Santa Barbara overhauls waterfront parking rules for annual permits The Santa Barbara City Council approved amending the municipal code pertaining to waterfront parking.

SANTA BARBARA — Annual parking permit holders to Santa Barbara waterfront parking lots will have to follow some new regulations. On Oct. 15, the Santa Barbara City Council voted to approve amendments to the Title 17 code related to harbor parking. The amendments were proposed by the Waterfront Department. Acting Waterfront Director Brian Bosse said the recommended changes are part of an effort to keep waterfront parking available to the public and to prevent waterfront parking spaces from becoming home to storage vehicles. “These are coastal spaces,” said City Council member Eric Friedman at the Oct. 8 Santa Barbara City Council meeting. “…They’re not for long term storage.” Those regulations impact annual general permit and slip permit holders. General permits cost $125 a year and previously allowed holders to park in Harbor Main for up to 72 hours. The slip permits are offered to boat owners with a slip in the harbor and cost $95

a year. The slip permits previously allowed holders to park indefinitely in Harbor Main. Under the changes, harbor slip permit holders will only be allowed to park in lots for 30 consecutive days, they will then be required to leave for 96 hours. However, if they leave at any point during the 30-day window, even for a short time, the clock starts over. The amendments also place stricter regulations on the size of vehicles that can park with either of the two annual permits, with some exceptions for Harbor Main for commercial operations. Vehicles with these permits

must be 22 feet or less in length, 90 inches or less in height and 82 inches or less in width. The changes also give the Waterfront Department the authority to deny parking permits if those permits would unduly interfere with coastal access or public parking. “The amendments will also ensure compliance with Local Coastal Program policies, increase public access to the coast, and provide slip permittees, locals, and visitors additional parking opportunities in all waterfront public parking lots,” Bosse wrote in a staff report on the recommended changes.

Bosse presented that staff report to the City Council on Oct. 8. He said parking has long been an issue that has gotten worse over the past five or so years. “We’ve had an increase in the popularity of the waterfront and the harbor,” Bosse said at the Oct. 8 meeting. “That’s resulted in an increase in pressure on limited parking resources and an increase in the number of complaints.” The department conducted a public workshop in June, which slip owners were invited to participate in, to figure out what is working, what needs to be fixed and what needs to be left alone. Many of the amendments grew out of the issues brought up at that workshop, as well as increased complaints about the number of vehicles that never move from the lot and are being used for storage. “This is possibly the biggest piece of policy work that the Waterfront Department has moved forward,” Santa Barbara Harbor Commissioner John Stedman said at the Oct. 8 meeting. A handful of community members spoke at the Oct. 8 meeting against the new parking amendments. The City Council voted 5-1 on Oct. 15 in favor of the amended municipal code. Council member Jason Dominguez cast the no vote. The changes take effect at the beginning of 2020.

Man grows 910-pound pumpkin, turns it into a boat 2C

CLEVELAND, Tennessee — Pumpkins – you can eat them, dress like them, decorate with them and turns out, even use them as a boat. A Tennessee man is wowing the internet with his one-man pumpkin regatta. Justin Ownby, a farmer from Cleveland, Tennessee, broke a personal record, growing a 910-pound pumpkin this year. After weighing it, he hallowed out that massive pumpkin, tossed it into a pond, climbed inside and took it for a spin. His wife, Christin, posted a video to Facebook showing her husband attempting to paddle around the pond inside the giant crop. The video has since

The Virginian-Pilot reports that fishing regulators have mandated an 18 percent reduction for recreational fishing. The new harvest cap would likely impact commercial fishing. The Atlantic States Marine Fisheries Commission’s Striped Bass Management Board adopted the changes at the end

Intersal found little loot when it located the shipwreck in 1996, but tens of thousands of artifacts have been recovered since then. The company says the state violated the contract by displaying media of artifacts from the ship on websites other than its own without a time code stamp or watermark. The state, meanwhile, has created a tourist industry around Blackbeard and his ship since the vessel’s discovery in 1996. That includes exhibits at the North Carolina Maritime Museum in Beaufort, which attracts about 300,000 visitors a year, according to the Queen Anne’s Revenge website. The artifacts, such as a 2,000-pound cannon, also go on tour to other state museums. The state also posts photos and videos on websites and social media sites. The opinion written by Justice Robin Hudson notes that the state didn’t argue to the Supreme Court that the 2013 agreement was invalid. And it refers to previous case law to note that the state can’t claim sovereign immunity when it has entered into a valid contract. The state argued that the plaintiffs had to exhaust administrative remedies before going to court, but the Supreme Court ruled that a specific administrative procedure isn’t part of every contract between the state and a private citizen. A spokeswoman for the state Department of Natural and Cultural Resources declined to comment.

Lobster boat rescues deer 5 miles from shore off Maine HARRINGTON, Maine—The crew aboard a lobster boat in Maine made an unexpected four-legged catch on Nov. 4. According to a Facebook post by the vessel’s captain, the crew spotted and rescued a deer found about five miles off the coast of the town of Harrington, drifting even further out to sea. “Found this little guy five miles offshore today drifting farther away from land,” Capt. Ren Dorr wrote in the post. “Couldn’t let the poor guy suffer and drown so we brought him aboard and sailed him half hour to land and dropped him off on the beach! And sailed back out to haul!” Photos accompanying the post showed the rescue as well as the deer huddling in a corner of the boat while being brought back to shore.

