: Long Beach will decommission an existing storm drain pipe and install a new concrete storm drain along Seaside Way, between Chestnut Avenue and Golden Shore. “The existing approximately 58-inch concrete storm drain pipe was damaged during rain storms in 2017, which flooded the area,” Coastal Commission staff stated in a report to commissioners. “Construction of the new storm drain pipe involves trenching, temporary shoring installation, protection of existing utilities, potential dewatering, and replacement of pavement.” Construction work could be a factor for those who drive in and out of Downtown Long Beach’s two marinas: Rainbow and Shoreline. “The proposed storm drain system is designed to capture and convey water associated with a 50-year storm event, which the applicant described is the standard in the Los Angeles region,” Coastal Commission staff stated. “If capacity is exceeded, excess water will be contained within the street right-of-way, which will either slowly drain back into the system or be pumped out of the street using a portable pump.” The approved project also calls for the construction and maintenance of two manholes.

AB 552 proposes to provide guidance and funding for implementation of climate change and sea level rise action items. By Parimal M. Rohit
SACRAMENTO—State legislators are back in session after their summer break and putting the final touches on legislation before voting on them and potentially sending those proposals to Gov. Gavin Newsom for signature or veto. One of those proposals is Assembly Bill 552 (AB 552), which would authorize the state to spend money on implementation of sea level rise and coastal climate change programs. AB 552 was amended in a State Senate committee on Aug. 12; the bill was then re-referred to the upper house’s Appropriations Committee. A scheduled hearing on Aug. 7 was postponed to allow for the amendments. “This bill would establish a program and direct specified revenues to it for the purpose of funding certain scientifically-sound activities in order to help the state address coastal climate adaptation and resiliency,” a legislative
analysis of AB 552 stated. The program – Coastal, Adaptation, Access, and Resilience Program – would direct public funding to activities intending to help state officials prepare, plan and implement actions to address and adapt to sea level rise and coastal climate change, according to a legislative analysis of AB 552. Funding would be directed to agencies such as the California Coastal Commission, California Natural Resources Agency, California State Parks, Coastal Conservancy, Ocean Protection Council and the State Lands Commission. These agencies, according to a legislative analysis of AB 552, would receive funding “to take actions, based upon the best scientific information, that meet the program’s objectives.” At least 30 percent of funding allocated to the State Lands Commission, beginning in Fiscal Year 2020-2021, would be available to the agency to use for the preparation and adaption program created by AB 552 (should it become law). Assemblymember Mark Stone introduced AB 552 earlier this year and is a descendant of the California Global Warming Solutions Act of 2006. sea level would lead to an estimated $48 billion in coastal property damages in the state,” Stone said in a statement. “AB 552 establishes the Coastal Adaptation, Access, and Resilience Program (CAARP) to support coastal protection and climate resilience measures. The measure requires that at least 30 percent of the state’s annual Tidelands Oil Revenues are directed into the CAARP fund starting in fiscal year 2020-21. “When it comes to adaptation and resilience measures, the cost of inaction is far greater than the cost of early investment,” Stone continued. Legislative analysts called climate change a “near-existential threat to California” and acknowledged there are multiple proposals aiming to address climate change adaptation and resiliency. An analysis of AB 552 also acknowledged more information is needed on costs and risks associated with action versus inaction on possible climate change events. “The Fourth Assessment provided an ‘order of magnitude’ estimate of annual costs of [more than] $100 billion annually by 2050, and cautioned about the underlying uncertainty in its result,” a June analysis of SB 552 stated. “One of the challenges in performing the economic projections is accounting for the costs of extreme events that may occur with increasing likelihood. Models need considerable improvement to quantify the risk appropriately. “Gaining a better handle on direct costs does not necessarily mean that indirect costs – such as a major utility declaring bankruptcy due to a wildfire – will be appropriately estimated,” the June analysis of AB 552 continued. Audobon California was a sponsor of AB 552; other groups expressing support for the bill included California Coastal Commission, California State Parks Foundation, the city of Long Beach and Sierra Club California. No formal opposition to the bill was found on record.

Port of San Diego Commissioners approve lease for Bayside Performance Park The 3.68-acre park will have a permanent outdoor stage for the San Diego Symphony as well as the opportunity for other events. By Lindsey Welling
SAN DIEGO—Construction is planned to get started in September for an outdoor performance venue on a San Diego marina waterfront. The Port of San Diego’s Board of Port Commissioners, on July 24, unanimously approved a lease for the San Diego Symphony Association’s Bayside Performance Park on a 3.68acre area in the northwest section of Embarcadero Marina Park South. The lease includes three 10-year options and one five-year option, allowing the association to lease the park for up to 50 years. The association currently uses the park land between the Marriott Marquis Marina and Fifth Avenue Landing for its Bayside Summer Nights concert series, which it started in 2004. The newly approved lease will provide a permanent home for the program in the same area, allowing the symphony to offer up to 55 full-day or 110 half-day events each year, year round. Currently, the events are only held between June and September. According to the lease, there will be unrestricted public access to Bayside Performance Park at least 85 percent of each year, with paid admission and rental events taking up no more than 15 percent per year. “This partnership with the Symphony will support the port’s goals of a vibrant and active waterfront,” Port Director of Real Estate Tony Gordon said at the July 24 meeting. Bayside Performance Park will feature a permanent outdoor performance stage with 10,000 seats and acoustic shell. It will also feature two pavilions for food, retail and/or other
services, a 42-inch-tall perimeter fencing and restrooms. Boaters docked at Fifth Avenue Landing and Marriott Marquis Marina would be able to watch or listen to concerts at Bayside Performance Park while aboard their vessels. The San Diego Symphony will also invest a minimum of $45 million in improvements, including maintenance and repair, landscaping, traffic and parking management and security 24 hours a day, seven days a week. The symphony will also contribute improvements to the rest of Embarcadero Marina Park South. Those plans include widening the existing public promenade around the perimeter of the Bayside Performance Park. In additional to its ticketed concerts, the symphony will also offer free programming including rehearsals, music lessons, educational workshops and movies. CEO of the San Diego Symphony Orchestra Martha Gilmer expressed her excitement for the venue at the July 24 meeting. “San Diego Symphony has dreamed for many, many years of a permanent venue on the bay, one that would be both the home for the symphony but also a destination for and a gift for our entire community.” Gilmer said. The commissioners all expressed their support for the project at the meeting. “It is a wonderful vision by the symphony leadership that will quickly become reality for everyone’s enjoyment,” Board Chairman Garry Bonelli said. The only concern raised was what some commissioners called an ambitious construction timeline. Orchestra officials say they plan to start construction in September with the goal of opening Bayside Performance Park in the summer of 2020. The lease agreement requires construction to be complete no later than November 2021.

MARINA DEL REY—Southern California’s 2019 summer boating season is more than two months old now but it’s never too late to talk about boating safety. L.A. County’s Sheriff’s Department offered a brief public service announcement about boating at the June 12 Small Craft Harbor Commission meeting in Marina del Rey. The quick presentation offered what one deputy considered as obvious but necessary reminders of what boaters need to do to be as prepared as possible while out on the water. Dep. Glenn Maska told members of the Small Craft Harbor Commission he and his colleague see several major faux pas whenever they patrol the waters of Marina del Rey. “You don’t want to have an emergency happen and not be ready for it,” Maska said. “You’d be surprised how many people think it’s easy to put on a life jacket for kids. But if you have an emergency and the boat capsizes, they got to have your life preservers on ahead of time.” Maska said his department has started issuing citations instead of
warnings to boaters who were observed as not following various safety protocols. He added law enforcement officials in Marina del Rey have observed excessive use of speed in the harbor. “Watch the wake. People don’t think their wake really does a lot. It can cause damage to the dock vessels,” Maska said. Boaters should also have all the necessary equipment aboard their vessels, Maska added. By Lindsey Welling NEWPORT BEACH—It will be a few more months before recommended changes to Newport Beach’s Title 17 – Harbor Code, go before the City Council for approval. At the Aug. 14 Newport Beach Harbor Commission meeting, Assistant City Manager Carol Jacobs delivered a staff report on those proposed changes. The written report recommended the commission authorize staff to push recommended changes to Title 17 on to the City Council, but Jacobs revised that at the meeting. She requested the commission and public give input and the draft be sent back to the committee. “There is more work to do,” Jacobs said. “I’m going to recommend we slow this process down a little bit so that we
get it exactly right.” Highlights of the drafted changes include clearly defining liveaboards in commercial marinas, limiting the number of live-aboard permits at commercial marinas to seven percent of slips, requiring operable marine sanitation devices and dye tablet testing and requiring each live aboard permittee to contract with an authorized commercial pumpout service at a minimum of twice a month. It also clears up the process for getting harbor development permits. Three community members spoke on the topic at the Aug. 14 meeting. All questioned the requirement that liveaboards be required to contract with an authorized commercial pumpout service at a minimum of twice a month. Many expressed the sentiment that they routinely and responsibly use pumpout stations. “The other consideration with the required twice a month contracted pumpout service is that each situation is different,” Herman Coomans said in a July 24 email to the commission. “There are single people with large holding tanks, families with small holdSee NBHC UPDATE page 12