Northern Channel Islands Marine Protected Areas Join Growing Network of Global Ocean Refuges SANTA BARBARA—At the Ocean Conference in Oslo, Norway on Oct. 28, Marine Conservation Institute and its international science council recognized the Northern Channel Islands Marine Protected Areas off the coast of Santa Barbara, California as an outstanding marine protected area (MPA) with a Blue Park designation. A total of 16 MPAs now hold the prestigious Blue Park Award, indicating that they meet the highest science-based standards for marine life protection and management. This Blue Park Award recognizes outstanding efforts by state and federal managers including NOAA’s Office of National Marine Sanctuaries, the National Park Service, and the State of California Department of Fish and Wildlife – all of which collaborate with other important partners to protect the island’s marine ecosystem now and into the future. “Our goal is to recognize those MPAs like those around the northern Channel Islands that deliver real results for marine life conservation and inspire others around the world to strongly protect 30% of the ocean’s most important places by 2030,” said Dr. Lance Morgan, President of Marine Conservation Institute. “We hope that Blue Park recognition of the Northern Channel Islands MPAs provides a shining example of regional marine conservation efforts and inspires others to follow the same path to protect our oceans for generations to come.” Over 5,000 species of invertebrates, mammals like seals and sea lions, large, open-water fish, small schooling fish, and seabirds all live here. More environmental friendly paints are already available and have been for some time now. Divers should always use soft carpet in my opinion, but some don’t because they get return business more frequently as they wipe away your paint and cause barnacles to grow faster. Tom Rega

In this case, the storage burden would be shifted to marinas as opposed to an impound lot that would normally be used for cars. My hope would be that the marinas would be compensated appropriately. Tom Rega that is a very ignorant statement. First off, nobody uses soft carpet these days as there have been better commercially manufactured products that are not abrasive. Secondly, “environmentally friendly” paints have proven not to work in our waters after 10-11 months and barnacles, etc. can grow on painted surfaces in just 10-14 days on paint that is only months old. Regarding the “return business,” divers return regardless of your paint condition every month. It is in the divers’ best interests to preserve the paint, as it makes their job easier. Rohit NATIONWIDE—It’s rare for this take action column to focus on one bill in consecutive issues, especially when that legislative act is floating around the halls of Congress in Washington, D.C. Here we are, alas, rehashing

the Sport Fish Restoration and Recreational Boating Safety Act of 2019, two weeks after this take action column last presented the federal bill to our readers. Our last issue introduced the general concepts of the proposal: the Sport Fish Restoration and Recreational Boating Safety Act of 2019, if approved, would extend funding for boating infrastructure and fishing conservation through 2024. An interesting detail revealed itself after we published the Nov. 1-14 issue: the same bill proposing to maintain funding for boating infrastructure and fishing conservation would also help ensure money collected by boaters See STANDING WATCH page 10

Shasta Lake: House-Boating Capital of the World? By Parimal M. Rohit

SHASTA LAKE—Take a drive up the 5 Freeway and eventually you’ll cross Shasta Lake, wedged in between Redding and the Shasta-Trinity National Forest. The one thing you might notice whenever you visit the Northern California waterway: there are no shortages of houseboats. Shasta Lake is hailed as the “Houseboat Capital of World.” The Shasta Marina at Packers Bay website says there can be as many as 450 houseboats on the lake at any time. “Shasta Lake became a prime location for houseboat rentals, due to its massive size, magnificent shoreline, plentiful fishing, and numerous waterfalls and hiking opportunities,” the Shasta Marina website stated. Several other websites for marinas and harbors at Shasta Lake also refers to the inland waterway as the “Houseboat Capital of the World.” A San Francisco Chronicle article published in June also acknowledged a similarly ambitious marketing tagline. “Shasta Lake, the state’s largest man-made reservoir, is considered the houseboating capital of California,” Chronicle contributor Jill K. Robinson said in her June 7, 2019 travel story on the inland waterway in Shasta County. reservoir,” the marketing copy reads on the visitcalifornia.com website. “There’s plenty of room to move on this 30,000-acre/12,140-hectare reservoir, the largest in California. A typical summer day finds the crystal blue waters sprinkled with fishing boats, jet skis, inner tubes – almost anything that floats. Especially houseboats. Some Almost 370 miles of shoreline wrap around mirror-smooth coves ideal for anchoring.” But Shasta Lake doesn’t have a monopoly on the “Houseboat Capital of the World” title. Lake Cumberland in Kentucky also claims to be the ultimate destination for houseboats, according to Discover Boating. “Some would say Lake Cumberland is THE Houseboat Capital of the World,” according to an entry on Discover Boating’s website about houseboat vacation destinations. “It’s the largest lake by volume in the U.S. east of the Mississippi River, and boasts 1,200 miles of shoreline on three state parks and the Daniel Boone National Forest.” The website did acknowledge Shasta Lake also claims to be the top destination for houseboats. “Just like fans of Lake Cumberland, Lake Shasta enthusiasts also claim it to be the ‘Houseboating Capital of the World,’” the Discover Boating website stated. The “Houseboat Capital” tagline is certainly a public relations tool more than anything else – and, perhaps, would remind some folks in California of the battle of two cities – Huntington Beach and Santa Cruz – claiming to be “Surf City USA.”