ing tanks and people off their boats for days, even weeks at a time.” The proposed change is part of an effort to keep the bay clean. A revised timeline for changes to Title 17 given at the Aug. 14 meeting gives an estimated commission review date of Oct. 9 with it moving onto a study session at the City Council on Oct. 22. The timeline estimates the changes would take effect in January 2020 if approved by the council. “This will come back to ad hoc,” Commissioner Bill Kenney said. “Once we are ready to sign off, it will come back to the full commission.” According to the staff report, an ad hoc committee comprised of Commissioners Paul Blank, Bill Kenney and Don Yahn has been working for months to review Title 17. The City Council requested the Harbor

such facilities in a manner that will permit the greatest public use and avoid continuous occupancy, congestion or blocking thereof,” the county code reads. “Where necessary to achieve public use and avoid extended occupancy, congestion or blocking thereof, the director is authorized and directed to post signs limiting the time during which a vessel may be docked or supplies or gear may be placed at or on any such pier or facility.” The code section’s mention of “director,” we’ve confirmed, is a reference to the official head of Orange County Parks: Stacy Blackwood. Section 2-2-134 continues: “When such sign is in place giving notice of such time limit, no person shall dock a vessel at any such facility for a period of time longer than posted or permit any supplies or gear to remain on such facility for a period of time longer than posted.” The three sentences of this code section make it clear the timings of dock use could be limited, especially if there is any sort of public nuisance – blocking, congestion, extended occupancy, etc. – caused by boaters. This interpretation of the code is black-and-

The code specifically states the person who has the authority to place stricter time limits on public dock use is the “Director.” This director (Blackwood) is not a member of the Sheriff’s Department. The code section, just the same, does not specify whether the referenced director transfers his or her authority any member of the Sheriff’s Department. So the question still remains of whether Corn had the authority to change the dock time limit from 72 hours to 20 minutes. A strict interpretation of Section 2-2-134 of the Orange County Code clearly indicates Corn could not have made the change on his own accord – at minimum he needs a mandate or direction from the referenced director (Blackwood). It’s really a question of whether Corn could act on behalf of Blackwood. Section 2-2-31 of the Orange County Code discusses Blackwood’s powers and duties. Blackwood is, among other things, permitted to “plan, organize, direct and control the work as it pertains to the development, main-

tenance, control or operation of the county’s regional harbors … and recreational area.” She also has the power to “enforce the laws, ordinances, traffic and safety regulations covering usage of county harbors, waterways … and recreational areas.” Another section of the code – 1-2-65 – discusses the limitation of authority of the County Executive Office. “No provision of this article is intended to vest in the County Executive Officer any duty or grant to him or her any authority which is vested by law in any other county officer or employee,” Section 1-2-65 of
the county code reads. “Nothing herein shall be construed to delegate to him or her any authority or duty required to be performed by the Board of Supervisors. The County Executive Officer shall have no power to bind, obligate or commit the County of Orange or the Board of Supervisors in connection with any contractual obligation.” Could this section be interpreted in such a way as to limit the delegation of authority from one county employee to another? Put in a more simpler way: does this section restrict Blackwood from authorizing Corn to unilaterally limit public dock usage?
TAKE ACTION It could be argued, in the grand scheme of things, our continued analysis of the public docks issue in Newport Beach is small potatoes. A small fraction of the population is actually affected by the public dock time restriction. Boaters are now allowed to dock at the place in question between sunrise and sunset. So why is The Log persisting with this story? Simple: if Corn was not authorized to act unilaterally and without direction in regulating the amount of time boaters had available to them at Newport Beach’s public docks, what else, beyond the scope of his authority, could he be deciding? Our government has a specific process in place. The process might be annoying but it’s in place to prevent abuses of power and maintain accountability and transparency. We need answers here to determine whether the Sheriff’s Department – and Orange County, for that matter – is following protocol and not abusing the powers it doesn’t have. AVALON—More than one month after Avalon City Council member Richard Hernandez resigned, his seat on the council remains empty. City Clerk Denise Radde delivered the news Hernandez had resigned shortly after roll call at the city council meeting on July 16. Radde read Hernandez’s resignation letter at the Aug. 6 council meeting. In that letter, Hernandez said, “Dear Denise, it is with strong feelings of regret I find that for personal reasons I must submit this letter of resignation as a member of the city council, effective immediately. I thank you for your support over the years in my role and I wish you, the mayor and the councilmembers every success as they move forward.” Hernandez, as of Aug. 19, had not return calls from The Log, which were made on Aug. 8 and Aug. 15; each call was made to seek comment on the reason for his resignation. The council did not discuss plans for how to fill the vacant seat during the Aug. 6 meeting. A discussion about
filling the vacant seat was not on the Aug. 20 agenda. Rohit EUREKA—Plans to remove and replace a private marina in Newport Beach were approved by the California Coastal Commission, Aug. 8. The updated Lido Marina will be 5,358 square feet in size, almost 1,000 square feet smaller than the current marina. Also to be included in the new marina are an Americans with Disabilities Act (ADA) compliant gangway (400 square feet) and ADA compliant gangway platform (80 square feet). A 175-square-foot cantilevered public boardwalk attached to Lido Marina will remain in place, according to Coastal Commission staff. Coastal Commission staff added the project, overall, “avoids adverse impacts to marine resources” while “enabling recreational boating” and allowing the marina currently in place to be “usable.” Yet the project could be problematic to water quality, according to a Coastal Commission staff report. “The proposed project, because of its location over the water, has potential for adverse impacts to water quality and marine resources during construction and post construction. Therefore, special conditions have been imposed in order to minimize any impacts to water quality and marine resources,” Coastal Commission staff stated in a report to commissioners. The project applicant – Batavia Business Park LLC – is required to manage and remove marine debris during construction and submit a Marina Management Plan under the Clean Marina Program. Public access was also a point of contention between the Coastal Commission and Batavia Business Park. “The main point of disagreement between commission staff and the

applicant concerns public access. The proposed project consists of replacement of a private marina over and in Newport Bay, which is public tidelands managed by the city of Newport Beach,” Coastal Commission staff stated in a report to commissioners. “The proposed private development would interfere with future development of a public boardwalk along this portion of Lido Marina Village/Lido Marina, which is a priority of the city’s certified LCP and would provide valuable public access to and along coastal waters.” The Coastal Commission imposed upon Batavia Business Park a requirement “to submit revised plans acknowledging the potential future expansion of the lateral public accessway in Lido Marina Village … and to redesign the proposed gangway platform and gangway so that the structures do not interfere with, and can accommodate, potential future expansion of an unobstructed lateral public access way.” Representatives of Batavia Business Park told Coastal Commission staff the marina, which measures 6,344 square feet in size, must be replaced because “the docks are in disrepair.” Lido Marina has been a private visitor-serving commercial marina since 1955. It is one of the largest private commercial marinas in Newport Beach Marina, according to Coastal Commission staff. “The marina accommodates a variety of uses, from individual recreational users to chartered functions,” Coastal Commission staff stated. “The portion of the marina proposed to be redeveloped on the subject site is located at the eastern extent of Lido Marina and ends in the area where landside development transitions from commercial development to residential development. “The docks located at the subject marina are rented out to the public and will continue to be if the commission approves the project,” Coastal Commission staff continues. “No See BATAVIA MARINA page 17

Rohit EUREKA—California Coastal Commission Executive Director John Ainsworth identified sea level rise as a “slow-moving disaster” during the quasi-judicial agency’s November 2018 meeting. He added rising ocean waters is a “real problem,” an issue private and public entities alike had to begin addressing as soon as possible in order to minimize the effects of sea level rise (and other related climate change events). Ainsworth expressed an urgency to address the future effects of sea level rise nine months later, this time informing commissioners and the public of a series of briefings and presentations the Coastal Commission will be making in an attempt to plan for one of the most discussed and analyzed climate change events. Sea level rise, if any number of projections are actually realized between now and 2100, would certainly affect Southern California’s many harbors and marinas. “This will be the first in a series of informational briefings that we are planning in order to highlight and break down the different aspects of sea level rise science and adaptive planning management strategies and policy approaches to deal with sea level rise,” Ainsworth said, addressing the first part of the briefing series. Humboldt Bay – which is home to Northern California cities such as Arcata, Blue Lake and Eureka – was the focus of the first briefing, which was on Aug. 9. The planned discussions would also, according to Ainsworth, identify “significant challenges we and local governments are facing and planning for sea level rise and climate change.”
Ainsworth added the informational briefings would actually allow the commission to have the most expansive discussion possible on sea level rise, as commissioners and staff members wouldn’t be limited to the four corners of a paper when considering a specific agenda item, such as a permit consideration or public hearing. SAN DIEGO—Community volunteers, Port of San Diego staff and tenants and law enforcement groups are teaming up to take on trash in and around the San Diego Bay. The San Diego Port Tenants Association (SDPTA) is holding its annual Operation Clean Sweep Saturday, Aug. 24 at 8:30 a.m. and is looking for boaters, walkers and divers to volunteer for the bay cleanup event. This year’s event is expanding to four of out of five San Diego Bay cities: San Diego, National City, Coronado, and Chula Vista. There will also be one additional cleanup site this year, making the total number of sites 19. The public is invited to join cleanups at Barrio Logan, Chollas Creek, Half Moon Marina, Marina View Park and Pepper Park. All the sites are family orientated, except Chollas Creek, which is recommended for adults only. Port staff and tenants, local businesses, military members and Harbor Police will also be participating. SDPTA reports that in 2018, 1,225 volunteers hauled 46,830 pounds of trash from 18 sites on the San Diego Bay. The amount of trash collected last year was almost double the nearly 24,000 pounds hauled out of the water