Lease terms for Marina del Rey’s Fisherman’s Village could be amended What Happened: The L.A. Small Craft Harbor Commission unanimously recommended a proposed lease amendment for the Fisherman’s Village parcel in Marina del Rey to be approved by the county’s Board of Supervisors, Oct. 30. Rent rates would be retroactively applied to Sept. 1, 2017, according to county staff. What’s On Tap: The new annual rent payable from Fisherman’s Village tenants to the county would be $510,814.92, or $42,567.91 per month. The commission’s recommendation includes the following additions or adjustments: • 10 percent for bicycle rentals (new income category) • 6 percent for commercial boating activities (adjustment from 4.5 percent rate) • 20 percent for dry storage income (adjustment from 10 percent) • 10.5 percent for fees on occupancy of structures other than apartments or offices (adjustment from 7.5 percent) • 12 percent collection on gross receipts or other fees for office occupancy (adjustment from 11 percent) • 4 percent collection on gross receipts for retail shops/stores (adjustment from 1.5 percent). There were no other proposed changes in other rental categories. “[The proposed lease amendment] would result in an increase in the annual minimum rent from $336,324 to $510,814.92, an increase of $174,490.92 based on 75 percent of the total average annual rent payable by the lessee to the county over the three years preceding Sept. 1, 2017,” county staff stated in a report to commissioners. “[The proposed lease amendment] would result in an increase in the total annual leasehold rent of approximately $52,000 as a result of the adjusted percentage rent.” County staff anticipates receiving a retroactive payment of $133,000 from the Fisherman’s Village parcel once the amendment is in effect. The recommended amendment proposal heads to the L.A. County Board of Supervisors for approval or rejection.

BoatUS acknowledges the boating infrastructure and fishing conservation proposal as a vital source of funding for the personal watercraft world. “The explosive growth of paddlesports including stand-up paddleboarding, kayaking and canoeing has local, state and federal governments working to ensure there’s plenty of paddler access, including paddlecraft-only launches that make it easy to launch a kayak, increasing efforts to ensure paddler safety, and minimizing user conflicts with traditional boaters. The question is, who pays for it,” BoatUS asked in its published statement on the federal bill, which is still making its way through Congress. “Under a nearly seven-decade-old federal funding mechanism, the answer is recreational power, sail, and fishing boat owners,” the BoatUS statement continued. The BoatUS answer to its own question raises another question: are kayakers, standup paddleboard users and others in the personal watercraft space making financial contributions to the federal fund backing these dedicated launch ramp initiatives and on-the-water safety programs? Or are the recreational power, sail and fishing boat owners carrying the load for everyone?

House of Representatives approve $34 billion for harbor trust fund Bipartisan bill, if approved by Senate and White House, would ensure federal funds are appropriated for dredging projects. By Parimal M. Rohit WASHINGTON, D.C.—Harbors and ports across the United States could be receiving an infusion of cash – $34 billion, to be exact – during the next 10 years, and Congress won’t have to raise taxes to redirect federal funds to our coastal infrastructure. House Resolution 2440 (H.R. 2440) made it out of the House of Representatives in late October; the bill, which proposes to direct $34 billion from the federal Harbor Maintenance Trust Fund toward harbor and port maintenance through 2029, now moves to the U.S. Senate for consideration. The House Committee on Transportation stated H.R. 2440 would make it easier to appropriate funds for harbor and port maintenance projects. The Harbor Maintenance Trust Fund already has $9.3 billion in revenues idly sitting in its coffers, according to the National Marine Manufacturers Association (NMMA); another $24.5 billion would be collected by the trust fund before 2030, an NMMA statement on H.R. 2440 said. Only $19.4 billion of the revenues would be spent on harbor maintenance through 2029, the official NMMA statement continued – leaving the Harbor Maintenance Trust Fund with a balance of about $14.4 billion at the end of the next decade. H.R. 2440, if passed by the Senate and signed into law by Pres. Donald J. Trump, would achieve two things: ensure the $24.5 billion the trust fund expects to collect during the next 10 years is spent on federal harbor maintenance; and, authorize an appropriation for additional harbor maintenance from the fund’s existing $9.3 billion. “Full utilization of the fund would provide the necessary funding to enable the U.S. Army Corps of Engineers to dredge all federal har-

bors to their constructed widths and depths,” NMMA staff said in a released statement about H.R. 2440. “Properly dredged channels are essential to providing critical access points for marinas and coastal communities where businesses depend on marine recreation-based economic activity. Additionally, without sufficient dredging in small recreation-based ports, some recreational boaters are forced to use high traffic commercial channels, which can lead to potential user conflicts and safety concerns.” Congress enacted a “Harbor Maintenance Tax” in 1986; the levy, according to an H.R. 2440 fact sheet published by the House Committee on Transportation and Infrastructure, would help fund the operation and maintenance of dredging costs. The 0.125 percent tax is assessed upon imported cargo coming into coastal and inland ports. Tax revenues are deposited into the Harbor Maintenance Trust Fund, which is managed by the U.S. Treasury. Congress appropriates money from the trust fund to the U.S. Army Corps of Engineers for dredging projects. “Unfortunately, what is collected and what is spent on harbor maintenance is not the same,” the H.R. 2440 fact sheet stated. “According to the Corps, navigation channels at our Nation’s busiest 59 ports are available less than 35 percent of the time – and the conditions of our midsize and emerging harbors are far worse,” the H.R. 2440 fact sheet continued. “The American Society of Civil Engineers estimates that our nation’s ports and harbors will need additional investment of $15.8 billion between now and 2020 just to meet the demands of larger and heavier ships that will use the Panama Canal.” The “Full Utilization of the Harbor Maintenance Trust Fund Act,” as H.R. 2440 is called, passed out of the House by a 296-109 vote. H.R. 2440 was co-sponsored by House Transportation Committee chair Peter A. DeFazio, R-Oregon, ranking member Sam Graves, R-Missouri, and 20 other representatives.