All volunteers are invited to an after party at Cesar Chavez Park from 10:30 a.m. to 12:30 p.m. There will be a taco stand, drinks, raffle, photo booth, live DJ and more. Volunteers must wear their Operation Clean Sweep t-shirt to get free entrance to the after party. Operation Clean Sweep was created in 1990 by the Marine Trades Association with the goal of providing an opportunity for people to get out on the San Diego Bay while providing a service to the waterfront community. In 1999, the Marine Trades Association merged into SDPTA, which took over the event.

AVALON—Catalina Island’s historic Hotel Atwater is on the cusp of celebrating its 100th birthday, but don’t let its age fool you, things are still roaring at the 1920s-built hotel. The seaside property in Avalon has been under renovation since January 2018. The Catalina Island Co. announced renovations have been completed and the hotel, as of Aug.11, reopened. Guests are now welcomed by a more spacious lobby with seating areas and new amenities including a fully equipped meeting and event space for gatherings of up to 65 people. The guest rooms feature larger bathrooms and high-tech comforts including digital concierge tablets, Wi-Fi and smart televisions. Each room has new island-inspired décor with a nod to the Art Deco style of the era in which the hotel was built and nostalgic elements to reflect the Wrigley family. War Heroes on Water Reception in Newport Beach NEWPORT BEACH—LoanDepot Founder and CEO Anthony Hsieh hosted the second-ever War Heroes on Water (WHOW) reception kickoff at his house in Newport Beach on Aug. 15. The reception raised money for a sportfishing tournament for Hsieh and decorated military veterans. Hsieh takes the veterans on a two-day sportfishing trip in Cabo San Lucas. The sportfishing tournament kickoff celebration was attended by 400 people and featured a silent auction. Funds raised by the auction benefit the WHOW’s tournament and veterans. Luxury vacation collections, custom artwork and sets for anglers and golfers were auctioned off during the Aug. 15 reception; more than $75,000 was raised that evening, bringing the total amount of donations for the tournament to more than $500,000 – an amount five times greater than what was collected at the inaugural War Heroes on Water event, held last year. Catalina Connection Competitors to take on Catalina Channel in outrigger race AVALON—Men and women will take on miles of open ocean in a canoe race between Newport Beach and Catalina Island. The annual Catalina Crossing returns Sept. 7 and 8 for its 60th year. Women and some coed teams participating in the U.S. Outrigger Championships will paddle 26 miles from Newport Beach to Avalon on Saturday, Sept. 7. The next day, men and some coed teams will start their 30-mile race back to Newport Beach from Lovers Cove. The event is organized by the Southern California Outrigger Association. Each team consists of nine members with six people paddling, including one steersman who sits at the back of the boat and has a special role in keeping the canoe on track. The canoe is followed by a chase boat, which pulls alongside the canoe every 15 to 20 minutes to swap out three paddlers. Last year, it took teams between about three hours and 45 minutes to five hours and 45 minutes to finish the race. The women’s race on Saturday will end with Hawaiian festivities at the

Boats race into Mission Bay for San Diego Bayfair By Lindsey Welling
SAN DIEGO—Boats will speed into Mission Bay when the San Diego Bayfair returns for its 55th year, Sept. 13-15. The competitive powerboat racing event typically draws tens-of-thousands people over the three-day span. H1 powerboats will take on a 2.5-mile racecourse, said to be the longest and fastest racecourse on the H1 Unlimited hydroplane circuit by the San Diego Bayfair website. The boats can reach speeds of nearly 200 mph, producing a massive 60-foot tall, 300-foot long wall of water called a “roostertail” behind them. The course is named after late hydroplane racer Bill Muncey, who is credited as the driving force in creating the race in 1964. Spectators can purchase an RV package to spend four days and five nights on East Vacation Island, Crown Point or Fiesta Island to watch the races. It is the only time of year for beach camping on East Vacation Island. The event will also feature food and merchandise vendors, live music and a barbecue competition with a beer garden. Spectators will be able
to watch the boat races while enjoying barbecue samples from America’s Finest BBQ state championship on Sept. 14. The KCBS sanctioned competition will take place at Crown Point from 11 a.m. until dusk. Samples will be available starting at noon and until they run out. Proceeds from the barbecue competition will benefit first responder charities, with this year’s title recipient being the San Diego Police Historical Association. San Diego Bayfair tickets for Friday cost $20, while Saturday and Sunday tickets are $30; a three-day pass costs $45. Parking runs $10-$20 per day. VIP packages are also available. LIMA, Peru—United States sailors won seven medals at the PanAm Games, which was held in Lima, Peru through Aug. 11. Two of the seven medalists were sailors from Southern California: Riley Gibbs (Long Beach) and Charlie Buckingham (Newport Beach). Gibbs won gold in the Mixed Nacra 17 class with her teammate, Anna Weis (Ft.
Lauderdale, Florida). Buckingham, meanwhile, earned a bronze medal in the Men’s Laser class. Gibbs and Weis earned a country qualification for the 2020 Summer Olympics in Tokyo, Japan. Competition was cutthroat, as the number of countries seeking a spot for sailing events at the 2020 Games exceeds the number of slots available to compete for a medal. “There are far more countries competing in Olympic class boats than there are available spots at the Games,” U.S. Sailing staff said in a released statement. “Therefore, athletes must first secure a berth for the United States in their chosen class before they are eligible to
qualify as individuals to Team USA. LONG BEACH—Ocean and bay course classes will compete against each other in the Labor Day Regatta, Aug. 31 and Sept. 1. The two-day sailing event will feature the Laser District 25 Championship and SCYYRA Ullman Frost Regatta. Alamitos Bay Yacht Club is the organizing authority for the regatta. The following ocean course classes are eligible to compete in the Labor Day Regatta: 29er, 5-0-5, A-Cat, C-15, Cal 20, Etchells, Finn, Formula 18, Hobie 16, I-14, Laser Standard, Laser Radial, Laser 4.7, Mercury 18, Nacra 15, Open Bic-Ocean, Optimist, Portsmouth (monohull and multihull), Shields, Snipe, Tempest, Thistle and Viper 640.
Bay course classes, such as Naples Sabot (Senior, Junior A, B, C1, C2, C3), Lido 14 (A, B), Open Bic-Bay, RS Tera and Optimist Green, are also invited to compete. “Additional One-Design classes will be accepted at the discretion of the Regatta Chair based on the number of entries and the classes that are established,” according to the official Notice of Race. Entry fee is $50 for ocean classes before Aug. 25 and $60 afterwards. Those competing in the Ullman Frost Regatta will pay an additional $10. Bay course classes are on the hook for a $40 fee prior to Aug. 25 and $50 afterwards. Juniors younger than 18 are entitled to a $5 discount in fees; U.S. Sailing members are offered a fee discount of $3. Nine bay course and seven ocean course races are scheduled during the regatta. The first-race warning signal will be at 11:57 a.m., both days. No races will begin after 3 p.m. on Sept. 1. Racing for ocean classes will take place in Long Beach Harbor, behind the federal breakwater. Alamitos Bay will be
home to all bay class racing. A competitors’ meeting will be held at 10 a.m. on Aug. 31 for ocean classes and 10:30 a.m. for bay classes. SAN DIEGO—The San Diego Olympic Classes Regatta is returning for a second year, giving some aspiring Olympic sailors the chance to compete in international, high-performance classes. Nine fleets have been invited to San Diego for the second annual San Diego Olympic Classes Regatta (SDOCR), Sept. 7-8. The invited fleets are 29er, 49er, Finn, I420, Laser, Laser Radial, Nacra 15, Star and Snipe. The regatta will include two courses in Coronado Roads, allowing for national level management and competition. San Diego Yacht Club, with the 2028 Los Angeles Olympic Summer Games in sight, introduced the event last year to provide a venue for sailors to train and compete in international, high-performance classes. Brothers Ian Nyenhuis, 12, and Noah Nyenhuis, 14, were among the winners