Mike Galvin, the director of waterfront and commercial real estate at the Port of Los Angeles, gave a project update at the Oct. 3 L.A. Board of Port Commissioners meeting. He said the Wilmington Waterfront Promenade, which is the next project the port will start, has had some slippage on the schedule due to some design modifications to improve safety and access, specifically the stairway to the water’s edge. “Looking at some different issues there to make sure everything is accessible and also that it is safe to access at the edge where the stairway goes into the water,” Galvin said at the Oct. 3 meeting. Fishing lines are not biodegradable, and when left in the environment, it poses a serious hazard to wildlife, which can become entangled and suffer severe injury such as loss of limbs or even death from gangrenous infection or strangulation. Fishing line discarded in our waterways is a safety issue due to the risk of fouling boat propellers, especially around boat ramps and fishing areas. Even when we dump the line into trash bins, it still creates hazards for wildlife around landfills. Existing recycling containers provide one solution to properly discard of used line. Some students choose to go straight into the industry and others transfer to four-year maritime academies. Avery noted because OCC School of Sailing and Seamanship is a community college, they are able to serve a wide range of students and provide tuition cost assistance to those who need it. The state provides a program called Board of Governors Fee Waiver (BOGW), which waives enrollment fees for qualifying students at California Community Colleges. OCC of Sailing and Seamanship also offers scholarships for books and other program-related costs. Avery said the Professional Mariner Program currently has about 50 students. The state’s Department of Water Resources is urging all Californians to prepare for winter storms and the possibility of flooding. By Lindsey Glasgow

SACRAMENTO—Living in Southern California, where barely a drop of rain has been felt in the past several months, it can be easy to forget that winter is coming. It’s unclear how much rain the season will bring to the region, but the California Department of Water Resources (DWR) is urging Californians to be proactive and prepare for possible flooding as the winter storm season quickly approaches. The combination of storms and tides can create the risk for coastal flooding for those who live on or near the water. Last winter, the combination of winter storms and king tides prompted many flash flood warnings, record rainfall and some coastal damage. California’s rainy season, according to DWR, usually lasts from November to April. This is when the chance of heavy flooding and flash floods is greatest. The National Oceanic and Atmospheric Association’s (NOAA) 2019 winter precipitation outlook gives Southern California equal chances of below, near or above average precipitation. Lt. Erik Engebretson, the interim Santa Barbara Harbor operations manager and Santa Barbara Harbor Patrol supervisor, said it doesn’t take much wind or rain to cause major problems, including damaging or sinking an unattended boat. He said there are several things boaters can do to stormproof their boats: • Monitor weather reports and visit your boat before the next storm or find a responsible person who can • Visually inspect dock lines for chafe, wear and trip hazards (don’t run mooring lines across fingers), tie lines securely to cleats or pilings; consider chafing gear and doubling-up lines • Don’t store skiffs or other items on the dock • Test your bilge pump to ensure that it’s working; float switches properly activate the pumps and float switches aren’t hindered by debris, be sure limber holes aren’t blocked, close seacocks and check propeller and rudder shafts • Have an adequate number of appropriate-sized fenders • Store or tightly secure sails, rigging, tarps and any loose gear on deck • Close and secure hatches, ports and windows • And consider removing valuables and electronics, installing a dehumidifier or moisture absorber, propping up cushions and opening the boat during periods of fair weather to circulate air.

LONG BEACH—What was once an uninhibited motel on a piece of prime real estate on Pacific Coast Highway in Long Beach now a new two-story shopping center. A ribbon cutting ceremony was held on Oct. 24 for 2nd & PCH. The center will be home to about 60 businesses and Property General Manager Samantha Lopez said they are about 75 percent leased. She anticipates being at 100 percent by summer of next year. Stores such as Whole Foods, the first Long Beach Shake Shack, Lululemon and Hawt Yoga are open for business, but many others, including several fitness studios, about a dozen other restaurants and several retail stores, have only signs with their names foreshadowing their opening. “We’re really trying to keep that announcement momentum going,” Lopez said. The site was previously the SeaPort Marina Hotel, whose doors closed in February 2017. The location on the corner of 2nd Street and PCH is walking distance from Alamitos Bay Marina and the shopping center is described on its website as “a coastal contemporary retail and restaurant destination inspired by the neighboring marina.” Lopez said visitors have come from all over, including Los Angeles and the neighboring marina. “I see a lot of Los Alamitos consumer coming over,” Lopez said. One thing creating a buzz at the center: the arrival of celebrity chefs Mary Sue Milliken and Susan Feniger, who opened Pacha Mamas. Lopez said Feniger has been spotted at the restaurant, calling out orders. The duo has a second restaurant, Border BBQ, also at 2nd & PCH. They are opening a third, Twist, which will be a dessert shop with churros, soft serve and other sweets. “We wanted to think about every consumer and how they can each come here and spend time here and dine here and shop here and have an experience from it as well,” Lopez said. Lopez said they wanted to add to that experience in every detail, by providing plenty of general outdoor seating, which includes swinging chairs, wall art both in and outside of stores and landscaping, including olive trees. The center is also going to have several second floor restaurants with outdoor seating and marina views. “Thinking about the consumer experience has been a really huge part of what we are doing,” Lopez said. Marina expressed concern at a May meeting at Long Beach Yacht Club; they said the center would increase parking issues in the already busy area. Lopez said the center has 1,100 parking spaces in two parking structures on either end of the center. In a statement on the Long Beach Economic Development website, the department wrote on Oct. 29 that no complaints or serious incidents related to parking were reported throughout the grand opening weekend of the retail center. Catalina Connection Catalina spreading island style holiday cheer AVALON — If the most wonderful time of the year has you itching for a getaway from the mainland madness, Catalina Island will get you in the holiday spirit with a slew of upcoming events. On Dec. 5, visitors will be invited inside the Inn at Mt. Ada, the former Wrigley Family mansion, during the holiday open house. The open house runs from 2-6 p.m. and tickets cost $5. Cookies, drinks, music and Santa Claus will also be part of the festivities. Taxis will run continuously from the Tour Plaza to Mt. Ada from 1:45-6:30 p.m. Rides cost $2 each way. SAN DIEGO—Efforts to clean up the “plastic vortex”, a gyre of marine debris particles in the north central Pacific Ocean, will be the topic of a presentation at the Maritime Museum of San Diego on Nov. 22. Mary Crowley, the founder of Sausalito-based Ocean Voyages Institute (OVI), will be speaking on the non-profit organization’s efforts in that cleanup. Those efforts include a 25-day mission this past June where more than 42 tons of fishing nets and consumer plastics were removed from the Pacific Gyre, which sits where four ocean currents meet between California and Hawaii. OVI was founded in 1979 by a group of international sailors, educators, and conservationists with a mission of teaching maritime arts and sciences and preserving the world’s oceans. OVI launched a project in 2009 to focus on major ocean clean up and to raise awareness of the global problem of marine debris. The Port of San Diego and the San Diego Port Tenants Association are partnering with the Maritime Museum of San Diego for the special event. Yacht designer Ron Holland will also join the discussion; he is an avid supporter and par-

LONG BEACH—Alamitos Bay Yacht Club will be spending the final weekend before Thanksgiving hosting the Turkey Day Regatta and competitions for other One-Design classes. Also included in the weekend of racing are Southern California Youth Yacht Racing Association (SCYYRA) Hamlin and Ullman/Frost Series, and 29er and I420 Pacific Coast Championship. The regatta event will be held in Long Beach, Nov. 23-24. The following ocean course OneDesign classes are slated to compete at the Turkey Day Regatta (and other competitions): 29er, 5-0-5, A-Cat, C420, Cal 20, Etchells, Finn, Formula 19, Hobie 16, I420, Laser Standard, Laser Radial, Laser 4.7, Mercury 18, Optimist, PHRF, Portsmouth (monohull and multihull), Snipe, Thistle and Viper 640. Bay course classes will also compete in the Alamitos Bay YC regatta weekend. The classes competing here are Naples Sabot (Senior; Junior A, B, C1, C2 and C3), Optimist (Green), Open Bic (Bay) and RS Tera (Bay). Alamitos Bay YC will be accepting online entries for the race through Nov. 15. In-person entries will also be accepted; those seeking to enter last minute can do so on at 9:30 a.m. on Nov. 23. Five pride entries are required to establish a class.

Entry fees for the regatta weekend are as follows: $60 for Bay Classes, singlehanded; $75 for all other Bay Classes; $70 for Oceans Classes, singlehanded; and, $85 for all other Ocean Classes. U.S. Sailing members are entitled to a $3 discount on fees; juniors younger than 18 years old can receive a $5 discount on fees. Regatta fees include Alamitos Bay YC’s traditional Turkey Day dinner on Nov. 23, launching, recovery and storage for visiting (and competing) boats. Registration for the regatta begins at 8 a.m. on Nov. 23. A competitor’s meeting will be held for all classes at

the Alamitos Bay YC patio on Nov. 23 at 10:30 a.m. Nine races are scheduled for Bay Classes and Optimist Gold, with no more than five races on any one day. Ocean Classes have six races scheduled, with no more than three races held on any one day. The first warning signal will be at 11:57 a.m. on each day of racing. No warning signal will be made after 3 p.m. on the final day of racing. Bay Class races will take place inside Alamitos Bay, while Ocean Class races will be held at Long Beach’s Outer Harbor. Prizes will be awarded as follows:

one trophy for classes with five boats competing; two trophies for classes with six to eight boats; three trophies for classes with nine to 11 boats; four trophies for classes with 12 to 14 boats; and, five trophies for classes with 15 or more boats. The Arkie Hauck Cal 20 Perpetual Trophy will be up for grabs in the Cal 20 class. Sailors will also be competing for the Neil Dundas Daily First Perpetual Trophy, which is presented to any Alamitos Bay YC member winning a race at a holiday regatta but otherwise not winning a trophy. Two Southern California yacht clubs recognized on Top 50 list Platinum Clubs organization names Newport Harbor YC and San Diego YC to worldwide compilation. By Parimal M. Rohit SOUTHERN CALIFORNIA—Newport Harbor and San Diego yacht clubs both earned a spot on the Top 50 Platinum Yacht Clubs for 2020-2021, it was recently announced. The worldwide list is compiled by Platinum Clubs of the World. Placing on the list means a yacht club is presented with the title of “Five Star Clubs of Excellence.” San Diego YC was founded in