from the 2018 event. Noah told SDYC the event is getting him closer to his goal of making it to the Olympics, by bringing together sailors in Southern California to race at some of the highest levels. “My goal for the future is to go to the 2028 Los Angeles Olympics with my brother, Ian,” Noah told SDYC. In addition to the SDOCR, the Snipe Fleet will be doubling the regatta as their Snipe North American Championship. The Snipe North American Championship will begin on Friday, Sept. 6. DANA POINT—Dana Point Yacht Club is again hosting a charity regatta to benefit the South Orange County city’s 5th Marine Regiment Support Group. The yacht club will be hosting the 21st annual Richard Henry Dana Charity Regatta, Sept. 14 and 15, with the hopes of raising money for the 5th Marine Regiment Support Group for a second year in a row. This year’s regatta features several events, such as the Marine Corps Twilight Fishing Tournament, standup paddleboard races, youth and adult dinghy racing, silent auctions, yacht racing, a VIP/sponsor cocktail reception and a regatta gala/race party with entertainment. Local charities have received more than $750,000 from the Richard Henry Dana Charity Regatta through the years, according to Dana Point YC staff. The Richard Henry Dana Charity Regatta will be a Category C event, according to the Notice of Race; the regatta is open to all boats in the PHRF Spinnaker, Non-Spinnaker and multihull classes. Anyone who raises $1,000 or more will have his or her entry fee waived; the skipper will receive tickets to the Mount Gay Rum Party and be granted sponsor benefits for the amount of donations received. Ratings for Spinnaker and NonSpinnaker classes will be adjusted based upon the amount of money raised by each team. The adjustment is as follows: • $100 = +2 seconds • $200 = +4 seconds • $300 = +6 seconds • $400 = +8 seconds • $500 = +12 seconds • $750 = +18 seconds • $1,000 or more = +30 seconds. A continental breakfast will be available from 8-10 a.m. on Sept. 14; the skippers’ meeting will be held at 8:30 a.m. The first warning signal will be at
11:55 a.m., followed by the Mount Gay Rum Party and Auction after racing. The first warning signal for Sept. 15 will also be at 11:55 a.m. Trophy presentations will take place after racing on Sept. 15. Four races are scheduled for the Spinnaker fleet, and two races for the Non-Spinnaker fleet. The 5th Marine Regiment Support Group provides civilian assistance and support to members of the 5th Marine Regiment, who served out of Camp Pendleton just south of San Clemente, and their families. SAN DIEGO—The San Diego Council of Bass Clubs (SDCBC) recently donated $9,000 to three local charities. Rick Fallon, who is the secretary of the freshwater bass fishing organization, said in May they presented $3,000 checks to the ALS Association San Diego Chapter, Rady Children’s Hospital and Warrior Foundation Freedom Station. Fallon said SDCBC donates to local charities every year but this year they were able to give a little bit more. He said SDCBC started a fund sometime in the 1990s for someone in the San Diego bass fishing community with Amyotrophic lateral sclerosis (ALS). People from within SDCBC and several other local organizations donated to the fund over the years; the fund was intended for the family to help cover medical costs. Fallon said they donated the left over funds. ALS Association was selected, according to Fallon, because they wanted to find an organization that helps people with the disease. Fallon said 95 percent of donations to the organization go to people with ALS. “So much of the money goes
straight to the people,” Fallon said. They also donated to an organization SDCBC President Bill van Wulven has continually supported over the years, the Warrior Foundation Freedom Station, which is a recovery-focused transition center and housing facility that provides injured warriors with acclimation time, guidance and resources to successfully make the transition from military service to civilian life. Diver awarded for locating SoCal’s few white abalone SOUTHERN CALIFORNIA—The National Oceanic and Administrative Administration (NOAA) gave an award to diver Amanda Bird of Paua Marine Research Group for locating some of the few remaining white abalone locations off the Southern California coast, it was recently announced. Bird earned the Species in the Spotlight Partner Award from NOAA Fisheries for her efforts in spotting various white abalone locations as a professional diver. The white abalone is a critically endangered species. “White abalone is one of just eight species we’ve identified nationwide for the Species in the Spotlight program,” Sam Rauch, NOAA Fisheries’ Deputy Assistant Administrator for Regulatory Programs said in a released statement. “Thanks to assistance from our partners like Amanda, white abalone recovery is on the verge of being a great success.” The NOAA Fisheries Species in the Spotlight program, according to the federal agency, is an “initiative to bring imperiled species back from the brink of extinction. “Part of the challenge in restoring white abalone to its native rocky reef habitat off southern California is finding wild white abalone for breeding in captivity. Bird has applied her diving expertise along the California coast and knowledge of abalone habitat specifically to find and collect several wild specimens in partnership with NOAA Fisheries,” an official statement about the award and Species in the Spotlight program stated. A breeding program for white abalone is also underway at Bodega Marine Laboratory, according to NOAA Fisheries. Scientists at the laboratory are reintroducing