1886 and has recently hosted sailing events such as Women’s Winter Invitational, Yachting Cup, the CA500, the SoCal 300, Dutch Shoe Marathon, International Masters Regatta and Lipton Cup. Newport Harbor YC first opened its doors in 1916 and hosts the Newport to Cabo Race every two years, among other regattas. Other yacht clubs making the Top 50 list included: Annapolis Yacht Club, Beach Point Club, Chicago Yacht Club, Cruising Yacht Club of Australia, Nassau Yacht Club (Bahamas), Raffles Marina (Singapore), Real Club Nautico de Vigo (Spain), Royal Bombay Yacht Club (India), Royal Cork Yacht Club (Ireland), The Royal Prince Alfred Yacht

Club (Australia), Société des Régates du Havre (France), Yacht Club de Monaco and Yacht Club Santo Amaro (Brazil). VENTURA—Sailboat racers are invited to compete in Ventura Sailing Club’s 15th annual Wild Turkey Classic Plastic, which takes place in Ventura on Nov. 30 - the Saturday after Thanksgiving. The pursuit race is open to all boaters; boats with PHRF certificates will receive high points for the championship. Only boats older than 1999 are eligible for the Classic Plastic Perpetual Trophy. Classes competing in the regatta are as follows: PHRF handicapped 60s, 70s and 80s non-spinnaker; spinnaker, post 96 feet monohulls, beachcats and ORCAs will determined on an as-needed basis prior to the race. Racers do not have to belong to a yacht club to compete in the Wild Turkey Classic Plastic. The entry fee is $20 for Ventura Sailing Club and $30 for non-members. U.S. Sailing Association members receive a $5 discount. The racing course begins just outside the northern entrance of Channel Islands Harbor. The random leg course is about 15 miles in length and will be chosen on race day (depending upon conditions).

SailGP launches program to help young sailors experience foiling a boat SYDNEY (LOG NEWS SERVICE)— Olympic gold medalist and SailGP Season 1 champion Tom Slingsby has helped launch an innovative new program that aims to create a pathway into high-performance sail racing. The new initiative is part of SailGP Inspire — the global racing league’s youth and community outreach arm. The newly launched program will use the new WASZP flying dinghies at SailGP events in Season 2 to help bridge the gap between youth sailing programs and professional pathways. “This is a fantastic opportunity for young sailors to get experience on foiling boats and learn about the technology – something that is inaccessible for many young people and what we want to change with this program,” Slingsby said The SailGP Inspire program, which will take place at a number of SailGP events in Season 2, is geared towards young competitive sailors with an interest in learning to foil. Successful candidates will be invited to a high-performance camp with access to expertise from coaches and SailGP team members before

getting the chance to race on the same waters as the SailGP F50s in front of cheering crowds – inspiring them to become the SailGP athletes of the future. To accelerate the young sailors’ development, the winner from each event will be awarded a WASZP foiling sailboat and each season a boy and a girl will also be selected to compete in the WASZP Games to offer further racing experience. A selection panel will decide the final 16 sailors, comprising of a 50/50 gender split, that will join the program in Sydney and San Francisco. Applications for the SailGP Inspire Racing events in Sydney and San Francisco are now open for sailors aged 20 or under at the time of the event and candidates for either of the two events can apply online at www.SailGP.com/ general/Inspire. Applications for the Sydney event will close Jan. 5, and successful candidates will be notified at the end of January. The captain summed it up himself: “We landed 38 fish, 18 bluefin with 4 fish at, or just over 100 pounds, the rest were 45-60#. The yellowfin were 25-55#. After our 7-hour drift we were unable to find another school, but we were stoked with our end results.”

Rohit CABO SAN LUCAS, Mexico—The 39th annual Bisbee’s Black and Blue Tournament wrapped up on the final weekend of October with a record amount of payouts – and quite the large catch to take first place honors in the tournament. Angler Bill Pino of Squidnation made headlines with his 577-pound blue marlin catch, which he reeled aboard Tranquilo after a 44-minute fight. The catch resulted in a $1,411,375 payout for Tranquilo. This year’s tournament was also the first time it featured three consecutive days of $1.3 million (or more) payouts. Pino caught his 577-pounder on day three of the tournament; more than $3 million in payouts were made during the first two days, preceding the Tranquilo win. Paul Beaullieu headlined the first day of fishing with his 466-pound black

marlin, which was caught aboard Wild Hooker. The marlin was reportedly valued at $1,751,462. Wild Hooker edged out Tranquilo in total winnings as the former’s catch included the Chupacabra jackpot. The second day of fishing was highlighted by Jim Putnam, who caught a 498pound black marlin aboard True Grit. The catch was worth $1,296,062 in prize money and jackpots. Recreational Dungeness crab season opened amidst health advisory STATEWIDE—The California Dungeness crab season opened on Nov. 2, but not without a health advisory warning issued by the state’s Department of Public Health. Anglers are advised by Public Health staff to avoid consumption of the viscera (guts) of crab due to domoic acid. The advisory applies to anglers catching Dungeness crab in two specific areas: Shelter Cove in Humboldt County (40° 01.00′ N. Lat.), south to Point Arena in Mendocino County (38° 57.50′ N. Lat.); and, from Point Reyes in Marin County (38 ° 00.00′ N. Lat.), south to Pillar Point in San Mateo County (37° 30.00′ N. Lat.). “Domoic acid is a potent neurotoxin produced by a

naturally occurring marine diatom (algae). Under certain ocean conditions large blooms of these diatoms occur and then accumulate in Dungeness crab,” California’s Department of Fish and Wildlife (CDFW) staff said in a released statement about the health advisory. “At low levels, domoic acid exposure can cause nausea, diarrhea and dizziness in humans. At higher levels, it can cause persistent short-term memory loss, seizures and death.” The Dungeness crab season itself kicked off at 12:01 a.m., Nov. 2. The daily bag and possession limit for anglers is 10 crabs at 5.75 inches or larger in width, “as measured by the shortest distance through the body from edge of shell to edge of shell directly in front of and excluding the points (lateral spines),” according to CDFW staff.