Bird’s work, according to NOAA Fisheries, has helped scientists and researchers monitor and track white abalone once they’ve been reintroduced into the wild. “Intensely harvested in the 1970s for their culinary value, white abalone all but disappeared from the wild in the 1990s. NOAA Fisheries listed them as endangered in
2001, but they have shown few signs of recovery,” NOAA Fisheries staff said in a released statement. “The Agency’s Species in the Spotlight initiative has heightened attention and focused efforts on recovering the species,” NOAA Fisheries staff continued in its released statement. “Researchers hope that reintroducing progeny of the captive breeding program into the waters off Southern California as early as this fall will be a turning point for their recovery.”

Tuna Update: Yellowfin Surges, Jumbo-Sized Bluefin Biting By Bob Vanian
SAN DIEGO—The 2019 Southern California offshore fishing season has seen a break out rally on the yellowfin bite. The past week of fishing seeing some near limit to limit catches of yellowfin tuna being posted. In addition to the yellowfin bite, offshore anglers have also been catching bluefin to 300-plus pounds along with some pretty good numbers of kelp paddie yellowtail, a few striped marlins and some Dorado. The yellowfin have been running from 8 to 40 pounds, with most falling within the 12- to 18-pound range. The good yellowfin bite zone has been around some of the offshore banks within 40 miles or so from Point Loma while fishing areas such as the 224 Spot, the 230 Spot, the 371 Bank, the San Salvador Knoll and the 390 Bank. Those same areas where the yellowfin are being caught have also been producing a mix of the 20- to 40-pound bluefin tuna, some kelp paddie yellowtail and a few Dorado. Most of the yellowfin and the 20- to 40-pound bluefin in the mix with the yellowfin have been caught on sardines after stopping the boat alongside of some breaking fish, puddling fish, breezing fish, a meter mark, a kelp paddie or a sonar mark. Most of the stops are “plunker” bite stops where you drift and chum and keep a hookup or two going during a long drift. It usually helps anglers draw strikes on the sardines in these situations by using 15- to 20-pound test fluorocarbon leaders and small hooks. In other areas, there are also occasional yellowfin tuna caught from around the 9 Mile Bank and boats fishing around some of the banks up toward Catalina report seeing signs of yellowfin and getting some tuna meter marks while fishing areas such as the 181 Spot, the 209 Spot and the 277 Spot but not much is being caught. Kelp paddies in these same areas are also sometimes holding a few yellowtail or Dorado. Reports from the Mackerel Bank and the 289 Spot are of occasional showings of breaking bluefin and yellowfin but most boats have been focusing on fishing other areas. Another highlight is there are also pretty good numbers of jumbo-sized bluefin biting off the backside of San Clemente Island. These bluefin have gone to 300-plus pounds and anglers fishing this zone continue to have the chance of catching the fish of a lifetime. Finding spots of puddling fish, spots of breezing fish, sonar marks and meter marks are helping anglers find most of the jumbo-sized bluefin. Once located, the bluefin have been biting best on kite trolled Yummy Flyers and on flying fish that are fished from a kite while drifting or while slow trolling. Slow trolled mackerel, Flat Fall jigs and mackerel fished from a floating balloon have also been drawing some strikes. The fishing along the San Diego County coast continues to be good for a mix of

sand bass, calico bass, reds, rockfish and sculpin and there has also been a chance at catching a bonus yellowtail, lingcod or halibut. Calico bass continue to provide most of the surface fishing action with kelp bed areas up and down much of the San Diego County coast producing action. The more productive kelp bed areas for calicos have been the kelp at the upper end of La Jolla, the kelp bed areas between Solana Beach and South Carlsbad, the Barn Kelp, Yellowtail Kelp and the kelp off Box Canyon. The best zone for a chance at scratching out a yellowtail has been at the upper end of La Jolla. Capt. Joe Cacciola of Sea Star with Sea Star Sportfishing and the Oceanside Sea Center reported about some incredible calico bass fishing on a trip to the Barn Kelp and the Yellowtail Kelp areas above Oceanside. It was a Boys Club and Girls Club trip that was sponsored by the Oceanside Senior Anglers. Cacciola said it was a 100 percent catch-and-release trip and, in his 37-plus years of running trips out of Oceanside, it was the most calico bass one of his groups has ever caught in a single day of fishing. Cacciola reported the catch including catching and releasing 750-plus calico bass that day. The kids were tallying individual catch and release calico bass totals of numbers such as 83, 52, 49, and 36 calicos per person. It was an incredible day of calico bass fishing! The summer fishing season is providing anglers with opportunities for very good fishing that include a chance at catching a 300 pound class bluefin tuna out at San Clemente Island. Be it tuna offshore or calico bass and rockfish along the coast, an angler has a lot of fun options to consider in contemplating a day of fishing.