Anglers are permitted to catch Dungeness crab with crab loop traps (snares), crab traps or hoop nets. Skin and scuba divers may catch crabs with their hands, only. Crab trap buoys must display the owner’s “GO ID” number, which is assigned by the Automated License Data System. The trap must contain at least one destruct device, according to CDFW staff. “When using another person’s trap, written permission, including permission transmitted electronically (i.e. email or text), from the owner of the trap must contain the GO ID number that matches the GO ID on the buoy and must be in the operator’s possession in order to operate the trap,” CDFW staff added in a released statement.

OXNARD—More than three-dozen anglers boarded a boat in Oxnard and headed out to sea for a day of fishing at Santa Rosa Island Nov. 3. Those 38 anglers aboard a sportfishing vessel out of Stardust Sportfishing in Oxnard came back home with high quality fish: 230 rockfish, 150 red rockfish and six lingcod. “What an amazing day for weather at Santa Rosa Island! The boat is headed home after fishing out here all day, and the crew is filleting boat limits of rockfish! Constant action all day on quality fish,� Stardust Sportfishing staff said on its Facebook post about the Nov. 3 fishing expedition. A fishing trip on Nov. 2 came back home with 190 rockfish and 13 lingcod for 19 anglers.

Letter to the Editor: Newport Landing Sportfishing responds to litigation coverage Despite almost a decade of litigation, Long Beach whalewatching company wins $0 in damages, $0 in attorneys’ fees and $0 is disgorgement of profits from its Newport Beach competitors. Plantiffs Harbor Breeze Corporation and LA Waterfront Cruises LLC ‌ for the third time in almost ten years, sued their competitors, Newport Landing Sportfishing Inc. and Davey’s Locker Sportfishing Inc. (and in this last lawsuit, added Ocean Explorer Inc and Freelance Sportfishing Inc.) for false and misleading advertising. After bringing a failed contempt proceeding against Newport Landing in 2014 in state court, Harbor Breeze filed a new lawsuit in September 2017 in federal court. Harbor Breeze’s initial attempt essentially to shut down Newport Landing with an injunction failed; and the case proceeded to discovery and trial. Harbor Breeze, estimating its damages to be in excess of $15 million, spent over $2 million on attorneys’ fees, expert witnesses and other legal costs in the two years this litigation played out. However, after five days, a Los Angeles jury was unpersuaded, and it awarded Harbor Breeze $0 in damages and $0 in disgorgement profits. Harbor Breeze then petitioned the federal judge for a review of the jury’s award, and additionally, sought $1.5 million in attorneys’ fees. All of Harbor Breeze’s post-trial motions were denied. The only thing Harbor Breeze received after an almost two-year legal battle and spending millions of dollars, was a very limited injunction (similar to the one already in place from the 2011 state court action) that requires Newport Landing to include language in its own advertisements that “all cruises depart from

Bluefin and yellowfin providing epic offshore action By Bob Vanian SAN DIEGO—It will be the middle of November by the time you might first be reading this and it looks like the 2019 offshore fishing season is going to last a while longer as the fishing for yellowfin is as good as it has been all season. There are still bluefin and kelp paddie yellowtail biting as well. I was listening to the VHF radio this morning prior to preparing this report and it was one private boater after another talking about catching their limits of yellowfin. The yellowfin fishing on sportboats has been equally good and has been reaching near limit to limit numbers of yellowfin on a lot of trips in recent days as well. In addition to the great yellowfin fishing there has been a mix of bluefin, kelp paddie yellowtail and skipjack in recent catches as well. There are two main areas of yellowfin activity right now with the region between the 9 Mile Bank and the 224 Spot at the Kidney Bank being a productive zone for boats fishing from 18 to 30 miles 230 to 240 degrees from Point Loma. The other hotspot area is the Butterfly Bank and the 390 Bank that are producing lots of yellowfin and some pretty good numbers of bluefin. Most of the yellowfin by the 9 Mile Bank and 224 Spot are running from 15 to 25 pounds and most of the yellowfin out by the Butterfly Bank and 390 Bank have been in the 20- to 40-pound range. Most of the bluefin out by the Butterfly Bank and 390 Bank have been in the 40- to 60-pound range with occasional larger fish entering the picture that have ranged to 300-plus pounds. Private boater Tom Golding of Last Buck reported catching limits of yellowfin tuna while fishing a recent trip to the Butterfly Bank. Golding’s limit catch for the three anglers aboard came from a single 3.5-hour stop that he found from stopping on a meter mark and chumming. The yellowfin stop was so good that before leaving to head for home, they turned the stop over to a sportboat that accepted their invitation to take over the stop and came over and started catching yellowfin right away. Golding said the yellowfin were not shy about biting their sardines. They started out using 30-pound test fluorocarbon leaders on 30 pound test line but once the fish

got going they were able to tie their hooks straight to 60-pound test monofilament and get bit right away. Their yellowfin were running from 25 to 40 pounds and they found the hot action in 65.67-degree water while fishing to the south-southeast of the eastern wing tip of the Butterfly Bank at 51 miles 223 degrees from Point Loma. Private boater Capt. Bob Fletcher of Fletch reported about fishing the Butterfly Bank aboard a recent 1.5-day trip aboard Pacific Queen out of Fisherman’s Landing. Fletcher said they had a great trip with 33 anglers catching 125 yellowfin tuna and 58 bluefin tuna. Fletcher described it as being “one amazing day of fishing” and said the quality size of the fish they were catching was outstanding. Most of their yellowfin tuna were in the 20- to 40-pound range and their bluefin tuna were up in the 40- to 50pound class. Fletcher said his biggest fish on the day was a bluefin that was up in the 45- to 50-pound range. Private boater Marcus Hale of Cabrilla reported about fishing a recent trip to the Butterfly Bank and he reported finding good fishing for a mix of bluefin, yellowfin and yellowtail. They caught two bluefin in the 50- to 60-pound class, two yellowfin in the 30- to 40-pound range and a bunch yellowtail from a kelp paddie. Hale reported finding the action while fishing about 5 miles southeast of the southern wing tip of the Butterfly Bank which has you down at 55 miles 222 degrees from Point Loma. The fishing for jumbo sized bluefin tuna to 300-plus pounds off the back side of San Clemente Island had been holding up pretty steady but the bite did drop off and turn scratchy over the past weekend. What was good off the back side of San Clemente Island over the past weekend was the fishing for 35- to 40-pound yellowfin tuna and a few of the 60-pound bluefin tuna that were biting for some boats fishing the region between Desperation Reef and the 81 Fathom Spot. There are still some of the jumbo sized bluefin around and the region of the 381 Spot and the area to the west and southwest of the 57 Fathom Spot are two zones where there has been some jumbo sized bluefin tuna activity reported in recent days. The jumbo sized bluefin off the back side of San Clemente Island have been biting best on

kite fished flying fish or helium balloon fished flying fish. The yellowfin and the 60 pound sized bluefin that have been biting in the Desperation Reef and 81 Fathom Spot sector over the past couple of days have been biting well on sardines and mackerel. There are still some bluefin and yellowfin in the Catalina region but it is often times difficult to get them to bite. Skippers report seeing spots of breaking tuna while fishing around the eastern part of the Island while working off the Slide, the 152 Spot and the 277 Spot. At times there has also been tuna activity found while working 2 to 4 miles off the back side of the Island ranging from being outside of Church Rock on up to the Farnsworth Bank. Several days ago there was a report of a boat that was fishing while anchored at the Farnsworth Bank that caught several yellowtail, a couple of bluefin tuna and hooked and lost 2 marlin. There are also some kelp paddie yellowtail in the Catalina region with a weekend report of kelp paddies found between the 277 Spot and the 289 Spot holding biting yellowtail. Marlin activity has been slow with marlin encounters being widely scattered and inconsistent. Areas producing occasional marlin activity have been the Farnsworth Bank, the 152 Spot, the 277 Spot, the Slide, the upper end of the 9 Mile Bank and the 178 Spot. Deep drop fishing for swordfish continues to produce occasional action with my estimate being that there were two or three swordfish that were caught over the past weekend. Productive areas for the deep drop swordfish fishing have been the 152 Spot, 277 Spot, the Slide, the upper end of the 9 Mile Bank and the 178 Spot. There were a couple of recent reports from Los Coronado Islands and the reports were of good fishing for rockfish along with a chance at getting into some bonito action. Good spots to try for bonito would be the Rockpile and the weather side of North Island. Productive bottom fishing areas have been at the South Kelp Ridge while fishing in 25 to 40 fathoms of water and at the hard bottom areas to the north, the northwest and the northeast of North Island while fishing in 20 to 45 fathoms of water. The fishing along the San Diego County coast continues to be good for a mix of sand

bass, calico bass, reds, rockfish, whitefish and sculpin and there has also been a chance at catching a bonus bonito, lingcod, halibut or yellowtail. The best zone for a chance at scratching out a yellowtail along the coast has been at the upper end of La Jolla but the yellowtail fishing remains slow. Calico bass are still biting at kelp bed areas up and down much of the San Diego County coast but a lot of Skippers have been focusing on fishing for rockfish. Some of the more productive areas for calicos have been the Point Loma Kelp Beds, the kelp at the upper end of La Jolla, the kelp bed areas between Solana Beach and South Carlsbad, the Barn Kelp, Yellowtail Kelp and the kelp off Box Canyon. In addition to the kelp bed areas, hard bottom and structure spots have also been producing some bass and sculpin with productive places being the Imperial Beach Pipeline, hard bottom spots between the Imperial Beach Pipeline and the Mexico border, the hard bottom to the north and northwest of Buoy #3 at Point Loma, the Green Tank, the upper end of La Jolla, Del Mar, the Anderson and Buccaneer Pipelines, the artificial reefs outside of Oceanside and Box Canyon. Rockfish are getting a lot more attention as the seasons change and the water continues to cool. There have been recent reports of good rockfish catches coming from hard bottom areas around the International Reef, the Imperial Beach Pipeline, the Whistler Buoy at Point Loma, the Point Loma Pipeline, the Green Tank at Point Loma, the upper end of La Jolla, Torrey Pines, Del Mar and Box Canyon. We are well into the month of November and the 2019 tuna season is still going strong. Do not make the mistake of putting your tackle away for the winter too early as the tuna should stay around as long as the water conditions remain favorable and there is food for them to eat. If northern and western weather systems steer clear of Southern California for a while longer, I would expect the tuna to stay around for a while.
